Department staffing, overhead, billable services, and Wisconsin Medicaid cost reporting are used to review and calculate rates. The requested HHS rate increase is less than 2%. HHS Director's Report (Bob Rohret) Bob Rohret, HHS Director, shared that Human Resources will assist in facilitating a 2027-2030 strategic plan. Members of the HHS Board are invited to participate in the planning sessions; interested members should reach out to Rohret. Shar Lopez, HHS Deputy Director, wrote an article regarding partnerships with law enforcement, adult protective services, and behavioral health crisis co-response, which is set to be featured in the December WCA Magazine. Rohret is working with Polk County and DHS to expedite the release of Crisis Care Facility funding in the amount of $10 million by the Joint Committee on Finance. Two Polk County providers are interested in developing a regional care facility. If funds are not released soon, the approved time period to use these funds will expire and the funds will then return to the state. Vital Strategies, a global public health nonprofit, matched $100,000 in opioid settlement funds, which supported the duties of a substance-use professional, Kim Kitzberger, embedded in Child Protection Services and Family Treatment Court, as well as a Public Health evaluation effort. A presentation from Public Health will follow with additional details. Rohret also provided updates from each specific HHS Division. 5. Evaluation of Projects Related to Vital Strategies Opioid Settlement Matching Funds (Genevieve Palazzolo, PH Strategist) Genevieve Palazzolo, HHS Public Health Strategist, provided a presentation regarding an evaluation of projects related to the Vital Strategies opioid settlement matching funds. This funding was utilized to support a Substance-Use Professional, Kim Kitzberger, embedded within the Children Services department, to work with families affected by substance use in Child Protective Services (CPS) cases, and to support the implementation of Family Treatment Court (FTC). Public Health conducted an evaluation to assess preliminary outcomes for these interventions with respect to out-of-home placements, reunification, and support for recovery within families. This grant facilitated the integration of Page 3 of 78 substance-use support directly into Children Services, allowing for earlier connections to assistance for families. The grant concluded at the end of August 2026; however, Kim's position will continue through existing opioid settlement funding. Please refer to the presentation slides in the packet for further details. Request for Future Agenda Items Rohret requested to provide a series of presentations at the October HHS Board meeting regarding mental health, addiction, and behavioral health systems and our response to the needs in St. Croix County, focusing on various departments within the county and HHS divisions. Announcements 1. The next Men's Shed event is November 4, featuring Phil Landgraf of Veterans Services. 2. The ADRC and Public Health will host the first ADRC Expo on October 21 at Ready Randy's in New Richmond. Date of Next Meeting 1. Page 64 of 78 Legislative Policy of Wis. Stat. Ch. 51 • It is the policy of the state to assure the provision of a full range of treatment and rehabilitation services in the state for all mental disorders and developmental disabilities and for mental illness, alcoholism and other drug abuse. • There shall be a unified system of prevention of such conditions and provision of services which will assure all people in need of care access to the least restrictive treatment alternative appropriate to their needs, and movement through all treatment components to assure continuity of care, within the limits of available state and federal funds and of county funds required to be appropriated to match state funds. • To protect personal liberties, no person who can be treated adequately outside of a hospital, institution or other inpatient facility may be involuntarily treated in such a facility. Page 65 of 78 Wis. Stat. Ch. 51 – Overall • Generally speaking, individuals have the right to decide for themselves whether to treat their mental illness or substance use disorders. • Only in limited circumstances can the County intervene and require individuals to receive treatment against their will. • Individual must be dangerous to themselves or others due, as set forth in the statute, in order to be involuntarily committed for treatment. Page 66 of 78 Definition of Mental Illness Wis. Stat. § 51.01(13): (a) “Mental illness” means mental disease to such extent that a person so afflicted requires care and treatment for his or her own welfare, or the welfare of others, or of the community. (b) “Mental illness”, for purposes of involuntary commitment, means a substantial disorder of thought, mood, perception, orientation, or memory which grossly impairs judgment, behavior, capacity to recognize reality, or ability to meet the ordinary demands of life, but does not include alcoholism. Page 67 of 78 Project Subject for Treatment • “Treatment" means those psychological, educational, social, chemical, medical or somatic techniques designed to bring about rehabilitation of a mentally ill, alcoholic, drug dependent or developmentally disabled person. • Most often treatment is obtained through the involuntary administration of psychotropic medication. Page 68 of 78 Dangerousness In order for a individual to be placed under a civil commitment, one of the standards of dangerousness in Wis. Stat. § 51.20(1)(a)2 must be met: • Harm to Self • Harm to Others • Impaired Judgment • Unable to Care for Self as to Create a Substantial Probability of Harm or Death • Fifth Standard (Subject not Taking Psychotropic Medication) Page 69 of 78 Three Ways to Initiate • Emergency Detention by Law Enforcement • Wis. Stat. § 51.15 • Treatment Director’s Hold • Subject voluntary presents for treatment at a facility but then wants to leave. If the Treatment Director believes that the person meets the criteria of mentally ill, treatable, and dangerous to self or others, the Director (or designee) can initiate a 72-hour hold that proceeds much like a detention by law enforcement. • Three-Party Petition • Three adults with knowledge can petition the court, through the Corporation Counsel Office, to commence the involuntarily commitment process for a subject. The initial petition is reviewed by the judge who determines whether the subject should be held inpatient pending the probable cause and final hearings. Page 70 of 78 Law Enforcement Detention – Wis. Page 71 of 78 Overview of the Process • Law enforcement involvement • Determination that an emergency detention might be necessary • Co-Responder, Northwest Connections or Telehealth involvement for a crisis assessment • Emergency Detention Not Required – Safety Plan and done • Emergency Detention Required – Medical Clearance • Transport to facility • Determination by approved treatment facility regarding need for Probable Cause Hearing • Probable Cause Hearing (within 72 hours of Emergency Detention) • Final Hearing (within 14 days of Emergency Detention) • Dismissal; • Settlement Agreement (up to 90 days); • Commitment • If committed, initial commitment can be up to 6 months; can be recommitted for one-year periods.
