Seconded by David Held. Motion carried. 3 favor, 0 opposed. New Business - Variance Petitions The first Hearing was Roman Vovchak / Vasyl Vovchak, et al, owners and applicants Town: Town of LaGrange Tax Parcel Number: HCO 00011A1 Required by Ordinance: The ordinance requires a 75- foot setback from the ordinary high-water mark. Variance Request: The applicants are requesting a 26.7- foot setback. The request is a variance from Section(s) 74-174 and 74-181 of Walworth County’s Code of Ordinances – Shoreland Zoning, to permit the location of a retaining wall and associated grade changes. Board of Adjustment Decision: The Walworth County Board of Adjustment, during the meeting of August 13, 2026, for the petition of Roman Vovchak / Vasyl Vovchak, et al, owners and applicants, voted to DENY the request for a 26.7-foot setback. Board of Adjustment Findings: The Board found the property owner did not meet all the necessary criteria for a variance. The Board found there was not a unique property limitation. The Board found steep slopes are not unique to this property. The Board found no unnecessary hardship. The Board found the hardship to be self-imposed. The Board found there are options that would not require a variance. The Board found there would be no harm to the public, but acknowledged the letter received stating the DNR’s concerns. A motion was made by Rose Smith -Miller to DENY the variance. Seconded by Ann Seaver. Motion carried. 3 favor, 0 opposed. The second Hearing was James Haraldsen Trust / Mary Haraldsen Trust, owners and applicants Town: Town of Troy Tax Parcel Number: LK 00018 Required by Ordinance: The ordinance requires the structure to be in the side yard and/or rear yard, which would require the structure to be at least 54.1 feet from the road right-of-way. The request is a variance from Section(s) 74-38 of Walworth County’s Code of Ordinances – Zoning, to construct an accessory structure. Board of Adjustment Decision: The Walworth County Board of Adjustment, during the meeting of August 13, 2026, voted to DENY the request to allow the structure partially in the street yard, approximately 35.8 feet from the right-of-way. Board of Adjustment Findings: The Board found the property owner did not meet all the necessary criteria for a variance. The Board found there was not a unique property limitation. The Board found no unnecessary hardship. The Board found that an accessory structure could be built on the property without a variance. The Board found that additional expenses associated with construction that would meet the ordinance cannot be factored into their decision making. The Board found that the large size of the requested building contributed to the difficulties with placement. The Board found the request would not be consistent with the intent of the ordinance regarding structures in the street yard insofar as visual aesthetic preferences are concerned. The Board found that no neighbors showed up to object to the variance request. A motion was made by David Held to DENY the variance. Seconded by Ann Seaver. Motion carried. 3 favor, 0 opposed. The third Hearing was Nicholas Croucher and Allison Croucher, owners and applicants Town: Town of Delavan Tax Parcel Number: FDLA 00068 Required by Ordinance: The ordinance requires the new residence to maintain the footprint and envelope when within 5 feet of the lot line. Board of Adjustment Decision: The Walworth County Board of Adjustment, during the meeting of August 13, 2026, voted to APPROVE the request to allow the change of footprint and envelope to 3.8 feet from the east lot line and 4.2 feet from the west lot line, as well as the deck that was requested to be 9.8 feet from the street yard. Board of Adjustment Findings: The Board found the property owners did meet all the necessary criteria for a variance. The Board found there was a unique property limitation in that the lot is very small. The Board found there to be unnecessary hardship. The Board found the existing house is closer still to the lot lines than what is being requested. The Board found the applicants are just straightening the house to be squarer to the lot lines. The Board found no harm to the public interest. The Board found the request to be a small increment of relief in regard to the footprint. The Board found the increase in envelope to also be modest. The Board found the neighborhood architectural review committee approved the request. A motion was made by Rose Smith -Miller to APPROVE the variance. Seconded by Ann Seaver. Motion carried. 3 favor, 0 opposed. The fourth Hearing was Tower View Mobile Court Inc, owner, and Nicholas Jayne – R.H. The Board found unnecessary hardship. The Board found the bridges do need to be replaced and the applicants are requesting to do so in a way that would best serve the commercial traffic through the property. The Board found there would be no harm to the public interest. The Board found the project will improve traffic flow and visitor safety. The Board found that removing existing bridge abutments and culverts from the creek will improve current flooding conditions. The Board found that the Town of Geneva approved the variance request. A motion was made by David Held to APPROVE the variance. Seconded by Ann Seaver. Motion carried. 3 favor, 0 opposed. Other A. According to the plans submitted, you are requesting for the house to be constructed outside the existing footprint and envelope within the 50-foot vision triangle, as well as four parking stalls for a residence with 5 bedrooms. The Walworth County Code of Ordinances require any structures within the vision triangle can only be replaced in the same footprint and envelope, as well as require one parking stall per bedroom for a residence. Therefore, I must deny your permit application. You have the right to appeal my denial to the Walworth County Board of Adjustment within 30 (thirty) days of receiving this letter and request a variance to the requirements of the Ordinance. This variance may or may not be granted. Attached for convenience, is the Board of Adjustment variance request application. If the variance request is approved, an erosion control application and conservation plan will also need to be submitted. Additionally, when applying for County permits, it is recommended to contact the Town Inspector for information regarding local permit/variance requirements. If you have any questions or wish to discuss the matter further, please feel free to contact me or call our office for an appointment. We can be reached at 262-741-4972 on weekdays from 8:00am – 4:30pm.
