Zoning Board of Appeals May 21, 2026 Draft Minutes Subject to Approval 1 Minutes City of Monona Zoning Board of Appeals Thursday May 21, 2026 Chair Holmquist called the meeting of the Monona Zoning Board of Appeals to order at 6:03 pm. Present: Alder Holmquist (Chair), Mr. Schweiger, Mr. Davies & Mr. Patton (1st Alternate) Excused: Ms. Piliouras Also Present: Planning Director Douglas Plowman Minutes: A motion by Mr. Davies, seconded by Mr. Patton, to approve the minutes of March 19, 2026 and April 16, 2026 carried with no corrections. Appearances: None. New Business: Public Hearing: Brent Bunker, 5714 Tecumseh Avenue is requesting a variance from Monona Municipal Code of Ordinances Sec. 480-24(d)(4)(d) Shore Yard Setbacks for the purpose of rebuilding and expanding the second-floor rear deck. (Case No. Z-003-2026) Mr. Brent Bunker and Ms. Jamie Bunker presented their variance request. They would like to replace the existing deck due to deterioration. The proposed deck will cantilever out and retain the current footing and stair locations. A 2’ bump-out is necessitated because of the window on the existing home. The request is sized to allow for a functional space for a table and chair. They shared that there will be no impact to the environment, privacy or sight lines. It will preserve the existing yard space, align with surrounding homes and neighborhoods and the Applicants have support from neighbors. There were no other appearances and the public hearing was declared closed. Consideration of Action: Brent Bunker, 5714 Tecumseh Avenue is requesting a variance from Monona Municipal Code of Ordinances Sec. 480-24(d)(4)(d) Shore Yard Setbacks for the purpose of rebuilding and expanding the second-floor rear deck. (Case No. Z-003-2026) Planning Director Plowman gave an overview and explained the reason for the variance. Mr. Schweiger asked the Applicant how feasible it would be to rebuild without the added 2’ cantilever. Mr. Bunker responded that it would only leave 4’ of usable space which isn’t enough for a table and the depth would be unusable. The ZBA asked when the bay window was put in, and it was shared that the house is from 1968. While exact dates are not known, Mr. Bunker did not add the window. Chair Holmquist added that the ZBA has seen similar requests. There is no encroachment on the ground, both adjacent properties are closer to the shore. The Applicant has presented their hardship and that there is no harm to the public. The unique property limitations were also outlined. A motion was made by Mr. Patton, seconded by Mr. Schweiger to approve a variance from Monona Municipal Code of Ordinances Sec. 480-24(d)(4)(d) Shore Yard Setbacks for the purpose of rebuilding and expanding the second-floor rear deck. The unnecessary hardship is present that in order to comply with Ordinance standards it would lead to the elimination of the existing deck. The property limitations are present in that the house is located in a Zoning Board of Appeals May 21, 2026 Draft Minutes Subject to Approval 2 position that the deck is not feasible. The request is modest and balanced with minimal harm to the public interest. Mr. Schweiger added that the unique property limitations are difficult. While a patio could be built, there is a door on the second floor that would pose a safety concern if the deck were not rebuilt. There was further agreement that the current location of the house and the smaller lot make building and complying with setbacks difficult. The motion passed unanimously. Public Hearing: Rick and Shawdi Nesbit, 1300 Neponset Trail are requesting a variance from Monona Municipal Code of Ordinances Sec. 480-24(d)(4)(a) Street Yard Setbacks and Sec. 480-24(d)(4)(d) Shore Yard Setbacks for the purpose of expanding and rebuilding the existing single-family home. (Case No. Z-004-2026) Mr. Rick Nesbit presented his request to demolish the existing home and rebuild a new single-family home. Mr. Nesbit highlighted the difficulties on the lot concerning the buildable area, and how the proposed location aligns with the other 3-4 nearby homes. There is a long family history on the lot, and the concrete block foundation has sunk over time. Additions were made to the existing home, but the best option is to rebuild to protect this for future generations. Consideration has been given to the shore yard setbacks for aesthetics and consistency and that is reflected in the proposal. The Applicant has worked with their current contractor to evaluate all options. The existing non- conforming detached garage will be removed and attached to the proposed house. The plans have been discussed with several neighbors both in the neighborhood and adjacent to the property. There were no other appearances and the public hearing was declared closed. Consideration of Action: Rick and Shawdi Nesbit, 1300 Neponset Trail are requesting a variance from Monona Municipal Code of Ordinances Sec. 480-24(d)(4)(a) Street Yard Setbacks and Sec. 480-24(d)(4)(d) Shore Yard Setbacks for the purpose of expanding and rebuilding the existing single-family home. (Case No. Z-004-2026) Planning Director Plowman gave an overview of the request and explained the setbacks for this property. Chair Holmquist asked if it was feasible to rebuild in the same footprint. Mr. Nesbit responded that the proposed footprint is 2’ further back from the existing location. Mr. Davies asked about hardscaping and proposed landscaping on the lot. Director Plowman responded that floodplain considerations will be evaluated as well as lot coverage and impervious requirements. Mr. Nesbit discussed their experience on the lot with water and runoff. There was discussion of the shore yard setbacks, their alignment with adjacent neighbors, and concern raised by the ZBA of potential creep of these requests. A motion was made by Mr. Patton, seconded by Mr. Schweiger to approve a variance from Monona Municipal Code of Ordinances Sec. 480-24(d)(4)(a) Street Yard Setbacks and Sec. 480-24(d)(4)(d) Shore Yard Setbacks for the purpose of expanding and rebuilding the existing single-family home. The unique property limitations are present through the inability to have a reasonable buildable envelope due to the two roads that abut the lot. The unnecessary hardship is that compliance with Ordinance standards prevents a realistic rebuild of the structure. The public interest is preserved by moving the footprint back from the shoreline compared to the current condition along with positive feedback from neighbors. A condition of approval was added that the property remain outside of the regulated floodplain. The motion passed unanimously. Zoning Board of Appeals May 21, 2026 Draft Minutes Subject to Approval 3 Public Hearing: David Wood, 4909 Tonyawatha Trail is requesting a variance from Monona Municipal Code of Ordinances Sec. 480-24(d)(4)(b) Side Yard Setbacks and Sec. 480- 24(d)(4)(d) Shore Yard Setbacks for the purpose of rebuilding and expanding the rear deck and steps. (Case No. Z-005-2026) Mr. David Wood presented his request to rebuild and expand the rear deck on his home at 4909 Tonyawatha Trail. The former deck was converted to steps that are now the current condition. He shared health and accessibility challenges of the current condition. He shared how difficult it can be to have chairs on the deck, and one wrong step can lead to a fall. He added context to adjacent properties and their shore yard setbacks. He summarized the request to convert the existing stairs back to a deck with some expansion. There were no other appearances and the public hearing was declared closed. Consideration of Action: David Wood, 4909 Tonyawatha Trail is requesting a variance from Monona Municipal Code of Ordinances Sec. 480-24(d)(4)(b) Side Yard Setbacks and Sec. 480- 24(d)(4)(d) Shore Yard Setbacks for the purpose of rebuilding and expanding the rear deck and steps. (Case No. Z-005-2026) Planning Director Plowman summarized the request. ZBA members discussed the orientation of the request and specifics of the proposal. Specifically, they considered the 4” encroachment towards the water and the additional 4’ on the side that is requested. The Applicant responded that otherwise it would be dead space and not used. Members discussed their concern with creep and proximity to the meander line. There was discussion of the need for a variance if the stairs were replaced with the same footprint for a deck. Mr. Davies acknowledged that the entire project area is non- conforming and there is an attempt to consolidate and recognize safety. Members acknowledged the safety concerns but also the expansion that makes the request difficult. Members encouraged minimal encroachment, but recognized the difficulty of using for a permitted purpose. Alternate designs and options were discussed with the Applicant for consideration. A motion was made by Mr. Patton, seconded by Mr. Davies (for discussion) to approve a variance from Monona Municipal Code of Ordinances Sec. 480-24(d)(4)(b) Side Yard Setbacks and Sec. 480-24(d)(4)(d) Shore Yard Setbacks for the purpose of rebuilding and expanding the rear deck and steps. The unnecessary hardship is present through the inability to construct a usable deck in the existing space. The unique property limitation is present through the existing location of the house being too close to the setbacks. There is no harm to the public interest, and there is no other safe and convenient way to design. The proposal includes a safe space to use but would not permit side yard setback encroachment. Mr. Davies stated that it is not the role of the ZBA to design the project but also acknowledged the unique situation. There are elements of the design that are problematic, but solutions that may be possible without further encroachment. Mr. Davies clarified that the current deck footprint allows everything as requested without impacting the established tree on the property. Safety measures were evaluated along with their impact of the main structure. The motion was clarified to allow a deck to be built in the 124” x 80” existing rectangular footprint, with stairs to be anywhere within that area. The ZBA recognized that the corner is likely in the side yard setback as proposed although encroachment is much less than before. The motion (as clarified) passed unanimously. Upcoming Meetings: Director Plowman shared that the June 18, 2026 meeting is cancelled. He will be in contact as soon as agenda items are ready for a future meeting. Zoning Board of Appeals May 21, 2026 Draft Minutes Subject to Approval 4 Updates/Discussion on Diversity, Equity and Inclusion (DEI) Efforts: None. Updates/Discussion on Sustainability Efforts: None. Adjournment: A motion by Mr. Davies, seconded by Mr. Patton, to adjourn carried. (7:35 pm) Respectfully submitted by: Douglas Plowman, Director of Planning and Economic Development 97 Chapter 15 – Variances SECTION IV Area and Use Variance Decision Process Step 2: Determine if all three statutory variance criteriay are met. Step 1: Consider alternatives to the variance request. Step 3: Grant or deny requesty qy for variance recording rationale and findings. Area Variance – Provides an increment of relief (normally small) from a dimensional restriction such as building height, area, setback, etc. Use Variance – Permits a landowner to put property to an otherwise prohibited use. 1. Unnecessary Hardship exists when compliance would unreasonably prevent the owner from using the property for a permitted purpose or would render conformity with such restrictions unnecessarily burdensome. Consider these points: ƒ Purpose of zoning restriction ƒ Zoning restriction’s effect on property ƒ Short term, long term and cumulative effects of variance on neighborhood and public interest. 1. Unnecessary Hardship exists when no reasonable use can be made of the property without a variance. 3. No harm to public interests A variance may not be granted which results in harm to public interests. Public interests can be determined from the general purposes of an ordinance as well as the purposes for a specific ordinance provision. Analyze short-term, long-term and cumulative impacts of variance requests on the neighbors, community and statewide public interest. 2. Unique physical property limitations such as steep slopes or wetlands must prevent compliance with the ordinance. The circumstances of an applicant, such as a growing family, elderly parents, or a desire for a larger garage, are not legitimate factors in deciding variances.
