John Sorensen – 524 13th Place Mr. Sorensen expressed concerns regarding recurring basement flooding and standing water on 13th Place since the street reconstruction project was completed several years ago. He stated that his property had not previously experienced significant flooding during the 45 years he has lived there but has experienced repeated basement flooding after rain events since the road project. Mr. Sorensen reported that multiple neighboring properties have experienced similar flooding issues and that homeowners have incurred property damage and installed sump pumps to manage water intrusion. He presented photographs and videos showing standing water in yards, roadway drainage conditions, and water entering basements. Mr. Sorensen stated that he previously raised the issue during discussions regarding flooding priorities and had not received follow-up communication regarding the concern. He referenced highway drainage design standards and Wisconsin statutes related to drainage and protection of private property from flooding. Mr. Sorensen requested that the Village investigate the drainage concerns on 13th Place and pursue corrective measures to alleviate flooding impacts to affected properties. Sharon Janusz – 8730 12th Street Ms. Janusz spoke regarding citizen engagement and communication within the Village. She stated that attendance at Village meetings appears to have declined and shared feedback from residents who feel their input is not considered in the decision-making process. Ms. Janusz commented on current communication methods, including newspapers, newsletters, meetings with the Village President, and the electronic sign, and suggested the Village explore additional ways to engage residents and improve communication. She encouraged the Board to consider citizen feedback and provide follow-up regarding concerns raised during public comments. Ms. Janusz also complimented PTS for its professionalism and responsiveness during the water main project. Additionally, she noted that she had obtained quotes for lateral installation work and that one contractor indicated a willingness to provide a reduced rate if multiple residents utilized his services. American Blvd., Suite 500 Bloomington, MN 55437 RE: Comments on the Menominee Kenosha Casino Draft Environmental Assessment (EA) Menominee Indian Tribe of Wisconsin – Kenosha Casino Project Dear Branch Chief Johnson: Root-Pike Watershed Initiative Network (WIN) has reviewed the Draft Environmental Assessment (EA) for the Menominee Indian Tribe of Wisconsin’s proposed fee‑to‑trust action and associated casino and hotel development in the City of Kenosha, Wisconsin. Root-Pike WIN is the local 501c3 non-profit focused on improving water quality, native habitats, and sense of place in southeastern Wisconsin. Root-Pike WIN also provides education and outreach to 20 municipalities in southeastern Wisconsin through our Respect Our Waters program. Root-Pike WIN acknowledges the EA’s clear project description, regulatory framework, and mitigation commitments. However, several areas would benefit from additional analysis or strengthened mitigation to ensure protection of water resources, habitat, and ecological function within this area of the Des Plaines watershed. The following comments are offered to improve the environment and reduce long‑term impacts. 1. Water Quality & Stormwater Management The EA identifies substantial grading and impervious surface expansion associated with the project. While detention basins sized for major storm events are included, Root-Pike WIN recommends these enhancements: - Provide quantitative pollutant load modeling (TSS, TP, dissolved phosphorus, hydrocarbons) for both construction and post‑construction phases. - Incorporate performance‑based water quality targets, such as 80% TSS removal and 50% TP reduction, consistent with Wisconsin stormwater standards. - Evaluate infiltration feasibility and include biofiltration or bioretention where soils allow. - Naturalize stormwater basins with native emergent vegetation, shelves, and habitat features to improve ecological function. - Include a long‑term maintenance plan specifying inspection frequency, responsible parties, and adaptive management triggers. These measures would help ensure the project contributes to improved water quality in the Des Plaines watershed. 12 (262) 883-4018 4116 12th St Kenosha, WI 53144-1106 www.rootpikewin.org 2. Wetlands & Hydrologic Connectivity The EA states that wetlands will be avoided with protective buffers. Root-Pike WIN recommends strengthening this section by: - Conducting a wetland functional assessment (e.g., HGM or Wisconsin Rapid Assessment Method). - Evaluating potential indirect hydrologic impacts from grading, drainage modifications, and increased impervious surface. - Considering wetland enhancement or creation to offset hydrologic changes and support watershed‑scale restoration goals such as the EPA/DNR’s TMDL program. 3. Biological Resources & Habitat Enhancement Root-Pike WIN supports the EA’s commitment to avoid sensitive resources; however, additional measures would improve habitat outcomes: - Provide ‘species‑specific effect determinations’ for federally listed species as part of ESA Section 7. - Implement seasonal tree‑clearing restrictions (Nov–March) to protect roosting bats. - Incorporate bird‑safe lighting and glass treatments, given the proximity to Lake Michigan flyways. - Expand native landscaping to include prairie buffers, pollinator‑focused seed mixes, and habitat connectivity features. - Establish a five‑year vegetation management plan with invasive species monitoring and success criteria. These enhancements would convert basic mitigation into meaningful ecological improvement. 4. Cumulative Impacts Root-Pike WIN recommends expanding the cumulative impacts section to address: - Regional impervious surface growth along the I‑94/122nd Avenue corridor. - Combined stormwater, traffic, and air quality impacts from nearby planned developments. - Watershed‑scale nutrient loading trends (via the TMDL) and opportunities for coordinated mitigation. - Potential induced growth associated with the project. A more robust cumulative impacts analysis will strengthen the NEPA record. Root-Pike WIN appreciates the Tribe’s and BIA’s efforts in preparing the Draft EA and encourages incorporation of the recommendations above to enhance environmental protection and watershed health. We look forward to working with the Menominee Indian Tribe and their partners as the approval process advances. The existing asphalt will be pulverized and relayed, driveway approaches will be removed and replaced 8 feet from the road edge to match the new road grade, existing Village-owned culverts and a few residential culverts within the project limits will be removed and replaced, and 21 existing sanitary structures will be adjusted to match the new road grade and resealed to prevent infiltration and inflow. At the Village Board Meeting on May 12, 2026, the project was awarded to Payne & Dolan, Inc. in the amount of $571,571.00. The Capital Improvement Project was estimated to cost $779,000.00 when approved by the Board. Of the project, $116,052.00 can be funded from the balance of the 2-year borrowing, with the remainder paid from cash reserves and utility funds. The Village also received a Local Roads Improvement Program (LRIP) award in the amount of $34,030.42, lowering the Village's cost for the project. Staff previously prepared a cost breakdown for the 2026 paving project based on the 2026 Consolidated General Fund CIP and Sewer Fund CIP. Based on the awarded bid and fund allocations, the actual General Fund cost is estimated at $458,665.58, leaving $320,334.42 in excess General Fund paving CIP funds before adding any additional road section. The Sewer Fund also has an estimated savings of $42,450 from the approved 2026 Sanitary CIP funds. PRIOR ACTION TAKEN: 22 At the May 19th, 2026 Village Work Session, staff proposed adding the repaving of 80th Avenue to the 2026 paving project schedule. The additional section is located off of CTH E, between J&M's and the Canadian Pacific Railway. The work includes pulverizing the existing asphalt and relaying new material. There are no utility adjustments needed with this section of road. Assuming railroad approval is received, Staff recommended adding this work to the 2026 paving project by change order. The Board was agreeable to moving forward with the additional work and requested staff to bring the item back for formal action once the change order total was confirmed. UPDATE: Staff has coordinated with Payne & Dolan, Inc. regarding the addition of 80th Avenue. The change order total is $78,025. The work requires a Right-Of-Entry permit from the railroad which costs an additional $1,500, and additional insurance, which are required to work on Railroad property. The contractor has not yet provided the cost, which we hope to have available by the meeting. Currently the proposed addition remains below 15% of the original $571,571.00 contract price ($79,525) without the additional insurance. The updated General Fund paving balance is estimated as follows: $ 320,334.42 - Excess General Fund paving CIP funds before 80th Avenue $ (79,525) - 80th Avenue change order $ 242,309.42 - Remaining General Fund paving balance after 80th Avenue SUGGESTED ACTION/ACTION REQUESTED/COMMENTS: In the event that the Village Board agrees with the suggested action, a suggested motion to approve would be as follows: "Motion to approve a change order to add the repaving of 80th Avenue to the 2026 paving project schedule contingent upon receipt of approval from Canadian Pacific Railway, and total change order costs do not exceed 15% of the original contract price.” ATTACHMENTS: 80th Avenue Paving Map Payne & Dolan Change Order quote 23 DISCLAIMER This map is neither a legally recorded map nor a survey and is not intended to be used as one. Action on proposed Ordinance 2026-003, an Ordinance to Create Section 18.55 of the Code of Ordinances of the Village of Somers Regarding the Comprehensive Plan (Shoreland Lutheran High School, 2024) b. Action on proposed Ordinance 2026-004, an Ordinance to Create Section 18.56 of the Code of Ordinances of the Village of Somers Regarding the Comprehensive Plan (Somers Creek, 2024-2025) c. Action on proposed Ordinance 2026-005, an Ordinance to Create Section 18.57 of the Code of Ordinances of the Village of Somers Regarding the Comprehensive Plan (Maplecrest, 2025) BACKGROUND: While reviewing previous modification to the Comprehensive Plan, staff found four amendments that were approved by the Board without the adoption of an ordinance. As part of Shoreland Lutheran High School’s current expansion project, the Village Plan Commission and Village Board approved with conditions their request to change the land use designation of parcels located in the SE 1/4 of Section 8, T2N, R22E, Village of Somers (then Tax Parcel #s 82-4-222-084-0272 and 82-4-222-084-0262) from "Medium- Density Residential", “Governmental and Institutional”, “Other Conservancy Land to be Preserved”, “Nonfarmed Wetland”, and “Surface Water” to “Governmental and Institutional”, “Other Conservancy Land to be Preserved”, “Nonfarmed Wetland”, and “Surface Water” in April 2024. 33 In October 2024, the Village Plan Commission recommended to the Village Board to change the land use designation of the Somers Creek/Willow Creek subdivision, parcels located in the NE 1/4 of Section 15, T2N, R22E, Village of Somers (Tax Parcel #s 82-4- 222-151-0560, 82-4-222-151-0561 and 82-4-222-151-0563), from “High-Density Residential” to “Medium-Density Residential”. The Village Board approved the request in August 2025. From May – June 2025, the Plan Commission and Village Board approved MapleCrest Country Club Inc. request to change the land use designation of parcel located in the NE 1/4 of Section 20, T2N, R22E, Village of Somers (Tax Parcel #82-4-222-201-0100) from “Park and Recreational”, “High-Density Residential”, “Nonfarmed Wetland” and “Other Conservancy Land to be Preserved” on the Land Use Plan Map. This amendment was necessary before the Village could approve their request to rezone, and a CSM. (For information use only, the property is located on the south side of Highway 195 at 1911 1st Street). C. Preliminary Plat (land division) Request by: David W Rasmussen & Scott B Rasmussen, 2004 3rd Street, Kenosha, WI 53140 (Owner), Raymond C. Leffler, 8338 Corporate Drive, Mt. Pleasant, 42 WI 53406 (Agent); requests approval of a preliminary plat (dated February 24, 2026 and prepared by John P. Konopacki of Pinnacle Engineering Group), on Tax Parcel # 83-4- 223-062-0200, located in the NW ¼ of Section 6, T2N, R23E, Village of Somers. (For information use only, the property is located on the south side of Highway 195 at 1911 1st Street). BACKGROUND: The proposed plan is summarized in the memo from Luke Godshall, Senior Land Use Planner. The Petitioner is proposing to allow for a 41-lot single-family residential subdivision development on 43.24 acres. The proposal includes future plans for condominium duplexes, or side-by-sides. The specific requests are reviewed in the attached memo from Senior Land Use Planner Luke Godshall. A concept plan was reviewed by the Village Plan Commission in December 2025, and a public hearing on April 13, 2026. Initially, the Village Plan Commission voted 3-2 to negatively recommend the project. In review of the meeting, the objection was due to non-conformance with Village’s Comprehensive Plan. The 2008 Country Club Neighborhood Plan designates the area as Low to Medium Density Residential due to access constraints caused by the Pike River (the Kenosha County Bike Trail and Union Pacific Railroad are further east), and the river’s environmental significance. The Plan recommends one unit per acre density for this type of land use. UPDATES: At the May 19 Village Work Session, the Developer requested reconsideration of the application request. After discussion, the Village Board unanimously agreed that the Plan Commission should reconsider the application. Trustee Nelson and I prepared a memo to explain the Village Board’s position that was reviewed at the June Plan Commission meeting. Upon further review of additional information, the Commission unanimously adopted a resolution to approve the proposed comprehensive plan amendment, and recommended approval of the rezone and preliminary plat. The items were discussed at the 6/16 Work Session with Luke Godshall. A question came up regarding the Fire Department review of the project. In speaking with Chief Andersen, while they prefer a second access point, the department understands that the Wisconsin Department of Transportation will only allow one access point at the site. The proposed roadways within the subdivision provide sufficient turn radiuses Fire apparatus. SUGGESTED ACTION / ACTION REQUESTED / COMMENTS If the Village would like to consider approval of the above items, then the Board shall adopt an ordinance to amend the Village’s comprehensive plan, and approve the rezone and preliminary plat requests. 43 “Motion to waive the first reading of Ordinance No. 2026-006, an Ordinance to create section 18.58 of the code of Ordinances of the Village of Somers regarding an Amendment of the Comprehensive Plan. “Motion to approve proposed Ordinance No. 2026-006, an Ordinance to create section 18.58 of the code of Ordinances of the Village of Somers regarding an Amendment of the Comprehensive Plan.” “Motion to approve request for Rezoning by: David W Rasmussen & Scott B Rasmussen for rezoning from A-2 General Agricultural Dist. & C-2 Upland Resource Conservancy Dist. to R-4.5 Urban Single-Family Residential Dist., R-2 Suburban Single-Family Residential Dist., R-8 Urban Two-Family Residential Dist., C-2 Upland Resource Conservancy Dist. & C-1 Lowland Resource Conservancy Dist., on Tax Parcel # 83-4- 223-062-0200. “Motion to approve preliminary plat request by: David W Rasmussen & Scott B Rasmussen, for a preliminary plat (dated February 24, 2026, and prepared by John P. Proposed Zoning: R-4.5 Urban Single -Family Residential Dist., R-2 Suburban Single -Family Residential Dist., R-8 Urban Two-Family Residential Dist., C-1 Lowland Resource Conservancy Dist., C-2 Upland Resource Conservancy Dist. 8. Existing Land Use: Suburban-Density Residential , Primary Environmental Corridor, Nonfarmed Wetland, Other Conservancy Land to be Preserved 9. Proposed Land Use: Medium-Density Residential, Suburban -Density Residential, Primary Environmental Corridor, Nonfarmed Wetland, Other Conservancy Land to be Preserved PROJECT OVERVIEW: The Petitioner is proposing to amend the land use and zoning designations on the subject parcel to allow for a proposed 41-Lot single-family residential subdivision development to be known as Bose Farms. Additionally, three of the Outlots shown on the preliminary plat (Outlots 1, 4 and 5) are intended for future development of condominium duplexes. A concept of this development was brought before the Plan Commission in December 2025 PLANNER COMMENTS: The submitted rezoning application proposes R-4.5 zoning for most Lots of the subdivision, with the exception of Lots 10 and 11 which are proposed to be zoned R-2. These Lots are shown to meet R -2 zoning minimum standards for lot area (40,000 square feet), frontage (150 feet or at least 75 feet on a cul -de-sac or curve provided there is at least 150 feet of width at the required building setback line) and setbacks (30’ from Village roads, 15’ side and 25’ rear) . The proposed R-2 zoning for Lots 10 and 11 of the preliminary plat is consistent with the existing land use plan category of ‘Suburban -Density Residential’ and therefore no amendment to the land use plan is required for this area of the plat. The majority of the Lots in the subdivision are proposed to be zoned R-4.5 and are shown to meet minimum R- 4.5 zoning standards for lot area (at least 12,000 square feet) and minimum setback requirements (65’ from CTH E, 30’ from Village roads, 10’ side and 25’ rear). The proposed R -4.5 zoning for these Lots will require 47 RPT 2026-04-07 - Rasmussen Rezone & Preliminary Plat - 2 - approval of the petitioner’s submitted application for land use plan amendment from ‘Suburban-Density Residential’ to ‘Medium-Density Residential’. Outlots 1, 4, and 5 at the northern end of the preliminary plat are proposed to be rezoned to R -8 Urban Two- Family Residential District , as the petitioner intends to build 2 -unit condominium buildings on these Outlots with a future condominium plat . The proposed R -8 zoning for these Outlots will require approval of the petitioner’s submitted application for land use plan amendment from ‘Suburban -Density Residential’ to ‘Medium-Density Residential’. The submitted preliminary plat dated February 24 , 2026 and prepared by John P. Konopacki of Pinnacle Engineering Group, generally conforms to the requirements found in the Village of Somers Land Division and Platting Control ordinance (Chapter 18). Several items that will need to be added to and revised on the preliminary plat have been indicated in the staff recommendation below. These items, and any other items determined by the Plan Commission and Board, will need to be incorporated into a revised plat for eventual Final Plat approval. The plat is shown to be accessed from STH 195 (1 st Street) on the eastern side of the development tract via a new public road entrance (“Road A”) with several other roads forming the internal subdivision street network. The connection to STH 195 falls under the jurisdiction of Wisconsin Dept. of Transportation (WisDOT) and therefore the petitioner will need to obtain any necessary permits and approvals through WisDOT. All road rights-of-way within the development are shown to be 66’ in width to conform with Village standards. The two cul-de-sacs proposed are shown to have a radius of 75’. “Road C” is shown to stub off at the eastern boundary of the plat allowing for future extension into the land to the east. Per Village code, “ temporary termination of streets intended to be extended at a later date shall be constructed with a temporary cul-de-sac in accordance with the standards set forth above or by construction of a temporary "T" 25 feet wide extending to each adjacent right-of-way.” The plat should be revised to comply with this section of Village code. The Kenosha County Land Information Office has reviewed the street layout and indicates the streets shown on the preliminary plat shall be named as follows: • Road A – 18th Ave. • Road B – 1st Pl. (east-west portion) / 20th Ct. (north-south portion) • Road C – 2nd St. • Road D – 2nd Cir. • Road E – 2nd Pl. A draft copy of restrictive covenants was not submitted by the petitioner. A copy of such restrictive covenants shall be submitted for Village review prior to submittal of a final plat, to ensure that any contemplated restrictions are no less restrictive than Village of Somers ordinance regulations. STAFF RECOMMENDATION: Should the Plan Commission choose to recommend approval of th e proposed rezoning and preliminary plat , staff would recommend the following: 48 RPT 2026-04-07 - Rasmussen Rezone & Preliminary Plat - 3 - 1. Subject to addressing and incorporating any necessary preliminary plat review comments/conditions from external entities, including but not limited to the Wisconsin Department of Administration-Plat Review, Southeastern Wisconsin Regional Planning Commission (SEWRPC), Wisconsin Department of Natural Resources (DNR), and local utility companies. 2. Subject to subdivision restrictive covenants any by -laws being submitted for review and approval by the Village of Somers prior to final plat submittal. 3. The following items shall be added to the face of the preliminary plat: a. Per Section 18.20(B)(18) of the Village ordinance, add conceptual sanitary sewer, water main and storm sewer layout. b. Per Section 18.27(C)(2) of the Village ordinance, add a temporary cul -de-sac or temporary "T" to the east end of “Road C”. c. On Lot 10, show that there is at least 150’ of width at a tangent to the building setback line (as shown for Lot 11). d. On Sheet 1, indicate owners of adjacent unplatted parcels 83-4-223-062-0220 and 83-4-223-062- 0250. e. Indicate the Ordinary High Water Mark of the unnamed stream running through the western and southern portion of the plat. f. Add a note that reads: “ Any land below the ordinary high water mark of a lake or navigable stream is subject to the public trust in navigable waters that is established under article IX, section 1, of the state constitution”. g. If applicable, identify all proposed phases of the proposed subdivision on the preliminary plat. h. If applicable, locate and identify any proposed development sign easements on the preliminary plat. 4. The following items shall be revised on the face of the preliminary plat: a. Change title of plat on all sheets to “Bose Farms”. b. On Sheet 1, remove the statement ‘(ALSO KNOWN AS COUNTY TRUNK “KR”)’. c. Revise the street names on the preliminary plat as follows: • Road A – 18th Ave. • Road B – 1st Pl. (east-west portion) / 20th Ct. (north-south portion) • Road C – 2nd St. • Road D – 2nd Cir. • Road E – 2nd Pl. d. The floodplain boundary shown on the preliminary plat does not appear to match the boundary as indicated on FEMA’s National Flood Hazard Layer (NFHL). Revise floodplain boundary to match FEMA’s layer. e. Revise ‘shoreland zoning’ line to match as shown on Kenosha County Interactive Mapping, and label as ‘Shoreland Boundary’. f. Revise legend item for ‘300’ shoreland setback’ to read as ‘Shoreland Boundary’. 5. Box 1607 Somers, WI 53171 RE: Preliminary Plat, Rasmussen Estates NW ¼ Section 6, T 2 N, R 23 E, Village & Town of Somers SEWRPC No. CA-114-14 Dear Ms. Burnette: This is to acknowledge receipt of your letter of March 10, 2026, concerning the above-captioned matter and to advise of the following Commission staff findings and recommendations relative thereto: 1. The proposed plat is to be developed with centralized sanitary sewer service and is located within a planned sewer service area as delineated in SEWRPC Community Assistance Planning Report (CAPR) No. 106, Sanitary Sewer Service Areas for the City of Kenosha and Environs and CAPR No. 147, Sanitary Sewer Service Area for the City of Racine and Environs. 2. The subject plat abuts upon CTH KR, which is identified in the transportation element of VISION 2050 as a four-lane arterial highway along the development site. The right-of-way shown on the plat is adequate for this arterial facility. 3. The subject plat contains land delineated by the Commission as a primary environmental corridor (PEC) which consists of wetlands, woodlands, floodplains, steep slopes, and wildlife habitat. Commission adopted plans recommend that these areas be preserved in essentially natural open uses to the greatest extent practicable as determined by county and local plans. The PEC is contained in Parcel 10, 11, Outlot 2, and Outlot 3. As shown on the plat, building envelopes for Parcel 10 and 11 are located outside of the PEC. It is recommended that deed restrictions against any disturbance or development of the PEC and wetland areas be placed on the face of the plat. Disturbance of any wetlands on the site including earth moving activities adjacent to wetlands may require permits from the Wisconsin Department of Natural Resources and/or the U.S. Army Corps of Engineers. Commission staff recommends that the developer contact those agencies to determine if any permits are required and to apply for those permits. 101 Ms. Wendy Burnette April 23, 2026 Page 2 4. The subject plat is partially located within an identified 1-percent-annual-probability (100-year recurrence interval) flood hazard area as delineated in the Federal Flood Insurance Study (FIS) for Kenosha County. As shown, the floodplain is entirely within the PEC and does not intersect with any structures in the planned development. 5. The subject subdivision is located in the Pike River watershed. Runoff from the subject plat drains to the Lower Pike River. The regional water quality management plan recommends that nonpoint source pollution in this area be reduced. Adequate erosion control is necessary to reduce pollutant runoff from construction sites, and post-construction stormwater management would be needed to meet the nonpoint source pollution reduction requirements of the Village stormwater management ordinance. We would suggest that the subdivider call upon the Village Engineer for technical guidance in the attainment of sound erosion control management practices in connection with the development process, and that the post-construction stormwater management plan for the site comply with the requirements of the Village ordinance. Should you have any questions concerning the foregoing, please do not hesitate to call. Sincerely, Benjamin R. McKay, AICP Deputy Director BRM/FGF #280670 - RASMUSSSEN ESTATES PRELIMINARY PLAT 102 ORDINANCE NO. 2026-006 AN ORDINANCE TO CREATE SECTION 18.58 OF THE CODE OF ORDINANCES OF THE VILLAGE OF SOMERS REGARDING A COMPREHENSIVE PLAN AMENDMENT _____________________________________________________________________________ The Village Board of Trustees of the Village of Somers, Kenosha County, Wisconsin, hereby creates Section 18.58 of the Code of Ordinances of the Village of Somers regarding a comprehensive plan amendment to read as follows: TWENTIETH AMENDMENT TO THE COMPREHENSIVE PLAN OF THE VILLAGE OF SOMERS. After discussing with Kenosha County, the ownership of the property is unclear; however, it was determined that it is a Village Right-of-Way for the possible future extension of 15th Street. Staff looked at the current ordinances for guidance about the request. • Ordinance 9.01 prohibits the discharge of a firearm in the lakeshore area. • Ordinance 9.03 read as follows: “No person shall throw or shoot any object, arrow, stone, snowball or other missile or projectile, by hand or by any other means, at any person or at, in or into any building, street, sidewalk, alley, highway, park playground or other public place within the Village.” While it is not the intent of the Village to restrict the rights of residents to lawfully hunt or bear arms, it is unclear if current ordinances restrict hunting or firing a projectile in a Village right-of-way unless it is a street, sidewalk, alley, highway, park playground or other public place within the Village. Other communities do regulate hunting such as Pleasant Prairie Chapter 250-3. PRIOR ACTION TAKEN: 107 At the June 16 Work Session, Staff proposed changing Section 9.01 of the Village Ordinance. At the Board’s direction, Staff moved forward with proposing to amend only Section 9.03 of the Code, adding “right-of-way” as a prohibited location to shoot a projectile. SUGGESTED ACTION/ACTION REQUESTED/COMMENTS: In the event that the Village Board agrees with the suggested action, a suggested motion to approve would be as follows: “Motion to waive first reading of Ordinance No. 2026-007 an Ordinance to amend Section 9.03, Throwing or Shooting Missiles and Projectiles in the Right of Way within the Village.” “Motion to adopt proposed Ordinance No. 2026-007, an Ordinance to amend Section 9.03, Throwing or Shooting Missiles and Projectiles in the Right of Way within the Village.” ATTACHMENTS: Proposed Ordinance No. 2026-007 108 ORDINANCE NO. 2026-007 AN ORDINANCE TO AMEND SECTION 9.03 OF THE CODE OF ORDINANCES OF THE VILLAGE OF SOMERS REGARDING THROWING OR SHOOTING MISSLES AND PROJECTILES ______________________________________________________________________________ The Village Boat of Trustees of the Village of Somers, Kenosha County, Wisconsin, hereby amends Section 9.03 of the Code of Ordinances of the Village of Somers to read as follows: § 9.03 THROWING OR SHOOTING MISSLES AND PROJECTILES No person shall throw or shoot any object, arrow, stone, snowball or other missile or projectile, by hand or by any other means, at any person or at, in or into any building, street, sidewalk, alley, highway, right of way, park playground or other public place within the Village.
