VILL
AGE MANAGER’S REPORT
The
following is a summary of this week(s) activities performed by Village Manager Burkart.
Organ
izational Management
• I led the weekly Administration meeting each Tuesday. This allows all personnel at
Village Hall to connect with one another along with the Parks and Recreation team. This
meeting allocates time for staff to inform each other on what’s going on in the Village so
they can better assist community members when they call and include updates for our
communications.
• I led our biweekly department head meeting to reflect on the previous Village Board
meeting, review the upcoming Village Board agenda, and a roundtable of several
department updates for the team.
• Finance Director Derrick Danner, HR Manager Kris Connolly, and I met with R&R to go
through our liability and workers’ compensation performance. We anticipate costs going
up in 2027 due to some work-related injuries and inflationary costs.
Fisc
al / Business Management
• Community Development Director Nate Piotrowski and I met with potential developers
about the Hansen Storage site. We continue to make a push for single family housing
along Sherman once it is finally constructed.
• Mr. Piotrowski and I met with Signicast to give us a tour of their building and operations.
They talked about their growth and future plans.
Rel
ationship with Village Board
• I talked with President Montgomery regarding Village Board agenda and other updates.
• I met with Trustee Owens to give him updates about the Village and discuss how things
are going with their committees.
Lon
g Range Planning
• Department heads are meeting with Finance Director Derrick Danner and me regarding
their 2027-2031 Capital Improvement Plan requests. Those requests will be finalized in a
draft plan to be presented to the Village Board at the July 20 meeting.
Pub
lic Relations
• I plan on attending the July 4 celebration and fireworks for Brown Deer in Village Park.
A huge thank you to Parks and Recreation, Public Works, Police, the Special Events
Committee, and all the volunteers for their help with this event.
Inte
rgovernmental Relations
• I met with the North Shore managers on June 17 to discuss potential e-bikes legislation
and room tax revenue with short-term rentals.
• I attended the Wisconsin City/County Management Association Conference in La Crosse.
Starting July 1, I will serve as the WCMA President for a one-year period. I am thankful
for Brown Deer for their support as I serve and give back to the profession in this
leadership role.

We hosted four Mental Health Matters events throughout the month of May, each falling on a Saturday
and throughout the North Shore. These events coincided with Mental Health Awareness month and
promoted mental health and well being. We were joined by multiple community partners and had great
support from folks in our communities. Huge kudos to our Public Health Specialist for planning and
implementing these successful events!
WORKFORCE DEVELOPMENT
Our Public Health Nurses (PHNs) celebrated National Nurses Week by recognizing our UWM nursing
clinical group and their clinical instructor, Arianne, with treats and cards. We appreciate the hard work of
our future nurses and the educators who help guide them.

Our Public Health Strategist prepared for and facilitated the North Shore Overdose Fatality Review (OFR)
meeting. This was the first time we reviewed cases combined to establish reccomendations, in total
reviewing over 18 cases. To our knowledge, this was the first time this was done in the state.
After working diligently for almost a year, our PHNs launched a new electronic health record (EHR)
system. It will allow us to chart more cohesive and detailed notes for patients we serve.
We hosted the Safe Kids Wisconsin Child Passenger Safety Technician (CPST) course, where 13 folks
became certified car seat techs, as well as a Community Car Seat Check Event with Safe Kids
Wisconsin. Additionally, we hosted a Safe Kids Wisconsin CPST Refresher Day, where 30 new and
experienced techs stopped by to brush up on their car seat skills and learn about updates in child
passenger safety.
Our vending machine moved from Glendale City Hall back to Brown Deer Village Hall. It is still stocked
with all of the same prevention items (and maybe a few new ones to come).

Lib
rary Director Report
The
following is a summary of the recent activities performed by
Library Director Dana Andersen-Kopczyk
● The
library’s Children’s Librarian, Jenn, will be away from the library from mid July through
the end of August. Reference staff has had to pivot in order to cover both her desk shifts
and her programming. There are a few programs that Dana has requested be dropped in
order for the Reference Desk to be staff during those times; otherwise, the bulk of the
programming has been delegated out to other staff members (including Dana).
● The library has a temporary Reference Intern a couple of days a week that will help cover
the Reference Desk and prep for programs. She will primarily be with the library from July
1
st to August 29th.
● The library is doing an “Animals Crossings” inspired scavenger hunt around the Village.
Library staff has noticed that people are picking up the rocks and keeping them, rather than
bringing them back to the library in order to collect a prize bag. Staff has started
painting/hiding more rocks, because so many people are coming in to ask about the
program, but rocks so far are just being kept by the person finding them.
● The
library hosted the Wehr Nature Center mid June for a program about the animals and
insects that live beneath our feet. The kids got to help put on a very fun play, then broke
into groups to participate in different stations. Stations included worm observation, learning
about different animals and insects that live in our area (including some live insects!), and
going through tunnels acting like whatever animal was on the card they were given.
● The
library has debuted it’s new "Brown Deer Reads" program series. This series looks to
answer the question “Why does reading matter?”. It’s because:
● Reading builds empathy.
● Shared reading time strengthens family bonds.
● 20 minutes of reading a day improves vocabulary and imagination!
Our mission is to build a community of readers, and once a month we welcome a guest
reader to the library, share a story as a community and then enjoy dedicated reading and
craft time.
● The library has again struggled to keep attraction passes on the shelf, as does other
libraries in the MCFLS system, with the increased summertime demand. Particularly in
demand this summer have been the Milwaukee County Zoo and Schlitz Audubon passes.
● A representative from Employ Milwaukee is at the library Mondays and Fridays from 12:30-
2:30pm, to help with career resources and job training.
● Reference staff has begun working on the fall/winter/spring library programs. Dana has
given instructions on how she wants things done differently going forward, including how
programming is “pitched”, planned for, and implemented.

Mit
ch Hohlen, Director of Development for Woodsonia Real Estate, was present via zoom, and emphasized that Jilly’s Car
Wash was the preferred user for the car wash due to their local presence and willingness to invest in an enclosed vacuum
bay. Mr. Hohlen presented other examples of successful car wash locations in the Milwaukee area. He emphasized that Jilly's
Car Wash would serve as a complementary business to attract customers from other areas, particularly those visiting Target
and other retail businesses in the development.
Jon Z
immerman, owner of Jilly’s Car Wash, emphasized the importance of creating a high-quality site plan for the
development, as it’s the first impression for the community. Mr. Zimmerman highlighted the enclosed vacuum area and
consideration of premium amenities within the enclosed area. It was described as enclosed vacuums, mat cleaners, and
restrooms for a year-round experience. Mr. Zimmerman emphasized their willingness to invest $6 million in the project, noting
their business model works well with recurring customers who learn the access pattern.

REQUEST FOR CONSIDERATION
COMMI
TTEE CONSIDERATION: Village Board
ITEM DESCRIPTION: Review and Possible Approval of a Services Agreement with
Valbridge Appraisal for 9120-9140 N. Green Bay Road
PREPARED BY: Nate Piotrowski, Development Director
REPORT DATE: July 1, 2026
BACKGROUND:
As part of the recently approved relocation order for the northern half of the Marketplace
Shopping Center an appraisal is required to be completed by the Village prior to making an
offer to acquire under Wisconsin Eminent Domain law. Attached is a proposal for said
appraisal from Valbridge at a cost of $12,000. Valbridge is a highly qualified firm that
specializes in appraising commercial real estate and eminent domain related appraisals. They
are available to begin the work this month and the Village has used them previously for an
appraisal of the former First Citizen’s site. Staff found their previous work to be excellent. The
cost of that earlier effort was $10,500 which is in line with the current proposal given the
larger parcel and building size at the Marketplace.
Recommended Motion:
A motion to approve the services agreement.

ADDENDUM TO OFFER TO PURCHASE (Revised v3 6-25-26)
THIS
ADDENDUM is made a part of and is incorporated by reference into the WB -15 Offer to
Purchase (“Offer”) submitted by Atwood, LLC (“Buyer”), to the Village of Brown Deer,
Wisconsin (“Village” or “Seller”), for the property located at 8725 N. Deerwood Drive, Brown
Deer, Wisconsin (“Property”).
1. CO
MMISSION
The Firm’s commission shall be equal to Three Percent (3%) of the final gross sale price. All
commissions shall be deemed earned only upon closing and shall be paid in full at the time of
closing from Seller’s proceeds.
2. GUARANT
EED MINIMUM ASSESSED V ALUE
(a) Guaranteed Amount and Term. Subject to the conditions herein, Buyer guarantees that the
Property shall maintain a minimum aggregate assessed value equal to Seven Hundred Fifty
Thousand Dollars ($750,000.00) (“Guaranteed Amount”). This guarantee shall commence on the
first tax assessment cycle following the issuance of a final certificate of occupancy for the full
commercial kitchen built on the Property, or January 1, 2027, whichever occurs later , but in no
case to be later than January 1, 2028. The Guaranteed Amount covenant shall run through the tax
year 2035, or through the tax year in which Tax Incremental District (TID) #4 closes, whichever
occurs first (“Guaranteed Value Term”).
(b) Shortfall Payments. If the actual municipal assessment on the Property falls below the
Guaranteed Amount in any tax year during the Guaranteed Value Term, the then- owner of the
Property shall make a payment equal to the difference between the annual property taxes that
would have been due had the Property been assessed at the Guaranteed Amount and the actual
property taxes levied for that year (“Payment in Lieu”). Under no circumstances shall Buyer be
penalized or required to make a Payment in Lieu for assessment shortfalls o ccurring prior to the
completion and final occupancy approval of the commercial kitchen.
(c) Remedies and Notice. Any Payment in Lieu due under this Addendum shall be payable at the
same time and in the same manner as standard ad valorem property taxes. If the owner fails to
timely make a Payment in Lieu, the Village may levy a special assessment against the Property in
the amount of the deficiency. The Village agrees to provide the owner with written notice of any
alleged deficiency and thirty (30) days to cure such deficiency prior to executing any legal remedy
or special assessment. The payment obligation under this Section shall be a personal obligation
strictly limited to the specific legal entity or person that holds record title to the Property at the
exact time the Property value falls below the Guaranteed Amount.
(d) Covenants Running with the Land. The covenants contained in this Section shall be deemed
covenants running with the land and shall bind subsequent physical owners of the real estate for
the duration of the Guaranteed Value Term.
3. RI
GHT OF FIRST REFUSAL
(a) Notice of Third-Party Offer. If at any time the record owner of the Property receives a bona
fide, written offer from an unrelated third party to purchase the physical real estate of the Property
which the owner desires to accept, the owner shall promptly deliver a complete copy of such offer
to the Village (“Offer Notice”).
(b) Exercise of Right. The Village shall have an exclusive right of first refusal to purchase the
Property upon the identical terms, conditions, and purchase price set forth in the Offer Notice. To
legally exercise this right, the Village must deliver unconditional written notice of acceptance to
the owner within 15 business days of receiving the Offer Notice. If the Village timely exercises
this right, the closing of the sale shall take place within 60 days thereafter, or per the timeline in
the third-party offer, whichever is longer.
(c) Waiver. If the Village fails to deliver written notice of acceptance within the 15 business day
window, the right of first refusal shall automatically expire, and the owner shall be entirely free to
sell the physical real estate to the third party under the terms of the Offer Notice.
4. CORPORATE TRANSFER EXCLUSION (CHANGE OF CONTROL)
Notwithstanding anything to the contrary in this Addendum, the Offer, or any associated
covenants, the Right of First Refusal (Section 3) and the Guaranteed Minimum Assessed
Value transfer restrictions (Section 2) apply strictly to a transfer of physical title to the real
estate via a recorded deed.
The sale, transfer, assignment, pledge, or issuance of corporate stock, membership interests, or
ownership units of Atwood LLC (or any successor entity holding title to the Property),
or DonutMonster LLC (the operating retail business), resulting in a change of control of either
corporate entity, shall NOT constitute a sale or transfer of the Property. Such corporate
transactions shall not trigger the Village’s Right of First Refusal, shall not require Village consent,
and shall not be prohibited or delayed by the Village in any manner, provided that the underlying
corporate entity holding title to the real property remains bound to the terms of the Guaranteed
Value Term through 2035 or the expiration of TID #4, whichever occurs first.
5. VILLAGE FEE WAIVER
(a) Waiver of Village Fees. As a material inducement for Buyer to purchase and develop the
Property, the Village agrees to waive, forgive, and not impose upon Buyer any municipal fees,
charges, costs, or assessments customarily imposed by the Village in connection with the
acquisition, ownership, development, construction, occupancy, or operation of the Property, to the
fullest extent permitted by law.
(b) Covered Fees. Without limiting the foregoing, the waiver shall include, but not be limited to,
all building permit fees, plan review fees, zoning review fees, occupancy permit fees, engineering
review fees, inspection fees, utility connection or hookup fees imposed by the Village, impact fees,
development fees, park fees, stormwater review fees, sign permit fees, driveway permit fees, right-
of-way permit fees, administrative processing fees, recording or filing fees payable to the Village,
and any other municipal fee, charge, reimbursement, or assessment arising out of the development
or use of the Property.
(c) Exclusions. This waiver shall not apply to ordinary real estate taxes or utility consumption
charges for services actually used after occupancy, unless otherwise expressly waived by the
Village.
(d) Binding Effect. The Village represents that it has the authority to grant the waivers described
herein and agrees that no Village department, board, commission, employee, or official shall
impose or collect any waived fee from Buyer. In the event any such fee is assessed or invoiced,
the Village shall promptly withdraw such assessment or reimburse Buyer for any amounts paid.
(e) Survival. The provisions of this Section shall survive Closing and shall remain binding upon
the Village and its successors and assigns with respect to the Property.
(f) No Additional Development Conditions. Except as expressly set forth in the Offer and this
Addendum, the Village shall not require Buyer to make any additional payments, contributions,
reimbursements, donations, off -site improvements, public infrastructure improvements, or other
financial concessions as a condition of issuing approvals, permits, inspections, certificates of
occupancy, or otherwise allowing the development contemplated by this Offer.

ITTEE CONSIDERATION: Village Board
ITEM DESCRIPTION: Review and Possible Approval of Certified Survey Map land division
at 8725 N. Deerwood Drive
PREPARED BY: Nate Piotrowski, Development Director
REPORT DATE: July 1, 2026
BACKGROUND:
As part of the sale of the building in Community Square a new Certified Survey Map (CSM) is
necessary to divide the building land from the remainder of Community Square so that the
private land transaction can proceed. The CSM was recommended for approval by the Plan
Commission last December but was never formally approved by the Village Board due to the
previous offer to purchase falling through. The CSM remains the same and includes a
permanent pedestrian access easement on the south side of the building where the private
property will extend over the existing patio and sidewalk
Recommended Motion:
A motion to approve the CSM.

TTEE CONSIDERATION: Village Board
ITEM DESCRIPTION: Present Financial Status of Tax Incremental Districts
PREPARED BY: Tyler Burkart, Village Manager | Derrick Danner, Finance Director
REPORT DATE: July 6, 2026
RECOMMENDATION: No formal recommendation is provided.
EXPLANATION:
Vill
age staff are proactively presenting to the Village Board the financial status of tax
incremental districts (TID) 3-6. Below are important notes for each TID:
• TID 3 c
ontinues to perform well and is subsidizing TID 4 at the moment.
• TID 4 is performing the same it did the previous year. The rate of the deficit in the TID
has plateaued, and we anticipate as developer payments to conclude shortly the trend
moving in the opposite direction. Removing debt payments from TID 4 to the tax levy
has helped this projection by a few million dollars thankfully. While it may not be
needed, pursuing the technical college 3-year extension with the Department of
Revenue could give the Village an additional 3-year extension and allow TID 4 the
ability to not close in the red.
• TID 5 and 6 have now been created. Projects in TID 5 show promise for the future of
that district. Village 43, Riverside Landing, and other future projects are giving some
helpful increment to TID 5. Atlas Assisted Living will also be a help for TID 6.

REQUEST FOR CONSIDERATION
COM
MITTEE CONSIDERATION: Village Board
ITEM DESCRIPTION: Present Overview of Current Outstanding Debt
PREPARED BY: Tyler Burkart, Village Manager | Derrick Danner, Finance Director
REPORT DATE: July 6, 2026
RECOMMENDATION: No formal recommendation is provided.
EXPLANATION:
Vi
llage staff is proactively presenting to the Village Board the current amounts for each
outstanding debt issuance:
• Eac
h debt issuance has a different allocation of repayment depending on the projects
that the debt is funding
• Every year, the Village levies money to pay the interest and principal amounts that are
not associated with the utilities or the TIDs
• The Village does not have much say when preparing the upcoming budget. There is a
debt payment due every year on April 1 and October 1
• The goal when we do our capital improvement fund each year is to try and steady the
amounts so that there is less volatility in the size of the debt payments
• The debt issuances go back to 2011 and all the way up to the 2026 debt issuance that
was done this year
• The new DPW building, the new library, and other similar debt issuances could be
amortized over 20 years, whereas other newer debt issuances are amortized over 10
years
• The columns on the left show the total amount due each year. The middle columns
show the total due for each utility and for each TID. The far right column is the amount
that the Village will need to levy for those years in order to make the payments
