REGULAR MEETING OF THE VILLAGE BOARD OF THE VILLAGE OF LAKE DELTON August 14, 2023 Upon giving proper notice pursuant to Section 19.84 Wis. Stats., and certifying compliance with the open meetings law, a Regular Meeting of the Village of Lake Delton was called to order on Monday, June 10, 2023, at 4:00 P.M. in the Lake Delton Police Department located at 35 Miller Drive. Present were Trustees Leslie Bremer, Cary Brandt, Merije Ajvazi, Thomas Diehl and Bernadette Skwor. Excused were President John Webb and Trustee Joe Eck. Also in attendance were Richard Cross, Attorney, Troy Locken, Water Operator, Jason Puttkamer, Public Works Director, Daniel Hardman, Police Chief, Assistant Police Chief Eric Thunberg, Dillon Gavinski, Deputy Public Safety Director, Jeremy Peach, Assistant Zoning Administrator, Raine Gardner, MSA, and other members of the public and media. Call to order and certify compliance with the open meeting law. Village Administrator Tim McCumber appeared via Zoom meeting. A motion was made by Ajvazi, seconded by Skwor, to certify compliance with the open meetings law and to adopt the meeting agenda as amended. Motion carried. No one appeared under Citizen Appearances. A motion was made by Brandt, seconded by Eck to close the Public Hearing and approve the application for a “Class B” Fermented Malt Beverage and Intoxicating Liquor License, applied for by Uphoff Resorts, LLC, Brent Gasser, Agent, Dawn Manor Restaurant & Conference Center, 413/505 South Burritt Ave. for the period August 15, 2023 to June 30, 2024. Motion carried. A motion was made by Diehl, seconded by Skwor, to close the Public Hearing and the application for a Class “B” Fermented Malt Beverage License and a Class “C” Wine License, applied for by Dells Diner Inc, Uriel Dominguez, Agent, Dells Diner, 230 W. Munroe Ave., for the period August 15, 2023 to June 30, 2024. Motion carried. A motion was made by Diehl, seconded by Brandt, to approve the Initial Class A-PM permit application expiring 9/30/2023 for Property Manager - Destination Dells, LLC for Gidget Gibbons (Owner) at 530 E Hiawatha Dr – Lighthouse Cove #416 as recommended by the Housing & Property Committee. Motion carried. A motion was made by Bremer, seconded by Eck, to approve the Initial Class A-PM permit application expiring 9/30/2023 for Property Manager - Destination Dells, LLC for Grace-Jo Vacation Rentals LLC (Owner) at 874 Xanadu Rd –Highland #5 as recommended by the Housing & Property Committee A motion was made by Diehl, seconded by Skwor, to ratify the action taken at the Regular Meeting of the Village Board held on July 10, 2023; Ordinance Committee, Airport Committee and Housing and Property Maintenance Committee held on July 24, 2023 as delivered Written reports were received by the board for the Police Department by Police Chief Daniel Hardman; Public Works Department by Director Jason Puttkamer; Water Department by Operator Troy Locken; Delton Fire Department by Deputy Director of Public Safety Dillon Gavinski, Engineers update by John Langhans and Raine Gardner; Zoning Department by Assistant Zoning Administrator Jeremy Peach; and Village Administrator’s Report, Tim McCumber. A Monthly Report by Aaron Kirby for Lake Delton Ice Arena. President Webb announced he was not changing the Committee and Commission Appointments for the 2023-24. A motion was made by Diehl, seconded by Ajvazi, to approve the Contract for Revaluation Assessment Services for the year 2024 and Contract for Maintenance Assessment Services for the 2023 to 2027 assessment years with Associated Appraisal Consultants, Inc. Motion carried. A motion was made by Brandt, seconded by Skwor to approve the a proposed contract with VC3 for IT services for the Public Works and Water Departments. A motion was made by Eck, seconded by Skwor to accept and approve a contract for the soil boring locations for the Lake Delton Commercial Development project on parcel 146-0147-53311 from Giles based on the recommendation from MSA. Motion carried. A motion was made by Brandt, seconded by Bremer to introduce for publication ORDINANCE MODIFYING AND AMENDING CHAPTER 42 OF THE MUNICIPAL CODE (Operating on sidewalk restricted 42.20). Motion carried. A motion was made by Brandt, seconded by Skwor to introduce for publication ORDINANCE MODIFYING AND AMENDING CHAPTER 46 OF THE MUNICIPAL CODE (46.12 Speed restrictions on certain water areas of Lake Delton). Motion carried. A motion was made by Bremer, seconded by Skwor to introduce for publication ORDINANCE MODIFYING AND AMENDING CHAPTER 40 OF THE MUNICIPAL CODE (40.13 Permits - Sign Code). Motion carried. A motion was made by Brandt, seconded by Eck to approve Resolution No. 23-014 Resolution to Supporting the I-39/90/94 Corridor Study. Motion carried. A motion was made by Brandt, seconded by Eck to approve Resolution No. 23-015 Resolution to combine Wards 6 & 7. Motion carried. A motion was made by Diehl, seconded by Skwor to approve the Private Development Agreement between the Village of Lake Delton and Kwik Trip, Inc for the property at 532 West Munroe Street (STH 23). Motion carried. A motion was made by Bremer, seconded by Diehl to approve the Pre-Development Agreement between the Village of Lake Delton and T&S Nelson Acquisitions for the property located at 397-471 County Rd A. Motion carried. Brandt abstained. A motion was made by Brandt, seconded by Bremer to approve the Development Agreement between the Village of Lake Delton and Green Dots Builders LLC for the property at Lot 2 of Sauk County CSM#6281. Motion carried. A motion was made by Brandt, seconded by Bremer to approve on the Development Agreement between the Village of Lake Delton and Core Commercial, Inc. for the property at Lot 2 of Sauk County CSM#6281 (approx. 4.5 acres). Motion carried. A motion was made by Bremer, seconded by Brandt to approve the CSM from Grothman & Associates S.C for Tom Diehl / Tommy Bartlett Inc general location Being part of the SE ¼ of the Sw ¼ of Section 16 and part of the NE ¼ of the NW ¼ of Section 21, Town 13 North, Range 6 East, Village of Lake Delton, Sauk County, Wisconsin (Lot 1 1.61 acres). Motion carried. Diehl abstained. A motion was made by Ajvazi, seconded by Skwor to waive the fees and approve the application for a Temporary Class “B” Fermented Malt Beverages / “Class B” Wine Retailer’s License applied for by Delton Fire Dept. Inc. for Block Party on September 9, 2023, located at 45 Miller Drive. Motion carried. A motion was made by Diehl, seconded by Ajvazi to waive the fees and approve the application for Class C Activity License applied for by Delton Fire Department for Block Party at 45 Miller Drive, on September 9, 2023 starting at 4:00 pm. Motion carried. A motion was made by Brandt, seconded by Skwor to waive the fees and approve the application for outdoor musical performance permit applied for by Delton Fire Department for Block Party at 45 Miller Drive, on September 9, 2023 from 4:00 pm – 10:00 pm. Motion carried. A motion was made by Eck, seconded by Bremer to waive the fees and approve the application of Parkway Group Inc. d/b/a UNO’s Chicago Grill – 1000 Wisconsin Dells Pkwy S for a License to erect a Party Tent for the Joe Heintz Scholarship Benefit/ Wisconsin Dells Education Foundation to be erected on August 18 and taken down on August 21, 2023. Motion carried. A motion was made by Bremer, seconded by Skwor to waive the fees and approve the application for an Outdoor Musical Performance Permit applied for by Parkway Group Inc. d/b/a UNO’s Chicago Grill – 1000 Wisconsin Dells Parkway S for performance by the Wisconsin Dells Jazz Band and Hal Edwards Orchestra on August 20, 2023, from 1pm – 4 pm A motion was made by Ajvazi, seconded by Skwor to waive the fees and approve the application for a Class C- Activity License applied for by Dells Hotels (Staybridge Suites) for the Badgerland Ford F-100 Truck Club Show to be held in Buffalo Phil’s Back Parking lot located at 150 Gasser Rd on September 15 – September 16, 2023 from 9:00 am – 4:00 pm A motion was made by Brandt, seconded by Ajvazi to approve the License to erect Tent applied for by by Dells Hotels (Staybridge Suites) at Buffalo Phil’s Back Parking lot located at 150 Gasser Rd on September 15 and taken down on September 18, 2023. Motion carried. A motion was made by Eck, seconded by Skwor to approve the application from Baker’s Sunset Bay- 921 Canyon Road for a License to erect a Tent by Stevens Point Tents LLC for the Hackett Family Reunion on September 8 and taken down on September 11, 2023. Motion carried. A motion was made by Eck, seconded by Ajvazi to the application for an Outdoor Musical Performance Permit applied for by Baker’s Sunset Bay on September 8, 2023 from 7am – 10:30 pm and September 11, 2023 from 7am – 10:30 pm, for a Family Reunion to be held at Sunset Bay Resort located at 921 Canyon Road. Motion carried. A motion was made by Brandt, seconded by Ajvazi to approve the Taxi Operator Permits applied for by Joseph S Spittel for Dells Express Taxi as recommended by the Lake Delton Police Department expiring 6/30/2024. Motion carried. A motion was made by Bremer, seconded by Eck to approve the application for Cigarette and Tobacco Products Retail License applied for by and issued to Lake Delta LLC at 1300 Great Wolf Drive STE 130 expiring 6/30/2024. Motion carried. A motion was made by Brandt, seconded by Skwor to approve the applications for Operator’s Licenses applied for by and issued to Paulina Quitian, Shantal Simmonds, Jeada Bonilla, Katina Guzman, Carlos D Duque, Mallory Engen, Aila R Duerr, Taylor Williams, Vartush Khanoian, Lauren Myklebust and Scott J Loomis expiring 6/30/2024. Motion carried. A motion was made by Brandt, seconded by Skwor to approve the Payment of claims. Motion carried. There were no other matters authorized by law or presentation of items to be considered at future Village Board Meetings. Motion to adjourn by Ajvazi, second by Eck. Motion carried.
