Ordinances
Denial Report: Text Amendment to the Door County Comprehensive Zoning Ordinance – Clay Banks
Motion by Fisher, seconded by Tlachac to accept the report and the denial recommendation.
The Town of Clay Banks petitioned to amend the Door County Comprehensive Zoning Ordinance to state that
temporary uses are prohibited within the Town of Clay Banks. Currently, uses which are conducted on a lot for not
more than 10 days total, including not more than 7 consecutive days, in a calendar year shall be known as
temporary uses and may be conducted in any zoning district, except the Wetland district, except that in the Town
of Liberty Grove, temporary uses may be conducted for not more than 6 days total, including not more than 3
consecutive days. The Resource Planning Committee held a public hearing concerning this petition on July 16,
2026 at the Door County Government Center, Sturgeon Bay, WI. Notice of the public hearing has been given in
accordance with Chapter 59.69, Wisconsin Statutes. Proof of publication of the notice of the public hearing and
proof of the giving of notice to the town clerk of the hearing is attached hereto.
The Resource Planning Committee recommends denial of the text amendment petition for the following reason:
The Committee decided they need more time to consider the language in regards to temporary uses and will
reconvene on this topic for further discussion to possibly sponsor their own proposed text amendment. Several
towns had various requests of which RPC noted and will consider moving forward to incorporate into one overall
future update. Discussion followed. CC Donohue explained under the Comprehensive Zoning Ordinance the
County allows a temporary use for a certain number of days per year which is not otherwise permitted within a
zoning district such as temporary garage sales, weddings at Cave Point, town festivals with vendor stands;
temporary use on a limited basis is allowed. Number of days allowed was reviewed and other counties regulations
were reviewed when RPC reviewed the petition. Motion carried by voice vote.
Report Amendment to the Zoning Map of Baileys Harbor
Motion by Fisher, seconded by Zettel to accept the report and accept the report. Motion carried by voice vote with
Supervisor Pluff voting no.
2026-03 Amendment to the Zoning Map of Baileys Harbor
Motion by Fisher, seconded by Zettel to approve Ordinance 2026-03.
CC Donohue explained the zoning amendment request came from a property owner in the Town of Baileys
Harbor for an amendment to the detailed zoning map to rezone two upper parcels from Countryside (CS) to
Mixed-use Commercial (MC). The two parcels were surrounded by MC and the request was to make the area
uniform. The property owner also wanted to include another lower parcel. The matter was considered by the
Town of Baileys Harbor. The Town voted to change the upper two parcels but not the lower parcel. The intent of
the change was for future development to subdivide the property into smaller lots to increase the potential for a
mixture of commercial businesses and residential uses in the area. The Resource Planning Committee agreed
with the Town of Baileys Harbor and recommends approval of a modified zoning map amendment petition,
whereby the two northern lots (7886 CTH A and 7880 CTH A) be rezoned from Countryside (CS) to Mixed Use
Commercial (MC), but not the southern lot (parcel ID 002-01-26302723C). Reasons for recommending a
modified petition include: 1. The proposed modified amendment is consistent with the town’s recommendation; 2.
The proposed modified amendment is consistent with the Future Land Use map designation.
Motion carried by roll call vote with 17 Members voting Yes; 1 Member voting No – Pluff; 3 Members excused.

MEMORANDUM
Date: September 17, 2026
To: Door County Board of Supervisors
From: Sean Donohue, Corporation Counsel
Re: Taxpayer request for reimbursement of interest and penalty on 2025 property tax
second-installment payment under Wisconsin Statute § 74.69
Property Tax Interest and Penalty Reimbursement Request
A taxpayer, Margie Nelson, asserts she prepared and mailed the second installment of her
2025 property taxes (due July 31, 2026) before the deadline. Ms. Nelson claims the County
did not receive the payment due to a U.S. Postal Service issue. After learning the payment
was not received, Ms. Nelson stopped payment on the original check and submitted a
replacement.
Ms. Nelson requests a determination under Wis. Stat. § 74.69 that the original payment would
have been timely if not for U.S. Postal Service delay or administrative error, and asks to be
reimbursed for interest and penalties she paid due to the late payment. Ms. Nelson’s request is
attached for your review.
As of the date of this memorandum, the Door County Treasurer’s Office has not received the
original payment.
Wisconsin Statute § 74.69
General Rule:
A property tax payment is timely if it is mailed in a properly addressed envelope, postmarked
before midnight of the prescribed due date for making the payment, with postage prepaid, and
is received by the proper official, regardless of when it is received.
U.S. Postal Service Delay Exception:
A payment which is not timely under the general rule solely because of a delay or
administrative error of the U.S. Postal Service shall be considered timely.
County Board’s Role Under § 74.69
The County Board is the body authorized to determine whether the sole reason the payment
was not timely made was a delay or administrative error by the U.S Postal Service.
If the Board finds both of the following:
1. The taxpayer timely mailed the payment, and
2. The payment was not received solely because of U.S. Postal Service delay or
administrative error,
then the Board must direct reimbursement of all interest and penalties paid because the
payment was not made timely.
If the Board cannot make these findings, the request should be denied.
Action Options
1. Approve Reimbursement
Motion:
“I move to determine, under Wisconsin Statute § 74.69, that the taxpayer’s second-
installment payment was timely mailed but not received solely due to U.S. Postal
Service delay or administrative error; and to direct the Door County Treasurer to
reimburse the interest and penalty paid by the taxpayer.”
2. Deny Reimbursement
Motion:
“I move to deny the taxpayer’s request for reimbursement under Wisconsin Statute §
74.69 because the Board cannot make the required findings that payment was
appropriately made but not received solely due to U.S. Postal Service delay or
administrative error.”
