Public Safety Radio System Upgrade Vendor Recommendation
TS Project Manager Ashley DeGrave presented a PowerPoint on the Public Safety Radio System which
included: Invitation to Negotiate (ITN) - layout of system requirements (frequencies, site design/layout,
coverage requirements, warranty, maintenance and monitoring pricing equipment refresh); ITN timeline –
released February 27th, required pre-proposal conference, proposals due May 11th – three received (Motorola,
Racom/L3Harris, and Bay Electronics); Committee review process – first and second review, questions
submitted to vendors, vendor response, demos, additional clarification from vendors, committee met for
discussions, grading, and selection; preferred / recommended vendor – Bay Electronics / EF Johnson – initial
pricing proposal $34,220,571; next steps / timeline – request approval to move forward with the recommended
vendor, finalize contract details, present final contract in November / December.
TS Director Jason Rouer explained the technology itself does not use AI to share data. From a loose
standpoint, there is intelligence built into the system but it is nothing to be concerned about as a county.
DeGrave noted all three proposals submitted were very similar. Costs came within discussed budget. All
systems proposed met requirements. The County’s working relationship with Bay Electronics and their
2 of 40
knowledge of County systems was an important metric when making the vendor recommendation. It is
anticipated the system would be live in Spring 2028. Staff is working with Nsight and Vertical Bridge for tower
construction.
Public Safety Radio System Project Update
The vendor has been recommended. Staff continue to search for tower sites to acquire.
Motion by Jeanquart, seconded by Shaw to direct staff to negotiate with Bay Electronics for the Public Safety
Radio System contract. Motion carried by voice vote.

Attn: Ashley DeGrave
421 Nebraska Street
Sturgeon Bay, WI 54235
Subject: Annual Radio System Maintenance Contract
Ms. DeGrave:
Per the request of the county, Bay Electronics submits the following pricing for annual maintenance of the radio communication system. This
proposal encompasses the entire network as a whole; radio infrastructure, radio dispatch infrastructure and network/microwave infrastructure.
Per our discussions, we are proposing an 18 month service contract for the radio system maintenance, for the time frame of January 2027 – June
2028, with the agreement of moving to a month-to-month contract based on the status and completion date of the new Door County P25 Radio
system.
• January 2027 – June 2028: $227,745.00/18-Month Contract
o Contracts will be billed monthly on the 1st of each month = $12,625.20/month (current payment arrangement)
As part of this maintenance contract, the county will receive the following service and support from Bay Electronics:
• System Spares
o Bay Electronics will maintain a complete spares part inventory for system, currently Bay Electronics maintains spare parts for
approximately 90-95% of the entire system
• Annual Maintenance Inspection
o Repeater/Receiver Testing
▪ TX Frequency Error, Coded Squelch Modulation, Local Voice Modulation, Dispatcher Voice Modulation, Console Tone
Modulation, Power Output (Chassis/After Filter), Reflected Power, Receiver Sensitivity, Tone Level, Local TX
Descense, Site Noise
o Antenna Line Sweeps
o Battery Maintenance and Capacity
o Microwave Quality and Performance
o Site Clean-Up as necessary
• Response Time as Dictated by Schedule (PLEASE NOTE! Bay Electronics makes best effort to respond to issues regardless of category as
quickly as possible, in most circumstances less than 20 minutes)
o Category A: 365/24/7
o Category B: Monday – Friday, 8 a.m. – 4:30 p.m
o Time and Material: As Needed
A complete list of the equipment and maintenance schedule is attached. If there any questions in regards to this proposal, please feel free to
contact me at your convenience. Thank you!
Respectfully submitted,
Bay Electronics, Inc.

VOLUNTARY AGREEMENT
BY AND BETWEEN THE STATE OF WISCONSIN
DEPARTMENT OF HEALTH SERVICES,
AND
Door County
for
Jail-Based Competency Services in the Door County Jail
This Agreement (“Agreement”) is made and entered into by and between the State of Wisconsin Department of Health
Services (“DHS”), and Door County, Wisconsin (“the County”), hereinafter collectively referred to as “the parties.”
WHEREAS, Wis. Stat. § 971.14(5)(a)1. provides that a Court shall commit a criminal Defendant that it finds not
competent to proceed but likely to become competent to DHS for custody and treatment to competency; and,
WHEREAS, that statute provides that the DHS shall determine whether the defendant may appropriately receive
treatment to competency in a County jail; and,
WHEREAS, the DHS has determined that treatment to competency of certain individuals may be appropriate in a County
Jail.
NOW, THEREFORE, in consideration of the mutual responsibilities and considerations set forth herein and in any exhibits
attached hereto and incorporated herein by reference, DHS and County agree as follows:
1. TERM OF AGREEMENT
The Term of this Agreement begins on 10/01/26 and auto renews annually on 10/01.
2. SCOPE OF THIS AGREEMENT
The Agreement and any Exhibits and/or Attachments to this Agreement constitute the entire understanding
between the parties. Any conflict in terms shall be governed by the highest listed source. The order of
precedence is as follows:
a. Laws, regulations and policies of the State.
b. This Agreement, including all exhibits, attachments, appendices, and addenda to the Agreement.
3. DESCRIPTION OF WORK
This Agreement supports treatment to competency of designated inmates in the custody of the County Jail who
have been determined by the Court to be not competent to proceed at trial, but likely to become competent if
treatment is provided.
a. The County shall provide, at its own expense, the care and treatment it would otherwise provide to any
inmate in the Jail.
b. The County agrees to provide access in the Jail to the designated Jail inmates for DHS staff and/or DHS
subcontractors for purposes of providing competency treatment in furtherance of the Court ordered
treatment to competency. The County agrees to provide a suitable space in the jail for treatment to
competency programming to occur, this space should support individual counseling between the Jail
inmate and the provider of service.
c. The County agrees to provide a virtual access option in the Jail to the designated Jail inmates for DHS
staff and/or DHS subcontractors for purposes of providing competency treatment in furtherance of the
Court ordered treatment to competency.
d. DHS will provide services that support the attainment of competency and recovery including:
psychotropic medications, psychiatric consultation, forensic case management/system navigation, and
legal education (if appropriate).
e. The County shall collaborate with DHS staff and/or DHS subcontractors for the purpose of innovative
service delivery options such as group education.
28 of 40
2
Definitions
i. Forensic Case Management: Coordination of care between levels of care (inpatient, jail,
outpatient), assessment and treatment planning to assist the individual in addressing barriers to
competency, and other issues that may prevent their return to the criminal justice system.
ii. Legal Education: Education to help the client understand the nature and consequences of the
legal proceedings against them, and to assist in their own defense. This service may not be
provided to individuals who are unable to participate due to mental health instability.
iii. Psychiatric Consultation: Provision of psychiatric consultation to the jail mental health
prescriber for the purpose of providing support regarding pharmacological intervention. The
consulting psychiatrist is available to provide diagnostic clarification and treatment
recommendations, including but not limited to pharmacologic treatments.
f. The County will collaborate with DHS and other partners to provide and support medication access and
continuity in prescribing.
i. If DHS clients are prescribed medication by a prescriber at a DHS facility or community-based
DHS program, the County shall continue those medications without interruption and/or delay. If
the jail prescriber determines there is an associated safety concern or contraindication, they
shall request a consultation with the DHS psychiatrist consultant
ii. Medications indicated in the DHS/Wisconsin Medicaid formulary should be made available to
DHS clients without interruption and/or delay. If the jail prescriber determines there is an
associated safety concern or contraindication, they shall request a consultation with the DHS
psychiatrist consultant.
1. Rationale: If the jail prescriber were to prescribe medications that are not on the
Medicaid formulary, upon arrival in the community the client would likely have to be
switched to a different medication, which can destabilize their condition. This is
especially true with mental health medications.
iii. Jail prescriber comfort with, or general preference for, a particular medication does not
constitute a clinical indication. If there is a substantial clinical indication to discontinue, replace,
or change the dosage/dosing/formulation of a medication that was effective, the prescriber will
make reasonable attempts to discuss the change with the patient’s community or DHS facility
provider of that medication if clinically appropriate, and will meet with the patient, explain the
reason for the change, and provide education about the new plan. If in making this decision, the
jail prescriber needs documentation or historical records, the assigned forensic case manager
can provide assistance.
iv. The County shall not charge DHS clients for psychotropic medications while they are receiving
Jail-Based Competency Services.
v. The County shall not require DHS clients to initiate a request for mental health services; rather,
this service connection and subsequent treatment recommendations, education, and
prescription (if applicable) shall be initiated by the jail prescriber or designee.
4. CANCELLATION AND TERMINATION
a. Termination for Cause
Either party may terminate this Agreement after providing the other party with ten (10) calendar day’s
written notice of the right to cure a failure to perform under the terms of this Agreement unless the other
party cures its failure within the 10-day notice period.
Upon the termination of this Agreement each party shall be released from all obligations to the other party
arising after the date of the termination or expiration, except for those that by their terms survive such
termination or expiration.
b. Termination for Convenience
Either party may terminate this Agreement at any time, without cause, by providing a written notice to the
other party at least ninety (90) days in advance of the intended date of termination. In the event of
29 of 40
3
termination for convenience by the County, treatment to competency of the inmates in the Jail shall
continue under this Agreement until the date of termination and the inmates will remain in the custody of
the Jail, until DHS, in its sole discretion, makes other provision for the inmates.
5. NON-APPROPRIATION
DHS reserves the right to cancel this Agreement in writing, in whole or in part, without penalty, if the Wisconsin
Legislature, United States Congress, or any other direct funding entity contributing to the financial support of
this program fails to appropriate funds necessary to continue jail-based restoration programming. The County
reserves the right to cancel this Agreement in writing, in whole or in part, without penalty.
6. CONFIDENTIAL, PROPRIETARY, AND PERSONALLY IDENTIFIABLE INFORMATION
In connection with the performance of work hereunder, it will be necessary for DHS to disclose to County certain
information that is considered to be Confidential, Proprietary, or containing Personally Identifiable Information
(“Confidential Information”). The County shall not use such Confidential Information for any purpose other than
the limited purposes set forth in this Agreement, and all related and necessary actions taken in fulfillment of the
obligations herein. The County shall hold all Confidential Information in confidence, and shall not disclose such
Confidential Information to any persons other than those directors, officers, employees, and agents who have a
business-related need to have access to such Confidential Information in furtherance of the limited purposes of
this Agreement and who have been apprised of, and agree to maintain, the confidential nature of such
information in accordance with the terms of this Agreement.

limited purposes of this Agreement and who have been apprised of, and agree to maintain, the confidential
nature of such information in accordance with the terms of this Agreement.
Indemnification: In the event of a breach of this Section by DHS and the State, DHS and the State shall indemnify
and hold harmless the County and any of its officers, employees, or agents from any claims arising from the acts
or omissions of DHS and the State, and its Subcontractors, employees and agents, in violation of this Section,
including but not limited to, disallowances or penalties from federal oversight agencies, and any court costs,
expenses, and reasonable attorney fees, incurred by the County in the enforcement of this Section.
Equitable Relief: The County acknowledges and agrees that the unauthorized use, disclosure, or loss of
Confidential Information may cause immediate and irreparable injury to the individuals whose information is
disclosed and to the DHS, which injury will not be compensable by money damages and for which there is not an
adequate remedy available by law. Accordingly, the parties specifically agree that the DHS, in its own behalf or
on behalf of the affected individuals, may seek injunctive or other equitable relief to prevent or curtail any such
breach, threatened or actual, without posting security and without prejudice to such other rights as may be
available under this Agreement or under applicable law.

7. NOTICE AND CHANGE OF CONTACT INFORMATION
Any notice required or permitted to be given hereunder shall be deemed to have been given on the date of
delivery or three (3) Business Days after mailing by postal service, certified or registered mail-receipt requested.
In the event the County updates contact information, the County shall inform DHS of such change in writing
within ten (10) Business Days. DHS shall not be held responsible for payments delayed due to the County’s
failure to provide such notice. In the event the DHS updates contact information, the DHS shall inform County of
such change in writing within ten (10) Business Days.
8. EXAMINATION OF RECORDS AND INFORMATION SHARING
DHS shall at any time during normal business hours, upon reasonable notice, have access to and the right to
examine, audit, excerpt, transcribe, and copy, on County's premises, any of the County’s records involving
transactions directly pertinent to this Agreement. If the material is on computer data storage media, the County
shall provide copies of the data storage media or a computer printout of such if DHS so requests. Any charges
for copies of books, documents, papers, records, computer data storage media or computer printouts provided
by the County shall not exceed the actual cost to the County. This provision shall survive the termination,
cancellation, or expiration of this Agreement.
The County will provide inmate records to DHS upon request. Records should be sent via email whenever
possible. Records requested may include, but are not limited to:
• Medication Lists
• Incident/Conduct Reports
• Classification Reports
• Medication Administration Record (MAR)
• Assessment or evaluations
9. APPLICABLE LAW
This Agreement shall be governed by the laws of the State of Wisconsin. The County shall at all times comply
with and observe all federal and state laws, rules and regulations, and policies and procedures relating to the
provisions of services under this Agreement.
10. BREACH NOT WAIVER
A failure to exercise any right, or a delay in exercising any right, power or remedy hereunder on the part of
either party shall not operate as a waiver thereof. Any express waiver shall be in writing and shall not affect any
event or default other than the event or default specified in such waiver. A waiver of any covenant, term or
condition contained herein shall not be construed as a waiver of any subsequent breach of the same covenant,
term or condition. The making of any payment to the County under this Agreement shall not constitute a waiver
of default, evidence of proper County performance, or Acceptance of any defective item or work furnished by
the County.
11. AGREEMENT AMENDMENT
This Agreement may not be modified or amended except by mutual Agreement of both parties in writing. The
automatic renewal of this document does not intend to decrease communication between DHS and the
County for program improvement and collaboration. DHS will reach out to the County, at a minimum, annually
to gather feedback and offer an opportunity to discuss any questions or concerns. Technical assistance will be
provided as needed throughout the life of this agreement.
12. SEVERABILITY
If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable,
the remainder of the Agreement shall remain valid and in full force and effect. The invalid provision shall be
replaced by a valid provision that comes closest in intent to the invalid provision.

13. SOVEREIGN IMMUNITY
Nothing in this Agreement shall be construed to constitute a waiver of the County’s immunity under applicable
law, or the State’s sovereign immunity under the Eleventh Amendment to the United States Constitution and
Article IV, Section 27 of the Wisconsin Constitution.
14. ENTIRE AGREEMENT
This Agreement, including all documents incorporated herein by reference, constitutes the final and complete
Agreement of the Parties in connection with the subject matter hereof, and supersedes all prior and
contemporaneous Agreements, understandings, negotiations, and discussions, whether oral or written, by the
Parties. This Agreement shall be construed as a fully integrated Agreement. There are no warranties,
representations, or Agreements among the parties in conjunction with the subject matter hereof, except as
specifically set forth or referred to herein.
15. RESPONSIBILITY FOR ACTION
The County shall be solely responsible for its actions and those of its agents, employees, or Subcontractors
under this Agreement, and neither the County nor any of the foregoing parties has authority to act or speak on
behalf of DHS. The DHS shall be solely responsible for its actions and those of its agents, employees, or
subcontractors under this Agreement, and neither the DHS nor any of the foregoing parties has authority to act
or speak on behalf of the County.
16. STATE TAX EXEMPTION
DHS is exempt from payment of Wisconsin sales or use tax on all purchases.
17. FORCE MAJEURE
Neither party shall be in Default by reason of any failure in performance of this Agreement in accordance with
reasonable control and without fault or negligence on their part. Such causes may include, but are not restricted
to, acts of nature or the public enemy, acts of the government in either its sovereign or contractual capacity, fires,
floods, epidemics, quarantine restrictions, strikes, freight embargoes and unusually severe weather, but in every
case, the failure to perform such must be beyond the reasonable control and without the fault or negligence of
the party.
18. CONTRACTOR AND APPARENT AGENCY
The County, its officers, agents, and employees, in the performance of this Contract, shall act in the capacity of
an independent contractor and not as an officer, employee, or agent of DHS. To the extent within its reasonable
control, the County agrees to take such steps as may be necessary toward assuring that each Subcontractor
under this Contract will be deemed to be an independent contractor and will not be considered or permitted to
be an agent, servant, joint venture, or partner of DHS. The County shall not take any action, or make any
omission, that may imply, or cause others to reasonably infer, that the County is acting as a DHS agent in any
matter or in any way not expressly authorized by this Contract.
19. JAIL-BASED COMPETENCY RESTORATION PROGRAM CONTACT INFORMATION
For any questions or concerns related to the Jail-Based Competency Restoration Program (JBCR), please contact

RE: Annual fee for service review/recommendation
Background:
The Judiciary and Public Safety Oversite Committee of the Door County Board of Supervisors is tasked
with establishing the billing base rates and loaded mileage charge (per mile with patient on board) for
Door County’s ambulance service. The last review/increase occurred March of 2025. Our intent going
forward is to review rates annually in the fall of the year with any changes to take effect January 1 of the
next year.
Consideration:
Base Rates:
ALS emergent (A0427) Current: $1,200 No increase recommended
ALS non-emergent (A0426) Current: $1,200 No increase recommended
BLS emergent (A0429) Current: $900 No increase recommended
BLS non-emergent (A0428) Current: $900 No increase recommended
ALS II (A0433) Current: $1,300 No increase recommended
SCT (A0434) Current: $1,300 No increase recommended
Service Charge ALS (A0998) Current: $300 No increase recommended
Service Charge BLS / Lift Assist Current: No Charge No change recommended
37 of 40
Resident vs Non-resident rates Current: No Charge No change recommended
Mileage:
Loaded Miles Current: $21.00 per mile No increase recommended
Special Events Varied Rate No changes recommended
Ambulance: $49 per hour
Command/chase vehicle: $37 per hour
Paramedic/AEMT/EMT: $43 per hour (same rate regardless of rank)
Command Staff: $72 per hour
Ambulance with crew: $135 per hour
Chase vehicle with one EMS: $80 per hour
Command vehicle with one command staff: $109 per hour
Estimated annual revenue is less than $5,000
Considerations:
• We truly do not dedicate equipment/personnel to an event. We must make it clear that
in times of disaster or mass casualty our equipment/personnel will be pulled from the
event.
• An event may have an insurance policy that dictates the level (EMT/AEMT/Paramedic)
of personnel required. We will do our best to meet their need.
• As command staff, we dictate the minimum needs required to protect the event.
• At this point in time, these requests are handled on a case by case basis.
• Established events (triathlon/fair) have preference over new events on the same dates.
• Any event requesting the fee be waiver or reduced must make a formal written request
to the Judicial and Public Safety committee.
Recommendation:
As noted with each rate, I am not recommending any increases or changes to take effect January 1st of
2027. Our increases in 2025 ranged from 20-30% and put us to the high end of our comparables in
northeast Wisconsin.

DATE: September 2, 2026
TO: Door County Board Public Safety Committee
FROM: Sean Ryan, Race Director Door County Triathlon
MESSAGE:
I am writing to request that the Door County Board of Directors Public Safety
Committee waive the Door County Emergency Services invoice dated August 28,
2026 in the amount of $4,148 for services provided to the July 11-12, 2026 event.
While we enjoyed a slight increase in participation this year with nearly 2,000 athletes,
our registration revenue dropped more than $20,000 as we replaced our Half Iron course
with a lower priced Olympic Distance course to address changing market conditions.
Door County Triathlon has a significant tourism impact each year for Door County.
Based on our annual participant survey, this year’s participants generated over 2,200
lodging nights and $1.3 million in local spending.
Door County Triathlon also contributes a significant amount to local charities each year.
This year’s event will benefit more than 20 local non-profit organizations. Since 2005, the
event has donated over $1 million to charities in Door County and northeast Wisconsin.
Door County Triathlon is a 501C3 charity organization governed by a nine-member board.
The current list of board members includes David Eliot, Tonya Felhofer, Jon Jarosh, Polly
Kuehn, Erin Shortall, Wayne Spritka, Deb Neuville, and Bill Woodward.
