SUBJECT: Va1iance Petition for 4823 Riverview Drive (Tax Key: V10_048600A) - Mike and

POLICY QUESTION: DOES THE BOARD OF ZONING APPEALS BEL!EVE THE APPL!CANT MET THE BURDEN FOR PROVING AN
UNNECESSARY HARDSHIP, UNIQUE PROPERTY LIMITATIONS, AND A COMPELL!NG PUBLIC fNTEREST FOR THE REQUESTED
VARIANCES?
ISSUE SUMMARY:
The issue before us tonight is whether the petitioner, Mike and Catherine Dallia, have made a compelling case for the
requested "Dimensional Variance ". Our applicant is requesting a "Dimensional Variance " from Section 170.1263 of
the Village Code, related to development standards within the Floodplain Overlay Dist1ict. A Class II Public Hearin g
Notice was published in the Daily News on June 16th and June 23rd, respectively. On June 19th, the Public Hearin g
Notice was sent to all properties within 500 feet of the subject property. At the time of this Communica tion Fonn , Staff
has received one written co1Tespondence from a neighboring property owner. It is included in the attachments for your
convenience. However, please be advised that the lack of objections from neighbors does not provid e a basis for
granting a variance (Arndo, fer v. Sauk County Bel. Of Adjustments, 1991).
The subject property is zoned Rs-4, Single-Family Lake Lots District. The parcel is located on the northwest side of
F1iess Lake on Riverview Drive . The parcel was originally two (2) parcels that were combined by the property owner
into CSM 6680 which was approved by both the Plan Commiss ion and the Village Board. The parcel is 0.31-acres in
size. This was done approximately around the same time as the Village Board approved a re-platting of portions of the
right-of-way on Riverview Drive because the road 'as platted' versus the road 'as traveled ' at the time, was
considerably differen t, and on this parcel , still encroaches on the land that we have by prescriptive easement.
Dimen sional variances provide relief when there is no
reasonable use of the property (State v. Kenosha
County Board of Adjustment , 1998). The Wisconsin
Supreme Court held that a zoning variance may be
granted only when strict enforcement of a zoning code
would result in unnecessary hardship that effectively
leaves the property with no reasonable use. The Court
ruled that variances are meant to provide relief only in
exceptional circumstances , not simply because a
property owner wants to use land in a more
convenient way.
As you know, to legally grant a "Dimensional
Variance ", the petitioner must prove three (3) different
criteria: 1) unnecessary hardship- exists when no
reasonable use can be made of the property without a
variance 2) unique property limitations- such as
steep slopes, wetlands, or other layered restrictions
which prevent compliance with the ordinance . The
circumstances of the applicant, such as a growing
family, elderly parents, or a desire for a larger garage,

are not legitimate factors in deciding variances. 3) no harm to public interest - a variance may not be granted which
results in harm to public interests. Public interests can be determined from the general purposes of an ordinance as well
as the purposes for a specific ordinance provision. Analyze short-term, long-term and cumulative impacts of variance
requests on the neighbors, community, and statewide public interests.
In looking at the Zoning District in question, the Intent of the Rs-4 District is as follows:
"Single-Family Lake Lots (RS-4) District. The District is for comparatively small lake lots which have riparian
shoreline lake frontage on Amy Belle Lake, Bark Lake, Friess Lake, Lake Five, and Little Friess Lake. It also refers to
parcels located on Bark Lake Drive, Lakeview Avenue, Bonnie View Lane, Shore/and Lane, Footbridge Road, and
Lake Drive. The Zoning classification is limited to those parcels so designated on July 20, 2023."
The Village began working with the property owner several months ago when they first engaged the services of Mr.
Evan Nickodem from Parish Surveying and Engineering in West Bend. Mr. Nickodem was hired to create a hydraulic
model from the DNR's Surface Water Data Viewer to use in their analysis. The subject property is in the Flood Fringe
and Flood Storage Districts, as classified by FEMA and the Wisconsin DNR. The applicable provision of the Code is
that surrounding the proposed home, fill shall extend to a minimum of 15' beyond the limit of any structure. The
following is an analysis of their submittal. The applicant has indicated they will present additional information the
night of the public hearing, for the benefit of the BOZA.
UNNECESSARY HARDSHIP
For this type of variance, um1ecessary hardship exists when compliance would unreasonably prevent the owner from
using the property for any permitted purpose (State ex rel. Ziervogel v. Washington County Ed. Of Adjustment, 2004).
To determine whether this standard is met, our Board should consider the purpose of the zoning ordinance in question,
its effects on the property, and the short-term, long-term, and cumulative effects of granting the variance (State ex rel.
Ziervogel v. Washington County Ed. Of Adjustments, 2004).
Applicant's Response:
• "Literal enforcement of the terms of the zoning code would result in uffilecessary hardship, by unreasonably
preventing the owner from using the property for a permitted purpose or rendering conformity with such
restrictions unreasonably burdensome. This lot of record is zoned for single family residential uses, and the
property owner seeks approval to build a reasonable structure for that permitted use." (Conclusions of Law,
Variance Decision for 4916 Lakeview Avenue , September 2015)
• Without this variance we would not be able to build a house and use the property for its
permitted purpose.
• Approval of this variance will allow development that is consistent with the development on abutting parcels
and ensures stability and compatible development as intended by the Zoning Code.

MEETING DATE: June 30, 2026
SUBJECT: Variance Petition for 4823 Riverview Drive (Tax Key: Vl 0 _ 048600A) - Mike and
Catherine Dallia, Petitioners
DATE SUBMITTED: June 25, 2026
SUBMITTED BY: Jim Healy, Village Administrator
Staff's Response:
The requested variance is not simply a matter of avoiding compliance with the dimensional standards of the RS-4
District. Rather, the Property is subject to the additional requirements of the Floodplain Overlay District, which
significantly limit the area available for residential development. To construct a residence, the applicant must satisfy
both the underlying zoning requirements and the floodplain management regulations established under Wisconsin
Administrative Code NR 116.
To demonstrate compliance with these floodplain regulations, the applicant commissioned a HEC-RAS hydraulic
analysis. The purpose of the study was to determine whether the proposed fill and structure would adversely impact the
Regional Flood Elevation (RFE) or Base Flood Elevation (BFE) of Friess Lake and the Oconomowoc River. The
applicable standard prohibits development that would increase the BFE or place fill or structures within the floodway.
An analogy often used to explain this concept is a claw-foot Victorian bathtub filled completely to the brim with water.
One may be able to carefully place a volleyball, beach ball, or even a soccer ball on the surface without causing any
water to spill over the edge. However, there comes a point where adding additional volume displaces enough water that
it overflows the tub. The HEC-RAS analysis identifies that threshold- the exact nexus point in which that occurs. In
floodplain terms, the "overflow" represents an increase in the Regional Flood Elevation or Base Flood Elevation,
which is prohibited underNR 116.
The hydraulic analysis submitted by the applicant demonstrates that the proposed fill and structure are not located
within the floodway and will not increase the Base Flood Elevation of Friess Lake or the Oconomowoc River. Because
the floodplain regulations substantially constrain the developable area of the lot beyond the requirements applicable to
similarly zoned properties outside the Floodplain Overlay District, the applicant faces conditions unique to the
property. These additional regulatory constraints create practical limitations on the reasonable residential use of the
property and support a finding that the property is subject to an uunecessary hardship not generally shared by other
properties within the RS-4 District or otherwise residentially zoned.
The purpose of the proposed fill is to create a compliant building site within a property that is further constrained by
the Floodplain Overlay District. Unlike a typical residential lot within the RS-4 District, development of this property
is subject not only to the underlying zoning requirements but also to the additional standards imposed by Wisconsin's
floodplain management regulations. To construct a residence, the applicant must establish a building pad that is
elevated above the required flood protection elevation while ensuring that the placement of fill does not adversely
impact flood storage capacity, flood conveyance, or surrounding properties.
Additional information will need to be gathered during the site visit and during the Public Hearing to determine if this
standard is met.

Unnecessary hardship must be due to unique physical
limitations of the property , such as steep slopes or
wetlands that prevent compliance with the ordinance
(State ex rel. Spinner v. Kenosha County Bd. Of
Adjustments, 1998).
Applicant's Response:
• "The unnecessary hardship is due to unique
conditions created by compliance with the WDNR
flood storage regulations.
• This property lies within a WDNR designated
Floodplain Storage area
• Limited lot size to work with.
• Public road goes thru the north side of the property
which restricts buildable area
Setback requirement for the 1 ft over the floodplain creates the need for additional filling."
Staffs Response:
The fill is not being placed for convenience or to create additional usable yard area. Rather, it is a necessary component
of developing the property in a manner that complies with state and local floodplain regulations. The need for
substantial engineered fill and a detailed hydraulic analysis reflects the unique physical constraints of the property and
the additional regulatory burdens imposed by the Floodplain Overlay District. Absent the fill, the property would not
be developab le. Additionally, it should be noted that as was previously mentioned, this parcel has a prescriptive road
easement where actual road aspha lt is on their physical property. Additionally, on the ' lake side', they have a 25'
easement granted for the benefit of the boat lot owners that are directly adjacent to their parcel. There are no known
wetlands on this property.
Additional information will need to be gathered during the site visit and Public Hearing to determine if this standard is
met.
NO HARM TO PUBLIC INTERESTS

A variance may not be granted which results in harm to public interests (State v. Winnebago County, 1995; State v.
Kenosha County Bd. Of Adjustments, 1998). In applying this test, the Zoning Board should review the purpose
statement of the ordinance and related statutes to identify public interests. Considering public interests, zoning boards
must consider the short-term and long-term impacts of the proposal and the cumulative impacts of similar projects on
the interest of neighbors, the community, and even the state. Review should focus on the public interests, rather than
the narrow interests or impacts on neighbors, patrons or residents in close proximity of the project.
Applicant's Response:
• "The unnecessary hardship is due to unique conditions created by compliance with the WDNR flood storage
regulations.
• This property lies within a WDNR designated Floodplain Storage area
• Limited lot size to work with.
• Public road goes thru the north side of the property which restricts buildable area
• Setback requirement for the 1ft over the floodplain creates the need for additional filling."
Staff's Response:
The purpose of the Village's Floodplain Overlay District and the corresponding provisions of Wisconsin
Administrative Code NR 116 is to protect public health, safety, and welfare by minimizing flood hazards, preserving
flood storage capacity, and preventing development that would increase flood elevations or adversely impact
neighboring properties and waterways.
Based upon the HEC-RAS hydraulic analysis submitted by the applicant and reviewed as part of this petition, Staff
finds that the proposed fill and residential development satisfy those underlying public policy objectives. The
engineering analysis demonstrates that the proposed fill is located within the Flood Fringe District rather than the
Floodway and does not result in an increase to the Base Flood Elevation of Friess Lake or the Oconomowoc River. As
such, the project does not diminish flood storage capacity in a manner that would adversely impact upstream or
downstream properties, nor does it increase flood risk to neighboring lands or the broader community.
Staff further notes that the proposed development remains subject to all applicable floodplain permitting requirements
and regulatory standards intended to protect the public interest. The variance request does not seek relief from those
standards. Rather, the applicant has demonstrated compliance with the floodplain regulations through detailed
hydraulic modeling and engineering analysis.

4823 Riverv iew Drive, in the Village of Richfield , Wiscons in, to determine if the installation of
fill for new single family home construction would be in confotmance with Wisco nsin
Adm inistrative Code NR 116. A map, generated from the Wash ington County GIS website,
containing a locati on of the subject p roperty, can be found in Attachment A. The property is
located in the Northwest ¼ of the North west ¼ of Sect ion 17, Township 9 North , Range 19 East,
Village of Richfield, Wiscons in. The comm unity/zoning authority for this project is Washington
County Land Use Division. The specific contacts for this project are:
• Jim Healy - Village Adm inistrator, Village of Richfield
• Brett Scherer - Land Use Manage r, Washington County
• Andrea S tem - Water Managem ent Engineer-Wi sconsin Depa1tment of Natural
Resources (WDNR)
The vertica l datum for this location is NGVD 88; the horizontal datum is NAO 83 , Western
Hemispher e. A copy of the current floodplain is presented on a FIR.l"1ETTE for this location
which can be found in Attachm ent B.
APPLICABLE FLOODPLAI N REGULATIONS
The appli cable regulation to confom1 with the a nalysis is Wisconsin Adminish·ative Code-NR
11 6-Fl oodplain Management. The Villag e of Richfi eld, WDNR and Washington County all
adhere to this code regarding development within a floodplain. The provision of the fill cannot
raise the Base Flood Elevation (BFE) of Friess Lake or the Oconomowoc River and the structur e
and/or fill can not be located in the floodway . This report, along with the hydraulic model input
and output, will show that the proposed fill and structur e are not located in the floodway and will
not increa se the Base Flood Elevation (BFE) of Friess Lake or the Oconomowoc River.
HYDRAULIC MODEL DEVELOPME NT
We obtained the Effective Hydrauli c Model from the WDNR Surface Water Data Viewer for use
in the ana lysis. The model description :
122 Wisconsin Street • West Bend. Wisconsin 53095
Phone (262) 346-7800 • www.parishse.com
• Detailed (Zone AE) study of Oconomowoc River in Village of Richfield, Washington
County Study extends detailed FIS study from Waukesha County where the
Oconomowoc River discharges into the Rock River to the headwaters of the
Oconomowoc River northeast of Friess Lake in Washington County.
Within this hydraulic model, the upstream reach of the Oconomowoc River from approximately
extends to the northeast of Friess Lake to River Station 215818. The downstream limit of the
model reach is at River Station 195146, approximately 800 feet south of the footbridge crossing
the Oconomowoc River south of Friess Lake. Once the Effective Hydraulic Model was
downloaded from the WDNR website, it was saved as the Duplicate Effective Hydraulic Model.
The geometry of the Duplicate Effective Hydraulic Model, such as slopes and overbank areas on
either side of the river, and lake, and roughness co-efficients were reviewed for accuracy.
Topography and aerial imagery provided in the Wisconsin Department of Natural Resources
Surface Water Data Viewer (SWDV) was used for this purpose as well as topography from
Washington County GIS. The geometry of the Duplicate Effective Hydraulic Model was
generally consistent with our review. However, a Corrected Effective Hydraulic Model was
produced using updated elevation data from both the Washington County GIS system and
bathymetric data as available on the SWDV for River Stations 198278 and 198720 was developed
for this project.
The man-made geometry of the Duplicate Effective Hydraulic Model at Freiss Lake, such as
physical crossings, and structures were reviewed for accuracy. As noted above, a Corrected
Effective Hydraulic Model was produced to include both updated River Stations 198278 and
198720, and the inclusion of River Station 198470 to effectively model existing elevation data
cutting through the project site that is the subject of this study. For the newly introduce River
Station 198470, topographic survey data collected on the subject property was included with the
other data to generate the River Station elevation data. The Corrected Effective model was
created to compare the modeled water surface elevations within Friess Lake and the
Oconomowoc River with the Duplicate Effective model to determine if the addition of a new
River Station and updated elevation data will change the water surface elevations modeled.
None of the changes from the Duplicate Effective model to the Corrected Effected model were
sufficient to have any effect ou the published water surface elevation for the regulated floodplain.
PROPOSED HYDRAULIC MODELING
The subject property is located on the right side of the introduced River Station 198470 starting at
Station 2+805.36 of the River Station cross section. The project is intended to fill a small section
of lands with elevations less than one foot (l ') below the regulated floodplain water surface
elevation of961.10. The lands will be filled to 961.10 to 2' above the floodplain to meet the
requirements of the building being outside and above the floodplain elevation at River Station
198470. A Cross Section Location Plan specific to this project is inclnded as Attachment C.
An encroachment was also added to determine the if the proposed fill and structure will be
located out of the floodway. The floodway encroachment was determined using an iterative
approach which was resulted in locating the floodway at the lake shore.
The proposed flll/grading design plan for the property is shown in Attachment D.
HYDRAULIC MODEL RESULTS
The following table summarizes the BFE (Base Flood Elevation) for the Effective Hydraulic
Model and the Post-Project Conditions Hydraulic Model incorporating the proposed fill. The
MD-08-25 Page 12
Dallia property cross section is highlighted below which shows the Base Flood Elevation (water
surface elevat ion) does not increase with the proposed fill.

The cross section output below shows that the velocity in the Right Overbank is 0.00 ft/second
which indicates little to no conveyance. The low velocity indicates that this area is acting as the
flood fringe and not the floodway , therefore the proposed fill is located in the flood fringe.

WISCONSIN and VILLAGE OF RICHFIELD CODE COMPLIANCE
As required in Wisconsin NR I 16.13 (2)(b) For residential areas where fill is applied to design a
constructible property with the floodfring e zone of a given floodplain , three criteria apply.
)
MD-08-25 Page 13
1. The fill must not be less than l foot above the regional flood elevation . The floodplain
water surface elevation in this area is computed to be 96 1.02 ft. The elevation of lands
shall be raised to 962.02 feet to be at the minimum 1 foot over the floodplain elevat ion.
2. The fill shall extend to a minimum of 15 feet beyond the limit of any structure or building
erected on the site. The site is designed to be a elevation 962.02 feet to a point 4 feet
from the crest of the buildable zone on the north side of the property . This is not in
compliance with the Village of Richfield code 170.1263 B. Any structure or building
constructed within the prescribed setbacks will meet the criteria of lands being at or
above 962.02 feet. A variance from this code requirement will be needed through the
Village of Richfield to construct on this building pad with the reduced setback to the
floodpla in as noted above.
3. Fill placed in areas of flood storage will be required to have fill remo ved to compensate
for the filling that occmTed on the lands to maintain the flood storage volume required by
the State and Village. Village code l 70.1263 B. allows for fill in flood storage areas if
this fill is compensated for with excavation within the flood storage area.
4. Dryland access shall be provided to structur e or building. The proposed site will have
grading at or above the floodplain elevation of 961.02 from the building pad to Riverview
Drive located to the 1101thwest comer of the property.
CONCLUSIONS
The result of the analysis, as shown in the tables above, is that the provision of the fill on the
property at 4823 Riverview Drive in the Village of Richfield , does not negatively impact the Base
Flood Elevation , is located in the flood fringe , not the floodway , of Freiss Lake or the
Oconomowoc Riv er, and meets the code requirements of the Village.

Technical Detail for Variance Request
4
• The building proposal
• Seeking a variance to support filling and excavating to
comply with Village of Richfield code regarding the
building pad in the floodplain area.
6/26/2026
2
Criteria for Approval of a Variance
5
• To qualify for this variance, we will demonstrate that all
three of the following criteria defined in state statues have
been met
• Unnecessary Hardship
• Unique Property Limitations
• No Harm to Public Interests
Unnecessary Hardship
6
• "Literal enforcement of the terms of the zoning code would result in
unnecessary hardship, by unreasonably preventing the owner from
using the property for a permitted purpose or rendering conformity with
such restrictions unreasonably burdensome. This lot of record is zoned
for single family residential uses, and the property owner seeks
approval to build a reasonable structure for that permitted use."
(Conclusions ofLaw, Variance Decision for4916 Lakeview Avenue, September 2015)
• Without this variance we would not be able to build a house and
use the property for its permitted purpose.
• Approval of this variance will allow development that is consistent with
the development on abutting parcels and ensures stability and
compatible development as intended by the Zoning Code.
6/26/2026
3
Unique Property Limitations
7
• The unnecessary hardship is due to unique conditions created by
compliance with the WDNR flood storage regulations.
• This property lies within a WDNR designated Floodplain Storage area
• Limited lot size to work with.
• Public road goes thru the north side of the property which restricts
buildable area
• Setback requirement for the 1ft over the floodplain creates the
need for additional filling.
No Harm to Public Interest
8
• "Issuance of a variance in this instance would not be contrary to the public
interest by creating or having the potential for creating an adverse impact on
the public health, safety, or welfare of adjoining and surrounding residents,
properties or the community. This merely allows for the construction of a
residence that is compatible with surrounding development patterns. Just as
the residences on the abutting lots create no adverse impact, a residence on
this lot also creates no adverse impact."
(Conclusions ofLaw, Variance Decision for4916 Lakeview Avenue, September 2015)
• Summary analysis shows that proposed filling does not cause an increase in
the flood plain elevation upstream or downstream of the property.
• Approval of this variance would allow the creation of a building pad and
single-family home that meets FEMA and Wisconsin DNR flooi::I storage
codes.
• This variance does not conflict with uses on adjacent properties or in the
neighborhood[ does not result in harm to public interests, and does not
require multip e or extreme variances.

A Country Way of Life!
Having considered the information submitted by the application. observations made at the subject property, the
Staff report prepared by the Village Planning and Zoning Administrator. and comments made at the public
hearing by the applicant and those members of the publ ic in attendance, the Board of Zoning Appeals makes the
following findings:
I) Sally S Coyle Trust (hereinafter "applicant") owns the property at 49 16 Lakeview Avenue (Tax Key:
VI0-056200A) in the Village of Richfield (hereinafter "suqject property").
2) The subject property is located on tht: south side of Friess Lake and is zoned f- 1, Flood land District.
3) There is currently a single-family residence on the subject property which does not comply with current
floodplain regulations.
4) The subject property is considered a lot of record in that it was created prior to the adoption of the
relevant regulations. There are newer single-family residences on the lake.
5) The Board of Zoning Appeals conducted a public hearing, which was duly noticed in the West Bend
Daily News with a Class II Public Notice. Prope1ties within 300 feet of the subject property were also
notified via first-class mail.
6) The Board of Zoning Appeals viewed the subject property on September 23.2015 as part of its
proceedings.
7) Mr. Don Thoma. Ms. Ann Coyle, and Jim Healy, Village Administrator, were all sworn-in by the
Chairman and provided oral testimony.
8) Mr. Jim Healy, Administrator, provided factual background information about the property as well as
read po1tions of the staff communication form which was distributed to the members of the Board of
Zoning Appeals.
9) Ms. Ann Coyle. representing the applicant, presented their request to the Board along with Mr. Don
Thoma, agent and surveyor. Mr. Thoma in particular addressed stormwater management issues related
to the project.
B. Requested Variance
The applicant requested to put in less than the required 15 feet of fi II around the perimeter of the house.

C. Conclusions of Law2
The Board of Zoning Appeals makes the following conclusions of law:
I) The Board finds that literal enforcement of the terms of the zoning code would result in practical
difficulty or unnecessary hardship, by unreasonably preventing the owner from using the property for a
permitted purpose or rendering conformity with such restrictions unreasonably burdensome. This lot of
record is zoned for single family residential uses, and the prnperty owner seeks approval to build a
reasonable structure for that permitted use. Compliance with the literal code requirements of the zoning
code would result in a long narrow house, which is substantially disproportionate to the home
construction standards in the immediate area. The purpose of having fi II around the perimeter of a house
is to provide an additional layer of protection from floodwaters. Given the size of the property, the
requested variance does not violate the intent of the Code. Allowing development that is consistent with
the development on abutting parcels ensures stability and compatible development, as intended by the
Zoning Code, and denying the ability to do so would therefore be unreasonably burdensome.
2) The unnecessary hardship is clue to unique or special conditions or limitations affecting the subject
property and/or structure that are not typical or generally shared by other surrounding properties. The
subject property is about 6,535 square feet in area, a relatively small lot in the area.
3) Issuance of a variance in this instance would not be contrary to the public interest by creating or having
the potential for creating an adverse impact on the public health, safety, or welfare of adjoining and
smrounding residents, properties or the community. This merely allows for the construction of a
residence that is compatible with surrounding development patterns. Just as the residences on the
