Attorney Ehlinger stated that when Mr. Lopez purchased his home, he didn’t know he
wouldn’t be allowed to continue the business he successfully ran in Florida here in
Wisconsin. Attorney Ehlinger stated there is nothing in the ordinances that expressly
prohibits the business, but nothing that allows it either. He told the Board that they
have the authority to permit conditional uses. He stated that Mr. Lopez is a fully
employed, highly qualified machinist that, as a side job, creates prototypes for
manufacturers. Attorney Ehlinger said there would be no signage, no additional traffic,
and no displays. He said Mr. Lopez would be doing the work in his off-time and on the
weekends. His shed, where he plans to do the work, is insulated and sound proofed.
There will be no dumping and no environmental concerns. He felt small businesses run
from home is an evolution in employment and economy. People want to do things from
home and being fair to small businesses can attract new residents. Attorney Ehlinger
referenced Town of Fredonia ordinances, Administrator Jenkins reminded him that he
should have reviewed Village of Fredonia ordinances.
Mr. Lopez gave a brief personal history and description of his business. He stated he
has spoken with all his neighbors, and the wider community, and none have objected
to his small business.
Mr. Polzin asked Attorney Woodward if Mr. Lopez would be allowed to machine things
as a hobby. Attorney Woodward did not feel this was an appropriate interpretation of
the question, and reminded the Board that land use variances, like the request before
them today, must prove that there is significant hardship based on the unique features
of the property. The variances are almost impossible to grant. Ms. Bartz expressed
concern that Mr. Lopez’s business would grow to the extent it would become
disruptive. Mr. Lopez stated it would not. Mr. Gehrke stated that while the Board may
agree Mr. Lopez will not be bothering his neighbors, they must consider the effect of
setting a precedent and the impact on the community as a whole.
Motion to Close the Public Hearing made by Mr. Gehrke.
Seconded by Chairman Donald.
Passed by 5-0 voice vote.
Motion to Deny Variance Request for Property Address 800 Fredonia Ave, Applicant
Edwin Lopez. made by Mr. Gehrke.
Seconded by Mr. Polzin.
Mr. Polzin asked how this has delayed Mr. Lopez’s work. Mr. Lopez responded he hasn’t
been working for six months.
Passed by 4-0 voice vote.
6. Items for Future Consideration: Mr. Polzin expressed regret at the outcome and hoped the
Village Board would consider changing the ordinances to allow Mr. Lopez to run his
machining business.
7. Correspondence: none
8. Motion to Adjourn made by Chairman Donald.

Village Administrator
Board of Appeals
June 4, 2026
Mr. Gibb Request for Height Variance
Board of Appeals,
Mr. Mark Gibb, owner of 217 N. Wilson Street, has submitted a request for a variance to
exceed the maximum allowable height for an accessory structure within his RS-1 zoned property.
This request was received by Administration after the applicant applied for a residential building
permit through Inspector Jeremy Pfeifer and was denied due to non-compliance with the Village
of Fredonia Code of Ordinances.
Village Ordinance §575-83(B)(1), “Accessory Uses, Buildings or Structures – Placement
Restrictions,” states:
“Placement restrictions. An accessory building, use or structure may be established
subject to the following regulations:
(1) Placement and dimensions. Notwithstanding any placement and dimensional
standards pertaining to principal structures set forth in the applicable zoning
district, accessory uses and detached accessory structures are permitted in the rear
yard only; shall not be closer than five feet to the principal structure, shall not be
closer than three feet to any lot line, shall not exceed 15 feet in height, and shall
not occupy more than 20% of the rear yard area in all districts …”
Municipal ordinances are intended to provide consistency and maintain aesthetic
compatibility among similarly sized buildings and uses. As Zoning Administrator, it is my
responsibility to enforce these ordinances as written. Based on the information provided, I
recommend denial of the requested variance.
Per Wisconsin State Statutes and local ordinance, the applicant must demonstrate the
following criteria to justify a variance: unnecessary hardship, unique property limitations, and no
harm to public interests. More specifically, the ordinance states:
“To authorize, upon appeal in specific cases, such variance from the terms of the Village
zoning regulations as will not be contrary to the public interest, where owing to special
conditions a literal enforcement will result in practical difficulty or unnecessary hardship,
so that the spirit of the Zoning Code shall be observed, public safety and welfare secured
and substantial justice done; provided, however, that no such action shall have the effect
of establishing in any district a use or uses not permitted in such district”.
Any questions, please reach out.
Thank you,
Christophe E. Jenkins - Village Administrator/Zoning Administrator

Variance Request Letter - Accessory Building Height
Date: 04/22/2026
To: Village of Fredonia Zoning Board of Appeals
Subject: Request for Variance-Accessory Building Height
Dear Members of the Zoning Board,
I am writing to formally request a variance from the current zoning ordinance for my property
located at 217 N Wilson St.
The ordinance limits accessory structures to a maximum of 1,200 square feet and a height of 15
feet. I am proposing to construct a detached garage measuring approximately 30 feet by 40 feet
(1,200 square feet), with an overall height of approximately 22-24 feet.
Hardship Justification:
The strict application of the 15-foot height limitation creates a practical hardship due to the
unique characteristics of my property and the relationship between the proposed structure and the
existing residence:
1. Topography and Elevation of the Property:
The home is built on a hill with an exposed basement. The proposed garage will be
located to the rear of the home, with its floor set at the basement level. Because of this
elevation difference, a structure limited to 15 feet in height would appear
disproportionately small and inconsistent with the scale of the existing residence.
2. Architectural Compatibility:
The existing home has a pitched roof ( approximately 8/12 pitch). In order for the garage
to match the character and appearance of the home, a pitched roof is necessary. A 15-foot
height restriction would effectively require a flat or minimally sloped roof, which would
not be consistent with the home's design or the surrounding area. The requested height
allows for a properly pitched roof that maintains visual harmony and protects overall
property value.
3. Good-Faith Effort to Minimize Height:
As a good-faith effort to reduce the overall height and visual impact, I am willing to
reduce the garage roof pitch to approximately 6/12. This adjustment lowers the overall
height while still maintaining compatibility with the existing home. Even with this
reduction, the structure cannot reasonably comply with the 15-foot limitation due to
functional roof requirements and the property's topography.
4. Avoidance of Inferior Alternatives:
Without the variance, the only practical alternative would be a flat-roofed or
prefabricated steel structure. Such a structure would be less visually appropriate and more
impactful than a properly designed building that complements the home. The requested
variance allows for a higher-quality strncture that blends with the property rather than
detracts from it.
5. Placement Minimizes Impact:
The garage will be located behind the house, significantly limiting its visibility from the
road and neighboring properties. Due to both its rear placement and the slope of the lot,
the perceived height and visual impact will be reduced.
6. No Adverse Impact on Neighboring Properties:
The proposed strncture will comply with all required setbacks and will not negatively
impact neighboring properties with respect to light, air, or views. The additional height is
solely to accommodate proper roof design and proportionality with the existing home, not
to create additional living space or increase density.
Summary:
The requested variance is necessmy due to the unique topography of the property and to ensure
that the proposed strncture is consistent with the design and scale of the existing home. Granting
this variance will result in a strncture that is more aesthetically appropriate and less visually
intrnsive than alternatives permitted under the cunent ordinance.
I respectfully request your consideration and approval of this variance.
Thank you for your time and consideration.
Sincerely,
Mark Gibb
