12. Informational: Administrative and Operations reports.
Director of Utilities Brian Johnston provided updates on current Utility operations.
Mr. Johnston reported that Ferguson has completed approximately two-thirds of the hydrant
painting project along College Avenue and Rawson Avenue. He also reported that Lemke Pro
Blasting completed hydrant restoration work along 13th Street and Pine Court. The work is focused
on hydrants located along heavily salted county roadways where corrosion has accelerated
deterioration. The project is also serving as a comparison of two restoration methods to evaluate
long-term performance. Mr. Johnston noted that the restored hydrants have significantly improved
the appearance of the system.
Mr. Johnston informed the Board that hydrant flushing has begun, although the program is
approximately two months behind schedule. He noted that flushing operations began during a
period of high seasonal water demand and acknowledged the additional coordination required with
Water Treatment Plant operations while customers are using increased amounts of water for lawn
and landscape irrigation.
Mr. Johnston also provided an update on recent maintenance activities, including completion of the
water main repair on East Puetz Road and a recent service lateral repair. Utility crews are
preparing to complete valve repairs along East Puetz Road before the City's scheduled roadway
improvements begin.
Mr. Johnston explained that three 24-inch butterfly valves installed during the early 2000s are no
longer operating properly. Staff believe the issue is related to failed components within the valve
gear assemblies. Crews will excavate each location to determine the specific repairs required
before ordering replacement parts. Mr. Johnston noted that the Utility currently has 38 inoperable
valves throughout the distribution system and continues to address repairs as staffing and project
schedules allow.
The Board discussed staffing levels within the Utility. Mr. Johnston reported that a new treatment
plant operator is scheduled to begin employment the following week, returning the plant to full
staffing levels. The new employee will complete required training and obtain Wisconsin
Department of Natural Resources certifications over the coming months.
Mr. Johnston also reported that recently hired employees Caden, Mike Polder, and Ashley are
progressing well in their respective positions and will continue working toward required DNR
certifications. In response to Board questions, Mr. Johnston stated that the Water Utility currently
employs ten treatment plant operators and eight employees within the distribution division.

Item No. 6
Item: Drexel Town Square Splash Pad Surface Repair and Sealing
Recommendation: That the Board of Public Works and Capital Assets to consider a motion to approve

Account at the cost of $22,031.82 (Quote Attached).
Fiscal Impact: unbudgeted capital project request for approval.

Background: The Drexel Town Square Splash Pad was completed in 2016 with a stained, textured concrete
surface. After installation, it was determined that the surface texture was not sufficiently coarse, resulting
in slippery conditions leading to user injuries. To address this issue, a textured colored sealer was applied,
providing improved slip resistance. This coating has performed well for approximately 10 years and has now
exceeded its recommended service life.
This project will include recaulking the expansion joints and recoating the splash pad surface using the
same product applied in 2016, with the appropriate amount of texture to restore slip resistance and
extend the life of the surface.
If approved, the work is anticipated to be completed in September 2026, weather permitting. If
weather conditions prevent completion, the project will be scheduled for Spring 2027.
A second quote was requested to ensure competitive pricing. An appointment was scheduled with a
competing contractor on July 29, 2026; however, the contractor did not attend the site visit and later
indicated by phone they were not interested in performing the work.
Inspired, Aligned, and Proactive City Organization
Options/Alternatives: Leave as is and risk potential injuries from a failing slippery suface

Project Alterations and Change Orders: Any deviations from the original scope of work outlined in the contract, or requests for additional work, will require a formal
customer change order. Such change orders must be approved in writing by the Owner and will result in adjustments to the project cost and timeline. The Owner should contact
their Sundek Representative directly for any proposed alterations.
Surface Preparation and Pre-existing Conditions: Sundek systems are designed to conform to the existing contour of the concrete substrate. The Contractor disclaims
responsibility for pre-existing drainage issues, including inadequate pitch or slope. The Owner is solely responsible for implementing any necessary changes to pitch or slope
prior to Sundek application. The Owner should not apply any materials, coatings, or sealers to the concrete surface prior to application that may compromise the bond integrity
of the Sundek system. If work is performed by the Owner or other third-party contractors prior to installation, a Sundek representative must inspect the affected areas to

Owner's Obligations:
Access and Utilities: The Owner shall provide the Contractor with unimpeded access to the property and all designated work areas and at their sole expense furnish all
necessary water and electricity required for the proper construction and installation of the SUNDEK system.
Removal of Personal Property: Prior to the commencement of the project, the Owner is solely responsible for the removal of all personal property in or about the area where
the Contractor will be constructing or installing improvements. This includes, but is not limited to, pool covers, all furniture, furnishings, grills, and toys.
Vegetation Trimming: The Owner is responsible for the trimming of all grass, trees, shrubs, flowers, and other vegetation adjacent to the work areas prior to the project's
commencement. This ensures SUNDEK installers have unobstructed access to the entire perimeter for proper completion. Should Contractor deem it necessary to trim or cut
back any vegetation, Contractor shall assume no responsibility or liability for the subsequent condition of said items.
Protection of Work Area and Improvements: During the entire application stage, the Owner shall protect the improvements and working areas from water damage by
ensuring all irrigation systems adjacent to the project area are deactivated prior to the project's commencement and remain off throughout the entirety of the project.
Additionally, the Owner shall protect the project area from damage or disturbance caused by pets, other tradesmen, and any third parties. Any damage to work "in progress"
due to the Owner's failure to deactivate irrigation systems or adequately protect the project area will be repaired at the Owner's sole expense.
Payment Terms: A deposit is required prior to the tentative project start date. The Owner shall promptly remit the remaining project balance due in full UPON
COMPLETION, in strict accordance with the agreed-upon payment terms as specified in project proposal. Owner will be responsible for 3% credit card surcharge & returned
check fees.
Owner's Warranties and Rights:
Alterations to Plans and Specifications: In the event that the Owner and Contractor mutually agree in writing to any alterations, modifications, or deviations to the original
plans or specifications for the construction, the Owner shall be obligated, upon completion of the project, to compensate the Contractor for all extra work performed and
materials furnished as a direct consequence of such agreed-upon alterations. Such additional sums shall be deemed an integral part of the consideration for this Contract and
shall be secured by the terms and conditions herein.
Indemnification against Liens or Claims: Should the Owner reasonably anticipate or become aware of potential liability for any lien, claim, or encumbrance for labor
performed or materials furnished to the Contractor and primarily chargeable to the Contractor, the Owner reserves the right to withhold from any payment due to the Contractor
an amount deemed sufficient, in the Owner's sole discretion, to fully indemnify and protect the Owner against such lien or claim, until such time as the lien or claim is fully
satisfied or otherwise discharged.
Contractor’s Warranties:
Limited Warranty on Workmanship and Materials: The Contractor warrants that all work performed hereunder shall be free from defects in material and workmanship,
specifically limited to bond failure, chipping, flaking, or peeling, for the period stipulated herein. This warranty expressly excludes bond failure occurring adjacent to substrate
cracking. Upon timely written notice from the Owner within the warranty period, the Contractor shall, at its sole option, remedy any proven breach of this Guarantee by repair
or replacement, provided the Owner has strictly complied with all terms and conditions of this Contract, including timely and full payment.
Disclaimer Regarding Substrate Movement and Cracking: Due to the inherent and unpredictable movement characteristics of concrete, soil, and wooden structures, and
the potential for pre-existing or latent lack of structural integrity within these substrates, no guarantee, either express or implied, is extended or granted by the Contractor
concerning the occurrence of cracks within the applied coating or bond failure specifically adjacent to any pre-existing or subsequently occurring substrate cracking.
Saw Cutting Disclaimer: Sundek National Accounts shall not be held responsible or liable for any damage incurred to electrical lines, plumbing, irrigation systems, pool
ground wiring, or any other subsurface utilities during the process of saw cutting concrete. For the purposes of this clause, "saw cutting" refers exclusively to a complete cut
through the concrete slab performed to facilitate specified work, such as the removal or installation of deck drains or other instances explicitly requested by the Owner. Normal
preparation activities, including but not limited to grinding, scoring of existing cracks, scoring for decorative effect, and scoring for coping or joint relief, do not constitute saw
cutting by Sundek National Accounts and do not require the identification of buried utilities. The Owner affirmatively agrees to identify and mark the precise location of all
buried utilities prior to the commencement of the project.
Drainage Disclaimer and Blending Limitation: Sundek National Accounts assumes no obligation or responsibility for existing deck drainage conditions. Sundek National
Accounts may, in an effort to mitigate identified low areas, apply blending material to attempt to alleviate water pooling. Such blending efforts shall be strictly confined to the
specific low areas explicitly identified in this Contract. Sundek National Accounts disclaims all responsibility for water drainage in any other areas not specifically delineated
and identified in this Contract. Pricing for blending services is an estimate, and Sundek National Accounts commits only to the application of the specified amount of material
quoted. Should the Owner express dissatisfaction with the outcome of the blending, additional material may be applied solely upon the Owner's request and written acceptance
of a change order, which shall incur additional charges. Water testing, if requested by the Owner, shall also be subject to additional charges. The blending installation carries a
limited one (1) year warranty, applicable only to the blended area.
Exclusion for Misuse, Neglect, or Improper Maintenance: Defects or failures of the SUNDEK system directly attributable to obvious mistreatment, neglect, or improper
maintenance by the Owner or third parties shall not be covered by the Contractor's warranty and shall be repaired at the Owner's sole expense.
Voiding of Guarantees: All guarantees, warranties, and obligations connected with this Contract, including the work performed and materials provided, shall become null and
void if, at any time during the life of said guarantee, any work, modification, or repair is performed upon the Sundek National Accounts coating by parties other than authorized
Sundek National Accounts personnel.
I have read and understood the above contract section
Alterations to Construction: The Contractor shall not unilaterally make or charge for any alterations in the construction as described in the specifications. Any proposed
alterations must be mutually agreed upon by the Contractor and the Owner via a change order. Any unauthorized alterations made by the Contractor will be considered part of
the original Contract and will not incur additional cost for the Owner.
Owner’s Rights of Cancellation: By law the Contractor is required to provide the Owner with notice explaining their right to cancel. The NOTICE OF CANCELLATION
document, detailing the Owner’s rights, is attached as the final page of this contract.
Contractor's Obligations:
Sub-Deck Condition and Compatibility: The Contractor cannot fully inspect the sub-deck’s condition or compatibility before removing existing coatings (carpet, adhesive,
overlays, tile, etc.) Therefore, the Contractor reserves the right to cancel this Contract if, upon exposure, the sub-deck is incompatible with the SUNDEK system. If additional
preparation, blending, or crack treatment of the sub-deck is necessary for installation, the Owner will incur an additional cost for such work.
Owner's Default - Performance by Contractor: In the event the Owner fails to perform any of its obligations as set forth in this Contract, the Contractor may, at its option,
perform such obligations. The Owner shall reimburse the Contractor on demand, at the place where the Contract is payable, for any sums so expended by the Contractor, plus
interest on such sums from the dates of payment at the rate stated in the note for matured, unpaid amounts. Any sum to be reimbursed hereunder shall be secured by this
Contract.
Owner's Default - Attorney's Fees: If the Owner defaults on any payment due under this Contract, or if the lien associated with this Contract is foreclosed upon, the Owner
shall reimburse the Contractor for all reasonable fees paid to an attorney who is not an employee of the Contractor for the collection of such payments or for the foreclosure of
the lien. Any sum to be reimbursed hereunder shall be secured by this Contract.
Owner's Default - Termination of Work and Acceleration of Payments: If the Owner defaults on this Contract, or fails to perform any of the Owner's obligations
hereunder, or if the Contractor, in good faith, believes that the prospect of payment or performance by the Owner is impaired, and such default or good-faith belief in
impairment persists after the Contractor provides the Owner with notice of the default or the basis for the belief in impairment and a reasonable time within which such default
or impairment must be cured (as may be required by law or by written agreement), then the Contractor may, at its option, terminate work on or construction of the
improvements and may declare all sums due under this Contract to be immediately payable.
Contractor's Rights:
Lien Enforcement upon Incomplete Construction: In the event the construction contemplated by this Contract is not completed as mutually agreed between the Owner and
the Contractor, the amount of the consideration subject to the Contractor's lien shall be determined by the amount reasonably necessary to achieve completion of the
agreed-upon construction.

Lien Superiority: The lien created herein shall maintain its superiority over any subsequently created liens, notwithstanding any extension of the time of payment for all or
part of the promissory note or the release of any portion of the Property.
Application of Payments to Unsecured Portions: Should any portion of this Contract not be lawfully secured by the liens created herein, all payments received shall be
applied first to discharge that unsecured portion.
Non-Waiver of Remedies: Proceeding under the terms of this Contract, filing a suit for foreclosure, or pursuing any other available remedy shall not constitute an election of

Various:
Color (Finish Coat) Matching: Sundek National Accounts neither expresses nor implies that the color being installed today will match exactly to the color that was installed
previously. Sundek National Accounts will install the same color that was installed previously at the owner’s request. Sundek uses only a finish coat. Due to weather and
elements of nature (i.e.: trees, plants, pool chemicals, etc.) the finish coat installed previously may not match for a period of time. Sundek National Accounts has found that
colors generally blend in 120-180 days, but again, no guarantee due to area and elements.
Power Washing: Sundek National Accounts is not responsible for any finish coat that is damaged under pressure washing after being installed for more than 2 years. In most
cases the coating material will withstand pressure washing within 2000-2500 PSI with fan tip nozzle at least 10”-12” from surface, but no guarantees.
Pool Cleaning: Sundek National Accounts assumes no responsibility for the cleaning of any pool after the installation of a Sundek Coating System. The Installation of coating
requires grinding, chipping of existing surfaces, removal of existing coatings, removal of wood, plastic and caulk expansion joints, and the trimming back of landscaping, etc.
Sundek National Accounts will protect the surface by either bubble pack that is attached to the tile line and out over pool water approximately 2 feet out or attached visqueen
plastic to the tile line and cover the entire pool. These above methods are only to keep the debris that may get into a pool to a minimum. Circumstances beyond Sundek
National Accounts`s control such as high wind, rain, pool cleaner devices, delays, etc. often affect the protection and debris accumulates into the pool. It is the owner`s
responsibility to have the pool cleaned. Sundek National Accounts is not to be held responsible for pool cleaning, pool chemical re-stabilization, or pool equipment once the
coating installation is complete.
Painted Surfaces: Sundek National Accounts must install protective paper, masking & fiber tape to complete the coating application. Areas not to be coated with material
such as the house, trim, siding, retaining walls, iron and wood fencing, and landscaping will be protected in this matter. Sundek National Accounts is not responsible for any
paint that is pulled from a house, siding, trim, iron fence, etc. If paint is pulled during our protection process, it is the owner`s responsibility to have the paint touched up or
re-painted. Sundek National Accounts will not be held responsible.
Color/Texture & Slip Resistance: SunStamp/ SunStain/ Tuscan/ SunStone/ SunCanvas/ SunEpoxy/ SunOne: Sundek National Accounts does not accept any responsibility
for customer safety regarding slip resistance of the surface installed. The owner accepts all responsibility and will hold Sundek National Accounts harmless in this matter.
Client understands and agrees that color and texture will vary throughout the finished SunStamp / SunStain / SunCanvas / Tuscan / SunStone product.
SunColor: Sundek National Accounts neither expresses nor implies that the SunColor product being installed will provide any slip resistance to the surface area. Sundek
National Accounts has offered a product with slip resistance (SunSand product) that is being declined by the owner representative. Sundek National Accounts does not accept
any responsibility for customer safety regarding slip resistance of the surface installed. The owner accepts all responsibility and will hold Sundek National Accounts harmless
in this matter.
I have read and understood the above contract section
Color Choice Agreement

I accept the fact that all colors are as specified. A slight differentiation will be seen in transition to textured material. Colors may also vary slightly by being a shade lighter or

and will pay all necessary charges to change the color. Color mottling and variations together with texture irregularities are intended to enhance the finished project, each is a
custom creation and is unique in its color and texture characteristics in the following systems SunStamp/SunStain/SunAcid/SunDye/SunStone/SunCanvas products.
Sundek National Accounts will strive to achieve the color and texture desired by the client however Sundek National Accounts makes NO GUARANTEE that the color or texture

Background: The Abendschein Park Water Main Extension project extended the water main through the park,
connecting the dead end from the Stonebrook on the Park development to the existing 20-inch water main along
E. Drexel Avenue. The project enhanced water quality and fire protection for the Stonebrook development.
Additionally, the new main supplies water to the existing bathroom and concession building in the park
(replacing a long 2-inch lateral from E. Drexel Avenue), and will serve the proposed Biergarten.
DK Contractors successfully completed the water main installation. The contractor has submitted the affidavit,
and the final payment as been approved.
The original contract amount was $290,965, while the completed cost was $283,894.61. Two Change Orders

25118) (All Aldermanic Districts)

Background: This project is part of the Utility's ongoing Sanitary Sewer Rehabilitation Program. The Utility uses
the NASSCO rating system to evaluate the condition of sanitary sewers and prioritize repairs based on closed-
circuit television (CCTV) inspections. The primary focus of this project was the rehabilitation of the existing 18-
inch and 30-inch sanitary sewer mains in the Abendschein Park area and the Stonebrook Development. The goal
was to complete these repairs before the Stonebrook Development comes online, ensuring the sewer system has
the necessary structural integrity and capacity to serve future flows.
Visu-Sewer completed the rehabilitation project and has submitted the required affidavit. The original contract
amount was $487,388, and the final project cost was $471,433. As part of the project closeout, the contractor
agreed to reduce the cost of the 30-inch CIPP lining by $14,000 to cover restoration of the ball field. The funds
will be used by DPW for the restoration of the field. This amount reflected the contractor's estimated cost to
complete the restoration work. Overall, the project was completed under budget.

Recommendation:
That the Board considers a motion to approve the final payment for the Ryan Road at
Shepard Avenue Water Main Relay project to IHC Construction Companies, LLC, in the
amount of $8,277.78. (Project No. 25120) (3rd Aldermanic District)
Fiscal Impact:
This project was budgeted $350,000 in the 2025 Capital Improvement Project Budget

Background: The Ryan Road at Shepard Avenue Water Main Project replaced 250 LF of 16-inch DIP water main,
originally installed in 1983, and installed 330 feet of 16-inch PVC water main. The work was required because of
planned intersection improvements by WisDOT. New traffic signals are proposed at the intersection and the
bases for the proposed signals will interfere with the existing water main.
IHC Construction successfully completed the water main relay installation. The contractor has submitted the
affidavit, and the final payment has been approved.
The original contract amount was $331,111, while the completed cost was $325,048.25. The project was
completed under budget.

WATER & SEWER UTILITY — Brian Johnston
Underground Facilities Rehabilitation (UFR) Project: Tree clearing completed and
the erosion control permit has been issued. C.D. Smith anticipates beginning
construction in August. Staff are also reviewing emergency response procedures and
developing contingency plans for potential "what-if" scenarios, including a treatment
plant failure during construction that could require boil water advisories for the entire
service area.
HVAC Replacement at the Water Treatment Plant: Southport continues to address
the remaining punch list items. Installation of the bathroom radiant heat panels is
pending delivery of the equipment.
Lakeview Drive and Mona Court Water Relay: Zignego continues construction in
coordination with the City's roadway improvement project. The Lakeview water main
has been successfully pressure tested, and service laterals are now being installed.
Construction of the Mona Court water main is underway.
Neptune Meter Replacement Program: Installation of the new Neptune water meters
continues throughout the service area. Software training for staff began in July and will
continue in August. Once the system implementation and training are complete, the
Utility will begin the large-scale meter replacement program.
Sanitary System Map Upgrade: Engineering met with Strand Associates to kick off
the sanitary system mapping project. The team reviewed existing concept maps and
provided information for a comprehensive evaluation of undeveloped areas and their
impacts on the sanitary collection system. Strand will continue developing the
mapping, with completion anticipated by the end of the year.
Development Projects: Engineering continues to review plans for Garden Medley
Estates, The Prairie, and Hey Day Phase 2. Construction activities also continue at Lucy
Meadows and Millwood Glen.
Water Main Breaks: Distribution crews responded to and repaired two water main
breaks during the month: a 16-inch ductile iron water main at 10303 S. Chicago Road
on July 19 and a 6-inch ductile-iron water main at 9830 S. Burrell Street on July 23.
Both repairs were completed, and service was restored promptly.

Water Main Breaks:
On July 19 th, there was a break on Hwy 32 just south of Oakwood on the 16” ductile iron pipe.
There was large hole in the bottom of the pipe and was right next to a lateral tap. Other than that,
the pipe was in great shape.
On July 23 rd, there was a main break in the 9300 block of S. Burrell. The 6” main was repaired
with a clamp.
On July 27 th, the 6” main on Wake Forest Ct. blew during hydrant flushing. The rain storm and
gas main over the main made it more difficult.
On July 27th, the water main that is in the process of being replaced on Mona Ct. started leaking.
A repair clamp was put on since people are still being serviced by that main.
On July 29 th, the 8” main on Wayland Dr. blew. Once they got the clamp on, the realized there
was another hole in the pipe roughly 6’ away. They added another clamp.
On July 31st, the 12” main on Howell Ave. just north of Drexel Ave. broke. The cast iron has a
blow hole, longitudinal crack and circumferential crack in the same spot. A repair was made with
a clamp.
Water Lateral Repairs:
No laterals were repaired in the month of July.
Hydrant Repairs/Maintenance:
A fire hydrant was replaced in the 8000 block of S. 20 th St. We had to replace the valve, so we
replaced the hydrant right away.
Hydrant flushing for 2026 started. The heavy rains in April postponed it.
Valve Repairs:
A butterfly valve on E. Puetz was worked on ahead of the road project. We had to order parts
direct form the manufacturer to repair it. There is a 6-week lead time on those parts.
Several valve boxes were repaired for road project work.
Sewer Repairs/Maintenance:
Manhole are being resealed and repaired in coordination with the road projects.
Out of Service:
There are currently five fire hydrants out of service in need of repair. There are currently 38
valves jammed open in need of repair.
