SEVEN MILE CREEK LANDFILL STANDING COMMITTEE MEETING MINUTES OCTOBER 24, 2024 Members Present: Jessica Janssen, Kathy Campbell, Joe Knight, Richard Arnold, Matt Steinbach, Lane Berg Members Absent : Jon Johnson Others Present: Phil Schumacher, Mark Vinall, John Blackmon, Pamela Johnson Call to Order: Meeting called to order at 1:01 p.m. Approval of Minutes: Motion to approve the May 9 , 2024 Minutes by Matt Steinbach and seconded by Lane Berg. The August 1, 2024 Minutes could not be approved due to absence of members that were in attendance at the August 1, 2024 meeting. Approve at the next meeting. Public Comment: None Landfill Data Presentation and Summary Presented by GFL: ● The tonnage for the third quarter totalled 97,210 which is up when compared with the same quarter in 2023. The quantity of leachate collected was nearly double due to wet fall and new cell. Litter pickup and sweeping is based on weather conditions. It can be hazardous for the litter pick-up crew at times when drivers are passing. Jessica will remind residents to be more cautious. ● Several odor complaints and a call about trash on County P were noted. Flare was shut down on September 22 and methane gas was not captured, causing a strong odor before it was repaired on the following Monday. An odor suppressant is being used. ● DNR denied Lake City Recycling request to dispose of “dirty” recyclable material at SMCL. ● There was a site inspection by the DNR on 7/9/24 when the new cell was opened. ● July 29, 2024 a Deviation Submittal was filed with the DNR. DNR approved Well Risings and approved gas well extensions. August 28 Semi-Annual Report was filed with the WDNR. ● August 27 the Commencement of Filling Operations Phase 14B was submitted to the WDNR Air Department. ● Leachate spill on August 9 was cleaned up and the area of spill was reseeded. Sector 1 leachate headwell cover soil repair. Request for an extension to Complete Corrective Action on Sept. 27. ● Monitoring data set files were submitted to the DNR on Sept. 5 and 6 for Sector l and 2. ● Planned redrilling of wells for gas collection will be completed next week. Additional well projects are not expected. ● There was no groundwater monitoring during the third quarter. ● All GFL sites are being evaluated to determine how to best use expelled methane gas to produce electricity. Discussion and Action Items: Health Department Inspection: ● All Solid Waste is not being placed in 14A with liquid waste being deposited on top. Average waste volume remains steady at approximately 1500-1600 tons per day. The current peak elevation is 1,084 feet. ● The gas collection system is being upgraded with new vacuum lines. New wells are being added and others are being redrilled. Leachate tank #2 and the new compactor is operational. ● Compost piles were turned. Property Protection Letter to Residents: A draft of the Property Protection Letter to residents is being reviewed by GFL. Other Business: Annual Sociological Payment Eligibility: Pamela Johnson informed the Committee that her father, Dale Johnson, died in April. His 40 acre property was at 7222 Olson Drive, within ¾ of a mile of the landfill. The property was sold on 9/25/24. It is believed that the home and 15 acres will not be owner-occupied by the new owner during 2024. The remaining 25 acres are vacant and owned by Pamela Johnson. She believes the estate is eligible for the sociological payment for 2024 for the term her father resided on the property. A second resident, John Anderson, 9409 Burnell Drive, died during 2024 and his estate also transferred to his family. This property is within one mile and on 90th Avenue. It’s believed that no one is presently residing at the home. Is the estate eligible to receive the 2024 sociological payment? The Agreement states that “to be eligible, the property must be an owner-occupied dwelling as of November 30 of the year of the program for which payment is sought.” It is unclear as to whether Pamela Johnson and Duane Anderson, Personal Representative, are eligible to receive a payment for 2024 based on the contract language. Motion was made by Matt Steinbach and seconded by Lane Berg that Jessica request Attorney Anders Hellquist provide a legal interpretation or clarification as to the intent of the contract language and the impact of death, estates’ rights, and partial year occupancy on the eligibility for the sociological payment. County Planning & Development Assessment Roll: Roxie provided the Real Estate Assessment Roll for the residents residing within one mile of the landfill. Upon a quick review, some of the land transfers that occurred in 2024 were not listed. GFL was informed by Kathy of the new owners on her list. She will remind new owners to complete the W9 at the Scale House at the landfill. Jessica will check with Roxie about the date the report was completed. If there is an updated list, Jessica will forward it to Kathy. Host Fee: Payment of the Host Fee to the Town is not arriving in a timely manner, impacting the Town’s budget. Jessica will write a letter to the City of Eau Claire about receiving the payment in a shorter time frame. Road Construction: Resurfacing will occur on County Road. County Road Q will be down to one lane at times. Traffic will be detoured onto Black Avenue to Tower Drive for two days. Jessica will give GFL a map of the detour. GFL will inform the drivers. Agenda Items for Next Meeting: ● Approve August 1 and October 24, 2024 Meeting Minutes ● Approval of Property Protection Letter ● Review Updated Assessment Roll ● Attorney Opinion on Sociological Payment Eligibility ● Response from City of Eau Claire regarding Host Fee Payment Next Meeting Date: January 30, 2024 at 1:00 p.m. at the Seymour Town Hall Adjourn: Motion to adjourn at 2:56 p.m. by Matt Steinbach and seconded by Lane Berg. Respectfully submitted by: Kathy Campbell Secretary
