MINUTES OF THE
OAK CREEK PLAN COMMISSION MEETING
TUESDAY, JULY 14, 2026
Mayor Bukiewicz called the meeting to order at 6:00 PM. The following Commissioners were
present at roll call: Commissioner Hanna, Commissioner Bautch, Assistant City
Administrator/Engineer Matthew Sullivan , Alderman Loreck, Mayor Bukiewicz, Alderman
Guzikowski, Commissioner Oldani, Commissioner Siepert, and Commissioner Chandler. Also
present was Senior Planner Todd Roehl.
3. Minutes of June 9, 2026, meeting
Commissioner Siepert moved to approve the minutes of the June 9, 2026, meeting. Alderman
Loreck seconded. On roll call: Commissioner Chandler abstained, all others voted aye. Motion
carried.
4. PRELIMINARY SUBDIVISION PLAT – Review a preliminary subdivision plat for Bluestem
at The Prairie, a single-family residential subdivision to be located at 2241 and 2264 W.
Prairie Wind Blvd., submitted by Justin Johnson, Pinnacle Engineering Group, LLC and
John Siepmann, OC Land Holdings, LLC (Tax Key Nos. 762-9011-000 & 762-9018-000; 2nd
Aldermanic District)
Senior Planner Roehl provided an overview of a preliminary subdivision plat for Bluestem at the
Prairie, single-family residential subdivision (see staff report for details).
Comments were heard from the following individual:
Paul Grieger, 2231 W Rawson Ave
John Siepmann, Siepmann Realty, explained that their proposed stormwater plan is within the
state and local standards for discharge. Mayor Bukiewicz added that the development will have
a modern sewage system for storm discharge.
Commissioner Hanna asked if there is a plan for retention ponds on the site. Mr. Siepmann
explained there is and there are other stormwater controls on the site.
Assistant City Administrator/Engineer Sullivan stated the proposal has been reviewed by the
City’s consultants to ensure it meets Chapter 13 Municipal Code requirements and has been
submitted to and approved by MMSD. Assistant City Administrator/Engineer Sullivan also noted
all wetlands on the site are being left alone, so the environmental protections that are currently in
place will remain in place.
Alderman Loreck asked if any trees are being removed from the north property line, if the 18
replaceable trees will be over the entire 34-acre site, and if the 38 trees will be planted in a
concentrated area. Mr. Siepmann confirmed they are not removing trees along the north lot line
except for a few in the northwest corner so they can convey the stormwater down and around the
northwest lots. Senior Planner Roehl referenced the landscape plan and confirmed the 18 trees
will be over the entire site and the 38 trees will be planted in the northeast corner.
Commissioner Siepert made comments that were not audible.
Alderman Loreck moved that the Plan Commission approves the Preliminary Subdivision Plat for

Bluestem at The Prairie single-family residential subdivision to be located at 2241 & 2264 W.
Prairie Wind Blvd, with the following conditions:
1. That all water and sewer utility connections are coordinated with the Oak Creek Water &
Sewer Utility.
2. That all required Development and Stormwater Agreements are coordinated with the
Engineering Department.
3. That all technical corrections, including, but not limited corrections required for compliance
with the Municipal Code and Wisconsin Statutes, are made prior to recording.
4. That all revisions to the preliminary subdivision plat are submitted electronically to the
Department of Community Development prior to submission of permit applications.
Commissioner Bautch seconded. On roll call: all others voted aye. Motion carried.
5. SIGN APPEAL – Review a sign permit appeal for Derse, a future business to be located at
10300 S. Oakview Pkwy., submitted by Chris Weida, Derse, Inc. (Tax Key No. 955-9005-000;
5th Aldermanic District)
Senior Planner Roehl provided an overview of a request for a variance to allow for a temporary
sign with an area of 50 square feet and seven (7) feet in height to be displayed for 458 days on
the property located at 10300 S. Oakview Pkwy (see staff report for details).
Commissioner Chandler asked why they are requesting such a large sign, if the sign is temporary,
and what the timeframe is based on. Chris Weida, Derse, Inc., 3800 W Canal St, Milwaukee,
explained they decided on the sign size by looking at Google Maps to get dimensions relative to
the cross streets. Mr. Weida confirmed the sign is temporary and will be removed when the
permanent sign is installed on the building. Mr. Weida explained that 458 days would be the
maximum and they are requesting the temporary sign from now until the permanent sign is
installed on the building. Mr. Weida also stated the building is scheduled for a 15 to 16-month
build period.
Commissioner Siepert made comments that were not audible.
Mr. Weida explained that given the size of the building and high-profile intersection the applicants
thought people would want to know what is being built there throughout the course of the build
and not just the first 90 days.
Alderman Guzikowski stated he is not opposed to the sign.
Alderman Loreck asked what material the sign would be made of. Mr. Weida stated the sign will
be a printed PVC material.
Commissioner Hanna asked if there will be a maintenance plan for the sign. Mr. Weida stated it
would be Derse’s responsibility to have it maintained and they would instruct their general
contractor to advise them if there is need for any sign repairs. Mr. Weida also stated he would be
on site at least every two weeks and would see the sign.
Mayor Bukiewicz gave an overview of the building and Derse and reiterated the time frame.
Alderman Loreck moved that the Plan Commission approves a sign appeal allowing a temporary
sign with an area of 50 square feet and a height of seven (7) feet to be displayed for 458 days on
the property at 10300 S. Oakview Pkwy. with the following conditions:

TID #11 Project Plan Amendment
4
Section 2: Introduction and Description of Project Plan
Amendment
Tax Increment District #11 (the “TID”) was created on April 3, 2012, for the
purpose of promoting development in the area west of South Howell Avenue
(STH 38) between Drexel Avenue and West Forest Hill Avenue. The District is
commonly known as Drexel Town Square and serves as a gateway to the City
of Oak Creek. Development within the District includes City Hall, the public
library, retail shops, restaurants, residential apartments, a hotel, a medical
facility, and other appropriate uses, all of which are consistent with the City’s
development and redevelopment plans.
Since its creation, TID #11 has been amended several times to respond to
evolving development conditions within the District. Project Plan (“Plan”)
Amendment No. 1, adopted in January 2014, incorporated an adjacent parcel
formerly known as 400 West Forest Hill Avenue. Project Plan Amendment No.
2, finalized in December 2014, further modified the District boundary to
include a portion of 8131 South How ell Avenue and facilitated site
reconfiguration, including the construction of the South 6th Street connection
between Drexel Avenue and West Forest Hill Avenue. Project Plan Amendment
No. 3, adopted on April 11, 2017, updated the Project Plan to reflect increased
project costs and developer incentives associated with Phase II of the Emerald
Row apartment development, a manufacturing facility at 8142 S. 6th Street,
and public parking improvements.
This TID #11 Project Plan (“Plan”) Amendment No. 4 has been prepared in
compliance with Wis. Stats. §66.1105 . The District continues to comply with
the requirements for a “Mixed -use TID” wherein more than 50% of the land
area of the District, as amended, is suitable for a combination of industrial,
commercial, or residential uses. This amendment to the TID #11 Project Plan
is proposed to expand eligible project costs to include the following:
• Land acquisition
• Infrastructure improvements
• Developer incentives
• Planning, administrative, legal & professional costs
• Park improvements
Project Plan Amendment No. 4 is proposed to update the authorized project
costs within TID #11 to reflect current development priorities and
implementation needs. This amendment adjusts project costs to better align
with planned and ongoing development within the District. This amendment
does not involve any boundary additions or subtractions. Revised cost
categories include, but are not limited to, public street and infrastructure

improvements, land acquisition, developer incentives, planning,
administrative, legal, and other professional services, street rehabilitation and
reconstruction, and selected public amenity enhancements.
The Project Plan authorizes the expenditure of funds for eligible project costs
within a one ‑half mile radius of the TID boundary. This Project Plan
Amendment increases authorized project costs by $12,319,022 and addresses
only those elements or subject areas, as required by statute, that are directly
affected by the amendment.
In addition, the overall level of authorized spending has been increased from
prior amended Project Plan s to better reflect actual development within the
existing boundary and expected development within the TID area.
Consistent with the goals and objectives of the District as set forth in this
Project Plan, all project expenditures are intended to promote orderly
development, stimulate commercial revitalization, support job creation,
enhance property values, and expand the property tax base of the City of Oak
Creek and the overlying taxing jurisdictions.
The authorization of additional positive tax increment from TID #11 for eligible
project costs will not affect the maximum life of TID #11 beyond its
termination date of April 3, 2032.
The following map illustrates the TID #11 boundaries for reference purposes
only. No changes have been or will be made with this amendment.

Section 3: Statement of Kind, Number and Location of
Proposed Projects
The City intends to implement this amendment to expand eligible project costs
to include additional infrastructure improvements, developer incentive
payments, land acquisition, and associated planning and administrative
expenses. While the project cost estimates below are considered a reasonable
estimate, the City reserves the right to adjust authorized expenditures higher
or lower as necessary. Accordingly, this amendment increases the overall level
of authorized spending under the Project Plan to more accurately reflect actual
development activity and anticipated project needs within the existing District
boundaries. The details below capture expenditures to date and all anticipated
future costs.
1. INFRASTRUCTURE IMPROVEMENTS
TOTAL: $28,620,000
DESCRIPTION: The City proposes to include project costs for public
infrastructure improvements necessary to support development of Drexel
Town Square within the District. Eligible improvements may include roadways,
sanitary sewer, water facilities, storm sewer systems and related stormwater
management features, along with associated design, engineering, and
construction-related costs.
2. DEVELOPER INCENTIVES
TOTAL: $26,750,000
DESCRIPTION: Direct developer assistance and incentives may be provided
through the use of tax incremental financing (TIF) to support and leverage
viable development opportunities within the District.
3. LAND ACQUISITION
TOTAL: $2,650,000
DESCRIPTION: The City may acquire property located within the TID boundary
or within one-half mile of the TID boundary, subject to the availability of tax
increment.
4. PLANNING, ADMINISTRATIVE, LEGAL & PROFESSIONAL COSTS

5. PARK IMPROVEMENTS
TOTAL: $108,000
DESCRIPTION: The City may make improvements to public places and
amenities including public art and a pocket park behind UW Credit Union.
Section 4: Detailed List of Project Costs
1. INFRASTRUCTURE IMPROVEMENTS $28,620,000
2. DEVELOPER INCENTIVES/LOANS $26,750,000
3. LAND ACQUISITION $2,650,000
4. PLANNING, ADMINISTRATIVE, LEGAL & PROFESSIONAL COSTS $2,750,000
5. PARK IMPROVEMENTS $108,000
ESTIMATED TOTAL $60,878,000
The project cost is based on current prices and preliminary estimates. The City
reserves the right to increase this cost to reflect inflationary increases and
other uncontrollable circumstances between the creation /amendment of the
TID and the time of construction. The tax increment allocation is preliminary
and is subject to adjustment based upon the implementation of the Plan.
This Plan is not meant to be a budget nor an appropriation of funds for specific
projects, but a framework within which to manage projects. All costs included
in the Plan are estimates based on the best information available. The City
retains the right to delete or pursue future projects listed in the prior
paragraph, and shown on the map, or change the scope and/or timing of
projects implemented as they are individually authorized by the City Council,
without amending the Plan.
The Plan authorizes the expenditure of funds for project costs within a 1/2 -
mile radius of the TID boundary.

Section 5: Economic Feasibility
To evaluate the continued economic feasibility of TID #11 pursuant to this
amendment, it is necessary to project the amount of tax revenue and surplus
tax increment that can be reasonably generated over the remainder of its legal
life.
Included in Exhibit A is the TID #11 proforma analyses labeled “Hypothetical
Cash Flow Proforma ”. This proforma analyzes existing expenses and new
projects costs against projected TID revenue, pursuant to this current TID
#11 Project Plan Amendment. Tax revenue is conservatively estimated based
on existing or actual increment through January 1, 202 5. The District is
projected to receive tax increment revenue through 2032; however, debt
service obligations will continue beyond that period, with final repayment
anticipated in 2037.
Section 6: Method of Financing and Timing of When Costs
are to be Incurred.
The City plans to fund project costs with cash received from future TID #1 1
tax increments and to issue a developer grant/loan to provide direct or indirect
financing for the projects to be undertaken. The following is a list of the types
of obligations the City may choose to utilize.
General Obligation (G.O.) Bonds or Notes (BAN, NAN, TAN)
The City may issue G.O. Bonds or Notes to finance the cost of projects
included within this Plan. Wisconsin Statutes limit the principal amount of
G.O. and State Trust Fund Loan debt that a community may have outstanding
at any point in time to an amount not greater than five percent of its total
equalized value (including increment values).
Community Development Authority Lease Revenue Bonds:
Pursuant to Section 66.1335 Wisconsin Statutes (i.e., the “Community
Development Authority Law”) the City may issue Community Development
Authority Lease Revenue Bonds to finance projects included within this Plan.
Lease Revenue Bonds are not general obligations of the City and therefore
do not count against the City’s borrowing capacity. To the extent tax
increments collected are insufficient to meet the annual debt service
requirements of the revenue bonds, the City may be subject to either a
permissive or mandatory requirement to appropriate on an annual basis a
sum equal to the actual or projected shortfall.
City of Oak Creek
TID #11 Project Plan Amendment
11
Tax Increment Revenue Bonds
The City has the authority to issue revenue bonds secured by the tax
increments to be collected. These bonds may be issued directly by the City or
as a Lease Revenue Bond by a Community Development Authority (CDA). Tax
Increment Revenue Bonds and Lease Rev enue Bonds are not general
obligations of the City and therefore do not count against the cities. borrowing
capacity. To the extent tax increments collected are insufficient to meet the
annual debt service requirements of the revenue bonds, the City may be
subject to either a permissive or mandatory requirement to appropriate on an
annual basis a sum equal to the actual or projected shortfall.
Utility Revenue Bonds
The City can issue revenue bonds to be repaid from revenues of the sewer
and/or water systems, including revenues paid by the City that represent
service of the system to the city. There is neither a statutory nor constitutional
limitation on the amount of revenue bonds that can be issued, however, water
rates are controlled by the Wisconsin Public Service Commission and the City
must demonstrate to bond underwriters its ability to repay revenue debt with
the assigned rates. To the extent the City utilizes utility revenues other than
tax increments to repay a portion of the bonds, the City must reduce the total
eligible project costs in an equal amount.
Board of Commissioners of Public Lands State Trust Fund Loans
The City may issue State Trust Fund Loans to finance the cost of Projects
included within this Plan. Wisconsin Statutes limit the principal amount of
State Trust Fund Loan and GO debt that a community may have outstanding
at any point in time to an amount not greater than five percent of its total
equalized value (including increment values).
Bonds Issued to Developers (“Pay as You Go” Financing)
The City may issue a bond to one or more developers who provide financing
for projects included in this Plan. Repayment of the amounts due to the
developer under the bonds are limited to an agreed percentage of the
available annual tax increments collected that result from the improvements
made by the developer. To the extent the tax increments collected are
insufficient to make annual payments, or to repay the entire obligation over
the life of the District, the City’s obligation is limited to not more tha n the
agreed percentage of the actual increments collected. Bonds issued to
developers in this fashion are not general obligations of the City and therefore
do not count against the City’s borrowing capacity.

Federal/State Loan and Grant Programs
The State and Federal governments often sponsor grant and loan programs
that municipalities may potentially use to supplement TID expenditures or
provide financing for capital costs which positively impact the district. These
programs include Wisconsin Com munity Development Block Grants, Rural
Development Administration Community Facility Loan/Grants, Transportation
Economic Assistance Grants, and Economic Development Administration
Grants. These programs require local match funding to ensure State and
Federal participation in the project.
The actual amount of debt issuance will be determined by the City at its
convenience and as dictated by the nature of the projects as they are
implemented.
Plan Implementation
Projects identified will provide the necessary anticipated governmental
services to the area, and appropriate inducements to encourage development
of the area. The City anticipates making total project expenditures, including
the amendment, of approximatel y $60,878,000 to undertake the projects
listed in this Project Plan. The expenditure period of this District has 1 year
remaining to incur new projects or developments. The projects to be
undertaken pursuant to this Project Plan are expected to be financed primarily
with tax increments. The City reserves the right to alter the implementation
of this Plan to accomplish this objective. Interest rates projected are based on
current market conditions. Municipal interest rates are subject to constantly
changing market conditions. In addition, other factors such as the loss of tax-
exempt status of municipal bonds or broadening the purpose of future tax -
exempt bonds would affect market conditions. Actual interest expense will be
determined once the methods of financing have been approved, and securities
or other obligations are issued.
If financing as outlined in this Plan proves unworkable, the City
reserves the right to use alternate financing solutions for the projects
as they are implemented.
Section 7: Annexed Property
There are no lands proposed for inclusion within the TID that were annexed
by the city on or after January 1, 2004 or during the preceding three -year
period.

Section 8: Proposed Changes in Zoning Ordinances
Any changes in zoning that may take place throughout the life of the TID will
be consistent with the City’s Comprehensive Land Use Plan – Future Land Use
Map.
Section 9: Proposed Changes in Master Plan, Map, Building
Codes, and City Ordinances
The City does not anticipate that the TID will require any changes in the
master plan, map, building codes, and City ordinances to implement this
Project Plan. The proposed development and uses are consistent with the
adopted Oak Creek Comprehensive Plan.
Section 10: Relocation
The City does not anticipate the need to relocate persons or businesses in
conjunction with this Plan . In the event relocation or the acquisition of
property by eminent domain becomes necessary at some time during the
implementation period, the City will follow applicable state statues as
required in Wisconsin Statutes Chapter 32.
Section 11: Orderly Development of the City
The TID will enable the City to undertake projects in furtherance of the stated
objectives of its Comprehensive Plan and other planning documents. To this
extent, the continuation of the TID promotes the orderly development of the
City.
Section 12: A List of Estimated Non-Project Costs
Non-Project costs are public works projects that only partly benefit the TID
or are not eligible to be paid with tax increment, or costs not eligible to be
paid with Tax Incremental Financing funds. The City does not anticipate any
non-project costs for the TID.

TID #12 Project Plan Amendment
4
Section 2: Introduction and Description of Project Plan
Amendment
Tax Increment District #12 (the “TID”) was created on July 19, 2016 for the
purpose of promoting private development in the Drexel Avenue corridor
consistent with the City’s development and redevelopment plans.
In 2019, as part of the first amendment to the Project Plan, TID #12 was
expanded to the south and east of the original boundary to accommodate
additional projects and to capture the significant increment potential
associated with several large-scale development proposals. Since its creation
and subsequent amendment, development activity within the District has
progressed and additional projects are anticipated.
This TID #12 Project Plan Amendment No. 2 has been prepared in compliance
with Wis. Stats. §66.1105 . The District continues to comply with the
requirements for a “Mixed-use TID” wherein more than 50% of the land area
of the District, as amended, is suitable for a combination of industrial,
commercial, or residential uses. This amendment to the TID #12 Project Plan
(“Plan”) is proposed to expand eligible project costs to include the following:
• Land acquisition
• Infrastructure improvements
• Developer incentives
• Park improvements
In addition, the overall level of authorized spending has been increased from
the first amended Project Plan to better reflect actual development within the
existing boundary and expected development within the TID area.
The Plan authorizes the expenditure of funds for project costs within a 1/2 -
mile radius of the TID boundary. This Project Plan Amendment increases
authorized project costs by $ 31,068,234 and addresses only those elements
or subject areas, as required by statute, that are directly affected by the
amendment. All other subject areas remain unchanged and can be referenced
in the original TID #12 Project Plan or the subsequent am endment. This
amendment does not remove any projects contemplated in the original TID
#12 Project Plan or subsequent amendment.

The authorization of additional positive tax increment from TID #12 for eligible
project costs will not affect the maximum life of TID #12 beyond its
termination date of July 19, 2036.
The following map illustrates the TID #12 boundaries for reference purposes

TOTAL: $19,400,000
DESCRIPTION: The City proposes to include project costs for public
infrastructure improvements necessary to support development within the
District. Eligible improvements may include roadways, sanitary sewer, water
facilities, storm sewer systems and related stormwater management features,
along with associated design, engineering, and construction-related costs.
2. DEVELOPER INCENTIVES
TOTAL: $30,750,000
DESCRIPTION: Direct developer assistance and incentives may be provided
through the use of tax incremental financing (TIF) to support and leverage
viable development opportunities within the District.
3. LAND ACQUISITION
TOTAL: $8,000,000
DESCRIPTION: The City may acquire property located within the TID boundary
or within one-half mile of the TID boundary.
4. PLANNING, ADMINISTRATIVE, LEGAL & PROFESSIONAL COSTS
TOTAL: $1,000,000
DESCRIPTION: The City will allocate $50,000 annually over the life of the
District for planning, administration, legal and professional costs as indicated
in the original Project Plan.
City of Oak Creek
TID #12 Project Plan Amendment
8
4. PARK IMPROVEMENTS
TOTAL: $1,000,000
DESCRIPTION: The City may make improvements to public places and
amenities by the stormwater pond near IKEA.
Section 4: Detailed List of Project Costs
1. INFRASTRUCTURE IMPROVEMENTS $19,400,000
2. DEVELOPER INCENTIVES $30,750,000
3. LAND ACQUISITION $8,000,000
4. PLANNING, ADMINISTRATIVE, LEGAL & PROFESSIONAL COSTS $1,000,000
5. PARK IMPROVEMENTS $1,000,000
ESTIMATED TOTAL $60,150,000

To evaluate the continued economic feasibility of TID #12 pursuant to this
amendment, it is necessary to project the amount of tax revenue and surplus
tax increment that can be reasonably generated over the remainder of its legal
life.
Included in Exhibit A is the proforma labeled “ Hypothetical Cash Flow
Proforma” analyzes existing expenses and new projects costs against
projected TID revenue, pursuant to this current TID #12 Project Plan
Amendment. Tax revenue is conservatively estimated based on existing or
actual increment through January 1, 2025. In 2037, the final year of revenue
collection for the TID, it is projected to have repaid all expenditures and is left
with a positive surplus balance.
Section 6: Method of Financing and Timing of When Costs
are to be Incurred.
The City plans to fund project costs with cash received from future TID # 12
tax increments and to issue a developer grant/loan to provide direct or indirect
financing for the projects to be undertaken.
Tax Increment Revenue Bonds
The City has the authority to issue revenue bonds secured by the tax
increments to be collected. These bonds may be issued directly by the City or
City of Oak Creek
TID #12 Project Plan Amendment
11
as a Lease Revenue Bond by a Community Development Authority (CDA). Tax
Increment Revenue Bonds and Lease Revenue Bonds are not general
obligations of the City and therefore do not count against the cities. borrowing
To the extent the tax increments collected are
insufficient to make annual payments, or to repay the entire obligation over
the life of the District, the City’s obligation is limited to not more than the
agreed percentage of the actual increments collecte d.
These
programs include Wisconsin Community Development Block Grants, Rural
Development Administration Community Facility Loan/Grants, Transportation

Economic Assistance Grants, and Economic Development Administration
Grants. These programs require local match funding to ensure State and
Federal participation in the project.
The actual amount of debt issuance will be determined by the City at its
convenience and as dictated by the nature of the projects as they are
implemented.
Plan Implementation
Projects identified will provide the necessary anticipated governmental
services to the area, and appropriate inducements to encourage development
of the area. The City anticipates making total project expenditures of
approximately $60,150,000 to undertake the projects listed in this Project
Plan. The expenditure period of this District has 5 years remaining to incur
new projects or developments. The projects to be undertaken pursuant to this
Project Plan are expected to be financed primarily with tax increments. The
City reserves the right to alter the implementation of this Plan to accomplish
this objective. Interest rates projected are based on current market
conditions. Municipal interest rates are subject to constantly changing market
conditions. In addition, other factors such as the loss of tax-exempt status of
municipal bonds or broadening the purpose of future tax-exempt bonds would
affect market conditions. Actual interest expense will be determined once the
methods of financing have been approved, and securities or other obligations
are issued.
If financing as outlined in this Plan proves unworkable, the City
reserves the right to use alternate financing solutions for the projects
as they are implemented.
Section 7: Annexed Property
There are no lands proposed for inclusion within the TID that were annexed
by the city on or after January 1, 2004 or during the preceding three-year
period.
Section 8: Proposed Changes in Zoning Ordinances
Any changes in zoning that may take place throughout the life of the TID will
be consistent with the City’s Comprehensive Land Use Plan – Future Land Use
Map.
City of Oak Creek
TID #12 Project Plan Amendment
13
The City does not anticipate any
non-project costs for the TID.

on March 6, 2018. TID #15 was created by the City of Oak Creek to redevelop
blighted and underutilized properties near W. Drexel Avenue and S. 6th
Street, just north of Drexel Town Square. TID #15 prior to and including this
amendment is considered a “ Blight” based on the identification and
classification of the property included in the TID. The amended TID boundary
will keep the TID #15 as a Blight District.
Wisconsin Statutes Section 66.1105(4)(h)2 allows a municipality to modify
the TID boundaries no more than four times during the life of the TID. This
amendment is the first territory amendment in TID #15.
This first amendment involves the subtraction of two parcels totaling 2.27
acres within the TID, and the addition of three parcels totaling approximately
20.17 acres. An additional 14.66 acres of wetlands are intentionally not
included in the boundary amendment due to their environmental
characteristics. These parcels are planned to be subtracted/added in the
efforts to facilitate development and redevelopment that but for TIF, would
not happen in the district. In accordance with Wisconsin Statute Section
66.1105(4)(h), to add the parcels w ithin TID #15, a contiguous connection
via parcels of land must be made to the existing TID #15 boundary. North
Branch Oak Creek is being used to maintain a contiguous connection for this
TID as illustrated in the Amended Boundary Map within this Project Plan.
The TID #15 territory amendment includes both the subtraction and addition
of property, resulting in a net subtraction, with the net change to the base
value being negative. This is the only permissible territory amendment when
a municipality exceeds the 12% TID value threshold.
The City confirms the estimate of approximately 2.38% of the territory within
the district, as amended, will be devoted to retail business at the end of the
district’s maximum expenditure period, pursuant to Wisconsin Statutes
Sections 66.1105(5)(b) and 66.1105(6)(am)1.
This first Project Plan and Territory Amendment only address the elements or
subject areas (required by Statute) that are affected by the territory and
Project Plan Amendment. All other subject areas remain unchanged and can
be referenced in the original TID#15 Project Plan.

The maps in section 3 show the district before and after the amendment ,
reflecting the subtraction and addition of new territory, and demonstrate that
TID #15, as well as the entire District area, will remain contiguous.
Section 6 of this Project Plan contains the list of specific parcels to be
subtracted/added with this first amendment.
The City anticipates additional project cost expenditures related towards the
amendment of approximately $4,800,000 not including interest/financing
costs during the TID’s 22-year expenditure period. This amendment t o the
TID #15 Project Plan is proposed to expand eligible project costs to include
the following:
• Infrastructure improvements
• Developer incentives
• Planning, administrative, legal & professional costs
• Park improvements
As part of the Project Plan, developer incentives may be provided by the City
to developers of property within the TID in the form of cash grants.
As a result of the amendment of this TID, the City projects a preliminary and
conservative cash flow analysis indicating $6,753,455 in tax increments. The
TID increment will primarily be used to pay the administrative expenses and
project development incentives.
Exhibit A demonstrates r evenues for TID #15 are generally trending toward
meeting our expenditure commitments for projects within the TID boundaries.
Although the final year of revenues for TID #15 remains several years off
(2046), any additional property tax increment that can be captured by the TID
would help to meet the expenditure commitments ahead of time and
potentially help with additional redevelopment efforts within the TID. TID #15
has a maximum statutory life of 27 years, closing no later than March 6, 2045,
with final tax collection in 204 6. The final year to incur TIF related
expenditures is 20 40. Based on current cash flow projection, TID #15 is
expected to close by the end of its maximum statutory life.
The legal description in Exhibit C describes the full TID #15 territory updated
for the amended area.

Section 7: Equalized Valuation Test
The following calculations are presented for informational purposes
regarding the City’s position relative to the 12% equalized valuation
threshold under s. 66.1105(4)(gm)4.c., Wis. Stats. The proposed
amendment to TID #15 includes both the removal and addition of parcels,
resulting in an overall net subtraction of territory and a corresponding
decrease in base value. As such, the amendment is permitted under state
law despite the City being ove r the 12% threshold, and it brings a net
reduction to the total value subject to the limitation. With the TID #15
amendment, the value increment of all existing Tax Increment Districts will
be approximately 13.24%.
Valuation Test Compliance Calculation
2025 Equalized Valuation (TID IN) $ 6,385,876,600
Limit for 12% Test $ 766,305,192
Increment Value of Existing TIDs $ 845,760,700
Projected Base Value of TID Amendment $ (408,600)
Total Value Subject to Test $ 845,352,100
($845,352,100 > $766,305,192)
Section 8: Statement of Kind, Number and Location of
Proposed Projects
The City intends to implement this amendment to expand eligible project
costs to include additional infrastructure improvements, developer incentive
payments, associated planning and administrative expenses , and park
improvements. While the project cost estimates below are considered a
reasonable estimate, the City reserves the right to adjust authorized
expenditures higher or lower as necessary. Accordingly, this amendment
increases the overall level of authorized spending under the Project Plan to
more accurately reflect actual development activity and anticipated project
needs within the existing and amended District boundaries. The details below
capture expenditures to date and all anticipated future costs.
1. INFRASTRUCTURE IMPROVEMENTS
TOTAL: $1,575,000
DESCRIPTION: The City proposes to include project costs for public
infrastructure improvements within the District and the associated one -half

mile boundary area identified in the TID Project Plan. Eligible costs may
include roadways, streetscape enhancements, sanitary sewer, water facilities,
storm sewer systems, stormwater management features, and related design,
engineering, and construction costs. These expenditures may support
development but are not limited to development-related projects.
2. DEVELOPER INCENTIVES
TOTAL: $3,000,000
DESCRIPTION: Direct developer assistance and incentives may be provided
through the use of tax incremental financing (TIF) to support and leverage
viable development opportunities within the District.
3. PLANNING, ADMINISTRATIVE, LEGAL & PROFESSIONAL COSTS
TOTAL: $360,000
DESCRIPTION: The City will allocate $ 7,500 annually over the life of the
District for planning, administration, legal and professional costs as indicated
in the original Project Plan.
4. PARK IMPROVEMENTS
TOTAL: $750,000
DESCRIPTION: The City may make improvements to public places and
amenities at the Oak Creek Little League Complex.

1. INFRASTRUCTURE IMPROVEMENTS $1,575,000
2. DEVELOPER INCENTIVES $3,000,000
3. PLANNING, ADMINISTRATIVE, LEGAL & PROFESSIONAL COSTS $360,000
4. PARK IMPROVEMENTS $750,000
ESTIMATED TOTAL $5,685,000
The project cost is based on current prices and preliminary estimates. The City
reserves the right to increase this cost to reflect inflationary increases and
other uncontrollable circumstances between the creation/amendment of the
TID and the time of construction.
The City
retains the right to delete or pursue future projects listed in the prior
paragraph, and shown on the map, or change the scope and/or timing of
projects implemented as th ey are individually authorized b y the Common
Council, without amending the Plan.
The Plan authorizes the expenditure of funds for project costs within a 1/2 -
mile radius of the TID boundary.
Section 11: Economic Feasibility
The information and exhibits contained within this Project Plan demonstrate
that the proposed TID is economically feasible insofar as:
• The City has available to it the means to secure the necessary financing
required to accomplish the projects contained within this Plan. A listing of
“Method of Financing and Timing of When Costs are to be Incurred” follows.
• The development anticipated to occur because of the implementation of
this Plan will generate sufficient tax increments to pay for the cost of the
projects. This Plan identifies the following: 1) the development expected
to occur, 2) a projection of tax increments to be collected resulting from
that development and other economic growth within the TID, and 3) a

15
cash flow model demonstrating that the projected tax increment
collections and all other revenues available such as debt issuance will be
sufficient to pay all project costs.
To evaluate the economic feasibility of TID #15 it is necessary to project the
amount of tax revenue that can be reasonably generated over the legal life
of the TID. Included in Exhibit A is a proforma analysis of TID #15 . The
proforma analyzes expenses based on Project Plan costs of TID #15 against
projected TID revenue. Tax revenue is conservatively estimated. Cash
received from future TID #15 tax increments will be used to fund project
costs and implementation of this Plan will also require that the City issue a
developer grant/loan to provide direct or indirect financing for the Projects to
be undertaken. In 2046, the final year of revenue collection for the TID, it is
projected to have repaid all expenditures and is left with a positive su rplus
balance.
Section 12: Method of Financing and Timing of When Costs
are to be Incurred.
The City plans to fund project costs with cash received from future TID #15
tax increments and to issue a developer grant/loan to provide direct or indirect
financing for the Projects to be undertaken.
TID #15 Territory Amendment #1 Project Plan & District Boundary
16
Tax Increment Revenue Bonds
The City has the authority to issue revenue bonds secured by the tax
increments to be collected. These bonds may be issued directly by the City or
as a Lease Revenue Bond by a Community Development Authority (CDA). Tax
Increment Revenue Bonds and Lease Revenue Bonds are not general
obligations of the City and therefore do not count against the cities. borrowing
There is neither a statutory nor constitutional
limitation on the amount of revenue bonds that can be issued, however, water
rates are controlled by the Wisconsin Public Service
Commission and the City must demonstrate to bond underwriters its ability to
repay revenue debt with the assigned rates. To the extent the City utilizes
utility revenues other than tax increments to repay a portion of the bonds, the
City must reduce the total eligible project costs in an equal amount.
To the extent the tax increments collected are
insufficient to make annual payments, or to repay the entire obligation over
the life of the District, the City’s obligation is limited to not more than the
agreed percentage of the actual increments collecte d.

17
provide financing for capital costs which positively impact the district. These
programs include Wisconsin Community Development Block Grants, Rural
Development Administration Community Facility Loan/Grants, Transportation
Economic Assistance Grants, and E conomic Development Administration
The City anticipates making total project expenditures of
approximately $5,685,000 plus financing/interest costs to undertake the
projects listed in this Project Plan. The Expenditure Period of this District has
13 years remaining to incur new projects or developments.
Section 13: Annexed Property
There are no lands proposed for inclusion within the TID that were annexed
by the City on or after January 1, 2004 or during the preceding three -year
period.
Section 14: Proposed Changes in Zoning Ordinances
Development within the District may require future amendments to the City’s
zoning map and/or zoning ordinances . Any such changes will be completed
in accordance with applicable laws and City procedures and will support the
goals of this Project Plan Amendment.
City of Oak Creek
TID #15 Territory Amendment #1 Project Plan & District Boundary
18
Section 15: Proposed Changes in Master Plan, Map,
Building Codes, and Town Ordinances
Development within the District may require future amendments to the City’s
Comprehensive Plan and Future Land Use Map. Any such amendments will be
considered through the City’s established review process. No specific changes
to building codes or other City ordinances are anticipated at this time.
Section 16: Relocation
The City does not anticipate the need to relocate persons or businesses in
conjunction with this Plan . In the event relocation or the acquisition of
property by eminent domain becomes necessary at some time during the
implementation period, the City will follow applicable state statues as
required in Wisconsin Statutes Chapter 32.
Section 17: Orderly Development of the City
The amendment of the TID will enable the City to undertake projects in
furtherance of the stated objectives of its Comprehensive Plan and other
planning documents. To this extent, the TID promotes the orderly
development of the City.
Section 18: A List of Estimated Non-Project Costs
Non-Project costs are public works projects that only partly benefit the TID
or are not eligible to be paid with tax increment, or costs not eligible to be
paid with Tax Incremental Financing funds. The City does not anticipate any
non-project costs for the TID.
Section 19: City Attorney Opinion
Exhibit B contains a signed opinion from the City Attorney advising whether
the Project Plan A mendment is complete and complies with Section

PLAN COMMISSION REPORT
Item No. 10
Proposal: Site Plan & Architectural Review – Colder’s Furniture & Ashley HomeStore
Description: Review site, architectural, and related plans for site and exterior building modifications
on the property at 9725 S. 13th Street.
Applicant(s): Sam Winterfeldt, Keller Inc. & Bill Fonti, Boston, Inc.
Address(es): 9725 S. 13th Street (5th Aldermanic District)
Suggested Motion : That the Plan Commission approves the site, architectural, and related plans for site
and exterior building modifications to Colder’s Furniture, an existing business located
at 9725 S. 13th Street with the following conditions:
1. That the parking lot be striped to clearly delineate all parking stalls and the
pedestrian walkway is striped in accordance with the approved site plan.
2. That the landscape plan be revised prior to the issuing of any permits to include
foundation landscaping with a minimum width of seven (7) feet along the front
and exterior side yards for at least eighty percent (80%) of the length of the
building façade, excluding areas occupied by walkways and driveways. The
revised landscape plan shall also include a total of eight (8) replacement trees, as
required by the City's Tree Preservation Ordinance.
3. That the lighting plan be revised prior to the issuing of any permits to
demonstrate that all outdoor lighting fixtures on the site are full-cutoff fixtures
with the light source fully shielded and directed downward. Light trespass shall
not exceed 0.5 horizontal footcandles, measured at the property line at a height
of four (4) feet above grade.
4. That the plans be revised, prior to the issuance of any permits, to either: (a)
provide screening for all loading docks and overhead doors along the east
elevation in accordance with Section 17.0502(c)(3) of the Municipal Code; or (b)
if such screening is determined by the Director of Community Development to
be infeasible due to site constraints, provide additional landscaping beyond the
minimum requirements of Section 17.0505 of the Municipal Code to
compensate the visual impact of the loading docks and overhead doors, as
approved by the Director of Community Development.
5. That all revised plans (landscaping, lighting, etc.) are submitted in digital format
for review and approval by the Department of Community Development prior
to submitting any permit applications.

Item No.: 10
Tax Key(s): 904-9011-001
Lot Size(s): 15.618 acres
Background: The Applicant is requesting approval of plans to modify the exterior of the existing 157,392-
square-foot retail and warehouse building occupied by Colder's Furniture at 9725 S. 13th Street. The
proposed modifications are associated with the addition of the Ashley HomeStore brand to the existing
Colder's Furniture location. The project also includes improvements to the existing parking lot, site lighting,
and landscaping.
District Specific Standards, Use Specific Standards, & Land Use: While the proposed development is
consistent with the B-4 General Business District, the Commercial Planned Development (CPD) approved
in November 1990 (Ordinance No. 1489), and the City's Comprehensive Plan, the proposed site
improvements do not fully comply with the requirements of Chapter 17 of the Municipal Code. Specifically,
the proposed landscaping and lighting improvements do not meet applicable code standards, as discussed
in greater detail in this report. Accordingly, staff cannot recommend approval of the proposed plans as
submitted.
Design: As shown on the submitted plans, the project includes several exterior modifications to the existing
building. A new customer entrance for Ashley HomeStore is proposed on the west elevation and will feature
storefront doors, projecting wall elements, and a canopy to create a prominent entrance visible from the
adjacent parking lot and Interstate 94.
Additional façade enhancements are proposed along the west elevation, including a raised parapet with
horizontal and vertical articulation along the lower roofline. The applicant also proposes removing portions
of the existing precast wall panels and installing four (4) glass curtain wall windows and one (1) glass curtain
wall entrance to serve the Ashley HomeStore. On the east elevation, eight (8) aluminum storefront windows
are proposed for Colder's Furniture. Collectively, these improvements will introduce additional glazing to
portions of the building that currently have limited transparency.

The proposal also includes painting all remaining precast wall panels, service doors, and overhead doors
white on all building elevations. The existing loading docks along S. 13th Street will remain. Although
screening the loading area is not feasible due to site constraints, painting the overhead loading dock doors
to match the adjacent wall surfaces will reduce their visual prominence.
Parking: Pursuant to the Commercial Planned Development (CPD) approved in 1990, one (1) parking space
is required for every 600 square feet of sales floor area. With the addition of Ashley HomeStore, the total
sales floor area will be 93,456 square feet, requiring a minimum of 156 parking spaces. The site currently
provides 373 parking spaces, which exceeds the minimum parking requirement.
The striping within the existing parking lot has significantly faded, making parking stalls difficult to identify.
Accordingly, staff recommends, as a condition of approval, that the parking lot be restriped to clearly
delineate all parking stalls and include a striped pedestrian walkway leading to the proposed customer
entrance to improve pedestrian and vehicular safety.
Off-Street Loading: Pursuant to Section 17.0502(c)(3) of the Municipal Code, loading docks and overhead
doors may face a street right-of-way provided they are screened through architectural and/or landscaping
methods approved by the Plan Commission. The existing building includes loading docks and overhead
doors on both the east elevation facing S. 13th Street and the west elevation facing Interstate 94, both of
which are street rights-of-way. These loading areas are currently unscreened and visible from the public
right-of-way.
To improve screening of the loading area along the west elevation, the Applicant proposes landscaping the
existing parking lot median west of the building with a combination of trees and shrubs that will reach a
mature height of approximately 10 to 25 feet, providing visual screening from Interstate 94.
Screening the loading docks and overhead doors along the east elevation may not be feasible because
existing pavement extends from the building to the east property line, leaving insufficient space to install
screening. To reduce their visual impact, the Applicant proposes painting the overhead loading dock doors
to match the adjacent wall surfaces.
The landscape plan includes evergreen trees with an anticipated mature height of 40 to 60 feet along the
east side of the building as part of the required building foundation landscaping. While these trees will soften
the appearance of the area, they will not effectively screen the loading docks and overhead doors from
public view.
Pursuant to the Zoning Code, the loading docks and overhead doors must be screened from public view.
Because adequate screening may not be feasible due to the site's physical constraints, the Applicant may
instead provide additional landscaping beyond the minimum building foundation landscaping requirements
to help compensate for the lack of screening. A condition of approval has been included requiring either

Item No.: 10
code-compliant screening of the loading docks and overhead doors or the installation of additional
landscaping, subject to staff approval, in lieu of screening.
Lighting: The Applicant proposes replacing all existing perimeter building wall-mounted lighting fixtures
with new energy-efficient LED fixtures. The replacement fixtures will be installed in the same locations as
the existing wall-mounted fixtures. In addition, six (6) architectural accent lights are proposed along the
west elevation of the building, as shown on the submitted lighting plan. All proposed wall-mounted
replacement fixtures and architectural accent lights comply with applicable City requirements.
No new or additional lighting is proposed for the parking lot west of the building or the access drive from
S. 13th Street. Pursuant to Section 17.0509(b)(1) of the Municipal Code, all outdoor lighting installed and
maintained on public or private property must comply with the general lighting standards established in
Section 17.0509(b).
As shown on the submitted photometric plan, existing lighting fixtures along the access drive near S. 13th
Street exceed the maximum allowable light trespass of 0.5 horizontal footcandles, measured four (4) feet
above grade at the property line, as required by Section 17.0509(b)(1)a of the Municipal Code. Although no
new lighting is proposed in these areas as part of this request, all existing site lighting, as well as any future
lighting installations, must comply with current Municipal Code requirements.
Accordingly, if the proposal is approved by the Plan Commission, staff recommends a condition of approval
requiring all site lighting to be brought into compliance with the Municipal Code prior to issuance of any
permits associated with the development. Any future installation or modification of site lighting shall
require the property owner or tenant to obtain the appropriate permits prior to commencing work.
Engineering: Engineering indicated no concerns. The Applicant will comply with all regulations and
requirements.
Access: The site currently has vehicular access from S. 13th Street, and no new or additional vehicle access
is proposed as part of this request. The Applicant proposes reconfiguring the sidewalk along the west side
of the building to accommodate both store entrances, improve ADA accessibility, and provide additional
space for landscaping between the sidewalk and the building. As previously noted, the parking lot will also
include a striped pedestrian walkway connecting the parking area to the proposed entrances to improve
customer and employee safety.
Signage: While there will be changes to signage on site, signage is part of this review. Any future signs must
comply with the Municipal Code, and the owner or tenant will need to apply for the necessary permits
before installing any additional signs on the property.
Environmental: The site does contain wetlands, floodplain and Primary Environmental Corridor (PEC) in
the northern portion of the site. None of what is proposed will encroach on any of these areas.
Oak Creek Plan Commission Report Meeting Date: July 28, 2026
Item No.: 10
Landscaping/Tree Preservation: Pursuant to Section 17.0505(b)(3) of the Municipal Code, all non-single-
family developments, except food processing facilities regulated by the U.S. Food and Drug Administration
(FDA), are required to provide building foundation landscaping. The landscaping required by this section is
in addition to any other landscaping requirements established in Chapter 17 of the Municipal Code.
Section 17.0505(b)(3)a–c further requires a minimum seven (7)-foot-wide building foundation landscape
area along front and exterior side yards, with landscaping installed along a minimum of 80 percent of the
building façade, excluding areas occupied by walkways and driveways.
The Applicant has submitted a landscape plan; however, the plan does not demonstrate compliance with
the building foundation landscaping requirements of Section 17.0505(b)(3). Accordingly, if the proposal is
approved by the Plan Commission, staff recommends a condition of approval requiring the Applicant to
revise the landscape plan to provide building foundation landscaping in accordance with the Municipal Code
prior to issuance of any permits.
During staff’s review of the proposed site and architectural modifications, it was observed that four (4)
mature trees along the west façade of the building had been removed since Google Street View imagery
was captured from Interstate 94 in August 2025. Pursuant to Section 17.0505(d) of the Municipal Code,
removed trees must be replaced at a ratio of two (2) replacement trees for each one (1) tree removed.
Therefore, a total of eight (8) replacement trees are required. The Municipal Code further specifies that
replacement trees may not be counted toward the minimum landscaping requirements; therefore, the
required replacement trees must be provided in addition to the landscaping otherwise required for the site.
The submitted landscape plan identifies only four (4) replacement trees proposed between the existing
parking lot and the west property line, which does not satisfy the City's tree preservation requirements.
Accordingly, providing the required eight (8) replacement trees has been included as a condition of
approval.
Fire Department: The Fire Department indicated no concerns. The Applicant must comply with all
regulations and requirements of the City of Oak Creek Fire Department.
Options/Alternatives: The Plan Commission has the discretion to approve plans as presented, approve with
specified conditions, or disapprove the proposal. Should the request not be approved, Plan Commissioners
must provide the Code Sections upon which the denial is based so that the Applicant may revise and
resubmit (if necessary).

RE: Plan Commission Review for Property Located at 9725 South 13 th Street.
Dear Plan Commission Members,
Thank you for your review of the proposed exterior façade and site plan modifications for a new Ashley
HomeStore location and an updated Colder’s Furniture façade. We appreciate the Plan Commission’s
willingness to work together to improve the community.
Boston Inc., an employee-owned company, is proposing a significant remodel of the existing Colder’s
Furniture building to accommodate an additional retail furniture tenant (Ashley HomeStore) and expand
its o=erings to the community. This project will consist of:
1. A clearly defined, highly visible customer entrance on the west wall for Ashley HomeStore,
featuring storefront doors, perimeter bump-out walls, and canopy.
2. A raised façade with horizontal and vertical articulation constructed along the lower roof portion
of the west wall.
3. Removal of precast wall panels and installation of (4) glass curtain wall windows and (1) glass
curtain wall entrance for Ashley HomeStore on the west and (8) aluminum storefront windows
for Colder’s east side, both to provide natural light into the retail space.
4. Painting of all remaining existing precast panels, service doors, and overhead doors on all sides
of the building. Since there is no feasible option for screening the existing loading docks facing
13 th Street, matching the color of the loading dock doors to the adjacent wall surfaces is
proposed to reduce their visibility and improve the overall aesthetic.
5. Reconfiguration of the sidewalk along the west side to accommodate both store entrances,
enhance ADA accessibility, and provide space for additional landscaping between the sidewalk
and the building.
6. Landscaping proposed along the west side of the building to complement the adjacent façade
updates and screen the loading docks facing I-94.
7. Replacement of perimeter building lighting with new energy-e=icient LED fixtures, along with
installation of (6) architectural accent lights on the west elevation to unify with the façade
design.
8. Restriping of existing parking spaces along with striping of a new pedestrian walkway to the
proposed entrance for customer and employee safety.
9. An interior remodel to separate Colder’s retail area from the Ashley retail areas through the
construction of display walls and pass-through openings. The interior remodel will also include
new finishes throughout the spaces and architectural features such as ceiling clouds, display
casework, and interactive elements.
We hope you are as enthusiastic about these improvements as the employee-owners of Boston Inc. and
Keller Inc., and we appreciate your support for this project.
Sincerely,
Sam Winterfeldt

INSTALLATION
The Skyline Wall Pack is designed for effortless installation, featuring a patent-pending
universal quick-mount bracket that enables hands-free wiring. This innovative bracket
securely holds the fixture in place while wiring connections are made, streamlining the
installation process. It is compatible with standard 3-1/2” to 4” round/octagonal, 4”
square, and single-gang masonry junction boxes, as well as vertical surface mounting
using lag bolts (supplied by others). The SBB option allows for 1/2” NPT conduit entry
points for surface conduit or through-branch wiring. The back box is an authorized
electrical wiring compartment. The Architectural Wall Spacer (AWS) enhances the
fixture’s aesthetic by creating a subtle floating effect while also helping to compensate
for minor wall surface irregularities.

PLAN COMMISSION REPORT
Item No.: 11
Proposal: Conditional Use Permit with Conditions and Restrictions – Midwest Fleet
Maintenance
Description: Review a request for a Conditional Use Permit with conditions and restrictions for
autobody/automotive mechanical repair, and outdoor storage.
Applicant(s): Dave Parker, Midwest Fleet Maintenance LLC
Address(es): 6925 S. 6th Street, Suite 100 (1st Aldermanic District)
Suggested
Motion :
That the Plan Commission recommends that the Common Council approves a
Conditional Use Permit for autobody/automotive mechanical repair, and outdoor
storage at Midwest Fleet Maintenance LLC, a proposed business to be located at 6925
S. 6th St., Ste 100 after a public hearing and subject to Conditions and Restrictions.
Owner(s): CROSSWEST BEECH OAK CREEK, LLC
Tax Key(s): 735-9045-000
Lot Size(s): 9.89 acres
Background: The Applicant is seeking approval of a Conditional Use Permit for an autobody/automotive
mechanical repair business, and outdoor storage at the property located at 6925 S. 6th Street, Suite 100.
The property, along with all adjacent parcels, is zoned M-1 Manufacturing. Under this zoning designation,
autobody/automotive mechanical repair, and outdoor storage are both permitted as Conditional Uses.
The Applicant will occupy approximately 13,000 square feet (Suite 100) of a roughly 35,000 square-foot
building. Approximately 6,800 square feet of maintenance shop space and 1,350 square feet of parts
storage area will be utilized for fleet maintenance and repair operations. Services will include, but are not

limited to, inspections, oil and fluid changes, brake and tire repair and replacement, and general fleet
maintenance. Approximately 4,900 square feet will be used for office operations, while the remaining
1,350 square feet will serve as warehouse storage. Outdoor activities will be limited to vehicle parking,
loading and unloading of parts and materials, temporary vehicle staging of customer’s equipment, and
related business operations.
The outdoor storage area will accommodate employee vehicles, customer fleet vehicles, tractors and
trailers, and service vehicles associated with the business operations. As indicated in the site plan, this will
be confined to the eastern third of the rear parking lot, located north of the building. The storage area is
not visible from any public roadways. The site is anticipated to generate approximately 30 to 50 truck trips
per business day.
The business will operate 24 hours a day Monday through Friday. It will employ seven (7) office staff
members and seven (7) shop personnel. That staff includes management, administrative staff, technicians,
mechanics, and support personnel.
The proposed site plan includes a total of 160 parking spaces for the building. Of these, 46 spaces (15 in
the front and 31 in the rear) are designated for Suite 100. According to the Municipal Code, a total of 39
parking spaces are required for the combined existing and proposed uses of suite 100.
Plan Commission may recall that portions of the outdoor storage area at the rear of the building are
surfaced with crushed recycled asphalt rather than traditional pavement. This condition is linked to past
environmental remediation efforts on the site. A previous use had resulted in soil contamination,
prompting the Wisconsin Department of Natural Resources (WDNR) to require the removal of
approximately 18,000 cubic yards of contaminated soil. While this removal addressed the majority of the
issue, some contaminated soil was allowed to remain under specific conditions. To ensure long-term
compliance, a deed restriction was recorded in September 2004. This restriction is binding on current and
future property owners and stipulates that any excavation, grading, or placement of structures or
improvements within the area covered by crushed recycled asphalt must be preceded by a soils
management plan and may require the WDNR to reopen the case file. As a result, any approval of
Conditional Use Permits for outdoor storage—such as that permitted under the contractor’s yard use—
must comply with the terms of the deed restriction. Crushed recycled asphalt may continue to be used in
these areas, provided that any expansion or alteration of parking or storage areas aligns with the conditions
outlined in the recorded deed restriction.
Options/Alternatives: If the Commission determines the proposed Conditional Use meets the
requirements of the Municipal Code, a public hearing may be scheduled as early as September 1, 2026.
Staff has also prepared Conditions and Restrictions for review (attached). The Plan Commission has the
discretion to recommend or not recommend Common Council approval of the Conditional Use Permit
request. Should the request not be recommended for Council approval, Plan Commissioners must provide
the Code Sections upon which the denial is based, and the Applicant may choose to request Council

approval without recommendation. In that case, the Council would have the authority to approve the
request, and remand the proposal back to the Plan Commission for Conditions and Restrictions.

Proposal: Certified Survey Map – Sikh Temple of Wisconsin
Description: Review a Certified Survey Map (CSM) reconfiguring the properties at 7502 and 7512
S. Howell Ave.
Applicant(s): Balhair Dulai; Sikh Temple of Wisconsin
Address(es): 7502 and 7512 S. Howell Ave. (1st Aldermanic District)
Suggested
Motion :
That the Plan Commission recommends to the Common Council that the Certified
Survey Map reconfiguring the properties at 7502 and 7512 S. Howell Ave. be approved
with the following condition:
1. That all technical corrections, including, but not limited to spelling errors, minor
coordinate geometry corrections, and corrections required for compliance with
the Municipal Code and Wisconsin Statutes, are made prior to recording.
Owner(s): Sikh Temple of Wisconsin
Tax Key(s): 781-9034-000; 781-9033-000
Lot Size(s): 7502 S. Howell Ave. – 2.45 Acres; 7512 S. Howell Ave. – 9.49 Acres
Background: The Applicant is seeking a recommendation for approval of a Certified Survey Map (CSM) to
reconfigure the properties at 7502 and 7512 S. Howell Ave. The rear parcel, 7502 S. Howell Ave., was created
as Outlot 1 of CSM 9090. The proposed CSM is intended to enable potential future expansion of the existing
Sikh Temple of Wisconsin.

Oak Creek Plan Commission Report Meeting Date: July 28, 2026
Item No.: 12
Proposed Certified Survey Map: The proposed lot line adjustment would shift the shared property line
of both existing parcels approximately 93.5 feet to the east. This creates a 250-foot north-south property
line extending from the north property line to the center of the parcels. The proposed lot line would
increase the rear setback to the northeast corner of the principal structure from approximately 23 feet to
approximately 84 feet. The proposed setback from the existing stormwater retention pond would be
approximately 25 feet.
District Bulk & Dimensional Standards, Lot Design Standards, & Land Use: Each of the proposed lots
meets the requirements of I-1 Institutional District, as defined in Section 17.0301(b) of the Municipal Code.
There are no standards for minimum lot size or minimum lot width in the I-1 District. As previously stated,
the lot line adjustment creates a rear setback of approximately 84 feet, bringing the parcel into compliance
with the Code’s rear setback minimum for the I-1 District of 50 feet. The proposed lots remain under the
maximum building coverage of 30% and maximum lot coverage of 70%. The proposed property line is set
back approximately 25 feet from existing wetlands, maintaining both a minimum 15-foot setback and five-
foot undisturbed buffer. The Comprehensive Plan land use designation for the existing parcel is
Public/Semi-Public.
Engineering & Fire Department: Engineering and Fire Department have no concerns with the proposed
CSM.
Options/Alternatives: The Plan Commission may recommend that the Common Council approve the
proposed Certified Survey Map (CSM) with specified conditions or recommend that the Council deny the
CSM. If the Commission recommends denial, it must cite the specific sections of the Municipal Code on
which the denial is based, allowing the applicant the opportunity to revise and resubmit the proposal, if
necessary.
If the Commission determines that the proposed CSM complies with all applicable requirements of state
statutes and the Municipal Code, a motion recommending approval by the Common Council at its August
18th, 2026 meeting has been provided above.
It should be noted that approval of the Certified Survey Map does not constitute site plan or architectural
approval.

On January 6, 2026, staff hosted a workshop for the Plan Commission and Common, discussing the City’s
2023-2027 Strategic Action Plan (SAP) goal of Thoughtful Growth and Prosperous Local Economy. Under
that SAP goal is a Critical Success Factor of Preserve key real estate for developments that yield the highest
value proposition to the community. Most of the workshop discussion was focused on future changes to the
Zoning Code’s Permitted and Conditional Use table; however, we also introduced an ongoing internal
effort to identify key strategic parcels that may be better positioned for desired development under an
alternative Future Land Use (FLU) category or through rezoning.
Staff is providing a list of strategic parcels with recommended FLU and/or rezoning changes, attached to
this report. It is requested of the Plan Commission to review the list and recommendations, keeping in
mind that all future changes will require property ownership notifications and public hearings. Staff initially
identified more than 50 key areas throughout the City and has since refined the list to just under 20. Staff
is seeking Plan Commission feedback on the recommended changes in order to conclude the exercise and
move forward with the public hearing process.

Subject: 2023-2027 SAP goals, Final Future Land Use (FLU) and Re-Zoning
Recommendations
Date: July 17, 2026
The Council-adopted 2023-2027 SAP contains the following goal under the
Thoughtful Growth and Prosperous Local Economy Critical Success Factor:
>Preserve key real estate for developments that yield the highest
value proposition to the community.
Since fall 2025, a City policy team led by Community Development (Kristi)
achieved the following objectives on this SAP goal:
1) Created a strategic map (“Strat Map”) to identify all highly visible or
otherwise valuable parcels in the City. Staff assessed each parcel’s
current use (if not vacant land), current zoning, and future land use
designation in the City’s Comprehensive Plan, among other property
features. Staff will continue to reference the Strat Map when stakeholders
inquire about potential (re)development.
2) The Strat Map also cross-referenced parcels in past City studies
identified to be preserved for traditionally single-family development.
Those lands have been left intact for single family use.
3) Lead Plan Commission and Common Council approvals on numerous
changes to the City Zoning Table of Permitted and Conditional Uses.
Among other policy goals, this objective identified substandard or
incompatible uses the City no longer wanted to increase in the City or
identified a better zoning category for certain uses.
Where are we today?:
Over the next several meeting cycles, staff will conclude the last steps for
exercise #1 above. Based on the review of all parcels in the Strat Map, there are
remaining gaps in our land use policy. The City can further protect and close
those gaps on certain Strat Map parcels by changing the property’s “Future
Land Use” FLU designation in the City Comprehensive Plan and/or changing the
current Zoning of several private properties. Please see attachment for this
package of land use recommendations.
Prior to the staff preparing public hearing notices, notifying owners/neighbors,
preparing legal descriptions, and other administrative work, staff wanted to share
the attached package of recommendations in advance.
MEMO
Kristi will provide an informational presentation for the July 28 Plan Commission.
We do not anticipate having a similar Common Council informational session but
request any Councilmember feedback or questions not later than Friday,
August 7.
