Ted noted that even if a specific set of criteria is developed, it will still be a case-by-case approach. The planning commission agreed to a conditional motion to accept the request for vacating the alley with modifications (that the length vacated be expanded to that between lots seven through 10 and 17 through 20 and that a garage be built on the property within five years and that deed restrictions be placed on said lots such that they must be sold as one parcel in the future so it can't be built and then sectioned off). Fizell motioned to accept the request. Cornelius seconded the motion, with a note that future requests will be on a case-by-case basis. Bland and Carrier abstained because of concern over inappropriate ex parte contact on the part of City officials in advancing this case.
