Agency Review
Town of Somerset: The Town Board of Somerset met on September 2nd, 2026, where the Board
“denied the request to build closer to the town road than the original house footprint, recommending
the setback stay at the original 35 feet due to no hardship.”
National Park Service: A letter from NPS was received on 8-26-26 prior to the August hearing where
additional information was requested. The agency was sent the updated plans, and no additional
comments have been received as of 9-15-26.
Wisconsin Department of Natural Resources: A letter from WI DNR was received on 8-19-26 prior to
the August hearing where additional information was requested. An additional letter was received on
9-14-26. Susan Vanden Langenberg with WI DNR noted three questions for consideration:
1. Does the deck need to expand east and west beyond the footprint of the former deck (500 SF)
which was adjacent to the residence?
2. Is this deck expansion portion of the variance request for minimal relief?
3. Would the replacement of the residence within the same footprint (1,934 SF) which exceeds the
1,500 SF limitation within Section 17.I.2.d.1.h. considered minimal relief?

Applicable Statutes & Criteria
Applicant: Joseph & Natalie Weber VAR-2026-0383
The Board of Adjustment may issue a variance to dimensional standards only when statutory
criteria are satisfied.
The Board of Adjustment may approve the variance if the property owner demonstrates that the
application complies with the requirements of Wis. Stat. 59.694(7)(c):
• The variance from the terms of the ordinance will not be contrary to the public interest; and
• Owing to special conditions, a literal enforcement of the provisions of the ordinance will result in
unnecessary hardship; and
• That the spirit of the ordinance shall be observed and substantial justice done.
• That the property owner has demonstrated that strict compliance with the ordinance would
unreasonably prevent use of the property for a permitted purpose or would render conformity with
the zoning ordinance unnecessarily burdensome; and
• The property owner has proven that the unnecessary hardship is based on conditions unique to the
property, rather than considerations personal to the property owner, and that the unnecessary
hardship was not created by the property owner.
Applicable Statutes & Criteria (continued)
• Section 17.70(6)(e) of the Ordinance states that a variance shall not:
1. Grant, extend or increase any use prohibited in the zoning district.
2. Be granted for a hardship based solely on an economic gain or loss.
3. Be granted for a hardship which is self-created.
4. Damage the rights or property values of other persons in the area.
5. Allow actions without the appropriate amendments to this ordinance or its associated
map(s).
6. Allow any alteration of an historic structure, including its use, which would preclude its
continued designation as an historic structure.
• Section 17.70(6)(f) of the Ordinance states that in granting a variance, the Board of
Adjustment may prescribe appropriate conditions and safeguards which are in
conformity with the purpose of this chapter. Violations of such conditions and
safeguards when made a part of the terms under which the variance is granted shall be
deemed a violation of this chapter.

VARIANCE CRITERIA
Pursuant to Wisconsin statutes and the St. Croix County Zoning Ordinance, Section 1 5.715, the St. Croix
County Board of Adjustment has the authority to issue a variance only when all the following criteria are
met:
o An unnecessary hardship must be present meaning that literal enforcement of the Ordinance would
unreasonably prevent the owner from using the property for a permitted purpose or would render
conformity with such restrictions unnecessarily burdensome.
o The hardship must be due to unique physical limitations of the property rather than the circumstances
of the property owner.
. The hardship cannot be self-created.
. The hardship cannot be based upon the financial gain or loss of the property owner.
. The variance will not be contrary to the public interest.
It is the applicanfs responsibility to prove that these criteria are met. Please answer the following questions
and provide any additional information that you feel addresses these criteria in support of your request
(ottoch additionol poper tf necessory|.
1) Describe the details of your request.
2) Explain how literal enforcement of the ordinance would unreasonably prevent you from using your
Property for a permifted use and why the standards in the Ordinance should not apply to your property.
3) Describe the unique characteristics of your property with respect to lot size, shape, topography, and
other physical limitations that make literal enforcement of the Ordinance impractical. Were any of these
limitations created by you or by past property owners?
4) What other options have you considered and why were they not chosen?

Responses to Questionnaire
1) Describe the detaits of your request.
A structure that was destroyed by a fire is being replaced with a new structure which
includes a house, garage, deck and the required foundations. The proposed house
and attached garage lie almost entire ly within the old footprint of the house,
detached shed and concrete slab and walk. The proposed deck is slightlysmaller
than the original deck. The proposed home is not any closerto the bluff line, nor any
higher, than the original home. The proposed deck is approximately 12-feetfurther
from the bluff line than the original deck was. The proposed impervious surtace is
slightly expanded, but, that additional stormwater will be mitigated.
2) Exptain how literaI enforcement of the ordinance woutd unreasonabty prevent you
from usingyour propertyfor a permitted use and whythe standards in the
Ordinance shoutd not appty to your property?
Literal enforcement of the Lower St. Crox Riverway District Ordinance would
prevent the reasonable use of my property for a permitted use. The proposed project
is consistent with the intended residential use of the property and is not intended to
increase development beyond whatis otheruzise permitted on other properties in
the area. The unique physical characteristlcs of my property make it impractical to
comply with every dimensional requirement of the ordinance while still allowing
reasonable use of the property.
3) Describe the unique characteristics of your property with respect to lot size, shape,
topography and other physicat timitations that make literaI enforcement of the
Ordinance impracticat. Were any of these limitations created by you or by past
property owners?
Twin Springs Addition was platted in 1941 prior to zoning codes and the creation of
the LowerSt. Croix Riverway District. The /ots are small bytoday's standards. From
the road to the bluff line is only 105 feet to 1 1 0 feet. Applying the respective road and
bluff line setbacks leaves nothingto almostnothingto build upon.Ihis limitation is
inherent to the plat and not caused by any owner.
4) What other options have you considered and whywere they not chosen?
2026-0383
The only option available would be to construct a smaller home. The proposed
home is under 2500 square feet. Ihis is certainly not a large house by any standards,
particularly on the St. Crox River. While not large, it will reasonably serve the needs
of our family.
5) Exptain how granting this variance is consistent with protecting the pubtic interest,
in particutar, exptain how it witt impact sensitive pubtic resources and/or adjacent
properties.
lmpacts to public resources are minimal. Although the home and garage are slightly
larger than what existed originally, the expansion is lateral and forward. The
proposed deckis slrghtly smaller and is further away from the bluff line than the
original deck. The proposed home is no higher above grade than the originat home,
so there isn't additional home to be viewed from the river. ln addition, where there
wasn't any mitigation of stormwater, there will now be some.
Since the use of the property remains as it always was, there aren't any negative
impacts to adjacent landowners with respect to traffic, noise or other circumstance
typical of residential property.

St. Croix County Board of Adjustment
Sent via Email
Re: Joseph and Natalie Weber Variance Requests
Dear Board Members:
The Department of Natural Resources received the hearing notice for August 27, 2026, public hearing
concerning variance requests on the 0.8-acre property located at 1488 Twin Springs Road in part of GL
1, Sec 15 T30N R20W, Parcel # 032-2083-80-100, Town of Somerset. Joseph and Natalie Weber
request the following variances:
1. Lower St. Croix Riverway Overlay District, to St. Croix County Ordinance Section 17.I.2.d.1.g.
to construct an addition to a non-conforming principal structure that is within the Ordinary High-
Water Mark and bluff line setbacks,
2. Lower St. Croix Riverway Overlay District, as required by St. Croix County Ordinance Section
17.I.2.d.1.h. to exceed 1500 square feet total footprint of a non-conforming principle structure
wholly or partially within the 200-foot Ordinary High-Water Mark setback area. 36.G.5.c.3
(Structure Setbacks) to construct an accessory structure,
3. Lower St. Croix Riverway Overlay District, to St. Croix County Ordinance Section 17.I.3.b. to
reconstruct an existing deck with a reduced overall footprint,
4. R-2 Residential Zoning District, to St. Croix County Ordinance Section 15.405.2.a.2. to
construct a structure within the 50-foot road right-of-way setback area to expand a non-
conforming principal structure
The Snyder vs Waukesha County Zoning Board of Adjustment decision (74 Wis. 2d 468, 478-79, 247
N.W.2d 98) made it clear a circumstance or desire of the applicant is not a factor to be considered
when deciding variances.
As the Board reviews these variance requests, please keep in mind that the applicant has the burden of
proving that their request meets all of the statutory requirements for the granting of a variance for all
four variance requests. That is, the applicant must prove that they will suffer unnecessary hardship if
the provisions in the county’s Lower St. Croix Riverway Overlay District are literally enforced. The
Wisconsin Supreme Court has made it clear that proof of unnecessary hardship by itself does not
entitle an applicant to a variance. All three statutory variance criteria must be satisfied in order to grant
a variance. It may be possible that the applicant will provide additional evidence at the hearing which
may change the conclusions listed below.
Unique physical limitations: The applicant must demonstrate that unique physical limitations
(wetlands, steep slopes, streams, rock outcroppings) or special conditions of the property exist that
prevent compliance with ordinance regulations. The physical limitations must be unique to the property
in question and not generally shared by other properties in the area.
No harm to public interests: The applicant must demonstrate that variance will not result in harm or
be contrary to public interests. The Board must consider the impacts of the proposed project as well as
the cumulative impacts of similar projects on the interests of the neighbors, the community, and the
State of Wisconsin

general public. These interests are listed in the purpose statement of the ordinance and, for the St.
Croix Riverway Zoning, include promote the public health, safety, and general welfare, reducing the
adverse effects of overcrowding and poorly planned shoreline and bluff area development, preventing
soil erosion and pollution and contamination of surface water and groundwater, preserving and
maintaining the exceptional scenic, cultural, and natural characteristics of the water and related land of
the Lower St. Croix .
Unnecessary hardship: The applicant must demonstrate that if the variance is not granted, an
unnecessary hardship exists. The applicant may not claim unnecessary hardship because of conditions
which are self-imposed or created by a prior owner (for example, building a home in compliance and
then subsequently constructing a deck without a permit). Courts have also determined that economic or
financial hardship does not justify a variance. When determining whether unnecessary hardship exists,
the Board must consider the property as a whole, rather than just a portion of the parcel.
Questions for consideration: The proposed deck is about 15.9’ x 47.7’ and has a floor area of over
758 square feet. The footprint of the former deck adjacent to the residence was approximately 15.9’ x
32’ which was 500 square feet in area. Does the proposed deck need to expand further to the east and
west beyond the footprint of the former deck? Is this portion of the variance request for minimal relief?
According to Chapter 17 Lower St. Croix Riverway Overlay District, Conditional Use and Variance
Procedures, Section 17.J.2.b., the variance application submitted is incomplete and lacks the following
items. It is unclear if the project meets all requirements and/or if a conditional use permit is also
required.
• Location of the bluffline and water setback.
• The location and description of existing and proposed alterations of vegetation, topography,
including vegetation removal and replacement.
• A recent aerial photo with property lines drawn in, showing the location of existing and proposed
structures, including height and setback dimensions.
• Photos of the site taken from the river slightly upstream and downstream of the property, and
directly offshore.
• Is a mitigation plan required?
• How much area is proposed to be filled and graded? Is a conditional use permit required?
The Department is not opposed to the board granting the requested variances provided the Board of
Adjustment finds the applicant has met the burden of proof that the request meets all the statutory
requirements for the granting of a variance for all four individual variance requests. If the board finds
that the above criteria have been met, the Department provides consent to the granting of the
variances. The Department also recommends that a condition be placed such that best management
practices shall be utilized during construction to prevent erosion and sedimentation.
Please note that these comments are regarding the Lower St. Croix National Scenic Riverway zoning,
and shoreland zoning regulations only, and do not reflect applicable erosion control, waterway
permitting, floodplain zoning, or other department regulations.
It is the responsibility of the Board of Adjustment to assure that the statutory standards for the granting
of a variance are met. The standards help to ensure protection of the public interest, including the
preservation of water quality and fish and wildlife habitat along lakes and rivers. Wisconsin’s navigable
waterways are held in trust for all people to enjoy. The Department appreciates your commitment to St.
Croix County’s protection of the Lower St Croix National Scenic Riverway for future generations.
Thank you for the opportunity to provide comments.
Sincerely,
Sue Vanden Langenberg
Shoreland Zoning Program Coordinator

RE: Tract LOSA 12-173, House and Deck Rebuild, Building Additions, Excavation
Dear Mr. and Ms. Weber:
Thank you for meeting with National Park Service (NPS) staff in May about your rebuilding plans
for 1478 Twin Springs Road, Town of Somerset , St. Croix County (PIN 032-2084-30-000)
Wisconsin. This property is within the boundary of the St. Croix National Scenic Riverway
(Riverway) and identified as tract LOSA 12-173. NPS owns a “Scenic Easement – Limited
Development” interest, as described in the recorded Grant of Easement Document 357473. This
legal document outlines land use restrictions and requires NPS approval on specific activities so
that the Riverway scenic resources located on your property are preserved and protected.
According to the plans included with the variance application which was submitted to St. Croix
County on July 7
th, you propose to rebuild structures destroyed by fire , with additions. NPS has
divided your request into three project areas as NPS understands them.
Project 1: rebuilding a house in the original location, with additions. It includes what appears to
be a 4 ft x 44 ft (176 sq ft) addition on the landward side and a 13 ft x 26 ft (338 sq ft) addition on
the northeast end of the home. The addition on the northeast end seems to incorporate 140 sq ft of
a previously standing accessory shed plus 198 additional sq ft on all sides of the shed footprint.
Plans also include a large window well on the southwest end. The height of the house to the peak
will not exceed the 14.5 ft height of the previous building.
Project 2: deck replacement. The main deck will be rebuilt in the original location with what
appears to be a 5.5 ft x 15 ft lateral extension on the southwest end. The plans also indicate that
the footprint of the old 16 ft x 16 ft deck is being relocated adjacent to the house overlapping part
of the previous deck and filling in a roughly 10.5 ft x 10.5 ft space adjacent to the house.
Project 3: grading and potential vegetation removal. The plan removes two retaining walls and
builds one new wall in a different location. Excavation includes removing soil to enlarg e the
walkout area of the house facing the river.

NPS needs more information to clarify certain project details. We have requested through St.
Croix County the following; before and after building dimensions, window well details, vegetation
removal, and clarification if a tram is part of the request. Once we receive the requested
information, we will complete our review under the NPS scenic easement and provide a project
determination.
Because this project must also comply with all local, county, and state regulations , the Town of
Somerset, St. Croix County, and the Wisconsin Department of Natural Resources have been
included for reference.

It is our understanding that the
hearing is postponed to September 24, 2026, and Joseph and Natalie Weber request the following
variances:
According to the application materials, it appears the project is requesting the following five variances:
The required setback from the OHWM is 200’.
1. Proposed residence (beyond the footprint of the original house) is about 127’ from the OHWM.
2. Proposed deck (beyond the footprint of the original deck) is 112’ from the OHWM.
The required setback from the bluffline is 40’.
3. Proposed deck (beyond the footprint of the original deck) is 31’ from the OHWM.
The footprint of the residence shall not exceed 1500 square feet in area.
4. The footprint of the proposed residence (including attached garage) is about 2,433 square feet.
The required setback from the road right-of-way is 45’.
5. Proposed residence (beyond the footprint of the original house) is about 32’ from the road R-O-W.

The Board must consider the impacts of the proposed project as well as
the cumulative impacts of similar projects on the interests of the neighbors, the community, and the
general public.
Questions for consideration:
The proposed 15’ x 48’ (1’ deeper on the northwester 16’ section) irregular-shaped deck has a floor
area of about 736 square feet (including the two sets of stairs).
• Does the deck need to expand east and west beyond the footprint of the former deck (500 sq. ft.)
which was adjacent to the residence?
• Is this portion of the variance request for minimal relief?
• Would replacement of the residence within the same footprint (1,934 sq. ft.) and which exceeds the
1,500 square foot limitation within Section 17.I.2.d.1.h. considered minimal relief?
