Centennial Fall Event
The Fall Centennial event will be hosted on the Chipstone Foundation’s grounds to showcase Fox Point’s
history, architecture and neighborhoods as the final event of the Centennial year.
The date will be Saturday, September 5, 2026, 11:00am to 2:00pm. Other dates were considered in
September but wanted to avoid currently scheduled local gatherings and religious holidays as well as ensure
the landscaping is still vibrant and thriving.
Proposed Event Activities:
• The Chipstone exterior grounds will be open to visitors 11:00am to 2:00pm. Visitors are invited to stroll
around the grounds, observe landscaping and bring in a packed lunch (“old-fashioned picnic”) if so desired.
Free refreshments may be provided (TBD), but there will be no options of purchasing food will be available.
Open to all ages.
• The Carriage House will be open with possible artists demonstrating woodworking and the contemporary
art gallery on the second floor. Open to all ages.
• Chipstone will conduct 4 tours of 12 people each (45 minutes each, 2 groups at 11AM and 2 groups at
1PM). Tours would be free. Online sign up required and organized by Centennial Planning Committee. Tours

• The Fox Point historical book will be released and complimentary copies will be given out at this event.
Douglas Frazer will be on hand to sign copies.
• Possible walking tour of neighborhood by Eric Vogel (Docomoco) or someone else in to highlight some
special architecture in the area.
• Possible musicians onsite during event. This would need to be sponsored or paid for by something other
than the Centennial budget. Chipstone looking into.
Since parking is limited at the property and on the roads in the neighborhood, walking and biking will be
encouraged. Chipstone and the Centennial Committee will investigate providing transportation to the property
so attendees can park offsite (Longacre Pavilion) and be bussed to Chipstone to limit parked vehicles.
Chipstone will first look into using their passenger van, otherwise Centennial may be able to arrange

Re: Aquatics Facility
Overview
During the March 2026 Village Board meeting under the Future Agenda Items section of the agenda,
President Symchych requested from Staff a review of action taken regarding the aquatics facility, and to
invite the Friends of the Fox Point Pool to give a presentation on fundraising progress.
Background
The Fox Point Municipal Pool operated from 1968 until 2023. The facility was demolished in 2025 as part
of the capital budget to prepare the site in expectation of future fundraising. All aquatics facility
documents such as the 2019 survey (PDF), concepts, studies, and presentations are available on the
Village website (LINK).
Request
In the last five years, the Fox Point Village Board has taken affirmative action towards a new facility.
Below is a timeline of formal action taken by the Village Board including links to minutes, video
recordings of discussion, and any pertinent documents.
November 2022 (VIDEO LINK)
The Village Board reviewed 2019 Ayres aquatics facilities concepts (PDF); two concepts located at
Longacre and two concepts located at the current Santa Monica location.
No formal action was taken (PDF), however, the Village Board expressed a desire to continue
providing aquatic recreation in the Village.
December 2022 (VIDEO LINK)
The Village Board directed Staff to return with updated cost estimates for the 2019 Ayres aquatics
facility concepts. No formal action was taken (PDF).
42
February 2023 (VIDEO LINK)
Parkitecture + Planning returned with updated cost estimates (PDF) for the 2019 Ayres aquatics
facility concepts as was directed in December of 2022. No formal action was taken (PDF).
July 2023 (VIDEO LINK)
Following the unfortunate closure of the pool (PDF), the Village Board took a number of formal
steps towards a new aquatics facility.
After lengthy discussion, the Village Board unanimously (PDF) (7-0 Symchych, Fonstad, Sumner,
Ollman, Anderson, Aelion, Stoltz) adopted Resolution R2023-15 (PDF) which established a
Municipal Pool Citizens Committee tasked to help locate an existing entity or assist citizens with
creating a fundraising entity for a new aquatics facility, and additionally committed the Village to a
new aquatics facility once private fundraising hits a target of $4,000,000 (the expected 50% cost
for a future facility).
November 2023 (VIDEO LINK)
Throughout 2023, the Municipal Pool Citizens Committee, which solicited members from the
community to take part, assisted with the creation of the Friends of the Fox Point Pool (LINK), a
501c3 tasked with private fundraising for the new aquatics facility.
After lengthy discussion during the November meeting, the Village Board unanimously (PDF) (7-0
Symchych, Fonstad, Sumner, Ollman, Anderson, Aelion, Stoltz) selected the current Santa Monica
location as a future aquatics facility site and directed Staff to return to Parkitecture + Planning for
two facility concepts on the site.
March 2024 (VIDEO LINK)
Parkitecture + Planning presented two concepts (PDF) for aquatics facilities based on previous
Village Board feedback. The Village Board unanimously approved (PDF) (7-0 Symchych, Fonstad,
Sumner, Ollman, Anderson, Aelion, Stoltz) a site with conceptual drawings (PDF) to assist the
Friends of the Fox Point Pool with fundraising.

Dear Village Board and Village Leadership,
Thank you for allowing The Friends of the Fox Point Pool (FFPP) an opportunity to give you and the
community an update.
Since June 2024, the FFPP Board, committees, and volunteers have worked to build community awareness
about the pool, engaged in grassroots fundraising, reached out to scores of potential major donors and
assessed the feasibility of meeting the private fundraising goals outlined in the Board’s resolution. In
addition to our update, we would also like to share several challenges we are facing, request clear answers
to questions we have received from potential donors, and ask for your assistance in our efforts moving
forward including adding an agenda item to the June Village Board meeting so that the Board can discuss
these matters in detail.
Community Engagement and Progress to Date
Since June 2024, the FFPP Board, committees, and volunteers have:
• Formed a 501(c)(3) nonprofit organization with the help of skilled community volunteers who have
expertise in legal, finance and fundraising.
• Created and distributed grassroots awareness materials – postcards, fliers, yard signs, pamphlets,
and buttons – which were funded largely by the Board of the FFPP and community volunteers.
• Had a presence at many community events over the past two years, including, Fox Point Foundation
events, Fox Point Farmers Market, Fox Point 4th of July Celebration, Fox Point Village Open House,
Stormonth Bayside’s Cupcake Run and more.
• Facilitated hundreds of direct conversations with residents and potential donors.
• Ran multiple digital and print fundraising campaigns – cold letter outreach to top potential donors,
matc hing donor drives, Giving Tuesday, end of year asks, and more.
• Broadened awareness of our campaign by securing a feature article in North Shore Magazine,
and advertising in the Nicolet Rec Department Bulletin, which are sent to every village household.
• Partnered with our Village youth through The Lemonade Stand Challenge in summer 2025 and
Bayside Middle School 5th grade Girl Scout Troop for fundraising events.
These combined efforts have led to more than 300 donations and pledges totaling $158,200, with the
majority (78.4% of unique donors) coming from Fox Point residents.

Fundraising Challenges
Despite the FFPP’s strong progress in raising awareness and generating broad grassroots support, we are
facing significant challenges—especially in securing campaign advancing donors for the pool project. Our
major donor committee, made up of experienced fundraisers with deep community connections, reached
out to over 100 potential donors. Many expressed concerns about the feasibility of the project and the
Village’s commitment to it. The key themes that we heard include:
• Donor s are unsure if philanthropy alone can realistically raise $4 million.
• Many ar e hesitant to be early contributors when they perceive uncertainty or limited commitment
from Village leadership.
• Donor s want a clearer, more detailed plan and timeline for the project.
• Donor s desire clearer guidance from Village leadership on long term maintenance, tax implications,
and decision making processes.
• Donor s want to know if scaled back or phased construction options exist.
• They also want to learn what is realistic and achievable in the near term.
• Residents hold diff ering views on the balance of public and private funding—some question why
private fundraising is needed at all, while others ask why FFPP is expected to raise funds for the
entire f acility, including the playground and community room, rather than just half the pool cost.
It is important to emphasize that the current fundraising total should not be interpreted as a lack of
community support for the pool. The Village’s 2019 survey—based on 935 responses, (34% of Fox Point
households) —showed that 84% of respondents support maintaining a pool in Fox Point. Throughout our
two year campaign, the majority of residents we’ve spoken with at events and via email have expressed
support for having a pool in the community.
Fox Point Pool private fundraising requirements versus other local and regional projects
The private fundraising ask for the Fox Point Pool was modeled after the Bridge Lane Ravine Footbridge,
which may have been the best available project comparison at the time, however after researching other
publicly owned and maintained outdoor pools in our region of Wisconsin completed within the last 2-8
years, we found that none of them had a 50% required private fundraising ask.
2
45
A reason many potential donors wonder if raising $4 million privately is realistic also has to do with the size
of our community compared to the size of the fundraising goal. When we look at recent local projects, the
difference becomes clear:
Project Name Date

Fox Point

If the Village Board wants to help make a new Fox Point Pool a reality for our community, then we need
your assistance now to find a path forward. The Friends of the Fox Point Pool are a fundraising entity only
– we can’t make policy, get alternate bids for the project or approach neighboring municipalities to discuss
joining forces to bring back the pool. We need the Village Board to address these obstacles to land the first
large donors that will build momentum.
We hope the Village Board would consider moving forward on one or more of these potential actions
regarding the pool fundraising:
• Revisit discussion about amount of required private fundraising to build the pool.
• Adopt a new pool resolution with a more achievable private fundraising goal (we recommend $1
million), along with a c lear time line, defined scenarios and a possible alternate scenarios. This will
give don ors confidence that the project is realistic.
• Explore partnerships with neighboring communities (Whitefish Bay, Bayside, Glendale) to share
costs and rebuild the pool together.
• Hold a November 2026 referendum so residents can vote on publicly funding the pool as a
community asset. If approved, current FFPP funds could support future maintenance.
We ask that you please review the supplied information and add an agenda item for the June Village Board
meeting to discuss actions Village leadership can take to address the challenges we are facing so we can
work together to return the pool to our community.
If we work together to achieve success, the pool can be a lasting investment in Fox Point’s future: one
that supports connection, physical, mental and emotional well-being for all ages, and a strong sense of
community for generations to come.
Sincerely,
The Friends of the Fox Point Pool Board

Re: Pickleball Use on Village-Owned Facilities – Recreational Use Approval
Overview
The Village Board is asked to consider approval of pickleball courts located on Village-owned property in
the F Institutional District. Repair of Village-owned tennis courts were included in the 2023 capital plan
and included striping of the courts to include lines for pickleball.
The Village Attorney has determined that the addition and operation of pickleball courts constitutes a
public outdoor recreational use requiring formal approval under Section 745-10 (Outdoor Recreational
Areas and Facilities) of the Municipal Code (LINK) and Section 745-20 (F Institutional District) (LINK).
Background
The adopted Village capital plan included restriping its existing municipal tennis courts to include
pickleball court markings. The restriping did not involve expansion of the court footprint, installation of
new structures, or modification of impervious surface area.
Shortly thereafter in 2023, a private club in the Village applied for conditional use approval to convert its
tennis courts to pickleball courts. The Village Attorney determined that the conversion constituted a
change of use requiring formal approval. After approval was granted, litigation was initiated and later
resolved through settlement. Pickleball play on the striped Village courts (Indian Creek) was prohibited
until a use approval was granted.
The Village Attorney has advised that the Village Board should formally approve the municipal pickleball
courts to ensure procedural consistency and full compliance with the Zoning Code.
Request
The Village should investigate approval of the existing municipal courts for use as pickleball courts as a
public outdoor recreational facility pursuant to: Section 745-10 (Outdoor Recreational Areas and
Facilities) and Section 745-20 (F Institutional District). No physical expansion of the courts is proposed.
The request is limited to formal zoning authorization of the pickleball use.
Staff Analysis
51
The subject property is located in the F Institutional District under Section 745-20, which permits the
following:
• Buildings and adjoining grounds for municipal purposes (Section 745-20A(2)(a))
• Community recreational purposes operated on a not-for-profit basis (Section 745-20A(2)(d))
Under Section 745-10B(1), the existing courts are owned and operated for public recreational use, they
qualify as a Public Facility.
Section 745-10A requires that outdoor recreational facilities:
• Not create a nuisance or hazard
• Not result in substantial adverse effect on surrounding property values
• Not be detrimental to public welfare
• Include reasonable efforts to control lighting and provide appropriate screening
• Provide adequate off-street parking
Under Section 745-10F(4) and Section 745-20B(2), the Board must consider:
• Appropriateness in location;
• Compatibility with the neighborhood;
• Protection of surrounding property values;
• Consistency with the residential character of the Village.
Pickleball is functionally similar to tennis in land-use and physical footprint. With reasonable conditions,
the Board may find that the use is compatible with surrounding residential properties and public park
space.
Process
Under Section 745-10C, public recreational facilities owned and operated by a governmental agency
may be permitted in any district subject to the procedure set forth in Section 745-10F.
The required process includes:
1. Referral by the Village Board to the Plan Commission for study and recommendation.
2. Plan Commission recommendation back to the Village Board.
3. Village Board shall hold a public hearing and may take action to approve, deny, or approve with
modification.
Recommendation
Staff recommends that the Village Board refer the pickleball use on Village-owned facilities to the Plan
Commission for study and recommendation per Sections 745-10 and Section 745-20 of the Fox Point
Municipal Code.

plan that the Village Board, in its sole discretion, finds to be substantial shall require a new permit,
and all procedures in place at the time must be followed.
11. Severability. Should any paragraph or phrase of this conditional use permit be determined by a

Re: Chipstone Electrical Generator – Cultural Overlay
Overview
Uihlein Electric, on behalf of the Chipstone Foundation, has applied for a permit to allow a backup
generator on the property located at 7820 North Club Circle.
The Village Attorney has determined that the existing property is governed by Cultural Overlay approval
and a modification of the site to allow a generator requires formal approval under Section 745-22 Cultural
Overlay District of the Fox Point Municipal Code (LINK).
Background
The Chipstone Foundation operates a museum on the subject property and entered into an agreement for
the operations of such facility with the Village in 1988 under Cultural Overlay authority.
Request
The property owner is requesting to add a backup generator on the east facade of the principal
structure, immediately adjacent to the rear of the building, and located 151ft from the side yard (north)
property line and 96ft from the rear yard (east) property line. The applicable underlying setbacks of the
A-1 Residence District are 20ft side yard and 20ft rear yard, which the subject property easily meets.
Process
On April 14, 2026, the Village Board referred the request to the Plan Commission for study and
investigation after finding that the proposed generator is not a material change to the existing Cultural
Overlay and waived a requirement of a public hearing. The Plan Commission met on May 4 and
unanimously found that Section 745-22E was satisfied.
Recommendation
Staff recommends the Village Board approve the request.

Proposed Backup Generator
7820 North Club Circle, Fox Point, WI
To Whom It May Concern:
The Chipstone Foundation would like to place a backup generator on its museum
property located at7820 North Club Circle in Fox Point. The property experiences frequent
power outages during storms. Since the museum houses the Foundation's collection, a backup
generator will help protect the collection during those power outages. The generator will be
placed on the east side of the museum, between the museum and the ravine, where an existing
half wall will shield the generator from view.
The Chipstone Foundation has requested that Uihlein Electric submit the necessary
application to the Village on its behalf. By signing this letter, the undersigned hereby confirms
that The Chipstone Foundation has authorized Uihlein Electric to submit the application and any
supporting information on its behalf.
If you need any additional information or confirmation of the authority granted to Uihlein
Electric, please contact me at 414-238-6255 or edunn@chipstone.org.

Statement of Intended Use – Backup Generator Installation
This statement is submitted in response to the requirement for a description of the general
character of the intended use of the premises, including the days of the week and hours of
the day during which people will be permitted on site.
The intended use of the premises is the installation and maintenance of a standby generator
system to provide backup electrical power in the event of a utility outage. The generator
will serve as an emergency power source only and will not be used for continuous or
routine power generation.
All installation, testing, and related labor activities will be conducted during normal
weekday business hours. Work is anticipated to occur Monday through Friday, unless
otherwise approved. No regular evening, overnight, weekend, or public access use is
proposed as part of this installation.
Once installed, the generator will remain on-site in a standby capacity and will operate only
during power outages or during brief, scheduled testing in accordance with applicable
codes and manufacturer requirements.

Work Order Agreement—Engineering Services
CLIENT: Village of Fox Point DATE: May 5, 2026
PROJECT: North Beach Drive Bluff Stability Evaluation
PROJECT DESCRIPTION
Based on our site walkthrough with Mr. Scott Brandmeier, we understand there are three
areas of concern for bluff stability along North Beach Drive in the Village of Fox Point. The
location of each area is shown on the attached Vicinity Map.
Area A is an approximately 650-foot-long gravel path that traverses down the
approximately 95’ tall bluff beginning at East Fox Lane and ending at North Beach Drive.
We understand the path was constructed approximately 8 years ago to provide a potential
additional access road down to North Beach Drive. A recent soil slide along the portion of
the path adjacent to the 1717 E Fox Lane property has resulted in vertical displacement of
the gravel path. During our site walkthrough, we observed the surficial soils upslope of the
path were wet and a soil slide was present upslope of the path. We understand the Village
wishes to have the entire length of the path evaluated and restored.
Area B is the stacked flagstone retaining wall along the west side of North Beach Drive and
across the street from the 7900 N Beach Drive property. The existing limestone block
retaining wall is severely bulging and the upper courses of block indicate portions of the
wall have dropped vertically. Behind the limestone blocks appears to be timber posts every
several feet and at least an upper timber board. Therefore, the limestone blocks may be a
façade installed at a later date in front of a timber post and lagging retaining wall. On the
date of our walkthrough, it appeared the slope above the retaining wall was stable.
Therefore, we suspect the bulging may be due to the lateral earth pressure of the soil that
has accumulated between the timber wall and the limestone block wall. We understand
the Village wishes to repair the retaining wall.
Area C is located at the south end of North Beach Drive adjacent to the 7106 N Beach Drive
property where the wet soil mass from a recent slide upslope has accumulated behind the
existing dry stacked CMU retaining wall around a fire hydrant. Additionally, the gravel
backfill behind the recently installed low timber retaining wall along the drive has been
displaced during the recent heavy rains. While the existing CMU retaining wall does not
show signs of distress, the additional lateral earth pressure from the wet soil mass behind it
may cause future wall instability. We understand the Village wishes to remove the soil mass
from the recent slide and have the bluff slope adjacent to the low timber retaining wall
evaluated.
SCOPE OF WORK
To develop concept designs for repair and stabilization work for each of the three areas of
concern, our scope of services will consist of the following for each area:
1. Perform a Topographic Survey of the existing site conditions for each of the areas of
concern which will include surface features, pavement, marked utilities, and visible
slope features. This information will be used to prepare an Existing Conditions Plan for
each area.
72
2. Perform Manual Borings at each area of concern to determine the soil
characteristics in locations of each of the slides in Areas A and C and behind the
retaining wall in Area B. All soil samples obtained will be classified and moisture
contents obtained.
3. Provide a Concept Plan to repair and stabilize each area of concern. The plan will
consist of recommended grading and path repair for Area A, a retaining wall repair
plan for Area B, and a grading plan for the Area C. These plans are NOT
construction ready documents but can be used by a contractor to develop
preliminary construction cost estimates for budgeting purposes.
Upon Village approval of the concept plans, we can provide a Contract Amendment to
prepare final construction-ready plans, assist in obtaining the requisite permits, and provide
periodic construction observation services.
FEES
The above-described scope of services will be provided on a time-and-expense basis
according to the attached Professional Services Fee Schedule. Invoices will reflect actual
hours accrued for services provided to Client or on Client’s behalf.
We recommend the following budgets for our scope of services as outlined below. These
are not Not-To-Exceed amounts, but estimates that reflect our anticipated level of effort for
the services as described. Our fees are based on one iteration of concept design.
Additional iterations or substantial changes will be provided as an additional service.

Conditions of Agreement Between CLIENT and CIVIL/GEOTECHNICAL ENGINEER
Right of Entry
1.1 The CLIENT will provide for right of entry of the ENGINEER and all his equipment, in order
to do the work.
1.2 While the ENGINEER will take reasonable precautions to minimize damage to the
property, it is understood by the CLIENT that in the normal course of work some damage
to the surface may occur, the correction of which is not part of this Agreement.
Buried and Above-Ground Structures and Utilities
1.3 In the prosecution of his work, the ENGINEER will take reasonable precautions to avoid
damage or injury to subterranean and above-ground structures and utilities.
1.4 The CLIENT agrees to hold the ENGINEER harmless for any damages to subterranean and
above-ground structures and utilities which are not called to the ENGINEER's attention or
correctly shown on the plans furnished.
Invoices
1.5 The ENGINEER will submit invoices to the CLIENT monthly and a final bill upon completion
of services. Invoices will show total charges accrued during the billing period.
1.6 Payment is due upon presentation of invoice and is past due thirty (30) days from invoice
date. CLIENT agrees to pay a finance charge of one and one-half percent (l.5%) per
month, or the maximum rate allowed by law, on past due accounts.
Notice of Lien Rights
1.7 As required by the Wisconsin construction lien law, ENGINEER hereby notifies CLIENT that
persons or companies furnishing labor or materials for the improvement on CLIENT’s land
may have lien rights on CLIENT’s land and buildings if not paid. Those entitled to lien
rights, in addition to ENGINEER, are those who contract directly with the CLIENT or those
who give the CLIENT notice within 60 days after they first furnish labor or materials for the
improvement. Accordingly, CLIENT probably will receive notices from those who furnish
labor or materials for the improvement, and should give a copy of each notice received
to the lender, if any. ENGINEER agrees to cooperate with the CLIENT and the CLIENT’s
lender, if any, to see that potential lien claimants are duly paid.
Ownership of Documents
1.8 All original reports, boring logs, field data, field notes, laboratory test data, and other
documents prepared by the ENGINEER, as instruments of service, shall remain the
property of the ENGINEER. Copies of all such material delivered to the CLIENT shall
become the property of the CLIENT.
1.9 The CLIENT agrees that all documents and other work furnished to the CLIENT or his
agents, which is not paid for, will be returned upon demand and will not be used by the
CLIENT for any purpose whatsoever.
Standard of Care
1.10 Services performed by the ENGINEER under this Agreement will be conducted in a
manner consistent with that level of care and skill ordinarily exercised by members of the
profession currently practicing in the same locality under similar conditions. No other
representation express or implied, and no warranty or guarantee is included or intended
in this Agreement, or in any report, opinion, document or otherwise.
75
VILLAGE OF FOX POINT
May 2026 Page 2 of 7
Insurance
1.11 The ENGINEER represents and warrants that it and its agents, staff and consultants
employed by it is and are protected by worker's compensation insurance and that the
ENGINEER has such coverage under public liability and property damage insurance
policies which the ENGINEER deems to be adequate.
1.12 Certificates for all such policies of insurance shall be provided to CLIENT upon request in
writing. Within the limits and conditions of such insurance, the ENGINEER agrees to
indemnify and save CLIENT harmless from and against any loss, damage, or liability
arising from any acts or omissions by the ENGINEER, its agents, staff, and consultants
employed by it. The ENGINEER shall not be responsible for any loss, damage or liability
beyond the amounts, limits, and conditions of such insurance.
1.13 The ENGINEER shall not be responsible for any loss, damage, or liability arising from any
acts or omissions by CLIENT, its agents, staff, and other consultants employed by it.
Termination
1.14 This Agreement may be terminated by either party upon seven (7) days written notice in
the event of substantial failure by the other party to perform in accordance with the
terms hereof. Such termination shall not be effective if that substantial failure has been
remedied before expiration of the period specified in the written notice. In the event of
termination, ENGINEER shall be paid for services performed to the termination notice
date.
Confidentiality of Information
1.15 Except as required by law or this Agreement, or requested by the CLIENT, the ENGINEER
will communicate with and submit work products only to the CLIENT and parties
specifically designated by the CLIENT. The CLIENT is responsible for all regulatory agency
submittals and public health officials notifications.
1.16 Information required by law to be released to public health officials or regulatory
agencies will be provided only with the CLIENT's knowledge.
Limitation of Professional Liability
1.17 Except to the extent that CLIENT’S claims for losses, damages and/or expenses are
covered by any of ENGINEER’S policies of liability insurance, including, but not limited to
ENGINEER’S professional liability insurance, the CLIENT agrees to limit the ENGINEER's
liability to the CLIENT, and anyone claiming by, through or under the CLIENT, for any and
all claims, from the ENGINEER's professional acts, errors or omissions, such that the total
aggregate liability shall not exceed $50,000.
1.18 The CLIENT may request, in writing, an increase in the amount of professional liability for
additional services which may be conducted under the authorization of this Agreement.
Severability
1.19 CLIENT and ENGINEER have entered into this Agreement of their own free will, to
communicate to one another mutual understandings and responsibilities. Any element of
this Agreement later held to violate a law or regulation shall be deemed void, and all
remaining provisions shall continue in force.
1.20 However, CLIENT and ENGINEER will in good faith attempt to replace any invalid or
unenforceable provision with one that is valid and enforceable, and which comes as
close as possible to expressing the intent of the original provision.
Changed Conditions
1.21 CLIENT has relied on ENGINEER's judgement in establishing the workscope and fee for this
project, given the project's nature and risks. CLIENT shall therefore rely on ENGINEER's
76
VILLAGE OF FOX POINT
May 2026 Page 3 of 7
judgement as to the continued adequacy of this Agreement in light of occurrences or
discoveries that were not originally contemplated by or known to ENGINEER.
1.22 Should ENGINEER call for contract renegotiation, ENGINEER shall identify the changed
conditions which in ENGINEER's professional judgement make such renegotiation neces-
sary, and ENGINEER and CLIENT shall promptly and in good faith enter into renegotiation
of this Agreement to help permit ENGINEER to continue to meet CLIENT's needs. If
renegotiated terms cannot be agreed to, CLIENT agrees that ENGINEER has an absolute
right to terminate this Agreement. If renegotiated terms cannot be agreed to, CLIENT
agrees that ENGINEER has an absolute right to terminate this Agreement, provided that
in no event shall such termination result in any further charge or cost to CLIENT.
Defects in Service
1.23 CLIENT and CLIENT's personnel, contractors and subcontractors shall promptly report to
ENGINEER any defects or suspected defects in ENGINEER's work, in order that ENGINEER
may take prompt, effective measures which in ENGINEER's opinion will minimize the
consequences of a defect in service.
Delays
1.24 Neither party shall hold the other responsible for damages or delays in performance
caused by acts of God or other circumstances beyond the control of the other party,
and which could not reasonably have been anticipated or prevented. For purposes of
this Agreement, acts of God and other circumstances include, but are not necessarily
limited to, unusual weather, floods, epidemics, war, riots, strikes, lockouts or other
industrial disturbances, protest demonstrations, unanticipated site conditions, or inability
despite reasonable diligence—to supply personnel, equipment or material to the project.
Should such acts occur, CLIENT and ENGINEER shall utilize their best efforts to overcome
the resulting difficulties and resume conduct of services called for herein as soon as
reasonably possible.
1.25 Delays within the scope of this provision that cumulatively exceed forty-five (45) calendar
days shall, at the option of either party, make this Agreement subject to renegotiation or
termination.
Disposal of Samples
1.26 Soil, rock, water and/or other samples obtained from the Project site are the property of
CLIENT. ENGINEER shall preserve such samples for no longer than thirty (30) calendar days
after the issuance of any document that includes the data obtained from them, unless
other arrangements are mutually agreed upon in writing.
Information Provided by Others
1.27 ENGINEER shall indicate to CLIENT the information needed for rendering of services
hereunder, and CLIENT shall provide to ENGINEER such information as is available to
CLIENT. CLIENT recognizes that it is impossible for ENGINEER to assure the sufficiency of
such information, either because it is impossible to do so, or because of errors or
omissions which may have occurred in assembling the information.
1.28 Accordingly, CLIENT waives any claim against ENGINEER for injury or loss allegedly arising
from errors, omissions, or inaccuracies in documents or other information provided to
ENGINEER by CLIENT.
Public Responsibility
1.29 CLIENT recognizes that he owes a duty of care to the public that requires him to conform
to applicable codes, standards, regulations and ordinances, principally to protect public
health and safety.
77
VILLAGE OF FOX POINT
May 2026 Page 4 of 7
1.30 ENGINEER/SURVEYOR likewise owes a duty of care to the public, in that the public,
through its professional engineer registration law, has granted to ENGINEER/SURVEYOR an
exclusive license to perform functions which require engineering skill and knowledge, to
protect public health and safety. ENGINEER/SURVEYOR will at all times endeavor to
perform in a faithful and trustworthy manner and, in this regard, do his best to alert CLIENT
to any matter of which ENGINEER/SURVEYOR becomes aware and believes requires
CLIENT's immediate attention to help protect public health and safety, or which
ENGINEER/SURVEYOR believes requires CLIENT to issue a notice or report to certain public
officials, or to otherwise conform with applicable codes, standards, regulations or
ordinances.
1.31 If CLIENT for any reason decides to disregard ENGINEER's/SURVEYOR's recommendations
in these respects, ENGINEER/SURVEYOR shall employ his best judgement in deciding
whether or not he shall notify public officials. CLIENT agrees that such decisions are
Engineer's/Surveyor's to make, in light of ENGINEER's/SURVEYOR's public responsibilities as
ENGINEER/SURVEYOR perceives them and, in any event, ENGINEER/SURVEYOR should not
be held liable in any respect for failing to report conditions which were CLIENT's
responsibility to report.
1.32 Accordingly, CLIENT waives any claim against ENGINEER/SURVEYOR, and agrees to
defend, indemnify and hold ENGINEER/SURVEYOR harmless from any claim or liability for
injury or loss allegedly arising from ENGINEER's/SURVEYOR's notifying or not notifying public
officials about conditions existing at the project site.
1.33 Further, CLIENT agrees to compensate ENGINEER/SURVEYOR for any time spent or
expenses incurred by ENGINEER/SURVEYOR in defense of any such claim, with such
compensation to be based upon ENGINEER's/SURVEYOR's prevailing fee schedule and
expense reimbursement policy.
Subsurface Risks
1.34 CLIENT recognizes that special risks occur whenever engineering or related disciplines are
applied to identify subsurface conditions. Even a comprehensive sampling and testing
program, implemented with the appropriate equipment and experienced personnel
under the direction of a trained professional who functions in accordance with a profes-
sional standard of care may fail to detect certain conditions, because they are hidden
and therefore cannot be considered in development of a subsurface exploration
program.
1.35 For similar reasons, actual environmental, geologic and geotechnical conditions that
ENGINEER properly infers to exist between sampling points may differ significantly from
those that actually exist. The passage of time must also be considered, and CLIENT
recognizes that, due to natural occurrences or direct or indirect human intervention at
the site or distant from it, actual conditions discovered may quickly change.
1.36 CLIENT realizes that nothing can be done to eliminate these risks altogether, but certain
techniques can be applied by ENGINEER to help reduce them to that level deemed
tolerable by CLIENT. ENGINEER is available to explain these risks and risk reduction
methods to CLIENT, but in any event, the scope of services included with this Agreement
is that which CLIENT agreed to or selected in light of his own risk preferences and other
considerations.
CLIENT's Responsibility to Notify ENGINEER
1.37 CLIENT hereby warrants that, if he knows or has any reason to know or suspect that
hazardous materials may exist at the project site, he has so informed ENGINEER. CLIENT
also warrants that he has informed ENGINEER of such known or suspected hazardous
materials type, quantity and location.
78
VILLAGE OF FOX POINT
May 2026 Page 5 of 7
1.38 When hazardous materials are known, assumed or suspected to exist at the site,
ENGINEER is required to take appropriate precautions to protect the health and safety of
his personnel, to comply with applicable laws and regulations, and to follow procedures
that ENGINEER deems prudent to minimize physical risks to employees and the public.
Discovery of Unanticipated Hazardous Materials
1.39 Hazardous materials or certain types of hazardous materials may exist at a site where
there is no reason to believe they could or should be present. ENGINEER and CLIENT
agree that the discovery of unanticipated hazardous materials constitutes a changed
condition mandating a renegotiation of the scope of work or termination of services.
1.40 In addition, CLIENT waives any claim against ENGINEER for injury or loss arising from
ENGINEER's discovery of unanticipated hazardous materials or suspected hazardous
materials.
Discovery of Unanticipated Hazardous Materials on Site not Owned by CLIENT
1.41 In the event the project site is not owned by CLIENT, CLIENT warrants that he has
obtained all necessary permissions for ENGINEER to enter onto the site and conduct
subsurface exploration activities. CLIENT recognizes that it is his responsibility to inform the
property owner of the discovery of unanticipated hazardous materials or suspected
hazardous materials.
1.42 CLIENT also understands that any such discovery may result in recognition of a significant
reduction of the property's value, and this may spur the property's owner to institute a
claim for compensation for alleged damages even though discovery is not the cause of
damages. Accordingly, in such situations, CLIENT waives any claim against ENGINEER for
injury or loss of any type arising from ENGINEER's discovery of unanticipated hazardous
materials or suspected hazardous materials on a site not owned by CLIENT and CLIENT
agrees to indemnify, defend, and hold harmless the ENGINEER from and against any
claim, liability, loss or cost, including reasonable attorney’s fees and cost of defense,
allegedly arising out of access to or activities conducted on any such property.
Jobsite Safety
1.43 Insofar as jobsite safety is concerned, in cases where construction work is being done on
the site, ENGINEER is responsible solely for his own and his employees' activities on the
jobsite, but this shall not be construed to relieve CLIENT or any construction contractors
from their responsibility for maintaining a safe jobsite.
1.44 Neither the professional activities of ENGINEER, nor the presence of ENGINEER or his
employees and subcontractors, shall be construed to imply ENGINEER has any responsi-
bility for methods of work performance, superintendence, sequencing of construction, or
safety in, on or about the jobsite.
1.45 CLIENT agrees that the Contractor(s) is solely responsible for jobsite safety, and warrants
that this intent shall be made evident in the CLIENT's Agreement with the General
Contractor or other contractors and subcontractors. CLIENT also warrants that ENGINEER
shall be made an additional insured under the Contractor's general liability insurance
policy.
Observation of the Work
1.46 ENGINEER shall make visits to the site at intervals appropriate to the various stages of
construction as ENGINEER deems necessary in order to observe as an experienced and
qualified design professional the progress and quality of the various aspects of
Contractor's work. The purpose of ENGINEER's visits to the site will be to enable ENGINEER
to better carry out the duties and responsibilities assigned to and undertaken by
ENGINEER, and, in addition, by the exercise of ENGINEER's efforts as an experienced and
qualified design professional, to provide for CLIENT a greater degree of confidence that
79
VILLAGE OF FOX POINT
May 2026 Page 6 of 7
the completed work of Contractor will conform in general to the Contract Documents
and that the integrity of the design concept of the completed Project as a functioning
whole as indicated in the Contract Documents has been implemented and preserved
by Contractor.
Construction Monitoring
1.47 CLIENT recognizes that unanticipated or changed conditions may be encountered
during construction. When CLIENT agrees to retain ENGINEER to monitor construction,
ENGINEER agrees to assign to the monitoring function persons qualified to observe and
report on the quality of work performed by contractors, et al.
1.48 CLIENT recognizes that construction monitoring is a technique employed to minimize the
risk of problems arising during construction. Provision of construction monitoring by
ENGINEER is not insurance, nor does it constitute a warranty or guarantee of any type. In
all cases, contractors et al, shall retain responsibility for the quality of their work and for
adhering to plans and specifications. Should CLIENT for any reason not retain ENGINEER
to monitor construction, or should CLIENT unduly restrict ENGINEER's assignment of
personnel to monitor construction, or should ENGINEER for any reason not perform
construction monitoring during the full period of construction, ENGINEER shall not have
the ability to perform a complete service.
1.49 Should the ENGINEER be prevented from performing a complete service, CLIENT waives
any claim against ENGINEER, and agrees to indemnify, defend and hold ENGINEER harm-
less from any claim or liability for injury or loss arising from problems during construction
that allegedly result from findings, conclusions, recommendations, plans or specifications
developed by ENGINEER. CLIENT also agrees to compensate ENGINEER for any time
spent and expenses incurred by ENGINEER in defense of any such claim, with such
compensation to be based upon ENGINEER's prevailing fee schedule and expense
reimbursement policy.
Indemnification
1.50 The ENGINEER shall indemnify and hold harmless the CLIENT, its officers, and employees
from and against damages, liabilities, losses, judgments, costs, and expenses, but only to
the extent caused by the negligent or intentional acts, errors, or omissions of the
ENGINEER, or of those for whom the ENGINEER is legally liable, which arise out of the
ENGINEER’s performance of its professional services under this Agreement. The CLIENT
shall indemnify and hold harmless the ENGINEER, its directors, officers, and employees
from and against damages, liabilities, losses, judgments, costs, and expenses, but only to
the extent caused by the negligent or intentional acts, errors, or omissions of the CLIENT,
or those for whom the CLIENT is legally liable. Neither the ENGINEER nor the CLIENT shall
be obligated to indemnify the other party in any manner whatsoever for the other party's
negligent or intentional acts, errors, or omissions.
Reliance by Third Parties
1.51 Any information, including but not limited to data, reports, findings, summaries, or
recommendations, prepared by ENGINEER for CLIENT in the course of performing the
Services hereunder may not be relied upon by any person or entity other than CLIENT
without ENGINEER’s prior written consent. Unless otherwise agreed, any use of information
prepared by the ENGINEER by anyone other than the CLIENT is entirely at that third
party’s own risk.
Assignment
1.52 Neither party to this Agreement shall transfer, sublet or assign any rights under or interest
in this Agreement (including but not limited to monies that are due or monies that may
be due) without the prior written consent of the other party.
80
VILLAGE OF FOX POINT
May 2026 Page 7 of 7
Dispute Resolution
1.53 All claims, disputes, and other matters in question between the parties to this Agreement,
arising out of or relating to this Agreement or the breach hereof that cannot be resolved
by the parties, shall be subject to mediation upon the written notice of either party to the
other. The mediation proceeding will be conducted in accordance with the then current
Center for Public Resources (CPR) Model Procedure for Mediation of Business Disputes. If
the parties have not agreed within thirty (30) days of the request for mediation on the
selection of a mediator willing to serve, either party may inform the CPR of the nature of
the dispute and request it to appoint a member of the CPR Panels of Neutrals to act as
mediator. In the event a settlement of any claim, dispute or other matter in question is
not completed within sixty (60) days of the selection of a mediator, the mediation
procedure shall terminate upon election of either party, and either party shall have the
right to litigate the claim, dispute or other matter in question. In connection therewith,
each party agrees to submit to the jurisdiction of such court.
1.54 CLIENT and ENGINEER agree that the prevailing party will be entitled to recover all
reasonable costs incurred in the litigation including court costs, attorney fees and
expenses and other claim related expenses.
1.55 Notwithstanding the foregoing, either party may commence litigation without first
initiating or completing mediation if such action is necessary to prevent the expiration of
any applicable statute of limitation or statute of repose relating to the party’s claims
arising under this Agreement.

REGARDING: APPROVAL OF FUNDS
I am requesting approval from the Village Board for the acquisition of four (4) new portable fingerprint
scanners for the Police Department. This technology will enhance our officers’ ability to accurately and
efficiently identify individuals in the field, improving both officer safety and overall operational
effectiveness. The device allows for real-time identification through state and national databases, reducing
reliance on transporting individuals for identification purposes and minimizing delays during
investigations.
The total cost of the scanners is $10,000 and will be fully covered through funds awarded to the department
via a state grant. As such, this purchase will not require the use of local taxpayer dollars or impact the
Village’s operating budget when completed.
The addition of this equipment aligns with our ongoing commitment to modernize policing practices,
improve service delivery, and utilize available external funding sources to support departmental needs.

MEMORANDUM

Subject: Proposed 2026 North Shore Environmental Health Consortium Fee Adjustments
Overview
The North Shore Environmental Health Consortium (NSEHC), administered by the North Shore Health Department, is responsible for licensing and
inspecting food establishments, temporary events, farmers’ markets, public pools, and hotels, as well as investigating related public health
complaints.
The NSEHC program is fee-supported and has not implemented a fee increase in the past three years. Projections indicate an estimated
programmatic shortfall of ~$30,000 in 2026. The proposed fee adjustments, which are aligned with our current Agent Contract with DATCP, will
address this shortfall, while ensuring the continued delivery of essential public health services.
Proposed Fee Changes
1. Across-the-Board 15% Increase
Aside from the adjustments in the box below, a 15% increase is proposed for all program fees to maintain operations, meet regulatory obligations,
and address rising administrative and personnel costs, including DATCP reimbursement requirements.
2. Targeted Market-Aligned Adjustments
In addition to the standard increase, certain license categories require further adjustment to better align with fees in neighboring health
departments. See attached table.
Detailed Adjustments
Category License Type 2025 Fee 2026 Fee
Retail Food (No Meals) Prepackaged $90.00 $144.00
Retail Food (No Meals) Simple Non-TCS $90.00 $203.00
Retail Food (No Meals) Complex $1,339.00 No Change
Hotels All Types - No Change
Tourist Rooming Houses - $110.00 $340.00
Public Pools Simple $274.00 $329.00
Public Pools Moderate w/ Features - No Change
Public Pools Complex w/ Features - No Change
Note: All other fees associated with the license categories receiving additional adjustments have been increased proportionally, consistent with
the standard 15% increase applied across the remaining program fees.
Rationale for the Adjustments
• Fiscal Stability: Prevents the projected deficit and aligns revenue with program costs
• Regional Consistency: Aligns fees with those of surrounding jurisdictions
• Regulatory Compliance: Supports required DATCP agent program functions
• Operational Sustainability: Ensures continued inspection, enforcement, and complaint response services
Next Steps
Upon approval, the updated fee schedule will be implemented for the next licensing cycle. The attached schedule provides full details on all
adjusted fees.
For questions prior to the meeting, please contact the North Shore Health Department at (414) 371-2980.

Subject: Request for Ordinance Updates Related to Reinspection, Reinspection Fees, and License Expiration Dates
The North Shore Environmental Health Consortium (NSEHC) respectfully requests updates to Chapter 375, Food, Lodging and
Recreational Safety and Licensing Code of Ordinances to align local code with current operational needs and fee‑ supported
program requirements.
1. Update Definitions in Ch. 375-4 Definitions – Reinspection and Reinspection Fee
The NSEHC requests revised definitions clarifying that a reinspection occurs whenever a follow‑up inspection is required to verify
correction of violations, including the first required reinspection. When a reinspection occurs is outlined in policy . A reinspection fee
may be charged for the first and any subsequent reinspections.
2. Update Ch. 375-11(E) – Inspection and Reinspection
Last year the NSEHC completed 133 reinspection’s. We request this section be updated so a reinspection fee is charged beginning
with the first reinspection. This change is to increase revenue by ~$22,000 in reinspection fees and ~$4,000 in staff time.
These updates will ensure consistency across ordinance sections and maintain the long‑term financial viability of the fee‑supported
environmental health program.

(1) Originated from an unapproved source;
(2) May be unsafe, adulterated, or not honestly presented;
(3) Is not labeled according to law or, if raw molluscan shellfish, is not tagged or labeled according
