Chippewa County approved the Town of Bloomer's zoning around 2003. Motion to approve the rezones and forward to County Board for final consideration. Motion: Approved Result: (3 - 0) Mover: Joel Seidlitz Seconder: Rocky Kempe Ayes: George Rohmeyer, Jr., Joel Seidlitz, Rocky Kempe Nayes: None Absent: Jason Bergeron, David Kelly 4. Discussion on POWTS Maintenance Program Clary discussed the proposed POWTS Maintenance Program, the challenges with the software, the process for creating four separate mailings, the status of the wastewater treatment plants coming back online, the number of notices sent and the number of notices still needing to be sent. Issues: timing of the cards, the $25 late penalty, septics that have never been pumped, the backlog of the service providers and the possible modifications to the program for this year. Clary offered the following modifications to the POWTS Maintenance Program: 1. Late Fee: Waive the late fee for all owners for this year. 2. Seasonal Properties: The Administrative Code allows for an occasionally occupied structure to have an additional 2 years for pumping, if allowed by ordinance. While Chippewa County does not have this provision, DPZ is recognizing a significant scheduling problem with POWTS Maintenance and allowing this option would alleviate some pressure for some owners. DPZ will figure out a process to properly document this within the existing system. 3. Proposed Mailings 3 & 4: Combine into one mailing with one deadline. 4. Compliance Deadlines: Extend the deadlines out to the middle of September for all POWTS owners. 5. Final Non-Compliance Notice: A non-compliance/final notice will be sent out to all POWTS owners if a POWTS maintenance record has not been entered into the county's system by mid-September. 6. Citations: Focus on the individuals who have not pumped their septic systems for over six (6) years. 7. This process is subject to change based on the results over the next month or so. DPZ staff will keep the PZC updated on the status. DPZ's goal is compliance with the program and not to issue citations. Yet, we will still need to take Page 4 of 44 enforcement action for some. While a motion was not made, the PZC was in favor of the proposed modifications. 8. Agenda Items for Future Consideration 9. The temporary moratorium set forth shall be referred to herein as the “Moratorium”. (1) Definition. For purposes of this Moratorium, “Data Center” means a building, campus, or group of buildings used for the primary purpose of cloud compung, arficial intelligence compung, digital storage, networking, internet hosng, colocaon services, cryptocurrency processing, high -performance compung, or other electronic data processing acvies, together with all associated infrastructure necessary for operaon of which the total square feet exceeds 20,000 sq uare feet . (3) Nothing contained herein shall be construed to authorize any use otherwise prohibited under the County Ordinances. (c) Purpose. The purpose of this Moratorium is to preserve the status quo while Chippewa County researches, evaluates, and develops comprehensive plans and zoning regulaons governing the sing, construcon, operaon, expansion, maintenance, and decommissioning of Data Centers in order to preserve and protect public health, safety and general welfare. (d) Authority. This Moratorium is adopted pursuant to the authority granted to counes under Wis. Stat. § 59.03 , Wis. Stat. § 59.69 (4), and any other applicable provisions of Wisconsin law authorizing counes to regulate land use and adopt temporary moratoriums to preserve the public health, safety, and general welfare. The County Board finds that adopon of this Moratorium constutes a reasonable exercise of its police powers and zoning authority for the preservaon and protecon of the public health, safety and general welfare of Chippewa County’s residents, natural resources, property, businesses and visitors. (e) Duration of Moratorium . Page 30 of 44 Public Hearing Draft Dated: July 22, 2026 Page 5 of 6 The County Board reserves the right to amend this Moratorium as permited by Wisconsin law if it determines such amendment is necessary to protect the public health, safety, and general welfare or to facilitate implementaon of permanent zoning regulaons. (f) Direction to Develop Data Center Regulations. During the period of this Moratorium, the Commitee, and the Chippewa County Director of Planning and Zoning (the “Administrator”), or the Administrator’s delegate(s), are directed to research and dra an amendment to the County Zoning Ordinance, to be presented to the County Board, providing comprehensive and appropriate regulaons of Data Centers to protect the health, safety and general welfare of Chippewa County’s residents, natural resources, property, businesses, visitors and the public from the potenal impacts of Data Center construcon and operaon in Chippewa County. It is the intenon of the County Board to amend the Chippewa County Comprehensive Plan and the County Zoning Ordinance by adopng an amendment to the exisng County Comprehensive Plan and County Zoning Ordinance to address the sing and regulaons for the development and use of Data Centers, before the expiraon of the moratorium set forth in this Moratorium. (g) Subjects for Consideration. In preparing an amendment to the exisng County Comprehensive Plan and County Zoning Ordinance, the Commitee and the Administrator shall review the possible impacts that Data Centers may have on the health, safety and general welfare of the residents, natural resources, property, businesses and visitors of Chippewa County. The Administrator may, in his or her discreon, consult with other counes and municipalies, review and research appropriate studies and informaon pertaining to data centers, associated infrastructure, sing impacts, land use impacts, and other impacts, and then report back to the Commitee. The Administrator may also, in his or her discreon, consult with any professionals, experts or scholars with knowledge about the possible impacts of these systems, including but not limited to engineers, lawyers, law enforcement officers, fire fighters and those with specialized knowledge in the fields of data storage facilies’ potenal impacts on the human environment, geology, soils, water quality and conservaon, emergency response, or other public health or environmental protecon issues, and then report back to the Commitee. The Commitee shall provide opportunies for public parcipaon in its review process, and consider the public health, safety and general welfare of Chippewa County’s residents, natural resources, property, businesses and visitors throughout the process. (h) Severability. If a secon, subsecon, paragraph, sentence, clause, or phrase of this Moratorium is declared unconstuonal or invalid for any reason by any court of competent jurisdicon, such decision shall not affect the validity of the remaining porons of this Moratorium. Page 31 of 44 Public Hearing Draft Dated: July 22, 2026 Page 6 of 6 (i) Construction. If the provisions of this Moratorium are found to be inconsistent with other provisions of this ordinance or any County Ordinances, the provisions of this Moratorium are deemed to control. 2. That this ordinance amendment shall take effect upon passage and publicaon. Forwarded to the County Board by the Planning & Zoning Commitee. POWTS & Wells CHIPPEWA COUNTY Date: July 14, 2026 To: Andy Albarado, County Administrator From: Douglas Clary, RE: 2027 DH Requested Budget Submission Good Afternoon Mr. Albarado, Please find attached a copy of the 2027 DH Requested Budgets for the Department of Planning & Zoning (DPZ), which I plan on introducing to the Planning & Zoning Committee on July 23, 2026. Below, I have highlighted the major changes or points of consideration within these budgets: 1. 100-53-56410 – Planning & Zoning a. Per Budget letter – The requested tax levy increase was limited to 55% of the increase between the 2026 and 2027 Position Based Budgeting (PPB) spreadsheets. b. The permit fees are estimated on a projected value around a 6-year and 7-year average. c. In 2026, some of the department’s fees were increased. I have tried to capture a reasonable figure to include in the budget until we can get some more data through the upcoming years. d. I increased the POWTS Maintenance Fee from $3 to $4, which is projected to net an additional $17,860. e. I have placed a line item in the budget to contract with OPG3 to build a public portal where residents can access our permit records. This will still need to be scoped and approved within the applicable guardrails. 2. 100-53-56411 – Building Inspection Fund (Uniform Dwelling Code) a. This budget is funded 100% through revenues received from related inspections. 3. 100-53-56413 – Comprehensive Planning Project a. $30,000 for potential Land Use Planning Plans. 4. 100-54-51715 – Land Records Program a. Per Budget letter – The requested tax levy increase was limited to 64% of the increase between the 2026 and 2027 Position Based Budgeting (PPB) spreadsheets. b. $120,000 was budgeted for upgrading our LiDAR. This project would be subject to Chippewa County and surrounding counties successfully being approved for a federal grant via the USGS -3DEP program. The total projected cost is just over $300,000, with USGS and other partners carrying approximately $185,850 of the project. c. $50,000 was budgeted for miscellaneous projects as listed in the Land Records modernization Plan and would be subject to the county receiving an increase in the Strategic Grant. See 220- 54-51715 budget for additional info. 5. 100-54-51725 – Plat Book/Road Map Publishing a. A plat book was produced in 2021. We have been seeing a significant drop in plat book sales due to the increased functionality of our GIS web site. Thus, the incoming revenues are the sale of plat books has been decreasing. This being said, in the past the funds within the account are also used to assist in the purchase of aerial photography and other information that adds value to our GIS. 6. 100-54-51912 – Tax Deed Expense a.
