STAFF REPORT
Conditional Use Permit Application
Applicant Information
• Property Owner: Ronald and Kelly Leuzinger Revocable Trust
• Applicant: James Leuzinger
• Parcel Identification Number: 018-25-0022
• Zoning District: Recreational Commercial (RC)
• Petition request, including sections of zoning ordinance requiring permit:
James Leuzinger, on behalf of the Ronald and Kelly Leuzinger Trust, is requesting a conditional use permit to install a
210 square foot addition to the single-family residence located at 1110 Wagon Trail Circle. The lot contains 30 single-
family residences and is considered a Multiple Occupancy Development (MOD) . A conditional use permit is required
for the addition because not all units in the MOD meet all setback requirements.
Ordinance Sections: 2.05(3)(a), 4.08(8) & 11.04 of the Door County Comprehensive Zoning Ordinance
Description of Subject Property and Surrounding Area
• Lot Area: 27.71 acres
• Road & Shore Frontage: Private Road named Wagon Trail Circle is accessed from the north by County ZZ;
Approximately 1,000 Feet of Shoreline.
• Traffic patterns/road usage: Traffic on County ZZ is light to moderate depending on the season. Wagon Trail Circle
has light traffic from the residents of the MOD.
• Existing uses/structures: The lot contains 30 single-family residences and is considered a Multiple Occupancy
Development (MOD). The MOD is known as Wagon Trail Condominium.
• Surrounding Area: Surrounding lots to the South are zoned Wetland (W), Natural Area (NA), Single-Family
Residential-30,000 (SF-30) and Recreational Commercial (RC). Surrounding lots to the North and East are zoned
Recreational Comercial (RC) and Wetland (W). The former Rowleys Bay Resort is to the North.
Zoning Considerations
• Purpose of zoning district: DCCZO Section 2.03(18) Recreational Commercial (RC). “This district is intended for Door
County's resort areas, particularly areas where high concentrations of recreational uses are located or are
appropriate. These areas are not intended to develop into business districts and, thus, many retail, office, and
service uses are restricted or prohibited in favor of recreational uses such as golf courses, ski resorts, multiple
occupancy developments, marinas, and restaurants. Lot sizes of at least 20,000 square feet are required for new
lots.”
• Does the use meet the zoning ordinance’s stated purpose and intent? Yes.
• Specific requirements for proposed use and/or possible conditions that may be relevant.
1. A regular zoning permit authorizing construction of the building(s) shall be obtained within 12 months;
construction must begin within 12 months of the issuance of the regular zoning permit.
2. The project(s) shall comply with all applicable local, state, and federal building codes and ordinances, including
obtaining all required approvals and permits prior to beginning construction.
3. The entire project shall be completed by ___________________ (RPC to determine date).

4. Any outdoor lighting erected in conjunction with this use shall utilize fixtures whose lens, hood, or
combination thereof allow no direct beams to be seen from off the property or cast skyward, and the lighting
elements of which shall not be visible from adjacent properties.
Comprehensive Plan Considerations
County comprehensive plan land use map designation and description.
The subject parcel is designated as Commercial and Woodland / Wetland / Natural Area on the comprehensive plan’s
future land use map, as described below and shown in the attached map.
Commercial – “Commercial” areas are those intended for development with retail sales, trade of goods and/or
services, commercial offices, and commercial lodging establishments and are found largely in community
centers, core areas, or “downtowns.” Commercial areas should maintain defined boundaries, avoid excessive
access points to major roads by encouraging shared driveways or internal circulation patterns, and have
buffering or screening of light industrial uses and storage and parking areas from adjacent public rights-of-way
and residential areas. Highway corridor development should avoid further strip development and loss of
community separation by limiting future development density, employing stringent setbacks, and requiring
screening of new uses. Note that the future land use maps depict many “outlying” (i.e., non-core) commercial
areas, reflecting existing commercial zoning or businesses such as multiple occupancy developments; when
redevelopment is proposed for the latter, it should be undertaken carefully and with consideration for
neighborhood compatibility.
Woodland/Wetland/Natural – Lands designated as “Woodland/Wetland/Natural” are primarily in a natural
state, and include wetlands, woodlands, and public and private conservancy areas. Note that lands in this
category can – outside of wetland and conservancy areas – and most likely will, contain very low-density
residential uses in upland areas. The character of these regions should be protected by discouraging any
development that would adversely impact the environmental quality or natural beauty of these areas.
Maintenance of these natural areas should include continued private stewardship and public ownership or, if
necessary, acquisition of easements or additional public lands.
The subject property is located in what the Commercial future land use category considers to be an “outlying”
commercial area. Redevelopment within these areas is to be undertaken carefully and with consideration for
neighborhood compatibility. The rebuilding and expansion of an existing multiple occupancy development is,
however, allowed by the zoning ordinance via a conditional use permit. Thus, presumably, any concerns regarding
neighborhood compatibility can be alleviated via any conditions the Resource Planning Committee deems
appropriate.

APPLICATION FOR CONDITIONAL USE PERMIT – ADDENDUM
A conditional use permit applicant has the burden of proof. S/he must demonstrate that the application and all
requirements and conditions established by the Resource Planning Committee relating to the conditional use are or shall
be satisfied, all of which must be supported by substantial evidence. “Substantial evidence” means facts and information,
other than merely personal preferences or speculation, directly pertaining to the requirements and conditions an applicant
must meet to obtain a conditional use permit and that reasonable persons would a ccept in support of a conclusion.
If an applicant meets this burden of proof, the Resource Planning Committee will grant the conditional use permit. If an
applicant fails to meet this burden of proof, the conditional use permit application will be denied.
To aid in its review of the proposed project, the Committee will consider the Door County Comprehensive Zoning
Ordinance criteria set forth below. Answer all portions of all questions completely. State “not applicable,” if appropriate,
offering an explanation as to why facts and information were not provided.
Please provide the Resource Planning Committee members substantial evidence regarding:
1) Whether the proposed project will adversely affect property values in the area.
Regarding the proposed project for Leuzinger, 1110 Wagon Trail, Ellison Bay, WI: The increase in bedroom
sizes will increase the value of the current residence and will have no adverse effect on the adjacent properties.
2) Whether the proposed use is similar to other uses in the area.
This is not applicable as the use of the property as a single-family primary residence will remain the same.
3) Whether the proposed project is consistent with the Door County Comprehensive and Farmland Preservation Plan or
any officially adopted town plan.
This proposed change will not have any effect on the plans listed.

Not applicable.
The Resource Planning Committee will establish a completion date for the proposed project.
By what month and year will the project be completed? December , 2026
The Resource Planning Committee is allowed to consider topics in addition to the above. Please provide information on
additional topics you think the Committee should or may consider in evaluating this project.
The project involves 2 scopes: 1) expand the footing of an existing bedroom from a small bedroom to a hallway
passthrough and larger bedroom with reading/TV area. 2) Dormer the backside of the upstairs bedroom without
increasing the footprint to allow more headspace & windows.
Note that a conditional use permit will generally remain in effect as long as the conditions and requirements upon which the
permit was issued are followed. Subsequent owners of the property are generally allowed to continue the use, subject to
those conditions and requirements. An affidavit is to be recorded with the deed to provide successors in interest notice of the
conditional use permit and conditions and requirements.
The Resource Planning Committee may, however, impose conditions regarding the permit’s duration, transfer, or renewal, in
addition to any other conditions pertaining to ordinance standards or the specific criteria listed above. For example, the
Committee may grant a limited term conditional use permit if a reasonable basis exists for such limitation. Any limited term
conditional use permit may be subject to renewal after a re-evaluation of the use via a hearing before the Resource Planning
Committee.

STAFF REPORT
Conditional Use Permit Application
Applicant Information
• Property Owner: Northeastern WI Antique Power Assoc Inc
• Applicant: Gerald Nelson
• Parcel Identification Number & Address: 022-02-11282641, 5005 N Country View Rd
• Zoning District: Prime Agricultural (PA)
• Petition request, including sections of zoning ordinance requiring permit:
Gerald Nelson, on behalf of Northeastern WI Antique Power Assoc Inc, proposes to expand the
existing agricultural visitation facility and to establish an assembly hall use within existing buildings.
Ordinance Sections 2.05(3)(a), 4.03(4), and 11.04 of the Door County Comprehensive Zoning
Ordinance.
Description of Subject Property and Surrounding Area
• Lot size & road frontage: 40.06 acres; 1,300 ft. +/- road frontage along N Country View Rd
• Access & Traffic: Access to subject parcel is via N Country View Rd, which has low to moderate
traffic levels (depending on season).
• Existing uses/structures: Existing land use is an Agricultural Visitation Facility (i.e., Valmy Thresheree
& Antique Machinery Show). Existing structures include a club house/pavilion, a sawmill shelter, a
blacksmith shop, a windmill, storage/pole buildings, a garage, a grain bin, and an informational
booth.
• Water and sanitation: Existing private well and existing mound system.
• Surrounding Area: All Surrounding properties are zoned Prime Agricultural (PA) and are being used
for agricultural purposes.
Background/History
• In 1997, the Resource Planning Committee issued a Conditional Use Permit to operate the
Thresheree grounds as an Agricultural Visitation Facility including the construction of a 30’ x 70’
machine storage building.
• In 2000, the Resource Planning Committee issued a Conditional Use Permit for an expansion of the
Agricultural Visitation Facility and approved the long-range concept plans to operate the Thresheree
grounds as an Agricultural Visitation Facility. One condition of approval was that “an improved si te
plan shall be submitted to the Planning Department and for review by the Resource Planning
Committee.” On June 28, 2000, a revised site plan was submitted to the Door County Planning
Department which identified three (3) areas for future buildings. The Resource Planning Committee
reviewed and approved the revised site plan on July 20, 2000. Per a July 24, 2000 letter from the
Planning Department, “each future building to be placed at the thresheree grounds must be located
in the area specified.” The three (3) areas approved for future buildings are labeled on the site plan
included with the packet.
36
36
36
• In 2018, the RPC granted a CUP for three additional areas on the property that may be used for the
construction of buildings serving the Agricultural Visitation Facility land use. The three additional
areas are highlighted yellow on the site plan included with the packet.
• The area of the proposed expansion of the facility for this CUP is highlighted in green on the site plan
included in the packet.
Parking Area Landscaping Requirements:
The proposed development complies with all applicable requirements of the County Comprehensive
Zoning Ordinance.
Zoning Considerations
• Purpose of the Prime Agricultural (PA) zoning district: “This district is intended to maintain and
preserve agricultural lands which have historically demonstrated high agricultural productivity.
Lands eligible for designation in this district shall generally include those designated as farmland
preservation areas in the Door County Comprehensive and Farmland Preservation Plan. This district
is also intended to provide farmland owners with additional management options by allowing
limited residential development, but with residential density limits and other requirements set so as
to maintain the rural characteristics of this district. Lot sizes of at least 20 acres are required for new
lots.”
• Does the use meet the zoning ordinance’s stated purpose and intent?
• Specific requirements for proposed use and/or possible conditions that may be relevant.
1. The project(s) shall comply with all applicable local, state, and federal building codes and
ordinances, including obtaining all required approvals and permits prior to beginning
construction.
2. A regular zoning permit authorizing construction of any structures or buildings shall be obtained
prior to commencing construction.
3. Any outdoor lighting erected in conjunction with this use shall utilize fixtures whose lens, hood,
or combination thereof allow no direct beams to be seen from off the property or cast skyward,
and the lighting elements of which shall not be visible from adjacent properties.
4. The entire project shall be completed by _______, 20__. (Staff recommends at least 10 years
due to funding availability).
Comprehensive Plan Considerations
• County comprehensive plan land use map designation(s) and description(s):
The parcel in question is designated on the comprehensive plan future land use map as
“Rural/Agricultural” and “Woodland/Wetland/Natural”, described as follows and shown on the
attached future land use map:
Rural/Agricultural – “Rural/Agricultural” areas cover much of southern and central Door County,
where there are currently relatively stable agricultural lands with few non-agricultural uses, as well
37
37
37
as most of the cleared areas located within the northern part of the county, which has more limited
or discontinued agricultural activities. These areas are not planned for non-agricultural development
in the next 15 years, however, lands in this category can, and most likely will, contain residential uses
compatible with agriculture. Agricultural and related operations in these areas should be protected
by ensuring development is at low density levels.
Woodland/Wetland/Natural – Lands designated as “Woodland/Wetland/Natural” are primarily in a
natural state, and include wetlands, woodlands, and public and private conservancy areas. Note that
lands in this category can – outside of wetland and conservancy areas – and most likely will, contain
very low-density residential uses in upland areas. The character of these regions should be protected
by discouraging any development that would adversely impact the environmental quality or natural
beauty of these areas. Maintenance of these natural areas should include continued private
stewardship and public ownership or, if necessary, acquisition of easements or additional public
lands.
This property has long been used as an agricultural visitation facility with no adverse impact on the
surrounding land uses. The proposed building will be located in the Rural/Agricultural area of the
parcel on existing open space with no adverse impact to the Woodland/Wetland/Natural area. An
expansion of this agricultural visitation facility will continue to be compatible with the surrounding
agricultural and residential land uses and is consistent with the comprehensive plan.
• Relevant goals/objectives/action items from comprehensive plan: None.
• Other relevant text from county comprehensive plan: None.

Mixed-Use
Commercial (MC)
Rural Agricultural
• Petition request and purpose: To rezone approximately 12.62 acres from Countryside (CS) to Mixed-
Use Commercial (MC) to better homogenize with the surrounding parcels and better align these parcels
with the Future Land Use map.
Background
• The parcel addressed 7886 County Highway A was zoned A-1 prior to the 1995 rewrite of the
comprehensive zoning ordinance. At that time the parcel was zoned as Mixed-use Commercial. The
previous owners attempted to rezone the portion of the parcel in question in 1997 but were denied
because there weren’t any existing nonconforming structures on the property. The parcel was
purchased in 1999 under common ownership to the parcel adjacent to the north. In 2007 the parcel was
divided, leaving approximately 22,900 square feet of countryside zoning along the eastern lot line.
• The parcel addressed 7880 County Highway A was created by Warranty Deed in 1987. At that time the
parcel was zoned in the A-1 zoning district. A permit for a single-family residence was issued the same
year. In 1992 another permit was issued for an attached deck.
• The vacant parcel ending in -23C was divided from the parcel addressed 3388 Wooded Lane in 2013
via CSM document # 771865. This parcel has remained vacant since.
Description of Subject Property and Surrounding Area
Subject Property:
• Lot area and road frontage: Subject parcels total to 12.62 acres with 451.86 feet of road frontage on
the parcel addressed 7880 CTH A and 517.74 feet of road frontage on the parcel ending in -23C. 7886
CTH A contains 273.81 feet of road frontage, however the portion to be rezoned does not make up any
of the road frontage. All portions of the road frontage are along County Highway A.
53
53
53
• Existing uses/structures: The structure occupied by the previous business at 7886 CTH A remains
vacant. The single-family residence at 7880 CTH A has remained in the permitted location and
continues to be used as a residence.
• Traffic patterns/road usage: Moderate/heavy levels of traffic, depending on season.
Surrounding Area – Zoning and Use:
• Various sized lots located west of CTH A and north of CTH E zoned Mixed-use Commercial (MC) and
Countryside (CS), some of which contain single family residences and other businesses. Nearby lots
range in size from 1 acre to 40 acres. The lots adjacent to the north and east of the subject lots consist
of approximately 35 acres zoned as Mixed-use Commercial (MC) and appear to be used for
commercial and agricultural purposes.
Zoning Considerations
• The subject parcels are all under common ownership.
• In 1996, the subject parcel at 7886 County Highway A applied for a map amendment on the easterly
80’ of the lot. This was denied due to a lack of nonconforming structures on that portion of the parcel.
That parcel has contained split zoning since the parcel was divided in 2007.
• Two of the three parcels are entirely surrounded by parcels zoned Mixed-Use Commercial (MC) and
are mapped as Mixed-Use Commercial / Residential on the Future Land Use map. The parcel ending
with -23C Is adjacent to the existing Mixed-Use Commercial zoning district but is designated as Rural
Agricultural on the Future Land Use Map.
• Section 2.03(6): Purpose of the current Countryside (CS) zoning district: This district is intended for
mostly rural areas of the interior of the county where a mixture of low density residential, agricultural, and
rural commercial activity exists or is desirable. The district provides for residential development at modest
densities consistent with a generally rural environment and allows for nonresidential uses which require
relatively large land areas and/or which are compatible with surrounding rural land. The district also
accommodates agricultural uses and, hence, can serve as a transitional district between the Exclusive
Agricultural, Prime Agricultural, and General Agricultural districts and more intensely developed areas. Lot
sizes of at least 5 acres are required for new lots in the Town of Baileys Harbor.
• Section 2.03(7): Purpose of the proposed Mixed-use Commercial (MC) zoning district: This district
permits both residential and commercial uses and is designed to accommodate those areas of Door
County with an existing desirable mixture of uses, or where such a mixture of uses is wanted. Typically,
this district will be located within or near existing communities, but it is also intended for outlying or smaller
nodes of development. In addition, this district can be used as a transition between business centers and
strictly residential areas. Lot sizes of at least 20,000 square feet are required for new lots which are not
served by public sewer.
• Zoning district requirements. Please see the attached Table of District Requirements to compare
minimum lot size requirements, maximum impervious surface ratios and setbacks. There are significant
dimensional differences between the existing Countryside (CS) zoning district and the proposed Mixed-
use Commercial (MC) zoning district (i.e., minimum lot size requirements, maximum impervious surface
ratios, and setbacks).
• Principal uses allowed. Please see the attached Table of Principal Uses to compare the types of
uses allowed in the existing zoning district as opposed to the proposed zoning district. The current
district, Countryside, is defined in the blue column and the proposed zoning district and Mixed-use
Commercial is defined in the red column. The types of uses allowed in the existing Countryside (CS)
zoning district are primarily agricultural and residential. The types of uses allowed in the proposed
Mixed-use Commercial (MC) zoning district are more commercial based uses.
54
54
54
• Rezoning a property means that any use allowed in the new zoning district may be established on the
property, now or in the future, not just the use(s) being proposed by the current applicant.
Issues for the RPC to consider in evaluating petitions to rezone are below. A brief staff opinion
regarding these matters is at the end of the list of questions. The RPC needs to reach its own
determinations.
• Was the existing district due to a mistake in the mapping process?
• Have circumstances changed for this property or surrounding properties since the original zoning
district designation?
• How are the adjacent properties zoned and used?
• Will rezoning allow for higher intensity or higher density uses than those allowed on surrounding
properties?
• Would the new district fit official plan guidelines for the property? Is the existing district a better fit?
• Is the request simply to economically benefit one property owner or a small group of property owners?
• Is there an overriding public good to be gained by rezoning the property? (If yes, rezoning might be
justified even if other considerations point toward denying the petition.)
The existing Countryside (CS) and Mixed-Use Commercial (MC) zoning districts were not due to a mistake in
the mapping process.
A rezoning will allow for a higher intensity and density of uses on the subject properties. To the north,
properties already being used fairly intensely.
In 1995, a portion of the parcel addressed 7886 County Highway A was rezoned from the A-1 zoning district to
the Mixed-use Commercial (MC) zoning district as part of the major, county-wide Comprehensive Zoning
rewrite due to an existing business on the parcel. The other two parcels were rezoned from A-1 to Countryside
(CS) at this time. Circumstances for this property and surrounding properties have changed since this property
and surrounding properties were rezoned. Several surrounding parcels were rezoned from Countryside (CS) to
Mixed-use Commercial (MC) through a map amendment in 2005.
The majority of parcel ID 002-01-26302722A1 (7886 CTH A) is already zoned MC and used to contain a
business. The proposed Mixed-use Commercial (MC) district is consistent with the County Comprehensive
Future Land Use Plan.
Parcel ID 002-01-26302722C (7880 CTH A) contains a single-family residence. The proposed Mixed-use
Commercial (MC) district is consistent with the County Comprehensive Future Land Use Plan.
Parcel ID 002-01-26302723C is vacant and appears to have been used for agricultural purposes. The
proposed Mixed-use Commercial (MC) district is not consistent with the County Comprehensive Future Land
Use Plan.
The request would economically benefit the owners of the subject properties.
Comprehensive Plan Considerations
County Comprehensive Plan Future Land Use Map Designation & Description:
• Future Land Use Designation: The subject parcels addressed 7886 and 7880 County Highway A are
designated as “Mixed Commercial/Residential” on the County Comprehensive Plan Future Land Use
Map. The parcel ending in -23C is designated as “Rural/Agricultural” on the County Comprehensive
Plan Future Land Use Map, as described below and shown on the attached Future Land Use Map.
• Mixed Commercial/Residential Future Land Use Description: Areas designated as “Mixed
Commercial/Residential” are intended to accommodate a variety of commercial and residential
activities, typically higher-density and in designated community centers, core areas, or “downtowns.”
There are also several small “Mixed Commercial/Residential” areas scattered throughout the county
outside the core areas, most of which have historically been minor development nodes and which are
55
55
55
usually situated at a major crossroads. Unlike core areas, public sewer is not expected to extend to any
of these outlying areas. Development in these outlying areas should avoid large-scale projects that
would conflict with the “small-town” character of these communities, alter the visual quality of the
surrounding areas, or create conflicts with surrounding agricultural uses.
• Rural/Agricultural Future Land Use Description: “Rural/Agricultural” areas cover much of southern
and central Door County, where there are currently relatively stable agricultural lands with few non-
agricultural uses, as well as most of the cleared areas located within the northern part of the county,
which has more limited or discontinued agricultural activities. These areas are not planned for non-
agricultural development in the next 15 years, however, lands in this category can, and most likely will,
contain residential uses compatible with agriculture. Agricultural and related operations in these areas
should be protected by ensuring development is at low density levels.
The proposed rezoning to Mixed-use Commercial (MC) of the northern two lots is consistent with the Mixed
Commercial/Residential future land use designation, but the proposed rezoning of the southern lot is not
consistent with the Rural/Agricultural future land use designation.
Relevant County Comprehensive Plan Goals/Objectives/Action Items:
• GOAL 3: Protect existing agriculture and promote sustainable agricultural innovations, operations, and
techniques, with an emphasis on providing local food sources to serve present and future generations.
o Objective 1: Coordinate with county municipalities to develop plans, ordinances, and programs
to protect existing agricultural areas and encourage further agricultural uses.
o Objective 2: Minimize conflicts between agricultural and non-agricultural uses by supporting a
compact land use pattern that directs future development to smaller, less productive land
parcels.
• GOAL 4: Maintain and enhance the community’s rural atmosphere and agricultural heritage by pursuing
smart growth and infill development strategies through a compact land use pattern that minimizes
conflicts between land uses and preserves the small-town aesthetic of the county.
o Objective 2: Work cooperatively with developers and county municipalities to identify future
development areas using infill and smart growth development strategies.
Other Relevant County Comprehensive Plan Text: None.

Reference: Rezone Request – Parcel IDs 0020126302722A1, 0020126302722C, 0020126302723C
PCJ Capital Management, LLC (Laura Seidensticker) has formally applied to have 3 of the 5
parcels they own in the Town of Baileys Harbor re-zoned from Countryside (CS) to Mixed Use
Commercial (MC). The reason for this request is to more accurately align the zoning
classification with the intended future use of the property.
The DC Land Use application lists these questions in the application paperwork (applicant
answers are listed below each question.)
Was the existing district due to a mistake in the mapping process?
Parcels 1 and 2 seem to be either a mistake or perhaps an intentional exclusion from MC zoning
at the time of Countywide Zoning adoption. Both parcels are surrounded by MC zoning, with
Parcel 1 being split internally between zoning designations. Converting both of these parcels fully
to MC zoning would optimize zoning boundaries in this area.
Parcel 3 is an extension of the landowner’s property and would benefit from having MC zoning as
it borders County Highway A
Have circumstances changed for this property or surrounding properties since the original zoning
district designation?
Yes, the commercial shop space (Zettel’s Sales and Service) is no longer in operation, and the
home located on 7880 is no longer tied to an agricultural business.
How are the adjacent properties zoned and used?
The property is bordered on the north and west by County Highways, with commercial entities
directly to the west (Tipsy Cow Restaurant) and north (Stones Throw Winery). Also, to the north
and west are residential properties. Areas adjacent to the east and southern boundaries are
vacant fields, woods, or large-lot residences.
This area – the intersection of County A & E has always been a small collection of commercial
entities, either bars, restaurants, grocery stores, or machinery services. The future land use
shows the greater area as Mixed Use Commercial/Residential; which is the intended future
development plan.

Reference: Rezone Request – Parcel IDs 0020126302722A1, 0020126302722C, 0020126302723C
Is the land area in question large or small?
The overall ownership of PCJ is roughly 48 acres – with the cumulative area of the parcels to be
rezoned as follows:
• Parcel 1 - 1.87 acres (0.5 acres to be rezoned)
• Parcel 2 – 4.62 acres
• Parcel 3 – 7.47 acres
Would the new district fit official plan guidelines for the property? Is the existing district a better
fit?
Yes – the future land use shows the area as mixed use – commercial and residential, which is the
intended use of the owner (see attached Proposed Site Plan)
Is the request simply to economically benefit one property owner or a small group of property
owners?
No. While the rezoning would support the landowner’s ability to plan the property more efficiently,
the benefits are not limited to a single property owner or small group of owners. At final buildout,
the project is anticipated to create 50 or more separate ownership opportunities through a mix of
commercial and residential areas.
The rezoning would also benefit existing businesses in the surrounding area by creating
additional residential units, commercial spaces, visitors, and daily activity near the County
Highway A and E intersection. This added activity would increase the potential customer base for
nearby restaurants, wineries, service businesses, and other local establishments. In that respect,
the request supports a broader economic benefit by strengthening an existing commercial node
rather than creating an isolated benefit for one landowner.
Is there an overriding public good to be gained by rezoning the property? (If yes, rezoning might
be justified even if other considerations point toward denying the petition.)
The requested rezoning is necessary to allow for a more logical and efficient development pattern
across the property. The majority of the project area is already appropriately zoned for the
proposed mixed-use development; however, a small portion of the site remains zoned for single-
family residential use. This portion is located along a major roadway, where commercial or mixed-
use zoning is more appropriate due to visibility, access, and compatibility with the surrounding
transportation corridor.
Rezoning this limited area will allow the project to create a clearer and more intentional transition
between commercial and residential uses. Commercial and mixed-use activity can be placed
along the major roadway frontage, where it is best suited, while residential homes can be located
farther into the interior of the development. This arrangement supports better land-use planning
by placing higher-activity uses along the roadway and preserving a quieter residential character
within the neighborhood portion of the project.

The rezoning also allows for more optimal use of the property by avoiding an irregular zoning
boundary that would otherwise limit cohesive site planning. Rather than leaving a small single-
family-zoned area along a major roadway, the proposed zoning creates a unified development
pattern with a distinct commercial frontage and a distinct residential area. This helps the overall
project function more efficiently and provides a better experience for future residents, businesses,
and the surrounding community.
Overall, the requested rezoning is limited in scope but important to the success of the project. It
supports orderly development, improves land-use compatibility, strengthens the commercial
presence along a major transportation corridor, and moves residential uses into a more
appropriate location within the development. The result is a more cohesive project that clearly
establishes both a commercial zone and a residential zone.
Attached to this letter you will also find:
• Maps of the parcels with both existing and Future Land Use (zoning) overlays.
• Parcel Reports for the 3 parcels
• Conceptual plan for future development
Thank you for your acceptance of this application. Please do not hesitate to reach out if you have
