Discussion and Recommendation related to potential amendment to Village Ordinance relating to the
Keeping of Chickens in Single-Family Residential Districts, including the petition submitted by Timothy
Schwister to allow for the Keeping of Poultry in Residential Districts by Amending §205 -21G(5) of the
Zoning Code and by Creating §61-12 Keeping of Poultry.
Hebein recapp ed the current status of the Schwister petition to allow for the Keeping of Poultry in
Residential Districts by Amending §205-21G(5) of the Zoning Code and by Creating §61-12 Keeping of Poultry
stating the following:
• The Advisory Referendum in the April 7, 2026 Election is not allowed.
• A proposed Survey to the residents was declined based on cost.
• Public Hearing was held.
Hebein stated it is not the responsibility of the Village Board to redraft the petition that was submitted by
Timothy Schwister due to insufficient information.
Hoeft stated , from a legal stand point , the Schwister petition was insufficient and h e has concerns
regarding the text amendment pertaining to the code sections, noting it potentially takes the regulation
of poultry out of the zoning code.
Hoeft added, the draft that was considered in 2021 had a provision that kept the amendment within the
zoning code.
Wagner provided the history from when to petition failed in 2021.

P. Duckart inquired on the status of the current petition.
Hebein stated the Village should not be incurring Attorney fees or use Village Staff time to rewrite or edit
the Schwister petition.
P. Duckart ask if the 2021 version of the draft ordinance could be reviewed at this time.
Hebein stated the Village Board is reviewing what was proposed in the current petition.
Rudolph stated that there is pending legislation in Madison which would prohibit Municipalities from
banning the keeping for Hens and Quails. Noting if this passes, this would allow the Village of set conditions
and permit regulations.
Rudolph offered to work with the Village Attorney to come up with a draft to be proactive if the bill passes
at the State level.
Hebein suggested to Table the Schwister petition until the legislation is determined at the State , so the
Village does not incur additional legal fees.
Nowlen suggested the petitioner could resubmitted the 2021 version as a good starting point.
Hoeft stated the process would start over, first going to Plan Commission and then a Public Hearing at the
Village Board. Fees would also be incurred with the new petition . He noted that creating new sections of
the zoning code would require a Public Hearing.
Hebein stated if the Village starts creating the ordinance now, the Village would incur legal fees, then if
the State passes the new legislation, the Village would need to come back to amend the ordinance based
on the new law, adding extra cost to the Village.
P. Duckart asked if there is a timeline on the new legislation.
Rudolph stated the new legislation is at the committee level now, looking to be completed before the
legislative session is completed in April 2026.
Rudolph added concerns on the effective date if the new law is passed.
Wagner asked the Village Attorney to explain the options regarding the current petition.
Hoeft responded, the Board could deny the petition as presented , postponed the action decision on the
current petition or modify the current petition. Hoeft does not recommend modificat ion of the Schwister
petition.
Hoeft stated if the Board wants to take action on the current petition, Schwister would then know where
he stands with his request.
Hebein stated if the matter is Tabled, the Board could postpone action until the status of the States pending
legislation is determined.
Nowlen noted that the timeline remains the same based on the original plan for an Advisory Referendum
during the April 7, 2026 Election.
Rudolph/Donen recommended to the Village Board to Table the Discussion and Recommendation related
to potential the amendment to Village Ordinance relating to the Keeping of Chickens in Single -Family
Residential Districts, including the petition submitted by Timothy S chwister to allow for the Keeping of
Poultry in Residential Districts by Amending §205-21G(5) of the Zoning Code and by Creating §61-12 Keeping
of Poultry until the April 8, 2026 meeting. Motion Carried.
