President Lenz called the meeting to order at 7:00 PM, followed by the Pledge of Allegiance. 2. Trustees Present: President Lenz, Trustee Abegglen, Trustee Franck, Trustee Syring, Trustee Eippert, Trustee Van Roo. Staff Present: Administrator Jenkins, Treasurer Upson, Clerk Johnson, Foreman Heinen, Chief Weyker, Marshal Leet 3. Public Comments: None 4. Motion to Approve Minutes of the February 5th, 2026, Village Board of Trustees Regular Meeting, and General Fund, Water and Sewer Invoices made by Trustee Abegglen. Seconded by Trustee Franck. Passed by 6-0 voice vote. 5. Presentations a) Presentation from Administrator Jenkins on Unaudited 2025 Financials. Administrator Jenkins shared the unaudited end-of-year financials for 2025. He said the budget is a best guess and mid-year adjustments are made based on actual revenues and expenditures. He reviewed revenues and expenditures from each fund. Administrator Jenkins said each annual budget commits money to be added to the Village’s fund balance. There is approximately $110,000 in the 2025 budget to be rolled over into fund balance. 6. Report on Village Operations by: VILLAGE OF FREDONIA Find Your Moments Here a) Village President: President Lenz shared the Joint ALS-Paramedic Program is fully staffed for the first time and providing a greater level of safety to the Village and partner communities. He said that strategic investment in equipment, like the sewer vac and blowers, allowed the DPW to easily respond to the breakdown of the primary clarifier at the WWTP. b) Village Administrator: Administrator Jenkins met with Ramboll Environmental and shared that, while the contamination plume in the Stoney Creek subdivision is stable, the DNR has requested vapor intrusion testing at homes within 100 feet. He anticipates another year before the lots can begin to be sold. A business, Greazille, is exploring the purchase of 755 Tower Dr., currently a vacant building. Director Paulus has determined that the WWTP can tolerate contaminants that the company may discharge into the system. Fredonia First is gaining momentum and the draft developer’s agreement with Hillcrest is moving forward. Administrator Jenkins is working with Ehlers and Port Washington State Bank on the upcoming bond package to fund the projects the Board has approved for 2026 and 2027. PWSB had the best terms: 4% over a ten-year period. He highlighted the ways in which Village staff finds ways to save money, and used an example of DPW crews rebuilding a hydrant instead of purchasing a new one. McMahon has presented the results of the Fire & EMS study to the participants, and it will be brought to the governing bodies of each municipality at a joint meeting in April. Administrator Jenkins continues to explore grant opportunities including with the Lake Michigan Alliance that could help with stormwater management plans, WEDC opportunities to fund bathrooms at Freedom Park, AARP grants to fund pedestrian safety, and federal opportunities to help fund the purchase of a fire truck. c) Village Marshal: Marshal Leet said that January and February are slow months for his department. He encourages the Board to reach out to him with any special projects they may want him to work on, including ordinance updates. He also stated that he is planning speeding enforcement along Fillmore St. Fredonia Ave for spring. Trustee Van Roo asked about a recent law enforcement action at Spring Hill Apartments. Marshal Leet said it was not his team responding and was unaware of the issue. d) Fire Chief: Chief Weyker shared that no new volunteers were on-boarded in January. The paramedic program is fully staffed for the first time, a huge weight off his shoulders. The McMahon study had no surprises for him; the findings indicate that joint training should be prioritized and a reduction of equipment across northern Ozaukee County would be appropriate. He reviewed January’s call volumes. Trustee Syring asked if Chief Weyker plans to start tracking mutual aid calls separately. He does and is working out how to effectively do that. e) DPW Director: Foreman Heinen said that Director Paulus’s report is on file. f) Village Clerk: Clerk Johnson shared that the website migration has stalled due to problems separating Village and Town content. Civic Plus has scheduled a meeting of all relevant managers, and she is hopeful they will identify a resolution. Trustee Van Roo asked if staff has explored other vendors and if the continued delays are costing the Village money. Clerk Johnson said staff negotiated the same rates as the previous contract and the existing website can stay up until midyear. The delays are frustrating but are not costing the Village any money and there will be no disruptions in service. Administrator Jenkins reminded the Board that the Village did not request the migration and is required to move the website to a new platform. He has investigated other vendors, but Clerk Johnson felt that Civic Plus is the gold standard for municipal websites, even though this experience doesn’t speak to that. Clerk Johnson worked with the Village’s legal team, the WEC and county on the ballot for the Spring election and it has gone to print. IPAV begins on March 24. g) Village Treasurer: Treasurer Upson has been working on implementing new billing software that will more effectively invoice for Village services such as the lab. She said the CLA auditors have been wonderful to work with, and she is making many of the adjustments that Baker Tilly did in the past. She hopes that future audits will be more of a true audit, instead of auditors doing bookkeeping. h) Building Inspector: Not present, report on file. i) Ozaukee County District 2 Supervisor: Not present, report on file. 7. Items for Action and/or Discussion a) Motion to Award Project 2026-02: Fillmore and Soney Creek Park Parking Lots and Fillmore St. Culvert Project to Ozaukee County Highway Department, Not to Exceed $65,120.00 made by Trustee Syring. Seconded by Trustee Franck. The Public Works Committee approved foregoing the public bid process and instead went directly to the Ozaukee County Highway Department for a quote to reconstruct Fillmore St. and Stoney Creek parking lots. The Village budgeted $62,000.00 for the project and county quoted $65,120.00. Administrator Jenkins added that Village crews can take on a portion of the work to bring the cost of the project within the budgeted amount. In addition, the County will replace a failing culvert that crosses Fillmore St. The culvert will take at least a year to settle before any resurfacing or reconstruction of Fillmore Street can occur. Passed by 6-0 voice vote. b) Discussion and Possible Action on the Emergency Purchase of a Replacement of a 2006 Sterling Snowplow Truck with Salter. Administrator Jenkins and Director Paulus reached out to local snow removal contractors. None were willing to plow just a portion of the Village; however, they did provide quotes for the entire Village. Treasurer Upson used their quotes for equipment, salt and labor and the Village’s actual costs for equipment, salt and labor to create a cost-per-snow event. The Village had approximately 25 plowable snow events this winter. Treasurer Upson calculates that the Village would pay $160,000 to an external contractor to handle those 25 events; the Village’s cost to respond to those events would be $66,000. Trustee Franck expressed concern regarding damage to roads and private property if using an outside contractor. Trustee Syring reached out to truck dealers and the least expensive option he was able to find was $293,000. He thanked Director Paulus for finding the Village a competitive price. Administrator Jenkins recommended paying for the truck from 2026 cash reserves: 30% from the CIP Fund, 20% from the Sewer Fund, and 50% from the Water Fund. The 2026 budget has approximately $156,000 earmarked for reserves and he recommends transferring 30% of the cost of the truck to the CIP Fund from the money set aside for reserves. Trustee Van Roo thanked staff for conducting the research into private contractors. Motion to Approve the Emergency Purchase of a Replacement Truck and Plow System Not to Exceed $271,000; 30% From the CIP Fund, 50% From the Water Fund, and 20% From the Sewer Fund made by Trustee Franck. Seconded by Trustee Van Roo. Passed by 6-0 voice vote. c) Discussion and Possible Action on Crosswalk Safety. Administrator Jenkins, Director Paulus, and Village Engineer Isak Fruchtman identified three potential locations along Fredonia Ave. for enhanced crosswalk safety measures: the intersections at S. Milwaukee St, S. Wilson St., and Wisconsin St. The northwest and southwest sides of S. Wilson St is the most likely candidate to receive enhanced crosswalk safety measures, including a RRFB crosswalk sign. Wisconsin and Milwaukee Streets do not have sufficient space to accommodate ADA requirements and would need a “bump-out” into Fredonia Ave. Administrator Jenkins stated that Director Paulus strenuously objected to any bump-out into Fredonia Ave. Snow removal operations and road work would be more dangerous and difficult to accomplish with bump-outs. The Village would have to purchase some part of the right-of-way from Brouillette Back & Neck Clinic to install a RRFB crosswalk at Fillmore St. Administrator Jenkins shared that the light-up sign is not the only safety enhancement the Village can make. Staff can paint crosswalks using highly visible techniques at very little cost. Motion to Approve Installation of RRFB and Improved Pedestrian Crosswalk Signage at the Northwest and Southwest Intersection of S. Wilson St. and Fredonia Ave made by Trustee Abegglen. Seconded by Trustee Franck. Passed by 6-0 voice vote. 8. Correspondence: None 9. Items for Future Consideration: None 10. Motion to Adjourn made by Trustee Syring. Seconded by Trustee Franck. Passed by 6-0 voice vote. With this equipment being purchased and reconstruction numbers secured, we can now bond for this debt. PWSB gave us the most competitive offer at 4% over 10 years – resulting in a mill rate breakdown as provided by Ehlers as attached. Staff Comments: As a reminder, due to State levy limits, municipalities may not increase their general tax levy to gain “extra cash”, which results in us either going to referendum to increase the general levy, or take on debt when making large capital purchases. We have been strategically balancing debt financing as to not impact taxpayers with large spikes or declines. This latest borrowing is front-loaded, meaning a large payment is due the first year, and then shrinks over the term of the loan, allowing us to continue this path. Administrator’s Recommendation: Approve Action Requested: Motion to Approve Resolution 2026-1: A RESOLUTION AUTHORIZING BORROWING FROM PORT WASHINGTON STATE BANK Attachments: 1. Resolution 2026-1 2. Ehlers Projected Debt Service Impact VILLAGE OF FREDONIA Find Your Moments Here I • RESOLUTION 2026-01 A RESOLUTION AUTHORIZING BORROWING FROM PORT WASHINGTON STATE BANK WHEREAS, pursuant to Wis. Recently, sample policies were shared by the City of Cedarburg, which adapted its framework primarily from the GovAI Coalition, an organization specializing in best practices for governmental use of AI technologies. Staff Comments: These draft policies were reviewed by me, legal counsel, and Trustee Richard Abegglen, who has a background in information technology. Trustee Van Roo has also emphasized the importance of proactively establishing processes to guide the responsible use of these tools. If adopted, these policies would create both a new section within the Employee Handbook and a standalone Village policy, making the standards enforceable moving forward. At present, staff have utilized Microsoft’s built-in AI tools, such as Copilot, as well as platforms like ChatGPT, primarily for document and email review and editing. Administrator’s Recommendation: Approve Action Requested: Motion to Approve Adoption of Village Policy 4-3 and Employee Handbook Section VII-A, Pertaining to Use of Artificial Technology (AI) Attachments: 1. Village Policy 4-3: Artificial Intelligence (AI) Policy 2. Employee Handbook Section VII-A: USE OF ARTIFICIAL INTELIGENCE (AI) VILLAGE OF FREDONIA Find Your Moments Here I • 1 Artificial Intelligence (AI) Policy Village of Fredonia I. Purpose This policy establishes a governance framework for AI systems utilized by, or on behalf of, the Village of Fredonia. It ensures that AI systems benefit the community while mitigating potential risks. The key objectives of the AI Policy are to: • Provide clear guidance for Village staff, including full-time, part-time, interns, consultants, contractors, partners, and volunteers involved in purchasing, configuring, developing, operating, or maintaining AI systems for the Village of Fredonia. • Ensure that AI systems adhere to the strategic goals, reflecting the Village’s values in how AI systems are acquired, configured, developed, operated, and maintained. • Define roles and responsibilities for the Village’s use of AI systems. • Establish processes to assess and manage risks associated with AI systems. • Align AI governance with the Village’s existing data governance, security, and privacy measures in coordination with the Village’s IT provider. • Define prohibited uses of AI systems. • Establish procedures to safely retire AI systems that no longer serve the Village’s needs. • Ensure AI usage aligns with applicable local, state, and federal laws, as well as Village policies. The Village defines “artificial intelligence” as a machine-based system that, for given human- defined objectives, can make predictions, recommendations, or decisions influencing real or virtual environments. AI systems process data through automated analysis, creating models that can inform or perform actions. An “AI system” includes any data system, software, hardware, application, tool, or utility that functions, in part or in full, using AI. II. Scope This policy applies to: 1. All AI systems used by the Village or it’s vendors that provide AI solutions for the Village. III. Guiding Principles for Responsible AI Systems 1. Human-Centered Design: AI systems prioritize the public’s well-being and are evaluated for community impact. 2. Security & Safety: AI systems safeguard confidentiality, integrity, and availability, ensuring reliability and minimizing risks to individuals, society, and the environment. 3. Privacy: AI systems protect personal and sensitive data from unauthorized access, disclosure, and manipulation. 2 4. Transparency: AI systems' purposes and usage are communicated to the public, with data sources, models, and governing policies documented and accessible. 5. Equity: AI systems support fair outcomes, mitigating biases to reduce harm to affected individuals. 6. Accountability: Roles and responsibilities in AI deployment and maintenance ensure adherence to laws and regulations through human oversight. 7. Effectiveness: AI systems meet their intended objectives, delivering reliable and accurate outcomes. 8. Workforce Empowerment: Village staff are trained and supported in using AI through education and collaboration. IV. Roles & Responsibilities • Village Administrator: Responsible for overseeing technology resources, policies, projects, and services, including those related to AI. • Village Administrator (via IT consultant): Oversees enterprise security infrastructure, cybersecurity operations, and ensures compliance with Village security policies. • Village Administrator (via IT consultant): Manages digital privacy practices and responsible technology use, ensuring compliance with privacy policies for AI systems. • Village Departments: Responsible for adhering to this policy and its updates and ensuring annual compliance checks. • Village Administrator: Notifies departments of any policy updates. • Village Attorney: Advises on legal risks associated with AI use. • Village Administrator: May inspect and direct adjustments to AI system usage by departments or partners. • Village Treasurer: Oversees procurement of AI systems, ensuring vendors comply with Village standards. V. Policy When managing AI systems, the Village will: 1. Uphold the Strategic Priorities. 2. Conduct an AI Review, coordinated by the Village administrator, to assess risks. 3. Obtain or create technical documentation (e.g., AI FactSheet) for AI systems. 4. Require contractors to comply with applicable legal standards and documentation. 5. Follow an Incident Response Plan in the event of an AI-related incident, overseen by the Village Administrator or designee. 3 Prohibited Uses Certain AI applications are prohibited due to high sensitivity and risk, including: • Real-time covert biometric identification. • Emotion analysis based on computer vision. • Fully automated decision-making with no human oversight and substantial individual impact. • Social scoring of individuals. • Manipulation of vulnerable groups through cognitive or behavioral methods. • Autonomous weapons systems. Staff are required to notify their supervisor and the Village Administrator of any incident in which an AI system causes harm, error, or unintended negative consequences. Sunset Procedures If an AI system ceases to benefit Fredonia residents, its usage must be halted unless an exception is granted by the Village Administrator or Village Board. If an abrupt halt would disrupt Village services, a gradual phase-out shall occur. Public Records The Village adheres to public records laws and retains and discloses records per current procedures. Policy Enforcement All Village staff and vendors involved with AI systems must comply with this Policy. VI. Violations of the AI Policy Non-compliance with the AI Policy, may result in disciplinary action, up to termination. Third- party violations may lead to contract breaches or damages. Legal violations may be referred to authorities. VII. Terms & Definitions Artificial Intelligence: Machine-based system for making predictions, recommendations, or decisions. Algorithm: Series of logical steps to transform inputs into outputs. AI System: Includes any system automating processes or analyzing data with minimal human input. 4 VIII. Acknowledgment This policy was created with GovAI coalition templates. This policy reflects efforts of over 150 state and local agencies committed to ethical, community-centered AI use. SECTION V11-A: USE OF ARTIFICIAL INTELIGENCE (AI) The Village recognizes that the use of AI tools can potentially assist employees with the performance of job duties. However, there are many risks. To ensure the protection of confidential information and the integrity of our operations, as set forth below, all employees who wish to use AI tools must receive management approval and, if granted, comply with the below best practices. (a) Evaluation of AI tools. Employees must evaluate the utility and security of any AI tool before using it. This includes reviewing the tool's security features, terms of service, and privacy policy. Employees should also review the reputation of the tool developer and any third-party services used by the tool. But most importantly, employees must receive management approval prior to using any AI tool after explaining the manner in which it will be used and the benefits to the Village. (b) Protection of confidential data. In using any AI tool, employees must not upload or share any confidential, proprietary, or protected data without prior written approval from IT Director. This includes data related to customers, employees, or partners. Similarly, employees must ensure any AI tool does not utilize confidential or copyrighted information of a third party. (c) Access control. Employees must not give access to any AI tools approved for Village use to anyone outside the Village without prior approval from the Administrator and implementation of processes as required to meet security compliance requirements. This includes sharing login credentials or other sensitive information with third parties. (d) Compliance with security policies. Employees must apply the same security best practices we use for all Village and customer data. This includes using strong passwords, keeping software up-to-date, and following the Village's data retention and disposal policies. Request for Board Consideration Item Description: 415 Fredonia Ave CSM and Re-Zoning Request Report Prepared By: Admin Jenkins Report Date: 3-3-2026 Meeting Date: 3-5-2026 Strategic Priority? o Smart Residential, Industrial, or Commercial Growth o Responsible Fiscal Priority o Supports Public Safety and Infrastructure o Encourages Open Communication and Collaboration o Strong Sense of Community Fiscal Summary: N/A Budget Line Item: N/A Wisconsin Statute or Local Ordinance: N/A Background Analysis: Ms. Hannah Cholip has submitted a request related to the property at 415 Fredonia Avenue that includes a preliminary Certified Survey Map (CSM) and a proposed zoning map amendment. The request involves reconfiguring two adjoining parcels and rezoning the parcel containing the existing residence from B-1 Central Business District to RS-3 Single-Family Residential District. This request follows enforcement concerns regarding residential use occurring as the primary use within the B-1 zoning district. Two actions are proposed: 1. Review and potential approval of the preliminary CSM 2. Consideration of a zoning change These were recommended for approval by the Plan Commission 5-1 at the March 2 nd, 2026 meeting. Background: 415 Fredonia Ave is a B-1 zoned commercial property. In 2023, the Village approved the division of this parcel from its parent parcel to the west, which currently houses a hair salon and a nail business. B-1 zoning allows for residential uses only when they are accessory to a business. In other words, the residence was originally intended as living quarters for the businesses next door. When the property was split, the Plan Commission acknowledged that it could not be used solely for residential purposes under B-1 zoning, and the original property owner did not request a rezone at that time. The property was last listed for sale in July 2024 as a commercial property. Attached are the "Commercial" disclosure and MLS listing, which invites prospective buyers to “bring your business,” along with the special assessment letter from our staff confirming its commercial designation and residency restrictions. VILLAGE OF FREDONIA Find Your Moments Here I • Additionally, earlier in 2024, an inquiry was made about purchasing the property as a residential home. After consulting with staff, the potential buyer opted not to proceed due to the zoning restrictions. All these documents and efforts indicate a commercially-listed property. In August 2024, Ms. Hannah Cholip purchased the property with the intention of using it solely as a residence, despite several indications that this was not in compliance with the zoning. In October 2024, Ms. Cholip contacted to Village Hall to apply for a chicken permit, at which point it became clear that she had purchased the property with the intent of using it as a home. (Note: chickens are not allowed on business-zoned properties). Both Ms. Cholip and her realtor were informed of the zoning restrictions, and we provided information on potential business uses for the property alongside residential use. After a period of time, the Village Marshal and I reached out to Ms. Cholip for a status update and conducted a zoning inspection, the results of which are attached. The inspection found that a minimal effort had been made to establish a compliant business by repurposing one room into an office space. Despite this effort, it remained evident that the primary use of the property is as a residence. Ms. Cholip was given three options: 1. Start an appropriate business, 2. Request a rezone, or 3. Begin the sale and evacuation of the property. Ms. Cholip has now chosen to apply to adjust her property lines and rezone a portion of her property to allow primarily residential use for her property while keeping the bordering property commercial for future use. Staff Comments: The Village’s long-range Comprehensive Plan designates properties along Fredonia Avenue in the center of the Village as a commercial corridor. The vision has been to cultivate and develop a cohesive “downtown” district over time. In 2023, the Plan Commission acted in alignment with that vision when it split the property and retained its commercial designation. The 2026 recommendation by the current Plan Commission regarding 415 Fredonia Avenue represents a departure from that previously established direction and the Village’s Comprehensive Plan. Decisions that contradict the Village’s adopted Comprehensive Plan should be made thoughtfully and with full consideration of their long-term implications. If approved, the Village would rezone the property to a classification that is inconsistent with the Comprehensive Plan, thereby permitting Ms. Cholip to reside at the property without restriction. The structure was originally constructed as a single-family residence, and no exterior or structural modifications would be required for continued residential use. If denied, the Village would need to consider pursuing enforcement action, which could include litigation related to the improper use of the property. As Zoning Administrator, my responsibility is to administer and uphold the adopted zoning code and Comprehensive Plan. Based on those obligations, I recommend denial of the requested change. Should the Board choose to approve the amendment, it would further reinforce the need to formally revisit and update the Comprehensive Plan to ensure it reflects the Village’s current vision and long-term development goals. My commission expires 5-15-2029 From the Desk of: Christophe E. Jenkins Village Administrator 415 Fredonia Avenue New CSM and Re-Zoning Request 1-28-2026 Commissioners, Ms. Review and potential recommendation to the Village Board of the preliminary CSM (Plan Commission recommendation followed by final action by the Village Board). 2. Consideration of a zoning change (Plan Commission recommendation following a public hearing; final action by the Village Board). Certified Survey Map A draft CSM prepared by Adam DeGroot of Parish Surveying and Engineering reallocates approximately 4,300 square feet from Proposed Lot 1 to Proposed Lot 2. This adjustment allows the parcel containing the existing residence to meet the minimum lot area, frontage, and setback requirements of the RS-3 zoning district. The remaining parcel (Proposed Lot 1) would retain its B-1 zoning and be configured as a flag lot, with potential access from Fredonia Avenue. While the parcel meets minimum dimensional standards under the zoning code, its layout may limit viable commercial development options. Rezoning The proposed rezoning of the residential parcel from B-1 to RS-3 is inconsistent with the Village’s Comprehensive Plan. The remaining parcel retaining B-1 zoning would remain consistent with the plan; however, its configuration and adjacency to residential uses may impact future commercial use or marketability. Staff Comments If the Planning Commission has an appetite to consider the requested rezoning, a public hearing should be set for March 2 nd, 2026 at 7:00PM. Staff recommend handling both the CSM request and the rezoning request in unison. A recommendation for both items may be made at the March VILLAGE OF FREDONIA Find Your Moments Here 2nd Planning Commission meeting following the public hearing. Staff are seeking direction and feedback from the Plan Commission regarding the acceptability of the proposed CSM and whether there is interest in considering a rezoning request that is inconsistent with the Comprehensive Plan. Deviation from the Comprehensive Plan may require an amendment to the Plan as part of the rezoning process. This feedback will assist the applicant and her consultants in determining how to proceed. Please contact staff with any questions prior to the meeting. Thank you, Christophe E. THE PROPOSED ADJUSTED CSM LOT 2 WILL CREATE AN RS-3 ZONE COMPLIANT RESIDENTIAL LOT. THE PROPOSED CSM LOT 1 WILL STAY IN THE B-1 ZONING DISTRICT, AND MEETS ALL ZONING REQUIREMENTS. USE STATEMENT THERE IS NO CONTEMPLATED CHANGE OF ACTUAL USE. THE EXISTING HOUSE AT 415 FREDONIA AVENUE HAS HISTORICALLY BEEN UTILIZED AS A RESIDENTIAL DWELLING. PRIOR TO THE 2023 LAND DIVISION OF CSM #4213 THIS DWELLING WAS A PERMITTED ACCESSORY USE IN THE B-1 ZONE. AFTER THE LAND DIVISION AND THE SALE TO CHOLIP, THE RESIDENTIAL USE WAS DEEMED NON-COMPLIANT BECAUSE OF A NON-EXISTENT OR UN-ACCEPTABLE BUSINESS USE OR OCCUPANCY. THE FUTURE INTENT IS TO CONTINUE THE HISTORICAL RESIDENTIAL USE. ZONING CHANGE STATEMENT THE 2023 LAND DIVISION OF CSM #4213 DIRECTLY CREATED THE SCENARIO WHERE A NON-COMPLIANT USE COULD ARISE. THE PLAN COMMISSION WAS AWARE OF THIS, AND STATED IN THE 11/07/2022 MINUTES "IT WAS NOTED THAT THE HOUSE IS CURRENTLY ZONED B-1 AND CANNOT BE USED SOLELY OF LIVING QUARTERS; HOWEVER SOMEONE CAN LIVE THERE AS LONG AS THERE IS BUSINESS ACTIVITY AS WELL." THE SURROUNDING PROPERTIES COMPRISE A MIXED-USE AREA. OF THE EIGHT (8) ADJOINING PROPERTIES, SIX (6) ARE ZONED RESIDENTIAL USE. IT IS UNDERSTOOD THAT THE VILLAGE CHERISHES ITS LIMITED B-1 CENTRAL BUSINESS DISTRICT ZONING AREAS. THIS ZONE CHANGE TO RS-3 WOULD KEEP THE ACTUAL HISTORICAL RESIDENTIAL USE OF ADJUSTED LOT 2, WHILE PRESERVING A VACANT MARKETABLE B-1 BUSINESS PROPERTY WITH THE PROPOSED LOT 1. Adam DeGroot, PLS - Parish Survey & Engineering, LLC adegroot@parishse.com 541-580-2675 To Whom It May Concern, My name is Hannah Cholip and I am applying to get my property, 415 Fredonia Ave, Fredonia, Wisconsin 53021, rezoned. I am a nurse at a hospital in the area. I bought this property in August and it was my first home buying experience. I closed on the property and a short time later attempted to apply to have chickens on my property. I was informed by the village clerk that my property was zoned as commercial therefore I could not have chickens. It was not clear to me that I was purchasing a commercial property. I have never owned a business and never intended to start a business. There is a house and a garage on the property and I am currently using it as a residence. It not only benefits me personally to have it rezoned but the community as well. A property benefits a community more as residential because it provides a stable housing base for residents, which can lead to increased community engagement, improved local services, a stronger sense of belonging, and a more vibrant local economy by supporting nearby businesses and contributing to the tax base. I want to contribute to the community and make this my home. This property does not resemble a business, it resembles a home, therefore it would be better used as a residential property than a commercial property. Mr. Lundberg stated that a variance will be needed to allow only 30 parking stalls; currently Village code would require 1 parking space per 250 square feet of building area which would calculate to 36.4 parking stalls. It was noted that JT Engineering did a review of the submitted plans. Comments and recommendations from JT Engineering were given to Mr. Lundberg. Motion by Gerry Weiland, seconded by Jerry Jacque, to approve the Dollar General Plans contingent on completion of the punch list items from JT Engineering. Motion carried. Motion by Trustee Long, seconded by Dan Wellskopf, to recommend the Board of Appeals approve a variance to reduce parking requirements from 36.4 parking stalls to 30 parking stalls. Motion carried. Review and approval of proposed lot division - Lot 6, in block 5 of Assessor's Plat- Fredonia/ 415-421 Fredonia Avenue Brian Feucht explained that currently there are two buildings on the property, a house and a salon. The water and sewer currently go to the house and then to the salon all on one meter. Mr. Feucht is requesting to split the property into two separate lots and have each building have its own water and sewer service. Mr. Feucht is recommending to keep the existing curb box and split the service just inside the curb so that no road cuts will be necessary. Driveway access agreements will be needed. It was noted that the house is currently zoned B1 and cannot be used solely for living quarters; however someone can live there as long as there is business activity as well. Motion by Trustee Long, seconded by Jerry Jacque, to approve the lot division as proposed with water and sewer service being split and a water meter being placed at each property. Motion carried. Review and approval of proposed of request to merge Lots as proposed by Lundman Development Corporation (LDC) Lundman Development Corporation (LDC) currently owns 421-435 Wheeler Avenue as well as the 4 vacant lots east of the property and one small strip of land to the south. Mr. Lundman is requesting to combine the 5 vacant parcels with 421-435 Wheeler Avenue and have all property zoned M1. He noted he is planning ahead for possible future expansion for Peterson Products Co. while maintaining some green space. Trustee Long stated that public hearing will be needed due to the zoning change. The public hearing will be before the Plan Commission on December 5, 2022. 21Pa ge Plan Commi ssion 11/07/22 vvi::iCONSIN REAL TORS ® ASSOCIATION -~n1 Forest Run Road i.lad,son. PS Form 3800, January 2023 PS N 7530 02-000 .9041 See Reverse for Instructions Re: 415 Fredonia A venue, Village of Fredonia Parcel ID # 09-050-05-06-002 Dear Ms. Cholip: I serve as the Village Attorney for the Village of Fredonia . The Village has notified me of an ongoing issue involving the above-referenced property. I know you have been in contact with Village staff for several months regarding this matter , and are aware of the issue. To ensure there are no misunderstandings , I will summarize that issue here. The property is zoned B-1 Central Business District. The permitted uses for a B-1 zoned property can be found at Section 575-26 of the Code of the Village of Fredonia. The Code permits , as an accessory use, "[r]esidential quarters for the owners, proprietor, commercial tenant , employee , or caretaker located in the same building as the business." Code§ 575-27(C)(3) (emphasis added). There is no business established at the property; therefore, there can be no residential use . The Village is aware the property is being used solely for residential purposes. The Village has referred this matter to my office for legal action. Prior to bringing court action against you, the Village has authorized me to give you a deadline of Monday, October 27, 2025 to furnish me and the Village Administrator with an actionable solution for how you intend to bring your use of the property into compliance . If an acceptable , actionable solution is not presented by this deadline , and you continue to use the property for residential purposes in violation of the B-1 zoning, I expect the Village will direct me to bring an action against you in circuit court to seek an injunction against your continued residential use of the property. This action may also subject you to forfeitures or other monetary penalties. If you are represented by an attorney in this matter, I can only communicate with your attorney . If so, please provide this letter to your attorney, and ask them to contact me. If not, I will await your response by Monday, October 27. Upon arrival, we met with Hannah who allowed us to enter and inspect the property. The nature of the inspection was related to how the property was being used as opposed to how it was zoned. Upon entry, it was immediately apparent that the building was currently being used as a residence. Personal possessions and furnishings were readily apparent, and there was no sign of any other function of either a commercial, retail, or industrial use. 1 Of 11 Continuation Reporting Officer(s): Pages:: Incident Report Number Incident Location: Incident Date: That said, the building was small, and the design and layout of the building clearly appeared to be more of a residential building. The entrance and entrance way especially was designed more for residential than public or consumer access. Although it appeared conceivable the building could be used for commercial or retail purposes, the size, access, and layout of the building appeared challenging in that regard. I stood by as Administrator Jenkins reviewed options with Cholip. Cholip allowed us to take pictures which I have attached. 2 Of 11 I I I I Fredonia Police Department Incident Report Incident: NU-ZONING CODE VIOLATION Incident Report Number: Between: Date - Time And/At: Date-Time 25-000877 12/11/25 13:00 Incident Location: 415 Fredonia Ave, Fredonia, WI 53021 Offense -1: Offense-2: Offense-3: Offense-4: 17.0311 Offense - 5: Offense-6: Offense-7: Offense - 8: Name (Last, First, Middle) DOB: Race/Sex CM Village Of Fredonia, Address: {Address, City, Slate, Zip) Phone 1 242 Fredonia Ave,BLDG, Fredonia, WI 53021 (262) 692-9125 Employer Phone 2 (262) 692-2883 Employer Address Worl< Phone# Name (Last, First, Middle} DOB: Race/Sex Address: (Address, City, State, Zip) Phone 1 Employer Phone 2 Employer Address Worl< Phone# SUMMARY Walk through of address with City Administrator for Code Compliance. Incident Location: 415 Fredonia Ave, Fredonia, WI 53021 NARRATIVE I was asked by the Fredonia City Administrator to accompany him on a compliance check at 415 Fredonia Avenue. This is related to the question of whether the building was being used for its zoned purpose. Upon arrival, we met with the owner, Hannah Cholip, who allowed us entrance. By outward appearance, the building appeared to be a small, single-family two story residence. My understanding in speaking with the village administrator is that the property is zoned as commercial use. Inside the building appeared to be small, with two small rooms and an attached small kitchen. I had attended a similar inspection of this location several months ago, and many of the personal effects that were present then had been removed. The lower level was fairly impersonal, and the Western room of the lower level was taken up by what Cholip described as her home office. A full-sized file cabinet was against one of the walls. There was a table set up as a desk, containing a computer which Cholip advised she used in her home health nurse business. Her work at the location being a combination of scheduling her home nurse visits, communications with her clients and other vendors related to that, and processing the "paperwork" the business involved. There did not appear to be any personal items or possessions in that room indicated other than her claimed usage. The room appeared to be the one in which her home business was focused. I estimated the room to be approximately 12 by 12 feet. The easter of the two rooms contained furniture and items consistent with what I would describe as a living room, however, again a number of the personal possessions that were in that room at the last visit were no longer there.
