Agenda Item III. PUBLIC HEARING 12
Chair Murphy opened the public hearing and swore in the applicants. 13
III.A Continued Public Hearing to Consider Variation s at 167 Abingdon Ave Avenue Pertaining to 14
Maximum Building Size and Maximum Building Coverage Requirements 15
Village Planner Andrew Dunham opened the first item with a presentation and explained that the 16
request remained unchanged from the July 13, 2026 meeting. Mr. Dunham stated the applicant 17
was requesting relief from building coverage and floor area requirements. 18
19
Charlie Waddell, applicant, explained that his request is intended to reflect community feedback 20
from the Village’s recent Zoning Code Audit and Survey. The feedback, he further explained, 21
showed interest in enabling property owners to modernize their homes. Mr. Waddell stated that 22
additional space is needed to improve how the home functions for his growing family and he would 23
like the improvements to be in line with community standards. 24
25
Project architect, Keith Labutta, shared that the request had been reduced by 30% from June to 26
July’s meeting. 27
28
Neighbor, Brad Minkow, noted his support for the request that he believed was modest and would 29
improve property values. 30
31
Member Roeser asked if the Waddell family had considered splitting their requests, as she could 32
more readily support the proposed work on the detached garage versus the garage and sunroom 33
addition. 34
35
Village Attorney Mackey relayed that the applicant is permitted to split the requests if that is what 36
they choose. In response to questions from the applicant, Ms. Mack explained regulations for non-37
conforming structures and that a variance would be required to rebuild the detached garage in its 38
exact footprint. Ms. Mack further explained that there would be a two-year waiting period for 39
similar applications if the current variance request was denied. 40
41
Chair Murphy and members Tzur and Quigley stated their support for the request. 42
43
Members Roeser, Chalmers, and Peterson shared support for the detached garage, however, they 44
did not believe a hardship was present to justify the variance request for the addition. 45

Mr. Waddell requested a brief recess at 7:43 p.m. so they could discuss their preferred path 1
forward. The meeting resumed at 7:56 p.m. 2
3
Ms. Waddell asked the ZBA members how other similarly scoped variations were approved 4
compared to their request. Member Chalmers responded that the ZBA reviews the totality of 5
circumstances, and each property is unique. Member Roeser emphasized the need for requests 6
to meet the standards for variations outlined in the code. Member Peterson agreed. 7
8
Mr. and Ms. Waddell asked the ZBA to continue their request to September 14th for further 9
discussion. 10
11
Following a request by the applicant, Member Roeser made a motion to continue the request to 12
the regularly scheduled ZBA meeting on September 14, 2026. Member Chalmers seconded the 13
motion. 14

Request for Commission Action
Agenda Item: III.A
Staff Contact: Andrew Dunham, Teska Associates, Inc.
Subject: Public Hearing to Consider a Variation at 307 Melrose Avenue Pertaining to Maximum
Length of Garage Door Openings Facing the Lot Line Abutting an Adjacent Street
Petitioner: Amy Berka of Scott Simpson Design Build, on
behalf of owner Todd and Sarah Simpson
Location: 307 Melrose Avenue
Zoning: R-1 Single-Family Residential
Purpose: Request a variation to permit construction of a new
one and a half -story, three-car garage with total garage door
openings exceeding 20 feet in length facing the adjacent street
Applicable Regulations:
§153.080 Parking and Storage of Vehicles (F)
Introduction:
The petitioner, Scott Simpson Design Build, is requesting a variation to maximum total garage
door openings facing the right-of-way requirements on behalf of the homeowner to permit
construction of a one and a half-story three-car garage to replace the existing three-car garage
on the same site. This property is situated on a corner lot at the east side of the intersection of
Melrose Avenue and Essex Road.
Discussion:
A two-story stucco home and detached one-story garage are currently located on the 26,244 sq.
ft. property at 307 Melrose Avenue. The existing three-car garage is situated in the rear yard
and faces the lot line abutting Melrose Avenue and is 26 ft. and 3 in. in width. Its current garage
door openings total 24 ft., making the existing garage a legal nonconformity.
The petitioner proposes replacing the existing garage with a one and a half -story, three-car
detached garage with the same orientation at roughly the same location. The proposed garage
would measure 31 ft. 5 ½ in. in width with total garage door openings consisting of 27 ft. (the
sum of three 9 ft. garage openings). An additional half story is proposed for storage space. The
replacement garage would be served by the existing driveway.
• A one and a half-story, three-car garage is proposed to replace the existing one-story,
three-car garage as part of this request.

• In total, the replacement garage would increase the total length of garage door openings
facing the lot line abutting Melrose Avenue from 24 ft. to 27 ft.
• The proposed garage would be 19 ft. 10 ¼ in. tall, compliant with the Zoning Code.
• As part of the proposal, the garage depth would be decreased by 1 ft. 7 in. and its distance
to the lot line would be increased to 5 ft. from the side lot line (north) and 8 ft. from the
rear (west) lot line.
• The existing garage openings are partially screened from the right-of-way by plantings
and landscaping, which are expected to be retained as part of the proposal.
• The current building size (floor area) of the structures on the property is 5,778 sq. ft. and
the total building coverage of the structures is 3,577 sq. ft.; the proposed replacement
garage would result in a net increase of 81 sq. ft. in both floor area and building coverage,
compliant with the Code.
• All other aspects of this proposed addition are compliant with the Zoning Code.

Requested Variation:
Variation– Maximum Size; Maximum Lot Coverage
Applicable Regulation: Section 153.080 (F) of the Zoning Ordinance
The petitioner requests a variation from Section 153.080 (F) of the Zoning Code specifying a
maximum total length of 20 feet for garage door openings facing the lot line abutting any
adjacent street. The petitioner proposes replacing the existing nonconforming one-story, three-
car detached garage with a total garage opening length of 24 ft. with a new one and a half -story,
three-car detached garage with a total garage opening length of 27 ft. The proposed garage
would have the same orientation as the existing garage, facing the lot line abutting Melrose
Avenue. As part of this project, the property’s floor area and building coverage would increase by
81 sq. ft., in compliance with the Zoning Code.
Section 153.080 (F) of the Zoning Ordinance specifies that no garage shall have door openings
facing the lot line abutting any adjacent street where the sum of the garage door openings
exceeds 20 ft. Existing garage door openings on this property facing Melrose Avenue total 24 ft.
and the total openings of the garage would total 27 ft.
The following table illustrates the requested variation from the maximum length of garage
openings facing the lot line abutting any adjacent street:

Example Motion for Consideration:
I move to approve (with conditions) the request submitted by the petitioner, Amy Berka of Scott
Simpson Design Build, on behalf of owner Todd and Sarah Simpson, to permit construction of a
detached one and a half-story, three-car garage in the rear yard that exceeds maximum total
length of garage door openings requirements by 7 ft. and at 307 Melrose Avenue in accordance
with the materials included in this packet.

Standards for Variations
For Zoning Variations, please respond to the applicable standards listed below in the written explanation of the
request.
(1) The Board shall not grant a variance from any of the regulations of Chapter 153: Zoning, as authorized by Subsection
153.244(D), unless it shall make a finding of fact, based upon the evidence presented to it in a particular case, that:
(a) In the case of property the principal use of which is for business purposes, the property in question cannot yield a
reasonable return if permitted to be used only under the conditions allowed by the regulations applicable to the district in
which it is located;
(b) The plight of the owner is due to unique circumstances; and
(c) The variation, if granted, will not alter the essential character of the locality.
(2) For the purposes of supplementing the above standards, the Board, in making its determination whether the plight of the
owner is due to unique circumstances and whether the variation, if granted, may alter the essential character of the locality,
shall take into consideration the following factors to the extent they are established by the evidence and deemed relevant by
the Board:
(a) The particular physical surroundings, shape, or topographical condition of the property in question would result in a practical
difficulty or particular hardship upon the applicant for the variation, as distinguished from a mere inconvenience, if the strict letter
of the regulation were enforced;
(b) The conditions upon which the application for variation is based would not be applicable generally to other property in the
same district;
(c) The request for the variation is not based exclusively upon the desire to make more money out of the property;
(d) The alleged difficulty or hardship has not been created by any person presently having an interest in the property;
(e) The variation will not impair an adequate supply of light and air to adjacent properties or substantially increase the runoff of
storm water onto adjacent properties or public streets, or substantially increase congestion in the public streets or increase the
danger of fire or otherwise endanger the public safety or substantially diminish or impair property values within the neighborhood.
(3) For the purpose of further supplementing the above standards and factors in connection with requests for variations from
the requirements of Section 153.068, the Board, in making its determination, may also take into consideration the following
factors, among other factors deemed relevant by the Board, to the extent they are established by the evidence and deemed
relevant by the Board:
(a) The effects of the proposed construction on the overall appearance of the size and bulk of the existing structures on
the property when viewed from streets abutting the property and from adjacent properties;
(b) The proximity of the proposed construction to streets abutting the property and to adjacent properties;
(c) The relative proximity of the proposed construction to streets abutting the property and to adjacent properties in comparison
with the relative proximity of existing structures on other properties in the same vicinity;
(d) The magnitude of the variation requested in absolute terms and in proportion to the floor area and/or impervious surfaces
allowed if the strict letter of the regulation were enforced;
14
7
(e) The need for other variations in connection with the proposed construction and the nature and extent of those other variations;
(f) The need for the variation to allow the owner or occupant of the property to make reasonable use of a structure, the design of
which otherwise fails to conform to generally accepted or prevailing standards of the Village for the use and enjoyment of a
structure as a residence for a family;
(g) The efficient and advantageous use of existing structures and the degree to which the proposed construction makes efficient,
economical, and advantageous use of existing and proposed floor area and impervious surfaces; and
(h) The reasonableness of the variation requested in light of the purposes served by the proposed construction and the design
problems of the existing structure intended to be alleviated by the proposed construction.
(4) For purposes of supplementing the above standards and factors in connection with requests for variations from the
requirements of Section 153.067, the Board, in making its determination, may also take into consideration the following
factors, among other factors deemed relevant by the Board, to the extent they are established by the evidence and deemed
relevant by the Board:
(a) The heightand location of existing and proposed structures on the property and adjacent properties;
(b) The need to maintain theheightof the proposed structure in relation to the height of an existing structure in order to enable
the existing and proposed structures to present a pleasing appearance reflecting architectural integrity and harmony among
separate structural elements; and
(c) The need to maintain a particular heightof a proposed addition to a structure in order to observe sound structural design and
accommodate good building practices in the construction of the proposed addition.
(5) For the purpose of supplementing the above standards with regard to variations for signs, the Board, in making its
determination shall take into consideration the following factors to the extent they are established by the evidence and deemed
relevant to the Board:
a) In the case of a commercial message sign, strict application of the Kenilworth Sign Code would render the applicant
unable to yield a reasonable return from its property.
b) The variation will not endanger the public safety or substantially diminish or impair property values within the
neighborhood;
c) The variation would not result in a sign or master sign plan as required by the Kenilworth Sign Code that:
1. Would not be in harmony with the general and specific purposes for which the Kenilworth Sign Code and the
provisions from which a variation is sought were enacted;
2. Would be materially detrimental to the public welfare or materially injurious to the enjoyment, use, development, or
value of adjacent property or improvements;
3. Would substantially increase congestion in the public streets due to parking or traffic;
4. Would create an unnecessary distraction to vehicle and pedestrian traffic; and
5. Would result in a sign that is not aesthetically consistent with the environment, or not proportional or architecturally
compatible with existing land uses and buildings and with any adjacent residential neighborhood.

RE: 307 Melrose Avenue – responses to standards for variation application
Dear Village of Kenilworth Zoning Board of Appeals,
The following are responses to the Standards for Variation 153.244 (E):
(1) The Board shall not grant, and the Plan Commission, as applicable, shall not recommend
approval of, a variance from any of the regulations of this chapter, as authorized by
subsection (D) above, unless it shall make a finding of fact, based upon the evidence
presented to it in a particular case, that:
(a) In the case of property, the principal use of which is for business purposes, the property
in question cannot yield a reasonable return if permitted to be used only under the
conditions allowed by the regulations applicable to the district in which it is located;
Response: Not applicable – this is residential property.
(b) The plight of the owner is due to unique circumstances; and
Response: The unique circumstance is the age of the existing garage along
with the standard to which it was built. The current garage does not reasonably fit typical
vehicles of today’s size. The existing garage is non-conforming with 24’ of garage doors
facing the street; the single garage door is 8’ wide and the double door is 16’ wide. Both
doors are only 6’-7” tall. The size of a typical single garage door is 9’ wide and 8’ tall.
(c) The variation, if granted, will not alter the essential character of the locality.
Response: The design of the proposed garage will not alter the character of the
neighborhood. The current garage walls are wood lap siding with 1x6 and 1x4 wood trim. The
siding is painted tan while the trim is painted green. The proposed garage walls will be
stucco with painted wood trim to match the house color and detailing. A front and rear
facing dormer were also added to the garage to complement the original architecture of the
home as a nod to the larger dormer on the front and back of the house.
(2) For the purpose of supplementing the above standards, the Board or, as applicable, the
Plan Commission, in making its determination whether the plight of the owner is due to
unique circumstances and whether the variation, if granted, may alter the essential character
16
of the locality, shall take into consideration the following factors to the extent they are
established by the evidence and deemed relevant by the Board or, as applicable, the Plan
Commission:
(a) The particular physical surroundings, shape or topographical condition of the property
in question would result in a practical difficulty or particular hardship upon the applicant for
the variation, as distinguished from a mere inconvenience, if the strict letter of the
regulation were enforced;
Response: The height of the existing first floor and the location of the home on the lot
present a practical difficulty for a side-load garage. The existing first floor is approximately 5’
above grade resulting in an 8-riser stair from the garage to the house which seemed
excessive to the team. The height difference of the existing home merged with a ground level
garage may make complying with the aesthetics noted in Standard 4(b) quite a challenge. If
an attached garage was added all views from the family room to the rear yard would be
completely blocked. All of these factors resulted in the Owner seeking zoning relief for a
modernized detached garage. If the regulation is strictly enforced, the Owner would be
limited to building a garage that would not fit 3 cars.
(b) The conditions upon which the application for variation is based would not be
applicable generally to other property in the same district;
Response: The request for variation is based solely on the specific conditions of 307
Melrose Avenue.
(c) The request for the variation is not based exclusively upon the desire to make more
money out of the property;
Response: This is our client’s forever home. They are firmly rooted in the community. Their
motivation for the project is to have a 3-car garage that is sized appropriately and more
functional – there is no intention to sell the property for profit.
(d) The alleged difficulty or hardship has not been created by any person presently having
an interest in the property; and
Response: The current hardship was not created by any person who has an interest in the
property.
(e) The variation will not impair an adequate supply of light and air to adjacent properties or
substantially increase the run-off of stormwater onto adjacent properties or public streets,
or substantially increase congestion in the public streets or increase the danger of fire or
otherwise endanger the public safety or substantially diminish or impair property values
within the neighborhood.
Response: The proposed project will not create any of the conditions listed above.
17
(3) For the purpose of further supplementing the above standards and factors in connection
with requests for variations from the requirements of § 153.068, the Board, in making its
determination, may also take into consideration the following factors, among other factors
deemed relevant by the Board, to the extent they are established by the evidence and deemed
relevant by the Board:
(a) The effects of the proposed construction on the overall appearance of the size and bulk of
the existing structures on the property when viewed from streets abutting the property and
from adjacent properties;
Response: The proposed garage design is an improvement in appearance when viewed from
adjacent properties and abutting streets.
(b) The proximity of the proposed construction to streets abutting the property and to adjacent
properties;
Response: The proximity of the garage to adjacent properties and abutting streets is
consistent with neighboring homes. From Melrose to the face of the garage is 142’-5”. From
Essex to the face of the garage is 158’-9 1/2".
(c) The relative proximity of the proposed construction to streets abutting the property and to
adjacent properties in comparison with the relative proximity of existing structures on other
properties in the same vicinity;
Response: The proximity of the garage to adjacent properties and abutting streets is
consistent with neighboring homes. The proposed garage setbacks are also an improvement:
5’ on the north side proposed (vs 2’-3” existing) and 6’ on the west side (vs 1’-6” existing.)
(d) The magnitude of the variation requested in absolute terms and in proportion to the floor
area and/or impervious surfaces allowed if the strict letter of the regulation were enforced;
Response: Not applicable – there is no request for floor area or impervious surface relief.
(e) The need for other variations in connection with the proposed construction and the nature
and extent of those other variations;
Response: Not applicable – there are no other variations requested.
(f) The need for the variation to allow the owner or occupant of the property to make
reasonable use of a structure, the design of which otherwise fails to conform to generally
accepted or prevailing standards of the village for the use and enjoyment of a structure as a
residence for a family;
Response: The proposed variation will not diminish or impair property values withing the
neighborhood. The necessary replacement of a garage that has reached the end of its
serviceable life with a new, sound structure and modernized 3-car garage will be an
improvement. Additionally, the proposed new garage will complement the original architecture
18
of the home, which the existing garage does not.
(g) The efficient and advantageous use of existing structures and the degree to which the
proposed construction makes efficient, economical and advantageous use of existing and
proposed floor area and impervious surfaces; and
Response: The existing 26’-3” x 25’-3” (662.6 sf) garage is in poor condition. The proposed
garage is 31’-5 1/2" x 23’-8" (744.5 sf). The proposed garage is 5’-2 1/2" wider in the east west
direction and 1’-7” shallower in the north south direction. The 31’-5 1/2" width of the garage is
set by (3) 9’ wide individual overhead doors and (4) 10” Simpson portal frame kits.
Portal frames are required by code because standard wall bracing is insufficient to resist the
lateral loads on the south wall.
(h) The reasonableness of the variation requested in light of the purposes served by the
proposed construction and the design problems of the existing structure intended to be
alleviated by the proposed construction.
Response: The requested variation is reasonable. While the proposed garage is wider than the
existing garage, only 17’-8 5/8” will be visible from Melrose once a proposed addition to the
home is built. The view from Essex is improved as the proposed garage is 1’-7” shallower.
(4) For purposes of supplementing the above standards and factors in connection with
requests for variations from the requirements of § 153.067, the Board, in making its
determination, may also take into consideration the following factors, among other factors
deemed relevant by the Board, to the extent they are established by the evidence and deemed
relevant by the Board:
(a) The height and location of existing and proposed structures on the property and adjacent
properties;
Response: The proposed height (19’-10 1/4") is significantly less than the adjacent coach
house at 321 Melrose.
(b) The need to maintain the height of the proposed structure in relation to the height of an
existing structure in order to enable the existing and proposed structures to present a pleasing
appearance reflecting architectural integrity and harmony among separate structural
elements; and
Response: Not applicable – the garage is detached from the house.
(c) The need to maintain a particular height of a proposed addition to a structure in order to
observe sound structural design and accommodate good building practices in the
construction of the proposed addition.
Response: Not applicable – this is not an addition.
19
(5) For the purpose of supplementing the above standards with regard to variations for signs,
the Board or, as applicable, the Plan Commission, in making its determination or
recommendation shall take into consideration the following factors to the extent they are
established by the evidence and deemed relevant by the Board or, as applicable, the Plan
Commission:
(a) In the case of a commercial message sign, strict application of the Kenilworth Sign Code
would render the applicant unable to yield a reasonable return from its property.
Response: Not applicable.
(b) The variation will not endanger the public safety or substantially diminish or impair
property values within the neighborhood;
Response: The proposed variation will not endanger public safety or substantially diminish or
impair property values within the neighborhood.
(c) The variation would not result in a sign or master sign plan as required by the Kenilworth
Sign Code that:
Would not be in harmony with the general and specific purposes for which the
Kenilworth Sign Code and the provisions from which a variation is sought were enacted;
Would be materially detrimental to the public welfare or materially injurious to the
enjoyment, use, development, or value of adjacent property or improvements;
Would substantially increase congestion in the public streets due to parking or traffic;
Would create an unnecessary distraction to vehicle and pedestrian traffic; and
Would result in a sign that is not aesthetically consistent with the environment, or not
proportional or architecturally compatible with existing land uses and buildings and with
any adjacent residential neighborhood.
Response: Not applicable.

Request for Commission Action
Agenda Item: III.B
Staff Contact: Andrew Dunham, Teska Associates, Inc.
Subject: Public Hearing to Consider a Variation at 235 Leicester Road Pertaining to Minimum
Yard Requirements
Petitioner: Vincent Fiore of Fiore Builders on behalf of owner
Coskun Cavusoglu
Location: 235 Leicester Road
Zoning: R-1 Single-Family Residential
Purpose: Request a variation to permit construction of a new
addition and garage to encroach into the required rear yard
Applicable Regulations:
§153.070 Minimum Yard Requirements (A)
Introduction:
The petitioner, Fiore Builders, is requesting a variation to minimum rear yard requirements on
behalf of the homeowner to permit construction of a two-story addition to the principal structure
containing a three-car garage, laundry room, and second-story game room. This property is
situated on the east side of Leicester Road between Oxford Road and Woodstock Avenue. The
existing detached garage would be removed as part of the scope of work.
Discussion:
A two and a half-story brick home and detached one-story garage are currently located on the
16,975 sq. ft. property. The current home, the principal structure on the property, is located 56
ft. from the rear lot line (compliant with the Zoning Code) and the detached garage is situated 8
ft. from the rear lot line (compliant with the setback requirements of accessory structures).
The Zoning Code specifies that minimum rear yard depth equal the larger of 25 ft. or 20% of the
depth of the lot. For this lot measuring 175 ft. in depth, the rear yard setback is 35 ft. (20% of
175 ft.). The applicant proposes removing the existing three-car garage and replacing it as part
of a two-story addition to the principal structure. This addition would encroach 9 ft. and 9 in.
into the required rear yard setback, resulting in a rear yard depth of 25 ft. 3 in.
Considered By: Date:
Zoning Board of Appeals 09/14/26
Village of
38
• One two-story addition to the rear of the principal structure is proposed. The addition
would consist of the following.
o A three-car attached garage replacing the existing detached three-car garage.
o A laundry room.
o A game room on the second floor.
• This addition would reduce the rear yard setback (56 ft.) to 25 ft. 3 in., less than the
minimum 35 ft. required for this lot by Code.
• The variation is requested to modernize an existing home by improving accessibility to
the garage and adding living and laundry space to the rear of the home.
• As part of the scope of this work, the existing detached garage would be demolished, and
the driveway would be reoriented to serve a side-loaded garage.
• All other aspects of this proposed addition are compliant with the Zoning Code.

Requested Variation:
Variation– Minimum Yard Requirements
Applicable Regulations: Section 153.070 (A) of the Zoning Ordinance
The petitioner requests a variation from Section 153.070 (A) Minimum Yard Requirements. The
petitioner proposes a decrease in the rear yard setback of 30 ft. 9 in. for a rear addition to the
39
principal structure including an attached garage, reducing the rear yard setback from 56 ft. to
25 ft. 3 in., 9 ft. 9 in. less than the minimum required rear yard for this property.
Section 153.070 (A) of the Zoning Ordinance specifies the required minimum rear yard of a
residential building in the R-1 zoning district to be the larger of 25 ft. or 20% of the depth of the
lot. For this lot measuring 175 ft. in depth, a 35 ft. minimum rear yard setback (20% of 175 ft.) is
required.
The following table illustrates the requested variation from the maximum rear yard
requirements:
Lot Depth
Lot Depth 175 ft.
Maximum Floor Area % Min Rear Yard
Minimum Rear Yard Setback
The larger of 25 ft. or 20% of the lot depth 35 ft. 100%
Existing Rear Yard Setback 56 ft. 160%
Variation % Min Rear Yard
Proposed Variation 9 ft. 9 in. 27.9%
Proposed Rear Yard Setback 25 ft. 3 in. 72.1%
Example Motion for Consideration:
I move to approve (with conditions) the request submitted by the petitioner, Vincent Fiore of
Fiore Builders, on behalf of owner Coskun Cavusoglu, to permit construction of a two-story rear
addition to the principal structure of a single-family residence that encroaches into rear yard
setback by 9 ft. 9 in. at 235 Leicester Road in accordance with the materials included in this
packet.

Section 153.244(E) – Standards for Variations
Property Address: 235 Leicester Road
Applicant: Coskun & Kader Cavusoglu
Introduction
This narrative is submitted in support of the requested variation from the rear yard setback
requirements to permit construction of an attached garage at 235 Leicester Road.
The request is based upon the unique physical characteristics of the property, the historic
nature of the residence, and the accessibility needs of the homeowners' daughter. The
requested variation represents the minimum relief necessary to reasonably
accommodate these circumstances while preserving the architectural integrity of the
home and maintaining compatibility with the surrounding neighborhood.
1. Standards for Variations
1(a) - Business Property
Not applicable. The property is improved with a single-family residence and is not
used for business purposes.
1(b)- The plight of the owner is due to unique circumstances.
The hardship arises from several unique circumstances specific to this property.
The residence was constructed in 1908, decades before the adoption of the
Village's current zoning regulations. The home is recognized as a Centennial
Home by the Kenilworth Historical Society , and the owners have intentionally
preserved its original architectural character rather than substantially altering the
historic structure.
The original placement of the residence on the lot, together with the existing
easement and required setbacks, leaves no practical alternative location for a
functional attached garage.
In addition, the homeowners' daughter has Morquio Syndrome (MPS IVA), a rare
skeletal disorder resulting in significant bone fragility and mobility limitations.
These accessibility needs further limit the available design alternatives and require
a garage configuration that safely accommodates independent vehicle access.
These circumstances are unique to this property and were not created by the
current owners.
46
1(c)- The variation will not alter the essential character of the locality.
The proposed garage has been designed to complement the existing residence
and maintain the architectural character of both the home and the surrounding
neighborhood.
The proposed improvement will preserve the appearance of a historic Centennial
Home while providing functionality consistent with modern residential use.
The requested variation will not alter the essential character of the neighborhood.
2. Supplemental Standards
2(a) - Practical Difficulty or Particular Hardship
Strict enforcement of the rear yard setback would create a practical hardship rather
than a mere inconvenience.
The homeowners are requesting an attached garage primarily to provide safe
access for their daughter between the residence and her vehicle.
Because of Morquio Syndrome, she is at an increased risk of serious injury from
falls. During winter months, walking across snow and ice between the residence
and a detached garage presents a significant safety concern.
In addition, moving the garage farther from the property line would reduce the
interior width available for parking. This would prevent her from fully opening the
driver's side door while another vehicle occupies the adjacent parking space,
making it difficult or impossible for her to safely and independently enter and exit
her vehicle.
The requested variation directly addresses these hardships.
2(b) - Conditions Not Generally Applicable
The conditions supporting this request are unique to this property.
Few properties combine:
• a residence constructed in 1908,
• historic preservation of the original structure,
• existing easement constraints,
• the need for an attached garage, and
• documented accessibility requirements for a disabled family member.
47
These circumstances are not generally applicable to other residential properties
within the Village.
2(c) - Request Not Based Upon Financial Gain
The requested variation is not intended to increase the value of the property or
maximize development.
Rather, the request is intended to preserve the historic residence while providing
safe and accessible accommodations for the homeowners' daughter.
2(d) - Hardship Not Self-Created
The hardship was not created by the current owners. The residence was
constructed in 1908 and its placement on the property predates the current zoning
regulations.
The owners have intentionally preserved the home's historic design rather than
substantially altering or relocating the existing structure.
The daughter's medical condition is permanent and independent of the owners'
actions.
2(e) - No Adverse Impact
Approval of the requested variation will not adversely affect neighboring properties.
The proposed garage:
• will maintain the residential character of the neighborhood;
• will not materially reduce light or air to adjacent properties;
• will not increase traffic;
• will not create drainage concerns;
• will not increase fire hazards; and
• will not diminish surrounding property values.
The garage has been designed to be architecturally compatible with the existing
residence and neighboring homes.
48
3. Additional Standards
3(a) - Overall Appearance
The proposed garage has been carefully designed to complement the architecture
of the existing residence. Materials, rooflines, proportions, and detailing are
intended to preserve the appearance of the historic home.
3(b) - Proximity to Adjacent Properties
The proposed location represents the only practical location for an attached
garage. The requested variation has been minimized to reduce impacts on
neighboring properties.
3(c) - Comparison to Neighborhood
The proposed construction remains compatible with surrounding residential
development. The addition preserves the scale and character expected within the
neighborhood while respecting the historic nature of the existing residence.
3(d) - Magnitude of Variation
The requested variation represents the minimum relief necessary to accommodate
the existing site constraints. The garage has been positioned to minimize the
extent of the requested encroachment while providing the functionality required for
safe vehicle access.
3(e) - Need for Additional Variations
No additional zoning variations are requested.
3(f) - Reasonable Residential Use
The requested variation allows the residence to continue functioning as a safe
family home while accommodating the accessibility needs of the homeowners'
daughter. Without the requested relief, the home cannot reasonably provide the
safe vehicle access required for her continued independence.
3(g) - Efficient Use of Existing Structures
The proposal makes efficient use of the existing residence by preserving the
historic structure while incorporating an attached garage that accommodates the
family's accessibility needs. The design avoids unnecessary demolition or
alteration of the original home.
49
3(h) - Reasonableness of the Request
The requested variation is reasonable because it balances several important public
interests:
• preservation of a recognized Centennial Home;
• accommodation of a documented disability;
• protection of public safety by reducing fall risk;
• preservation of neighborhood character; and
• the minimum relief necessary to accommodate existing site conditions.
Conclusion
The requested variation results from the unique physical characteristics of the property,
the preservation of a historic 1908 residence, and the documented accessibility needs of
the homeowners' daughter.
The request is not based upon convenience or financial gain. It represents the minimum
relief necessary to provide safe, accessible use of the property while preserving the
architectural character of the residence and maintaining compatibility with the surrounding
neighborhood.
For these reasons, the applicants respectfully request approval of the requested variation.

Request for Commission Action
Agenda Item: III.C
Staff Contact: Andrew Dunham, Teska Associates, Inc.
Subject: Public Hearing to Consider a Variation at 336 Abbotsford Road Pertaining to Maximum
Building Size and Maximum Building Coverage Requirements
Petitioner: Leah Conley
Location: 336 Abbotsford Road
Zoning: R-1 Single-Family Residential
Purpose: Request variations to permit construction of a one-
story rear addition to the principal structure
Applicable Regulations:
§153.068 Maximum Building Size; Maximum Building
Coverage (A), (B)
Introduction:
The petitioner, Leah Conley, is requesting variations to maximum building size and maximum
building coverage requirements on behalf of the homeowner to permit construction of a one story
addition to the principal structure. This property is situated on the south side of Abbotsford
Road between Kenilworth and Woodstock Avenues.
Discussion:
A two-story frame house and one and a half-story garage are currently located on the 17,500 sq.
ft. property. The current building size (floor area) of these structures is 5,862 sq. ft., higher than
the maximum allowed floor area per the Zoning Code (5,400 sq. ft.) creating an existing
nonconformity. Existing building coverage is 3,473 sq. ft., lower than the maximum allowed
building coverage (3,600 sq. ft.), and therefore compliant with the Zoning Code.
• Two one-story additions to the rear of the principal structure are proposed as part of this
request. This addition consists of two components: (1) a mud room addition to the family
room, replacing part of the existing wooden deck, and (2) an addition to the kitchen,
replacing existing exterior stairs.
• In total, these additions would increase building coverage and floor area by 146 sq. ft.
o The mudroom would measure 112 sq. ft.
o The kitchen addition would measure 34 sq. ft.
Considered By: Date:
Zoning Board of Appeals 09/14/26
Village of
60
• Existing building coverage is compliant, and the proposed variation would increase
building coverage beyond the maximum allowable by the Zoning Code by 19 sq. ft.
• The existing home and garage exceed the Zoning Code’s maximum building size (floor
area) requirements by 462 sq. ft., and the proposed variation would increase the
nonconformity by 146 sq. ft., yielding a floor area that is 608 sq. ft. above the maximum
building size.
• The variation is requested to modernize an existing home by adding a mudroom and
creating a more usable kitchen space.
• As part of the scope of this work, 146 sq. ft. of existing decks would be removed. This
impervious surface would not be replaced elsewhere on the property, thereby reducing
impervious coverage by 146 sq. ft.
• All other aspects of this proposed addition are compliant with the Zoning Code.

Requested Variation:
Variation– Maximum Size; Maximum Lot Coverage
Applicable Regulations:
Section 153.068 (A) of the Zoning Ordinance
Section 153.068 (B) of the Zoning Ordinance
61
The petitioner requests a variation from Section 153.068(A) Maximum Building Size and Section
153.068(B) Maximum Building Coverage. The petitioner proposes an increase in the existing
nonconforming building size (floor area) of 146 sq. ft. for a new mudroom and an expansion of
the kitchen, totaling 6,008 sq. ft., 608 sq. ft. above the maximum allowable floor area. The
proposed addition to the principal structure and garage will also increase the existing, Code-
compliant building coverage by 146 sq. ft., totaling 3,619 sq. ft., 19 sq. ft. above the maximum
allowable floor area, creating a new nonconformity. As part of this project, 146 sq. ft. of
impervious surface would be removed.
Section 153.068 (A) of the Zoning Ordinance specifies the maximum floor area of a residential
building to be calculated as follows: (Lot area X 0.24) + 1,200. No significant alteration has
occurred since 2005, and therefore the property is not subject to lower floor area requirements.
This lot measures 17,500 sq. ft., resulting in a maximum floor area of 5,400 sq. ft. The existing
structures’ floor area measures 5,862 sq. ft., higher than the maximum allowed floor area; the
proposed addition would increase floor area by 146 sq. ft., resulting in a proposed floor area of
6,008 sq. ft.
The following table illustrates the requested variation from the maximum building size:
Lot Area
Lot Area 17,500 sq. ft.
Maximum Floor Area % Max Floor Area
Maximum Floor Area
(Lot area X 0.24) + 1,200 5,400 sq. ft 100%

Variation % Max Floor Area
Proposed Variation 146 sq. ft. 2.7%
Proposed Floor Area 6,008 sq. ft. 111.26%
Section 153.068 (B) of the Zoning Ordinance specifies the maximum building coverage of a
residential building to be calculated as follows: (Lot area X 0.16) + 800. This lot measures 17,500
sq. ft., resulting in a maximum building coverage of 3,600 sq. ft. The existing structures’ building
coverage measures 3,473 sq. ft., compliant with the Zoning Code; the proposed addition would
increase building coverage by 146 sq. ft., resulting in a proposed building coverage of 3,619 sq. ft.
The following table illustrates the requested variation from the maximum building coverage:

Re: Explanation of Request for Zoning Variation
336 Abbotsford, Kenilworth Illinois
As the applicants' representatives, we respectfully request approval of a zoning variation to permit a
modest 146-square-foot, one-story rear addition to the existing residence. The proposed addition is
intended to address practical difficulties created by the home's existing configuration while preserving its
architectural character and maintaining compatibility with the surrounding neighborhood.
Existing Hardship and Unique Circumstances
The current owners purchased the home in 2021. Prior to their ownership, the previous owners obtained
zoning variations in 2002 to construct a family room, kitchen, and breakfast area addition. Although that
renovation increased the size of the residence, it resulted in a floor plan that does not function efficiently
for everyday family living.
The practical difficulty arises not from the owners' personal preferences, but from the home's existing
physical configuration. The location of the existing family room, structural walls, circulation pattern, and
the relationship between the kitchen and adjoining spaces create design constraints that cannot
reasonably be resolved through interior remodeling alone. These existing conditions, established long
before the current owners acquired the property, limit the ability to improve the home's functionality
while remaining within the current zoning requirements.
Working with Melichar Architects, the applicants explored twelve separate design alternatives to resolve
these deficiencies within the existing building envelope. Each option was carefully evaluated before
concluding that a modest rear addition represents the minimum amount of additional floor area
necessary to create a functional kitchen layout, establish an appropriate connection to the dining room,
and provide the mudroom that the residence has historically lacked. The requested variation is therefore
based on a practical hardship created by the existing structure rather than a matter of convenience.
The conditions giving rise to this request are unique to this property and are not generally applicable to
other homes within the neighborhood. The applicants did not create these circumstances. Rather, they
inherited the existing layout and are seeking only the minimum zoning relief necessary to make
reasonable use of their home as a modern family residence. The request is not intended to maximize the
size, value, or development potential of the property.

Compatibility with the Neighborhood
The proposed addition has been carefully designed to preserve the essential character of both the
residence and the surrounding neighborhood. The addition is limited to a single story, does not increase
the height of the home, and is located entirely at the rear of the residence, where it is largely concealed
from public view.
The project replaces an existing rear deck and is constructed over an existing hardscape patio. As a result,
the proposal does not increase the property's impervious surface coverage. The architectural design,
scale, rooflines, materials, and detailing are consistent with the existing residence, allowing the addition
to blend seamlessly with the original home.
Because of its modest size and rear location, the proposed addition will not impair access to light or air
for neighboring properties, increase stormwater runoff, create traffic or public safety concerns, or
adversely affect surrounding property values. The addition remains appropriately separated from
adjacent properties and is centered on the rear elevation to minimize its visibility and its impact on
neighboring homes.
Compliance with the Standards for Variations
The requested variation satisfies the standards set forth in Section 153.244(E) of the Village Code
because:
• The practical difficulty results from the unique physical configuration and existing layout of the
residence, rather than from the applicants' personal preferences.
• The conditions creating the hardship are specific to this property and are not generally applicable
to other properties within the zoning district.
• The hardship was not created by the current owners, who purchased the home after the existing
conditions had already been established.
• The request represents the minimum variation necessary to make reasonable use of the
residence while preserving the existing home.
• The proposed addition will not alter the essential character of the neighborhood, impair adjacent
properties, increase impervious surface coverage, or adversely affect the public health, safety, or
welfare.
For these reasons, the applicants respectfully request approval of the requested zoning variation.
