11. New Business
A. Discussion and Possible Action Re: Short Term Rental Ordinance
Modifications
Attorney Kleinmaier stated if the council wanted to amend the 7-night
minimum they could allow shorter minimums for properties that are the
owner’s primary residence.
Diaz stated that he is in support of a 2–3-night minimum stays as long as the
owner of the property has someone local that manages the property. He also
stated that if short-term rental operators aren’t registering with the city, there
should be significant fines. He would also like to see a chronic nuisance
element incorporated into the ordinance.
Weiss stated he would be in favor of eliminating a minimum night stay.
Helmke stated that there is a house in District 4 that generates a lot of
complaints and the neighbors support the 7-night minimum.
There was discussion regarding licensing being contingent upon complaints,
citations, and convictions.
Tucker Long stated she would like to see a requirement that the operator live
within a 20-mile radius of City Hall and not have more than 3 convictions for
the previous calendar year.
The alders agreed that they want to move forward with a split system. There
was a mix of suggestions for no minimum to 2-night minimum for the “plus”
licenses. They would also like staff to incorporate a chronic nuisance
element of the license requirements. They would like to see a 20-mile radius
for operators whose rental is not their primary residence.
B. Discussion and Possible Action Re: Addendum to Lease Agreement (The Art
House 360, Inc.)

MEMORANDUM
To: Mayor and Common Council, City of Verona
From: Jamie J. Aulik, City Administrator
Date: August 5, 2026
Re: Summary of Agenda Items – August 10, 2026, City Council Meeting
Below is a summary of items on the agenda for the upcoming Council meeting:
Finance Committee:
• Discussion and Possible Action Re: Claim (Coleen Rupnow)
o Potential motion: Move to deny the Claim (Coleen Rupnow)
o Coleen Rupnow submitted a claim seeking $1,000 for water damage to
her home at 1248 Enterprise Drive, which allegedly occurred on or
about June 27, 2026. The claim was submitted on July 28, 2026. The
City’s insurance carrier, CVMIC, recommends denial of the claim.
o Under Wisconsin law, municipalities are generally not liable absent a
known and compelling danger requiring a specific, non-discretionary
response. In this case, the increased water pressure experienced at the
property resulted from its transition from the Central Pressure Zone to
the Northern Pressure Zone, where pressures average approximately 80
psi. The water pressure remains within the 35 to 100 psi operating
range required by Wisconsin Administrative Code and DNR standards.
Because the water system was operating within applicable regulatory
standards, CVMIC concluded there is no basis for municipal liability.
o Staff concurs with CVMIC’s recommendation and recommends denial
of the claim.
• Discussion and Possible Action Re: Claim (Angie Simon)
o Potential motion: Move to deny the Claim (Angie Simon)

o The Plan Commission voted 4-0 to recommend that the Common
Council approve the final plat for the second addition to the Ardent
Glen subdivision to create eighty (80) single-family and twin home
parcels and five (5) outlots.
• Discussion and Possible Action Re: Resolution No. 26-027 for a certified
survey map to create two (2) lots located at 2000 Range Trail in the Town of
Verona
o Potential motion: Move to approve Resolution No. 26-027 for a
certified survey map to create two (2) lots located at 2000 Range Trail
in the Town of Verona with the condition listed in the packet.
o The Plan Commission reviewed the certified survey map on August 3,
2026. Lucas Sivertsen explained that the City cannot comment on
zoning and land use. The City has requested additional right-of-way
dedication for Range Trail, which the applicant has agreed to dedicate.
The Plan Commission voted 3-0 with Mayor Diaz abstaining to
recommend that the Common Council approve a certified survey map
to create two (2) lots from the existing one (1) lot located at 2000
Range Trail with the following condition:
▪ The certified survey map shall be modified for additional right-
of-way dedication for roadway improvements to Range Trail if
ever needed.

• Discussion and Possible Action Re: Resolution No. 26-028 Naming Private
Roads for 911 Purposes at 1979 Milky Way
21
o Potential motion: Move to approve Resolution No. 26-028 Naming
Private Roads for 911 Purposes at 1979 Milky Way
o The proposed resolution designates four private road names at 1979
Milky Way to support emergency response and property identification
in accordance with Section 14-1-70(u) of the City of Verona
Ordinances. The road names, as shown on the attached map, are Annex
Drive, Staff Park F, Staff Park G, and K Dock Road. Adoption of the
resolution will officially assign these names for 911 addressing and
emergency service purposes.
• Discussion and Possible Action Re: Resolution No. 26-029 Renaming a
Portion of Country View Road to Epic Lane
o Potential motion: Move to approve Resolution No. 26-029 Renaming a
Portion of Country View Road to Epic Lane
o As part of the addition and reconfiguration of roadways on the west
side of the Epic campus, staff is recommending that the portion of
Country View Road identified on the attached map be renamed Epic
Lane. The proposed street name change is authorized under Section 14-
1-70(u)(9) of the City of Verona Ordinances. Adoption of the
resolution will officially rename the roadway to reflect the updated
street network.
• Discussion and Possible Action Re: Short-Term Rental License Application
from Michelle & Christopher Turner located at 136 Paoli St.
o Potential motion:
o The short-term rental is advertised through Airbnb and VRBO as “Paoli
Place” and operated by Michelle Turner. They have a current license
through Dane County and are current on their inspections. The most
recent inspection for this rental was from July of 2023. The operator
has signed the application and acknowledged the City’s short-term
regulations must be followed. The short-term rental operations began
in 2023.
o There are no known City of Verona code violations or complaints on
file for this property since 2020.
• Discussion and Possible Action Re: Short-Term Rental License Application
from Bucky Properties LLC located at 361 Steeple Point Way
o Potential motion:
o The short-term rental is advertised through Airbnb and VRBO as
“Bucky Properties” and operated by Bucky Properties LLC. They have a
current license through Dane County and are current on their
22
inspections. The most recent inspection for this rental was from April
of 2024. The operator has signed the application and acknowledged the

for this property including neighbor disturbances and trash collection.
• Discussion and Possible Action Re: Short-Term Rental License Application
from Chandraban Bajoon located at 266 Canterbury Pass
o Potential motion:
o The short-term rental is advertised through Airbnb as “Spacious
Basement Apartment Near Epic and Madison” and is operated by
Chandraban Bajoon. The operator has a current license through Dane
County and is current on their inspections. The most recent inspection
for this rental was from December of 2024. The operator has signed the
application and acknowledged the City’s short-term regulations must
be followed.
o There are two City of Verona code violations or complaints on file for
this property. One from 2022 for a neighbor disturbance and one in
2024 for a complaint regarding short term rental operation.

• Discussion and Possible Action Re: Additional design costs for JT Engineering
to develop final plans for the Military Ridge State Trail paving project –
Project 2022-107.
o Potential motion: Move to approve the JT Engineering contract
amendment #1 to the Military Ridge State Trail paving project for
additional design costs not to exceed $42,895.
o Additional design costs for plan modifications and project scope
changes, including wetland delineation along the corridor, that were
identified during initial review/preliminary design. MSA performed
the wetland delineation as part of their contract for the bridge designs.
JT Engineering will subcontract the remaining wetland delineation
work to MSA for the other portions of the trail corridor.
• Discussion and Possible Action Re: Construction Inspection Services Contract
with Behnke Materials Engineering, LLC for quality assurance oversight of the
prestressed concrete girders for the Hyper Drive bridge project (Epic)
o Potential motion: Move to approve the inspection services contract
with Behnke Materials Engineering, LLC for a cost not to exceed
$74,594.04.
23
o This contract is for quality assurance oversight, fabrication inspection,
and reporting services associated with the fabrication of 126 prestressed
concrete girders for the new Hyper Drive bridge across the Sugar River.
The inspection will occur at the manufacturing facility in Janesville,
WI. Staff recommend contracting construction inspection services with
Behnke Materials Engineering, LLC. Behnke Materials Engineering,
LLC has extensive experience providing oversight of prestressed
concrete fabrication throughout Wisconsin, including at the Janesville
facility for more than thirteen years. All fees associated with inspection
services are the responsibility of the developer (Epic).
o Staff recommend approval.
New Business:
• Discussion and Possible Action Re: Petition for Detachment (Mark and Renee
Geller)
o Potential motion: Move to approve Petition for Detachment (Mark and
Renee Geller)
o As part of a road project redirecting Country View Road and
establishment of a cul-de-sac to serve homeowners, the City has
received a petition requesting the detachment of approximately 0.42
acres of property from the City of Verona to the Town of Verona
pursuant to Wis. Stat. § 66.0227. The property is located along Country
View Road, is contiguous to the Town of Verona, and is owned by
Mark and Renee Geller who are the sole owners of all taxable land
within the proposed detachment area, which has no electors residing
within the territory identified for detachment. The petition satisfies the
statutory filing requirements, including publication of the required
notice of intent.
• Discussion and Possible Action Re: Ordinance No. 26-1110 - An Ordinance
Amending Title 7, Chapter 15, Relating to the Regulation and Licensing of
Short-Term Rentals
o Potential motion: Move to approve Ordinance No. 26-1110 - An
Ordinance Amending Title 7, Chapter 15, Relating to the Regulation
and Licensing of Short-Term Rentals
o The proposed ordinance amends the City’s short-term rental
regulations to create a limited exception to the existing requirement
that all rentals be for a minimum of seven consecutive days. Under the
amendment, rentals of fewer than seven days would be permitted if:
24
▪ The property owner’s primary residence is located within 25
miles of the rental property, and;
▪ The property has received no more than three City ordinance
citations during the preceding 12 months.
o Owners seeking to qualify for the exception must provide
documentation demonstrating compliance with these requirements.
The ordinance also updates the licensing and advertising provisions to
reflect the new exception while retaining the existing seven-day
minimum for properties that do not qualify.
• Discussion and Possible Action Re: Early Access Fill Storage Agreement
(Cascade Development LLC / 2159 Range Trail)
o Potential motion: Move to approve Early Access Fill Storage
Agreement (Cascade Development LLC / 2159 Range Trail)
o The proposed agreement authorizes Cascade Development LLC to
access the City’s property at 2159 Range Trail prior to closing on the
property’s purchase to store approximately 50,000 cubic yards of clean
fill excavated from the Avalon Ridge development. The fill will
ultimately be used in the development of the property being purchased
by Cascade.
o The agreement limits access to fill storage activities only, requires City
approval of storage locations to ensure operations do not interfere with
the City’s salt storage facility, and terminates upon closing of the
property sale or termination of the purchase agreement.
o Cascade is responsible for all costs associated with the work and must
indemnify the City, maintain required insurance, keep the property
free of liens, and comply with the agreement's other terms and
conditions.
• Discussion and Possible Action Re: Ardent Glen Development Agreement -
Phase 6
o Potential motion: Move to approve Ardent Glen Development
Agreement - Phase 6
o The proposed Development Agreement authorizes Phase 6 of the
Ardent Glen subdivision, consisting of 41 residential lots and four
outlots, and incorporates Phase 6 into the existing Ardent Glen
development agreements. The agreement establishes the developer’s
responsibilities for constructing the required public improvements,
with construction anticipated to begin in August 2026 and be
substantially completed by November 2026, subject to City approval. It
25
also identifies the estimated Phase 6 fees, and it requires the developer
to provide a $2,161,000 financial guarantee to secure completion of the
public improvements. The agreement further provides that no
occupancy permits for Phase 6 will be issued until required public
improvements from the earlier phases have been completed or
appropriately guaranteed.
• Discussion and Possible Action Re: Second Amendment to Ardent Glen
Development Agreements
o Potential motion: Move to approve Second Amendment to Ardent
Glen Development Agreements
o The proposed Second Amendment updates the existing Ardent Glen
Development Agreements to reflect revisions related to the
subdivision’s phasing, public improvements, and developer
obligations.
▪ Specifically, the amendment requires completion of the Shady
Oak Lane water main loop by the earlier of:
• issuance of occupancy permits for 170 single-family and
twin home units
• extension of utilities east of Outlot 15, or
• July 31, 2028.
▪ It also revises the water main recapture provisions to establish
how the developer may be reimbursed for eligible construction
costs from future benefitted properties, subject to applicable
law.
▪ In addition, the amendment confirms that Phase 6 will precede
Phase 5, requires the developer to complete Shady Oak Lane
street improvements upon completion of the water main
improvements, and updates the total park fee and park
improvement fee calculations to account for the addition of 19
residential units to the development. All other terms of the
existing development agreements remain unchanged.
• Discussion and Possible Action Re: Request for tax incremental financing
(TIF) through a Municipal Revenue Obligation (MRO) (Livesey Co.)
o Potential motion:
o Staff are seeking feedback from the Common Council related to a
request by Livesey Co. for Tax Incremental Finance (TIF) assistance in
the form of a Municipal Revenue Obligation (MRO) related to a
potential expansion of Arrowhead Pharmaceuticals.
26
o The Council may convene into closed session to discuss the terms and
conditions of a MRO.

Re: Claims Against the City – Coleen Rupnow
Members of the Finance Committee:
• Discussion and Possible Action Re: Claim (Coleen Rupnow)
o Potential motion: Move to deny claim from Coleen Rupnow.
▪ Coleen Rupnow submitted a claim for water damage to her home and
associated damages in the amount of $1,000. The water damage
occurred on or about June 27, 2026, at1248 Enterprise Drive. The claim
was submitted on July 28, 2026. CVMIC, the City’s insurance carrier
recommended denying the claim for two reasons:
▪ Under Wisconsin law, a municipality does not face liability unless
there is a “known danger” that is compelling enough to warrant
specific, non-discretionary action by the municipality. Lodl v.
Progressive Northern Insurance Co., 2002 WI 71, 253 Wis. 2d 323, 646
N.W.2d 314. Wisconsin courts have developed a three-step test to
determine whether the known and compelling danger exception
applies in a given case: (1) whether something happened to create a
compelling danger; (2) whether a government actor “[found] out about
the danger, making it a known and compelling danger”; and (3)
whether the government actor addressed the danger by taking one or
more precautionary measures or instead “[did] nothing and let the
danger continue.” Heuser v. Community Ins. Corp., 2009 WI App 151,
¶¶27-28, 321 Wis.2d 729, 774 N.W.2d 653
▪ In this case, the water damage claim is being denied because the change
in water pressure experienced at the property was within the normal
28
and allowable operating range established by Wisconsin regulations.
The home was originally located in the Central Pressure Zone, where
water pressure was approximately 35 to 40 psi, and was subsequently
moved to the Northern Pressure Zone, where water pressure averages
approximately 80 psi. Wisconsin Administrative Code NR 810.13 and
Wisconsin Department of Natural Resources (DNR) standards require
municipalities to maintain distribution system pressures between 35
psi and 100 psi during peak demand conditions. The pressure at this
property remains well within those regulatory limits. In addition, the
increased pressure provides benefits including improved water quality,
more reliable system performance, and enhanced fire flow capabilities.
Because the water pressure delivered to the property is operating
within the range required and permitted by state regulations, the
increase in pressure does not constitute negligence or a defect in the
municipal water system and is not a basis for liability for the reported
water damage.
▪ Based on the recommendation of the City’s insurance carrier, staff
recommend denial of the claim.

Site and Operations:
Applicant has submitted a request to utilize approximately 11,922 square feet of a
26,400 square foot flexible industrial building for five (5) pickleball courts (“Application”)
located at 1162 Laser Street in the Liberty Business Park (“Property”) as depicted in
Figure 1. The Property is zoned Suburban Industrial (SI). The Applicant is expecting to
operate daily from 5:30 a.m. to 11:30 p.m., which may be adjusted over time. There will
be two (2) to four (4) employees that will visit the Property for cleaning, management,
and operational oversight. Per the Applicant’s narrative, “During typical operations,
occupancy is expected to range between 10 and 20 patrons. During periods of peak
activity, occupancy is anticipated to be approximately 30 to 40 patrons, including players
and individuals waiting between reservations. The waiting area primarily supports normal
facility operations by providing seating for players before and after scheduled
reservations”.
The Property currently contains two (2) businesses. Suite 102 consists of Play Zone/Play
Café and uses approximately 3,360 square feet. The second occupant is located in
Suites 110 – 112 by Perlisten Audio and uses approximately 11,280 square feet.
Background:
In April of 2024, the Plan Commission reviewed and approved a site plan for a 26,400
square foot flexible industrial building with the following conditions that were met:
a. Prior to the issuance of building permits, the Applicant shall enter into a
development agreement with the City for the future public improvements for Laser
Street.
b. The Applicant shall replace the proposed EIFS with concrete stucco.
c. The Applicant shall replace the proposed metal on the rear of the building with a
material used on the other three elevations.
Southeast Neighborhood Plan:
The Property is located in the Southeast Neighborhood Plan (“Plan”), which was adopted
in 2010. The Property is shown on the land use map as non-residential and is discussed
on page 15 of the Plan.
“Non-Residential Land Uses:
Non-residential land-uses within the ‘Southeast Neighborhood’ will be
located closest to the intersection of two county trunk highways with access
to a limited-access U.S. highway. As explained within the City’s
comprehensive plan—the City plans to take logical advantage of the
locational benefits provided by the interchange between County Highway’s
‘M’ and ‘PB’ and U.S. Highway 18-151 for non-residential land-uses in this
area. The City has already created a tax increment finance district in this
area (Tax Increment District No. 6) as part of the community’s effort to
promote non-residential development in this area.
44
1162 Laser Street, Suites 104 – 108

3
Planned non-residential land-uses in this area include a mix of commercial
uses closest to the intersection of ‘M’ and ‘PB’ and office, business-park,
research, educational, light-industrial, and corporate campus uses further
from this intersection. The City has taken great efforts to limit the amount of
land that will be utilized for retail development in this area and has allowed
only about 80 acres (closest to the intersection of CTH ‘M’ and ‘PB’…) to
be zoned for retail development. The City has taken great efforts to limit the
amount of retail zoning in this area to reinforce the City’s goal to continue
to concentrate the bulk of retail land-uses within our downtown area and
along Verona Avenue—as explained in greater detail within Chapter 8—
Land Use—of our comprehensive plan. The City of Verona plans to keep
the downtown area the retail and service center of the community. While
the downtown is the priority area for future retail development—the City
also plans to take logical advantage of the intersection of two County Trunk
Highways—‘M’ and ‘PB’—within the Southeast Neighborhood to
accommodate some retail development outside of the downtown. This
limited amount of retail development will also enhance the City’s effort to
promote employment and job-creation opportunities within the Southeast
Neighborhood by creating the amenities and services that are necessary in
close proximity to a major employment center.
See the ‘Southeast Commercial’ and the ‘Southeast Business Park’ Sub-
Area Plans below for additional information about planned non-residential
development within the ‘Southeast Neighborhood’.”
The Applicant is proposing an indoor pickleball court, which is located inside a flexible
industrial building. The land use matches the Plan’s desire for non-residential land use in
this area. The Zoning Ordinance supports the Plan’s need to maintain commercial
development in the center of the City as retail and restaurants are not allowed in the
industrial zoning districts. Tax Incremental District (TID) 6 is no longer active and was
able to promote development in this area as intended by the Plan.
“Southeast Business Park Sub-Area (North and South of CTH ‘M’)
• The City plans to utilize this area for creating jobs and employment
opportunities for Verona residents with office, corporate headquarter,
light manufacturing, warehousing, educational, and similar business
park-type developments;” (Plan, p. 20).
The proposed use is generally consistent with the Southeast Neighborhood Plan as it is
non-residential land use.
Draft Comprehensive Plan:
The Comprehensive Plan is underway and is being finalized. The Comprehensive Plan
designated this Property as mix – industrial or commercial land use.
“Mix – Industrial or Commercial

4
The Industrial and Commercial district supports a mix of employment-
oriented land uses, including light industrial, office, and commercial
activities. This district seeks to promote uses that can coexist with flexible
development framework, designed to accommodate both standalone
enterprises and multi-tenant developments that support Verona’s
economic base” (p. 66).
“Businesses to Attract Residents & Visitors. Creating a designation
where people want to live, shop, and spend time relies on a local economy
that attracts both residents and visitors. Supporting a vibrant mix of
business throughout the city – including retail, dining, services, and
entertainment – will help position Verona as a top destination. Targeting
efforts into key areas that will attract new businesses and support existing
businesses will help connect residents, visitors, and the local economy” (p.
100).
The Applicant proposes an entertainment facility to be used for members only pickleball.
The proposal supports the Comprehensive Plan as it is commercial activity in a multi-
tenant building.
Planning Review:
The existing building continues to meet all of the setback requirements for the SI zoning
district as well as the height requirements. The building design and landscaping will not
change.
Parking:
Access to the site will continue from Laser Street. Table 1 contains the minimum
required parking spaces per the amended parking ordinance as well as for each tenant.
The parking standards for an indoor fitness facility were recently amended to require 1/3
People at Maximum Capacity; or 1/each player + 1/employee; + 1/3 people per class;
+1/3 people per tournament for a minimum parking requirement. The pickleball facility
will have five (5) indoor courts allowing twenty (20) players to play. To support the
business, there will be four (4) employees. On a daily basis, there would be
approximately twenty-four (24) people in the building with others arriving or leaving. Peak
periods are anticipated to have approximately thirty (30) to forty (40) people waiting
between reservations. The existing parking lot has seventy-four (74) parking stalls, which
include two (2) electric vehicle charging stalls and handicapped stalls. Bicycle parking is
also provided along the front of the building.
Business Minimum Required Parking Spaces
Play Zone/Play Café (Suite 102) 23 spaces
Vacant (Suites 104 - 108) 24 spaces (normal operation)
40 spaces (peak operation)
60 spaces (tournaments)
Perilisten Audio (Suites 110 - 114) 8 spaces

Conditional Use Permit
5
Business Minimum Required Parking Spaces
Total Required Parking Spaces 55 spaces (normal operations)
71 spaces (peak operation)
91 spaces (tournaments)
Total Provided Parking Spaces 74 spaces
There are enough parking spaces for the normal operations of a pickleball facility to meet
the recently amended parking ordinance with some additional parking stalls to help with
overflow from these businesses. During peak operations, there will not be any additional
parking stalls for each business to use as all will be taken if the peak demand is during
business hours for the other businesses. If the facility has a pickleball tournament, the
business would be short of approximately seventeen (17) parking stalls. When the site
plan was before the Plan Commission in April of 2024, the Plan Commission had
concerns about parking and the tenant mix; however, this building was part of a phased
development with this being the first phase and the second phase was for an office
building. If the second phase is built as an office building, Staff recommends a shared
parking agreement for people to utilize their parking lot solely for tournaments as this is
the best option to reduce on-street parking. If the development is not an office building,
Staff is supportive of people using on-street parking solely for infrequent tournaments as
these would be special cases instead of the norm. Staff anticipate more traffic (trucks) on
Laser Street in the future due to potential industrial development occurring to the east,
which could hinder on-street parking due to truck turning radius.
Conditional Use Permit Findings:
The Applicant is requesting a conditional use permit approval for indoor commercial
entertainment land use, which is a conditional use in the Suburban Industrial district. The
Zoning Ordinance requires all conditional uses to fulfill general standards and specific
standards for all conditional use permit requests (Sec. 13-1-363).
a. How is the proposed conditional use (in its spec ific location) in harmony with
the purposes, goals, objectives, policies and standards of the City of Verona
Comprehensive Plan, this Chapter, and any other plan, program, or Chapter
adopted, or under consideration pursuant to official notice by the City?
The location of the proposed use is in harmony with the goals and policies of the City in
the specific location proposed.
b. Does the proposed conditional use, in its proposed location and as depicted
on the required site plan [see Subsection (c)(4), above], result in a substantial
or undue adverse impact on nearby property, the character of the
neighborhood, environmental factors, traffic factors, parking, public
improvements, public property or rights -of-way, or other matters affecting the
public health, safety, or general welfare, either as they now exist or as they
may in the future be developed as a result of the implementation of the
provisions of this Chapter, the Comprehensive Plan, or any other plan,
program, map, or Chapter adopted or under consideration pursuant to official

6
notice by the City or other governmental agency having jurisdiction to guide
development?
The proposed use has sufficient parking available on the Property for daily operation;
however, there is insufficient parking if there is a tournament based on the amended
Zoning Ordinance. The Applicant would be short by seventeen (17) parking stalls,
which could be accommodated through a shared parking agreement with the
neighboring properties or on- street parking as this is not the norm. Another creative
way to have a couple of additional parking stalls is to create additional parking
spaces for employees in the loading dock area for this business and potentially the
other businesses if they are supportive of this idea for tournaments only. There are
no adverse impacts on adjoining properties or the environment for normal business
operations.
c. Does the proposed conditional use maintain the desired consistency of land
uses, land use intensities, and land use impacts as related to the environs of
the subject property?
The proposed conditional use maintains the desired consistency of land uses, land use
intensities, and land use as the area is designated as industrial land uses.
d. Is the proposed conditional use located in an area that will be adequately
served by, and will not impose an undue burden on, any of the improvements,
facilities, utilities or services provided by public agencies serving the subject
property?
The Applicant will utilize an existing building and existing utilities. This use will not
impose an undue burden on these facilities or services.
e. Do the potential public benefits of the proposed conditional use outweigh any
and all potential adverse impacts of the proposed conditional use (as
identified in Subsections (d)(2)a—e above), after taking into consideration the
Applicant's proposal and any requirements recommended by the Applicant to
ameliorate such impacts?
The benefits of the proposed use outweigh any adverse impacts in the neighborhood.
Specific Fitness Facility and Entertainment Use Standards:
The Plan Commission as part of their review shall take into account the following per
Section 13-1-127 in the Zoning Ordinance:
(b): Fitness Facility/Entertainment Facility Indoor, 10,000 – 49,999 square feet
(1) Façades greater than one hundred (100) feet in length, measured horizontally,
shall incorporate surface articulation every twenty-five (25) feet.
(2) Ground floor facades that face public streets shall have arcades, clear glass
display windows, entry areas, awnings, or other such features along no less
than sixty (60) percent of their horizontal length.

7
(3) Curb cuts and site vehicular access shall be minimized in frequency and width
and shall not dominate the site plan or property and street frontage.
(4) Service areas, dumpsters, utilities, and the required screening thereof shall be
designed and located to minimize visibility from public rights-of-way.
(5) Pedestrian access shall be provided to the building entries and parking areas
connecting to the sidewalk at the street frontage.
(6) Exterior building materials shall be time- and weather-tested materials and
techniques such as but not limited to masonry, stone veneer systems, stucco,
precast panels with inlaid or stamped brick texture.
(7) If a facility has courts or fields, the parking requirements will be based on the
total number of players on each court or field plus employees and additional
parking for classes if offered as well as for spectators.
(8) A drop-off area must be designed on the site.
(9) A joint parking agreement for all tenants must be provided to the City and
recorded with Dane County Register of Deeds.
Typically, the Plan Commission reviews the specific use standards to drive the overall
design of the building for a particular land use. In this instance, the building was already
built without any known tenants at that time. The builder has met items 3 through 6 as
part of the site plan review. Items 1 and 8 are not met for fitness land use as the building
was reviewed and designed for industrial land use, which does not have this building
design standard. The Applicant does not need to redesign the exterior of the existing
building to meet these requirements. The Applicant should consider a drop-off area if
there will be classes offered to large amounts of children. Item 2 is met as the Applicant
is using three (3) tenant spaces for their business, which has windows and awning. Staff
reminds the Applicant to maintain item 2 as clear glass display windows for the building.
Item 7 is met for the peak occupancy without tournaments. If additional parking is
provided or a joint parking agreement is executed which provides additional parking the
Applicant would be allowed a tournament with twenty (20) spectators.
Recommendation:
Staff recommends the Plan Commission recommend that the Common Council approve
the conditional use permit to allow an indoor fitness facility greater than 10,000 square
feet and less than 49,999 square feet for pickleball located at 1162 Laser Street, Suites
104 – 108 with the following conditions:
1. The tenants of 1162 Laser Street shall enter into a shared parking agreement.

RE: 1162 Laser Street #104-108 Conditional Use Permit
Madtown Pickleball Club, LLC.
City staff and Commission members,
On behalf of Madtown Pickleball Club, we are requesting a Conditional Use Permit be granted
for an 11,922 square foot pickleball facility to be located within the existing multi-tenant building
located at 1162 Laser Street. The existing 26,400 square foot building is within the Suburban
Industrial (SI) Zoning district. The proposed pickleball facility is classified as a Fitness Facility
and Entertainment use, greater than 10,000 square feet as a conditional use.
Madtown Pickleball is a privately operated indoor pickleball facility offering year-round court
rentals, memberships, recurring group reservations, open play, clinics, and instructional
programming. The facility is designed to accommodate players of all skill levels and primarily
serves residents of Verona, Madison, and the surrounding Dane County area.
Operations follow a hybrid participation model in which customers may reserve courts either as
members or as pay-as-you-go guests. Membership is not required to use the facility. Walk-in
participation is limited, as court use is primarily reservation-based. Reservations are scheduled
in advance, resulting in predictable customer arrivals and departures throughout the day rather
than large event-based gatherings. The business is intended to provide a convenient, safe, and
professionally managed recreational facility for individuals, families, and organized groups.
Hours of Operation
The facility is expected to operate daily from 5:30 a.m. to 11:30 p.m. Hours may be adjusted
modestly over time based on customer demand and operational experience.
Security and Facility Access
Customer access is managed through a technology-enabled, primarily self-service operating
model. Building access is managed through secure electronic access that is integrated with the
facility’s reservation system. Building access is limited to customers with active reservations
during designated operating hours. Each reservation requires customer identification and
acceptance of an electronic liability waiver prior to facility access.
The building will utilize controlled electronic access, security cameras throughout the facility,
and remote monitoring of building systems, including security, lighting, and HVAC controls.
Emergency contact information will be prominently displayed within the facility, and ownership
will remain available by telephone during operating hours. Emergency responders will retain
appropriate building access in accordance with applicable codes and local regulations.

Employees
The business is expected to operate with approximately 2–4 employees, primarily in
management, customer service, facility maintenance, and programming roles. Employees will
not be continuously present during operating hours; however, staff will routinely visit the facility
for customer support, maintenance, cleaning, programming, and general operational oversight.
Occupancy
The building includes five indoor pickleball courts along with a small lobby and waiting area.
During typical operations, occupancy is expected to range between 10 and 20 patrons. During
periods of peak activity, occupancy is anticipated to be approximately 30 to 40 patrons,
including players and individuals waiting between reservations. The waiting area primarily
supports normal facility operations by providing seating for players before and after scheduled
reservations. We have reviewed the floor plan with Building Inspection and agree that a reduced
occupancy is justified.
Parking
There are currently 74 off-street parking stalls on the property, including two accessible stalls.
Per the zoning ordinance, parking needs per event type are:
General Play: 20 players + 4 employees = 24 stalls
Class/instruction: 16 players + 1 employee = 17 stalls
Tournament: 40 players + 20 spectators = 60 stalls
The result is an average need of 24 stalls. If a larger event were to take place such as a
tournament, parking would need 60 stalls.
Overall, Madtown Pickleball is intended to provide a safe, professionally managed indoor
recreational facility that meets the growing demand for year-round pickleball. This operating
model promotes predictable customer activity through scheduled reservations, controlled
building access, and modern facility management practices.
Respectfully,
Anthony Suy
Lee Schwartz
Madtown Pickleball Club, LLC.

Re: Public Institutional Zoning Text Amendment
As Staff has reviewed various types of land uses discussed in the draft
Comprehensive Plan, City Staff found that existing places of worship are not allowed
in the zoning district where they are currently located. For example, the downtown is
zoned Central Commercial (CC) and currently prohibits places of worship. This
means that the existing places of worship cannot make improvements to the building
outside of their existing building footprint. Staff propose to add places of worship to
four (4) zoning districts noted in red text that currently have places of worship in
those zoning districts.

Zoning Text Amendment Findings
61
2
A determination is required to ensure that a Zoning Text Amendment is in harmony
with the recommendations of the City of Verona’s Comprehensive Master Plan by
answering the following questions posed in Section 13-1-215 of the Zoning
Ordinance.
a. How does the proposed text amendment further the purposes of this title
and the general article in which the amendment is proposed to be located
as outlined in section 13-1-5?
The proposed text amendment allows places of worship in the Suburban
Commercial (SC), Central Commercial (CC), Neighborhood Office (NO), and
Suburban Office (SO) zoning districts, which are already built in some of these
zoning districts.
b. How does the proposed text amendment further the purposes of the
specific section in which the amendment is proposed to be located?
The proposed text amendment allows places of worship in the SC, CC, NO, and SO
zoning districts, which are already built in some of these zoning districts. This will
allow places of worship to construct additions or have modifications made to the
buildings by right.
c. Which of the following factors has arisen that are not properly addressed
in the current zoning text:
1. The provisions of this chapter should be brought into conformity with
the Comprehensive Plan (if a factor related to the proposed
amendment, note pertinent portions of the Comprehensive Plan);
2. A change has occurred in the land market, or other factors have
arisen which require a new form of development, a new type of land
use, or a new procedure to meet said change(s);
3. New methods of development or providing infrastructure make it
necessary to alter this chapter to meet these new factors;
4. If the proposed text amendment is concerned with the provisions of
articles C and/or D: How does the proposed amendment maintain the
desired overall consistency of land uses, land use intensities, and
land use impacts within the pertinent zoning districts?
Allowing this type of land use in the SC, CC, NO, and SO zoning districts may allow
places of worship on a piece of property in these zoning districts to make
improvements to the structure on the property. In 2021, the Zoning Ordinance was
overhauled, and the revision did not include places of worship in the proposed
zoning districts causing the existing places of worship to be grandfathered, which
62
3
means that these uses could not have any work done outside of the existing
footprint.
Recommendation:
Staff recommends the Plan Commission recommend the Common Council approve
the zoning text amendment for Section 13-1-105(d) – Use Matrix to allow places of
worship.

Planning Review:
Lots:
The Applicant is proposing eighty (80)
single-family and twin home parcels with a
Mixed Residential (MR) zoning district
designation and five (5) outlots with a
Public Institutional (PI) zoning district
designation. The smallest lot will be 3,084
square feet while the largest lot will be
7,834 square feet.
Connectivity:
The Applicant is proposing to extend Eagle
Eye Street. The Applicant will begin
construction of Spring Garden Street that
will create an east-west connection
towards Shady Oak Lane in the future.
Other roadways and alleys will be
constructed as part of this plat. Staff have
no concerns with the road configuration.
Outlots:
The Applicant is proposing one (1) outlot
for parkland and one (1) outlot to be used
for future development as part of a future
phased final plat. Any park design would
require approval from the Park Board as
well as park fees. The remaining three (3)
outlots contain private alleys and private open space. The private alleys will allow

5
access to garages from the rear of the home. These private alleys are labeled as fire
lanes as this allows the City to tow vehicles if the vehicles are parked in the alley.
Recommendation:
Staff recommend the Plan Commission recommend that the Common Council approve
the Final Plat for the Second Addition to Ardent Glen to create eighty (80) single-family
and twin home parcels and five (5) outlots.

CSM Review:
The Applicant is proposing a certified survey map (CSM) to split one (1) lot into two (2)
lots located at 2000 Range Trail (“Property”) in the Town of Verona. The lot division was
recently reviewed by the Joint Planning Committee, which was a committee created by
the City and Town Boundary Agreement. The request was denied, in part because it
was inconsistent with the standards of review outlined in the Boundary Agreement.
Since that review, the Boundary Agreement has expired and now the City will review it
as part of the extraterritorial jurisdictional review. Extraterritorial platting authority is a
state statute that provides Cities and Village’s the authority to review land divisions that
are within a mile and a half (1 ½ mile) radius around those municipalities. While the land
is within the Town of Verona, the Property is within the City’s extraterritorial platting
jurisdiction.
The Property is a total of 23.2 acres and zoned Rural Residential (RR-16) in the Town
of Verona, which allows one (1) single family home per sixteen (16) acres. The Property
is subject to Dane County Zoning regulations. While the City has extraterritorial plat
authority it does not have extraterritorial zoning authority. The Applicant is requesting a
zoning map amendment through Dane County to change the zoning from RR-16 to RR-
8, which would allow one (1) single family home per eight (8) acres.
Lot 1 will consist of approximately 9.54 acres with a new driveway accessing Range
Trail. The access is required from Range Trail per a deed restriction.
Lot 2 will consist of approximately 13.65 acres with an existing single-family home and
existing driveway. This lot also contains steep, wooded slopes due to the terminal
moraine.
The northern property line of Lot 1 abuts the Woods at Cathedral Point. The 2009 City
of Verona Comprehensive Plan was silent regarding land use for this area of the City
and Town of Verona. The draft City of Verona Comprehensive Plan shows this area as
Housing A (low density), which could consist of single-households, duplexes, triplexes,
and townhomes. The Woods at Cathedral Point was developed to allow water, sewer,
and roadways to be extended to the south to this Property if, or when, it develops.
However, the Property is not annexing into the City and would continue to follow the
Town of Verona development requirements including well and septic.
Since a CSM is being reviewed, the City can request land be dedicated towards right-of-
way. The City recommends the Applicant, as part of this CSM, dedicate additional right-
of-way than what is currently shown on the CSM to match the City’s right-of-way on
Range Trail for a total cross-section of seventy-two (72) feet or thirty-six (36) feet on
one (1) side of the road instead of the shown thirty-three (33) feet. This will allow Range
Trail to have the option of future roadway improvements to include roadway width,
sidewalk, or bicycle lanes if these are ever needed or if the land across from this
Property annexes to the City.

Recommendation:
Staff recommend the Plan Commission recommend that the Common Council approve
the certified survey map to create two (2) lots from the existing one (1) lot located at
2000 Range Trail with the following condition:
1. The certified survey map shall be modified for additional right-of-way dedication
for roadway improvements to Range Trail if ever needed.

2000 Range Trail – Town of Verona, Dane County, Wisconsin
Supporting Documentation for City of Verona CSM Application
Land Resources
Question C
• Does the CSM contain an area of soil instability—greater than 20% slope and/or organic
soils, peats, or mucks at or near the surface?
Yes. Portions of the subject property contain slopes greater than 20%, primarily within the
approximately 13.65-acre wooded terminal moraine area located in the southern and
central portions of the property. The attached Elevation Map – 2000 Range Trail identifies
multiple areas categorized as “20 and greater” slope. The attached USDA NRCS Soil Map
further confirms the presence of steep slope conditions associated with Elkmound sandy
loam soils ranging from 12% to 30% slopes.
The steep slope areas correspond closely with the wooded terminal moraine terrain and are
associated with constrained topographic conditions that limit both development intensity
and agricultural productivity. These areas are largely separate from the proposed 9.54-acre
parcel intended for limited residential use.
The proposed residential parcel is located primarily within the flatter agricultural field area
adjacent to Range Trail and avoids the majority of the steep slope terrain. The presence of
steep slopes further supports the appropriateness of low-intensity development and
preservation of environmentally constrained areas consistent with the City of Verona
planning framework.
No mapped organic soils, peats, or mucks at or near the surface were identified within the
reviewed soil mapping documentation.
Question D
• Does the CSM contain prime agricultural land (Class 1, 2, or 3 soils)?
Portions of the subject property, particularly within the flatter agricultural field area,
contain productive agricultural soils commonly associated with Class 1–3 capability soils.
The attached USDA NRCS Soil Map identifies several silt loam soil types within the
agricultural portion of the property, including Gale silt loam, Basco silt loam, and Troxel silt
loam.
However, a substantial portion of the property consists of steep wooded terminal moraine
terrain containing Elkmound sandy loam soils with slopes ranging from 12% to 30%, which
84
significantly limit agricultural productivity and development potential.
The soil mapping confirms that the property is not uniformly prime agricultural land and
instead contains a combination of flatter agricultural soils in the northern/western field
area and steep, environmentally constrained moraine terrain in the southern and central
portions of the property.
The proposed land division reflects these existing physical conditions by locating the
proposed residential parcel within the historically agricultural portion of the property while
preserving the constrained moraine area.
Question F
• Does the CSM contain unique physical features or wildlife habitat?
Yes. The subject property contains several unique physical and environmental features,
including wooded terminal moraine terrain, steep slopes, mature tree cover, natural
drainage features, and undeveloped open space areas that provide existing wildlife habitat
and environmental value.
The approximately 13.65-acre southern and central portion of the property consists largely
of wooded terminal moraine landscape characterized by steep topography and
environmentally sensitive terrain.
Importantly, the proposed CSM is designed to minimize impacts to these environmental
features by locating the proposed residential parcel primarily within the flatter agricultural
portion of the property, avoiding the majority of steep slope and wooded moraine areas,
preserving substantial open space and existing tree cover, and maintaining the existing low-
intensity land use pattern.
Human and Scientific Interest
Question A
• Does the CSM contain an area or buildings of archaeological, geological, or historical
interest?
Yes. The subject property contains geological features of significance associated with the
terminal moraine landscape present within this portion of Dane County and the greater
Verona area. The approximately 13.65-acre southern and central portion of the property
consists of steep wooded moraine terrain characterized by rolling topography, elevation
changes, and environmentally sensitive landforms that are representative of glacial
geological features.
At this time, no formally identified archaeological sites, historically designated structures,
85
or documented historic landmarks are known to exist within the proposed CSM area based
upon currently reviewed materials.
Question D
• Does the CSM contain old growth trees or significant woodland features?
Yes. The approximately 13.65-acre parcel contains numerous mature and old growth trees
within the wooded terminal moraine portion of the property.
The proposed 9.54-acre parcel, which is intended for limited residential use, is located
primarily within the existing agricultural field area and does not contain old growth trees or
significant woodland disturbance areas.
Importantly, the proposed CSM itself will not result in the removal of old growth trees.
City Planning
Question A
• Is the development consistent with the City Master Plan and other adopted planning
documents?
Yes. The proposed CSM is consistent with the City of Verona Comprehensive Plan and
related adopted planning documents because it represents a low-intensity form of urban
development that responds appropriately to the physical characteristics, environmental
constraints, and existing infrastructure conditions present on the property.
The proposed CSM is also consistent with the Town of Verona Comprehensive Plan and
related adopted Town planning policies. The Town of Verona formally reviewed and
approved the proposed Certified Survey Map, confirming that the land division complies
with applicable Town land use policies, zoning objectives, and rural residential
development standards.
The proposed CSM therefore represents a site-responsive, environmentally sensitive, and
low-intensity development pattern that is consistent with both the City of Verona
Comprehensive Plan and other adopted planning documents while preserving long-term
planning flexibility for future urban growth patterns.
Yes. The approximately 13.65-acre parcel contains numerous mature woodland including red oak,
white oak, and black oak trees.

To: Public Safety and Welfare Committee
From: Lucas Sivertsen, AICP – Director of Planning & Development
Date: August 10, 2026
Re: Short-Term Rental Application Review
The City of Verona enacted an ordinance requiring short-term rentals operating in the
City of Verona to obtain a short-term rental license and to provide requirements for
operating consistent with the Zoning Ordinance.
A list of operators was obtained through Dane County, who licenses tourist rooming
houses within Dane County on behalf of the State of Wisconsin. The County’s response
showed there to be seven short-term rentals with an active license through Dane
County. These operators were mailed a cover letter, application, and copy of the
adopted short-term regulations on April 7, 2026. The City’s administrative intern has
been helpful in following up with the operators through email and phone messages.
The City previously reviewed and approved three license applications in June. Three
additional applications have been received since that time and will be reviewed by the
Public Safety and Welfare Committee on August 10.
Of note, while the intent is for short-term rentals to be inspected by Dane County Health
annually, the County is unable to provide annual inspections, but has verified no
locations have open violations or have obstructed inspections from being performed.
The City’s review of the applications can be found below.
136 Paoli Street
The short-term rental is advertised through Airbnb and VRBO as “Paoli Place” and
operated by Michelle Turner. They have a current license through Dane County and are
current on their inspections. The most recent inspection for this rental was from July of
2023. The operator has signed the application and acknowledged the City’s short-term
regulations must be followed. There are no known City of Verona code violations or
complaints on file for this property since 2020. The short-term rental operations began
in 2023.
361 Steeple Point Way
The short-term rental is advertised through Airbnb and VRBO as “Bucky Properties” and
operated by Bucky Properties LLC. They have a current license through Dane County
and are current on their inspections. The most recent inspection for this rental was from
97
2
April of 2024. The operator has signed the application and acknowledged the City’s
short-term regulations must be followed. There are several City of Verona code
violations or complaints on file for this property including neighbor disturbances and
trash collection.
266 Canterbury Pass
The short-term rental is advertised through Airbnb as “Spacious Basement Apartment
Near Epic and Madison” and is operated by Chandraban Bajoon. The operator has a
current license through Dane County and is current on their inspections. The most
recent inspection for this rental was from December of 2024. The operator has signed
the application and acknowledged the City’s short-term regulations must be followed.
There are two City of Verona code violations or complaints on file for this property. One
from 2022 for a neighbor disturbance and one in 2024 for a complaint regarding short-
term rental operation.

of 126 prestressed concrete girders for Structure B-13-961. The girders are anticipated to be
fabricated at County Prestress in Janesville, Wisconsin.
Based on the information provided to date, the project is anticipated to consist of 126 36W
prestressed concrete girders with spans of approximately 96 feet. The attached estimate has been
prepared using the same actual cost-plus fixed-fee methodology used on Wisconsin Department of
Transportation (WisDOT) contracts.
BME has extensive experience providing oversight of prestressed concrete fabrication throughout
Wisconsin. Bob Bemis, PCI Level III inspector and BME’s lead prestressed girder inspector, has
performed quality assurance oversight at the County Prestress facility in Janesville for more than
thirteen years. During that time, Mr. Bemis has provided fabrication oversight and reporting
services on numerous WisDOT bridge projects involving prestressed concrete girders of similar
size and complexity.
Services anticipated under this proposal include:
• Quality assurance oversight of prestressed girder fabrication and prestressing operations.
• Review of fabrication activities, quality control documentation, and compliance with project
specifications and approved shop drawings.
• Witnessing of concrete placement operations and cylinder compression testing reports as
required.
• Preparation of fabrication reports and coordination with the fabricator, owner, and project
team.
• Pre-shipment inspection, final measurements, and documentation of girder dimensions and
fabrication tolerances to verify compliance with project specifications prior to shipment.
Due to the nature of prestressed concrete girder fabrication, quality assurance oversight requires
regular on-site presence throughout production activities, including prestressing operations,
concrete placement, fabrication verification, and project documentation.
This proposal is based upon the preliminary fabrication schedule provided by County Prestress and
an anticipated production duration of approximately 42 fabrication days of 126 girders. Based
127
upon the anticipated fabrication schedule and scope of services, BME estimates these services at a
not-to-exceed amount of $74,594.04.
As with our WisDOT contracts, the attached estimate is presented as a not-to-exceed amount. BME
will invoice only for actual labor hours and expenses incurred during performance of the work.
Should fabrication schedules, production quantities, or project requirements change significantly,
any adjustment to the estimate fee would be discussed and approved in advance.
The attached fee estimate provides a detailed breakdown of anticipated labor-related costs and
associated services. We appreciate the opportunity to provide these services and look forward to
working with the City of Verona on this project.
Please feel free to contact me with any questions regarding this proposal. We would be happy to
discuss the proposed scope, level of oversight or any project-specific considerations as the city
evaluates this proposal.
Sincerely,
Josh Amundson
Vice President

I. The Phase 1 Agreement, the Phase 2 A greement, the Addendum Agreement, the Phase 3

Agreement, and this Second Amendment all pertain to the developmen t of land in the
Plat of Ardent Glen, recorded with the Dane County Register of Deeds Office on the 29th
day of November, 2023, in Volume 61-098A of Plats, pages 581 to 584, as Document
No. 5936215, located in the City of Verona, Dane County, Wisconsin.
J. The parties acknowledge that they enter into this Amendment for their mutual benefit and
in order to specify certain rights, obligations, conditions and liabilities.
NOW, THEREFORE, for and in consideration of the mutual covenants and agreements
hereinafter set forth, the parties, on behalf of themselves, their heirs, successors and assigns,
agree as follows:
1. Public Water Improvements . Except as specified in this Section 1, the Water Main, as
that term is defined in Article I, Section B.7.(b) of the Phase 1 Agreement, and as referred
to in Section 4.i.(2) of the Annexation Agreement Marty Property executed between the
parties (the “Annexation Agreement”), which Annexation Agreement was recorded with

5802333, has been completed, exc epting the second connection on Shady Oak Lane
which would fulfill the looping requirement referred to in the Phase 1 Agreement and the
Annexation Agreement (the “Shady Oak Lane Water Improvements”) . Pursuant to plans
approved by the City, the Shady Oak Lane Water Improvements shall be completed on or
before the time that 170 single -family residential lots and twin homes have been issued
occupancy permits, or at such time as the Developer extends utilities east of Outlot 15, or
by July 31, 2028, whichever occurs first.
2. Recapture. Section 2.b. in this Second Amendment shall replace, in its entirety, Article I,
Section B.7.b. of the Phase 1 Agreement, and Exhibit B attached hereto and incorporated
herein shall replace, in its entirety Exhibit B attached to the Phase 1 Agreement.
b. The Developer shall construct a 12” water main from the CTH PD /
Northern Lights Road intersection to the entrance to the Subdivision off of
CTH PD and other associated connection points along the route as shown
on the plans prepared by AECOM and paid for by the Developer (for
152
3
purposes of this Section 2.b., the “Water Main”) . This construction also
includes the looping of the 12-inch water transmission line, which shall be
constructed on or before the time that one hundred (1 70) single -family
residential lots and twin homes have been issued occupancy permits. For
avoidance of doubt, the Water Main includes Shady Oak Lane Water

(1) Contingent on the City’s ability under applicabl e law to recapture
the costs of the Water Main, the Developer shall be entitled to
reimbursement of a portion of the sums paid by the Developer to
construct the Water Main from the Benefitted Parcels, as that term
is defined below, that do not include the Developer’s land
(identified as Ardent Glen in Exhibit B). The Developer agrees
and acknowledges that the City’s authority to require owners of
land located outside the Plat that may be served by the Water Main
to pay costs related to the Water Main may b e limited by and is
subject to Wisconsin law. The City and the Developer agree that
the c osts of the Water Main shall include costs associated with
labor, including engineering costs, and materials for the
construction of the Water Main (hereinafter, the “Water Main
Improvement Costs”). The Benefitted Parcels are identified in
Exhibit B attached hereto and incorporated herein. Exhibit B also
includes an estimate of the Water Main Improvement Costs and the
allocation thereof among the Benefitted Parcels.
(2) The City shall, to the fullest extent permitted by applicable law,
collect from a Benefitted Parcel a payment in the amount shown in
Exhibit B (the “Recapture Payment”) as a condition to the City
entering into an Annexation Agreement annexing a Benefitted
Parcel to the City. If the City is not permitted under appliable law
to require that the Recapture Payment be paid as a condition to
annexation, then the City, subject and contingent to Wisconsin law,
shall, at the time of recording of any plat, cert ified survey map, or
issuance of a building permit (for lands for which no plat or
certified survey map was recorded after the execution of this
Agreement and prior to the issuance of the building permit) on any
of the Benefitted Parcels, but excluding lands owned by Developer
or an affiliate of Developer, or lots within the Subdivision
(identified as Ardent Glen in Exhibit B), collect the Recapture
Payment from the Benefitted Parcel in question. The amount of the
Recapture Payment is subject to the provisi ons of paragraph (3),
immediately following this paragraph.
Within 30 days of collecting the Recapture Payment, the City shall
reimburse the Developer with the amount of the Recapture
Payment made by the Benefitted Parcel.
153
4
(3) A calculation of the actual Water Main Improvement Costs (the
“Actual Costs”) shall be made by the City Engineer and certified
by Developer promptly after completion of the work. If the City
Engineer’s calculation of the Actual Costs is disputed, the matter
shall be referred by the parties to a mutually agreed upon, unbiased
civil engineering firm for a final determination, which
determination shall be final and binding on the parties. The
Developer shall not be entitled to recover any interest on the
amount specified above. Until such time as the Actual Costs have
been calculated by the City Engineer and certified by the
Developer, the estimated costs as set forth in Exhibit B shall be
used to calculate the Recapture Payment due from a Benefitted
Parcel, subject to recalculati on after Actual Costs have been
calculated. The parties agree to update Exhibit B with the Actual
Costs once the Actual Costs are determined by this paragraph.
(4) The Developer’s rights to reimbursement under this Section 2.b.
shall not be assigned by the Developer to a third party without the
consent of the City, which consent shall not be unreasonably
withheld.
(5) The City’s obligations and the Developer’s rights under this
Section 2.b. shall terminate 10 years after Segment 1 of the Water
Main has been accepted by the City under th e applicable phasing
agreement and 10 years after Segment 2 of the Water Main has
been accepted by the City under the applicable phasing agreement,
respectively. Exhibit B identifies Segment 1 and Segment 2.
(6) The Developer agrees to indemnify, defend and hold the City
harmless from and against any and all claims, causes of action,
actions, suits, liabilities, damages, costs, expenses and attorney
fees arising out of this Section 2.b. , at the sole expense of the
Developer, including claims arising out of efforts by the City to
enforce the obligations hereof with respect to developments using
the Water Main, and in particular including claims challenging the
validity or enforceability of this Section 2.b. The Developer may
defend any matter covered by this paragraph by an attorney of the
Developer’s choosing, with the consent of the City, which will not
be unreasonably withheld or delayed. In the event of any legal
challenge to the validity or enforceability of this Section 2.b., the
Developer shall bear the risk in the event that such a challenge is
successful.
3. Phasing. The parcel identification numbers for the lots subject to this Second
Amendment are shown on Exhibit A attached hereto and incorporated herein. Further,
154
5
the phasing map for the Subdivision (as that term is defined in the Phase 1 Agreement) is
shown on Exhibit C attached hereto and incorporated herein (the “Phasing Map”).
Concurrent with the execution of this Second Amendment, the parties are execu ting a
phasing agreement for Phase 6 of the Subdivision. The parties agree and acknowledge
that Phase 6, as shown in the Phasing Map, shall occur before Phase 5, and that the next
phase to be developed in the Subdivision shall be Phase 5.
4. Street Improvements . When the Developer completes the Shady Oak Lane Water
Improvements, the Developer shall complete the street improvements on Shady Oak Lane
pursuant to plans approved by the City.
5. Park Fees and Park Improvements Fees . Article II, Section A.4 . of the Phase 1
Agreement, and Section 1 of the First Amendment Agreement, are modified to identify
the amount of Park Fees (as defined in the First Amendment Agreement) and Park
Improvement Fees (as defined in the First Amendment Agreement) in accordance with
the following schedules in order to account for the addition of 19 units to the
Subdivision:
a. Park Fees:
$2,450.00/unit X 19 units = $46,550.00
$380,970.00 + $46,550.00 = $427,520.00
Total Park Fees = $427,520.00
b. Estimated Park Improvement Fees:
Assume 3 bedrooms/unit X $300.00 per bedroom.
$900.00 X 19 = $17,100.00
$365,400.00 + $17,100.00 = $382,500.00
Total Estimated Park Improvement Fees = $382,500.00
The above Total Park Fees and Total Estimated Park Improvement Fees have been
calculated based on all phases of the Ardent Glen Plat, including future phases . Prior to
the execution of this Second Amendment, the Developer has already paid the following
Park Fees and Park Improvement Fees:
Park Fees:
Phase 1 $28,150.50
Phase 2 $27,212.15
Phase 3A $26,273.80
Phase 3B $14,075.25
Phase 4 $27,125.15
155
6
Total $122,836.85
Park Improvement Fees
Total $62,700.00
6. Except as modified herein, the Ardent Glen Development Agreements and the
Annexation Agreement shall be and remain in full force and effect.
