Administrator Jenkins stated that the two action items would be handled
together. At the January 5, 2026 meeting, the Commission voted to deny
Ms. Cholip’s request to rezone her entire parcel from commercial zoning
to residential. She has since provided a CSM and a new rezoning request
for the smaller lot, with the house, that the CSM creates. Adam Degroot
explained the dimensions of the new lot meet the requirements of the RS-
3 Single Family Residential zoning district. The business parcel would be
in the back of the lot with a driveway that fronts on Fredonia Ave and
meets the requirements of the B-1 Business zoning district. Mr. Degroot
said CSM creates a usable residential and usable business parcel. He
said the CSM would make it easier for Ms. Cholip to sell either parcel.
Administrator Jenkins stated that changing the zoning of either proposed
parcel is in conflict with the Village’s Comprehensive Plan and would
require the Village to update the plan. Mr. Degroot acknowledged the
Commissions desire to maintain a robust business district but noted many
residential parcels surrounding the property. Administrator Jenkins
clarified the actions requested of the Commission: if they wish to move
forward with the rezoning request, the Commission should set a public
hearing and then make a recommendation to the Village Board. The
Commission will make a recommendation on the CSM after the public
hearing. Administrator Jenkins asked Ms. Cholip if she had plans to sell
the commercial lot. She does not.
Motion to Set a Public Hearing on the Rezoning Request from B-1
Residential to R-S3 Single Family Residential at 415 Fredonia Ave on
March 2
nd, 2026 at 7:00PM made by Commissioner Franck.
Seconded by Commissioner Winker.
Commissioner Winker asked Ms. Cholip’s realtors how they managed to
inadvertently sell her a commercial lot. The realtors responded that none
of the documentation they had seen referred to the lot as a commercial
one. Administrator Jenkins responded strenuously that every single
document that went through Village staff to the title company before the
sale indicated that the parcel is commercial and could not be used for
residential use only.
Passed by 5-0 voice vote.
6. Correspondence: none
7. Items for Future Consideration: none

Village Administrator
415 Fredonia Avenue New CSM and Re-Zoning Request
1-28-2026
Commissioners,
Ms. Hannah Cholip has submitted a request related to the property at 415 Fredonia Avenue that
includes a preliminary Certified Survey Map (CSM) and a proposed zoning map amendment.
The request involves reconfiguring two adjoining parcels and rezoning the parcel containing the
existing residence from B-1 Central Business District to RS-3 Single-Family Residential District.
This request follows enforcement concerns regarding residential use occurring as the primary use
within the B-1 zoning district.
Two actions are proposed:
1. Review and potential recommendation to the Village Board of the preliminary CSM
(Plan Commission recommendation followed by final action by the Village Board).
2. Consideration of a zoning change (Plan Commission recommendation following a public
hearing; final action by the Village Board).
Certified Survey Map
A draft CSM prepared by Adam DeGroot of Parish Surveying and Engineering reallocates
approximately 4,300 square feet from Proposed Lot 1 to Proposed Lot 2. This adjustment allows
the parcel containing the existing residence to meet the minimum lot area, frontage, and setback
requirements of the RS-3 zoning district.
The remaining parcel (Proposed Lot 1) would retain its B-1 zoning and be configured as a flag
lot, with potential access from Fredonia Avenue. While the parcel meets minimum dimensional
standards under the zoning code, its layout may limit viable commercial development options.
Rezoning
The proposed rezoning of the residential parcel from B-1 to RS-3 is inconsistent with the
Village’s Comprehensive Plan. The remaining parcel retaining B-1 zoning would remain
consistent with the plan; however, its configuration and adjacency to residential uses may impact
future commercial use or marketability.
Staff Comments
If the Planning Commission has an appetite to consider the requested rezoning, a public hearing
should be set for March 2
nd, 2026 at 7:00PM. Staff recommend handling both the CSM request
and the rezoning request in unison. A recommendation for both items may be made at the March
VILLAGE OF FREDONIA

2nd Planning Commission meeting following the public hearing. Staff are seeking direction and
feedback from the Plan Commission regarding the acceptability of the proposed CSM and
whether there is interest in considering a rezoning request that is inconsistent with the
Comprehensive Plan. Deviation from the Comprehensive Plan may require an amendment to the
Plan as part of the rezoning process. This feedback will assist the applicant and her consultants in
determining how to proceed.
Please contact staff with any questions prior to the meeting.

ZONING CHANGE EXHIBIT MAP & PROPOSED CSM
HANNAH CHOLIP - AMENDED ZONING CHANGE APPLICATION - 1/28/2026
NARRATIVE
THE PURPOSE OF THIS EXHIBIT MAP IS TO DETAIL THE PROPOSED ZONING CHANGE AND CERTIFIED SURVEY MAP
AS REQUESTED BY HANNAH CHOLIP IN THE ZONING CHANGE AND LAND DIVISION APPLICATIONS DATED
1/28/2026. THE PROPOSED ADJUSTED CSM LOT 2 WILL CREATE AN RS-3 ZONE COMPLIANT RESIDENTIAL LOT.
THE PROPOSED CSM LOT 1 WILL STAY IN THE B-1 ZONING DISTRICT, AND MEETS ALL ZONING REQUIREMENTS.
USE STATEMENT
THERE IS NO CONTEMPLATED CHANGE OF ACTUAL USE. THE EXISTING HOUSE AT 415 FREDONIA AVENUE HAS
HISTORICALLY BEEN UTILIZED AS A RESIDENTIAL DWELLING. PRIOR TO THE 2023 LAND DIVISION OF CSM #4213
THIS DWELLING WAS A PERMITTED ACCESSORY USE IN THE B-1 ZONE. AFTER THE LAND DIVISION AND THE SALE
TO CHOLIP, THE RESIDENTIAL USE WAS DEEMED NON-COMPLIANT BECAUSE OF A NON-EXISTENT OR
UN-ACCEPTABLE BUSINESS USE OR OCCUPANCY. THE FUTURE INTENT IS TO CONTINUE THE HISTORICAL
RESIDENTIAL USE.
ZONING CHANGE STATEMENT
THE 2023 LAND DIVISION OF CSM #4213 DIRECTLY CREATED THE SCENARIO WHERE A NON-COMPLIANT USE
COULD ARISE. THE PLAN COMMISSION WAS AWARE OF THIS, AND STATED IN THE 11/07/2022 MINUTES "IT
WAS NOTED THAT THE HOUSE IS CURRENTLY ZONED B-1 AND CANNOT BE USED SOLELY OF LIVING QUARTERS;
HOWEVER SOMEONE CAN LIVE THERE AS LONG AS THERE IS BUSINESS ACTIVITY AS WELL."
THE SURROUNDING PROPERTIES COMPRISE A MIXED-USE AREA. OF THE EIGHT (8) ADJOINING PROPERTIES, SIX
(6) ARE ZONED RESIDENTIAL USE. IT IS UNDERSTOOD THAT THE VILLAGE CHERISHES ITS LIMITED B-1 CENTRAL
BUSINESS DISTRICT ZONING AREAS. THIS ZONE CHANGE TO RS-3 WOULD KEEP THE ACTUAL HISTORICAL
RESIDENTIAL USE OF ADJUSTED LOT 2, WHILE PRESERVING A VACANT MARKETABLE B-1 BUSINESS PROPERTY
WITH THE PROPOSED LOT 1.

To Whom It May Concern,
My name is Hannah Cholip and I am applying to get my property, 415 Fredonia Ave,
Fredonia, Wisconsin 53021, rezoned. I am a nurse at a hospital in the area. I bought this
property in August and it was my first home buying experience. I closed on the property and a
short time later attempted to apply to have chickens on my property. I was informed by the
village clerk that my property was zoned as commercial therefore I could not have chickens. It
was not clear to me that I was purchasing a commercial property. I have never owned a
business and never intended to start a business. There is a house and a garage on the property
and I am currently using it as a residence. It not only benefits me personally to have it rezoned
but the community as well. A property benefits a community more as residential because it
provides a stable housing base for residents, which can lead to increased community
engagement, improved local services, a stronger sense of belonging, and a more vibrant local
economy by supporting nearby businesses and contributing to the tax base. I want to contribute
to the community and make this my home. This property does not resemble a business, it
resembles a home, therefore it would be better used as a residential property than a commercial
property.
Thank your for your consideration,
Hannah Cholip

Re: 415 Fredonia Avenue, Village of Fredonia
Parcel ID # 09-050-05-06-002
Dear Ms. Cholip:
I serve as the Village Attorney for the Village of Fredonia . The Village has notified me of an
ongoing issue involving the above-referenced property. I know you have been in contact with
Village staff for several months regarding this matter, and are aware of the issue. To ensure there
are no misunderstandings, I will summarize that issue here. The property is zoned B-1 Central
Business District. The permitted uses for a B-1 zoned property can be found at Section 575-26 of
the Code of the Village of Fredonia. The Code permits, as an accessory use, "[r]esidential
quarters for the owners, proprietor , commercial tenant, employee, or caretaker located in the
same building as the business." Code§ 575-27(C)(3) (emphasis added). There is no business
established at the property; therefore, there can be no residential use. The Village is aware the
property is being used solely for residential purposes .
The Village has referred this matter to my office for legal action. Prior to bringing court
action against you, the Village has authorized me to give you a deadline of Monday, October
27, 2025 to furnish me and the Village Administrator with an actionable solution for how you
intend to bring your use of the property into compliance. If an acceptable, actionable solution is
not presented by this deadline , and you continue to use the property for residential purposes in
violation of the B-1 zoning, I expect the Village will direct me to bring an action against you in
circuit court to seek an injunction against your continued residential use of the property . This
action may also subject you to forfeitures or other monetary penalties.
If you are represented by an attorney in this matter, I can only communicate with your
attorney. If so, please provide this letter to your attorney, and ask them to contact me. If not, I
will await your response by Monday, October 27.

NOTE: It is hereby expressly understood that this memorandum statement is issued subject to
errors and omissions and shall not be binding upon the City, Village or Town providing this
memorandum. In accordance with Sec. 19.21 (2), Wisconsin Statutes, you are entitled to
examine the public records of this office and verify the information obtained therefrom to your
own satisfaction.
Mr. Lundberg stated that a variance will be needed to allow only 30 parking stalls;
currently Village code would require 1 parking space per 250 square feet of building
area which would calculate to 36.4 parking stalls.
It was noted that JT Engineering did a review of the submitted plans. Comments and
recommendations from JT Engineering were given to Mr. Lundberg.
Motion by Gerry Weiland, seconded by Jerry Jacque, to approve the Dollar
General Plans contingent on completion of the punch list items from JT
Engineering. Motion carried .
Motion by Trustee Long, seconded by Dan Wellskopf , to recommend the Board of
Appeals approve a variance to reduce parking requirements from 36.4 parking
stalls to 30 parking stalls. Motion carried.
Review and approval of proposed lot division - Lot 6, in block 5 of Assessor's
Plat - Fredonia/ 415-421 Fredonia Avenue
Brian Feucht explained that currently there are two buildings on the property, a house
and a salon. The water and sewer currently go to the house and then to the salon all on
one meter. Mr. Feucht is requesting to split the property into two separate lots and have
each building have its own water and sewer service. Mr. Feucht is recommending to
keep the existing curb box and split the service just inside the curb so that no road cuts
will be necessary. Driveway access agreements will be needed.
It was noted that the house is currently zoned B1 and cannot be used solely for living
quarters; however someone can live there as long as there is business activity as well.
Motion by Trustee Long, seconded by Jerry Jacque, to approve the lot division as
proposed with water and sewer service being split and a water meter being
placed at each property . Motion carried.
Review and approval of proposed of request to merge Lots as proposed by
Lundman Development Corporation (LDC)
Lundman Development Corporation (LDC) currently owns 421-435 Wheeler Avenue as
well as the 4 vacant lots east of the property and one small strip of land to the south.
Mr. Lundman is requesting to combine the 5 vacant parcels with 421-435 Wheeler
Avenue and have all property zoned M1. He noted he is planning ahead for possible
future expansion for Peterson Products Co. while maintaining some green space.
Trustee Long stated that public hearing will be needed due to the zoning change. The
public hearing will be before the Plan Commission on December 5, 2022.

NARRATIVE
Along with Village Administrator Jenkins, I met with Hannah Cholip at this
residence to assist the village with a home inspection that the Village
had scheduled.
Upon arrival, we met with Hannah who allowed us to enter and inspect the
property. The nature of the inspection was related to how the property was
being used as opposed to how it was zoned.
Upon entry, it was immediately apparent that the building was currently
being used as a residence. Personal possessions and furnishings were
readily apparent, and there was no sign of any other function of either a
commercial, retail, or industrial use.

That said, the building was small, and the design and layout of the
building clearly appeared to be more of a residential building.
The
entrance and entrance way especially was designed more for residential
than public or consumer access.
Although it appeared conceivable the
building could be used for commercial or retail purposes, the size,
access, and layout of the building appeared challenging in that regard.
I stood by as Administrator Jenkins reviewed options with Cholip.
Cholip allowed us to take pictures which I have attached.

Incident Location:

NARRATIVE
I was asked by the Fredonia City Administrator to accompany him on a
compliance check at 415 Fredonia Avenue. This is related to the question of
whether the building was being used for its zoned purpose.
Upon arrival, we met with the owner, Hannah Cholip, who allowed us entrance.
By outward appearance, the building appeared to be a small, single-family two
story residence. My understanding in speaking with the village administrator
is that the property is zoned as commercial use.
Inside the building appeared to be small, with two small rooms and an attached
small kitchen. I had attended a similar inspection of this location several
months ago, and many of the personal effects that were present then had been
removed. The lower level was fairly impersonal, and the Western room of the
lower level was taken up by what Cholip described as her home office.
A full-sized file cabinet was against one of the walls. There was a table set
up as a desk, containing a computer which Cholip advised she used in her home
health nurse business. Her work at the location being a combination of
scheduling her home nurse visits, communications with her clients and other
vendors related to that, and processing the "paperwork" the business involved.
There did not appear to be any personal items or possessions in that room
indicated other than her claimed usage. The room appeared to be the one in
which her home business was focused. I estimated the room to be approximately
12 by 12 feet.
The easter of the two rooms contained furniture and items consistent with what
I would describe as a living room, however, again a number of the personal
possessions that were in that room at the last visit were no longer there.

Nine Ladies Dancing – New Parking Lot Site Plan
Plan Commissioners,
Nine Ladies Dancing has submitted a modification to their approved site plan to
accommodate a larger parking lot. The revised plan includes 30 off-street parking stalls. Because
the lot exceeds 20 spaces, the Zoning Ordinance requires an interior landscaping plan providing
a minimum of 600 square feet of total landscaping, along with one tree for every 10 feet of
vehicular use area.
The applicant’s current submittal reflects approximately 1,300 square feet of landscaping;
however, this interior landscaping island is proposed to be constructed only with a future Phase 2
parking lot expansion. As proposed, the Phase 1 parking lot does not include the required interior
landscaping. Furthermore, even if installed along the perimeter, such placement would not meet
the ordinance requirement for interior landscaping within the parking area.
All site plans remain subject to approval by the Village Plan Commission. As currently
proposed, the plan is not compliant with the landscaping requirements unless and until the future
island is installed in a manner consistent with ordinance standards.
The Ordinance does provide the Commission with discretion:
“The Planning Commission has the discretion to approve other aesthetic
installations in place of a design standard requirement, or to leave off a
requirement completely if the Planning Commission determines that it makes no
sense aesthetically.”
Accordingly, the Commission may consider the following options:
1. Require installation of the interior landscaping island at this time to achieve general
conformance with the ordinance.
2. Require modification of the Phase 1 parking lot layout to incorporate compliant interior
landscaping.
3. Approve the plan as submitted and defer the landscaping requirement until Phase 2 is
proposed.
Interior landscaping requirements serve two primary purposes: aesthetics and traffic
safety. First, they support the Village’s goal of promoting a vibrant and dynamic community that
incorporates greenspace, as articulated in our ordinance. Second, landscaped islands and internal
barriers help organize parking areas, improve circulation, and provide visual and physical
separation within vehicular traffic areas. This may be particularly important given the anticipated
client base of children utilizing this future business.
Please feel free to reach out with any questions.
Thank you,
Christophe E. Jenkins

Corner Lot Shed – 544 Fir St
Plan Commissioners,
Per our Ordinances, an accessory structure, such as a shed, that is placed on a corner lot
requires Plan Commission approval, as corner lots have the unique distinction of sharing both a
side and rear yard that face the public right-of-way. The attached application has been reviewed
by staff, and the placement, size, and construction of the proposed shed is compliant with Village
ordinances. I recommend approval.
Any questions, please reach out.
