STAFF MEMO
Meeting Date: July 27, 2026
To: Public Safety Committee
From: Clerk/Executive Assistant Anastasia Gonstead
Subject: Ordinance 1157-2026 – Repeal and Recreation of §397-14, Bicycles, Electric Bicycles,
Play Vehicles, and Electric Micromobility Devices
Purpose
The purpose of this ordinance is to repeal and recreate §397-14 of the Municipal Code to
modernize the City's regulations governing bicycles, electric bicycles (e-bikes), play vehicles,
and electric micromobility devices. The proposed ordinance establishes clear operational
standards that reflect changes in transportation technology while promoting the safe and
orderly use of these devices on City streets, sidewalks, trails, parks, and other public property.
The ordinance is intended to balance the growing popularity of electric mobility devices with
the City's responsibility to protect pedestrians, motorists, and other users of public spaces.
Background
The City's existing bicycle ordinance predates the widespread use of electric bicycles and
other electric micromobility devices such as electric scooters, OneWheels, and similar
equipment. While Wisconsin law provides definitions and regulations for electric bicycles,
municipalities retain authority to regulate where and how these devices may operate on local
property and within municipal parks.
The proposed ordinance largely follows the framework recently adopted by the City of Horicon.
Staff reviewed Horicon's ordinance as a model because it incorporates current Wisconsin
statutory language while providing municipalities with local flexibility. Several modifications
have been incorporated at the request of the Mayville Police Department to improve
enforceability, clarify prohibited conduct, and address local public safety concerns.
Summary of the Ordinance
The proposed ordinance would:
• Update municipal definitions to recognize:
o Class 1, Class 2, and Class 3 electric bicycles;
o Electric micromobility devices;
o Out-of-class electric vehicles;
o Shared-use paths and bicycle facilities.
• Incorporate current Wisconsin statutory definitions and automatically recognize future
statutory amendments unless otherwise excluded.

www.mayvillecity.com
• Establish operational requirements for bicycles, electric bicycles, play vehicles, and
electric micromobility devices.
• Require operators to obey traffic laws and traffic control devices.
• Establish sidewalk operating requirements, including:
o Reduced operating speeds for electric devices;
o Yielding to pedestrians;
o Audible warnings when passing;
o Safe and prudent operation.
• Establish helmet requirements for certain operators under sixteen years of age.
• Restrict the operation of Class 3 electric bicycles and out-of-class electric vehicles in
certain locations.
• Establish where electric bicycles may operate within City parks, trails, and other public
property.
• Prohibit operation on playgrounds, athletic fields, pedestrian-only areas, and other
sensitive locations unless specifically authorized.
• Establish parking requirements to prevent obstruction of sidewalks and Americans with
Disabilities Act (ADA) accessible routes.
• Authorize enforcement actions for reckless operation and unsafe equipment.
• Provide enforcement authority through the existing municipal penalty provisions.
Why Municipalities Are Updating E-Bike Ordinances
Wisconsin municipalities have increasingly updated their bicycle ordinances over the past
several years due to the rapid growth in electric bicycles and other personal mobility devices.
Older bicycle ordinances often do not address newer technologies, leaving uncertainty
regarding where these devices may legally operate.
Common reasons municipalities adopt updated ordinances include:
• Providing clear rules for residents, visitors, and law enforcement regarding the
operation of electric bicycles and other micromobility devices.
• Improving pedestrian safety on sidewalks, trails, and shared-use paths.
• Reducing conflicts between pedestrians, bicyclists, motorists, and users of electric
mobility devices.
• Clarifying where various classes of electric bicycles may operate within municipal parks
and trail systems.
• Addressing high-speed or modified electric vehicles that exceed the classifications
recognized under Wisconsin law.
• Promoting consistency with current Wisconsin statutes while allowing local regulation
where authorized.
• Providing clear enforcement standards for unsafe or reckless operation.
• Protecting City infrastructure, recreational facilities, and natural resources from
inappropriate vehicle use.

Temporary Restrictions During Events and Emergencies
One of the notable additions included in this ordinance is Section J, which authorizes the
Director of Public Works/Parks, or their designee, to temporarily prohibit, reroute, or regulate
bicycles, electric bicycles, play vehicles, and electric micromobility devices on City property
under specified circumstances.
This authority may be exercised during:
• Construction or maintenance activities;
• Community festivals and special events;
• Hazardous weather conditions;
• Emergency situations;
• Public safety concerns; or
• Circumstances requiring protection of City infrastructure or natural resources.
Staff intentionally included this provision after learning from other Wisconsin municipalities
that have experienced challenges managing large public events without clear authority to
temporarily restrict these devices. Municipal officials have expressed regret that their
ordinances did not include such language, particularly during festivals, parades, concerts, and
other high-attendance events where heavy pedestrian traffic creates safety concerns.
Providing administrative authority for temporary restrictions allows City staff to respond
quickly to changing conditions without requiring Common Council action each time a
temporary safety concern arises. Appropriate notice would be provided through signage,
barricades, cones, fencing, electronic messaging, or other reasonable means.
Police Department Recommendations
The proposed ordinance incorporates several revisions requested by the Mayville Police
Department to improve clarity and enforcement. These revisions include additional operational
standards, provisions addressing reckless operation, restrictions on out-of-class electric
vehicles, impoundment authority for unsafe or unlawfully operated bicycles and electric
bicycles, and language intended to assist officers in applying the ordinance consistently.
Fiscal Impact
The proposed ordinance is not anticipated to have a significant fiscal impact. Enforcement will
be performed by existing City staff as part of their normal responsibilities.
Legal Review
The proposed ordinance has been submitted to the City's municipal counsel for legal review.
Any recommendations or revisions received from counsel will be presented to the Committee
and Common Council prior to final consideration.
