The Board met pursuant to adjournment, and was called to order by Chairperson Nooyen at 7:00 p.m. in the County Board Room, located at 320 South Walnut Street, Appleton, Wisconsin. ROLL CALL: 32 present, 4 absent. Members present: Thompson, Miller, Smith, Patience, Gabrielson, Kostelny, Hammen, Lawrence, Krueger, Lamers, Ferguson, McCabe, Wegand, Hermes, MacDonald, Croatt, Spears, Cooke, Santonato, Cuff, Hagen, Klemp, Thiede, Nooyen, Weinberg, Culbertson, Monfils, Winterfeldt, Nejedlo, VanderHeiden, Koury, and Lautenschlager. Members Absent: Clegg, Thyssen, Rettler, Schroeder The Board Chairperson requested the Board's confirmation to excuse Supervisor Schroeder, Supervisor Clegg, Supervisor Thyssen, and Supervisor Rettler. No objections; so ordered. MINUTES OF THE JANUARY 9, 2024 COUNTY BOARD MEETING Supervisor Patience moved, seconded by Supervisor Weinberg, to approve the minutes of the January 9, 2024, County Board meeting. ROLL CALL: 31 yes, 1 abstain (Spears), 4 absent. MINUTES OF THE JANUARY 9, 2024, BOARD MEETING ARE APPROVED. SPECIAL ORDER OF BUSINESS – None. ESTABLISH ORDER OF THE DAY – None. COMMUNICATIONS – Chairperson Nooyen summarized the following communications:  One Supervisor has yet to complete the October IT security training that was due in November. Please get this completed as soon as possible.  Four Supervisors have to complete the December IT security training that was due January 3rd. Please complete this training as soon as possible. PUBLIC PARTICIPATION IS LIMITED TO ONLY MATTERS LISTED ON THE AGENDA AND FOR A TOTAL OF FIFTEEN MINUTES WHICH MAY BE EXTENDED TO 30 MINUTES AT THE DISCRETION OF THE CHAIR – None. APPOINTMENTS – County Executive Nelson nomination for appointment of Pafoua Her, PhD, to the Health & Human Services Board, said term expiring December 31, 2027. Supervisor Gabrielson moved, seconded by Supervisor McCabe, for confirmation of the above-listed appointment. ROLL CALL: 32 yes, 4 absent. NEW BUSINESS Resolution No. 93—2023-24 – Highway, Recycling and Solid Waste Committee and Public Safety Committee. Approve to support pending legislation to allow a political subdivision to install and maintain cameras where persons are engaged in work in a highway maintenance or construction area to capture video or photographic evidence of traffic accidents and other violations of the law, as noted on the resolution. Supervisor Hagen moved, seconded by Supervisor Patience, for adoption. ROLL CALL: 27 yes, 4 no (Krueger, Klemp, Thiede, Lautenschlager), 1 abstain (Winterfeldt), 4 absent. RESOLUTION NO. 93—2023-24 IS ADOPTED. Resolution No. 94—2023-24 – Property, Airport, Recreation and Economic Development Committee. Approve to authorize a Temporary Limited Easement made by the State of Wisconsin Department of Natural Resources (Grantor) to the Wisconsin Department of Transportation (Grantee) on the Newton Blackmour State Trail located on a parcel of land being part of the Southeast ¼ of the Southeast ¼ and the Southwest ¼ of the Southeast ¼ of Section 8 in Township 23 North, Range 17 East, Village of Black Creek, Outagamie County, Wisconsin; for the purpose of installing a culvert and to upgrade the existing storm sewer in the village to alleviate flooding issues, as noted on the resolution and attachments. Supervisor Culbertson moved, seconded by Supervisor Monfils, for adoption. ROLL CALL: 32 yes, 4 absent. RESOLUTION NO. 94—2023-24 IS ADOPTED. Resolution No. 95—2023-24 – Agriculture, Extension Education, Zoning, and Land Conservation Committee. Approve the following line item changes, as noted on the resolution and fiscal note: increase Land Conservation Salaries by $9,850; increase Land Conservation Fringes by $11,950; decrease Land Conservation Travel/Training by $6,000; decrease Land Conservation Supplies by $15,800; increase TMDL – New Water Supplies by $3,100; and decrease the TMDL - New Water Purchased Services by $3,100, to better allocate and best spend the funds available for the Land Conservation Department. Supervisor VanderHeiden moved, seconded by Supervisor Lautenschlager, for adoption. ROLL CALL: 32 yes, 4 absent. RESOLUTION NO. 95—2023-24 IS ADOPTED. CLOSED SESSION PURSUANT TO SECTION 19.85(1)(g) WIS STATS. FOR THE PURPOSE OF CONFERRING WITH LEGAL COUNSEL FOR THE GOVERNMENTAL BODY WHO IS RENDERING ORAL OR WRITTEN ADVICE CONCERNING STRATEGY TO BE ADOPTED BY THE BODY WITH RESPECT TO LITIGATION IN WHICH IT IS OR IS LIKELY TO BECOME INVOLVED. Supervisor Lawrence moved, seconded by Supervisor Croatt, to enter into Closed Session as noted above. ROLL CALL: 32 yes, 4 absent. COUNTY BOARD ENTERS CLOSED SESSION AT 7:23 PM. Approve to disallow the claim submitted by Herrling Clark Law Firm Ltd. on behalf of a minor that has been placed on file in the office of the Outagamie County Clerk and that no action of this claim may be brought against Outagamie County or any of its officers, officials, agents, or employees after six months from the date of service of this notice. Supervisor Krueger moved, seconded by Supervisor Thiede, for adoption. ROLL CALL: 8 yes (Lawrence, Krueger, Cuff, Klemp, Thiede, Culbertson, Monfils, Koury), 24 no, 4 absent. RESOLUTION NO. 96—2023-24 IS DEFEATED. RECONSIDERATION/LOCK IN OF DEFEATED RESOLUTION NO. 96—2023-24 Supervisor Krueger moved, seconded by Supervisor Cooke, to reconsider Resolution No. 96—2023-24. VOICE VOTE CARRIED UNANIMOUSLY. DEFEATED RESOLUTION NO. 96—2023-24 IS RECONSIDERED. VOICE VOTE CARRIED UNANIMOUSLY. DEFEATED RESOLUTION NO. 96—2023-24 IS ADOPTED & LOCKED IN. REPORTS – None.
