Automated License Plate Reader (ALPR) - A device that uses cameras and computer technology to compare digital images to lists of known license plates of interest. ALPR Manufacturer - A public safety company that supplies ALPR systems, associated equipment, and houses data collected from their ALPR systems. Hit - A read matched to a plate that has previously been registered in a "hot list" of vehicle plates related to stolen vehicles, or other factors supporting investigation, or which has been manually registered by a user for further investigation. Hotlist - A list of license plate numbers associated with vehicles of interest either from NCIC, TIME, other criminal justice databases, or from individual alerts created by department members regarding vehicles of interest in specific investigations. These lists serve as officer safety and/or investigatory purposes. All entries into the department hotlist must be approved by a supervisor. Read - Digital images of license plates and associated vehicle metadata (e.g. date, time, and geographic coordinates associated with the vehicle image capture) that are captured by the ALPR system. ALPR Administrator - The Chief of Police or designee responsible for administrative duties relating to our ALPRsystem, including training, hotlist maintenance, and liaison with ALPR representatives. 416.3 ADMINISTRATION OF ALPR DATA Automated License Plate Reader (ALPR) technology, also known as license plate recognition, provides automated detection of license plates, associated vehicle data, and other meta data. ALPRs are used by the Germantown Police Department to gather data associated with vehicle license plates for official law enforcement purposes. ALPR data is "anonymous" in the sense that no ALPR read can be tied to any particular individual without further investigation. 416.4 SUPERVISION RESPONSIBILITIES All installation and maintenance of ALPR equipment, as well as ALPR data retention and access, shall be managed by the Chief of Police and/or designee. The Chief of Police will assign personnel under their command to administer the day-to-day operation of the ALPR equipment and data. Published with permission by Germantown Police Department ***DRAFT*** Automated License Plate Readers (ALPR) - 2 Designated supervisors shall: (a) Provide or oversee the training of all Officers and civilian employees who are authorized to operate an ALPR or to access or use ALPR stored data. (b) Ensure compliance with this directive. 416.5 ALPR OPERATION Use of an ALPR system is restricted to the purposes outlined below. Department personnel shall not use, or allow others to use, the equipment or database records for any unauthorized purpose. (a) An ALPR shall only be used for official and legitimate law enforcement business. (b) An ALPR may be used in conjunction with any patrol operation or official department investigation. Reasonable suspicion or probable cause is not necessary before using an ALPR. (c) No member of this department shall operate ALPR equipment or access ALPR data without first completing department-approved training. (d) An officer should verify an ALPR response through the Transaction Information for the Management of Enforcement (TIME) system of National Law Enforcement Telecommunications System (NLETS) before taking enforcement action that is based solely upon an ALPR alert. (e) All entries into the Department Hotlist shall be approved by a supervisor. (f) Department supervisors are responsible for ensuring that Hotlist entries are properly entered and removed when necessary. (g) Searches of historical data within the ALPR system shall be done in accordance with policy and legal requirements. Users shall report errors in ALPR data to the System Administrator as soon as possible. (h) Requests for GPD ALPR data or use by other agencies should follow the criteria outlined above and shall be authorized by a supervisor. Department members that receive authorization shall ensure that the request is for legitimate law enforcement reasons and note the agency and the agency case number in the "Search Reason" field. Requests for other agencies shall be completed on the appropriate electronic form. (i) Blanket searches absent a bona fide reason are strictly prohibited. The only exception is for training and/or demonstration purposes and will be labeled as such. 416.6 ALPR ALERTS / HITS (a) Officers shall visually verify that the vehicle plate number matches the plate number run by the ALPR system, including both the alphanumeric characters of the license plate and the state of issuance. (b) Officers shall verify the current status of the plate through dispatch or a query of NCIC, TIME, or other official database, unless doing so would create a threat to safety. Published with permission by Germantown Police Department ***DRAFT*** Automated License Plate Readers (ALPR) - 3 (c) An ALPR alert for a stolen or felony vehicle does not rise to the level of reasonable suspicion or probable cause without confirmation that the underlying reason for the alert still exists. (d) If an ALPR Alert cannot be verified both visually and for validity, members shall not act on it. ALPR data received from other law enforcement agencies, whether through the GPD ALPR or otherwise, is subject to the same procedures of the policy. 416.7 ALPR DATA COLLECTION ALPR information gathered and retained by the department may be used and shared with prosecutors or others only as permitted by the law. Data gathered from the ALPR Manufacturer system will be stored on their server for 30 days. Data that has been determined to be of evidentiary value shall be downloaded from the server and preserved in accordance with procedures for digital evidence collection and preservation. 416.8 ACCOUNTABILITY AND SAFEGUARDS All saved data will be closely safeguarded and protected by both procedural and technological means. The Germantown Police Department will observe the following safeguards regarding access to and use of stored date: (a) All non-law enforcement requests for access to stored ALPR data shall be referred to the Information Services Manager and processed in accordance with applicable law. (b) All ALPR data downloaded to the mobile workstation and server shall be accessible only through a login/password-protected system capable of documenting all access to information by name, date, and time. (c) Persons approved to access ALPR data under these guidelines are permitted to access the data for legitimate law enforcement purposes only, such as when the data relates to a specific criminal investigation or department-related civil or administrative action. On Sunday, August 16, 2026, a Germantown Police Department squad car was struck by another vehicle after the other driver crossed the centerline of the roadway. As a result of the collision, the squad car tipped onto its passenger side and sustained extensive, major damage. Following the crash, the vehicle was inspected by the insurance company and determined to be a total loss. The insurance company will cover the replacement cost of the squad vehicle. The applicable insurance deductible will also be submitted to the other driver's insurance company for reimbursement. The Department is requesting authorization to purchase a 2027 Ford F-150 Police Responder as the replacement vehicle. This vehicle will provide the Department with a suitable replacement for the totaled squad and will allow the Department to maintain its operational capabilities and fleet needs. At this time, there are no new F-150 Police Responder vehicles readily available for purchase. Therefore, the replacement vehicle will need to be ordered from the manufacturer. Ordering the vehicle will allow the Department to begin the replacement process as soon as possible while awaiting production and delivery. 1 – Ford F-150 Police Responder $48,727.00 The replacement vehicle will be funded through the insurance proceeds associated with the totaled squad car. The Department does not anticipate an out-of-pocket vehicle replacement cost, other than any applicable deductible or related expenses that will be pursued through the responsible driver's insurance coverage. Page 84 of 94 BUSINESS OF THE PUBLIC SAFETY COMMITTEE MEETING DATE: September 8, 2026 PLACEMENT: Ordinance ITEM TITLE: An Ordinance Repealing and Recreating Section 7.12 of the Germantown Municipal Code Relating to Regulation of Bicycles, Electric Bicycles, Electric Scooters, and Other Vehicles (ACTION) SUBMITTED BY: Brian Sajdak, Attorney SUMMARY EXPLANATION: Over the past several years, modes of personal transportation have evolved significantly, making it necessary for the Village to review and update its regulations governing their use. Electric bicycles (e-bikes) have become an increasingly popular mode of transportation for individuals of all ages, particularly younger riders and those who benefit from the assistance of an electric motor. The Village's current ordinance addresses only traditional pedal bicycles. Under Wisconsin law, electric bicycles equipped with factory-installed, operable pedals are classified as bicycles and are generally subject to the same rules of the road. However, the growing variety of personal transportation devices—including electric bicycles, electric scooters, skateboards, in-line skates, and other play vehicles—has created a need for greater clarity within the Village Code. Many municipalities have updated their ordinances to distinguish between these different modes of transportation and establish regulations that reflect their unique characteristics. Adopting similar ordinance revisions will provide clearer guidance regarding where these devices may be operated, the responsibilities of their operators, and the expectations for safe use within the Village. These updates will improve public understanding, enhance safety for both users and pedestrians, and provide law enforcement with clear and consistent regulations for enforcement. At the last Public Safety Committee meeting, the Committee directed the Village Attorney to prepare a draft ordinance for consideration. That draft is attached, and is based upon the current statutory scheme for regulating these devices and also ordinances from other communities. There are a couple of points to highlight and could be the source of further discussion and direction: 1. The current ordinance requires a license for bicycles. The proposed ordinance continues that requirement and extends the requirement to electric bicycles and Page 85 of 94 motor bicycles. Note that under Wis. Stat. § 349.18(2), it appears that the Village cannot require licenses for e-scooters. 2. The current ordinance prohibits bikes only on the pathway in Cedar Hills. This singular prohibition carries through to the draft ordinance. The Village could consider adding other sidewalks that are off-limits to bikes, e-bikes, e-scooters too. 3. The draft ordinance includes regulations that require safety equipment, parking of devices, and prohibition of abandonment. 4. E-Motos (purely electric non-pedal assisted vehicles) are somewhat nebulous. They are not defined by state law, and are essentially prohibited from being operated on a public road unless they are registered with the DOT. However, the DOT does not register them currently, so they are effectively illegal to drive on the road. The draft ordinance codifies this prohibiton. 5. Under Wis. Stat. § 346.78, play vehicles are prohibited from being operated in the roadway, unless using a crosswalk. The draft ordinance includes this prohibition. 6. The draft ordinance bans the commercial rental of scooters (Bird, Lime, etc.) within the Village. Despite their popularity in other communities, we have not seen any efforts to expand here. ATTACHMENT: 1. E-Bike and E-Scooter Ordinance STAFF RECOMMENDATION: Move to recommend approval of Ordinance Repealing and Recreating Section 7.12 of the Germantown Municipal Code Relating to Regulation of Bicycles, Electric Bicycles, Electric Scooters, and Other Vehicles ACTION BY COMMITTEE: Page 86 of 94 STATE OF WISCONSIN VILLAGE OF GERMANTOWN WASHINGTON COUNTY ORDINANCE NO. _____-2026 AN ORDINANCE REPEALING AND RECREATING SECTION 7.12 OF THE GERMANTOWN MUNICIPAL CODE RELATING TO REGULATION OF BICYCLES, ELECTRIC BICYCLES, ELECTRIC SCOOTERS, AND OTHER VEHICLES WHEREAS, the Village Board previously adopted Section 7.12 of the Germantown Municipal Code to regulate the use and operation of bicycles within the Village; and WHEREAS, the Village Board desires to repeal and recreate Section 7.12 to clarify the regulations applicable to bicycles, and to establish regulations governing the use and operation of electric bicycles, electric scooters, and other similar vehicles; and WHEREAS, the regulation of bicycles, electric bicycles, electric scooters, and other similar vehicles advances the health, safety, and welfare of the community.
