Respectfully Submitted, Holly Licht, City Clerk 7 CITY OF VERONA Resolution No. 26-035 Authorizing a Tax Bill Insert Regarding State Voucher School Funding Impact WHEREAS, the City of Verona, is committed to providing its taxpayers with clear, transparent, and accurate information regarding the allocation and impact of public funds; and WHEREAS, the state of Wisconsin uses complex funding mechanisms for public education, including traditional public school districts, independent charter schools, and private schools participating in the voucher school program; and WHEREAS, current state funding formulas divert public tax dollars from traditional public school districts to fund private schools participating in the voucher school program, directly affecting local public education budgets, state aid distributions, and the local property tax levy; and WHEREAS, municipal property tax bills serve as the primary direct communication to residents regarding local tax allocations, presenting an ideal vehicle to inform citizens on the systemic financial impacts of state-mandated education funding structures; and WHEREAS, providing objective, fact-based information regarding the fiscal relationship between state voucher school funding and local property taxes enhances civic awareness and promotes informed community dialogue; WHEREAS, since the 2022-23 school year, the Wisconsin Legislature has increased the per-pupil-payment for vouchers by 35% for grades K-8, 53% for grades 9-12, 26% for special education, and 38% for independent charter schools; and WHEREAS, for the 2025-2026 school year, the cost of private voucher school payments in the Verona Area School District was a total cost of $879,115 and the Verona Area School District therefore levied that full amount for the year to make up for this loss of state aid withheld for private school vouchers; and NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Verona, Wisconsin, that the City is hereby authorized and directed to include a separate informational insert with property tax bills issued by the City, beginning with the 2026 tax bills and annually thereafter. BE IT FURTHER RESOLVED that the informational insert shall explicitly detail the impacts of state voucher school funding on local education budgets and property tax 8 distributions, using objective data sourced from the Wisconsin Department of Public Instruction. BE IT FURTHER RESOLVED that the City Administrator and City Treasurer, in consultation with representatives from the local public school district, are authorized to finalize the text, layout, and production of said insert, ensuring it complies with all applicable state statutes regarding municipal communications. Adopted this 12th day of October, 2026. ____________________________ Luke Diaz, Mayor ____________________________ Holly Licht, City Clerk 9 How Your VASD Property Taxes Fund Private Voucher Schools The Verona Area School District (VASD) Tax Levy is not solely used for VASD public schools. A portion of your property taxes is also distributed to private voucher schools. It is important for Verona taxpayers to understand how this funding mechanism operates: ● State law compels the VASD Board of Education to levy a tax for both VASD and private voucher schools. ● Although funds go to both VASD and voucher schools and programs, the portion related to voucher expenditures does not appear on your individual tax bill. Instead, the tax levy amount for vouchers is included within the total amount attributed to VASD. ● It is important to note that even though the tax bill says all funds are going to VASD, a portion of the taxed amount goes to private voucher schools. The City of Verona and the Verona Area School District provide this information to ensure transparency on how your tax dollars are used and how state-level funding decisions influence your local property tax burden. —------------------------------- Property tax bills in Wisconsin reflect the funding needs of multiple local government entities, including your city, county, technical college, and public school district. Year Funds Sent to Private Voucher Schools Annual Increase from previous year 2022-23 $323,338 2023-24 $550,068 70% 2024-25 $639,097 16% 2025-26 $879,115 38% 10 Under current Wisconsin state law, a portion of public education funding is directed to independent voucher schools. Diverted Aid: State general aids that would otherwise be distributed to local traditional public school districts are reduced by the state to fund independent charter school seats based on the number of students who reside in our school district but attend a private school participating in the voucher program. ● Tax Levy Impact: Reductions in state aid result in public school districts increasing their local property tax levies up to their state-imposed revenue limits to maintain core educational services to make up for funds diverted to private schools participating in the voucher school program. ● The Result: Local property taxpayers directly absorb the fiscal impact of these state-mandated funding diversions. The City of Verona provides this information to ensure transparency in how your tax dollars are used and how state-level funding decisions influence your local property tax burden. Public Works, Sewer and Water Committee: • Discussion and Possible Action Re: Request to reconsider April 27, 2026 Council Action Related to South Main Street o Potential motion: Move to reconsider the Council’s April 27, 2026 action related to South Main Street and not proceed with the proposed painted bike lane/delineator configuration o Staff are asking the Common Council to reconsider its April 27, 2026 action directing installation of a painted bike lane on the east side of South Main Street between the Badger Mill Creek Bridge and Melody Lane. The Traffic Safety Committee previously denied the request due to the need for capital investment and the recommendation that improvements be evaluated through the City’s normal capital planning process. o Staff continue to recognize the pedestrian and bicycle safety concerns at this location, which lacks a dedicated facility and includes a hill and curve with limited sight distance. However, Staff do not believe placing pedestrians and bicyclists immediately adjacent to moving traffic, separated primarily by paint and temporary delineator posts, provides an adequately safe solution for this particular roadway. The delineators are 20 not a substantial physical barrier, would need to be removed for winter operations, and could create a false sense of security while leaving users exposed to traffic. o Staff recommend that the Common Council reconsider its April 27, 2026 action and not proceed with the proposed painted bike lane/delineator configuration. Instead, Staff recommend recognizing this as a deficient roadway condition and addressing it when major maintenance or reconstruction of this portion of South Main Street occurs. New Business: • Discussion and Possible Action Re: Scope of Services and Cost Estimate - Urban Service Area Amendment (Vandewalle & Associates, Inc.) o Potential motion: Move to approve Scope of Services and Cost Estimate - Urban Service Area Amendment (Vandewalle & Associates, Inc.) not to exceed $20,000, with the agreement subject to final approval by requisite City Staff o Staff are proposing to retain Vandewalle & Associates to assist the City with an Urban Service Area (USA) amendment application to the Capital Area Regional Planning Commission (CARPC), ultimately requiring review by the Wisconsin Department of Natural Resources (WDNR). The amendment would seek to add land to the Verona Urban Service Area to accommodate a proposed public works facility and the extension of public water and sanitary sewer service. o Vandewalle’s scope includes pre-application coordination with City and CARPC staff, preparation of the USA amendment application and required maps and exhibits, environmental and endangered resources screening, coordination of technical information provided by City staff and other consultants, and formal application submittal. The consultant would also assist with the CARPC public hearing and action meeting and coordinate the final WDNR review and approval process. o The proposed services would be provided on a time-and-materials basis with an anticipated fee not to exceed $25,000. The consultant’s scope is intended to provide the City with the technical and procedural assistance necessary to navigate the USA amendment process, while City staff, the municipal engineer, and other project consultants would provide supporting technical information related to utilities, stormwater, natural resources, and site development. • Discussion and Possible Action Re: Sub-Zero Development Agreement 21 o Potential motion: o City Staff and Sub-Zero have discussed the development agreement, and have reached a point where Staff would like to discuss the terms and conditions of the agreement with the council. o The Council may convene into closed session to discuss the terms and conditions of the agreement. 22 CITY OF VERONA RESOLUTION NO. NOW, THEREFORE, BE IT RESOLVED that a certified survey map be approved to create one (1) lot located at 201 South Main Street. CITY OF VERONA SEAL ______________________ Luke Diaz, Mayor ______________________ Holly Licht, City Clerk Passed, signed and dated this ____ day of October, 2026. 23 201 South Main Street Site Plan and Certified Survey Map Review Planning Report City of Verona Plan Commission 10-5-2026 Property Location: 201 South Main Street Property Owner: Memorial Baptist Church 201 South Main Street Verona, WI 53593 Applicant: Same Existing Zoning: Central Commercial (CC) Existing Land Use: Place of Worship Proposed Land Use: Place of Worship Figure 1 – Location Map Summary: The Applicant is requesting a site plan review to construct an approximately 4,700 square foot addition located at 201 South Main Street. A certified survey map is also requested. South Franklin Street South Shuman Street South Main Street East Park Lane 24 2 201 South Main Street Site Plan and Certified Survey Map Site Description: The Applicant is requesting a site plan review (“Application”) to construct an approximately 4,700 square foot addition to the existing building located at 201 South Main Street (“Property”), which is depicted in Figure 1 in yellow. The proposed building addition would allow for additional classrooms, a new entry, and support space. The parking lot will be reconfigured to allow for a drop-off/pick-up area. The Property is zoned Central Commercial (CC) and is currently a place of worship. Land uses surrounding the Property include residences and businesses. The proposed addition requires a site plan review. The Applicant proposes to dedicate land to the City for the construction of a sidewalk abutting East Railroad Street. Background: In August of 2026, the Applicant requested an initial review to construct an approximately 4,700 square foot building addition. Comments from the Plan Commission included concerns about the parking lot and emergency services being able to navigate the property in an emergency and overall support for the addition. Envision Verona: A Comprehensive Plan: The Property is located in the 2026 Envision Verona: A Comprehensive Plan (“Plan”). As part of that document, this Property is shown as downtown mixed use land use. The following are excerpts from the Plan. “Verona stakeholders and residents envision a future for the Downtown Verona that makes it a destination, with a neighborhood that accommodates new developments and public realm improvements, carefully blending the old and new in a unified, visually appealing, and pedestrian-oriented environment” (p. 56). “As Verona grows, the Downtown Verona area needs to adapt to support a larger, more walkable, and expanded Downtown that accommodates a greater number of businesses, residents, and community institutions, while maintaining its historic small town character. 4. Connected Street Grid and Sidewalk Network. A lack of through- streets in the Downtown Verona limits walkability and development potential. As parcels transition and develop, it is essential to establish roadway links and an expanded sidewalk network to create a well-connected and accessible Downtown Verona for both car travelers and pedestrians” (p. 70). The Property fronts South Main Street. The Applicant is proposing an addition in the rear of the building, which would be an expansion of the existing building. This addition is supported by the above text by maintaining and expanding the existing building. The Applicant is dedicating land for installation of a sidewalk along East Railroad Street in an effort to provide sidewalk access from South Franklin Street to South Main Street. There will be a sidewalk gap between this Property and South Main Street, but this connection is 25 3 201 South Main Street Site Plan and Certified Survey Map the first step to creating an overall sidewalk connection between these two (2) roads. Planning Review: Bulk Requirements: The proposed building addition will be located in the rear of the existing building away from South Main Street as depicted in Figure 2. The CC zoning district has a maximum building setback of fifteen (15) feet from South Main Street, East Park Lane, and East Railroad Street. The rear yard setback is ten (10) feet from South Franklin Street. The addition will be thirty-one (31) feet tall, which is under the maximum building height. The proposed addition will conform to the setback requirements and Staff does not have any concerns. Figure 2 - Site Plan Access, Parking, and Connectivity: Access to the Property will continue from South Main Street, East Railroad Street, and East Park Lane. The access from East Railroad Street will be shifted from the current location towards South Franklin Street. The parking lot will be reconfigured for a one (1)-way movement from South Main Street towards East Railroad Street. Access from 26 4 201 South Main Street Site Plan and Certified Survey Map East Railroad Street into the parking lot will only allow access to the addition area, which will be two (2) way traffic in this portion of the parking lot as depicted in Figure 2. As this Property is zoned CC, there are no minimum or maximum parking requirements for non-residential land uses, and the lot coverage allows for the entire lot to be covered. The Applicant has located three bicycle parking stalls by the entrance to the addition. In 2024, the City adopted a sidewalk policy. The policy states, “The following events will result in the construction of sidewalks or multi-use paths: c. development or redevelopment of a property along a roadway that does not currently have sidewalks”. Sidewalk will be installed along the frontage of the Property on East Railroad Street. While Staff understands the sidewalk will not connect to South Main Street, Staff is hopeful this is the first incremental step towards better connectivity. Architecture and Design: The Applicant is proposing a thirty-one (31) foot tall two (2)-story addition. The addition will match the existing materials with the addition of brick veneer for the building entrance columns as depicted in Figure 3. Staff recommends the windows of the addition complement the dimensions and proportions of the existing windows on the front of the church. In addition, shudders, art, or a dark outline could be added to the windows similar to the original portion of the building as depicted in Figure 4. Figure 1 - Addition Rendering 27 5 201 South Main Street Site Plan and Certified Survey Map Figure 2 - Existing Building Landscaping and Lighting: Landscaping and photometric plans were submitted as part of the Application. Section 13-1-153 of the Zoning Ordinance discusses landscape standards. Plantings are placed along the building addition foundation, abutting the single-family residences and along a portion of East Railroad Street. While the terrace along East Railroad Street is not wide enough for street trees, the Applicant has agreed to install canopy trees on their side of the property fronting East Railroad Street. The parking lot is screened from the street by a seven (7) foot wide planting area with a mix of shrubs. The Applicant has provided plants for the site that are seventy-five (75) percent native to the State of Wisconsin. Staff is supportive of the landscaping for the Property. All lighting is fully cut-off or downward facing LED fixtures with a shield as needed. All lighting is within the acceptable range for the Property and does not exceed 0.4 footcandles at the property lines. Per Section 13-1-159(a)(3)(e) of the Zoning Ordinance, “Lighting shall be dimmed to fifty percent (50%) after hours of operation. Dimming can be provided by timer or motion sensors”. The Applicant will provide dimming switches for all exterior lighting, and all lighting will be a consistent 3000 Kelvin color temperature. Site Plan Review: The Plan Commission as part of their Site Plan review shall take into account the following per Section 13-1-220(f) in the Zoning Ordinance: 1. The basic intent of the Comprehensive Plan and Zoning Ordinance to ensure attractive, efficient, and appropriate development of the land in the community; The Property is located in the Downtown subarea of the Plan, which focuses on infill development, a walkable environment, and higher design standards. The proposal meets 28 6 201 South Main Street Site Plan and Certified Survey Map these requirements. 2. Whether the site plan application ensures particularly that every reasonable step has been taken to avoid depreciating effects on surrounding property and the natural environment; The addition to the existing building meets all of the zoning requirements and does not have an impact on other properties. 3. Whether the site plan application ensures that adequate public utilities and public services are being provided. The Property is already served and will continue to be served by public utilities and services. Certified Survey Map (CSM): The Applicant proposes to dedicate land to the City. Dedicated land is approximately six (6) feet wide allowing a sidewalk to be built abutting Railroad Street as depicted in Figure 5. The lot will continue to meet the dimensional standards for the CC zoning district. Figure 3 - CSM illustrated with Lot 1 in beige and land dedication in red. Recommendation: Staff recommends the following Plan Commission actions: 29 7 201 South Main Street Site Plan and Certified Survey Map 1. Approve the site plan to allow for the construction of an approximately 4,700 square foot addition. 2. Recommends to the Common Council approve the certified survey map to create one (1) lot at 201 South Main Street. Main Street in Verona, is planning a building addition to their existing facility. The addition will be approximately 4,700 SF and will accommodate a new entry/drop-off area, 3 new classrooms, along with support spaces. The exterior will be designed to be a cohesive continuation of the existing facility by matching existing materials and details. The site will also be reconfigured to allow for additional parking along with a drop of lane for visitors. The existing facility is used as a place of worship, which includes the main sanctuary, fellowship / gym area, kitchen, classroom, along with support spaces. The new addition will include 3 additional classrooms, 2 single use accessible restrooms, and a unfinished second floor space set aside for future needs. The classrooms will be used during weekends and Wednesday night youth groups. At this time, we are requesting approval from Plan Commission at the October 5 th meeting. Country View Court 55 Certified Survey Map 2681 Country View Court 2 CSM Review: The Applicant is proposing a certified survey map (CSM) to combine three (3) pieces of land into one (1) lot located at 2681 Country View Court (formerly Road) (“Property”) in the Town of Verona. Extraterritorial platting authority is a state statute that provides Cities and Villages the authority to review land divisions that are within a mile and a half (1 ½ mile) radius around those municipalities. While the land is within the Town of Verona, the Property is within the City’s extraterritorial platting jurisdiction. Originally, Country View Road connected County Highway (CTH) PD to Epic Lane; however, Country View Road was relocated to swing to the west of the original roadway to connect to an under constructed road called Hyper Drive instead of Epic Lane. As part of Country View Road relocating, the original Country View Road became a cul-de- sac and does not continue south past the Property; hence the renaming to Country View Court. In February of 2026, Country View Road between this Property and Epic Lane was discontinued vacated as the right-of-way is no longer needed. The Applicant is requesting a CSM review to consolidate the existing two (2) properties located at 2681 Country View Court into one (1) property as well as 0.4213 acres of land to the Property from the discontinued right-of-way. The discontinued right-of-way will become the driveway access from Country View Court to the house and will be part of the newly created Lot 1. The Property will be a total of 2.373 acres. Utilities will remain in a twenty-five (25) foot utility easement as noted on the CSM. The Property will continue to be zoned Rural Residential (RR-2) in the Town of Verona. The Property is subject to Dane County Zoning regulations. Recommendation: Staff recommend the Plan Commission recommend that the Common Council approve the certified survey map to create one (1) lot located at 2681 Country View Court. Administrative Zoning for Vacated ROW. Property Address: 2681 Country View Road (In process of renaming to Country View Court) Owner: Mark Geller Agent: Nathan Lockwood, D'Onofrio Kottke & Associates To the Members of the Plan Commissions and Staff: On behalf of the property owner, Mark Geller, D'Onofrio Kottke & Associates is pleased to submit this application for a single-lot Certified Survey Map (CSM). The purpose of this submittal is to formally consolidate two existing residential lots and a portion of the recently vacated, detached Country View Road right-of-way (ROW) into a single, unified 2.373-acre residential parcel. Based on preliminary coordination with Dane County staff, it is our understanding that the required zoning map amendment will be handled through an administrative process. Consequently, this submittal serves as the formal application for CSM review, with the understanding that County staff will review the CSM only due to no new lot being created. Key Project Elements • Right-of-Way Consolidation: The land area formerly comprising the public right-of-way of Country View Road has been officially vacated. This defunct ROW sits adjacent to Mr. Geller's property and is no longer required for municipal infrastructure. This CSM will formally dissolve the interior lot lines of the two existing private lots and merge the vacated land into one cohesive parcel. • City Detachment & Jurisdiction: In accordance with City of Verona Ordinance No. 26-1111, the old vacated right-of-way is officially detached from the City of Verona, transferring local jurisdictional authority to the Town of Verona and Dane County. This detached, vacated ROW area encompasses 0.4213 acres. • Administrative Rezone & Zoning Consistency: The two existing private lots are currently zoned Rural Residential (RR-2) under the Dane County zoning ordinance. To eliminate split-zoning across the final 2.373-acre parcel, the un-zoned 0.4213-acre vacated ROW land will be designated as Rural Residential (RR-2) via the concurrent Dane County administrative zoning process to match the existing underlying classification. • Street Renaming Compliance: The application acknowledges and reflects the ongoing municipal process to rename Country View Road to Country View Court. Comprehensive Plan & Environmental Consistency The project preserves the strictly residential character of the surrounding neighborhood. No new buildable lots, new access points, or increases in residential density are proposed. Merging unutilized public infrastructure back into private tax parcels supports local comprehensive plans by maximizing land-use efficiency and maintaining clean neighborhood zoning maps. 57 Furthermore, the configuration of the driveway access to Country View Court exists today. Existing utility corridors located within the old ROW will be maintained via designated public utility easements on the face of the CSM. The lot consolidation involves zero physical land disturbance, grading, or vegetative clearing, ensuring no adverse impacts on local stormwater runoff or environmental corridors. We look forward to working with the Town, County, and City during this review process. Should you have any questions or require additional information, please contact me at your earliest convenience. The CSM is being reviewed as part of extraterritorial platting. The Property consists of two (2) different properties of 4.5 acres and 26.1 acres. These properties are zoned farmland preservation (FP-35) in the Town of Verona, which requires a minimum of 35 acres. The Applicant is requesting approval by Dane County to rezone the Property from FP-35 to Rural Mixed-Use (RM-8), which allows a maximum of 16 acres, to accommodate the new parcel and preserve the existing residential and farm uses. The Property is subject to Dane County Zoning regulations. Lot 1 will consist of approximately 15.6 acres. Although the CSM is utilizing 30.6 acres, the remaining portion of 15 acres is not required to create an additional lot as part of the CSM per the County Land Division Ordinance as the land is contiguous to FP-35 lands under the same ownership exceeding the minimum 35 acres. The Applicant is dedicating land for right-of-way for Spring Rose Road and does not need to dedicate additional land to U.S.H. 18-151. The City of Verona’s Comprehensive Plan was recently approved. As this Property is located outside of the study area, the City’s Comprehensive Plan is silent for future land use for this Property. Recommendation: Staff recommend the Plan Commission recommend that the Common Council approve the certified survey map to create one (1) lot of approximately 15.6 acres located at 2506 Spring Rose Road. Property Location: 2506 Spring Rose Rd, Verona, WI 53593 Parcel PINs: 060818390013 and 060818392119 1. Project Overview & Objective On behalf of the landowners, Thomas and Kari Gust, Nathan Lockwood of D'Onofrio Kottke & Associates is submitting a concurrent Certified Survey Map (CSM) application and Rezone application for the property located at 2506 Spring Rose Rd. The primary objective of this request is to consolidate the existing residential homestead and associated outbuildings into a single lot designated as Lot 1. 2. Purpose of the Application This application is initiated solely for long-term estate planning and family asset management. Creating a distinct, independent parcel for the residential portion of the property ensures the homestead can be cleanly managed or transferred in the future without disrupting the surrounding acreage. 3. Proposed Changes & Consistency • No Change in Land Use: The existing single-family residential use and surrounding agricultural land uses will remain entirely unchanged. No new development, structures, or use intensifications are proposed. • Certified Survey Map (CSM): The proposed CSM will officially establish the boundaries of the newly configured Lot 1, encompassing 15.566 acres. • Rezone Request: The rezone is a technical requirement to bring the newly configured lot into exact compliance with Dane County Zoning Code acreage thresholds. The zoning classification for the 15.566-acre Lot 1 will be changed from Farmland Preservation (FP-35) to Rural Mixed-Use (RM-8) to properly accommodate the new parcel size while preserving the existing residential and accessory uses. Remainder of lands to the east will remain FP-35 4. Jurisdictional Coordination Because the property sits within the Extraterritorial Jurisdiction (ETJ) of the City of Verona, this application is being routed simultaneously to all three reviewing bodies to ensure comprehensive compliance: • Town of Verona: For local land use, site plan, and community consistency review. • Dane County: For final zoning reclassification approval and land division recording. • City of Verona: For ETJ review of the CSM to ensure alignment with long-range municipal growth and planning boundaries. 5. Conclusion This request represents a standard, non-invasive land division designed purely for estate planning purposes. It preserves the rural character of the Town of Verona, maintains existing land uses, complies with Dane County zoning parameters, and respects the City of Verona’s ETJ oversight. We respectfully request your approval of this CSM and matching rezone. 68 Page 1 of 2 210 Martin Luther King Jr. Blvd. v Room 116, City-County Bldg. v Madison, WI 53703-3342 v Phone: 608.266.4266 v Fax: 608.267.1540 www.countyofdane.com/zoning Dane County Planning & Development Division of Zoning Joe Parisi Dane County Executive July 3, 2020 Twin Rock, LLC Bret Saalsaa 7935 Almor Dr Verona WI 53593 RE: Navigability Determination – 2528 Spring Rose Rd, Section 18, Town of Verona The Dane County Zoning Division has processed your request for a navigability and wetland determination for two intermittent streams and NRCS low spots that are located east of Spring Rose Road, south of Dairy Ridge Road, and north of US Highway 151 in the Town of Verona. Before conducting the site inspection, the County G.I.S., aerial photography, and the Wisconsin Surface Water Data Viewer w ere used to dete rmine the categorization of these intermittent streams. The map shows a waterway flowing southeast through parcels 060818386804, 060818381809, 060818395018, and 060818491100, and converging with a waterway flowing east through parcels 060818390013 and 060818395018. An intermittent stream is one that has a periodic or recurrent flow. A site inspection was conducted on July 2, 2020. The entirety of both waterways was inspected within the area of interest. It was observed that through the entire course of both wate rways any water flow can be described as sheet flow over land due to topography with no defined bed or bank, and no presence of water. In addition there was no evidence of wetland characteristics at any of the NRCS defined low spots and soil mapping do not suggest the presence of wetlands. There were isolated upland areas containing puddles of standing water but these appeared to be the result of human manipulation and soil compaction. After further review of the waterway s, it has been determined that t hese intermittent streams are NOT navigable to a point downstream at least to the south side of the US Highway 151 right -of- way, and the area of interest does not contain wetlands. This letter serves as notice that the future development that will occur on the above-described lots is NOT within the Shoreland Zoning District as defined under Chapter 11, Dane County Code of Ordinances. The CSM is being reviewed as part of extraterritorial platting. The Property is a total of 4.1 acres and zoned Rural Residential (RR-2) in the Town of Verona, which allows one (1) single family home per a minimum of two (2) acres. The Property is subject to Dane County Zoning regulations. Lot 1 will consist of approximately 2.08 acres. Lot 2 will consist of approximately 2.01 acres. Both lots are currently vacant with surface drainage crossing both lots. Proposed access will be through a shared driveway and utility easement from Davis Hill Drive. As a shared driveway is proposed, Staff understand that the Town of Verona will ensure that the driveway access meets Emergency, Fire, and Rescue service requirements allowing service to future single-family homes. As Davis Hill Drive is an established Town island, the City of Verona Comprehensive Plan is not proposing any land use changes to this area. Davis Hill Drive is already built for the current residents. The Property is not annexing into the City and would continue to follow the Town of Verona development requirements including well and septic. If well and septic were to fail, the Property must be annexed to the City before a connection is allowed to City water and sewer service. These conditions are particularly concerning for residents, including children, who may walk or bicycle to school, Fireman’s Park, and other destinations. The TSC previously considered the request and denied it. The TSC’s decision was based primarily on the fact that the proposed improvements would require capital expenditures that were not included in the current budget and that infrastructure investments of this nature should generally be evaluated through the City’s normal capital planning and budget prioritization process. The matter was subsequently appealed to the Public Works, Sewer and Water Committee on April 27, 2026. At their meeting, they contemplated investigating a striped bike lane with temporary delineator posts. The Common Council later voted to overturn the TSC decision 97 and directed that a painted bike lane be installed on the east side of South Main Street between the Badger Mill Creek Bridge and Melody Lane. Staff’s Current Concern To be clear, Staff does not believe the current configuration of this area is an adequate long- term solution and the TSC members remain concerned about pedestrian and bicycle safety in this area. However, after further consideration of the proposed configuration, Staff do not believe that placing pedestrians and bicyclists within the existing roadway, separated from moving vehicles primarily by paint and temporary delineator posts, is a sufficiently safe solution for this particular location. Staff’s concern is that the proposed interim solution may create a false sense of security while placing pedestrians and bicyclists immediately adjacent to moving traffic in a location with known visibility limitations. Delineator posts provide visual separation, but they are not a substantial physical barrier between a pedestrian and a motor vehicle. In this location, staff does not believe that distinction should be minimized. The physical characteristics of South Main Street are also important. This is an older roadway that was not designed around today’s expectations for pedestrian and bicycle facilities. The relevant portion of the roadway includes a curve and hill that limit visibility. Rather than providing a separated sidewalk, trail, or other dedicated facility, the proposed approach would essentially repurpose a portion of the existing roadway and place pedestrians and bicyclists immediately adjacent to moving traffic. There is also a practical concern with the proposed use of temporary delineators. Delineators are considered break away barriers meaning that a vehicle can drive through and over them instead of bouncing back such as a guard rail or a sidewalk curb. The temporary delineators' posts would need to be removed for winter operations. Consequently, the proposed solution would not actually provide consistent protection throughout the year. The City would effectively be establishing a pedestrian facility that changes substantially depending upon the season. The Existing Roadway Is the Problem Staff recognize the frustration with the current configuration and understand the desire to provide an immediate solution. The City should not dismiss the legitimate concern simply because the roadway was constructed many years ago under different standards and 98 expectations. At the same time, we should be careful not to confuse doing something with doing something safe. The absence of a sidewalk or dedicated pedestrian facility is a deficiency in the existing roadway. That deficiency does not necessarily mean that converting a portion of the roadway into a pedestrian facility is the appropriate interim solution. In our view, the better approach is to acknowledge that this portion of South Main Street presents a difficult infrastructure problem, note it, and in the longer term, when major road maintenance occurs on that section of South Main Street pursue a solution that provides pedestrians with meaningful separation from moving traffic. Staff Recommendation Staff recommend that the Common Council reconsider its April 27, 2026 action and not proceed with installation of the proposed painted bike lane/delineator configuration. 99 120 East Lakeside Street • Madison, Wisconsin 53715 • 608.255.3988 • 608.255.0814 Fax 247 Freshwater Way, Suite 530 • Milwaukee, Wisconsin 53204 • 414.988.8631 www.vandewalle.com Shaping places, shaping change Scope of Work and Cost Estimate Urban Service Area Amendment The following Scope of Services is designed to prepare and coordinate an Urban Service Area (USA) amendment application to the Capital Area Regional Planning Commission (CARPC) and, ultimately, the Wisconsin Department of Natural Resources (WDNR) on behalf of the City of Verona.
