Tax parcel number: _..#=2=51._-0..._8=0=2=3 ,.. 0..._00.._ ___________________ _ Lot dimensions and area: 15,680 square feet (0.36 acres. which includes Unit B along with 25% interest in the common parking area) Zoning District: Commercial / Business District Part A: General Information and Alternatives Analysis (f o be completed by the applicant) 1. General Information Current use and improvements: The property at 2005 Marinette Ave is an existing single-story denta1 office (Great Blue Dental) with approximately 2,910 square feet of floor area. The site includes an existing on-site parking area. The building currently contains operatories, hygiene rooms, reception, waiting, steriliz.ation, lab, and support spaces. Proposed use: We propose to construct a 1,989-square-foot addition to the existing dental office to expand patient care capacity. The addition measures approximately 34'-0" x 581-611 and wilJ be attached to the west side of the existing building. The addition will increase the total building footprint to approximately 4,899 square feet. The use remains a dental clinic. Description and date of any prior petition for variance, appeal, or special exception: None known. Description and location of all nonconforming structures and uses on the property: None known. Ordinance standard from which variance Is being sought (include code citation): City of Marinette Zoning Code§ 465 -Off-Street Parking Requirements. The code requires one (1) off-street parking space per 200 square feet of usable floor area for medical/dental clinic uses involving patient care (or alternatively 1 per 300 sq. ft. for dental clinics per § 465-211 ). The proposed addition of 1,989 square feet would require approximately 7-10 additional parking spaces depending on the applicable ratio. The site does not have sufficient land area to accommodate the required number of additional stalls while maintaining required setbacks and functional site circulation. Describe the variance requested: We are requesting a variance from the off-street parking requirement to allow the 1,989-square-foot building addition to proceed with fewer additional parking spaces than required by code. The site plan indicates that one (I) additional accessible parking space will be provided per the general notes; however, the full code required complement of parking stalls for the added square footage cannot be accommodated on the existing Jot. Specify the reason for the request: The property is a constrained urban lot bounded by W. Cleveland Ave to the north, existing property lines to the east and west, and the 20' building setback to the north and 10' setback to the east The existing building and surface parking already occupy the majority of the devclopable lot area. The proposed addition is located in the only available expansion area on the west side of the building. There is no remaining ]and area on the parcel to construct the full number of additional parking stalls required by code without encroaching into required setbacks or eliminating existing parking. The physical size and configuration of the lot - not the app1icant's preferences - prevent full compliance. Describe the effects on the property if the variance is not granted: If the variance is not granted, we will be unable to construct the proposed addition and expand the dental clinic to serve more patients. The existing dental office will remain at its current capacity, which is insufficient to meet patient demand in the Marinette area. The property wiJI be functionally I imited in its ability to be used to its permitted purpose as a medical/dental clinic, and a healthcare access gap will persist for the community. 2. A1ternatives Alternatives considered that comply with existing standards and reasons why they were rejected: A smaller addition that would require fewer parking spaces was considered. However, any meaningful addition to expand dental operatory capacity requires sufficient square footage to be clinically functional. A reduced-size addition would not achieve the operational goa1s of expanding patient care and would not be a good alternative for the business. Acquiring adjacent property to provide additional parking was explored. No adjacent parcels are available for purchase or lease for off-site parking at this t.i.ine. Alteraatives considered that require a lesser variance and reasons why they were rejected: Reducing the addition size to approximately 1,000 square feet was considered. This would reduce the parking shortfall but would not provide sufficient space for the additional operatories and support areas needed. A smaller addition does not address the clinical need and would result in an investment that does not solve the underlying capacity problem. Part B: Three-Step Test Step 1: Unique Property Limitation (To be completed by the applicant) Do unique physical characteristics of your property prevent compliance with tlle ordinance? Ill YES - The subject lot is a bounded urban commercial parcel with fixed dimensions. It is constrained on all sides by street right-of-way (W. Cleveland Ave to the north), required setbacks (20' north, 10' east), and existing adjacent properties. The existing building and parking area occupy the majority of the usable lot area. The only viable expansion area - the west side of the building - is the area identified for the proposed addition. Once the addition is constructed, no remaining area on the parcel exists to add the full complement of required parking spaces without violating setback requirements or eliminating existing parking. These are physical constraints inherent to the lot, not circumstances of the applicant's choosing. Step 2: No Harm to Public Interest Analysis of Impacts (To be completed by applicant): Short-term Impacts (through completion of construction): . ' Impact: Construction activity may temporarily affect parking availability and site access on the property. Mitigation measures: Construction will be phased and scheduled to maintain access to the existing parking area and building entrance. Construction vehicles and staging will be confined to the west side of the property near the addition footprint. Extent to which mitigation reduces project impact: Substantially. The existing parking and building entrance remain operational throughout construction. Impact: Minor temporary increase in truck and equipment traffic on W. Cleveland Ave during construction. Mitigation measures: Construction traffic will be limited to off-peak hours where practicable and will comply with all applicable City requirements for construction site management. Extent to which mitigation reduces project impact: Substantially. The construction period is limited in duration. Long-term Impacts (after construction is completed): Impact: A dental office of approximately 4,899 total square feet may generate somewhat more patient and staff vehicle trips than the existing building, which could increase demand for on-site parking. Mitigation measures: Great Blue Dental will implement a staggered appointment scheduling system to manage patient arrival and departure times and minimize peak parking demand. As demonstrated by the existing practice, dental patients do not arrive simultaneously; appointment-based operations inherently limit peak parking demand versus walk-in businesses Extent to which mitigation reduces project impact: Substantially. The appointment-based model of a dental practice means actual peak parking demand is significantly lower than what a raw square-footage formula would suggest. Neighboring properties are not expected to experience material impacts. Cumulative Impacts: Impact: If similar variances were granted to many properties in the area, there could be a general reduction in available off-street parking across commercial zones. Mitigation measures: This variance is requested based on unique physical constraints specific to this lot and use. The appointment driven nature of a dental clinic makes it a low-parking-demand use relative to other commercial users. Any cumulative impact would be mitigated by the city's case-by-case evaluation of variance requests, ensuring that variances are only granted where physical lot constraints, not mere convenience, prevent compliance. Extent to which mitigation reduces project impact: Substantially. the city's variance review process serves as a check against the cumulative erosion of parking standards. Will granting the ,·ariance harm the public interest? NO.The mitigation measures described above - including appointment-based scheduling, an accessible stall addition, and the inherently low peak parking demand ·of a dental clinic - will protect the public interest. The expansion will improve access to dental care for Marinette residents, which itself serves the public interest in community health and welfare. Step 3: Unnecessary Hardship (To be completed by the applicant) Are you applying for an area variance or a use variance? Ill AREA VARIANCE - We seek a relaxation of the dimensional off-street parking count requirement (number of stalls), not a change in permitted use. The property will continue to be used as a dental clinic, a. pennitted use in the applicable zoning district. Is unnecessary hardship present? tiZI YES. Compliance with the strict letter of the off-street parking requirement would unreasonably prevent us from expanding the use of the property for its permitted purpose as a dental cJinic. The physical si:ze and configuration of the Jot make it impossib1e to provide the full number ofrequired additional parking stalJs without encroaching into required setbacks or eliminating existing parking. This constitutes an unnecessary burden that would render confonnity with the parking standard unreasonably burdensome given the unique constraints of this lot. The hardship is created by the physical conditions of the property, not by the applicant's desires or self-imposed circumstances. Part C: Additional Materials / Exhibits The following exhibits are &nbmitted with this application: • Ii!! Architectural Site Plan (Sheet AOSO, Project 25-238) - showing property lines, building setbacks, existing building footprint, proposed addition area, and parking layout. • Ill First Floor Plan (Sheet A I I 0, Project 25-238) - showing existing and proposed building layout with room labels and square footages. • liZI Property lines and setbacks shown on site plan. • liZl Dimensions, locations., and setbacks of existing and proposed structures shown on site plan. • D Lot comers, lines, and footprints to be staked out prior to public bearing. • liZl Location of variance request shown on site plan (west side addition). • Ill Alternatives considered described in Part A. • Ill Location of unique property limitations descn'bed in Part B Step 1.
