TOWN OF FOND DU LAC FOND DU LAC COUNTY PUBLIC HEARING JUNE 9, 2025 6:00 PM The Public Hearing was called to order by Chairman Jeff Montsma. The Hearing was at the request of Fond du Lac County concerning the vacation of a portion of Farrell Drive in the County Aeronautical Park. Spark Ops has purchased property in the Park and in the expansion of the building, part of the building would go over Farrell Drive. The map was prepared by the County. There being no more discussion, the Public Hearing was adjourned. MONTHLY MEETING The Monthly Meeting was called to order by Chairman Jeff Montsma. Present were Chairman Montsma, Supervisors Aaron Kuhls, Jessica Allender, Jennifer Janeczko and David Washkoviak, Clerk Patti Supple, Treasurer Brenda Post, Attorney Matt Parmentier and various Town residents. Confirmation was made of open meeting notice. The Pledge of Allegiance was recited. Minutes prepared by Attorney Parmentier from the May 12, 2025 meeting were approved as presented. 4. The Board recently reviewed the services the present Permit Issuer/Building Inspector Safebuilt and the services offered by Final Look. After review, the Board made the recommendation to discontinue services with Safebuilt and work with Final Look. Attorney Parmentier has reviewed the contracts for both businesses and the following can be achieved. The contract with Safebuilt will terminate on July 1, 2025 and a refund of fees not earned will be returned to the Town. A contract with Final Look, Doug Hoerth will be finalized and begin on July 1, 2025. Motion was made and seconded to approve the discontinuation of the contract with Safebuilt and finalize the contract with Final Look. Motion carried. 5. The Board discussed the vacation of Farrell Drive. While the Town will lose some road funding, the addition of Spark Ops to the Town will be a plus. Motion was made and seconded to approve the vacation of Farrell Drive. Motion carried. 6. There is no action of the DPW pay. 7. The Preliminary Plan from Fondy Investments for a subdivision off Forest Avenue known as Prairieview Estates 2 was presented to the Town Board. The Planning Commission has previewed this plan and the concern was for the drainage. This issue is being addressed through ditching and tiling to the present pump on Forest Avenue. Residents in the area are concerned over the traffic this new subdivision will cause. While the option to extend Streblow Drive to Highway 23 would alleviate some concerns, the State has put restrictions on the number of access points on to the State Road. Residents also asked why the Town requires both a preliminary and final plan. This is required by State Statutes. Any project over 5 lots requires two phases. This allows for any issues to be resolved prior to final recording of the documents. The issue of sewer capacity was raised. There is no issue with capacity in this area. Motion was made and seconded to approve the Preliminary Plat contingent on the drainage issues being resolved, a development agreement, covenants, reimbursement agreement for the Attorney fees and Engineering fees, and acknowledgment that the roads will not be accepted by the Town until completed per Town standards. Motion carried 3 aye and Kuhls and Allender nay. Supervisor Washkoviak noted it is not fair to saddle one subdivider with issues not directly related to this project. It is not part of this discussion and the County has no issues with access onto Forest Avenue. 8. There is no update on the Computer Troubleshooters proposal. 9. a. Supervisor Allender noted the website update is underway. Supervisor Washkoviak noted the comments made concerning the lack of acknowledgement from the Board about resident’s concerns is unfair. This project has been seen by the Board and Planning Commission a total of 3 or 4 times. The Town Board forum is not the time for back and forth discussion but should have been done at the Planning level when the engineer and owner were present. The Town Board is not being disrespectful, but needs to keep the meeting moving forward. In addition, the Town Board must meet the needs of all residents of the Town and must act in the best interests of the Town as a whole. There will be other meetings concerning this project. Chairman Montsma noted this is a learning process for this new Board. While the Board wants to hear the concerns of the residents, there will be another Planning meeting where concerns can be addressed. The question was raised concerning closed sessions. The Town has had some legal issues that need to be addressed in closed session. Among these were two that have been addressed, ALF Rentals who has received a license and US Cellular who can construct a tower in the Town. Still active are the Van Dyne Bridge Road issue and the Jeffrey Brown case. The Vesta Audit has been completed. A proposal for a Deputy Clerk is in the works. The base for the Simon Park sign has been installed and will be lighted. Winnebago Lutheran Academy says they have access off Highway 23 and County OOO. Signs with flags have been put on Brown Road for stop ahead and the flashing stop signs have been ordered. The ditch on Forest Avenue is on private property. Clerk Supple noted there will be another election this year and is scheduled for November 4, 2025. On the ballot will be the judge for Lakeside Municipal Court. Clerk Supple also thanked everyone for the kind cards, emails and prayers that she has received during her recent health issues. Fire Chief Birschbach noted the Fire Department is looking for volunteers. He noted the Department has a Cadet program for 14 to 18 year olds. 13 No meetings are scheduled for the Board of Appeals or Planning Commission. 14.
