The petitioners, Bee and Y oua Hang, have petitioned to build an accessory structure !hat is in front of !he principal structure. This requires a Special Exception. Discussion between Commissioned,1embers, Staff and the Applicant occurred regarding !he proposed placement of the d¢tached accessol')I structure and whether or not a contractor could build in a compliant location. Mr. Hang shared that the proposed ~fracture is located 25 feet in front of the home. He also explained !he topography on the north andwesfside makes moving the building behind !he front face of the home challenging. The Plan Commission encouraged Staff to attempt, over !he next 30-days, to work with the property owners to see if the construction of an accessory structure could take place without the need for a Special Exception. Motion Vice Chairman Naze to table the petition by Bee and Y oua Hang, for properly located at 4350 Hubertus Road (TKN: VI O 0440001), to allow a proposed accessory structure to be placed ahead of the single-family home, to the July 9, 2026 Plan Counuission Meeting at 7:00 PM. Discussion/ Action regarding the proposed Site Plan Amendment for Basse's Taste of Country for the property located at 3190 County Hwy Q (TKN: V10_139200B)-Basse Trust, Petitioner/Owner Administrator Healy gave an introduction of the agenda item. It was stated that the petitioners were seeking to replace an existing recreational activity for children with another recreational activity for children in the 'Primary Activity Area' that was established by their conditional use permit. It was the then understanding of Staff that the Bull Riders area, as depicted on their site plan, would be replaced with a variety of novelty excavators, similar to other fam1ing operations. Discussion took place regarding the administrative denial of the petition by Staff. The policy question, as it was framed to the Plan Commission, was whether or not the Plan Commission believed the proposed site plan aniendment is in keeping with the 'spirit and intent' of the approved conditional use permit aud whether or uot it was 'compatible' with the approved activities for the site. Mr. Roger Basse spoke regarding the proposed Site Plan Amendment. It was stated that the excavators would be in the same location as the Bull Riders, but that they would like to also add the Bull Riders to another area, just east. Members of the Plan Commission stated that they were not in favor of adding additional recreational activities unless the Bull Riders were going to be removed from the property. Mr. Roger Basse agreed to the removal of the·Bull Riders. Discussion between the applicant, Commissiou_l\1embers and Staff occl.l1'1'ed regarding the proposed Site Plan Amendment. Motion by Commissioner Bartel to apprnve the proposed Site Plan Amendment for Basse's Taste of Country located at 3190.CTH O (TNKVl 0 139200B.by removing the "Bull Riders" as indicated on the Site Plan prepared by TrioConsulting(rev. 2023) arid replacing it with eight (8) Mini Excavators in the same identified 35x50' fenced-in enclosure subject to the following Conditions of Approval: 1. There was specific discussion on detached accessory stmctures height and allowable square footage. Staff was asked to review regulations found in similarly sized communities to present the information back to the Plan Commission in July. 6. ADJOURNMENT: Motion by Vice Chairman Naze, seconded by Commissioner Wittig, to adjourn the Plan Commission meeting at 8: 14 PM: Motion carried unanimously. Respectfully submitted, Jim Healy Village Administrator VILLAGE OF RICHFIELD PLAN COMM ISSION COMMUNICAT ION FORM MEETING DATE: Jul y 9, 2026 SUBJECT: Accessory Structure - Special Exception located at 1250 St. Augustine Rd (Tax Key: Vl0 076200F) - Cluis & Jennifer Slamer, Petitioners/Owner DATE SUBMITTED: July 1, 2026 SUBMITTED BY: Brad Calder, Administrative Services Coordinator POLICY QUESTIONS: DOES THE PLAN COMMISSION WISH TO APPROVE THE SPECIAL EXCEPTION FOR THE PLACEMENT OF A PROPOSED ACCESSORY STRUCTURE IN FRONT OF A SlNGLE -FAMILY HOME? ISSUE SUMMARY: Pursuant to § 170.874 of the Village Code, entitled "Placement of Detached Accessory Buildings on a Lot", the Plan Comm ission is allowed discretion in considering the placement of accessory building s in places other than the side or rear of properties . The logic and reasoning behind making such a policy decision was that it was recognized by Staff, the Plan Commission, and the Village Board that there were instances where it would make sense to provide flexibility to property owners that might not otherwise be availabl e even through the variance process. In the situation before us tonight, Mr. And Mrs. Stamer are acting as petitioner for the plac ement of a new detached accessory structure in the front yard as defin ed in our Village Code. In this case, per the Richfield Municipal Code's definitions most of the yard is considered the "fro nt yard". The only permissible area that a detached accessory structure to be located, is outlined in green in the picture (shown below). While the parcel is large in size 60 acres, there is very limited space for additional development on the parcel. Almost all of the parcel is located in the floodplain and environmental corridor with the exception of where the current single-family home (SFH) is located and the proposed location of the detached accessory structure to the south-southwest of the SFH. With the challenges of the floodplain, wetlands, environmental corridor and, steep topography just east of the SFH in the "rear yard" makes it virtually impossible to construct any functional accessory buildings on the lot, without receiving a Special Exception. As such, the applicants are requesting the Plan Commission consider a S ecial Exce tion for their VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICATION FORM MEET[NG DATE: July 9, 2026 SUBJECT: Accessory Structure - Special Exception located at 1250 St. Augustine Rd (Tax Key: Vl0 _076200F) - Cluis & Jennifer Slamer, Petitioners/Owner DATE SUBMITTED: July 1, 2026 SUBMITTED BY: Brad Calder, Administrative Services Coordinator -~ "' -~ iii Parcel with Flodplain & Wet land Layers Turned On Topography VILLAGE OF RICHFIELD PLAN COMMISS ION COMMUNICATION FORM MEETING DATE: July 9, 2026 SUBJECT: Accessory Structure - Special Exception located at 1250 St. Augustine Rd (Tax Key: V 10 _ 076200F) - Chris & Jennifer Slam er, Petitioners/Owner DATE SUBMITTED: July 1, 2026 SUBM ITTED BY: Brad Calder, Administrative Services Coordinator The Section of the Code previously referenced states the following: 170.874 Placement of detached accessory buildings on a lot Except as may be permitted in this section, a detached accessory building must be located behind the front face (i.e.Jace of the building closest to the street) of the principal building (Exhibit 6-3). In the case of a corner lot, the detached accessory building shall meet the minimum setback requirements from all streets. Only accessory buildings for agricultural uses are permitted in front of the principal building. Pursuant to the procedures and requirements in Article 5, the Plan Commission may approve a special exception to allow an accessory building in front of the principal building. In making such decision, the Plan Commission must consider {J ~ the size of the subiect property, (2} the character of the area, (3) the size of the proposed accessorv building. (4) the extent to which the proposed accessorv building is visible from public and private streets and other properties in the area, (5) the practical difficulty in placing the proposed accessory building in the location described in this subsection, and (6) other fact ors related to relevant circumstances. The subject property is zoned RS-1, Country Estate District. I The size of this prope1ty is 60.59 acres and is located on the far west side of the Village on St. Augustine Road just north of the intersection of St. Augustine Road and Hogsback Road. (2) In terms of the character of the area, the subject property is located on St. Augustine Road . With the Town of Erin on the west side of the road. The character of the area consists of residential lots of verifying sizes ranging from 2 acres to larger lots like the petitioners 60 acre parcel. Most parcels in the area are between 5-10 acres in size, and are primar ily wooded with a mix of upland and low land. View of the Property looking east /southeast on St. Augustine Road VILLAGE OF RICHFIELD PLAN COMM ISSION COMMUNICATION FORM MEETING DATE: July 9, 2026 SUBJECT: Accessory Structure - Special Exception located at 1250 St. Augustine Rd (Ta x Key: Vl0_076200F) - Chris & Jennifer Slamer, Petitioners/Owner DATE SUBMITTED: July I, 2026 SUBMITTED BY: Brad Calder, Administrative Services Coordinator View of the Property looking east just south of the Driveway 13) The parcel which the proposed accessory structure is to be built on is zoned Rs-1, Country Estate. The parcel is 60.59 acres in size. Under the Rs-1 Zoning District the application is allowed to build an accessory structure that is up to one (1) percent of the total lot area. For this parcel an accessory building up to 26,393 sq. ft. could be built. The petitioner is proposing to build an accessory strncture that is proposed garage is 55'x30' for a total of 1,650 sqft. well within the limit of what is legally penniss ible. {4) In terms of visibility from the roadways and residences, I've included photos of the property, from the road (St. Augustine Road). The proposed location is to the south of the home. It will be visible from St. Augustine Road , especially in the direct vicinit y of the driveway. South of the d1iveway there is a thick row of vegetation along St. Augustine Road that shields the property and proposed accessory structure from view. The closest neighbor is the property to the north, and the visibility of the proposed structure shou ld be lin1ited due to the vegetation and the distance between the two propertie s. Visibility from other neighboring properti es is limited due to the petitioner's _parcels size. T~ gro osed location exceeds all the re uired setbac ks. See the roposed site in the Ap lication materials. The proposed building consists of masonry wainscoting that looks like field stone. Above that will be a horizontal ''beige" color metal siding panel. With a "light stone" color trim. These colors closely match the SFH and proposed materials will give a similar appearance to the materials used on the SFI-1. The applicant has provided pictures of the cun-ent SFH and information sheets on proposed accessory structure material s. Staff believe the proposed exterior materials for the garage will satisfy the exterior materials requirement as set by Section 170A 2 17.02)(!3) Residential Accessory Structures -Exterior Materials. 5) There is "practical difficulty " in placing the garage elsewhere that woul d conform with the Village Code. Thi s "practical difficulty " in placing it behind the home is that there is no practical location to place the proposed garage without the proposed detached accessory structure being in the floodplain or due to topography. (6) In the opinion of Staff, these types of reasons are exactly why the Plan Commission and Village Board chose to adopt this provision in the Code. This petition would not be successful in receiving a variance. Hawthorne Drive Richfield, WI 53076 Subject: Request for Special Exception to Allow an Accessory Building to be Located Closer to the Street Than the Principal Structure Dear Members of the Plan Commission and Board of Appeals, We are writing to respectfully request approval of a special exception to allow an accessory building to be located closer to the street than the principal residence on our property located at 1250 Saint Augustine Road, Hubertus, WI 53033. One of the primary reasons for this request is the unique nature of our property. Although we own approximately 60 acres, less than 2 acres are located outside of the floodplain and suitable for development. As a result, the amount of buildable land ----~vailableiorstraclu1es is exlremelrlimitei . The location and configuration of the buildable area, together with its relationship to Hogsback Road and Saint Augustine Road, create unique site constraints that do not exist on most properties within the Village. Due to these constraints, the proposed building site represents the only practical location for an accessory structure of this type. Requiring the accessory building to be localed behind the principal residence would significantly restrict the use of the already limited buildable area and could make construction impractical due to site limitations and access considerations. The requested exception would allow the property to be used in a reasonable manner while respecting the natural limitations of the site. We deeply appreciate the natural beauty of this community and the unique landscape that makes Richfield such a special place to live, and we are committed to preserving those qualities on our property. The attached photographs and site renderings demonstrate that, from the perspective of the driveway and primary approach to the residence, the accessory building will appear to be located behind the house, minimizing its visual impact and maintaining the residential character of the property. The proposed accessory building is intended to provide secure storage for personal vehicles, equipment, and recreational vehicles while maintaining the overall appearance and character of the property. The building will be constructed using materials and colors that complement the existing residence and surrounding area. As shown in the attached photographs, site plans, building elevations, and material specifications, the proposed structure has been carefully designed and sited to be compatible with the existing home and surrounding properties while minimizing its visual impact. We respectfully submit that granting this special exception would not be detrimental to neighboring properties, public safety, or the general welfare of the community. The request is based on the unique conditions of the property and represents the most practical and least disruptive location for the accessory building. Thank you for your time and consideration of this request. We would be pleased to provide any additional information, site plans, photographs, renderings, or supporting documentation that may assist in your review. ISSUE SUMMARY: As requested by the Plan Commission, Staff conducted a review of accessory structure regulations adopted by several comparable communities. The ordinances examined include those from the Town of Mukwonago, Town of Cedarburg, Town ofHartford, Village of Lisbon, Town of Polk, and Town of Grafton. These municipalities were selected because they are predominantly rural communities with development patterns and minimum lot size requirements that are generally comparable to those found within the Village's active residential subdivision districts. In conducting this review, Staff focused on the Village's current preferred subdivision development model, the RS-lB Single-Family Cluster/Open Space Residential District. The RS-2 and RS-3 Residential Districts are fully developed and closed to new subdivision activity; therefore, they were not considered the most appropriate benchmark for evaluating future development standards. Because the RS-lB District already permits accessory structures with a minimum setback of ten (10) feet from all property lines, Staff does not believe modifications to the existing setback requirements are warranted. Instead, Staffs review centered on two specific development standards that have generated the most discussion over the years: the allowable lot coverage (square footage limitations) for accessory structures and the maximum permitted height of those structures. For the Commission's convenience, the provisions within each ordinance addressing these standards have been highlighted to facilitate comparison and discussion. It is important to emphasize that neither the Village Board nor Staff is advocating for amendments to the Zoning Ordinance at this time. Rather, the purpose of this review is to provide objective information and open a policy discussion on a topic that has been raised repeatedly throughout the Village's zoning recodification process and during the review of numerous building permit applications over the years.
