9. Specific matters for discussion and possible action by the Town Board:
A. Resolution 2026-06 Resolution of Town to Amend the 2026 Budget.
Fuge stated that she drafted 2026- 06 Town of Scott resolution to amend the 2026 budget.
The Town Board is the authority that can amend a budget; however, it was discussed at
SMU last night. The SMU Commission signed advisory resolution SMU 2026-01 to approve
the amendment. The resolution moves funds from the Water Transfer out General Fund
Account (Number 610 -0059100-000-000) to the Transfer Out Tax Equivalent Expense
Account (610-00-59100-001-000). The transfer reflects where the funds were spent in 2026.

C. Update on UTV/ATV Ordinance.
Fuge recapped that at the last meeting, the Board directed her to research the possibility of
an advisory referendum on the ballot in November. The cost would be roughly $2,000.
However, in speaking with the municipal attorney, the question does not fit in the parameters
of what a Town can have as an advisory referendum.
Cerny asked the Board for direction.
VandenLangenberg stated that there should either be no ordinance or that the Town could
follow a similar ordinance adopted by the Town of Humboldt.
Van Lanen stated that there is a county ordinance prohibiting ATVs/UTVs from operating on
county highways. He noted that the Town is divided by highways, making it difficult for
ATV/UTV operators to travel from one side of the Town to the other. He stated that creating
an ordinance did not make sense due to the difficulty of getting around and added that the
Town does not request enforcement.
Strebel stated that he did not have a problem with ATV/UTV use but did not want the Town
to act as peacekeepers. He added that he was unsure how an ordinance would help.
VandenLangenberg recommended placing information in the Town newsletter.
Van Lanen stated that the Town does not have the manpower to enforce the matter and
questioned the usefulness of adopting an ordinance without enforcement ability.
Moved by Van Lanen, seconded by Wojcik to direct staff to not proceed with drafting a
UTV/ATV ordinance for the Town of Scott. Vote: Aye-5. No-0. Motion Carried.
D. Appointment of Town Constable to fill the term ending in April 19, 2027.
