3699 MISHICOT VILLAGE BOARD Regular Meeting October 15, 2024 The Mishicot Village Board meeting was called to order by President Samz at 6:00 PM at the Mishicot Village Hall. Roll call indicated Trustees Becker, Boettcher, Ferry, Franz, Kliment, Rezek and Samz were present. Clerk Stiefvater, Chief Granger, John Tulachka, Lorelai Rezek, and Deal Anhalt were also present. President Samz led everyone in attendance in the Pledge of Allegiance. A motion was made by Trustee Kliment to approve the October 1, 2024 meeting minutes with corrections, seconded by Trustee Boettcher. All in favor, motion was carried. Dean Anhalt gave an update on the W Samz Rd project. Dean informed the board that the Funk property wouldn’t accept the right of way offer to purchase for $11,200, Randy Moss (Negotiator) offered $1,500 more making the offer $12,700 and the property owner accepted. All the right of way offers to purchase contracts have approved and signed expect for one. Par 5 has not responded back to the right of way offer to purchase of $5,600 and it is past the deadline of 60 days to respond. Dean explained that it was recommended by Moss to send another offer for $6,500 and Par 5 has 20 days to respond. If Par 5 does not respond, then we can still purchase the land for the offer amount, but Par 5 does have the ability for 2 years to appeal the decision and take it to court. If it would go to court and Par 5 would have an appraisal done that would be 15% more than our appraisal, then we would pay their court costs. Moss recommended sending a new offer for 15% more making it $6,500 because it shows good faith by trying to negotiate sending a second offer. A motion was made by Trustee Ferry to approve the increase of $1,500 for the right of way offer to purchase for the funk property for the total of $12,700 and the increase of $900 for the right of way offer to purchase for Par 5 for the total of $6,500, seconded by Trustee Becker.
