Page 14 of 68 Natural Resources Committee AGENDA INFORMATION SHEET AGENDA DATE: July 2, 2026 DEPARTMENT: Planning and Parks DIRECTOR: Andrew Struck PREPARER: Matt Aho AGENDA SUMMARY: Resolution: Approval of an Intergovernmental Cooperation Agreement / Memorandum of Understanding with the Town of Fredonia for the Transfer, Remediation, and Public Park and Open Space Use of Parcels 04-028-12-010.00 and 04-028-12-012.00 in the Town of Fredonia to Ozaukee County (Planning and Parks Department). BACKGROUND INFORMATION: Ozaukee County and the Town of Fredonia (Town) have worked together to advance their respective interest relating to parcels 04-028-12-010.00 and 04- 028-12-012.00, including two (2) buildings (Waubeka Mill and Button Factory) located at W4132 Mill Street in the Town of Fredonia (collectively, the “Property”), and promote their safe and harmonious use for a public park and open space purpose. The Property presently poses a threat to public health, safety and welfare in that it contains dilapidated structures which are in serious disrepair and contain hazardous substances (including asbestos), making it a public nuisance. In addition, the structures are non-conforming structures since they are located in C-1 zoning (Lowland Conservancy District) of the Town of Fredonia which only allows the previous historic use of the properties, has been a discontinued use for more than 12 months, are located in a flood hazard zone (e.g. floodway of the Milwaukee River), do not meet road and riparian setback requirements, and given the structural repairs required could not be rebuilt per the County shoreland and floodplain zoning ordinances and the lots are not be buildable for new construction. The Town of Fredonia legally acquired quit claim deed title to the Properties through a voluntary sale on June 3, 2026. Ozaukee County intends to submit grant requests (including a Wisconsin Economic Development Corporation Brownfield Site Assessment grant) to secure funding for the necessary remediation of the Properties, to ensure safe removal of the buildings and to take other actions that the County may deem necessary for the preservation of public health, safety and welfare. In support of these efforts, the Ozaukee County Board of Supervisors adopted Resolution 25-74 on April 1, 2026 approving 2026 Capital Fund Project inclusive of $40,000 in match funding for grant requests for remediation of the Properties. Ozaukee County access to the Properties is required to complete environmental testing so it may move forward with the grant requests and plan for other brownfield remediation and park and open space use of the Properties. ANALYSIS: Ozaukee County and the Town have prepared the attached Intergovernmental Cooperation Agreement / Memorandum of Understanding that states that the Town of Fredonia will convey the Property via quit claim deed to Ozaukee County for remediation and future public park and open space use, that Ozaukee County shall submit and secure grants to fund the necessary remediation of the Property to ensure safe removal of the buildings, complete the remediation of the property, and take other actions that the County may deem necessary for the preservation of public health, safety and welfare, and that the County shall reimburse the Town for a portion of Page 15 of 68 the acquisition by quit claim deed. and NOW, THEREFORE, BE IT RESOLVED, by the Ozaukee County Board of Supervisors, that Ozaukee County accepts the title to the properties located in the Town of Fredonia (Parcel 04-028-12-010.00 and Parcel ID 04-028-12-012.00) for addition to the Ozaukee County Park System Per §§ 59.52(6)(A) and 27.065(1)(A) Wisconsin Statutes via quit claim deed; and Page 30 of 68 Dated at Port Washington, Wisconsin, this 5th day of August 2026. SUMMARY: Acceptance of a donation of the title to properties located in the Town of Fredonia (Parcel 04-028-12-010.00 and Parcel ID 04-028-12-012.00) for addition to the Ozaukee County Park System Per §§ 59.52(6)(A) and 27.065(1)(A) Wisconsin Statutes. Page 31 of 68 Natural Resources Committee AGENDA INFORMATION SHEET AGENDA DATE: July 2, 2026 DEPARTMENT: Planning and Parks DIRECTOR: Andrew Struck PREPARER: Matt Aho AGENDA SUMMARY: Resolution: Acceptance of Title to Properties Located in the Town of Fredonia (Parcel 04-028-12-010.00 and Parcel ID 04-028-12-012.00) for addition to the Ozaukee County Park System Per §§ 59.52(6)(A) and 27.065(1)(A) Wisconsin Statutes. BACKGROUND INFORMATION: Ozaukee County and the Town of Fredonia have worked together to advance their respective interest relating to a 0.24 acre parcel (Parcel ID 04-028-12- 010.00) and a 0.62 acre parcel (Parcel ID 04-028-12-012.00) located at W4132 Mill Street in the Town of Fredonia (collectively, the “Property”) and promote their safe and harmonious use for a public park and open space purpose. Ozaukee County and the Town of Fredonia have prepared an Intergovernmental Cooperation Agreement / Memorandum of Understanding for the donation, remediation, and public park and open space use of the Properties. Acquisition of the Property is consistent with the adopted A Park and Open Space Plan for Ozaukee County: 2050 (4 th Edition) https://www.ozaukeecounty.gov/DocumentCenter/View/25832/Ozaukee-County-POSP-Review- Draft-November_resize_11132024?bidId= which identifies the Property parcel as part of the Page 32 of 68 Milwaukee River Recreation Corridor and recommends acquisition (donation) of lands within the project area by Ozaukee County for addition to the Ozaukee County Park System (pages 7, 187, 192, 206, 209, 210, 221, 257, 258), recommends providing access to waterways (pages 8, 80, 122, 135, 146, 212-213, 218, 456, 458-459) to provide trails and bicycle ways along the Milwaukee River as part of the proposed Milwaukee River Recreation Corridor (pages 81, 209, 242, 261), and recommends protection of groundwater resources and addressing contamination (page 26). The project is also supported by the adopted Multi-Jurisdictional Comprehensive Plan for Ozaukee County https://www.ozaukeecounty.gov/DocumentCenter/View/797/Multi- Jurisdictional-Comprehensive-Plan-Full-and-Final-Documentpdf?bidId= related to groundwater resources, groundwater contamination and soil contamination and associated grant opportunities (pages 84 - 88, 479, 491), the adopted Ozaukee County Land and Water Management Plan for Ozaukee County 2021-2030 https://www.sewrpc.org/SEWRPCFiles/Publications/CAPR/capr- 338-Ozaukee-County-Land-and-Water-Resource-Management.pdf related to groundwater resources and groundwater contamination (pages 24, 197, 204), and the Ozaukee County Strategic Plan 2020-2024 https://www.ozaukeecounty.gov/369/Strategic-Planning (Section III - Enhance Our Quality of Life Assets – “Continue to Preserve Environmentally Sensitive Lands and Natural Areas”, “Improve Our Water Quality and “Develop Recreational and Cultural Destinations for Tourism, Residents and Businesses”) (pages 10 -14). ANALYSIS: Inclusion into the Ozaukee County Park System will allow for Ozaukee County to secure grant funding to conduct the investigation of environmental contamination for the purposes of reducing or eliminating environmental contamination, such as Phase I and II Environmental Assessments, complete the demolition of any structures, buildings or other improvements located on the Property to facilitate and provide greater access for environmental site investigation, remove abandoned containers, as defined in § 292.41(1), complete asbestos abatement activities, as defined in § 254.11(2), remove underground hazardous substance storage tank systems or underground petroleum product storage tank systems, and complete the remediation of the site for public use.
