From: Maggie Mahoney, Administrator
Date: May 20, 2026
RE: Monthly Administrator’s Report
A. Budget Update
A reminder was mailed out the week of May 18 to properties that have not yet paid the
Ambulance Service bill. Staff will provide an update on projected revenue and
expenses at the meeting.
B. Major Projects Updates
i. Leonard Point Road Storm Detention Pond
Final steps for land acquisition for the pond are nearing completion. The
Winnebago County Planning & Zoning public hearing for the rezoning of the newly
created outlots is on May 26. The town is applying for the erosion control permit
with the county for the project.
ii. Leonard Point Road Reconstruction
The properties have been staked to identify temporary easements, permanent
easements, and permanent acquisition areas. Town staff are assisting property
owners in identifying their sump pump discharge points. The sales study is
underway and will be presented to the board at a future meeting, possibly July.
iii. Leonard Point Road & STH 21 Roundabout
WIS 21 is closed to traffic throughout the project and the posted detour will follow
WIS 116 to US 45 to I-41. Access is maintained for local residents, businesses,
and emergency vehicles.
The project website is at https://wisconsindot.gov/Pages/projects/by-
region/ne/Wis21/default.aspx includes proposed scope, schedule, traffic
impacts, displays and information for businesses in the work zone.
C. Community Development Update
i. Springhetti Lake
The final plat for phase 1 has been approved by other agencies. Some town
conditions remain to be met for our approval—primarily the developers
agreement. Staff will discuss the developers agreement with the Board in closed
session.
The town submitted the pre-application and was approved to submit an Idle Sites
Redevelopment Program application on 5/8/26 for the Fiscal Year 2027 cycle for
this project. Staff are working on submitting this application this month with the
assistance of GOED.
ii. Tommy’s Carwash and 7 Brew
The town received a couple of complaints about loud music that can be heard in
the residential areas to the north/west. Staff contacted both businesses and they
have addressed the issue.
ii. Rusch Property
At the time of this memo I have a meeting scheduled with Chet Wesenberg for May
20 to check in on the status of the plans for this property and possible location of
the new town hall.
D. Joint Fire Department Study Update
The project team met for the recommendations meeting on May 5. Per the consultant
agreement, this is the follow-up to the kick-off meeting that was held in October with
representatives from the city and town staff and fire/ems departments to verify the
information they are presenting to describe the departments/operations is accurate.
There is a brief feedback period then the formal report will be completed, likely in June.
The preliminary plan is for the final report to be presented to both governing bodies
together at a neutral location.

RE: Monthly Director’s Report
A. Road Maintenance Update
Winnebago County will be performing shoulder maintenance to fill low areas on gravel
shoulders along town roads.
The City of Oshkosh is in the process of installing a water main extension along with a
sanitary sewer extension on Claireville Road from 9th Avenue going South to Windsong
Terrace.
B. 2026 Asphalt Resurfacing
A preconstruction meeting was held with Kartechner Brothers LLC on May 7 regarding
the Town’s upcoming project. The contractor will notify the Town once the final
construction schedule has been established.
Staff will distribute notification letters to affected residents, along with a map of the
impacted roadways. Kartechner Brothers LLC stated that it will also distribute letters
to affected residents prior to the start of construction to provide information on the
project and schedule.
C. Parks Update
The grass at Jones Park was recently fertilized as part of ongoing park maintenance
activities.
Standing water has been an issue along the inside corner of the exit driveway at Jones
Park. This area will be reshaped to improve drainage and help extend the life of the
asphalt.
Additionally, Jones Park water system required replacement of four corroded water
valves to restore water to the park. Stainless steel valves were installed to minimize
future corrosion issues and improve long-term reliability.
D. Stormwater Update
Seasonal muskrat trapping operations have begun in the pond areas. Wildlife Solutions
also identified woodchuck activity in the pond areas, and McMahon, which oversees
pond maintenance, recommended trapping the woodchucks as part of ongoing
maintenance and erosion prevention efforts.
The MS4 Annual Report and final Stormwater Quality Management Plan have been
uploaded to the Town website. All stormwater-related updates can be viewed under
the Water Quality Resources section. The direct link is:
https://townofalgomawi.gov/water-quality-resources/

No update at time of Memo.
F. Oakwood Elementary School Update
Staff plan to meet with representatives from the Winnebago County Sheriff’s Office and

- Hwy 21 DOT Reconstruction: Highway 21 is scheduled to begin reconstruction from Highway 116 on April 6 .
District staff will adjust some manholes plus two for Aurora Hospital. Construction is expected to last 39 calendar
days before Westhaven Drive and Oakwood Road will reopen, with a scheduled project completion date of October
23. During this time, Witzel Avenue will be extremely busy.
- Watermain Extension to New Water Tower: The watermain extension down Potratz Hill Road to the future water
tower is scheduled to begin at the end of July with the watermain contractor, Advance Construction, an d District
staff. Staff will work with the Department of Transportation (DOT) for construction vehicles entering and exiting
that project site.
- Oakwood School Expansion: Staff has been working th rough the water and fire protection plans for this project.
The Town of Algoma is requiring a fire hydrant every 400 feet on the property and requested 13,000-30,000 gallons
per minute of water to the school for fire protecti on. Staff will coordinate this project with the sch ool to prevent
any school closures while tapping the watermain. Th e Town road right-of-way (ROW) permit has been secu red;
however, it was delayed until the hydrant location on the school property was determined and confirmat ion was
received that the watermains would be upsized from 6” to 8” for fire protection.
- Olde Apple Acres Development: Sewer and water installation is scheduled to begin on June 1, and the Developers
Agreement-Authorization to Proceed is not signed at this time. Kevin asked Maggie, Town of Algoma
Administrator, if she knew what was preventing the project from continuing. She answered the issue has more to
do with the County Planning and Zoning Department a nd their storm erosion control permitting since the road
installation would disturb more than an acre, adding it is the Town’s intention to help the developer proceed with
their project. Kevin stated the contractor is set to begin construction on June 1, but the District is unable to award
the contract without the signed Developer’s Agreeme nt. If the bid hold period is exceeded, the contrac tor could
say they are no longer available. It is unknown how much longer securing the erosion control permit co uld be
delayed. Maggie said she hoped to get what is neede d by the end of next week and will have a conversat ion with
their attorney.
- Westmoor Road Area Water Quality Issues: Staff rece ntly learned of water quality issues in the Westmoo r Road
area. District staff intends to send residents a survey letter later this month offering free water sampling before the
Town proposes to repave the road. Chad added this is a great opportunity to partner with the Town.
- Leaking Curb Box: One of the new water services on South Oakwood Road across the street from OSMS bega n
leaking that morning. DeGroot was already onsite that day to repair it at their expense as it was under the one-year
Page 2 of 4
warranty. Staff will send notice to the Town for the road right-of-way permit. Water was turned off to OSMS, but
the construction workers were supplied water to allow for their work to continue.
- Fiber Optic Line Installation: Staff was just notif ied of this project in the Town of Algoma. Kevin as ked Maggie
for a plan set for the fiberoptic lines to be installed through the town so District staff can verify the fiber lines are
not installed over existing or future sewer or watermains. Maggie stated it is on the Town’s website under Notices
and is proposed to be installed in phases, primarily north of Highway 21. She added Jason released the road ROW
permit so he has their plan sets, which may be adju sted somewhat from the plans, and she encouraged Ke vin to
reach out to Jason to request it. Chad added we will also get notices from Diggers Hotline as this project progresses.
6) Old Business.
a) Discuss and act on wastewater treatment rates from the City of Omro.
i) Chad made a motion to go into closed session at 1:0 8 p.m. pursuant to Wisconsin Statute 19.85 (1) (g) to
confer with legal counsel for the governmental body who is rendering oral or written advice concerning
strategy to be adopted by the body with respect to litigation in which it is or is likely to become in volved:
Wastewater Treatment rates from the City of Omro/second-Sue-carried unanimously.
b) Sue made a motion to reconvene at 1:23 p.m. into op en session to discuss and act on matters discussed during
closed session regarding wastewater treatment rates from the City of Omro/second-Chad/carried unanimously.
No action was taken. The meeting resumed with Agenda Item 8).
7) New Business.
a) Discuss and act on Resolution #2026-3-1 to Approve Memorandum of Understanding (MOU) with the Town of
Algoma related to work in the Road Right-of-Way.
- Attorney Parmentier explained the latest version, w hich Kevin had displayed on the screen, was receive d earlier
that month. He proposed some revisions, and then the Town’s attorney made some more back. There’s some legal
language that can be smoothed out between the attorneys; however, some substantive topics that merit discussion
include the following:
1) Permit Requirements: In Section 3, the District added language stating the District does not need to pull permits
for minor work, with minor work defined. The Town responded by striking that entire language, providing no
exception for small scale items. Kevin explained mi nor work, for example, included when a homeowner
connects to the curb stop and all the work may be able to be done on private property outside of the road right-
of-way (ROW). He presented some pictures and explained the contractor and/or District staff has to use a hand
shovel to expose gas lines that are in the ROW beca use, even though it is supposed to be within 18” of its
painted location, because it has been mislocated by feet and must be confirmed.
(a) Maggie stated that work may not necessarily require a permit, but it would be best addressed by contacting
Jason. The Town wants to be notified of the “minor work” the District is doing in the right-of-way and can
then decide whether to require a permit. Since this is a new agreement, the Town wants to be contacted
with any work in the ROW, and going forward it can decide later whether to add some of these small items
as minor work into the next version of the MOU. If it is ambiguous and left out of the agreement, the Town
and District can have that discussion. Maggie state d notification under this MOU includes by email or
phone, but this would not include emergency work.
(b) Chad stated the District is following what we were doing before, and he asked why the Town rescinded
the 1978 resolution that specifically allowed the D istrict to perform work in the right-of-way. Maggie
answered now that the Town has staff, it wants to i mplement and manage a road ROW program, with an
exemption for emergency work. This agreement would not apply to other entities and it would waive fees
for the District, while still requiring a permit along with a $3,000 security deposit.
(c) Kevin explained when the District sends a letter to residents, we used to be able to tell them we woul d
install a watermain in the road ROW because we had an easement, but without securing a ROW permit
before we send the letter, we do not even know if we have access. It is a concern whether a permit may be
denied, unlike the easement that was always there. Sue said it does not sound like the Town would deny a
permit, and Maggie agreed, stating the Town wants a record of activity in the road ROW, which she claims
they have not received in the past and she added is common practice. Kevin responded that the District has
always contacted the Town Chairman or Road Superint endent, who was sometimes the same person, to
communicate that information with a phone call and a follow-up email.
(d) Attorney Parmentier concluded that it sounds like t he Town may want more of a heads up than a permit,
and for minor work the District can provide notice. Maggie confirmed the District should check with th e
Town to determine if a permit is needed before perf orming work in the road ROW. Kevin listed normal
maintenance items such as inspecting manholes, jetting and televising sewer mains, painting fire hydrants,
exercising water valves, etc. should not require a permit. Maggie suggested including that in the response
to the Town’s attorney since she and Jason are working with her to complete the agreement, as she did not
want to provide an answer for that at this time. At torney Parmentier offered to put something together in
his response to address this.
2) Backfill Requirements: Section 6a discusses the bac kfill requirement for a hole to be left open for in spection
up to 72 hours. The District requires every hole to be backfilled immediately rather than wait up to 7 2 hours.
Kevin explained a six-foot-deep hole creates wet so il and, if left open for an unnecessary extended pe riod of
time, material could cave in, even with trench boxe s, and the back curb and gutter could be lost, resu lting in
questionable road quality and causing safety and liability issues. The District probably does about 40-50 new
customer connections every year. Sue suggested sending the Town pictures of the excavation.
(a) Attorney Parmentier asked what a District inspection would entail, and Kevin answered District Operators
are onsite to observe the excavation down to the curb box, the contractor is responsible for safety protocols
for trench boxes, and the District is responsible to make sure the pipe is installed to our curb box correctly
and is pressure tested to verify it is not leaking prior to backfilling. We then make sure the proper fill is
used and compacted correctly and that the rest of material is filled in and compacted.
(b) Attorney Parmentier asked what the Town’s inspectio n would involve, and if the Town would consider
delegating any inspections to the District. Maggie stated that is more Jason’s wheelhouse, saying she
hesitates to make an exception to all District activities. If it’s an emergency, then it’s a moot point. If there
is a permit, there could be some coordination. Atto rney Parmentier stated the District could complete the
inspection ourselves based on the Town’s standards so we are not waiting on the Town. Kevin offered to
get a checklist from Jason with follow up documenta tion so the District could perform these inspection s
for the Town, and it was unknown at that time what the Town’s inspection involves.
3) Duration of the Agreement: The original version was for two years with no automatic renewals and the District
proposed a longer term with auto renewals. Maggie answered once both entities are more comfortable with the
initial agreement the duration could be extended. The Town figured it would be easier to remember to r enew
it annually rather than bi-annually, and Chad felt the longer the term the better. Kevin explained this agreement
is relatively short term compared to the District’s substantial investment in the Town for water and s anitary
sewer mains that depreciate over 50 years, and he wants a guarantee the District can still access the road ROW.
Sue mentioned if a renewal gets overlooked, the District has nothing. Maggie reiterated this initial agreement
is new to everyone, we all will learn some things, and we have an opportunity to make adjustments. She added
that once all parties feel comfortable, it can like ly be extended to five years, adding the District w ould never
lose access to the ROW since there is a permitting process.
- Sue made a motion for staff and our attorney to review the Memorandum of Understanding with the Town
of Algoma related to work in the Road Right-of-Way and abide by their decision/second-Chad/carried
unanimously.
b) Discuss and act on options for charging Public Fire Protection (PFP) Fee in response to Town of Algoma’s request.
- Sue addressed Maggie and asked how this is different from the garbage and refuse fee that was taken out of the tax
levy because the cost was increasing and placed on the property tax bill as a separate charge. Sue exp lained that
special charge code #37 on Winnebago County’s Ascen t system can be used to add the PFP fee to municipa l tax
bills. Maggie stated the Town did not feel the exam ple that Attorney Parmentier provided met the exemp tion
criteria to place it as a special fee. Sue reiterated the code exists, and she and District staff also spoke with the tax
lister the previous day, who confirmed with the Department of Revenue (DOR) that this is a viable option.
- Attorney Parmentier stated the Town attorney’s view was that the PFP Fee had to be on the general tax levy or the
utility bills. However, he explained his view that the Statute states the Town agrees to pay but does not dictate
how, and the DOR allows it because it is set up for it. Maggie stated she looked at some documentation from 2014-
2015 when the Town considered having the District implement a PFP Fee and determined it does not count against
the tax levy. She is unaware of any municipalities that do this, and her understanding was that if the Town removes
it, they have to reduce their tax levy by that amount. Attorney Parmentier clarified the downward adjustment to the
levy does not apply to the production, storage, tra nsmission, sale and delivery, or furnishing of wate r for public
fire protection purposes.
- Maggie had not spoken with the tax lister about thi s, and Kevin recommended she call her. Kevin reiter ated the
tax lister clarified this option is 100% available and the tax lister confirmed it with the DOR. He ad ded this is a
Town of Algoma decision to do that and stay as a municipal charge, and no action would be necessary. The statute
does not define how the Town is to collect it, nor does it say it has to be included in the general tax levy.
- Chad stated that the Town currently collects the PFP Fee and forwards it to the District, meaning all Town residents
pay it. Then he asked if the Town was going to reduce their levy if the Town has the District collect this fee. Maggie
stated the Public Service Commission (PSC) offers t hree options on their website for collecting this f ee: on the
utility bill, as a municipal charge, which is how it is currently, or a combination of the two. When Chad again asked
if the Town was going to reduce the levy by the amo unt of the PFP Fee if the Town has the District bil l for it,
Maggie stated the Town would not reduce the levy be cause they do not have to. Maggie said the Town is subject
to levy limits and the money has to come from somew here, and the $170,000 would be used for roads and other
services the Town provides. Chad stated that is wha t a referendum is for, and Maggie said this could g o to
referendum, but if the Town can work within its levy, that’s the Town Board’s prerogative.
- Chad stated that it is going to look like the District is raising its fees when it sends this bill, and residents are going
to ask why we are charging more. Our response would be that the Town is no longer collecting it but is using the
money they used to collect for PFP for other purposes. Maggie said the Town would communicate that to residents.
She stated that the Town cannot arbitrarily raise i ts levy, adding that there is a significant cost to trying to pass a
referendum and it may not be helpful. Chad stated t hat if it is something that constituents thought th ey needed,
they would vote for it, and he has been bothered by this issue ever since it came up. Chad stated the room is going
to be filled because a public hearing would need to be held. This amount would only be a change in col lection
method, with the Town moving it from the tax levy t o a fee to be charged by the District, and he think s this is
disingenuous to the taxpayer. Maggie stated $170,00 0 is a drop in the bucket compared to what the Town needs,
and the Town is very transparent with its budget and capital improvement process. Maggie told Kevin previously
she realizes this is probably not a popular thing to do, but the Town would not shy away and would communicate
this with the public. They would help out as much a s they can and explain this is the Town asking the District to
do this. Also, it is going to be discussed at the Town’s meeting the following week.
- Sue asked Attorney Parmentier if the Town removes t he PFP Fee from its tax levy if it is able to free up those
funds for something else, and he answered yes, as l ong as the Town does not exceed their levy limit. S ue stated
everybody should pay for PFP, including those on we lls and vacant lots, and the District does not have a method
to bill everyone in the Town. Chad added if the District bills this fee only to water customers, not everyone (only
40%) would be charged, resulting in a 60% increase in water rates and causing an uproar. Maggie stated it is her
intention to present the facts and options to the T own Board, but she has no recommendation at this ti me. The
reason this is coming up now is because the District is planning to apply for a conventional rate case. Maggie also
wanted to mention that the PSC website states that non-water customers can also be charged this fee.
- Attorney Parmentier stated the District is providing the Town with new information at this meeting. If the special
charge is utilized, it accomplishes the Town’s goal of freeing up the money from the tax levy, it is l ogistically
easier, it reduces the overall cost, and it avoids the problem of the putting the entire increase on o nly a subgroup
of residents while giving everyone else a free ride . He offered to give the Town’s attorney this infor mation via a
phone call.
- Christy DeMaster of Trilogy Consulting explained the PSC’s website on this item creates confusion. It leads one
to believe those are the only options, but Section 196 of the state statutes does not say the municipal charge has to
be in the tax levy. Although it is commonly done on the tax levy, the utility’s tariff says a municipa l charge is to
be paid by the Town. Maggie stated the Town is open to a special charge, as it seems optimal when fair ness is a
concern, and she believes this could be resolved wi thin a day or two. Sue mentioned when it’s presente d to the
Town Board, the attorney should understand it as we ll. Maggie said she was very skeptical that this is a viable
option and she should feel better once she receives some assurances on that.
- Kevin concluded the Water Utility’s position is tha t the Town of Algoma should continue to fund 100% o f the
public fire protection fee by municipal charge. The Town gets to decide how to collect it, whether tha t is through
the tax levy, as a special charge, or on a Town bil l to all residents such as the recent ambulance bil l. If it is not a
municipal charge, it creates direct charge that water users would have to absorb and subsidize other Town residents.
Christy explained aside from the fact that the Water Utility is pursuing a conventional rate case, if the Town wanted
to change the process, it would have to adopt a resolution stating that, the PSC would open a docket, and it would
go through their process with a public hearing.
c) Discuss and act on Developer’s Agreement-Authorization to Proceed for Olde Apple Acres – 1 st Addition, Phase III.
- Kevin stated since no signed authorization to proce ed was received, these three items, c-e, will be re served for a
future agenda. No discussion was had, and the meeting continued with Agenda Item 6).
d) Discuss and act on Resolution #2026-3-2 to Award the Contract for the sewer and watermain extension to Olde Apple
Acres Subdivision – 1 st Addition, Phase III.
e) Discuss and act on Resolution #2026-3-3 to Approve a Final Resolution declaring the Sanitary District' s intent to
exercise its police power, pursuant to Section 66.0 703 of the Wisconsin Statutes, to levy a Special As sessment upon
the various parcels (30) included in Olde Apple Acres – 1 st Addition, Phase III in the Town of Algoma Sanitary District
No. 1 benefitted by the improvements.
i) Acknowledge Receipt of the Waivers of Special Asses sment Notices and Public Hearings in Accordance wit h
Wisconsin Statute 66.0703(7)(b).
8) Adjourn. Chad made a motion to adjourn the regular monthly m eeting at 1:23 p.m./second-Sue/carried
unanimously.

RE: Renew Town Residential Sanitation and Recycling Contract with Harter’s Fox Valley
Disposal, LLC
SUMMARY:
The town’s current five-year contract with Harter’s expires at the end of the year. Harter’s
has presented another contract for a five year term from January 1, 2027 to December 31,
2031. The proposed contract includes similar terms to the current contract, but now
includes the use of Harter’s carts as we are phasing out the town carts. This contract has
the same annual 4% rate increase as the current contract.
Information on garbage and recycling services can be found on the town website:
https://townofalgomawi.gov/garbage-recycling/
Staff worked closely with Harter’s on the contract and the town attorney has reviewed it.
The final draft of the contract is attached for your consideration.
RECOMMENDED ACTION: Staff recommend approval of the contract as presented.
Should the Town Board agree the following motion may be made:
“Motion to approve the contract between the Town of Algoma and Harter’s Fox Valley
Disposal, LLC for town residential sanitation and recycling.”
