Members absent: None Other Attendees: Kyle Noonan, Sue Noland, Brian Giese and Andria Farrand. Elect Chairman: Motion by Rief, seconded by Barna, to elect Joe Zenner as Chairman. Motion carried. Call Public Hearing to order: • Read Public Notice- the public notice was read by Noonan. • Request statement by applicant or representative - Noonan read the staff analysis report and project overview. The applicant is requesting a variance for the setback of a garage he would like to build on his property on Spirit Lake. He is proposing the garage to be 40 feet from the centerline of the town road, although the requirement is 55 feet. The board recessed at 9:14 a.m. due to a fire alarm and evacuation of the courthouse. The board reconvened at 9:22 a.m. Mr. Giese addressed the board and presented additional photos of the property where he is proposing the construction of the garage. Barna requested details of when the septic was installed, it was 1975. Noonan stated he went to the site and confirmed the setback of the septic is more than the 10 foot requirement. Giese stated he will address the septic and drain field if/when it fails. He is only at the property once a month and has done regular maintenance of it. Rief asked if there were any utilities involved, Noonan stated he was not aware of anything out of the right of way. • Request statement from the public- None. • Any final questions or comments- None. • Close the record and the hearing- Zenner closed the public hearing at 9:35 a.m. Deliberation and decision by the Board of Adjustment: Motion by Zenner, seconded by Rief, to grant the variance as submitted as long as all regulations are in compliance. Rief is concerned this will open up a can of worms for others in the county wanting to get a variance. He suggested he get a holding tank now and then he can build the garage at the required 55 feet from the center line. A roll call vote was cast with Zenner voting aye, Rief voting no and Barna voting no, the motion failed. The request for the variance was denied. Adjourn: Motion by Zenner, seconded by Barna, to adjourn. The meeting was adjourned at 9:51 a.m. Andria Farrand, County Clerk Board of Adjustment Secretary {NOTE: THESE MINUTES HAVE BEEN REVIEWED AND ARE BEING PUBLISHED PRIOR TO COMMITTEE OFFICIAL APPROVAL DUE TO THE INFREQUENCY OF MEETINGS.}
