Director Laine and Deputy Administrator Gagin provided an overview of the public hearing and

Alderman Loreck made three (3) calls for public comment for item eight (8) of the agenda. Seeing
none, the Public Hearing was closed.
Commissioner Bautch asked what the timeline would be to see possible investment into a specific

in the process. Deputy Administrator Gagin further explained that private development would have
to happen first to be able to fund significant investments.
Commissioner Oldani asked for clarification regarding how city-owned properties could be added
to the district without going over the state’s limit. Director Laine and Deputy Administrator Gagin
explained in detail how that is possible.
Alderman Loreck asked what the difference is between amending the district to include the city -
owned properties and considering those properties within a half-mile radius of the district? Deputy
Administrator Gagin explained that while incentivizing development could happen in either
situation; by including the properties into the district , the addition tax revenue from any
development goes directly back to the district
Commissioner Oldani moved that the Plan Commission adopts a Resolution to adopt Project Plan
and Territory Subtraction and Addition Amendment No. 1 for Tax Incremental District No. 15, City

documents and information to the commission regarding the conditions in the proposed exterior
modifications. Bill Fonti, 1457 Bayshore Dr, Steven Point WI, 54443, representing Colder
employees, stated work with the city will be continued.
Commissioner Hanna asked for further explanation of the presented conditions. Director Laine
and Mr. Fonti gave those explanations.
Alderman Loreck agreed with the applicant suggested compromises of striping only the needed
parking stalls. He also suggested not painting the staff -proposed gray stripe on the southern
elevation to elevate cost to the project.

related plans for site and exterior building modifications to Colder’s Furniture, an existing
business located at 9725 S. 13th Street with the following conditions:

Background:
During the City of Oak Creek Fire Department's annual inspection in November 2025, it was
discovered that the property at
7420 S. 10th Street
was occupied by Elevated Equipment Rentals, a full
-
service equipment rental business specializing in aerial and material
-
handling equipment. Staff determined
that the business had been operating without a Certificate of Occupancy and the required Conditio
nal Use
Permit (CUP) authorizing equipment sales and rental.
The property was previously approved for a Special Use Permit for cartage and express facilities. However,
because the current operation represents a change from the previously approved use, that Special Use
Permit is no longer applicable.
The
A
pplicant is requesting approval of a Conditional Use Permit to allow equipment sales and rental at
7420 S. 10th Street. The subject property and all surrounding properties are zoned
M
-
1 Manufacturing
District
.
Within the M
-
1 Manufacturing zoning district, equipment sales and rental is permitted as a
conditional use. The Municipal Code defines equipment sales and rental as follows:
“The use of any building or portion thereof, or other premises or portion thereof, for the display, sale, rental, or
lease of new or used commercial, industrial, or agricultural equipment, including, but not limited to, cranes,
tractors, bulldozers, grader
s, excavators, and other heavy equipment or machinery, as an ancillary use of a
zoning lot, and any warranty repair work and other repair service conducted as an accessory use.”
Pursuant to Table 17.0304(c) of the Municipal Code, equipment sales and rental uses must comply with
the permanent outdoor storage standards established in Section 17.0414(m). These standards require that
outdoor storage areas be surfaced with an approved
hard surface material and screened from view from
any public right
-
of
-
way by a solid wall between six (6) and eight (8) feet in height, with an accompanying
landscape strip.
To comply with these requirements, the applicant is proposing to install new fencing
with vinyl slats
and
landscaping on the site and is requesting Plan Commission approval for these site improvements.
Conditional Use Permit
Building and Site Use:
The Applicant occupies the entire
approximately 22,612 square feet of gross
internal
area, consisting of a first floor of approximately 18,520 square feet (including equipment storage,
service bays, wash
bay, offices, and show room) and a second floor of approximately 4,092 square feet
(including offices, a training
room, and a meeting room).
Interior storage will include 340 electric scissor
lifts, 20 forklifts, and 15 electric booms.
The outdoor storage area will accommodate
a maximum of 7
0 telescope booms, 20 rough terrain scissor
lifts, and 3
5
rough terrain forklifts.
The narrative provided by the Applicant provides a
table detailing the
quantity of equipment to be stored in specific areas on site.
As indicated in the site plan, this area will be
confined to the hard
-
surfaced parking lots in the side and rear yards.
All
the equipment will be kept

Business Operations:
Elevated Equipment Rentals operates a full
-
service equipment rental business
specializing in aerial and material
-
handling equipment. Its primary customers include electrical, mechanical,
and general contractors, as well as industrial facilities and manufac
turers.
The business is open to the public from 7:00 a.m. to 4:00 p.m., Monday through Friday. Delivery drivers
typically begin operations at 5:00 a.m. and return no later than 7:00 p.m. Equipment deliveries and pickups
are conducted using two vehicles: a day
-
cab
tractor with a 48
-
foot trailer and a day
-
cab rollback truck
with a 26
-
foot deck. Each truck makes a maximum of five round trips per day. Both vehicles are stored
overnight within the building's loading dock, where they are screened from view from the publi
c right
-
of
-
way.
The business currently employs 11 people and anticipates expanding to approximately 17 employees over
the next several years.
In addition to equipment rental and service, Elevated Equipment Rentals also sells equipment. Equipment
offered for sale is not displayed outdoors for promotional purposes. Instead, all inventory is stored within
the building or in the fenced outdoor stora
ge area used for the company's rental fleet.
Site Plan and Architectural Review
District Specific Standards, Use Specific Standards, & Land Use:
The proposed modification complies
with the intent, standards, and requirements of the City’s Zoning Ordinance and the M
-
1 Manufacturing
District
.
Additionally, the land use is consistent with the City’s comprehensive plan.
Design
/Screening
:
Pursuant to Section 17.0414(m) of Municipal Code, screening walls shall be
constructed from traditional, time
-
and weather
-
tested materials and techniques such as but not limited
to masonry, stone veneer systems, stucco, or precast panels with inlaid or s
tamped brick texture.
The outdoor storage yard is currently enclosed in part by an existing chain
-
link fence with a motorized
gate located at the northwest corner of the building. I
t
should be noted that the north
-
south segment of
this fence in the northwest corner, including the motorized gate, was installed by the Applicant without
the required permits or Plan Commission approval.
As part of this proposal, this portion of the fence with
gate will have blue vinyl privacy slats added and the existing barbed wire removed, as barb
ed wire is only
permitted on fences adjacent to side and rear property lines.
The existing fence continues east to the
property's northeast corner before extending south, where a manual gate is located at the southeast
corner of the building.

As part of this application, the Applicant is proposing approximately 612 linear feet of additional fencing
to fully enclose the remaining southern and eastern portions of the outdoor storage yard, as shown on
the site plan
. The proposed improvements include a 79
-
foot western tie
-
in section with a new 5
-
foot
pedestrian gate, a 303
-
foot southern fence line, and a 230
-
foot eastern fence line connecting to the
existing fence.
T

will consist of an

-
link fence with
blue
vinyl privacy
slats woven into the fabric to provide visual screening.
The fence will also include barbed
-
wire security
outriggers
adjacent to the side and rear property lines
.
No barbed wire is proposed or allowed for fence
s
not adjacent to the side or rear property lines.
Parking:
No modifications are proposed to the size or use of the existing building; therefore, no additional
parking is required as a result of this application. As shown
on
the site plan
, the site currently provides 38
off
-
street parking spaces, including one ADA
-
accessible space. Parking is divided between the primary
parking lot located northwest of the building and an additional paved parking area located south of the
building.
Pursuant to Section 17.0501(i) of the Municipal Code, the
A
pplicant is requesting approval to reduce the
minimum required off
-
street parking from 38 spaces to 25 spaces. This reduction would allow the 13
-
space parking area south of the building to be repurposed for outdoor equipment storage. The
A
pplicant
states that the reduction is warranted because the site's actual parking demand is substantially lower than
the parking requirement calculated under the Municipal Code.
The business currently employs 11 people and anticipates growing to a maximum of 17 employees over
the next several years. In addition, customer traffic is limited because the business primarily serves
commercial contractors and industrial customers, with
most equipment delivered directly to job sites
rather than picked up by customers. As a result, walk
-
in customer traffic is minimal. The required parking
ratio of one space per 600 square feet, which is based on the vehicle sales and rental use classificat
ion,
is calculated using building area rather than actual employment levels or customer activity and does not
accurately reflect the site's operational parking demand.
The 13 parking spaces proposed for removal are located in the paved parking area south of the building,
as shown on the site plan. This area would be converted to outdoor equipment storage while remaining
paved, allowing it to be restored to parking in the
future if warranted. The area would also remain available
for parking during the Applicant's quarterly training sessions, which are attended by a maximum of 20
participants.
Pursuant to Section 17.0501(i)(1)(5) of the Municipal Code, the Plan Commission may review the
adequacy of the approved parking reduction within one year of approval and periodically thereafter. If
the Commission determines that the reduced parking supply
is inadequate to serve the use, it may require
the property to be brought into compliance with the parking requirements of the Municipal Code.

Lighting:
No new or additional lighting is being proposed. Any future lighting additions will need to
comply with the Municipal Code, and the owner or tenant must apply for the necessary permits before
installing additional lighting on the property.
Engineering:
Engineering indicated no concerns. The Applicant will comply with all regulations and
requirements.
Access:
The site currently has access from S.
10
th
Street
. No new or additional access is being proposed.
Signage:
No new or additional signage is being proposed as part of this review.
Environmental:
The site is developed and does not contain any environmentally sensitive areas such as
wetlands, floodplains, or environmental corridors.
Landscaping:
As required by Section 17.0414(m) of the Municipal Code, the Applicant is proposing a five
(5)
-
foot
-
wide landscape buffer along the exterior of the proposed fence to screen the outdoor storage
area. In accordance with the code requirements, the landscape b
uffer will include four (4) trees and 10
shrubs for every 100 linear feet of fencing.
The proposed tree species is Colorado blue spruce, with each tree measuring a minimum of six (6) to
eight (8) feet in height at the time of planting. The proposed shrubs are Arrowwood viburnum, which will
be installed as a continuous hedge with an initial
height of three (3) to four (4) feet.
Fire Department:
The Fire Department indicated no concerns.
The Applicant must comply with all
regulations and requirements of the City of Oak Creek Fire Department.
Options/Alternatives:
The Plan Commission has the discretion to recommend or not recommend
Common Council approval of the Conditional Use Permit request. Should the request not be
recommended for Council approval, Plan Commissioners must provide the Code Sections upon which the
denial is based, and the Applicant may choose to request Council approval without recommendation. In
that case, the Council would have the authority to approve the request, and remand the proposal back to
the Plan Commission for Conditions and Restriction
s.
If the Commission determines the proposed
Conditional Use meets the requirements of the Municipal Code, a public hearing may be scheduled as early
as September 15, 2026. Staff has also prepared Conditions and Restrictions for review (attached).
The Plan Commission has the discretion to approve
the site and architectural
plans as presented, approve
with specified conditions, or disapprove the proposal. Should the request not be approved, Plan
Commissioners must provide the Code Sections upon which the denial is based so that the Applicant may

Conditional Use Permit & Site Plan and
Architectural Review
Dear Oak Creek Plan Commission,
Please accept this document as the combined narrative description of the proposal for a Conditional Use Permit
(CUP) and Site Plan & Architectural Review (SPAR) at 7420 S 10th Street, Oak Creek, parcel identification number
7649048000. Because the CUP and
SPAR applications for this site are related and will be considered jointly by the
Plan Commission, this single narrative addresses the findings and standards applicable to both approvals.
Business Operations
Elevated Equipment Rentals intends to use the property to operate a full
-
service equipment rental company,
providing primarily aerial and material handling equipment to its customers. Typical customers include electrical
contractors, mechanical contractors
, general contractors, industrial plants, and manufacturers. Elevated Equipment
Rentals' customers are professional contractors or local businesses, as opposed to homeowners, which limits traffic
flow to the building and remains consistent with or reduced
compared to traffic flow in the area.
Elevated Equipment Rentals is open to the public from 7:00 a.m. to 4:00 p.m., Monday through Friday. Drivers
normally begin operating at 5:00 a.m. and return by 7:00 p.m. at the latest. Current truck traffic consists of two
trucks that deliver and pick up
equipment: a day cab tractor pulling a 48' trailer, and a day cab rollback truck with a
26' deck. Maximum round
-
trip traffic would be five trips per truck per day. Delivery trucks are stored overnight in
the loading dock, which is not visible from the publ
ic right
-
of
-
way. Current employee count is eleven, with
projected growth to seventeen over the next few years.
In addition to rental and service, Elevated Equipment Rentals also sells equipment. Equipment offered for sale is not
stored or displayed outside the fenced yard for promotional purposes; all sale inventory is kept within the same
indoor and fenced outdoor
storage areas used for the rental fleet, consistent with the storage description below.
Site and Building Description
Per the interior floor plan prepared for the site, the building totals approximately 22,612 square feet of gross internal
area, consisting of a first floor of approximately 18,520 square feet (including equipment storage, service bays, wash
bay, offices, a
nd show room) and a second floor of approximately 4,092 square feet (including offices, a training
room, and a meeting room). The first
-
floor figure is consistent with the 18,269 square foot building footprint shown
on
Elevated Equipment Rentals Site Plan
(Pinnacle Engineering Group / Chaput Land Surveys); the modest variance
between the two reflects the difference between surveyed exterior footprint and measured interior floor area,
consistent with the floor plan's own notation that dimensions are approxi
mate.
Equipment Storage
Equipment is stored in an orderly manner both inside the building and outside in the fenced yard. Maximum planned
indoor stored equipment includes 340 electric scissor lifts, 20 forklifts, and 15 electric booms. Maximum planned
outdoor stored equipment wou
ld be 70 telescopic booms, 20 rough terrain scissors, and 35 rough terrain forklifts.
Because rental inventory turns over continuously and the specific mix of equipment on site varies with customer
demand, delivery schedules, and seasonal activity, the table below labels each outdoor storage zone with an
estimated typical capacity rather th
an a fixed equipment assignment or a binding per
-
zone maximum. Unlike off
-
street parking, outdoor equipment storage is not subject to a per
-
area minimum or maximum requirement under the
Oak Creek Municipal Code; these per
-
zone figures are informational est
imates, based on the paved area available in
each zone under typical spacing, prepared in response to Community Development's request to label these areas
with quantities, consistent with the labeling convention used for the parking areas. The binding limi
t on outdoor
equipment storage is the aggregate site
-
wide maximum shown at the bottom of the table, combined with the
requirement that all outdoor equipment remain within the fenced and screened storage areas depicted on
Elevated
Equipment Rentals Site Plan
. The estimated zone subtotal is lower than the aggregate maximum because the per
-
zone estimates reflect typical day
-
to
-
day spacing, while the aggregate maximum reflects the full planned fleet size,
which can be accommodated through denser equipment arrang
ement (for example, positioning boom arms to allow
equipment to be stored closer together) as operational needs require. Actual equipment placement within and among
zones is optimized day to day based on the current rental fleet mix, and multiple pieces of
equipment may occupy a
single zone's estimated capacity as space allows:

Street Parking
Per
Elevated Equipment Rentals Site Plan
, the site provides 38 off
-
street parking spaces, including one designated
handicapped stall, distributed between the primary off
-
street parking lot and the additional asphalted overflow area
in the yard, not on the street. The table below sets forth the p
arking calculation required under Oak Creek Municipal
Code
§ 17.0501

Use classification note: Because the business combines equipment rental, sales, and service, the
"Vehicle sales and

category (1 space per 600 square feet) under
§ 17.0501
is applied to the total building gross floor area of
22,612 square feet, consistent with the calculation shown on
Elevated Equipment Rentals Site Plan
(22,612 ÷ 600 =
38 spaces required).
Parking Reduction Request.
Pursuant to
§ 17.0501(i)
, Elevated Equipment Rentals respectfully requests that Plan
Commission reduce the minimum required parking from 38 spaces to 25 spaces, freeing the 13
-
space parking area in
the southern portion of the yard for outdoor equipment storage, on the basis that
actual parking demand at this site is
substantially lower than the ordinance's area
-
based ratio assumes. In support of this request:
The business currently employs eleven people, with projected growth to a maximum of seventeen employees. The
parking ratio applied above (1 space per 600 square feet, a vehicle sales and rental standard) is calculated on
building square footage rather than
employee count or customer visits, and does not reflect this business's actual
parking demand.
Customer traffic at the site is minimal. As described above, Elevated Equipment Rentals' customers are professional
contractors and businesses who receive equipment via truck delivery rather than visiting the site in person; walk
-
in
customer traffic is not
a meaningful driver of parking demand.
Company delivery trucks are accounted for separately in the Truck Parking allocation shown in the Equipment
Storage table above, and are not part of the 38
-
space general parking count.
The spaces freed by this reduction are the 13
-
space parking area in the southern portion of the yard, as shown on
Elevated Equipment Rentals Site Plan
. These spaces are proposed to be repurposed for outdoor equipment storage,
consistent with the Equipment Storage table above. Consistent with
§ 17.0501(i)(2)
, this area will remain as open,
unobstructed space capable of being converted back to striped parking if Plan Commission determines, upon its
required review, that the reduction is no longer supported by actual demand. Elevated Equipment Rentals
acknowled
ges that Plan Commission will review the adequacy of this reduction within one year of approval, a
nd
periodically thereafter, pursuant to
§ 17.0501(i)(1)(5)
.
Proposed Physical Site Modifications
This application includes the following physical modifications to the site, shown on
Elevated Equipment Rentals
Site Plan
:
Fencing.
The yard is enclosed by an existing chain link fence with a motorized gate at the northwest corner of the
building.
This fen
ce and gat
e were adde
d prior to
ten
ant

s lease c
ommencement. Tenant request
s approval for this
fence in addition to
future planned fence to the
South of building.
The existing fence runs east to the northeast
corner of the property before continuing south, with an existing manual gate at the southeast corner of the building.
This application proposes approximately 612 linear feet of new fencing to enclose the remain
ing southern and
eastern yard, per
Elevated Equipment Rentals Site Plan
, consisting of a 79
-
foot west tie
-
in run (including a new 5
-
foot gate), a 303
-
foot southern run, and a 230
-
foot eastern run, tying into the existing fence. Except where the
screening standards described below require a solid wall, the proposed new fence w
ill be 8 feet in height, galvanized
chain link fabric with vinyl privacy slats woven in for visual screening, topped with barbed wire security outriggers.
The purpose of the fence is security and screening
—
to deter theft of rental equipment inventory sto
red outdoors
and to limit visibility of outdoor storage areas, consistent with insurance and lender requirements.
Screening compliance.
Pursuant to Oak Creek Municipal Code
§ 17.0414(m)
, as amended by Ordinance No. 3156,
a solid wall constructed of masonry, stone veneer, stucco, or precast panel (6
–
8 feet in height) is required to screen
portions of outdoor equipment storage visible from S 10th Street or adjacent residentially or institu
tionally zoned
property. The new fence described above runs along the south and east property lines, facing the adjacent parcels
owned by BT Property LLC and Ercor FF, LLC. The 8
-
foot c
hain link fence with privacy slats described above does
not, on its own, satisfy the solid wall material standard. Elevated Equipment Rentals respectfully requests a variance
from Plan Commission to permit the slatted chain link fence, in combination with
the landscape buffer described
below, to serve as the screening treatment on the affected segments, in lieu of a solid masonry wall. This request is
based on consistency with the existing fence already in place on the property, and on the adequate screenin
g opacity
provided by the combination of the privacy slats and the required landscape buffer. Should the variance not be
granted, Elevated Equipment Rentals will construct a compliant solid wall meeting the material and height standards
of
§ 17.0414(m)
on the affected segments. A landscape plan showing the required 5
-
foot landscape buffer is
included as part of this submittal regardless of which screening material is ultimately used, at the code
-
required
density of 4 trees and 10 shrubs per 100 linear f
eet.
Evergreen trees (e.g., arborvitae, minimum 6 feet tall at
installation) are proposed for the required trees, in order to provide year
-
round screening of the outdoor equipment
storage areas, consistent with the intent of
§ 17.0414(m)
.
Gates.
The motorized gate at the northwest corner of the building and the manual gate at the southeast corner of the
building are both existing and are not being relocated or modified as part of this application. One new 5
-
foot
pedestrian (man) entrance is proposed as part of the new fence, located along the west tie
-
in run described above;
this is a walk
-
through entrance for personnel access and is not a vehicle gate.
Parking and storage striping.
Oak Creek Municipal Code
§ 17.0501
requires off
-
street parking areas to be paved
(already satisfied by the existing asphalted lot and yard) but does not independently require painted striping. The
primary parking lot is not currently striped; Elevated Equipment Rentals commits to striping
the primary lot
following approval of this application. The yard overflow parking area will remain a designated but unstriped area
and will not be striped until operationally needed. The 38 to
tal spaces, and their distribution between the primary lot
and yard overflow area, are as shown on
Elevated Equipment Rentals Site Plan
.
Exterior Lighting
No new exterior lighting is proposed as part of this application. Existing site lighting will remain unchanged.
Management Team
The company's management team is led by Robert Rivera, David Bartelme, and Phil Cook.
Robert Rivera, CEO of Elevated Equipment Rentals, has led organizations in the construction industry for more than
thirty
-
one years. His rental equipment management experience spans a diversity of industries including aerial lifting,
heavy highway, demolit
ion, and pipeline. Mr. Rivera has led multi
-
location operations across states and regions, and
most recently, as President of Aerial Work Platforms, led the doubling of EBITDA and the opening of a fourth,
profitable greenfield location in less than three y
ears during a pandemic. Through his industry connections, he led
the divestment of that company to Herc Rentals. Robert has a proven track record in the equipment rental industry,
leading teams to double
-
digit growth under any economic condition.
David Bartelme is the Chairman of the Board of Elevated Equipment Rentals. His career has spanned leading
engineering, operations, and maintenance departments in the energy industry, both domestic and international. He
has worked on and led more than fifty
acquisitions, and teaches Investment Banking at Marquette University as an
Adjunct Professor.
Phil Cook, CFO of Elevated Equipment Rentals, was Vice President of Finance for Aerial Work Platforms from its
purchase by Borgman Capital through its sale to Herc Rentals in 2023, successfully funding growth through
managed cash flow and appropriate debt
financing while supporting operations to allow the business to scale. Prior
to AWP, Phil led teams of accountants and general managers for F3 Marina, a full
-
service third
-
party management
company, across five states.
Lease Terms
Elevated Equipment Rentals has an eight
-
year lease, with an additional option to renew for eight years, at 7420 S
10th Street with landlord Oak Creek 18, LLC, c/o Zetley, Carneol & Stein, S.C., 788 N. Jefferson Street,
Milwaukee, Wisconsin 53202.
Conclusion
Elevated Equipment Rentals respectfully requests that the Plan Commission approve the Conditional Use Permit and
Site Plan & Architectural Review for the physical modifications and continued operations described above.

Background:
The Plan Commission approved the Preliminary Subdivision Plat for the property located at
10670 S. Nicholson Rd
.
, known as Edgemont Estates, on February 28, 2023. Shortly thereafter, the Applicant
and the City of Oak Creek entered into a Development Agreement outlining the installation of public
infrastructure to serve the subdivision, including roads, sanitary sewe
r, and water utilities. Completion of this
infrastructure
wa
s required prior to review and potential approval of a Final Subdivision Plat.
Pursuant to Wisconsin State Statutes 236.25(2), the Milwaukee County Register of Deeds may not accept a
plat for record if it is submitted more than 36 months after the first approval
—
in this case, the Plan
Commission’s approval on February 28, 2023. Because more than 36 months elapsed since that approval,
the Applicant resubmitted a Preliminary Subdivision Plat for consideration
at the March 10,
2026,
Plan
Commission Meeting
.
Plan Commission again approved the Preliminary Plat.
Since the approval in March, the Applicant has completed the installation of required improvements and all
other requirements of the Development Agreement. The Applicant is now seeking approval of the Final Plat.
Proposed
Final
Plat
:
Pursuant to Section 14.63
(a)(3), t
he Final Plat shall conform to the Preliminary Plat as
approved
.
Since the
March 10, 2026
approval
of the Preliminary Plan
, no changes have been made
to the
Plat
. The
P
lat includes 14 single
-
family residential lots ranging in size from 12,
058
square feet to 15,477
square feet, as well as four (4) outlots designated for stormwater management, easements, wetlands,
floodplain, and Primary Environmental Corridor areas.
Lot Design, District Specific Standards, & Land Use:
The proposed layout complies with the intent,
standards, and requirements of both the City’s Zoning Ordinance and the Rs
-
3
Single
-
Family Residential
District. Lot area, width, and setbacks are consistent with the bulk and dimensional standards outlined in
Chapter 17 of the Municipal Code. Additionally, Section 14.122(b) requires a minimum lot depth of 115 feet,
along with ade
quate lot dimensions to accommodate off
-
street parking, service, and loading area
s
appropriate for single
-
family residential use. The proposed subdivision also aligns with the land use goals
and policies outlined in the City’s Comprehensive Plan.
Environmental:
The site contains wetlands, floodplain areas
(floodfringe
), and a Primary Environmental
Corridor, most of which are located within Outlots 1
–
4. Outlot 1 is designated as a conservancy area in the

plat notes, with a fence to be constructed along its southern boundary and maintained by the Homeowners’
Association. The maintenance and ownership responsibilities for this fence should be documented in the
deeds for Lots 1
–
14.
Trees within the remaining outlots, outside areas required for stormwater infrastructure, are to be
preserved. A 50
-
foot
-
wide tree preservation easement is proposed along the west sides of Lots 1
–
7. While
the
P
lat notes indicate that all mature trees with a diameter of at least 12 inches (DBH) within the easement
will be preserved, staff recommend that a formal easement be created, recorded, and referenced in the
deeds for Lots 1
–
7.
Futher, staff has included a condition of approval
that a
copy of the easem
ent language
must be submitted to the Department of Community Development for review prior to recording.
Streets and
Access:
Access to the subdivision will be provided via the proposed Edgemont Drive,
a public
road
. Because the City’s Official Map designates a road reservation for a future public street connection to
the property east of the subdivision, a temporary cul
-
de
-
sac is shown on Outlot 1. Development and
stormwater agreements, detailed civil engineering pl
ans, and all necessary permits will be required for the
construction of the proposed public infrastructure and the development of the lots.
Lighting:
Street lamps are required in accordance with Section 14.108 of the City Code. Lamps shall be
installed at each street intersection and at additional locations within blocks as determined necessary by
the City Engineer. All required street lighting improvem
ents shall be dedicated to the City. The Applicant
proposes to install pole
-
mounted street lamps throughout the subdivision to meet these Municipal Code
requirements. All street lamps must comply with the City of Oak Creek Department of Public W
orks’
decorative residential lighting standards.
Engineering and Utilities:
As previously noted, the City
and the Applicant have entered into a Development
Agreement outlining the installation of infrastructure for the subdivision. The Applicant
has
complet
ed
this
work. Private storm sewer easements, each 20 feet wide, are shown between Lots 1 and 2, Lots 4 and 5, Lots
6 and 7, Lots 8 and 9, and along the east sides of Lots 10 through 14. The City’s Engineering and Utility
Departments have no additional concern
s. The Applicant must comply with all applicable regulations and
requirements.
Signage:
No new or additional signage is being proposed as part of this review. Any future signs must
comply with the Municipal Code, and necessary permits
w
ill
be required
before installing any signs on the
site.
Fire Department:
The Fire Department indicated no concerns.
The Applicant must comply with all
regulations and requirements of the City of Oak Creek Fire Department.
Options/Alternatives:
Pursuant to
Section
14.63(b)(1) of Municipal Code, the Plan Commission shall
examine the Final Plat as to its conformance with the approved
Preliminary Plat, which was approved on
March 10, 2026, as well as all conditions of approval. Following its review, the Plan Commission shall

Edgemont Estates, Oak Creek Wisconsin
Edgemont is a small 14 lot development. Surrounded by trees, woods and
nature. All homesites are fully improved with underground utilities, natural
gas, water and sewer laterals to the lot line. Mountable curb and gutter.
Attractive, well-lit street lighting on the east and south side of the subdivision
and sidewalks on both sides of the street. Each hone will have its own mailbox
matching the developer installed street lights. Architectural covenants to
create a harmonious design environment. The community will have a variety
of builders and custom-built homes. The lots vary in size from 12,058 sq.ft. up
to 15,477 sq.ft. There is a 50-foot tree preservation easement along the west
side of lots 1 to 7. There is an approved storm water management detention
pond on the north side of the development. Located at 78,883 sq.ft. Outlot 1.
This area is buffered by a protected mature forest. In a major storm water
event, the Outlot 1 pond will outlet toward the Crayfish Creek north of the
development. East of lot 9 and north of lot 10 exists a temporary Cul-De-Sac
large enough for emergency vehicles or a School Bus to turn around. There is
an approved storm water management detention pond on the south side of
the development. Located at Outlot 2. This area is buffered by a wetland to
the south. The preliminary plat was approved by the City of Oak Creek in 2023.
Construction did not commence until 2024. The three-year window from the
time the original preliminary plat was approved expired. The original
preliminary plat dated 5-22-2024 was resubmitted and approved at the Plan
Commission Agenda 3-10-2026. There have been a variety of factors that have
delayed this development. Fortunately, that is all in the past. The subdivision
is built, inspected and completed. 13 of the 14 lots are spoken for with a wide
variety of builders and individuals anxiously waiting to start their new home
and become a new resident in Oak Creek.
THANK YOU!
