The spring crack sealing program has been completed. Additional crack sealing may be
considered this fall, pending budget availability.
An updated mowing map was provided to Winnebago County in preparation for
roadside mowing activities, which will commence as their schedule allows.
Best Quality Tree Service removed a dead tree and ground the stump from the Town-
owned lot at the southwest corner of S. Oakwood Rd and Witzel Ave.
The posted speed limit on North Oakwood Road from Omro Road to Lake Butte des
Morts should be 25 mph. The current 30 mph signs were not updated following the

previous disbursements for sanitary and water as submitted with the addition/second-Sue/carried unanimously.
3) Public Forum. No comments from the public.
4) Commissioner Statements. None.
5) Director’s Report. Kevin submitted his report prior to the meeting and added the following information.
a) Review of District statistics. No discussion was had on this agenda item.
b) Correspondence.
- Oakwood Lane Request for Water Service: A potential property owner requested water service for an ADA-
compliant new construction home to be built on a va cant lot at the west end of Oakwood Lane. The Distr ict
installed watermain a couple of years ago on the east half, including three water services and a fire hydrant, which
is 500-600 feet away. The owner is communicating with other homeowners to see if any others want municipal
water. The District could install another fire hydrant closer to the west end if there is enough interest. There are
several vacant lots along Oakwood Lane, and we would rather install water down the street than have new wells
drilled. Sue asked if we are aware of water quality in the area, and Kevin responded when we installed water
previously, we were made aware of some issues, along with some noncompliant wells.
- Moon Farm Parcel Development: The new property owne r is planning to build a new assisted living facili ty
similar to the adjacent parcel, with construction l ikely to start later this year. Staff will work wit h the City of
Oshkosh to disconnect sanitary sewer service to the two homes to be razed, one on Witzel Avenue and on e on
Maryden Road. The City will serve the new development according to the terms of our sewer agreement.
c) Status of 2026 projects.
- Westmoor Road Area Water Quality Issues: Staff rece ntly sent a letter to notify residents in this area that private
wells have tested positive for coliform bacteria and contained high levels of arsenic exceeding the safe level of 10
parts per billion (ppb). The letter offered free we ll water sample testing to help determine the exten t of the water
quality issue, of which about 9-10 residents have p icked up sampling kits. This letter included a surv ey to gauge
resident interest in a potential watermain extensio n to address this issue, and communication between residents
online included one homeowner claiming to have a recent test result of 171 ppb of arsenic, which exceeds the skin
contact level of over 100 ppb, and another mentioning the road is going to be repaved sometime this year.
- The Water Utility’s goal has always been to get safe drinking water only to properties that want or need it, and
completing potential water extensions prior to asphalt paving saves substantial project costs. Survey responses,
which were due by May 1, will determine if the 70% participation threshold is met along the entire street or in
some area of it and will be discussed at the May 11 Commission meeting. If a watermain is extended,
homeowners are not required to connect nor are they required to abandon their well. Staff will continu e
communicating with area residents and were invited to a neighborhood meeting the following week.
- Request for Sewer Service: A homeowner on Witzel Avenue would need to be added to the Sanitary District prior
to connecting to sanitary sewer and/or water servic e. Upon receiving the signed Petition for Addition, this could
be approved by the Town of Algoma as early as their May meeting.
- Springhetti Lake Development: Staff is working with Davel Engineering to locate easements as this is planned to
be a private road in the future. We will need the T own’s final grades and future Leonard Point Road st orm sewer
plans to prevent future conflicts. Staff will continue to work through those details to determine if gravity sewer can
be extended from across the street or if grinder pumps will be required to serve each property.
- MOU with the Town of Algoma: Kevin stated he received some changes to the backfill requirements from Jason,
the Town of Algoma’s Public Works Director, who stated in some of the deeper trenches native material could be
used up to four feet then ¾” road gravel when backf illing. Kevin explained native material and stone will expand
differently when frozen, causing dips or bumps in the road if the backfill material is not similar.
- Kevin stated he is still also concerned about the 7 2-hour inspection time, along with the fact that so me
excavations would not make sense to require a modified proctor. Jason answered each project is unique and it
is difficult to lay out every single scenario for this agreement. He added working together to decide what makes
the most sense allows for the best product for both entities. Kevin stated that without these issues being worked
out ahead of time, staff would have to follow what the MOU and the ordinance state.
- Olde Apple Acres: This development is getting closer to beginning, but is currently delayed by Winnebago County,
who wants a survey completed to determine the sediment level in the pond prior to approving the development.
6) Old Business.
a) Discuss and act on wastewater treatment rates from the City of Omro.
i) The Commissioners opted not to go into closed session pursuant to Wisconsin Statute 19.85 (1) (g) to confer with
legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted
by the body with respect to litigation in which it is or is likely to become involved: Wastewater Trea tment rates
from the City of Omro. No discussion was had on this agenda item.
b) Discuss and act on Developer’s Agreement-Authorization to Proceed for Olde Apple Acres – 1
st Addition, Phase III.
- Kevin stated he spoke with the developer the previous day. The signed Developer’s Agreement is not received.
c) Discuss and act on Resolution #2026-3-2 to Award the Contract for the sewer and watermain extension to Olde Apple
Acres Subdivision – 1 st Addition, Phase III. Kevin recommended tabling this item.
d) Discuss and act on Resolution #2026-3-3 to Approve a Final Resolution declaring the Sanitary District' s intent to
exercise its police power, pursuant to Section 66.0 703 of the Wisconsin Statutes, to levy a Special As sessment upon
the various parcels (30) included in Olde Apple Acres – 1 st Addition, Phase III in the Town of Algoma Sanitary District
No. 1 benefitted by the improvements.
i) Acknowledge Receipt of the Waivers of Special Asses sment Notices and Public Hearings in Accordance wit h
Wisconsin Statute 66.0703(7)(b). Kevin stated the signed waiver was received from 300, LLC for all parcels of the
final phase of Olde Apple Acres. This resolution wo uld levy a special assessment for sanitary sewer an d water.
Peter made a motion to approve Resolution #2026-3-3/second-Sue/carried unanimously.
7) New Business.
a) None.
8) Adjourn. Sue made a motion to adjourn the regular monthly me eting at 12:19 p.m./second-Chad/carried
unanimously.

SUBJECT: Announcement of 2026 Recycling Grants to Responsible Units
Dear Responsible Unit Contact:
On behalf of the Governor, the Department of Natural Resources (DNR) is pleased to offer an award of
$12,434.82 to your responsible unit to offset your recycling program costs during the current calendar year.
This grant amount is composed of your Basic Recycling Grant + the Recycling Consolidation grant if you
applied and are eligible. Remember that the total grant amount may not exceed projected net eligible costs
as stated in your grant application.
Basic Recycling Grant Award $10,760.29
Recycling Consolidation Grant Award $1,674.53
Calculating Your Basic Recycling Grant
Your Basic Recycling grant amount was determined as prescribed by Wisconsin Statutes:
1- We identify your RU percentage of total available funds from 1999, then
2- We apply that percentage to the total available grant appropriation ($19,000,000).
Calculating Your Recycling Consolidation Grant
Per Wisconsin Statutes, the consolidation grant awards are calculated on a per capita basis. A total of 211
Responsible Units applied for this grant by the deadline and are eligible to receive this grant. The total
population of all those eligible applicants is 4,133,698. The Legislature provided $1M for this program. So,
the per capita rate is $0.241 per person in each Responsible Unit ($1,000,000 ÷ by population = $0.243 per
person in eligible RUs).
Timing of Grant Check
The grant award payments will be issued as one check per responsible unit on or before June 1, 2026.
Accepting Grant Conditions
By endorsing the grant check, you are accepting this award and agree to comply with the grant conditions,
the program's financial guidelines, and the assurances you signed in your grant application. Grant conditions
can be found at the Basic Recycling Grant website under the “RESOURCES” tab:

Important Reminders
• If you spent less than the awarded amount within the current grant year, you will be required to repay the
difference between your awarded amount and the actual amount you spent. A separate notification about this will
be sent to affected RUs.
• Your Recycling Grant Award is to be used for eligible expenditures directly related to the cost estimates submitted
with your grant application—Estimated Budget Spreadsheet.
• You will report actual 2026 recycling costs in the spring of 2027 Annual Report of Recycling Program
Accomplishments. This Annual Report is necessary for maintaining continuity of data collection and to determine
whether or not your total net eligible recycling costs matched or exceeded your grant award.
We appreciate your efforts to recycle in Wisconsin. Should you have any questions about this letter or the recycling grant
program, please contact Wendy Soleska, Grant Manager by e-mail at Wendy.Soleska@wisconsin.gov or by telephone
number (608) 852-1358.
Sincerely,
Jim Ritchie,

AGENDA MEMORANDUM
To: Honorable Town Chairperson and Town Supervisors
From: Maggie Mahoney, Administrator
Date: June 17, 2026
RE: Certified Survey Map by petitioner Jim Merrill to combine parcels 002-066301, 002-
0036, and 002-0035 on Oakwood Lane into one parcel.
GENERAL INFORMATION:
Petitioner & Owner: Jim Merrill
2928 Oakwood Lane
Oshkosh, WI 54904
Past Town Board Discussion(s): None
Action Requested: Petitioner is requesting approval of the Certified Survey Map to
combine three parcels on Oakwood Lane into one parcel.
Property Location and Type:
The subject properties are contiguous, owned by the same property owner, and are all
zoned R-1 Rural Residential. Two of the lots currently meet the dimensional requirements,
one does not (too small) in this zoning district. All lots are accessible. The property owner
wants to combine the three parcels to construct a new home on the one, newly created
parcel.
These parcels are in the protected area of the boundary agreement with the City of
Oshkosh.
ANALYSIS:
The proposed change, as stated above, would combine three contiguous parcels into one
parcel and will bring the smallest parcel into conformance with dimensional standards for
the R-1 Rural Residential Zoning District. The dimensional standards for this district per
Chapter 23: Town/County Zoning of the Winnebago County Municipal Code, Exhibit 8-2 are
as follows:
The proposed lot appears to meet the dimensional requirements and does not conflict
with any local, county, or regional plans.
PLANNING COMMISSION RECOMMENDATION:
The Planning Commission considered this item at their June 10, 2026 meeting.
The property owner was in attendance. The commission questioned the existing structure.
Mr. Merrill explained that it is an existing conforming garage what was used by the property
across the street. He plans on keeping as it is only about 25 years old.
The Planning Commission passed the motion to recommend approval for the proposed
CSM to the Town Board.
RECOMMENDED ACTION:
The Planning Commission recommends approval of the CSM. Should the Town Board
agree, the following motion may be made:
“Motion to approve the Certified Survey Map by petitioner Jim Merrill to combine parcels
002-066301, 002-0036, and 002-0035 on Oakwood Lane into one parcel. ”

RE: Resolution No. 2026-8 Dedication and Acceptance of Town Road Right-of-Way for a
Portion of N. Oakwood Road, parcel 002-0253
SUMMARY:
In March the Town Board approved the request to exempt this parcel from the 2025
Ambulance Service Charge because it is in the road right-of-way area (see attached aerial)
and should have been dedicated to the town as part of the Havenwood Village
Condominium project.
Upon notice of this determination from the town and recommendation to dedicate this
parcel to the town, the property owner (Midwest Real Estate Development Company) is
presenting the town with the deed to dedicate this parcel to the town road/right-of-way.
The Town Attorney worked with the property owner’s attorney on this matter.
RECOMMENDED ACTION: Staff recommend approval. Should the Town Board agree the
following motion may be made:
“Motion to approve Resolution No. 2026-8 Dedication and Acceptance of Town Road Right-
of-Way for a Portion of N. Oakwood Road, parcel 002-0253.”

AGENDA MEMORANDUM

From: Maggie Mahoney, Administrator
Date: June 17, 2026
RE: Winnebago County Planning and Zoning Committee is requesting a Text Code
Amendment to Chapter 23, Article 7, Division 1, section 23.7-3(10) of the
Winnebago County Town County Zoning Code.
SUMMARY:
The county planning committee is proposing this amendment to the section of code for
code amendments process (Division 1 Code Amendment).
The current language specifies that the recommendation can be held no sooner than 10
business days after the public hearing. The proposed language that shortens that period to
5 business days, is as follows:
(10) Planning and Zoning Recommendation. As soon after the public hearing as
possible, but no sooner than 5 business days after the public hearing or 30 days
after the public hearing if the Town Board passed a resolution establishing a 20-day
extension, the committee shall meet to make a written recommendation to the
Board of County Supervisors to (1) deny the proposed amendment (2) approve the
proposed amendment without revision, or (3) approve the proposed amendment
with revision(s) it deems appropriate.
Please note that in the attached notice the 20-day extension highlighted above says 30-day.
Per county staff, the 30 is a typo and will be corrected to 20 per the current code and
revised materials will be distributed.
This change is being proposed by the Planning & Zoning Committee due to a
scheduling/calendar issue with some of the members. Shortening this period will allow the
committee to meet on a different day of the week.
Staff do not see any issues with it because there is a process for the town to extend that
period by resolution if we so choose. Furthermore, if this helps speed up consideration of
items for applicants, staff is in favor of it.
The public hearing for this item will be held on June 30 (see attached notice).
RECOMMENDED ACTION: Staff recommend approval of the text code amendment.
Should the Town Board agree the following motion may be made:
“Motion to approve the Text Code Amendment to Chapter 23, Article 7, Division 1, section
23.7-3(10) of the Winnebago County Town County Zoning Code as requested by the
Winnebago County Planning and Zoning Committee.”
