a. Consideration of objection to 2025 Real Estate Tax Assessment from NS Retail
Holdings, LLC for property located at 660 Hometown Circle, Tax Parcel ID #
0608-142-9410-2
Mayor Diaz explained the process for the hearing.
Clerk Licht introduced the case for hearing.
Clerk Licht swore in the agent for the objector, Jaycee Yeadon, 9229
Delegates Row, Suite 375, Indianapolis, IN 46240 and the assessor, Dean
Peters, W6237 Newbert Rd. Appleton, WI 54914.
Assessor Peters stated that the assessment level for 2025 is 93.5%.
The objector began presenting evidence and giving testimony at 6:17 p.m.
Yeadon stated that the property in question is Festival Foods with a square
4
footage of 67,309 and built in 2019. The current assessment is $13,391,200
or around $199 per square foot. Yeadon stated that she has 5 comparable
recent sales within Wisconsin and applied a location adjustment to account
for that. The sale comparables range from $49.70-$118.54 per square foot
after adjustments for market conditions, size, year built, location, and land-
to-building ratio adjustment. The average of comparables is $87.45 and the
median is $102.57 per square foot.
Diaz asked why Yeadon did not do any comparables with Dane County
grocery stores. Yeadon stated there were no recent sales in the area.
Helmke asked if the objector paid taxes on the property in 2024 with a very
similar assessment. Yeadon stated that the owner did pay taxes in 2024. She
stated that they were unable to object last year, but believed the assessment
was excessive then.
Tucker Long asked if any of the properties Yeadon presented were new
builds. Yeadon replied no, the newest building was built in 2012.
Weiss asked where the numbers for the year-built adjustment came from.
Yeadon stated they applied a .5% depreciation per year. Weiss asked how the
.5% was determined. Yeadon stated that appraisers use .5% in standard
practice. Weiss asked if the recent sales demonstrate the correct real estate
market because if you sell a large retail store, the market in the area is
probably not great. Yeadon stated that the market conditions are looking at
when the property was sold, not necessarily the location.
Hoechst stated that the property was purchased in 2023 for $17 million and
the assessment is significantly lower than the purchase price. He asked why
they are objecting to the purchase price. Yeadon stated that they didn’t
necessarily think that the property was not over assessed, but she was not
working with the property owners at the time. She added that the acquisition
in 2023 was a sale-leaseback and not market sale.
Helmke asked if the objector considered any properties in Dane county that
were similar size. Yeadon stated that she looked at the entire state and she
only picked retail properties that were similar sized.
Tucker Long stated that the assessment hasn’t changed much since 2019
when the building was built, so why have they not contested it in 5 years?
5
Yeadon stated she is the agent, and she wasn’t engaged with the property
owner until this year.
Braithwaite asked if the objector compared other Festival Foods
assessments. Yeadon stated $189 per square foot is on the higher range of
the Festival Food locations that she has seen.
The assessor was given the opportunity to ask questions of the objector.
Peters asked where the objector got their square footage of the building from
as his records indicate the building is larger. Yeadon stated she believes the
numbers came from Festival Foods. Peters asked which properties that were
presented were vacant at the time of sale. Yeadon stated that she believed all
the properties were vacant at the time of sale. Peters asked if any of the sales
were under lease at the time of sale. Yeadon stated that they were not.
The assessor began presenting evidence and giving testimony at 6:38 p.m.
Peters stated that the current assessment is $13,391,200. He presented the
measurements that were given in the plans before construction and then
corroborated during fieldwork. He stated that the first floor has 69,235
square feet plus a 2nd floor upper mezzanine with 7,525 square feet of office
space for a total of 76,760 square feet. There are around 3.3 acres of paved
parking lot. Peters stated if you take the total assessed value divided by the
square footage, it equals $174.47 per square foot.
Assessor Peters stated that the building is owned by NS Retail Holdings, not
Festival Foods. Festival Foods built the building in 2019 and sold it in October
2023 on a sale-leaseback for around $17.1 million. He stated that since the
buyer/seller have a relationship going into the sale, it is not an arm’s length
sale. He added because the property is under a triple net lease, things like
consumer spending are not relevant to the assessment. He stated that any
potential buy would be an investment company, not a grocery store since
festival is occupying the building via a long-term lease. Peters explained
capitalization rates. He stated that the capitalization rate for this property is
7%. Peters stated that using the income approach, he applied a $14 per
square foot rental price. Multiplying $14 by the square footage equals
$1,132,210 for potential gross rent. He stated that he subtracted 3% for
potential vacancy and collection loss allowance which is industry standard.
He added that he took off another 8% for the owners’ operating expenses
which resulted in a net income of a little over $1 million. He then multiplied
the capitalization rate of 7% which results in a value indication of
$14,434,000 which is higher than the current assessed value. He used this
6
method because this is how this property would sell because it is currently
under lease.
Peters also presented comparable sales. He stated that the objectors’ sales
were not comparable because they were vacant at the time of sale. Peters
stated that it is appropriate to look at sales throughout Wisconsin. His first
comparable was Pick ‘n Save in Shorewood Hills. He added that it was
smaller than the subject property. It was sold in 2023 for a price that is equal
to $246 per square foot. Peters presented another Pick ‘n Save that was a
leased sale in Mukwonago. It was sold in June 2024 for a price of $187.50 per
square foot. He presented a Festival Foods in Menasha. It sold in 2021 for
$18.4 million. His final comparable was Festival Foods in Sheboygan sold in
2021 for $12.1 million.
The objector was given an opportunity to ask the assessor questions. Yeadon
asked if the Festival Foods comparables were sale-leasebacks. Peters stated
he wasn’t able to confirm if the Menasha sale was a sale-leaseback, but the
Sheboygan sale was not.
Diaz asked why the EV charger was not included as a value item. Peters
stated that he didn’t itemize every item into the assessment. Diaz stated that
he’s heard 2 different figures for square footage. He asked how we reconcile
that as both cannot be correct. Dean stated that his numbers come from
building plans that the city has on file.
Yeadon clarified that she only looked at vacant building sales because she
was looking for the value of the real estate, not the business and the real
estate.
Peters stated that there was a sale of this property for $17 million. He stated
that it is not assessed at the sale price because of the sale leaseback. He
used the income approach and looked at market capitalization rates to
determine the assessment. He stated he was only looking at the income
generated by real estate rental rather than the business activity. He added
that the Department of Revenue advises not comparing this type of sale with
vacant sales.
Yeadon stated that she presented 5 properties that are all similar to the
property in question and she is requesting an assessment value at
$8,777,080 which is $120 per square foot.
7
Peters stated that this is a leaseback property under a triple net lease. He
stated that he presented similar properties including 2 Pick ‘n Save stores
and 2 Festival Foods. He believes his assessment is fair.
The hearing ended at 7:10 p.m. Deliberations began.
Weiss stated that he didn’t believe the evidence submitted by the objector
does not prove that the assessment was incorrect.
Motion by Tucker Long, seconded by Harrison to exercise the Board of
Review’s judgement and discretion, pursuant to Wis. Stat/ 70.47 (9)(a), by a
majority and roll call vote hereby determine that the Assessor’s valuation is
correct. Motion carried on roll call vote 9-0.
Clerk Licht gave the determination form to the objector.
b. Consideration of objection to 2025 Real Estate Tax Assessment from Azura
Verona, LLC for property located at 285 Wildcat Way, Tax Parcel ID # 0608-
211-8660-2
Clerk Licht noted that the agent for this property withdrew their objection.
The Board of Review recessed at 7:14 p.m.
The Board of Review resumed at 7:58 p.m.
13. Adjournment: Motion by Hoechst, seconded Helmke to adjourn at 8:01 p.m. Motion

Subject: Written Notice of Intent to Object assessment
Date: Monday, July 27, 2026 10:20:01 AM
In WI the BOR has the authority to accept an Objection which is after the 48 hour deadline if a
person can show good cause.
I met with Mr. Peters on Thursday July 16, 2026.
We exchanged information.
He indicated
he would give me his opinion by Friday or at least by Monday, which was July 20.
I did not receive
any information from him on Friday or Monday.
Neither did I
receive any
information Tuesday, Wednesday, or Thursday.
I then initiated
a call to Mr. Peters since I was
concerned he might be off on Friday.
He returned my call and indicated that he was busy and
had not gotten to it yet.
I indicated I needed this information.
As a result he did send me an
Amended Assessment.
I signed it and returned it to him.
Had I not initiated the call to him on
Thursday I believe I would not have received the Amended Assessment.
This information can be verified through Mr. Peters.
I had to review the Amended Assesment and decide to object or not.
I decided to object and
went to the City Clerks office on Friday morning July 24 at 11:30 am.
I found the Office
closed not realizing they close at 11: 00 on Fridays.
At
about 8:15 Monday morning I went to see the Clerk and give my intent to object.
Had I
received the Amended Assessment from Mr. Peters earlier as he had indicated I would have
had
plenty of time to submit the objection on time.
WI statues allow the BOR to accept a late Notice of Intent to Object if a person has shown
good cause.
I believe I have done that.
Respectfully submitted,
Bruce A. Roberts
