Mountain View Acres LLC was requesting a variance to construct an FSA Runoff Collection
Basin closer to road right of way and property lines. Said land is located at E745 Luxemburg Rd.
Parcel 31 012 32.02.
John Roach presented to the Planning Commission and Town Board the proposed location of
the Basin and emphasized three points for the request for the variance. 1) Unnecessary
Hardship as the storage system was originally built in 2010 and the WDNR has changed
regulations which now make the system uncompliant. In order to make Basin compliant and
keep the required setbacks, the other Waste Storage Facility and Building would have be
moved. 2) Unique Property Limitations because of where the existing facilities are located, the
current flow channel location, and the two drainage area low points. 3) No Harm to Public
Interest as the new Basin will meet DNR requirements and reduce runoff and contamination of
groundwater and surface water.
Jim Salentine called for a motion to grant the variance.
Motion to approve the variance by John Haen, with a 2
nd by Gene Seidl.

Runoff Collection Basin closer to the road right of way and property lines. Said land being
located at E745 Luxemburg Rd. Parcel 31 012 32.02. Motion carried. 5 ayes, 0 nays
Linda Jonet then brought the decision to the Town Board. Matt Haen made the motion to
