BROOK LANE MILWAUKEE ASSOCIATES LP Title: Dated: 2026 VILLAGE OF BROWN DEER Title BY BY J REQUEST FOR CONSIDERATION COMMITTEE CONSIDERATION: Village Board ITEM DESCRIPTION: Presentation from the Village Assessor on the 2026 Assessment Process PREPARED BY: Caren Brustmann, Village Clerk REPORT DATE: May 4, 2026 RECOMMENDED MOTION: No motion, presentation only. EXPLANATION: The open book session is an informal meeting with the assessor where property owners can review their property assessment and ask questions. If you believe your property’s assessed value may not reflect current market conditions or property details, this is the time to discuss it directly with the assessor. • The open book period will be held from May 26 – June 2. To schedule an appointment, please call (262) 758-3681. Many concerns can be resolved at this stage without needing to attend the Board of Review. If, after attending open book, you still have concerns about your assessment, you may present your case to the Board of Review. This is a more formal process where property owners can provide evidence to support their opinion of value. The members will listen to your testimony and make a determination based on the information you presented. • The Board of Review will be held on Thursday, June 25 at 1:00pm at the Village Hall. Objections to your property assessment must be received at least 48 hours prior to this meeting. Sale prices are adjusted to remove any items sold that are not valued for tax purposes and may also be time adjusted . If sale prices used in this analysis were time adjusted it would be indicated in the heading on page 1 of this report. The total assessed value is the value of all properties in the tax class as determined by the Market Drive valuation model used for tax assessment purposes . Each property is placed into one and only one stratum. Therefore, the total assessed value shown here for a tax class will not match the market value shown on the statement of assessments for the same tax class if there are any properties that have land and/or buildings in multiple tax classes. The weighted ratio for a tax class is derived from the weighted assessment- to-sale ratio of each neighborhood group within the tax class. The neighborhood group ratios are combined using a weight that is proportionate to the total assessed value of all land and buildings in the neighborhood group . See the next section titled 'Weighted Assessment-to-Sale Ratios by Neighborhood Group'. The aggregate ratio is the sum value of all property sold divided by the sum of all sales prices . The aggregate ratio is another kind of weighted ratio. The mean ratio is the arithmetic average of the assessment-to-sale ratios for all valid sales in the stratum. The median ratio is the assessment-to-sale ratio of the middle sale in the stratum when those sales are sorted by their assessment- to-sale ratio. The coefficient of dispersion (C.O.D.) is the average deviation from the median ratio of all assessment- to-sale ratios for all valid sales in the stratum. The coefficient of concentration (C.O.C.) is the percentage of all valid sales whose assessment-to-sale ratio falls within 15% of the median ratio. The price-related differential (P.R.D.) is the mean ratio divided by the aggregate ratio. Assessments are said to be progressive when the ratio falls below 98% meaning higher valued properties are being overassessed therefore favoring low value properties. Assessments are said to be regressive when the ratio rises above 103% meaning higher valued properties are underassessed therefore favoring high value properties. Ratios falling between 98% and 103% suggest that properties are being treated uniformly. The confidence rating is the percentage of property value represented by a sample size ( valid sales) of at least 5% by count and by value. A low confidence rating means there are not enough sales to be confident that the statistical measures shown truly represent all properties . Maederer, PE, Director of Public Works/Village Engineer REPORT DATE: May 4, 2026 MANAGER'S REVIEW/COMMENTS: No additional comments to this report. See additional comments attached. RECOMMENDATION: Approval of the Natural Lawn Ordinance (New Section 38-14). EXPLANATION: UPDATE: based on feedback received staff are offering a revised ordinance which does not include an application process. To better track and enforce the Village’s lawn ordinance with respect to natural lawns the code enforcement specialist, Police Department and DPW staff drafted a new section in our code of ordinances to regulate natural lawns in the Village. If a residential property owner desired to install a natural lawn, then an application would be submitted to this committee for approval similar to how commercial landscape plans are approved by the committee. Attachments: • Natural Lawn Ordinance – revised version 1 STATE OF WISCONSIN: MILWAUKEE COUNTY: VILLAGE OF BROWN DEER: ORDINANCE NO: 26-05 An Ordinance Creating Standards for Lawn and Yard Maintenance WHERAS, The keeping of orderly yards and lawns promotes the general health and welfare of the Village; and WHEREAS, there has been a trend in recent years towards a “natural lawn” model that involves native plants and grasses, in an effort to benefit the overall environment; and WHEREAS, the Village does not currently have Municipal Code provisions that adequately addresses the “natural lawn” approach; and WHEREAS, creation of a new Land and Yard Maintenance Code Section will promote the health and welfare of the Village; NOW THEREFORE, the Village Board of the Village of Brown Deer, Milwaukee County does hereby ordain as follows: SECTION I Section 28-14, “LAWN AND YARD MAINTENANCE,” of Chapter 38, “NUISIANCES,” of the Village Code of the Village of Brown Deer, is created as follows: Sec. 38-14. LAWN AND YARD MAINTENANCE. (a) Definitions. For the purpose of this section, the following definitions shall apply: 1. Turf Grass Lawn. A planted landscape of various species of grass, including but not limited to, bluegrass, fescue, and ryegrass blends, that is regularly maintained. 2. Natural Lawn. A deliberately planted landscape of forbs, grasses, and wildflowers, including woodland, prairie, bog, fen, or wetland species, that is regularly managed, and may exceed eight (8) inches in height. A natural lawn will be managed, at least on an annual basis, to exclude Eurasian weeds and all noxious weeds listed in §38-3, and to remove dead or decaying plant material over eight (8) inches in height. Natural laws shall not impede the right-of-way or obstruct the vison of roadways, sidewalks or driveways, or harbor vermin or rodents. A clear boundary will be 2 maintained where the natural lawn ends. Plant species recognized as native to the upper Midwest states shall be deemed compliant with this definition. (b) General Lawn and Yard Requirements. 1. The owner or occupant of any lot or parcel within the Village shall install and maintain landscaping, turf grass, and decorative ground treatments in all yard areas, including Village rights-of-way adjacent to the property, in a neat and attractive conditi on consistent with accepted landscaping practices in southeastern Wisconsin. 2. Turf grass shall be maintained at a height not to exceed eight (8) inches. 3. Landscaping shall be maintained to prevent hazards to adjoining properties or to persons or vehicles traveling on public ways and shall contribute to the appearance and value of the property, neighborhood, and Village. 4. This subsection shall not apply to vacant lots or parcels that are naturally wooded or have reverted to a self-sustaining natural state, provided such vegetation does not include noxious weeds as defined in §38-3 and does not create a hazard or obstruction to adjoining properties or public ways. (c) Vegetation Height and Maintenance Standards. 1. Prohibited Vegetation Growth. No owner or occupant of any lot or parcel within the Village shall permit rank vegetation growth, including but not limited to weeds, grass, or other uncultivated plant material, to exceed eight (8) inches in height. Such growth shall be considered a public nuisance and in violation of this section. 2. Exemptions. The following plantings shall not be considered violations under this subsection: a. Decorative plantings located within maintained garden beds, planters, or landscaped areas that are clearly intentional and cultivated. b. Trees, shrubs, bushes, and ornamental grasses customarily used in residential or commercial landscaping. c. Natural Lawns that are established and maintained in compliance with the requirements of this chapter. 3. Responsibility for Compliance. 3 Property owners and occupants shall be jointly responsible for maintaining compliance with this subsection, including all areas within the public right-of-way abutting their property. 4. Abatement. Failure to comply with this subsection may result in enforcement action as provided in Chapter 38 of this Code, including notice of violation, abatement by the Village, and recovery of costs as a special charge against the property. Abatement may be performed by the Village or the Village’s designated agent after notice to the property owner of the violation and a seven (7) day opportunity to cure. Conditions that pose an immediate threat to health or human safety may be immediately abated following reasonable notice to the property owner. (d) Setbacks, Swales, and Pathways. 1. All natural lawns shall maintain a setback from edge of road pavement, side, and rear property lines. Where a fence, wall, or similar structure is installed along a side or rear property line, the natural lawn may extend up to the fence line but shall not extend beyond it. 2. Drainage swales shall remain free of plantings and be maintained consistent with subsection (b). 3. Adjacent property owners may waive side or rear setbacks in writing, provided such waivers are filed with the Village Clerk and do not affect drainage swales. 4. A maintained access pathway not less than two (2) feet in width shall be provided through or around the natural lawn area to allow access for maintenance and inspection. Setback areas shall not exceed eight (8) inches in height, excluding trees and shrubs. (e) Enforcement and Abatement. 1. Failure to maintain turf grass or a natural lawn in accordance with this section shall constitute a public nuisance under this chapter. 2. Upon determination of noncompliance, the Village Manager or designee shall issue notice to the property owner by personal service, posted placard, email, or mail. 3. The owner shall have seven (7) days from notice to abate the nuisance. This notice requirement does not apply to a condition that constitutes an immediate threat to human health or safety. If not abated, the Weed Commissioner shall cause the property to be brought into compliance and the costs assessed as provided in subsection (f). 4. A property owner may appeal a notice of violation on the grounds that the lawn qualifies as a natural lawn by submitting a written appeal within seven (7) days of the date of the notice. The appeal shall be considered by the Beautification and Public Works Committee at its next scheduled meeting. Upon review, the Committee shall determine whether the lawn constitutes a violation or complies with the standards for a natural lawn. If the Committee determines that 4 a violation exists, the property owner shall have seven (7) days from the date of that determination to abate the nuisance. (f) Cost of Abatement. In addition to any penalties under this chapter, the cost of abatement performed by the Village shall be collected as a debt from the owner, occupant, or person responsible and may be assessed as a special charge against the real estate. Nimmer, Chief of Police REPORT DATE: May 4, 2026 MANAGER'S REVIEW/COMMENTS: X No additional comments to this report. See additional comments attached. RECOMMENDATION: “I move to approve Ordinance 26-06” EXPLANATION: T he Village of Brown Deer adopted lawn and yard maintenance standards, codified in Section 38-14 of the Municipal Code. As part of that update, several provisions within Chapter 38 (“Nuisances”) now contain outdated or inconsistent references. T his ordinance makes technical amendments to Chapter 38 to ensure consistency with the newly adopted lawn and yard maintenance regulations. T he proposed ordinance includes the following key changes: U pdated Definition of “Natural Lawn” Removes the existing definition and replaces it with a reference to Section 38-14(a)2, where the term is now defined and regulated. R evised Definition of “Noxious Weed” Clarifies the definition and aligns it with Wisconsin State Statute 66.0407 and applicable Department of Natural Resources rules. The ordinance also includes a non-exhaustive list of specific plants considered noxious weeds. U ncut Grass Provision Updated Revises the “uncut grass” provision to reference violations of Section 38-14, ensuring that enforcement is tied directly to the updated lawn maintenance standards. N uisance Abatement Language Clarified Updates procedures allowing the Village to abate nuisances when property owners fail to comply after proper notice, with associated costs assessed as special charges on the tax roll. 2 Attachments: • Ordinance 26-06 1 STATE OF WISCONSIN: MILWAUKEE COUNTY: VILLAGE OF BROWN DEER: OR DINANCE NO: 26-06 An Ordinance Amending Sections of Chapter 38, “Nuisances,” of the Village of Brown Deer Municipal Code to be Consistent with the Newly Created Lawn and Yard Maintenance Standards W HERAS, The Village recently created new lawn and yard maintenance standards and incorporated those into the Village of Brown Deer Municipal Code; and W HEREAS, t here are cross references contained elsewhere in Chapter 3 8, “Nuisances,” of the Village of Brown Deer Municipal Code that need to be amended for consistency’s sake; and W HEREAS, the amendments herein will promote the general health and welfare of the Village; NO W THEREFORE, the Village Board of the Village of Brown Deer, Milwaukee County does hereby ordain as follows: S ECTION I T he definition of “natural lawn” contained in Section 38-3, “Human health hazards and public health nuisances,” of Chapter 38, “NUISIANCES,” of the Village Code of the Village of Brown Deer, is hereby repealed and replaced as follows: N atural lawn has the meaning defined and regulated under Section 38-14(a)2 of the Village of Brown Deer Municipal Code. PASSED AND ADOPTED by the Village Board of the Village of Brown Deer, Milwaukee County, Wisconsin, this 4th day of May, 2026. W anda Montgomery, Village President C ountersigned: C aren Brustmann, Village Clerk REQUEST FOR CONSIDERATION COMMITTEE CONSIDERATION: Village Board ITEM DESCRIPTION: Discuss and Consider Process for Appointing Village Trustee to Continue Term Previously Filled by Renee Booker PREPARED BY: Tyler Burkart, Village Manager REPORT DATE: May 4, 2026 RECOMMENDATION: 1. “I move to approve the plan established by staff in the memorandum to appoint a new Village Trustee.” EXPLANATION: Due to the passing of Renee Booker, the Village needs to initiate a process to appoint for his position. Trustee Booker was two years through his term, which expires April 2027. Generally, municipalities have two options for filling a Village Board vacancy. The Village Board can choose to either (1) wait until the next spring election to fill the position to complete its term or (2) conduct an appointment process to fill the position to complete its term. Considering the Village is several months away from the next spring election, it is being recommended to conduct an appointment process that would reflect similar processes utilized to fill a vacancy for the Brown Deer Village Board. Below are the steps and timeline being recommended: • Collect applications. Starting May 5, the Village would ask for residents to submit applications who have interest in serving as a Village Trustee. To officially apply, the applicant shall submit a cover letter, resume, and a response to a questionnaire. There will be a three-week window to collect applications as the final day to submit an application will be Monday, May 25 by 11:59 p.m. Applications shall be submitted to Village Clerk Caren Brustmann. The Village will promote this opportunity through all of its communication channels. The applications will be assembled and included in the June 1 Village Board packet for review. The questions that require a response as a part of the application includes: o Why do you want to be a Village Trustee? o What do you view as the primary responsibilities of a Village Trustee? o Describe your talents and abilities that will assist you as a Village Trustee. o What characteristics can you bring to strengthen the Village Board? o As a Board member, how would you deal with a committee recommendation that you do not agree with? o What concerns you about the future of the Village of Brown Deer? o Why are you the best candidate for this Trustee position? o What work have you done for the Village of Brown Deer or others in the past, including volunteer activities, Brown Deer school volunteer work, service on any Brown Deer committees, and attendance at Brown Deer events? o What committees would you want to serve on and why? • Review applications and Select Applicant. All applicants who apply would be invited to the June 1 meeting so Village Board members would have the opportunity to ask follow up questions about their applications. Applicants would also have the opportunity to present a few minutes on why they feel they are the best candidate for Village Trustee. After this period of presentations and asking questions, the Village Board would have time to deliberate and consider the applications. Ultimately, the Village Board would have the option to put forth a recommendation to be considered that night to appoint an individual to the Village Board. • Oath of Office of New Trustee. If the new Village Trustee is appointed June 1, then the Village would plan for an oath of office ceremony to take place on June 15. The Village Trustee would also need to be appointed to certain Village committees. Their term would expire in April 2027. Village staff are asking for the Village Board to consider this timeline and propose any alternative changes they deem necessary. Any amendments from this plan shall be included as a specified amendment in the proposed motion.
