Consideration of New Position Requests for 2027 Budget
Cover Memo
To: Public Protection and Judiciary Committee
From: Ken Witt, County Administrator
Audrie Haycraft, Human Resources Director
Date: August 6, 2026
Agenda Item: Consideration of New Position Requests for 2027 Budget
Background Information:
Medical Examiner request .5 FTE increase in Program Coordinator/Investigator to go from part-time to full-time.
Additional job duties, increased caseload and increased need for assistance in daily operations of the medical examiner
office. Fiscal cost estimated at $60,000.
Districtor Attorney Office request an additional 1.0 FTE Legal Assistant. The District Attorney's Office requests funding
for one additional Legal Assistant position to address substantial increases in attorney staffing, caseload volume, case
complexity, and administrative responsibilities that have occurred over the past two decades. While the demands placed
on the office have grown significantly, Legal Assistant staffing has not kept pace. Fiscal cost estimate at $90,000.
Staffing
The last Legal Assistant position added to the District Attorney's Office was in 2004. At that time, the office was staffed
with 4.7 attorney positions and 7 Legal Assistants, resulting in approximately 1.5 Legal Assistants per attorney.
Today, the office has grown to 8.5 attorney positions but remains staffed with 7 Legal Assistants, one of which has been
reclassified as a Lead Legal Assistant position. Although attorney staffing has increased by nearly 81 percent since 2004,
Legal Assistant staffing has not increased to support that growth. As a result, the ratio of Legal Assistants to attorneys
has declined from approximately 1.5 to 0.82 Legal Assistants per attorney.
In addition, the Lead Legal Assistant position cannot be viewed as equivalent to a full Legal Assistant position for
workload purposes. A significant portion of the Lead's time is devoted to supervision, staff training, workflow
coordination, problem-solving, quality control, and other leadership responsibilities that support the entire office.
Consequently, the effective level of direct Legal Assistant support available to prosecutors is even lower than the current
staffing ratio suggests.
Increase in Caseload
Since 2004, adult criminal case filings have increased by 31 percent. More significantly, felony case filings, the most
labor-intensive and resource-demanding cases handled by the office, have increased by 60 percent.
The increase in felony prosecutions has resulted in greater demands on Legal Assistants for case preparation, records
management, discovery processing, court scheduling, and document/digital record management. As caseloads have
grown, the administrative workload associated with supporting those cases has grown as well.
Digital Evidence
Since 2004, the nature of criminal case processing has changed dramatically due to the expansion of digital evidence. In
2004, case files were largely paper-based and digital discovery was limited.
Today, virtually every criminal and non-criminal case involves significant volumes of digital evidence, including body-
worn camera footage, squad video recordings, surveillance footage, cell phone extractions, social media records,
photographs, and other electronically stored information.
Managing this information requires substantial staff time to download, organize, label, redact, track, store, and
distribute digital files while maintaining compliance with discovery obligations and evidentiary requirements. Legal
Assistants play a critical role in these processes. The administrative workload associated with digital evidence represents
a significant expansion of responsibilities that either did not exist or existed only in a limited capacity in 2004.
Shorter Deadlines and Increased Compliance Requirements
In addition to increased workload and case complexity, the office must meet increasingly compressed deadlines.
Criminal complaints for operating while intoxicated and domestic abuse cases are routinely filed within 24 hours of
arrest. Criminal complaints and warrants for defendants who abscond from required drug and alcohol testing at the
Justice Services Center are also filed within 24 hours of request.
Discovery obligations likewise require prompt action. Discovery is generally ordered by the court to be provided to
defense counsel within 20 days of the defendant's initial appearance. Meeting these deadlines requires timely
processing, organization, and distribution of large volumes of case materials.
Redaction requirements have also increased significantly. In 2004, relatively little redaction was required. Following the
adoption of Marsy's Law in 2020, Legal Assistants must spend substantial time reviewing and redacting personal
identifying information contained in police reports before criminal complaints are filed and discovery materials are
released. This includes dates of birth, driver's license numbers, Social Security numbers, addresses, telephone numbers,
financial account information, and other protected information belonging to victims and witnesses.
Measures Taken to Maintain Operations Under Increased Workload
The District Attorney's Office has taken several steps to absorb increased workload without requesting additional Legal
Assistant staffing.
Historically, the office maintained a dedicated front-desk Legal Assistant position with a reduced caseload to manage
incoming calls, greet visitors, and handle public inquiries. In 2025, that position was removed and converted to full
casework support. While this change improved staffing efficiency on paper, it did not eliminate the front-desk workload.
Instead, those responsibilities were redistributed among all Legal Assistants and the Lead Legal Assistant in addition to
their existing case management duties.
As a result, all Legal Assistants now balance reception coverage and public-facing responsibilities while maintaining full
case-processing workloads. This reduces the amount of time available for critical case-support functions and further
strains existing staffing resources.
The Administrative Services Supervisor has also assumed responsibilities previously performed by Legal Assistants,
including entering referrals, maintaining law enforcement unavailability schedules, and updating office and court
calendars. While these adjustments have helped the office continue to meet operational demands, they have limited the
supervisor's ability to perform essential management functions such as employee mentoring, staff development,
performance management, workload monitoring, process improvement, and proactive problem-solving.
Conclusion
The District Attorney's Office has experienced substantial growth in attorney staffing, caseload volume, felony
prosecutions, digital evidence management responsibilities, discovery obligations, and victim/witness privacy
Page 21 of 26
compliance requirements since the last Legal Assistant position was added in 2004. Existing staff have absorbed these
additional responsibilities through operational adjustments and increased workloads; however, those measures have
reached their practical limits.
Adding one Legal Assistant position would help restore critical administrative support capacity, improve case-processing
efficiency, ensure continued compliance with court-imposed deadlines and discovery obligations, and allow prosecutors
and supervisors to focus on duties requiring their specialized expertise. This position represents a necessary and cost-
effective investment to support the continued efficient operation of the District Attorney's Office and its public safety
mission.

PROGRAM COORDINATOR FTE JUSTIFICATION – ST. CROIX COUNTY MEDICAL EXAMINER’S OFFICE
Since the introduction of the Program Coordinator position in 2021, the caseload at the Medical
Examiner’s Office has nearly doubled, increasing from 851 cases in 2021 to 1,319 cases in 2025. Based
on current trends, we are projected to reach approximately 1,600 cases in 2026. This sustained and
significant growth in caseload has placed increasing operational demands on staff, underscoring the
need for additional full-time personnel to maintain service quality, ensure timely case processing, and
support the department’s expanding statutory and administrative responsibilities. St. Croix County is the
17th most populous county in the state of Wisconsin, and comparable counties—such as Ozaukee and
Jefferson—have begun adding additional full-time positions to address their growing caseloads.
Understaffing in Medical Examiner and Coroner offices is a statewide issue, and positioning St. Croix
County ahead of this trend will be critical to maintaining service quality, operational resilience, and
timely case management.
The number of hospice registrations has increased in response to St. Croix County’s aging population.
We currently maintain 179 active registrations; the highest volume recorded since the establishment of
the department’s hospice program. Additionally, increased turnover among hospice nurses has required
significantly more communication with partner agencies regarding proper documentation and reporting
procedures. To address the challenges, the Program Coordinator has developed and will continue to
deliver in-person presentations to each hospice agency to ensure accurate, consistent, and efficient
reporting. This rising workload and growing need for direct provider support further underscore the
necessity of additional staff hours to maintain program quality and compliance.
Increasing the position from 0.5 FTE to 1.0 FTE will provide the capacity needed to reassign essential
administrative and operational duties away from the Chief Medical Examiner, allowing for more efficient
oversight of core functions. Improving versatility will reduce the significant excess hours currently
required of the Chief Medical Examiner, improving workload distribution and supporting long-term
operational sustainability. This adjustment represents a proactive investment in maintaining service
continuity, managing rising caseloads, and stabilizing staffing demands.
Increasing the FTE of this position will ensure that the DD building is consistently staffed Monday through
Friday during standard business hours. At present, the office is staffed by a single employee; when that
individual is required to respond to a scene, no personnel remain available to manage public inquiries,
coordinate body releases, or maintain office operations. Expanding this position will provide necessary
Page 23 of 26
2
coverage to support uninterrupted service delivery, improve operational reliability, and reduce risk
associated with single-staff dependency.
Enabling the Program Coordinator to conduct death investigations during regular business hours would
reduce reliance on on-call deputy staff, generating meaningful savings by offsetting approximately 48
hours of on-call and reportable death coverage within each 80-hour pay period. Additionally, because
on-call income is not guaranteed, it has become increasingly difficult to recruit and retain staff who are
available for daytime hours. Expanding and diversifying the Program Coordinator role would help
address this challenge by providing stable, predictable coverage during peak operational times. This
department also faces an ongoing risk of being understaffed at any given time; establishing a full-time
position with benefit eligibility will significantly strengthen both recruitment and long-term retention.
Further, the staffing structure and required skill set within a Medical Examiner’s Office are highly
specialized and unlike those in other county departments. Increasing the FTE and cross-training this
position will enhance operational resilience, streamline the onboarding process, and improve
competency development by allowing new staff greater exposure to decedent contacts and scene
investigations during training. Collectively, these improvements support cost efficiency, staffing stability,
and sustained service reliability.
In 2026, the Medical Examiner’s Office implemented a comprehensive medication inventory, retention,
and destruction policy. Collecting and documenting prescribed medications found at scenes is a critical
component of the investigative process, providing essential information regarding a decedent’s medical
history and medication compliance—details that are often unavailable from family or other sources.
Proper inventory, secure retention, and compliant destruction are time-intensive tasks, requiring up to
two hours per case depending on the complexity of the decedent’s medical history. Increasing the
Program Coordinator position to 1.0 FTE will ensure these policy requirements are consistently met,
allowing for the necessary level of accuracy, regulatory compliance, and attention to detail. Additionally,
having two full-time staff members (the Program Coordinator and the Chief Medical Examiner) present
in the office will ensure that medication counts and destruction are conducted with dual-staff
verification. This is essential when handling scheduled prescriptions and mitigating associated risk and
liability. Enhancing staffing in this manner will strengthen policy adherence, reduce operational
bottlenecks, and support the integrity and safety of the medication handling process.
An increasing number of funeral homes have implemented policies prohibiting the electronic
transmission of cremation photo documentation. As a result, in-person verification of these materials is
becoming essential to ensure accuracy, efficiency, and compliance in partnership with our funeral home
stakeholders. Increasing this position to 1.0 FTE will allow these required viewings to be scheduled and
completed during regular business hours by full-time staff, rather than relying on deputies who must be
called in at a two-hour minimum. This adjustment will not only improve workflow reliability and service
quality but also reduce avoidable per-diem costs associated with after-hours or unscheduled viewings.

As the county’s population continues to grow—particularly with a significant number of new residents
relocating from Minnesota—the volume and complexity of records requests have increased
substantially. Many individuals do not have an established primary care provider within Wisconsin,
requiring the department to submit multiple records requests to various agencies for a single case. St.
Croix County also contains a heavily traveled interstate corridor, bringing significant tourism traffic and
long-haul truck activity through the region. As a result, many decedents are transient individuals whose
medical histories are difficult to determine, requiring additional investigative time to identify originating
providers and facilities. In 2025 alone, the department issued a minimum of 320 records requests.
Additionally, beginning in 2024, the attestation form became mandatory for obtaining medical history
records. This form must be completed for each facility involved in a case, further increasing the
administrative workload. These factors have collectively expanded the time and coordination required
per case, reinforcing the need for increased staffing capacity to maintain accuracy, timeliness, and
compliance.
The implementation of the Randox multi-drug immunoassay in 2024 added significant new testing
responsibilities that require consistent staff availability. The Program Coordinator is responsible not
only for maintaining the comprehensive tracking log, monitoring inventory, and documenting
maintenance activities, but also for conducting the testing itself to ensure timely and accurate
toxicology screening. These responsibilities are critical for compliance, troubleshooting, and
maintaining testing efficiency. When quantitative toxicology analysis is required, the Program
Coordinator prepares and transports specimens to the nearest FedEx location in Hudson to maintain
proper chain-of-custody. The Program Coordinator also serves as the primary liaison with the
toxicology laboratory, coordinating additional or specialized testing as new synthetic substances
continue to emerge. Increasing this position to 1.0 FTE will strengthen testing reliability, support
regulatory compliance, and ensure timely processing and coordination of increasingly complex
toxicology needs.
Burial transit fee endorsements for cremations originating in Minnesota and finalized in St. Croix County
have increased fivefold since 2021 (from 159 endorsements in 2021 to 622 in 2025). This sharp rise has
significantly expanded the daily workload required to ensure accurate documentation and case
processing. Additionally, the introduction of a fee associated with each endorsement has added
substantial invoicing and tracking responsibilities. These combined administrative demands further
reinforce the need for increased staffing capacity to maintain accuracy, timeliness, and compliance as
caseloads continue to rise.
In conclusion, the cumulative increase in caseload, administrative demands, compliance requirements,
toxicology responsibilities, hospice program needs, medication handling requirements, funeral home
coordination, and records- retrieval complexity demonstrates a clear and urgent need to increase the
Program Coordinator position from 0.5 FTE to 1.0 FTE. This investment will enhance operational capacity,
reduce on-call costs, stabilize the workforce, and ensure the Medical Examiner’s Office can continue
meeting statutory obligations and the growing needs of St. Croix County.
