Fox Point Centennial Planning Committee
Final Report
Submitted by Emily Silverson, October 2026
Introduction
Beginning as early as the 1840s, European settlers were drawn to this North Shore land for its natural wonders,
abundant resources and beautiful Lake Michigan location, working tirelessly to build a thriving community
together. By the mid-1920s, Fox Point residents became increasingly dissatisfied with the Town of Milwaukee’s
limited services. And so, in 1926 –100 years ago, the residents voted to incorporate as the Village of Fox Point.
The goal of the Centennial Planning Committee was to develop and coordinate a year-long celebration of this
historic milestone (1926–2026), offering a variety of memorable festivities for residents of all ages. The
centennial year provided a meaningful opportunity to come together as a community, honor Fox Point’s history,
and celebrate its bright future.
Three major events were held on February 15, June 13, and September 5. A centennial tree was planted, a time
capsule was buried, and a complimentary 180-page historical book was produced and distributed to residents.
All events were well attended, supported by consistent communication across multiple channels and aided by
favorable weather.
Mission & Objectives
On July 9, 2024, the Village Board adopted a resolution establishing the Fox Point Centennial Committee and
appointing its members. The Board recognized that citizen involvement would be essential to the success of the
centennial and that a dedicated committee was needed to plan, organize, and oversee the celebrations.
Upon approval of a comprehensive centennial plan, the Committee was charged with the following
responsibilities:
• Organize and manage all centennial events and activities outlined in the approved plan.
• Form workgroups as needed to focus on specific aspects of planning.
• Operate within the budget approved by the Village Board and seek additional funding through grants,
sponsorships, and donations, subject to Board approval.
• Request expenditures or contracts through the Village Manager, who may act within his authority or
bring requests to the Village Board.
• Maintain regular communication with the Village President and Village Board, providing updates and
addressing issues as they arise.
• Carry out only the powers specifically identified in the resolution.
• Disband upon completion of its charge.

The Committee held its first meeting on October 7, 2024, followed by eight additional full-committee meetings
held either in person or virtually. Smaller work groups met separately to address detailed tasks for each event.
The Committee began by researching and brainstorming potential centennial activities, then narrowed the list
and voted on final selections.
Village staff were assigned to support the Committee throughout planning and implementation. Their
assistance — particularly with contracts, purchasing, communications, and logistics — was invaluable.
Event Summaries
ANNIVERSARY CELEBRATION - SUNDAY , FEBRUARY 15
The Committee hosted the official 100th anniversary celebration at Longacre Pavilion. History boards, time
capsule materials, decorations, and informational tables were displayed, along with giveaways, refreshments,
and cake. A short ceremony was led by Village President Christine Symchych, and several local media outlets
covered the event.
Notable attendees included State Senator Jodi Habush Sinykin, State Representative Deb Andraca, County
Supervisor Anne O’Connor, former Village President Douglas H. Frazer, Centennial Committee Chair Emily
Silverson, and current and former Village Board members. Fox 6 and TMJ 4 attended. More than 100 people
participated.
Three 90-minute coach bus tours of significant village sites were offered, guided by Douglas H. Frazer. All three
tours reached full capacity with 55 participants each, and feedback was overwhelmingly positive.
Bus tour stops included:
1. Stormonth Elementary
2. Country Day School / Milwaukee Jewish Day School
3. Mary Nohl House
4. Chipstone Foundation
5. Old Dutch Cemetery & School Site
6. Schneider Memorial at Doctors Park

CENTENNIAL SUMMER CELEBRATION – SATURDAY , JUNE 13
The second major centennial event featured a variety of family-friendly activities.
The Committee partnered with the Fox Point Foundation to add a 10K route to the annual Freedom 5K and
1-mile Run/Walk. The 10K route highlighted historical landmarks with signage and QR codes linking to audio
recordings of historical information.
Although not officially part of the centennial, June 13 also marked the opening day of the Fox Point Farmers
Market.
The Village hosted an Open House from 10 a.m. to noon, offering hands-on experiences with public works
equipment, opportunities to meet police officers, firefighters, and EMTs, and tours of kid-friendly vehicles.
Community organizations provided information and giveaways.
At noon, a Centennial Tree—a Swamp White × Bur Oak—was planted and dedicated in the boulevard
greenspace of Community Place, the site originally planned as the Village civic center. Remarks were provided
by former Village President and current Weed Commissioner Douglas H. Frazer and Village Forester John Gall.
From noon to 3 p.m., a community gathering took place at Longacre Pavilion. Food trucks, New Barons Brewing
beer, live music by Mixtape, and sponsor giveaways created a festive atmosphere. Children enjoyed a petting
zoo, inflatable obstacle course, slides, face painting, and balloon artists. Historic poster boards and the time
capsule were displayed inside the pavilion.
Community partners—including the Fox Point Foundation, Fox Point Garden Club, Save the Fox Point Pool,
MMSD, Fox Point-Bayside School District, North Shore Library, and Fox Point Artists—hosted booths. More than
500 attendees participated.

FOX POINT SHOWCASE – SATURDAY , SEPTEMBER 5
The final centennial event was held on the grounds of the Chipstone Foundation, highlighting Fox Point’s history,
architecture, and neighborhoods. The exterior grounds were open from 11 a.m. to 2 p.m. for visitors to explore,
enjoy the landscaping, and view centennial displays. Due to a storm the previous day, electricity was out in the
Carriage House, preventing access to the second-floor gallery. Lawn games were also canceled due to wet
conditions.
A shuttle bus transported attendees between Longacre Pavilion and the Chipstone grounds due to limited
parking.
Chipstone staff led four fully booked tours of the collection. Mid-century modern preservationist Matthew
Amman delivered two well-received presentations on Fox Point’s architectural heritage.
The historical book Discover Fox Point was released at this event, with complimentary copies distributed and
signed by Douglas H. Frazer. Additional giveaways and lemonade were provided. Approximately 150 people
attended.

Financial Accounting
The Village Board approved a $37,000 budget in April 2025. Actual expenditures totaled $22,340—about 60% of
the approved amount—due to cost savings and sponsor contributions. A detailed budget spending report is
located in the Appendix. The Village Board did not permit point-of-sale transactions, so merchandise could not
be sold and was instead offered as giveaways.
The Committee pursued sponsorships selectively, contacting known community supporters and distributing
letters to local businesses. A total of $2,950 in monetary donations was received, along with several in-kind
contributions.

Marketing & Media
A wide range of communication strategies supported the centennial, including:
• Informational booths at the 2025 Fox Point Picnic and September Farmers Market
• Articles in North Shore Living magazine (February, May, June, and September issues)
• Printed trifold mailers announcing all centennial events
• Postcard mailers prior to the February and June events
• A dedicated Centennial webpage (villageoffoxpoint.com/100years)
• Village email blasts
• Social media posts on Fox Point Parents and Village of Fox Point Facebook pages
• Inclusion in the Nicolet Recreation summer bulletin
• Yard signs with QR codes placed throughout the Village
• Press releases submitted to local media
• Coverage by Fox 6 and TMJ 4 at the February event
Graphics were produced by paid freelancers and committee members.
Archival & Legacy Details
The printed book, Discover Fox Point, provides a very informative historical account of Fox Point. A map of the
notable landmarks was created which included brief historical information of each location. QR codes included
audio of historical information. This map is available on the village website and shown in the Appendix of this

document. A time capsule was created and buried in honor of the centennial. Finally, this final report, photos
and committee meeting minutes provides information for archival purposes.
DISCOVER FOX POINT BOOK
During the planning of the Centennial, the committee agreed it would be beneficial to develop a book about Fox
Point using articles written by Douglas H. Frazer and submitted to the local neighborhood monthly publication.
Douglas contributed over 200 articles since 2010 that covered local history, architecture, citizens and services
of Fox Point. A small work group pulled together a draft and initially looked at working with Arcadia Publishing
but then decided to design and self-publish and use On Press Book Printing for the printing of the books. Five
hundred books were initially printed and given away for free at the September 5 event and then distributed to
others that visited Village Hall. An electronic copy of the book is also posted on the village’s website.

TIME CAPSULE
One of the centennial activities the committee decided on was to create a time capsule. The proposed burial
location agreed upon with the Village would be near the flagpole at Longacre Pavilion. Details were not
determined as to when the time capsule should be opened in the future. The contents include:
• Discover Fox Point, book created for Centennial
• Fox Point Police Department patch and letter
• Centennial Logo Sticker
• Centennial Lapel Pin
• Centennial Brochure
• Centennial February event program
• North Shore Living Magazine , February 2026 Issue
• Milwaukee Journal Sentinel Front Page, February 15, 2026
• Fox Point Sticker, Fox Point Foundation
• Nicolet Recreation Bulletin, 2026
• 1980 Fox Point Pool Admission Patch worn on bathing suits by pool members, donated by Louise
Petering

• 1979 Fox Point Bicycle License Plate, donated by Louise Petering
• 2014 Footbridge Friends, Inc. Button, donated by Louise Petering
• Metal piece of original footbridge
CENTENNIAL TREE & PLAQUE
A centennial tree was planted within the boulevard greenspace of Community Place, the road between Santa
Monica Boulevard and Longacre Road. Committee members worked with the Village Forester to determine
which variety should be used. On June 13, 2026, a Swamp White x Bur Oak was dedicated along with a metal
plaque and a brief dedication ceremony was held. This location was decided on as it was the planned village
civic center in the original village plan.
Acknowledgments & Next Steps
The Centennial Planning Committee extends its sincere gratitude to the Village Board, Village staff, and the Fox
Point community for their support. Staff assistance was instrumental in navigating processes and ensuring
smooth execution.
Committee Members:

Lessons Learned
The Committee’s first challenge was determining which activities and dates to include in the centennial year.
After extensive brainstorming, the Committee refined the list and presented a proposal and budget to the
Village Board for approval.
Clarifying responsibilities between the Committee and Village staff was another early challenge. Committee
members’ prior experience with community events contributed to smooth execution, and Village staff
responded promptly to requests.
Volunteer recruitment is essential but can be difficult. The Committee used a free online volunteer sign-up
system and promoted opportunities through social media, the Village website, and email blasts.
Residents provided positive feedback on all three major events.

I am emailing you because I will not be in attendance at the September 8 meeting at Pool. I
wanted to give you my thoughts about the pool despite my absence from the meeting. I
know that these thoughts represent a lot of people in the village, even if they aren't
expressing them directly to you.
Three years ago an agreement was made that the Friends of the Fox point Pool would raise
half of the amount of the cost of the $8 million pool. Now that time has passed and they
realize their fundraising is failing, they want to change all the rules so that other people pay
for it and we get taxed for it - that is NOT right.
There is no need for a pool. The previous pool was a money pit, costing the village many
thousands of dollars a year to maintain. When it was closed memberships were down to
around 78. Memberships were not and will not be enough to pay for annual maintenance
costs of the pool. At least 80% of the Village does not use the pool. Why would you tax
everyone for something that's used by an extremely small number of people in the
Village? That is terrible representation for something that is not a critical need item for the
village. Your job is to represent the Village and by ignoring the majority who do not want the
pool and who do not want to pay for it, you are not representing the Village. The massive
failure of the fundraising (raising 0.039% of the 4 million that was agreed upon) CLEARLY
shows that the vast majority of the village does not want to pay for a new pool. You NEED
to finally recognize this and stop any further discussions on building a new pool.
Any business that would have an $8 million cost and only be open two months out of the
year would go bankrupt. The fact that you think this is an acceptable expense is really
unbelievable. A small child could do the math and figure out that That is not a good
investment
Since the fundraising has failed, the friends of Fox Point Pool have suggested having a
referendum. That would be a big mistake also. The lack of fundraising and the fact that they
have only raised $157,000 of 4 million in three years is a referendum in and of itself, and a
VERY loud one. It proves beyond a shadow of a doubt that people do not want this pool and
they do not want to pay for it.
I belong to Elite fitness. There are three pools there and I pay for those. The very small
group of people who want a pool have options of joining clubs that have pools. They would
pay for their own use of the pool and it would not be a burden on anyone else. There are
also public pools in other communities that are open to anyone, and people can go there if
they want outdoor pools in the summer.
The fact that the Friends of the Fox Point Pool who have failed to raise the money they
committed to and want to change the rules and want you to vote to change the rules is
HIGHLY offensive. They agreed to raise 4 million and they are not doing that. That means
DRAFT
this whole issue with the pool should be dead, done, closed. We should stop wasting time
and money on this issue. Unless they can come up with the money per the legal document
that was signed, there is no point in even discussing a pool anymore. And the fact that
there's no time limit on this fundraising is wrong. There should have been a time limit. This
can't go on forever. What if they raise the money in 30 years and then the pool is $16 million
then? What happens then? The whole thing is absolutely ludicrous.
When I first contacted the village president three years ago about the pool, we had a frank
email discussion. Christine told me that for every email she got in favor of the pool, she got
at least 10 against it. Once again, you need to pay attention to the amount of people who
do not want this pool. They do not want their taxes raised and that's exactly what will
happen and it'll be for something that they don't even use. The people who want the pool
often say 'Let the Village pay for it'. They have zero understanding that the 'village paying
for it' means tax payers pay for it. Who exactly do they think the village is? Some have
called for halting or slowing down trash collection and snow plowing. Talk about
stupid! Trash collecting and snow plowing affect the ENTIRE village. A pool does not. And
people who suggested this are really ignorant about how the village operates and what is
important to every person who lives in Fox Point. The pool certainly is not one of these
items that affects every person who lives in Fox Point.
We are already taxed to the Nth degree in Fox Point. Not having a pool will have zero effect
on how the Village operates. It is not a critical element. It is not even a necessary element.
You need to listen to the vast majority of this Village, and you need to put an end to this
whole Pool fundraising issue and building of a new pool.

Dear Village Board Members and Mr. Kreklow,
I’m writing as a Fox Point resident and longtime pool member to express my
strong support for moving forward with a new Fox Point Pool.
Our family has been a member for more than 15 years, and now that I have a
two-year-old daughter, I appreciate even more what a wonderful resource the
pool is for our community. It is one of the few places where families,
children, neighbors, and residents of different ages can spend time together
right here in Fox Point.
I understand that building and operating a new pool is a significant
investment, and I appreciate the Village looking carefully at costs as well as
potential partnerships with neighboring municipalities and institutions. I hope
the Board will continue exploring those options rather than allowing the pool
to disappear altogether.
For families with young children especially, having a safe and accessible
community pool nearby is incredibly valuable. It gives children an
opportunity to become comfortable around water, learn to swim, be active
outdoors, and build connections with other families in the community.
A new pool would also be an investment in Fox Point itself. Amenities like
this are part of what makes a community attractive to families who are
deciding where they want to live and raise their children.
Please continue working toward a financially responsible solution that allows
Fox Point to have a community pool for the next generation. I strongly
support the pool and would hate to see such an important part of our
community lost.
Thank you for your time and for considering residents’ input before
Tuesday’s meeting.
Best,
Ekaterina Vargas

Dear Village Trustees,
I am a 13-year Fox Point resident and previous pool member, and I’m writing to show my
support for moving forward with a replacement pool.
The recent analysis shows that resident membership increased 19% over the last 8 years
of operation. This shows strong continued demand even as the facility and its amenities
became severely outdated and deteriorated, and programming declined significantly.
The decline in non-resident memberships coincided with a nearly 80% drop in camps and
classes revenue, so the prior numbers aren't a strong reflection of the true non-resident
demand for a pool. And the other municipalities' lack of interest in helping fund the pool
does not mean their residents wouldn't use it. Non-residents may be interested in
becoming members even if their municipality does not have enough community-wide
support to invest public funds. We can't gauge non-resident interest based on the other
community municipal decisions.
It also shows that the pool itself would cost much less than the broader project estimate
and that operating partnership interest from the JCC and Nicolet Rec could reduce ongoing
village support and help market the pool to non-residents.
I encourage the Board to reconsider the 50% fundraising requirement and pursue a
realistic path forward, including a referendum, if appropriate. A modern facility would be a
meaningful long-term investment in Fox Point’s quality of life, community and prospective
families.
Thank you for your consideration!
Sincerely,
Kristi Carlson

Good afternoon,
I realize there are many residents who are very passionate and supportive of the Fox Point pool. I
am not against the pool but I am very concerned about the rising costs - both the cost to build and
ongoing operating expenses. I haven’t heard those supporting the pool talk about their support of
the cost. I know that the Village Manager is scheduled to address many topics related to the pool
tonight.
At last update, the fund raising committee has raised only a small portion of the required amount. I
don’t support changing the resolution to remove the fund raising component. The community has
to have a stake in the pool!
At a board meeting earlier this summer, there was discussion about ongoing flooding in the village.
Every time there is heavy rain, some homes flood. That is not acceptable! Someone’s home should
not flood every time it rains. Dealing with the flooding should be a higher priority than a new pool.
The village hall is aging. The repair expenses are becoming more significant. The air conditioning at
board meetings is less than ideal. Another priority.
While not a board issue, school taxes. School taxes continue to rise with no relief on the way. This
year is a good example - one referendum is expiring and another one is in the wings.
I am asking you to carefully consider the village priorities and the financial impact on tax payers.
Regards,
Claudia Koehler
7531 N Boyd Way
I understand the pool will be a discussion at today’s meeting, and I may not be able to
attend. Hopefully, you have reviewed previous information I had sent regarding other
communities and what the pool brings to Fox Point. Without Fox Point spearheading a
campaign and getting behind this project we will never get the donations needed.

Background
Staff has been working with PI Tower Development LLC and the Assistant General Counsel to
Harmoni Towers to clarify terms and conditions of the License Agreement between the Village
of Fox Point and PI Tower Development. Clarifications to the License Agreement include
addressing the fee for collocated facilities on the cell tower, notification procedures, and the
description of the licensed premises contained within the License Agreement and Exhibits. The
licensed premises is reflected on the attached figure which will be finalized upon approval of
the Amendment by the Village Board.
The attached Second Amendment to the Ground License Agreement reflects the intent of the
parties.
Recommendation
Staff recommends the Village Board approve the Second Amendment to Ground License
Agreement in a form approved by the Village Attorney with the understanding that the amount
due and owing under the Agreement will reflect the amount due at the time of execution of the

Re: Accept the proposal from raSmith in the amount of $53,012 for the design and
coordination of the Lead Service Line Replacement Program. (Pg. 44-46)
Background
Pursuant to EPA and Wisconsin Department of Natural Resource (DNR) regulations,
communities are required to remove all lead service laterals and determine the material of
unknown service laterals from the community water system. The lead and copper rule
improvements (LCRI) and lead service line replacement (LCLR) program takes effect on
November 1, 2027 and communities have ten (10) years in which to remove all lead services
and lead unknown services. The following table reflects the current breakdown of the service
inventory in the Village:
Public Side
Lateral Type
Private Side
Lateral Type
Category for
DNR Reporting
Purposes
Number of
Services in
Each
Category
Lead Lead Lead 51
Lead GRR Lead -
Lead Non-Lead Lead 10
Lead Lead Unknown Lead 2
Non-Lead Lead Lead 44
Non-Lead Galvanized Non-Lead 11
Non-Lead Non-Lead Non-Lead 2,202
Non-Lead Lead Unknown Lead Unknown 93
Lead Unknown Non-Lead Lead Unknown 4
Lead Unknown Lead Unknown Lead Unknown 2
Fox Point's current service line inventory contains approximately 206 service lines impacted by
the rules. On top of the requirement to eliminate the lead service lines, new monitoring rules go
into effect in 2028 which reduces the reporting limit from 15 ug/l to 10 ug/l (micrograms per liter).
In 2026, Fox Point's 90th percentile sample was recorded at 14 ug/l. In 2028, the Village will
be required to perform standard monitoring and will need to collect 40 samples in the first and
fifth liters twice each year until the 90th percentile is below the 10 ug/l standard or until all of the
lead services are removed from the system.
In light of the EPA and DNR rules, staff submitted a request for proposal to thirteen consultants
to address the following scope items:
• Review current Village ordinances to ensure compliance with DNR and EPA rules,
• Develop a replacement plan for the 206 water service laterals,
• Provide communications to residents regarding the requirement to remove the lead
water service lines,
• Prepare construction documents and coordinate bidding of the work, and
• Identify funding opportunities that may exist.
Of the thirteen consultants, eight submitted a proposal to the Village though two of the
consultants teamed on the efforts resulting in seven proposals submitted to the Village for
consideration. Each proposal was evaluated based on the following criteria and received a
score of 1 (lowest) to 10 (highest) in each category. The individual categories were also
weighted as follows:
• Firm experience and qualifications (25%)
• Project team and key personnel (20%)
• Project understanding and approach (20%)
• Funding and Safe Drinking Water Loan Program experience (20%)
• Cost proposal and value (15%)
The consultants were invited to interview with Village staff to further elaborate on their proposal
and to respond to a series of questions. After the interview, consultants were provided an
interview adjustment score that ranged from minus one (-1) point up to one point (+1). The
adjustment allowed staff to more accurately reflect our comfort level with the first three
categories after meeting the project team members and learning more about their respective
approach to the project.
The final scores along with the proposed cost for each consultant are identified below (in order).
As anticipated by staff, the scoring was very competitive and staff would be comfortable with
many of the consultants.+
1. raSmith - 8.22 - $53,012
2. Baxter & Woodman - 8.21 - $247,600
3. Kapur & Associates - 8.07 - $252,645
4. MSA - 8.03 - $188,992
5. Graef/City Water - 7.94 - $297,264
6. Bolton & Menk - 7.31 - $177,122
7. Ayres - 5.59 - $272,404
As part of the proposals, each consultant was to explain how they planned to identify the
composition of the unknown service laterals (lead, copper, etc.) and each were to include a plan
Page 45 of 96
for potholing (hydro-excavating) by the curb stop so that staff and the consultant could
physically see the material on the public and private side. Of the proposals received, raSmith
and Graef/City Water planned to contract the work as part of the known lead lateral replacement
project, so the cost was not identified. Conversely, Kapur and MSA included all potholing in the
contract ranging from $30,000 to approximately $89,000, respectively. Baxter & Woodman
included construction inspection costs for the potholing to be performed, but not the actual
potholing. Bolton & Menk included a $9,000 allowance to pothole eight to ten locations. Under
the scenario where all unknown laterals need to be potholed, one could expect to add a cost of
approximately $90,000 to raSmith's proposal and Graef's proposal and another approximate
$80,000 to Bolton & Menk's proposal.
While cost is only one component of the overall ranking, it does impact the final scores as
raSmith scored slightly higher on their cost (1.35) compared to the remaining consultants. Staff
is comfortable with raSmith's proposal, even though the potholing is not included in the original
scope of services, because they have a great deal of lead lateral experience in Cedarburg and
Menomonee Falls, performed well during the interview process, and have identified a
streamlined approach to identifying the unknown lead lateral services.
Recommendation
Based on the foregoing, staff is recommending that the Village Board accept the proposal of
raSmith in an amount not to exceed $53,012 for the Lead Service Line Replacement Program
project with the understanding that the contract is to be approved by staff and the Village
Attorney. It is staff's further recommendation that the Village Board authorize the Village
President and Village Clerk/Treasurer to sign the contract with raSmith.

Re: Resolution Concerning the Village of Fox Point Municipal Pool. (Pg. 47-49)
Background
For the past several years, Village policy regarding a municipal pool has been set by
Resolution 2023-15 "A Resolution Establishing a Municipal Pool Citizens Committee." This
resolution, in essence, states that if the Friends of the Fox Point Pool successfully raised at
least $4 million for a municipal pool, the Village would provide the remaining funds and proceed
with construction of a pool.
As part of a discussion on the Fox Point Municipal Pool at the September 8th Village Board
meeting, the Board directed the Village Attorney to draft a resolution that would modify
Resolution 2023-15 in the following two ways:
1. Reduce the expected contribution from the Friends of Fox Point Pool from $4 million to
$3.3 million to reflect 50% only of costs related to the pool and not 50% of the total
project costs.
2. Establish a deadline for fundraising efforts on February 1, 2030. If the Friends of the
Fox Point Pool do not successfully raise $3.3 million by that date, the Village's
commitment to provide the remaining funds to build a pool would expire.
The resolution requested by the Board was drafted by the Village Attorney and is included in
the packet for this meeting.

A RESOLUTION TO MODIFY THE FUNDRAISING GOALS IN RESOLUTION NO.
2023-15 WHICH ESTABLISHED A MUNICIPAL POOL CITIZENS COMMITTEE
WHEREAS, the Village of Fox Point Village Staff have previously concluded that the

entitled “A Resolution Establishing a Municipal Pool Citizens Committee” on or about July 11,
2023 (the “Pool Resolution”); and

the actual costs the funds received in excess of 50% shall be held by the Village for expenditure
solely for pool operations and post-construction capital improvements at the facility”; and
WHEREAS, the private fundraising efforts conducted by the Friends of the Fox Point
Pool (the “Friends”) have not met this fundraising goal to date, and the Friends have requested

Ron and Marie Yoder have applied for Conditional Use approval for Play It Again Sports, to

Conditional Use Order
WHEREAS, an application has been filed by Play It Again Sports (hereinafter "Applicant"); and
WHEREAS, the Applicant is requesting that a conditional use permit be granted pursuant to the
Zoning Ordinance of the Village of Fox Point for the property located at 8643 N Port Washington Road,
Fox Point, Wisconsin.
NOW, THEREFORE, the Village of Fox Point Village Board, upon consideration of thoughts
expressed by all persons heard at the Village Board meeting in this matter, upon consideration of the
recommendation from the Plan Commission, and following all necessary study and investigation, having
given the matter due consideration, hereby ORDERS AS FOLLOWS: Commencing upon the date hereof,
the Applicant is hereby granted a conditional use permit, subject to initial and continued compliance with
each and every one of the following conditions, restrictions and limitations.
1. Use Restricted. Play It Again Sports will operate a retail sporting goods and consignment
establishment.
a. Hours of operation shall be limited to Monday through Friday, 10 AM – 8 PM,
Saturdays from 10 AM – 6 PM, and Sundays from 12 PM – 5 PM unless additional
hours are approved in writing by the Village Manager and remain consistent with
Municipal Code Section 340-9.
b. Outdoor display of merchandise prohibited.
c. Obtaining other required licenses, permits, and approvals. This includes but is not
limited to building permits, permits completed to the satisfaction of the Director of
Public Works, and/or Milwaukee County and State of Wisconsin approvals.
2. Presentation Compliance. All of the Applicant’s plans, specifications, terms and representations as
submitted with the application, or in support thereof, or as represented to the Village Board in the
course of the approval process, are specifically incorporated herein and made a part hereof by
reference, and the use of the subject property shall be in substantial conformance with the same
except as further restricted or modified herein.
3. Not Transferable. This conditional use permit is granted to the Applicant and shall not be transferred
or assigned without the Village Board’s prior written consent, which may only be granted following
the Village Board’s receipt of a recommendation from the Plan Commission.
4. Applicant and Owner Agreement. As a condition precedent to the issuance of the conditional use
permit, the owner of the Subject Property shall approve the issuance of this conditional use permit
upon the terms and conditions described herein in writing, and the Applicant is required to accept
the terms and conditions of the same in its entirety in writing.
5. Other Uses Prohibited. Any use not specifically listed as permitted shall be considered to be
prohibited except as may be otherwise specifically provided herein. In case of a question as to
whether a use is permitted, the question shall be submitted to the Plan Commission for
recommendation to the Village Board, and then to the Village Board for determination.
6. No Nuisances, and Compliance with Applicable Laws. No use is hereby authorized unless the use
is conducted in a lawful, orderly and peaceful manner. Nothing in this order shall be deemed to
authorize any public or private nuisance or to constitute a waiver, exemption or exception to any
law, ordinance, order or rule of either the municipal governing body, the County of Milwaukee, the
State of Wisconsin, the United States of America or other duly constituted authority, except only to
the extent that it authorizes the use of the subject property above described in any specific respects
described herein. This order shall not be deemed to constitute a building permit, nor shall this order
constitute any other license or permit required by Village ordinance or other law.
7. Subject Property Only. This conditional use hereby authorized shall be confined to the Subject
Property described, without extension or expansion other than as noted herein.
8. Abandonment. Should the permitted conditional use be abandoned in any manner, or discontinued
in use for twelve (12) months, or continued other than in strict conformity with the conditions of the
original approval, or should the Applicant be delinquent in payment of any monies due and owing
to the Village, or should a change in the character of the surrounding area or the use itself cause it
Page 54 of 96
2
to be no longer compatible with the surrounding area or for similar cause based upon consideration
of public health, safety or welfare, the conditional use may be terminated by action of the Village
Board following receipt of a recommendation from the Plan Commission and after the Village Board
holds a public hearing in the matter.
9. Amendments. Any change, addition, modification, alteration and/or amendment of any aspect of
this conditional use, including but not limited to an addition, modification, alteration, and/or
amendment to the use, premises (including but not limited to any change to the boundary limits of
the Subject Property), structures, lands or owners, other than as specifically authorized herein, shall
require a new permit and all procedures in place at the time must be followed.
10. Plan Amendments. Unless this conditional use permit expressly states otherwise, plans that are
specifically required by this conditional use order may be amended (a) without separate approval in
the limited circumstances described in Section 14.19(11) of the Village Code; or (b) by the Village
Board upon receipt of a recommendation from the Plan Commission if the Village Board finds the
plan amendment to be minor and consistent with the conditional use permit. Any change in any
plan that the Village Board, in its sole discretion, finds to be substantial shall require a new permit,
and all procedures in place at the time must be followed.
11. Severability. Should any paragraph or phrase of this conditional use permit be determined by a
Court to be unlawful, illegal or unconstitutional, said determination as to the particular phrase or
paragraph shall not void the rest of the conditional use and the remainder shall continue in full force
and effect.
12. Most Restrictive Applies. If any aspect of this conditional use permit or any aspect of any plan
contemplated and approved under this conditional use is in conflict with any other aspect of the
conditional use or any aspect of any plan of the conditional use, the more restrictive provision shall
be controlling as determined by the Plan Commission.
13. Prior Conditional Use Permits Terminated. Unless stated otherwise herein or in the documents
incorporated herein, all conditional use permits previously granted for the Subject Property, if any,
shall be automatically terminated without further action of the Village Board immediately following
full satisfaction of all condition’s precedent to this conditional use order taking effect.
14. Payment of fees. Applicant shall, on demand, reimburse the Village for all costs and expenses of
any type that the Village incurs in connection with this conditional use order including the cost of
professional services incurred by the Village (including engineering, legal, planning and other
consulting fees) for the review and preparation of required documents or attendance at meetings or
other related professional services for this application, as well as to enforce the conditions in this
conditional use order due to a violation of these conditions.
15. Payment of Taxes and Charges. Any unpaid bills owed to the Village by the Subject Property Owner
or his or her tenants, operators or occupants, for reimbursement of professional fees; or for personal
property taxes; or for real property taxes; or for licenses, permit fees or any other fees owed to the
Village; shall be placed upon the tax roll for the Subject Property if not paid within thirty (30) days
of billing by the Village, pursuant to Section 66.0627, Wisconsin Statutes. Such unpaid bills also
constitute a breach of the requirements of this conditional use order, that is subject to all remedies
available to the Village, including possible cause for termination of the conditional use order.
16. Conditions Shown in Minutes Incorporated. All conditions of approval imposed by duly adopted
motion of the Village Board in its consideration of the Applicant’s application, as noted in the
Minutes of the Village Board meeting at which approval was granted, are specifically incorporated
herein by reference.
17. The Applicant is obligated to file with the Village Clerk a current mailing address and current phone
number at which the Applicant can be reached, which must be continually updated by the Applicant
if such contact information should change, for the duration of this conditional use. If the Applicant
fails to maintain such current contact information the Applicant thereby automatically waives notice
of any proceedings that may be commenced under this conditional approval, including proceedings
to terminate this conditional use.

Re: Consideration of Outdoor Recreational Use Request for Pickleball Play and
Construction of Courts on Existing Tennis and Basketball Courts, Located at the
Porticos, 500 W Bradley Road, Under Section 745-10 of the Fox Point Municipal
Code. (Pg. 57-61)
Background
Munson Inc, on behalf of the Porticos, is requesting Outdoor Recreational Use Approval for the
property located at 500 W Bradley Road, to reconstruct and allow pickleball courts on the
existing tennis and basketball courts. The Village Attorney has determined that the addition and
operation of pickleball courts constitutes a public outdoor recreational use requiring formal
approval under Section 745-10 (Outdoor Recreational Areas and Facilities) of the Municipal
Code (LINK).
The Porticos is a multifamily development located at 500 W Bradley Road, which was
constructed in the 1970s. The subject property is bound by Interstate 43 on the west, the
Willows apartments and Congregation Sinai on the east, open space owned by Mapledale
School to the north, and Bradley Road to the south. The Fox Point Village Board designated
the subject property with PDO Planned Development Overlay zoning district in 1971 via
ordinance No. 394.
The applicant is requesting to alter the existing sport courts; five tennis courts and one
basketball court. If approved, the proposal indicates that the rough area of one tennis court and
the basketball court would be removed, leaving less total paved area. Four pickleball courts
towards the west of the existing area (nearest to the interstate) would be constructed, and 2
existing tennis courts would remain.
On September 14, the Plan Commission reviewed the application making findings that the
request is appropriate in the location, compatible with the neighborhood, protects surrounding
property values, and is consistent with the residential character of the Village. The Plan
Commission additionally recommended conditions which reflect other pickleball requests in the
Village.
Recommendation
As long as all issues which arise during discussion are addressed, Staff recommend that the
Village Board to approve the Outdoor Recreational Use request, following a public hearing,
subject to the following conditions recommended by the Plan Commission and any others
which may have arisen during discussion:
1. Pickleball use is limited to the residents of the Porticos and their guests only. Pickleball
use is not allowed for commercial enterprise.
2. Pickleball play is allowed Monday/Wednesday/Thursday from 10AM - 6PM,
Tuesday/Friday from 10AM – 8PM, and Saturday/Sunday from 9am – 4PM.
3. Pickleball play is allowed from May 1 – September 30.
4. No amplification of music is allowed.
5. Courts may not be illuminated.
6. There shall be a review one year following the execution date of the Outdoor Recreation
approval.

Re: Consideration of a Resolution Supporting a Community Development Investment
Grant Application for the Redevelopment of 8000 N Port Washington Rd. (Pg.
62-65)
Background
Given constraints with levy limits and to act upon goals of the Comprehensive Plan, Village
Staff have been working to activate vacant, blighted, or underutilized properties for a number of
years. To assist with the redevelopment of the Port Washington Road commercial corridor,
Village Staff drafted the Port Washington Overlay Zoning District (PDF) which was unanimously
adopted by the Village Board in January of 2025 as Section 745-22.5. John Degroote
(Developer) applied for Port Washington Overlay (PWO) zoning designation for the
redevelopment of 8000 N Port Washington Road to create Acronym Brewing Company which
was unanimously approved by the Village Board in December 2025 and recorded as Ordinance
2025-06.
Staff have proactively been in contact with representatives of WEDC and Milwaukee Economic
Development Corporation (MEDC) over the last few years to find grant funding or other
opportunities to support business growth in the Village. The CDI (Community Development
Investment) maximum grant amount is $250,000 in order to get promising development
projects over the finish line. A formal resolution by the Board must be submitted in order to
sponsor the application and the municipality may only sponsor one per year. Due to
macroeconomic factors such as the interest rate environment, commodities, and materials
pricing, the initial project cost has increased, and the proposal is now only feasible with this
grant funding.
An intake committee at WEDC has already reviewed preliminary application materials
favorably, indicating project merit; an adaptive reuse of existing structure, creating a catalytic
use on a major commercial corridor, and activation of vacant spaces while reducing blight are
all goals of the grant. The WEDC calendar year is from July 1 - June 30 so applications are
reviewed and awarded early in the cycle as funding is available. Since the WEDC requires a
municipal sponsor, Village Staff role is largely administrative; applying for the grant, receiving
and disbursing funds, and filing required reports. There is no financial commitment of Village
Page 62 of 96
funds for this project.
Recommendation
Staff recommend the Village Board approve a resolution supporting a Community Development
Investment Grant application for the redevelopment of 8000 N Port Washington Road.

Re: Resolution Approving a Financial Commitment and Financial Operational
Procedures for the North Shore Library. (Pg. 68-72)
Background
For a combination of reasons, the North Shore Library is experiencing financial pressures that
need to be addressed if the four partner communities wish to maintain current levels of service.
Under the existing Library agreement, municipal contributions are limited to the average of
allowable tax levy increases for the four partner communities, plus one percent. Since the
allowable tax levy increases for the partner municipalities has been very low for several years,
municipal contributions have not kept pace with costs for salaries and benefits, as well as
books and other supplies. These ongoing challenges were exacerbated by shortfalls in the
2025 and 2026 budgets that resulted from approximately $83,000 in unplanned expenses.
The new Library facility also impacts finances. The larger and more modern facility offers more
opportunities for programming, as well as additional meeting and community space. Initial
numbers show that Library usage has increased by 25% since the new facility opened.
However, the larger and more complex facility also results in increased operating expenses.
Municipal contributions will need to increase to maintain service levels similar to neighboring
communities. As the table below shows, the funding available per capita is much lower for the
North Shore Library than other peer libraries.
Library Per Capita Expense
North Shore $37.68
Brown Deer $55.32
Whitefish Bay $71.72
Shorewood $82.44
Over the past several months, the Village Managers from the four member communities have
met with Library staff and members of the Library Board to develop a financial strategy to get
the Library back on solid financial ground. The strategy that was developed includes the
following three components:
1. Operating Efficiencies and Cost Control — The 2027 Budget adopted by the Library
Board includes over $70,000 in operational savings.
2. Temporary Additional Municipal Support — The four member communities would
increase support for the Library by more than the original agreement. Contributions
would increase from the previous year's contribution by 9% in 2027, 6% in 2028, and
4% in 2029, as illustrated in the table below
2027 2028 2029
% Increase from
Prior Year
9.0% 6.0% 4.0%
3. Third Party and Alternative Revenue — The Library Board would expand efforts to
generate grants, donations, sponsorships and other appropriate non-municipal
revenues.
Under the proposed plan, the Village of Fox Point's contribution to the North Shore Library
would increase by $24,242 from $269,348 in 2026 to $293,590 in 2027. The table below
summarizes the contributions for Fox Point and other member communities for the next three
years.
2027 2028 2029
Member
Contributions
Bayside $194,718 $206,401 $214,657
Fox Point $296,589 $311,204 $323,653
Glendale $552,580 $585,735 $609,164
River Hill $78,549 $83,262 86,592
Total $1,119,436 $1,186,602 $1,234,066
The proposed plan also includes the safeguards to enhance the financial management
practices of the North Shore Library:
• A budget reconciliation plan within 30 days if fund balance falls below 10%;
• Quarterly financial review by the Library Board Finance Committee;
• At least twice-annual financial and budget meetings with the municipal
managers/administrator;
• Creation of an enrichment fund and operational fundraising plan in 2027;
• Maintenance or enhancement of existing Library hours;
• Annual financial presentations to each Village Board and Common Council; and
• The ability for municipalities to return to the funding level required under the existing
agreement if the financial safeguards are not satisfied
The Village Boards for Bayside and River Hills and the City of Glendale Common Council have
approved the agreement through the adoption of similar resolutions.
Recommendation
Approve the Resolution Approving and Financial Commitment and Financial Operational
Procedures for the North Shore Library.

Re: Resolution Approving a "Single or Multi-Year Capital" Budget to Purchase Large
Apparatus Equipment from 2027-2031. (Pg. 73-81)
Background
The North Shore Fire Department (NSFD) Board of Directors unanimously recommended that
each of the member municipalities approve NSFD Resolution 26-02 (attached) establishing a
rolling capital funding plan for major apparatus and ambulance replacements through 2031.
This resolution replaces the resolution approved in 2025. The NSFD has used this method to
fund replace of major apparatus since 2012. Each year, NSFD presents an updated resolution
replacing the previous one.
Maintaining a rolling five-year funding plan is important because new fire apparatus often
require up to four years from time of order until delivery. The approved five-year funding plan
allows NSFD to place orders far enough in advance to ensure that new equipment is received
before existing apparatus reaches the end of their useful service life.
The total contributions for capital apparatus from all member communities for 2027 will be
$1,121,000. Per the North Shore Fire Department agreement, the Village of Fox Point share is
8.71% of this total. The resolution must be approved by all member communities to take effect.
If approved, the five-year plan would include the following contributions from the Village of Fox
Point.

Re: Resolution Approving the 2027 North Shore Fire Department Fees For Service
Schedule. (Pg. 82-92)
Background
Each year the North Shore Fire Department (NSFD) updates their Fee For Service Schedule.
Following passage by the NSFD Board of Directors, the updated Fee For Service Schedule
must be passed by resolution by at least five of the seven member communities before it takes
effect.
The Fee for Service Schedule includes the following types of fees:
1. Fees for Emergency Services
2. Fire Prevention Permits/Inspections
3. Administrative Fees
The NSFD is recommending a 2.9% increase to all Emergency Fees except for BLS Service
and/or Treatment without Transport - Resident. NSFD is recommending a increase in that fee
from $155.60 to $175. The $175 rate would match reimbursement rates from Medicare under
2025 Wisconsin Act 36.
NSFD is not recommending any changes to Fire Prevention Permits/Inspection fees for
Administrative fees at this time.

Re: Resolution Authorizing an Exception to the Levy Limits for Charges for the North
Shore Fire Department Pursuant to 2005 Wisconsin Act 484. (Pg. 93-96)
Background
Section 66.0602(3)(h) provides that levy limits otherwise applicable to municipalities under
Chapter 66 of the Wisconsin State Statutes do not apply to the amount that a city or village may
levy in that year to pay for charges assessed by a joint fire department, to the extent that the
amount levied to pay for such charges would cause the city of village to exceed the limits
imposed under Section 66.0602. As a member of the North Shore Fire Department (NSFD),
this exception to levy limits could apply to the Village of Fox Point.
For the exemption to be applicable to any member municipalities, all member municipalities
must pass a resolution in favor of allowing this exception to be used. The NSFD Board of
Directors unanimously passed a resolution recommending that all seven member communities
pass that attached resolution to allow the levy limit exception to be used. Every community
must pass this resolution by November 15th of this year.
