reviewed a new zoning change request and CSM from Ms. Hannah Cholip
for her commercial property that is primarily being utilized as a residence.

permit application from a resident on a corner lot.
6. Items for Action and/or Discussion
VILLAGE OF FREDONIA
Find Your Moments Here
a) Motion to Approve Resolution 2026-01: Authorizing the Borrowing of
$821,300 from PWSB to Fund Equipment Purchases and Road
Maintenance made by Trustee Franck.
Seconded by Trustee Syring.
Administrator Jenkins stated that the biennial borrowing package is
strategically structured to spread out debt burden to taxpayers. This will
fund all 2026 approved CIP projects and possible 2027 CIP projects.
Administrator Jenkins explored three borrowing options: the State Trust
Fund, the bond market and local lenders. Port Washington State Bank had
the most competitive offer at 4% interest over ten years. The repayment
structure is front-loaded to pay additional interest in the first year, freeing
up debt capacity for future borrowing. The mil rate for debt impact is
estimated to be increased to .92 from the current .87. Administrator
Jenkins recommends a one-time $20-$30k payment from debt proceeds
to bring the mil rate back down to not affect taxpayers which will be
discussed further with the Finance Committee in advance of the 2027
annual budget. He has been explicit with department heads that the next
two years are going to be lean in terms of capitol purchases until debt
capacity frees up. Trustee Van Roo asked what the benefits to front-
loading the initial payment. Administrator Jenkins responded that it allows
the Village more freedom to manipulate the mil rate.
Passed by 6-0 voice vote.
b) Motion to Approve AI Addition to the Policies and Procedures Handbook
and Employee Handbook made by Trustee Van Roo.
Seconded by Trustee Eippert.
Administrator Jenkins shared that Trustee Van Roo had mentioned an
interest in creating an AI policy for the Village, and Trustee Abegglen had
reviewed and advised the policy through his background in IT. He said the
proposed policy allows AI to compliment the work of an employee, not
replace them. He said several other municipalities have adopted similar
policies. He has drafted an update to both the Employee Handbook and
the Policies & Procedures Handbook. Vendors and contractors must align
with both when working with the Village. Administrator Jenkins shared that
the policy restricts biometric information, emotional analysis, social scoring
or AI decision-making without human input. Trustee Abegglen stated that
he approves of the policy. Trustee Van Roo wished to know who would be
responsible for creating the associated technical documents. Administrator
Jenkins has reached out to Digicorp and the County IT team for
assistance. Trustee Van Roo asked what the sunset procedure would be.
Administrator Jenkins will reassess annually with the Village’s IT team.
Passed by 6-0 voice vote.
c) Discussion and Possible Action on CSM 2026-01
Applicant: Hannah Cholip
Agent: Adam DeGroot, Parish Survey and Engineering
Address: 415 Fredonia Ave; Parcel Numbers 090500506002 and
090500505000
Administrator Jenkins shared that Ms. Cholip purchased a commercially-
zoned property and is using it primarily as a residence. There was ample
evidence in the property listing, seller’s disclosure, and in Village
communications that the use of the property must be primarily commercial
in nature. Shortly after purchasing the property, Ms. Cholip made an
application to keep chickens on her property, it came to the Village’s
attention that the primary use of her property is residential. Ms. Cholip
made an initial rezoning request, which was denied by the Planning
Commission. She returned with a second request and a CSM to adjust the
lot lines of her two adjoining parcels to accommodate RS-3 Single Family
Residential zoning. Administrator Jenkins stated that the Planning
Commission recommends approval of the CSM and rezoning as
presented. He stated RS-3 zoning is the most appropriate zoning district
which would have the least impact to the abutting commercial district and
is allowable in this circumstance because it will be used to rezone an
already-existing parcel. Trustee Franck stated the decision was very
difficult to make and Ms. Cholip was let down by her entire real estate
team. President Lenz stated the Planning Commission begrudgingly
recommended approval and asked if the Village could put conditions on
the future sale of the property to revert to it’s commercial zoning.
Administrator Jenkins said the zoning is what it is until a property owner
requests a change.
Motion to Approve CSM 2026-01, Applicant: Hannah Cholip, Agent:
Adam Degroot of Parish Surveying and Engineering, Address: 415
Fredonia Ave Parcel Number 090500506002 made by Trustee Van Roo.
Seconded by Trustee Abegglen.
Passed by 6-0 voice vote.
Motion to Approve the Rezoning of Parcel Number 090500506002 and
a Portion of Parcel Number 090500505000 From B-1 Central Business
District to RS-3 Single-Family Residential District made by Trustee
Abegglen.
Seconded by Trustee Franck.
Passed by 6-0 voice vote.
d) Discussion and Possible Action on the Purchase of Parcel Number 09-
050-06-24-008. This topic may necessitate a closed session discussion.
Administrator Jenkins stated it was appropriate to adjourn into closed
session because the Village continues to negotiate the purchase of the
parcel.
Motion to Adjourn into Closed Session Pursuant to WI State Statute
19.85(1)(e) "Deliberating or negotiating the purchasing of public
properties, the investing of public funds, or conducting other
specified public business, whenever competitive or bargaining
reasons require a closed session (Purchase of Parcel Number

c) Village Marshal: Marshal Leet had a medical procedure and was unable to
submit a report in time for posting of the agenda packet. He shared that he

VILLAGE OF FREDONIA

d) Fire Chief: Chief Weyker said his team took advantage of the heavy truck
traffic in the area and was able to find a truck to perform excavation
training techniques on. He shared a new report with the Board, explaining
that the metrics will evolve as the team becomes more comfortable with
manipulating the data available. He highlighted the significant drop in
response times since the paramedic program became fully staffed: a
difference of nearly five minutes to get an emergency crew on-site.
e) DPW Director: Director Paulus shared that the DNR has completed its
sanitary survey of the Village’s water system, and for the first time in the
audit’s history, found zero deficiencies.
f) Village Clerk: Clerk Johnson stated that absentee ballots have been
mailed and will continue to be sent out as applications come in. She and
Treasurer Upson conducted in-person absentee voting at Forest Haven.
They were so busy they made two trips to ensure that each resident had
an opportunity to register and/or vote. She has completed the election day
schedule with her team of election inspectors. Polls will be open Tuesday,
April 7, 2026, from 7:00AM-8:00PM. In-person absentee voting begins on
March 24. She shared the team continues to explore grant opportunities
and has applied for Congressionally Directed Spending to offset the cost
of the fire truck purchase. She is working on the next alcohol licensing
cycle. Applications have been changed again for the third time in four
years. She will work closely with applicants and anticipates a smoother
process in the future. The newsletter has been completed a week in
advance and will be mailed with the water bills.
g) Village Treasurer: Treasurer Upson sent dog license reminders to 51
residents and has had 28 responses so far. She will send another
reminder after the deadline of March 31
st. She continues to work on the
accounts receivable module for billables. The audit is ongoing, and CLA
has been wonderful to work with so far.
h) Building Inspector: Not present, no report on file.
i) Ozaukee County District 2 Supervisor: Not present, Supervisor Paape
shared via Clerk Johnson that Wednesday, March 18
th, 2026 was Youth
Government Day at the Ozaukee County government buildings.
6. Items for Action and/or Discussion
a) Discussion and Possible Action on The Creation of a New Zoning District;
Sponsored by Trustee Van Roo.
Trustee Van Roo would like the Board to consider the creation of a new
zoning district that would allow lot sizes ½ to ¼ smaller than the smallest
existing current allowable lot sizes. He said these micro lots would
accommodate a tiny home or trailer. He also thought a new zoning district
could support household occupations. Trustee Van Roo said it was
important to consider flexibility and the affordability factor of smaller parcel
sizes. Clerk Johnson added some context: she shared examples of RS-2
and RS-3 zoning district parcel sizes. She said that RS-3 is currently the
smallest lot size of 8,000 sq. ft. and requires a dwelling of at least 1,080
sq. ft., however, it is no longer allowed to be created. An easy solution to
Trustee Van Roo’s proposal could be to simply reinstate the zoning district.
She said that just because a zoning district exists doesn’t mean a
community must utilize it. Administrator Jenkins has reached out to like-
size communities and found that some are exploring smaller zoning
districts and ADU’s, but staff is waiting on direction from the Board to
invest more time in the project. She shared that creating a new zoning
would require a lot of work at the Planning Commission level and staff
would need to revisit the Comprehensive Plan. President Lenz said lot
sizes smaller than RS-3 would not accommodate a home that meets the
needs of a family. Trustee Syring had concerns about the limited value that
would be added to the Village if it approved a zoning district that would
accommodate trailers versus the burden those trailer homes would place
on the Village utilities. Trustee Van Roo does not see a negative to looking
into his request. Trustee Franck stated the Village would be wasting
resources and would not consider a new zoning district without first
looking at the Comprehensive Plan. President Lenz agreed there is a cost
associated with the exploration of a new zoning district. President Lenz did
not hear a consensus amongst the trustees on a path forward and so
asked for a motion.
Motion to Refer the Creation of a New Zoning District and
Exploration of the Reinstatement of the RS-3 Single Family
Residential Zoning District made by Trustee Van Roo.
Motion failed for lack of second.
7. Correspondence: None
8. Items for Future Consideration: None
9. Motion to Adjourn made by Trustee Syring.
Seconded by Trustee Franck.
Passed by 6-0 voice vote.

Fiscal Summary: $5,816.48
Budget Line Item: N/A
Wisconsin Statute or Local Ordinance: Ordinance 60-13
Background Analysis: Per our Ordinances, sidewalk is required to be installed on one side of
each road in the village. As part of the scope of work on the Washington Ave reconstruction project,
sidewalk repair and replacement are occurring, along with improvements to crosswalks.
Historically, the Village has assessed 50% of the cost of sidewalk improvements to private property
owners following the process laid out in Fredonia Ordinances and State Statutes.
Staff Comments: Whether the Village wishes to specially assess and recoup the dollars for
sidewalk is up to the appetite of the Village Board. Also, whether we cover 50% or charge a
different amount to the property owner, is up to us. Property owners are not responsible when it’s a
direct replacement of sidewalk effected due to utility upgrades. As part of the assessment process,
notices will be sent, a public hearing set, and a payment structure to allow either payment in-full or
split over 5 years. In total, the Village will recoup $5,816.48.
Attached are the engineers report and breakdown of costs assessed to each property, along with
the initial resolution.

curb and gutter. If a machine is used, the resulting curb and gutter shall be of such a quality
as to equal or exceed that produced by the method described above.
B. Curb and gutter where required for street construction, site Work construction, or for
restoration of utility construction shall be placed using forms or a machine to the dimensions
and shape shown on the Drawings. Where curb and gutter details are not provided, curb
and gutter shape and dimensions shall match existing adjacent curb and gutter.
3.07 DRIVEWAY OPENINGS
A. The details for concrete gutter section through a driveway are shown on
the Drawings.
3.08 JOINTING–CURB AND GUTTER
A. A 3/4-inch expansion joint filler shall be placed through the curb and gutter at the radius
points of all intersection curbs, at storm inlets, and at a maximum interval of 250 feet. This
expansion joint filler shall extend through the entire thickness of concrete and shall be
perpendicular to the surface and at right angles to the line of the curb and gutter.
B. At intervals of not more than 10 feet, a contraction joint shall be tooled to a depth of one-fifth
of the total concrete thickness with a 1/4-inch-radius jointer. The contraction joint shall be at
right angles to the line of the curb and gutter.
C. If machine-formed curb and gutter is provided by CONTRACTOR, CONTRACTOR shall
create a plane of weakness at all joints that is sufficient to cause contraction cracking at the
joints.
Section 32 16 13-4
3844.023/1-2026
D. CONTRACTOR may saw contraction joints. The depth of cut shall be a minimum of one-fifth
of the total concrete thickness. Sawing shall be done as soon as practicable after the
concrete has set sufficiently to preclude raveling during the sawing and before any shrinkage
cracking takes place in the concrete. If this method results in random cracking,
CONTRACTOR will be required to tool the contraction joints as specified above.
E. Steel separator plates of a section conforming to the curb and gutter as shown on the
Drawings shall be placed directly opposite all contraction joints in abutting street pavement.
After separator plates have been removed, the edges of the joints shall be rounded with a
1/4-inch radius edge. The use of steel separator plates at other locations will not be allowed.
F. Jointing shall be included in the price bid for curb and gutter.
3.09 JOINTING–SIDEWALKS AND DRIVEWAYS
A. Concrete sidewalk shall be segmented into 5-foot-long rectangular blocks with tooled joints.
Concrete driveways shall be segmented into uniform rectangular blocks with tooled joints at
a maximum spacing of 10 feet in each direction. The joint must extend at least one-fifth of
the total thickness of concrete. The edges of the sidewalk along forms and joints shall be
rounded with an edging tool of 1/4-inch radius. All joints shall be at right angles to the
centerline of the sidewalk.
B. Concrete driveways shall be jointed in approximately square sections. The depth of the joint
and the finishing of the edges shall be the same as for concrete sidewalk.
3.10 EXPANSION JOINTS
A. A 1 /2-inch-thick asphaltic expansion join t filler shall be placed at sidewalk-driveway
intersections, between sidewalks and buildings, between back of curb and sidewalk, at
intersection between new or existing curb and gutter, around all castings, and at maximum
96-foot intervals in sidewalks.
3.11 SLOPE
A. Sidewalk cross slope shall be 1.5 percent unless otherwise noted in the Drawings or
requested by ENGINEER.
3.12 CURB RAMP
A. Curb ramps shall have a maximum slope of 7 percent, with maximum grade changes of
11 percent at curb to ramp transitions, and be provided with a truncated dome patterned
surface meeting ADA requirements and as shown on the Drawings.
3.13 INLET CASTING ADJUSTMENT
A. Inlet casting shall be adjusted to grade as required for the installation of the new curb and
gutter. Inlet casting backs shall be adjusted for a depressed flow line at all inlets in the low
points (0.72 feet); all other inlet shall be adjusted for a normal flow line (0.50 feet).
Section 32 16 13-5
3844.023/1-2026
3.14 CURING
A. As soon after finishing operations as the free water has disappeared, the concrete surface
shall be sealed by spraying on it a uniform coating of curing material in such a manner as to
provide a continuous water impermeable film on the entire concrete surface.
B. The material shall be applied to form a uniform coverage at the rate of not less than
one-half gallon per 100 square feet of surface area.
C. Within 30 minutes after the forms have been removed, the edges of the concrete shall be
coated with the curing compound applied at the same rate as on the finished surface.
3.15 PROTECTION OF CONCRETE
A. CONTRACTOR shall erect and maintain suitable barricades to protect the new concrete.
Where it is necessary to provide for pedestrian traffic, CONTRACTOR shall, at their own
cost, construct adequate crossings. Crossing construction shall be such that no load is
transmitted to the new concrete.
B. Any part of the work damaged or vandalized prior to final acceptance shall be repaired or
replaced at the expense of CONTRACTOR in a manner satisfactory to ENGINEER.
C. Pedestrian traffic shall not be permitted over new concrete prior to 72 hours after application
of curing material. Vehicular traffic shall not be permitted over newly placed concrete until a
minimum compressive strength of 3,000 psi has been achieved.
3.16 CONCRETE TESTING
A. The following tests of fresh concrete shall be performed by CONTRACTOR. CONTRACTOR
shall prepare, protect, transport, and have tested all cylinders at its expense.
1. Sampling of concrete for slump tests, air tests, temperature tests, and for making
concrete test cylinders shall be performed in accordance with ASTM C172.
2. Cylinders:
a. Three test cylinders shall be made for each pour less than 25 cubic yards, four test
cylinders shall be made for each pour between 25 and 100 cubic yards, and
eight test cylinders shall be made for each pour in excess of 100 cubic yards. Each
concrete mix shall be represented by at least four cylinders for the entire job.
Concrete for cylinders shall be collected near the middle of the load and/or as
requested by ENGINEER.
b. Cylinders shall be made and tested in accordance with ASTM C31 and ASTM C39,
respectively. The cylinders must be kept moist and at temperatures between 60 qF
and 80qF and shall remain undisturbed and stored in a location free from vibration.
In hot weather, the cylinders shall be covered with wet burlap and stored in a shaded
area. It is CONTRACTOR’s responsibility to provide a suitable protected location for
storing cylinders on the jobsite.
c. After 24 hours, the cylinders shall be transferred to an independent testing
laboratory acceptable to OWNER. The cylinders shall be packed in sawdust or other
cushioning material for transit to avoid any bumping or jarring of the cylinders.
d. Cylinders shall be broken at 7 and 28 days or as requested by ENGINEER. Test
results shall be transmitted immediately and directly to ENGINEER and OWNER.
