agreement by discussion between
the parties senior representatives
of management. If any dispute
cannot be resolved in this manner
within a reasonable length of
time, parties agree to attempt non-
binding mediation or any other
method of alternative dispute
resolution prior to filing any legal

actions are brought to enforce this
Agreement, the prevailing party
shall be entitled to collect its

Re: Proposal for Engineering Design Services for Jackson Drive and Georgetown Drive
Dear Jack:
Thank you for the opportunity to assist the Village of Jackson with its 2027 Street Improvement Project. We
appreciate the Village’s continued confidence in Clark Dietz and look forward to building upon our relationship
through the successful delivery of this project. This proposal presents our understanding of the project, proposed
scope of services, schedule, and estimated fee.
PROJECT UNDERSTANDING & SCOPE OF SERVICES
We understand that the Village desires to prepare construction plans and bidding documents for the reconstruction
of Jackson Drive from about 150’ north of STH 60 to about 150’ north of Georgetown Drive; and Georgetown Drive
from Jackson Drive to Wilshire Drive with the following elements:
• Project length is about 1,600 feet
of urban section.
• Construction will be during the
2027 construction season with a
desired bid date in February
2027.
• The project is planned to be
funded using LRIP and local
funding.
• The roadway will be fully
reconstructed, including the
pavement section, curb and
gutter, and sidewalk.
• Watermain, sanitary main, water
services, and sanitary laterals will
be replaced.
• Storm laterals will be replaced.
• Roadway alignment and drainage patterns will remain.
• Lighting will be converted from We Energies to Village-owned lighting.

Page 2
TOPOGRAPHIC SURVEY AND BASE MAP
We will complete a topographic survey of the project area. Data will be collected using GPS equipment and
translated into Civil 3D for use in design. Utility as-builts will be requested from private utility companies and
incorporated into the base map.
Benchmarks and control points will be set for future project use. Right-of-way will be shown on the base mapping
based on locating the existing property irons and section corner monuments. A right-of-way plat is not included.
PROJECT MANAGEMENT AND COORDINATION
Clark Dietz utilizes Quality Management on all projects. We have developed a method of tracking project activities
and document checking to ensure that our project deliverables meet or exceed the client’s needs. This results in all
design team members having the same understanding of the scope, needs, and goals for the project.
A Project Work Plan (PWP) will be prepared, which is a “living document” of the project scope and activities.
Individual staff and their activities are identified as well as describing each task in detail, effort, and resources.
Supporting design information and resources are an important part of the PWP.
Quality Management reviews will be conducted by an independent Clark Dietz staff member with management
responsibilities. The reviewer will consider the status of the project scope, schedule, budget, and staffing to ensure
that your needs are met.
KICK -OFF MEETING
Clark Dietz will meet with Village public works and utility staff to confirm the project scope, design criteria, schedule,
milestones, known areas of concern, utility-replacement limits, and anticipated agency coordination. Prior to the
meeting, Clark Dietz will review available record drawings, existing mapping, utility information, and other
background information provided by the Village.
PRELIMINARY DESIGN
During preliminary design, Clark Dietz will work closely with Village staff to confirm the proposed improvements,
identify design constraints, evaluate roadway and utility coordination issues, and establish the overall design
approach. Comments received during this phase will be incorporated as the project advances into final design.
The following activities will take place during preliminary design:
• Prepare horizontal roadway alignment and identify potential design challenges for discussion .
• Design horizontal utility alignments and show service locations.
• Prepare typical roadway sections.
• Lighting layout and coordination with WE Energies.
• Develop preliminary opinion of probable construction cost based on quantity takeoffs .
• 30% design review meeting in person with Village staff.

DESIGN DEVELOPMENT/ FINAL DESIGN
During design development/final design the two-dimensional preliminary plan will be used as a basis for generating
the three-dimensional project design. Permitting activities will also take place.
The following activities will take place during design development/final design:
• Prepare vertical alignment based on feedback from the preliminary review meeting.
• Generate cross-sections.
• Prepare Jackson/Georgetown intersection design.
• Prepare ADA ramp designs.
• Finalize vertical utility alignments and service locations.

STAFF MEMO Village of Jackson Public Works
To: Brian Heckendorf, Village President
Jen Heidtke, Village Administrator
CC: Budget and Finance; Village Board
From: Tyler Mentzel, Director of Parks and Recreation
Jack Straehler, Director of Public Works
Subject: 2025 Dog Park at Cedar Creek Park
Meeting Date: August 18, 2026 – Budget and Finance
Background and Analysis:
The Village of Jackson is working with Lowe Underground, Inc. and MSA Professional Services, Inc.
to reach substantial and final completion of the Cedar Creek Dog Park project. The project was
originally scheduled for substantial completion on May 15, 2026, and final completion on June 15,
2026.
Throughout the project, Village staff identified several opportunities to improve site conditions and
the overall functionality of the park. Due to the nature of the site, certain conditions were difficult to
visually identify and anticipate during the initial design process. Improvements identified during
construction included relocating portions of the fence outside of wetland areas, adding gravel to
raise pathways and improve drainage, and installing a culvert necessitated by the parking lot, which
was constructed after the original park design was completed.
Lowe Underground, Inc. also identified opportunities for additional improvements throughout
construction. These included additional tree and undergrowth clearing, increased seeding, and the
use of additional woodchips to raise and widen pathways.
The project also encountered several unforeseen challenges. Including heavy rain events limited
frost during winter months, and underground rock made it difficult to drive fence posts to the required
depth, requiring adjustments to the construction approach. Through discussions with the contractor,
Village staff were also able to negotiate a five-year warranty for the fence and poles, exceeding the
original one-year warranty provided for in the project.
The project site experienced increased rainfall during both the late fall of 2025 and the spring of
2026. These conditions provided an opportunity for the contractor, Village staff, and engineering
team to evaluate site drainage and make grading adjustments where needed. However, the weather
and resulting site conditions have contributed to current and past delays in the project.
Taking the lead in Washington County
The changes described above, including the culvert installation and fence relocation, as well as the
delays experienced during construction, have resulted in adjustments to both construction and
engineering/project management costs.
The change order being presented for the culvert, along with quantity adjustments, some of which
are reflected in the current pay request, represents an increase in construction costs to date. The
Village anticipates a total increase in construction costs of approximately $21,271.24.
In addition to increased construction costs, the project delays and changes have resulted in
additional engineering services. MSA Professional Services, Inc. estimates that approximately
$30,000 in additional engineering costs have been incurred. These costs may be considered as part
of the Village’s assessment of liquidated damages related to the failure to meet the substantial and
final completion deadlines.
Under the contract, liquidated damages of $500 per day have been accruing since the May 15,
2026, substantial completion deadline. As of July 15, 2026, liquidated damages totaled $30,000.
On July 21, 2026, Village staff met with representatives from MSA Professional Services, Inc., and
Lowe Underground, Inc. to discuss project completion and liquidated damages. During that
discussion, it was recognized that responsibility for the project delays was shared among the three
parties, along with delays attributable to weather-related conditions.
At this time, Lowe Underground, Inc. has agreed to a $12,500 credit, and MSA Professional
Services, Inc. has agreed to a $5,000 in credit toward the additional engineering costs. Village staff
continue to negotiate with MSA Professional Services, Inc., and Lowe Underground, Inc. regarding
the final amount of liquidated damages. Liquidated damages continue to accrue and may be
assessed to the extent the Village continues to incur costs resulting from the project delays.
To date, costs associated with the delays include additional engineering services from MSA
Professional Services, Inc., additional Village staffing costs, and the potential for lost revenue
associated with fundraisers that were being planned in conjunction with the opening of the park.
The current agreements reached are reflected in attached agenda items. A $12,500 credit from
Lowe Underground, Inc. is included in Pay Request No. 4, and a contract amendment with MSA
Professional Services, Inc., not to exceed $25,000, reflects a reduction of $5,000 from the previously
estimated $30,000 in additional engineering costs.
Village staff will continue working with Lowe Underground, Inc. and MSA Professional Services, Inc.
to reach final agreements regarding liquidated damages, contract adjustments, and completion of
the Cedar Creek Dog Park project.
If you have any questions, please let me know.
