RZN 26-012 requested zone district change from RR-1 to F-1 Request: Pcnnit desired for a sand & gravel {non-metallic mineral) extraction and processing operations including a rock crusher. Non-metallic mineral operations are an allowed with a conditional use pennit in the Forestry One (F-1). Operations would be an expansion of current existing mining on adjacent parcels, providing needed aggregate resources. Application is being submitted concurrently with a rezone application to rczonc the identified parcels from Residential/Recreational One {RR-1) to Forestry One (F-1) in order to support this application request. Total mine site to include 61.58 acres from total 80 acre parcels. Per Sawyer County Code of Ordinance-Appendix D-Scction 17.8(B) (8) & Section 6.2 Project History & Summary of Request This request of CUP 26-021 is for the location of a non-metallic mineral extraction operation including a rock crusher. Previously the public hearing for RZN 26-012 was for having the property rezoned to a district that would allow for this type of use with a CUP. Also, the previously held public hearing for CUP 26-021 would have been only for potential approval of the reclamation plan per NR 135. The property is approximately 80 acres in total and would in essence combine with the other existing Todd's Rcdi-Mix Pits to (he South. This would still be viewed as 2 separate pits but as per the applicant's statement, it would eliminate the need to have additional material hauled into the existing pit/plant which would eliminate additional truck traffic and fuel cost. The actual mine site for this property would be roughly 61.58 acres and would exclude the areas to the north, cast, and west that would be sloped inward and internally drained as well as a 50' Page 35 of 200 wide buffering of trees per applicants' operation plan. This 61.58 acre mine site would also exclude a no disturbance area for an internally located wetland complex on the property. Additional information regarding the plan of operations is included within this packet. As per conditions of an approved reclamation plan financial assurance no less than $1500 per acre is required. The applicant must provide payment of assurance prior to any excavation. It should be noted that the Sawyer County Zoning & Conservation Department does plan to increase the financial assurance amounts in the future and additional financial assurance amounts may be required. The specified hours of operation are 6 AM to 6 PM, Monday - Saturday normally during the construction season of March - November reduced hours may be needed during the other months due to supply. These hours would for the proposed "Inerchan & Walport Pit" with other general quiet maintenance outside of permitted hours. Additional information for Conditional Use Permits: Substantial evidence means facts and information, other than merely personal preferences or speculation, directly pertaining to the requirements and conditions an applicant must meet to obtain a conditional use permit and that reasonable persons would accept in support of a conclusion. If an applicant agrees to meets all of the requirements and conditions specified in the county ordinance or those imposed by the county zoning board, the county shall grant the conditional use permit. Any condition imposed must be related to the purpose of the ordinance and be based on substantial evidence. The conditions must be reasonable and, to the extent practicable, measurable. The applicant must demonstrate that the application and all requirements and conditions established by the county relating to the conditional use are or shall be satisfied, both of which must be supported by substantial evidence. The county's decision to approve or deny the permit must be supported by substantial evidence. Possible Conditions for Approval: (choose from list below) (add or delete from list below) 1 Obtain approval or conditional approval of reclamation plan per NR 135 2 Final ratification of the zone district change by County Board 3 Abide by specified Plan of Operation including hours of operation and pit access location from the South only. No access off Leos Road. Crushing to occur during specified hours of operation (Zoning Committee may want to set an annual duration amount on crushing) 4 Maintain compliance with Department of Natural Resources Chapter 30 5 Comply with all other federal, state, and local regulations 6 A Fire # or Site Address is required for this property 7 CUP goes with the property. If property changes hand before renewal the new owner must complete a "Non-Metallic Mine Transfer Form" with Sawyer County to acknowledge compliance of current plan of operation, conditions, and reclamation plan. The CUP request is dependent on the action taken upon the concurrent request for a Rezone for 80 acres from Residential/Recreation One (RR-1) to Forestry One (F-1), of those subject parcels. Nonmetallic mineral operations are an allowed conditional use within the F-1 district Todd's proposes to excavate and process sand and gravel from the Inerchan and Walport Pits, including a rock crusher, according to the enclosed operations plan. The operations plan describes the progressive extraction of sand and gravel materials with the reclamation of excavated areas. In order to permit the extraction of sand and gravel and processing from the two properties, a rezone of the properties from RRl to F1 and a Conditional Use Permit approval are required from the Town of Lenroot and the Sawyer County Zoning Committee. In this request, Todd's proposes to continue nonmetallic mining on the Hajward Sand and Gravel Pit and move north into the Inerchan Pit, and then eventually east in to the Walport Pit Nonmetallic minerals are essential to the building and maintaining of roadway infrastructure of the surrounding community and County. Access to, and extraction of, the minerals in the immediate area is critical to the supply of aggregate used for those projects. Local sourcing of these materials decreases cost of road projects, lessens truck traffic distances, and promotes jobs and other opportunities for the community. Todd's operates several mine sites effectively, contributing to the general welfare, safety, health, and economy of the County and citizens. 1.1 Legal Description Tax ID# 17831: 57-014-2-41-09-10-1 04-000-000010, SE Va. This application is for a regular conditional use permit The following factors are considered for the conditional use permit application. 2.1 Sec. 6.23 1): Rules and Standards for NMM Mining Hot mix plants, asphalt mixing plants and rock crushers shall conform to state, federal, or local pollution standards. The location and operation ofasphalt mixing plants, rock crushers and hot mix plants shall be requested by conditional use application. This conditional use application only considers the operation of a rock crusher and its associated equipment; screens, bins, and conveyors. Crushing equipment will have all environmental permits and comply with all permit standards set to protect public health and welfare. The location of the rock crusher will conform to all setbacks, as discussed next Todd's Redi Mix Concrete LLC - Inerchan and Walport Page 11 Page 44 of 200 Condirional Use Permit Application with Rezone Request - Town of Lenroot, Sawyer County 2.2 Sec. 6.23 2): Rules and Standards for NMM Mining Setback requirements for asphalt mixing plants, hot mix plants and rock crushers. Asphalt mixing plants, hot mix plants and rock crushers operating in nonmetaliic mines active as of August 16,2001, shall be located not less than 1.000feetfrom any residence, hotel, motel or resort Again, this conditional use application only considers the operation of a rock crusher and its associated equipment; screens, bins, and conveyors. The rock crusher will be located a minimum of 1,000 feet from any residence, hotel, motel or resort Refer to Figure 8 for a display of the area within the properties that meets the 1,000 foot setback. 2.3 Sec. 6.24 l)a]: Rules and Standards for NMM Mining Activities Ownership and management data: information on location ofthe proposed site ofthe operations, ownership of the land, leasehold, license and other property interests, and accurate information on the identity ofall individuals, partnerships, associations or corporations which will be involved in control ofthe proposed operation. The purpose ofthis requirement is to allow the Zoning Committee to determine accountability for all conditions that it decides to impose upon the activities and the information shall be sufficiently detailed and complete to accomplish this purpose. The location of the properties are described as follows: • Tax ID# 17831 (Inerchan): 57-014-2-41-09-10-1 04-000-000010, SE Vi NE V* Section 10, Township 41 N, Range 9 W, 40.357 acres. • Tax ID# 17895 (Walport): 57-014-2-41-09-11-2 03-000-000010, SWV4 NW ¥4 Section 11, Township 41 N, Range 9 W, 40.62 acres. Reference Section 4.0 of this document for the reclamation plan data. 2.6 Sec. 6.24 2)a): CUP Standards The mineral extraction and/or processing is an allowable conditional use in the zone district, and an appropriate land use at the site in question, based upon consideration of such factors as: (i) Existence ofmineral deposits; and (ii) Proximity of the site to transportation facilities and to market areas; and (Hi) Ability of the operation, as described in the proposed operations plan, to avoid harm to the public health, safety, and welfare and to the legitimate interests of nearby properties. A. Existence of mineral deposits. Todd's Redi Mix Concrete LLC - Inerchan and Walport Page | 2 Page 45 of 200 Conditional Use Permit Application with Rezone Request - Town of Lenroot, Sawyer County The properties have sufficient geologic resources [minerals) to support the operation of a gravel pit Exploration of the Inerchan property provided an average depth of approximately 20' of usable sand and gravel on site, and the Walport property having an average depth of 25' of usable sand and gravel. Mineable geologic resources include sand and gravel, with a projected total reserve amount of 1.9 million tons on the Inerchan properly, and 1.6 million tons on the Walport property. A total of approximately 61.58 acres would be mined and reclaimed. Todd's has explored other parcels (than those identified within this rezone request) within the immediate area, but has not been successful in locating the type of aggregate desired. Sourcing aggregate comes from where it naturally occurs, and the desired source is located on these properties and not on others nearby. This proposed source of aggregate would help support a diminishing supply within current mining operations located adjacent to these properties. Unfortunately, without these additional resources, Todd's would, in the very near future, be constrained to hauling aggregate material from other mining sources in the County. Hauling the aggregate material from other mines would significantly increase truck traffic that would ultimately travel through the City of Hayward. Expanding current mining operations into these two parcels would eliminate the need for hauling material in and thereby avoiding unnecessary, burdensome, and impacted safe travel to commuters within, and tourists traveling to, the local area. B. Proximity of the site to transportation facilities and market areas. The properties are adjacent to existing nonmetallic mining operations. Transportation of the extracted and processed minerals would occur on-site and go to the Todd's Redi Mix Concrete and Hayward Sand and Gravel facility located nearby. Dump trucks would be utilized to transport the materials from the Inerchan and Walport properties to the facility. Less than a % mile of North Olson Road would be utilized by Uie dump trucks to deliver materials to the facility. This portion of the road is already established and used by dump trucks serving existing nonmetallic mining activities. C. Ability of the operation to avoid harm to the public health, safety, and welfare and to the legitimate interests of nearby properties. Lands adjacent to the parcel include a mixture of zoning districts including Forestry One (F- 1), Residential/Recreational One (RR-1), Agricultural One (A-1) and Agricultural Two (A-2), reference Figure 3. Adjacent parcel use includes nonmetallic mining, agriculture, passive recreation or forested areas, with residences existing to the west and north. Existing nonmetallic mining operations exist to the south, southeast, and east, adjacent to these properties. Nonmetallic mining is an allowable conditional use on the subject properties, as with other adjacent properties zoned F-1. All operations comply with environmental and safety regulations which are set to protect public health and welfare. Applicable regulations are established and enforced by 1) Wisconsin Department of Natural Resources (WDNR), 2) Environmental Protection Agency (EPA), and 3) Mine Safety and Health Administration (MSHA). Reference Section 3.0 of this document for the Operations Plan. 2.8 Sec. 6.24 2)c): CUP Standards That a reclamation plan, which shall similarly be imposed as a condition ofapproval, will be enforceable and, as enforced, will result in a condition which is reasonably safe, attractive, and ifpossible, conducive to productive new usesfor the site. Reference Section 4.0 of this document for the reclamation plan data. Successful reclamation will support the continued development of recreational and forestry use within the district 2.9 Sec. 6.24 2]fQ: CUP Standards The Zoning Committee shall attach such conditions to each approved application as are necessary to assure that the operation will satisfy tiie standards set forth above. These conditions may be conveyed as deed restrictions. Todd's is open to discussing conditions necessary to achieve satisfaction of ordinance standards. 2.10 Sec 6.24 2)e): CUP Standards The conditional use permit shall be in effect for a period specified by the Zoning Committee not to exceed five (5) years and may be renewed or revised upon re-application for periods offive (5) years. All permitted operations shall be inspected at least once every year by the Zoning Committee or its agents and shall be inspected at the time a request for renewal is before the Zoning Committee to determine if all conditions of the operation are being complied widi. Todd's understands the term of a conditional use permit and would ensure proper and timely renewal when required. 2.11 Sec 6.24 2)f): CUP Standards A termination of mining or drilling activities on a site which is the subject of an approved conditional use permitfor a period of oneyear or more shall dis-titie the permit holder to a right of renewal at the end ofthe permit period, despite compliance of former operations will all conditions of the original permit, unless; (i) Such a discontinuance was specified as part of the original operations plan; or (ii) The operator has submitted and had Zoning Committee approval of an amendment to the original permit placing the operation in inactive status with accompanying conditions as to interim or partial reclamation. Operations are seasonal and based on material needs. There may be times when operations may cease for more than a one year period, but not as a termination of operations, only to idle them until such time demand necessitates operations to start up again. The Operations Flan details the potential for idle time, and Todd's will work wdth the Zoning Committee to ensure the permit remains in effect and is available for renewal. Final termination of mining activities will be communicated to the Zoning Committee within reclamation reporting communications. Todd's Redi Mix Concrete LLC - Inerchan and Walport Page 14 Page 47 of 200 Conditional Use Permit Application with Rezone Request - Town of Lenroot, Sawyer County 2.12 Sec. 6.24 2)g): CUP SUndards The Zoning Committee shall require reasonable assurance that the conditions it imposes will be satisfied. Such assurance shall be achieved through some combination of: (i) Performance bonds or substitute guarantees in theform of pledged collateral; (ii) Establishment of escrow accounts into which deposits shall be made to assure financial resourcesfor investments in reclamation work; (Hi) Clear identification ofthe relationship between /ondoivners, lessees, licenses, and operators and the signing 0/written pledges by those persons who assume responsibility for various elements ofthe conditions imposed. Todd's will meet the reasonable assurance requirements set by the Zoning Committee. Financial assurance for reclamation work will be provided by bond(s] unto Sawyer County Zoning. 2.13 Sec. 6.24 3]a): NMM Mining Exceeding 25 Acres Must file a digital and hard copy ofreclamation plan a minimum of60 days before thefirst public hearingfor the conditional use permit (i) Reclamation plans must follow the Large Pit Reclamation Plan guidelines as provided by the Department A digital copy, along with an original paper copy, of the reclamation plan will be submitted in accordance with the timing outlined in the ordinance. 2.14 Sec. 6.24 3]b]: CUP SUndards A stormwater management plan may be required at the discretion of the Zoning and Conservation Department based on the recommendations ofthe reclamation plan reviewer. A stormwater management plan will be developed in support of the Wisconsin Department of Natural Resources' General Permit to Discharge Under the Wisconsin Pollutant Discharge Elimination System (WPDES) for Mineral (Nonmetallic) Mining and/or Processing. 2.15 Sec. 6.24 3]c): CUP SUndards Wetland mitigation may be required through the Wisconsin Department of Natural Resources. The mining area will not result in the disturbance (taking) of any wetland. One wetland complex does exist on the Walport property, reference Figure 6. The operations and mine plan, and as illustrated in the reclamation plan, provides a minimum of a 50' setback from the wetland complex. 2.16 Sec. 6.24 4)c): CUP SUndards Impacts of particular concern to the Zoning Committee in evaluating plans and proposals, and in enumerating conditions, prior to the granting ofconditional use permits for mineral extractions activities. The Zoning Committee shall use its conditional use powers in such a way as to minimize, on-location and off-site, the potential for mineral extractions activities to: c) Production Activities: - Remove vegetation Vegetation will be removed only to the extent necessary to access the mineable resources. The vegetation will be removed in phases, for the current phase of operation. Vegetation will be replaced in accordance with the reclamation plan. • Create noise and odor problems Todd's Redi Mix Concrete LLC - Inerchan and Walport Pago |5 Page 48 of 200 Conditional Use Permit Application with Rezone Request - Town of Lenroot, Sawyer County Noise will be mitigated on the site by maintaining functional mufflem and exhaust systems on all internal combustion engines and by shielding mechanical processes with noise barriers. Further, setbacks from property boundaries and establishment oFberms will also assist in mitigating noise. Based on noise studies conducted on aggregate production operations, crushing will produce an originating decibel [db) level of around 100. The level drops down to approximately 85 db within the first 50 fee^ 79 db within 100 feet, 73 db within 200 feet, 68-72 db within 400 feet, and 50-54 db (normal conversation levels] after 500 feet Todd's is not aware of any noise complaints regarding current nonmetallic mining activities on adjacent properties. The nonmetallic mining activities are not expected to produce any odor problems. Todd's is not aware of any odor complaints regarding current nonmetallic mining activities on adjacent properties. • Displace wildlife There are no threatened or endangered species on the properties (according to the Wisconsin DNR Natural Heritage Inventory). Other wildlife may be displaced during the mining process up until reclamation. However, while there will be establishment of berms around the mining area, wildlife will be able to access and move through the area unhindered. Further, the nonmetallic mining activities will not occur on a constant basis, 24 hours each day, 365 days per year; rather, operations will be limited and occur on much shorter timeframes, minimizing the displacement of wildlife. • Create aesthetics problem The operations and mine plan identify the establishment of a 50' setback h'om the property boundaries, and berms around the mining area. These characteristics will minimize aesthetic impacts. - Destroy archaeological sites There are no archaeological sites on the properties according to the Wisconsin DNR Natural Heritage Inventory. - Potential safety problems The United States Department of Labor, Mine Safety and Health Administration (MSHA) regulates the safety and health considerations of the sand and gravel excavation and processing operation. The site will be subject to annual inspections by MSHA. Hard hats are mandatory for all personnel within the excavation and processing areas. Visitors must have permission to enter the site and must observe all safety regulations while visiting the site. Warning signs may be posted around the mining perimeter. Reference Section 6.6 of this document for more information regarding safety aspects. - Affect surface or groundwater quality Reference Sections 6.2 and 6.3 of this document for surfece and groundwater quality information. Todd's Redi Mix Concrete LLC - Inerchan and Walport Page 16 Page 49 of 200 Conditional Use Permit Application with Rezone Request - Town of Lenroot, Sawyer Coionty 3.0 Operations Plan Operations plan data: full and complete information on the precise nature of mineral extractions or processing activity that is proposed to be undertaken. A description of all the phases of the contemplated operation plan is detailed below. Figures 2,4, 5, and 6 refer to site features that include a scale bar on all figures indicating property boundaries, site conditions, terrain, surface water features, and wetlands. 3.1 Site Layout The proposed mining phases and extent are further detailed in section 3.3. Mining is proposed to occur in phases beginning with entering the Inerchan property from the south, moving north, then east, and moving into the northwest portion of the Walport property. Mining would then continue on the Walport property in a clockwise direction, moving east, and then moving south. Mining and processing equipment will be located within the exposed mine area, and moved to within each open area as mining progresses. Reclamation will occur in stages, concurrently with mining in a progressive fashion. A total of approximately 61.58 acres would be mined and reclaimed. 3.2 Operation Activity The primary operation activity will be the extraction of sand and gravel and the processing of aggregate products for construction use. The typical excavation operation sequence begins with the removal of the topsoil from the top of the sand and gravel deposit using bulldozers, a backhoe and/or scrapers and haul trucks. After the sand and gravel is exposed, the sand and gravel is then excavated from the bank and hauled by end-loaders or trucks a short distance to the crushing and screening plant where the sand and gravel is crushed and sized into various products. The crushing and screening plant typically includes several crushing units, screening units, and conveyors. The crushing and screening plants utilized are portable and are moved within the excavation area and in and out of the pit as needed to replenish the product stockpiles. After processing by the crushing and screening plant, the various products are stockpiled for later use. End-loaders are used to load the aggregate products into trucks from the stockpiles. The trucks are then weighed on a scale before leaving the site. There will be no washing of the sand and gravel. Dust suppression systems arc installed on crushing equipment and utilize water as a form of dust suppression mitigation. Occasionally, as recycle products become available, recycled concrete may be hauled to the pit for temporary storage and processing into aggregate products for resale. None of the recycle materials will be buried on site and all of the recycle materials will be temporarily stockpiled and hauled from the site after processing. Typical equipment and staffing involved in the sand and gravel operation: Overburden Removal: l-2backhoes 2-4 bulldozers 2-3 scrapers 1-3 haul trucks Processing Operations: 1 crushing and screening plant 1-4 front end-loaders 1 bulldozer Todd's Redi Mix Concrete LLC - Inerchan and Walport Page | 7 Page 50 of 200 Conditional Use Permit Application with Rezone Request - Town of Lenroot, Sawyer County 1 fuel truck 1 water truck 1-4 conveyors/stackers 1-3 portable power generators General: Scale house/office Portable toilet Employees: 1 Foreman 1-5 Operators 3.3 Operation Development Plan Excavation of the sand and gravel will occur as described above and detailed below. The portable crushing and screening operations, stockpile area, scale, and scale house may move throughout the property to minimize haul distances from working areas. The proposed mining phases and extent are displayed in the Operations Plan phase Figures included in Appendix B. Access to the Inerchan property will be from the existing Hayward Sand and Gravel Pit located directly [adjacent) south of the Inerchan property. The stockpiling and loading area will be located in this area as well. This will be the start of Phase 1. The mining operations will start in the south central portion of Phase 1 and then gradually progress west and east, and northwest; depicted in Operations Plan (Phase 1). A berm will be constructed in phase 1 with overburden along the western edge of the parcel with maximum slopes of 3:1 within the 50 foot setback from the property line. Additional berms will be constructed on the western edge as mining progresses. These berms will reduce visibility and noise as well as maintain the aesthetics of the established greenspace of the area as well. Mining and processing equipment will be located within the exposed mine area, and moved to within each open area as mining progresses and reclamation occurs behind. As mining advances into Phase 2, Phase 1 will have reclaimed slopes along the western portion of the site. The stock piling and loading area will also migrate towards the center of this phase. As operations continue in Phase 2, mining will progress in the southwestern portion of Phase 2 and then gradually progress north, northeast, east; depicted in Operations Plan (Phase 2). Berms will be constructed in Phase 2 with overburden along the western and northern edges of the parcel with maximum slopes of 3:1 within the 50 foot setback from the property line. Again, these berms will reduce visibility and noise as well as maintain the aesthetics of the established greenspace of the area as well. As mining proceeds into Phase 3, Phase 2 will have reclaimed slopes along the western- northwestern portions of the site. Most of Phase 1 will be at or near the established reclaimed slopes as well as the final floor elevation. The stock piling and loading area will also migrate east in the site. As operations continue in Phase 3, mining will progress east; depicted in Operations Plan (Phase 3). A berm will be constructed in Phase 3 with overburden along the northern edge of the parcel with maximum slopes of 3:1 within the 50 foot setback from the property line. Again, these berms will reduce visibility and noise as well as maintain the aesthetics of the established greenspace of the area as well. Todd's Redi Mix Concrete LLC - Inerchan and Walport Page | 8 Page 51 of 200 Conditional Use Permit Application with Rezone Request - Town of Lenroot, Sawyer County As mining proceeds into Phase 4, Phases 2 and 3 will have reclaimed slopes along the western, northwestern, and northern portions of the site. Most of Phase 2 will be at or near the established reclaimed slopes as well as the final floor elevation. The stock piling and loading area will also migrate east in the site. As operations continue in Phase 4, mining will progress east and then south; depicted in Operations Plan CPhase 4). Berms will be constructed in Phase 4 with overburden along the northern and eastern edges of the parcel with maximum slopes of 3:1 within the 50 foot setback from the property line. Again, these berms will reduce visibility and noise as well as maintain the aesthetics of the established greenspace of the area as well. As operations progress into the final stages of the site within Phase 5, reclamation will continue including reclaimed slopes along the northern and northeastern portions ofthe site. Most of Phases 1,2, and 3 will be at or near the established reclaimed slopes as well as the final floor elevation. The stock piling and loading area will also shrink towards the final area within Phase 5 of the site. As operations continue in Phase 5, mining will progress south; depicted in Operations Plan (Phase 5). Upon completion of operations, reclamation will be completed within Phases 4 and 5, and all berms will have been utilized in the final reclamation. Completion of operations is depicted in Operations Plan (Phase 6), with the final reclamation depicted in I' ignre 7. Based on the geology and estimated resources available at the site, and typical operation history of other mine sites in the County, it is approximated the mine may have an operational life ranging from 10 to 50 years. 3.4 Operation Schedule Activity at the pit will normally occur during the construction season (March to November). However, reduced operations may occur December through February, as supply and demand for sand and gravel aggregate products warrant The duration and frequency of activity in the pit is dependent upon construction project work in the area. Hours of operation at the pit are proposed to be 6:00am - 6:00pm Monday through Saturday, with general quiet maintenance outside of that schedule; to be consistent with existing adjacent nonmetallic mining operations permitted at the Hayward Sand and Gravel Pit Intermittent operations may include the idling of mining and processing activities for a period longer than one year. Ceasing operations for more than one year will not be an indication of termination of mining activities. Todd's will communicate to the Zoning Committee when operations idle for a period extending beyond one year, with an anticipated date for resuming the mining activities. 3.5 Trucking & Transportation Dump trucks will consist of traditional heavy-duty dump trucks designed to carry approximately 20 tons of aggregate per load. The number of truckloads transported in any day will vary depending on the demand and use for the intended project, and may be estimated at 10 to 150 trucks per day. However, this will not be a 24 hour, 7 days a week, 365 days per year operation; rather, it will be intermittent, with trucks hauling for a couple of days to several weeks, and then no trucking for an extended amount of time (weeks to months). The trucks used for material transfer from the pit would travel within existing nonmetallic mining areas, exiting to the south of the Inerchan property, and continuing south until Todd's Redi Mix Concrete LLC - Inerchan and Walport Page | 9 Page 52 of 200 Conditional Use Permit Application with Rezone Request - Town of Lenroot, Sawyer County reaching N Olson Rd. Trucks would travel less than a half mile south on N Olson Rd to deliver material to the Todd's Redi Mix Concrete and Hayward Sand and Gravel facility. 3.6 Sand and Gravel Use Todd's plans to produce and sell the sand and gravel aggregate products primarily for future road and highway construction in the area, along with sales to local Townships and Municipalities. Most of the sand and gravel aggregate products produced by this operation will be used as base aggregate and fill materials as well as for the use in concrete production. 4.0 Sawyer County Ordinance for Non-Metallic Mining Reclamation Reclamation plan data: full and complete information on the nature ofreclamation which the applicant proposes to undertake. The reclamation plan which conforms to the Sawyer County Ordinance for Non-Metallic Mining Reclamation is included in Appendix A. The mining area will be reclaimed to passive recreation, and includes the planting of trees. The reclamation plan is generally described in the operation plan under Section 3.0 above and associated displays provided in Appendix B. Todd's has demonstrated the abili^ to achieve successful reclamation. Most recently, Sawyer County certified 8 acres of the Hayward Sand and Gravel Pit (adjacent, south of the Inerchan property] on September 9, 2024. A copy of the certification is included in Appendix D. 5.0 Soil T3rpes, Geology, Hydrogeology, and Erosion Control Soil types have been identified using the United States Department of Agriculture - Natural Resources Conservation Service. A custom soil resource report, along with geology and hydrogeology of the area is included in Appendix C. Mineable geologic resources include sand and gravel. Operations shall be covered under the Wisconsin Department of Natural Resources' (WDNR) Wisconsin Pollution Discharge Elimination System (WPDES) General Permit No. WI-0046515-07-1. The WDNR storm water general permit will be obtained prior to commencing any nonmetallic mining operations and after obtaining the conditional use permit. 6.0 Environmental Considerations 6.1 Air Quality Control of fugitive dust from roads in the operation and excavation area will be provided by use of a water truck that will spray water on the roads as necessary. Wet suppression will be used to supplement insitu moisture for control of fugitive dust emissions from the plant equipment. Water is made available through filling of an on-site water tank which supplies water to associated operation equipment as needed; the tank is filled routinely by a delivery truck operated by Todd's, Air emissions from the crusher operations are regulated and controlled through compliance with an issued air pollution control permit The regulations, and compliance with those regulations, ensure the protection of public health and welfare, as established by the WDNR. Todd's Redi Mix Concrete LLC - Inerchan and Walport Page 110 Page 53 of 200 Conditional Use Permit Application with Rezone Request - Town of Lenroot, Sawyer County The Findings of Fact provided by the air permit includes, The proposed air pollution source meets all of the applicable criteria in ss. 285.63 and 285.64, Wis. Stats." S. 285.63, Wis. Stats., includes criteria for permit approval, including: The stationary source will meet all applicable emission limitations and other requirements promulgated under this chapter, standards of performance for new stationary sources under s. 285.27 (1] and emission standards for hazardous air contaminants under s. 285.27 (2]", and The source will not cause or exacerbate a violation of any ambient air quality standard or ambient air increment under s. 285.21 (1] or (2)." Whereas, s. 285.21, Wis Stats include ambient air quality standards to protect health or welfare: "(l](b) Standard to protect health or welfare.", and s. 285.27, Wis. Stats. Includes standards of performance for new stationary sources to protect public health or welfore: "Cl](b] Standard to protect public health or welfare." Compliance with the air pollution control permit and implementation of monitoring and testing practices, asserts proper protection of air quality and public health. A copy of the air permit can be provided to the County upon request The plant foreman will document the compliance activities associated with the permit requirements on a daily environmental tracking form. Records of daily, monthly and year- to-date production and compliance information will be available for inspection at the plant site. 6.2 Ground Water No mining will be conducted in the water table. Investigation of well construction records surrounding the properties show the groundwater is expected to be between 1230' (northwest) to 1220' (southeast) mean-sea-level (MSL) beneath the site. Mining will occur to a maximum depth of 1240' MSL in the northwest and sloping to a maximum depth of 1230' MSL in the southeast, staying approximately at least 10' above the underlying groundwater table and maintaining a dry pit floor. The lubrication, fueling, and repair practices used to maintain the equipment are designed to eliminate petroleum products from ground contact The Storm Water Pollution Prevention Plan (SWPPP) and the Spill Prevention Control and Countermeasures (SPCC) plans address practices for proper storage, handling, and use of petroleum products, as well as inspection and response procedures. Fuel for mobile equipment will be stored in an aboveground tank with secondary containment The pollution prevention practices addressed in site management planning minimize the opportunity for infiltrating water to carry contaminants to groundwater. Plant foremen will perform site inspections throughout the operating period. Observations and conditions will be reported daily for all applicable environmental programs. Rain that falls in the excavation area will be contained and allowed to seep naturally into the underlying sand. When and where necessary, temporaiy earthen berms will be constructed and seeded to direct surface water flow to prevent surface water runoff from leaving the site. 6.3 Surface Water The WNDR Storm Water Program regulates the proposed sand and gravel excavation operation. Operations are covered under the WDNR's Wisconsin Pollution Discharge Elimination System (WPDES) General Permit No. Wl-0046515-07-1. Todd's has coverage under a General Permit for Nonmetallic Mining Operations at the Hayward Sand and Gravel Todd's Redi Mix Concrete LLC - Inerchan and Walport Page 111 Page 54 of 200 Conditional Use Permit Application with Rezone Request - Town of Lenroot, Sawyer County Pit permitted under FIN #10120. The company has an existing storm water plan for aggregate operations that employs Best Management Practices fBMP's) for pollution prevention. The current General Permit will be expanded to include the operations at the Inerchan and Walport Pits. The management practices required by the permit address both petroleum product handling and erosion control, including the on-site containment of storm water runoff for suspended solids control. All storm water and spring snowmelt water from the operation will be contained on site. A surface water feature exists in conjunction with the identified wetland on the proposed site; reference Figures 5 and 6 for surface water and wetland features. 6.4 Floodplain and Wetlands The site is not located within a floodplain. The Wisconsin Wetland Inventory maintained by the Wisconsin DNR indicates one wetland complex on the Walport property, reference Figure 6. Excavation limits shall follow a 50-foot setback from all WDNR delineated wetlands. All appropriate permits and actions will be taken with the Department of Natural Resources as they have jurisdiction on such actions. 6.5 Waste Disposal and Recycling Solid wastes generated in the course of production will be disposed of in dumpsters provided by licensed haulers. Regular disposal intervals will be maintained to provide adequate availability. There will be no hazardous wastes produced in conjunction with the excavation or processing operations. Used oil and lubricants from equipment maintenance will be collected for recycling by a licensed used-oil contractor. The waste receptacles will be located away from active operation areas. Sanitary facilities will be provided at the site by use of a portable chemical toilet 6.6 Safety and Health The United States Department of Labor, Mine Safety and Health Administration [MSHA) regulates the safety and health considerations of the sand and gravel excavation and processing operation. The site will be subject to annual inspections by MSHA and must meet the noise and dust exposure limits established for personnel employed in the operation activity. Noise will be mitigated on the site by maintaining functional mufflers and exhaust systems on all internal combustion engines and by shielding mechanical processes with noise barriers. Respirable dust exposure will be minimized at the site by use of wet suppression for processing aggregate materials and by controlling fugitive emissions from peripheral activities, including trucking. The company is committed to maintaining respirable dust limits within MSHA standards and providing a healthy environment for employees. Hard hats are mandatory for all personnel within the excavation and processing areas. Visitors must have permission to enter the site and must observe all safety regulations while visiting the site. Soils found within the proposed future mining areas at the property primarily consist of stony Keweenaw-Sayner-Vilas complex silt loam soils. The stony Keweenaw-Sayner-Vilas complex soils at the site occur on 1 percent to 35 percent slopes on moraine landforms. The stony Keweenaw-Sayner-Vilas complex is characterized by a typical composition of 35 percent stony Keweenaw, 20 percent stony Sayner, 20 percent stony Vilas and 25 percent other minor soil components. These soils are well to excessively drained and are not classified as prime farmland soils. The Keweenaw soils at the site were formed in sandy and loamy till, the Sayner soils at the site were formed in stratified sandy and gravelly outwash, and the Vilas soils at the site were formed in sandy outwash. The typical profile for the Keweenaw series soils consists of a two-inch, loamy-sand, "A" horizon underlain by seven inches of loamy sand, followed by 70 inches of gravelly loamy sand. The typical profile for the Sayner series soils consists of a two-inch, loamy-sand, "A" horizon underlain by five inches of loamy sand, followed by 72 inches of sand to gravelly coarse sand. The typical profile for the Vilas series soils consists of a three-inch, loamy-sand, "A" horizon underlain by nine inches of loamy sand, followed by 68 inches of sand. Beneath the surficial soils at the site are outwash sand and gravel deposits of the Copper Falls Formation. The Copper Falls Formation generally consists of cross-bedded sand, gravelly sand, and some plane-bedded sandy gravel deposited by proglacial meltwaters between roughly 16,000 and 11,500 years ago (Clayton, 1985). The Pleistocene Geology of the Superior Region, Wisconsin Plate 1 map (Clayton, 1985) shows the site is mapped as collapsed proglacial, englacial, or subglacial stream sediment overlain by a thin layer of till, wind-blown, or offshore silt mixed with the undertying material. The sand and gravel sediment at the site was deposited by meltwater streams draining off the Superior lobe of the Laurentide Ice Sheet, during the Hayward Phase of Wisconsin Glaciation, roughly 14,000 years ago. The meltwater deposits of the Copper Falls Formation are the targeted deposits for extraction at the site and are of suitable quality for use in commercial and state asphalt mixes, commercial and state concrete mix aggregate, and road base aggregate along with other aggregate and landscape products. The unconsolidated glacial sand and gravel deposits are expected to be approximately 100 feet thick beneath the site. The bedrock beneath the local glacial deposits at the site is expected to consist of approximately 100 feet of sandstone of Cambrian age underlain by basalt or amphibolite gneiss of Precambrian age. Hydrogeotogy Private water supply wells in the vicinity of the application property are drilled into and completed in the glacial sand and gravel and Cambrian sandstone aquifers. A detailed review of well construction reports has been completed for 18 wells within two miles of the application property. A summary of the reviewed well construction report information can be seen in the below Table 1. They highlight soil limitations that affect various land uses and provide information about the properties of the soils in the sun/ey areas. Soil surveys are designed for many different users, including farmers, ranchers, foresters, agronomists, urban planners, community officials, engineers, developers, builders, and home buyers. Also, conservationists, teachers, students, and specialists in recreation, waste disposal, and pollution control can use the surveys to help them understand, protect, or enhance the environment. Various land use regulations of Federal, State, and local governments may impose special restrictions on land use or land treatment. Soil sun/eys identify soil properties that are used in making various land use or land treatment decisions. The information is intended to help the land users identify and reduce the effects of soil limitations on various land uses. The landowner or user is responsible for identifying and complying with existing laws and regulations. Although soil survey information can be used for general farm, local, and wider area planning, onsite investigation is needed to supplement this information in some cases. Examples include soil quality assessments (http;//www.nrcs.usda.gov/wps/ portai/nrcs/maln/soils/heaith/) and certain conservation and engineering applications. For more detailed information, contact your local USDA Sen/ice Center {https://offices.sc.egov.usda.gov/iocator/app?agency=nrcs) or your NRCS State Soil Scientist (http://www.nrcs.usda.gov/wps/portal/nrcs/detail/soiis/contaclus/? cid=nrcs142p2_053951). Great differences in soil properties can occur within short distances. Some soils are seasonally wet or subject to flooding. Some are too unstable to be used as a foundation for buildings or roads. Clayey or wet soils are poorly suited to use as septic tank absorption fields. A high water table makes a soil poorly suited to basements or underground installations. The National Cooperative Soil Survey is a joint effort of the United States Department of Agriculture and other Federal agencies, State agencies including the Agricultural Experiment Stations, and local agencies. The Natural Resources Conservation Service (NRCS) has leadership for the Federal part of the National Cooperative Soil Sun/ey. Information about soils is updated periodicaiiy. Updated information is available through the NRCS Web Soil Survey, the site for official soil survey information. They indude a description of the soils and miscelianeous areas and their location on the landscape and tables that show soil properties and limitations affecting various uses. Soil scientists observed the steepness, iength, and shape of the siopes; the general pattern of drainage; the kinds of crops and native piants; and the kinds of bedrock. They observed and described many soii profiies. A soii profile is the sequence of natural layers, or horizons, in a soil. The profile extends from the surface down into the unconsolidated material in which the soii formed or from the surface down to tiedrock. The unconsolidated material is devoid of roots and other living organisms and has not been changed by other biological activity. Currently, soiis are mapped according to the boundaries of major land resource areas (MLRAs). MLRAs are geographically associated land resource units that share common diaracteristics related to physiography, geology, climate, water resources, soils, biological resources, and land uses (USDA, 2006). Soil survey areas typically consist of parts of one or more MLRA. The soiis and miscelianeous areas in a survey area occur In an orderly pattem that is related to the geology, landforms, relief, climate, and natural vegetation of the area. Each kind of soil and miscellaneous area is associated with a particular kind of iandform or with a segment of the landform. By observing the soiis and miscellaneous areas in the survey area and relating their position to specific segments of the iandform, a soii scientist develops a concept, or model, of how they were formed. Thus, during mapping, this model enables the soil scientist to predict with a considerable degree of accuracy the kind of soil or miscellaneous area at a specific location on the landscape. Commonly, individual soils on the landscape merge into one another as their characteristics gradually change. To construct an accurate soil map, however, soil scientists must determine the boundaries between the soiis. They can observe only a limited number of soii profiies. Nevertheless, these observations, supplemented by an understanding of the soil-vegetation-landscape relationship, are sufficient to verity predictions of the kinds of soil in an area and to determine the boundaries. Soii scientists recorded the characteristics of the soil profiles that they studied. They noted soii color, texture, size and shape of soii aggregates, kind and amount of rock fragments, distribution of plant roots, reaction, and other features that enable them to identify soils. After describing the soils in the survey area and determining their properties, the soil scientists assigned the soiis to taxonomic dasses (units). Taxonomic classes are concepts. Each taxonomic dass has a set of soil characteristics with precisely defined limits. The classes are used as a basis for comparison to classify soils systematically. Soii taxonomy, the system of taxonomic classification used in the United States, is based mainly on the kind and character of soil properties and the arrangement of horizons within the profile. After the soil Page 82 of 200 Custom Soil Resource Report scientists classified and named the soils in the survey area, they compared the individual soils with similar soils In the same taxonomic class in other areas so that they could confirm data and assemble additional data based on experience and research. The objective of soil mapping is not to delineate pure map unit components; the objective is to separate the landscape into iandfbrms or landform segments that have similar use and management requirements. Each map unit is defined by a unique combination of soil components and/or miscellaneous areas In predictable proportions. Some components may be highly contrasting to the other components of the map unit The presence of minor components in a map unit in no way diminishes the usefulness or accuracy of the data. The delineation of such landforms and landform segments on the map provides sufficient information for the development of resource plans. If intensive use of small areas Is planned, onsite investigation Is needed to define and locate the soils and miscellaneous areas. Soil scientists make many field observations in the process of producing a soli map. The frequency of observation is dependent upon several factors, including scale of mapping, intensity of mapping, design of map units, complexity of the landscape, and experience of the soil scientist. Observations are made to test and refine the soil-landscape model and predictions and to verify the classification of the soils at specific locations. Once the soil-landscape model is refined, a significantly smaller number of measurements of individual soil properties are made and recorded. These measurements may include field measurements, such as those for color, depth to bedrock, and texture, and laboratory measurements, such as those for content of sand, silt, clay, salt, and other components. Properties of each soil typically vary from one point to another across the landscape. Observations for map unit components are aggregated to develop ranges of characteristics for the components. The aggregated values are presented. Direct measurements do not exist for every property presented for every map unit component. Values for some properties are estimated from combinations of other properties. While a soil survey is in progress, samples of some of the soils in the area generally are collected for laboratory analyses and for engineering tests. Soil scientists interpret the data from these analyses and tests as well as the field-observed characteristics and the soil properties to determine the expected behavior of the soils under different uses. Interpretations for all of the soils are field tested through observation of the soils in different uses and under different levels of management. Some interpretations are modified to fit local conditions, and some new interpretations are developed to meet local needs. Data are assembled from other sources, such as research information, production records, and field experience of specialists. For example, data on crop yields under defined levels of management are assembled from form records and from field or plot experiments on the same kinds of soil. Predictions about soil behavior are based not only on soil properties but also on such variables as climate and biological activity. Soil conditions are predictable over long periods of time, but they are not predictable from year to year. For example, soil scientists can predict with a fairly high degree of accuracy that a given soil will have a high water table within certain depths in most years, but they cannot predict that a high water tabie will always be at a specific level in the soil on a specific date. After soil scientists located and identified the significant naturai bodies of soil In the survey area, they drew the boundaries of these bodies on aerial photographs and Page 83 of 200 Custom Soil Resource Report Identified each as a specific map unit. Aerial photographs show trees, buildings, fields, roads, and rivers, ail of which help in locating boundaries accurately. The map unit descriptions, along with the maps, can be used to determine the composition and properties of a unit A map unit delineation on a soli map represents an area dominated by one or more major kinds of soil or miscellaneous areas. A map unit is identified and named according to the taxonomic classification of the dominant soils. Within a taxonomic class there are precisely defined limits for the properties of the soils. On the landscape, however, the soils are natural phenomena, and they have the characteristic variability of all natural phenomena. Thus, the range of some observed properties may extend beyond the limits defined for a taxonomic class. Areas of soils of a single taxonomic class raraiy, if ever, can be mapped without including areas of other taxonomic classes. Consequently, every map unit is made up of the soils or miscellaneous areas for which it is named and some minor components that belong to taxonomic classes other than those of the major soils. Most minor soils have properties similar to those of the dominant soil or soils in the map unit, and thus they do not affect use and management These are called noncontrasting, or similar, components. They may or may not be mentioned In a particular map unit desoiption. Other minor components, however, have properties and behavioral characteristics divergent enough to affect use or to require different management. These are called contrasting, or dissimilar, components. They generally are in small areas and could not be mapped separately because of the scale used. Some small areas of strongly contrasting soils or miscellaneous areas are identified by a special symbol on the maps. If included in the database for a given area, the contrasting minor components are identified in the map unit descriptions along with some characteristics of each. A few areas of minor components may not have been observed, and consequently they are not mentioned in the descriptions, especially where the pattem was so complex that it was impractical to make enough observations to identify all the soils and miscellaneous areas on the landscape. 11 Page 88 of 200 Custom Soil Resource Report The presence of minor components in a map unit in no way diminishes the usefuiness or accuracy of the data. The objective of mapping is not to delineate pure taxonomic classes but rather to separate the landscape into iandforms or landforrn segments that have similar use and management requirements. The delineation of such segments on the map provides sufficient information for the development of resource plans. If intensive use of small areas is planned, however, onsite investigation is needed to define and locate the soils and miscellaneous areas. An identifying symbol precedes the map unit name in the map unit descriptions. Each description includes general facts about the unit and gives important soil properties and qualities. Soils that have profiles that are almost alike make up a soil series. Except for differences in texture of the sur^ce layer, all the soils of a series have major horizons that are similar in composition, thickness, and arrangement. Soils of one series can differ In texture of the surface layer, slope, stoniness, salinity, degree of erosion, and other characteristics that affect their use. On'the basis of such differences, a soil series Is divided into soil phases. Most of the areas shown on the detailed soil maps are phases of soil series. The name of a soil phase commonly indicates a feature that affects use or management. For example. Alpha silt loam, 0 to 2 percent slopes, is a phase of the Alpha series. Some map units are made up of two or more major soils or miscellaneous areas. These map units are complexes, associations, or undifferentiated groups. A complex consists of two or more soils or miscellaneous areas in such an intricate pattern or in such small areas that they cannot be shown separately on the maps. The pattem and proportion of the soils or miscellaneous areas are somewhat similar in ail areas. Alpha-Beta complex, 0 to 6 percent slopes, is an example. An association is made up of two or more geographically associated soils or miscellaneous areas that are shown as one unit on the maps. Because of present or anticipated uses of the map units in the survey area, it was not considered practical or necessary to map the soils or miscellaneous areas separately. The pattem and relative proportion of the soils or miscellaneous areas are somewhat similar. Alpha-Beta association, 0 to 2 percent slopes, is an example. An undifferentiated group is made up of two or more soils or miscellaneous areas that could be mapped individually but are mapped as one unit because similar interpretations can be made for use and management The pattem and proportion of the soils or miscellaneous areas in a mapped area are not uniform. An area can be made up of only one of the major soils or miscellaneous areas, or it can be made up of all of them. Alpha and Beta soils, 0 to 2 percent slopes. Is an example. Some survey include miscellaneous areas. Such areas have little or no soil material and support little or no vegetation. Rock outoop is an example. 12 Page 89 of 200 Custom Soil Resource Report Sawyer County, Wisconsin 69C—Keweenaw-Sayner-Vilas complex, 1 to 15 percent slopes, stony Map Unit Setting National map unit symbol: 2xjss Elevation: 970 to 1,840 feet Mean annual precipitation: 30 to 34 Inches Mean annual air temperature: 39 to 43 degrees F Frost-fiee period: 100 to 140 days Farmland ciassmcation: Not prime farmland Map Unit Composition Keweenaw, stony, and similar soils: 35 percent Saynar, stony, and simiiarsdis: 20 percent Vilas, stony, and similar soils: 20 percent Minor components: 25 percent Estimates are based on oljservadons, descriptions, and transects of the mapunit Description of Keweenaw, Stony Setting L^ndfbrm: Moraines Landform position (two-dimensional): Backslope, shoulder Landform position (three-dimensional): Side slope Down-slope shape: Convex Across-slope shape: Convex Parent material: Sandy and loamy till lypicai profile A-0 to 2 inches: loamy sand E-2to4 inches: loamy sand Bsl -4 to 9 inches: loamy sand Bs2 -9 to 23 inches: gravelly loamy sand E/B • 23 to 35 inches: gravelly loamy sand B/E - NR 13S.40 (7)(c) for 8 acres of the Hayward Sand and Gravel Mine site in Sawyer County, Wisconsin. The mine site is located in Section 10, Town 41 North, Range 9 West. The nonmetallic mine site was operated by Todd's Redi Mix Concrete, LLC and was granted a reclamation permit on April 20*'', 2018. As part of the permit, a Reclamation Plan was approved for the mining site. The Reclamation Plan required that surface facilities be removed and that ttie site be graded, stabilized and revegetated according to the reclamation plan approved to meet the approved post-mining land use as per NR 135.19 (3) (4) (5). On November IS"*, 2022 the operator Todd's Redi Mix, in accordance with NR 135.40 (7) (a) notified the Sawyer County ^ning and Conservation Department that reclamation had teen completed for 8 acres at the Hayward Sand and Gravel mining site. Subsequently, the Sawyer County Zoning and Conservation Department acknowledged that fte criteria established in 135.19 (4) (g) have been met. Diuing the ensuing years the Sawyer County Zoning and Conservation Department conducted necessary site inspections and examined other relevant information pertaining to the successful reclamation of the site. Based on these inspections and examinations the Sawyer County Zoning and Conservation Department has determined that: the site has been reclaimed in accordance with the Reclamation Plan; and that such successful condition was maintained for a sufficient period of time following the completion of reclamation on November 15"', 2022 in accordance with NR 135.15; county ordinance s. 6.23 (5). Thus, given the favorable condition of the site the Sawyer Coimty Zoning and Conservation Department finds that the Certificate of Completion should be issued for this reclaimed mine site. Therefore, in accordance with s. 293.63 Stats., NR 135.19 and NR 135.40 (7) (c); county ordinance s. 6.23 (5) the Sawyer (bounty Zoning and Conservation Department hereby issues the Certificate of Completion for 8 acres of the Hayward Sand and Gravel mining site and acknowledges that Todd's Redi Mix Concrete, LLC has fulfilled its/their obligations set forth in the reclamation plan as approved under NR 135.19 (5); county ordinance s. 6.23 (5) to meet the reclamation standards NR 135.05 - 15. The issuance of this Certificate of Completion reflects the determination by Sawyer County Zoning and Conservation Department that the mine site has been satisfactorily reclaimed as per NR 135.40 (7) (c); county ordinance s. 6.23 (5). On behalf of the Sawyer County Zoning and Ck>nservation Department, I would like to conunend you and your company on your diligence and commitment to completing the necessary reclamation at this site. You have demonstrated that successful reclamation of nonmetallic mining sites can be achieved by restoring the site to a stable and attractive condition which provides a productive post mining land use.
