Village of Richfield 4128 Hubertus Road Joint Plan Commission& Village Board Meeting Minutes April 2, 2026 17:00 PM VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICATION FORM MEETING DATE: May 7, 2026 SUBJECT: Accessory Structure - Special Exception located at 668 Esker Ct (Tax Key: Vl0 _1214006)-Todd & Lois Zangl, Petitioners/ Zangl Joint Rev Trust, Owner DATE SUBMITTED: May 1, 2026 SUBMITTED BY: Brad Calder, Administrative Services Coordinator POLICY QUESTIONS: DOES THE PLAN COivfMISSION WISH TO APPROVE THE SPECIAL EXCEPTION FOR THE PLACEMENT OF A PROPOSED ACCESSORY STRUCTURE IN FRONT OF A SINGLE-FAMILY HOME? ISSUE SUMMARY: Pursuant to § 170.874 of the Village Code, entitled "Placement of Detached Accessory Buildings on a Lot", the Plan Commission is allowed discretion in considering the placement of accessory buildings in places other than the side or rear of properties. The logic and reasoning behind making such a policy decision was that it was recognized by Staff, the Plan Commission, and the Village Board that there were instances where it would make sense to provide flexibility to property owners that might not otherwise be available even through the variance process. In the situation before us tonight, Todd and Lois Zangl are acting as petitioner for the placement of a 896 sqft detached accessory structure in the front yard as defined in our Village Code. In this case, per the Richfield Municipal Code's definitions most of the yard is considered the "front yard". The only permi ssible area that a detached structure would be possible to be located in is outlined in green in the picture (shown below). The topography of the "rear yard" makes it virtually impossible to construct any functional accessory buildings on the lot, without receiving a Special Exception. As such, the applicants are requesting the Plan Commission consider a Special Exce tion for their ro ert . The Section of the Code previously referenced states the following: SUBJECT: DATE SUBMITTED: SUBMITTED BY: VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICA TION FORM MEETING DATE: May 7, 2026 Accessory Structure - Special Exception located at 668 Esker Ct (Tax Key: Vl0_1214006) - Todd & Lois Zangl, Petitioners/ Zangl Joint Rev Trust, Owner May 1, 2026 Brad Calder, Administrative Services Coordinator 170.874 Placement of detached accessory buildings on a lot Except as may be permitted in this section, a detached accessory building must be located behind the front face (i.e., face of the building closest to the street) of the principal building (Exhibit 6-3). In the case of a corner lot, the detached accessory building shall meet the minimum setback requirements from all streets. Only accesso,y buildings for agricultural uses are permitted in front of the principal building. Pursuan t to the procedures and requirements in Article 5, the Plan Commission may approve a special exception to allow an accessorv building in front ofthe principal building. In making such decision, the Plan Commission must consider (IJ the size o(the subject property, (2)1 the character o(the area, CJ), the size ofthe proposed accessorv building, (4) the extent to which the proposed accessory building is visible from public and private streets and other properties in the area, (5)1 the practical difficulty in placing the proposed accessorv building in the location described in this subsection, and (6) other factors related to relevant circumstances. The subject property is zoned RS-2, Single-Family Residential District. l )j The size of this property is 3 .65 acres and is located in the St. Augustine Estates Subdivision which is located on the southwest comer of the Village south of Elmwood Road and north of Monches Road and just east of St. Augustine Road. @ In term s of the character of the area, this property is located in the St. Augustine Estate Subdivision. The subject property and the neighboring properties to the east are heavily wooded (environmental co1Tidor) in the rear yard with a mix oflaw n and planted trees and landscaping in the front yards . The Neighboring parce ls to the west consist of maintained lawn with landscaping. the view of the homes from the street. The subject property has a row of evergreen trees that lines the frontage of Esker Ct when provides privacy and obscures much of the property from Esker Ct. The neighboring property to the n01ih is much more open but their view of the subject property is obscured by trees. The subject property does differ from the neighboring properties as the home is setback much further back from the road on the rear third of the parcel. The lot is similarly sized to the neighboring RS-2 lots. In the application materials there are photos of the property looking north-northwest from Esker Ct. (3\ Given the size of the property, the petitioner i s allowed to build a 1,470 sqft. garage. The proposed garage is 32'x28' for a total of 896 sqft. within the limit of what is legally permissible and is under the standard by 574 sqft. (4) In tem1s of visibility from the roadways and residences, I've included photos of the property , from the road (Esker Lane). The proposed location is setback about halfway into the parcel in front of the home on the eastern side of the parcel. This location was chosen in working with the neighbor to the east as it will have no impact on the neighbor 's view of Holy Hill. The proposed location exceeds all of the required setback s. See the proposed site in the Application materials. The proposed garage calls for "lap siding to match the house color", the current single family home on the site pictured below has a tan brick exterior. Staff believes the proposed exterior materials for the garage will satisfy the exterior materia ls requirement of "The exterior building material s must be the same as, or substantia lly the same as, the principal building on the property." in the Village Code. VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICA TION FORM MEETING DATE: May 7, 2026 SUBJECT: Accessory Structure - Special Exception located at 668 Esker Ct (Tax Key: Vl0 _ 1214006) - Todd & Lois Zangl, Petitioners/ Zangl Joint Rev Trust, Owner DATE SUBMITTED: May 1, 2026 SUBMITTED BY: Brad Calder, Administrative Service s Coordinator Exterior 5) 1 There is "practical difficulty" in placing the garage elsewhere that would conform with the Village Code. This "practical difficulty" in placing it behind the home is that there is no practical location to place the proposed garage without significant site work to create a building pad and access due to the topography. 6 In the opinion of Staff, these types of reasons are exactly why the Plan Commission and Village Board chose to adopt this provision in the Code. This petition would not be successful in receiving a variance. FUTURE I!v!PACT AND ANALYSIS: Forward to Village Board: No Additiona l Approvals Needed: No Signatures Required: No ATTACH 1\t!ENTS 1. The applicant signs the decision document accepting these and any other conditions the Plan Commission finds prudent and necessary. General Conditions of Approval: 1. I have enclosed a survey and the location where we would like to build our garage. I have also included the copy of the building permit request and build ing information. In addition to the fact that building to the side or back of our house would impede the view of Holy Hill by our neighbor, also note on the survey I provided that we are not allowed to build below a line to the north of our house. While I am unsure of the specific reason for that restriction, I would guess it may be due to the fact that it is on the hill heading north into the kettle. Thank you fo;your time and consideration in this matter. ~ u Todd a",;:J Lois Zangl March 3, 2026 Exception Request for New Garage Proposal for Todd and Lois Zangl 668 Esker Court Colgate, WI 53017 262-366-7868 tezangl@wi.rr.com RECEIVED MAR 3 U 2026 Request for exception VIU.P.GE U~ f~iCHFIELO The proposed builcjing site would be closer to the road than the front of the house. Our house was built just short of the ridge leading down into the kettle. ISSUE SUMM AR Y: In March of this year, the Plan Commission considered and approved the Plan of Operation, Site Plan, Grading and Erosion Control Plans for the proposed expansion of Richfield Service located at 1810 Wolf Road (TNK V10_034400G). The only remaining elements of the approvals process the Plan Commission must still consider are the Lighting and the Landscaping Plan. Lighting Plan The lighting plan is a resubmittal because the previous plan did not consider the entire property and only showed the light dispersion on the proposed addition. That has now since been corrected. Lighting for this property is controlled by Section 234-2 entitled "Applicability". It states, in part, the following: "All proposed ... building additions of 25% or more in terms of gross floor area, seating capacity, or other units of measurement specified herein ... shall meet the requirements of this chapter for the entire property . For all building additions less than 25%, the applicant shall only meet the requirements of this Chapter for any new outdoor lighting provided. " Building Coverage Maximum 60% (53,317sqft) Existing- l 3,863sqft Proposed - 5,839sqft Total- aprox.19,702sqft The proposed addition is greater than 25% of the gross floor area of the existing buildin g as shown above on the table. As a result, we need to see a Lighting Plan applied over the entire property, as the petitioner has now done. The proposed additional lighting to this building are six (6) full cut-off and fully shielded 'wall pack' light s. Each 'wall pack' light has a lumen output (per lamp and there is only lx in this instance) of 6,030 on these less than 40-watt bulbs (36.7-watt). The total amount of lumens for the addition equates to 36,180 leaving a balance of 163,820 "available lumens" for the 2-acre site. VILLAGE OF RICHFIELD PLAN COMMISS ION COMMUNICATION FORM MEETING DATE: May 7, 2026 SUBJECT: Lighting and Landscaping Plan for Richfield Service located at 1810 Wolf Road (TKN: V10_034400K and for prope1ty identified by TKN: V10_034400G - Richfield Service Sales, LLC, Petitioner DATE SUBMITTED: April 29, 2026 SUBMITTED BY: Brad Calder, Administrative Services Coordinator Because this prope1iy is east of STH 175, this prope1iy is in Zone 1. Pursuant to Section 234-7(D) , the Plan Commission with a full prope1iy Lighting Plan does not equal greater than 200,000 lumens for the property . The Subject Property does not have any parking lot lights on the northside of the building. The existing building itself has five (5) "wall pack" lights. There are no area lights, lighting for the signage, etc. elsewhere on the prope1iy. To exceed the lighting threshold with just these 'wall packs' on the property, there would need to be 33 more of them (assuming 6,030 lumens) or each of the existing five (5) would need to be in excess of 32,764 lumens which would be more of an ' area light ' not a downward facing "wall pack". The proposed Lighting Plan complies with Section 234-7(0)(2) , because there are no instances where the output from the lum ens equate s to 0.2 footcandle s or greater. The maximum allowance shown is 0.1, which is permissible. Village Staff s recommendation is for approval. Landscaping Plan • D § 170.1603 Landscap ing requir ed. A. Generally. Landscaping is required for on-lot landscaping, street bufferyards, peripheral bufferyards, and in off-street parking areas and in areas where vegetative mitigation is required. The area and/or length of each, as required herein must be measured in order to determine the amount of landscaping required. B. Addition s to buildings which increase overall building area up to 50%. Additions to buildings which increase their overall building area up to 50% shall conform to the landscaping standards set forth in this division reduced by 25%. The existing build ing contains 12,050 square feet, and the proposed addition consists of 6,630 square feet. Pursuant to Section 170.1603, becau se the proposed building addition exceeds 50% of the size of the existing structure (approximately 55%), the project does not qualify for the 25% reduc tion in required landscaping standard s. As a result, the applicab le landscaping requirement s must be calculated at the full standard rate. Additionally, the required landscaping improvements are driven by the proposed increase in parking. The petitioner has been approved for twenty-seven (27) additional parking stalls, and the correspond ing landscaping requirements are based upon that expansion. The table below outlines the applicable standards for the subject property. The petitioner is proposing landscaping that exceeds several of the minimum ordinance requirements. For shrubs, a total of twenty-seven (27) are required, while the submitted Landscape Plan identifies thirty-two (32) Spirea shrubs. For decorative trees , only three (3) are required, yet the petitioner is proposing four ( 4). Based on discussions with the petitioner's agent , the selected species include two (2) American Linden (Tilia) and two (2) Comelian Cherry Dogwoods (Camus mas). The proposed 1.5-inch caliper size is also consistent with Village standards. ~ VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICATION FORM MEETING DATE: May 7, 2026 SUBJECT: Lighting and Landscaping Plan for Richfield Service located at 1810 Wolf Road (TKN: Vl0 _034400K and for property identified by TKN: Vl0_034400G - Richfield Service Sales, LLC. In the situation before us tonight, Mr. And Mrs. Chance are acting as petitioner for the placement of a 1,026 detached accessory structure in the front yard as defined in our Village Code, to replace the current barn/shed. In this case , per the Richfield Municipal Code 's definitions most of the yard is cons idered the "front yard". The only permissib le area that a detached structure would be possible to be located in is outlined in green in the picture (shown below). The topography of the "rear yard" makes it virtually in1possible to construct any functional accessory buildings on the lot, without receiving a Special Exception. As such, the applicants are requesting the Plan Commission consider a Special Excep tion for their pro ert . VlLLAGE OF RICHFIELD PLAN COMM ISSION COMMUNICATION FORM MEETING DATE: May 7, 2026 SUBJECT: Accessory Structure - Special Exception located at 3207 State Hwy 167 (Tax Key: V l 0 _ 035600F) - James & Suzette Chance, Petitioners/Owner DATE SUBM ITTED: May 1, 2026 SUBM ITTED BY: Brad Calder, Administrative Services Coordinator The Section of the Code previously referenced states the following: 170.874 Placement of detached accessory buildings on a lot Except as may be permitted in this section, a detached accessory building must be located behind the front face (i.e.Jace of the building closest to the street) of the principal building (Exhibit 6-3). In the case of a corner lot, the detached accessory building shall meet the minimum setback requirements from all streets. Only accessory buildings for agricultural uses are permitted in.front of the principal building. Pursuant to the procedures and requirements in Article 5, the Plan Commission mav approve a special exception to allow an accessorv building in front of the principal building. In making such decision. the Plan Commission must consider (I) the size of the subiect property, (2h the character o{the area. (3) the size o{the proposed accessorv building. (4) the e.,,tent to which the proposed accessorv building is visible from public and private streets and other properties in the area, (51 the practical difficulty in placing the proposed accessorv building in the location described in this subsection. and (6) other factors related to relevant circumstances. The subject property is zoned RS-1 , Country Estate District. (_I The size of this property is 6.1 acres and is located just east of Kettle Hills Golf Course on the south side of State Hwy 175 west of Ball Drive. Mr. and Mrs. Chancce also own a small 0. 13 acre parcel along State Hwy 167. Their driveway access actually crosses this parcel. Staff is recommending that Mr. and Mrs. Chance have a Certified Survey Map (CSM) to combine the two lots, it will also address the potentia l gap in the legal description as noted on Washington County GIS . (2J In tem1s of the character of the area, the subjec t property and the neighboring properties to the east are heavily wooded (non-enviro nmental corridor) in the rear yard, with a mix of maintained lawn or hay fields in the front yards. The Neighboring parcel to the west is Kettle Hills Golf Course. The subject property has a row of evergreen trees that line the frontage of State Hwy 167 providing privacy and obscures much of the property from State Hwy 167. The neighboring property to the north is much more open but their view of the subject property is obscured by trees. View of the Property State Hwy 167 SUBJECT: DATE SUBMITTED: SUBMITTED BY: VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICATION FORM MEETING DATE: May 7, 2026 Accessory Structure - Special Exception located at 3207 State Hwy 167 (Tax Key: VI0 _035600F) - James & Suzette Chance, Petitioners/Owner May 1, 2026 Brad Calder, Administrative Services Coordina tor Q) Given the size of the property, the petitioner is allowed to build a 2,657 sqft. garage. The proposed garage is 32'x28 ' for a total of 1,026 sqft. within the limit of what is legally permi ssible and is under the standard by 1,63 I sqft. (4) In terms of visibility from the roadways and residences, I've included photos of the property, from the road (Esker Lane). The proposed location is setback about halfway into the parcel in front of the home on the eastern side of the parcel. This location was chosen in working with the neighbor to the east as it will have no impact on the neighbors view of Holy Hill. The propo sed location exceeds all of the required setbacks. See the proposed site in the Application materials. The proposed garage calls for a masonry and stucco exterior, the current single family home on the site pictured below has masonry stone and traditional side exterior. Staff believes the proposed exterior materials for the garage will satisfy the exterior materials requirement of "The exterior building materials must be the same as, or substantia lly the same as, the principal building on the prope1ty." in the Village Code. Exterior (5) There is "practical difficult y" in placing the garage elsewhere that would confonn with the Village Code. This " practical difficulty " in placing it behind the home is that there is no practical location to place the proposed garage w ithout significant site work to create a building pad and acces s due to the topograph y. 6 In the opinion of Staff, these types of reasons are exactly why the Plan Commission and Village Board chose to adopt this provision in the Code. Thi s petition would not be successful in receiving a variance. "? ISS UE SUMMARY: The petitioner is applying for a Temporary Use Permit to operate her coffee trailer in the parking lot of 3210 State Highway 167, the business address of Terrace 167. The use is classified under "Seasonal product sales" in our Municipa l Code and, whi le permitted in the B-2 Community Business Disttict , it requires a Temporary Use pennit. In early 2023, the Plan Commission decided that temporary uses intended for operation past 30 days needed Plan Commission approval. Previously, unless predicted to be particularly disruptive, temporary uses were all approved administratively. In the picture no the following page, the petitioner has illustrated how the site will be set up with her coffee trailer and accompanying picnic tables. The proposed hours of operation are Monday through Friday , 7:00-12:00PM. They will not operate on the weekend from this location and will likely pull the trailer off-site for weekend sales as they indicated in their submission materials. The applicant hopes to begin operation mid-May , weather pem1itting; the 150-day pennit wou ld then expire mid-October. There will be one to two (1-2) employees in the trailer per shift. There will only be wa lk-up service and no drive thru option. The petitioner 's trailer and operation plan has been previously approved by the Washington County Health Department and continued compliance will need to be demonstrated. Further details of their proposal are located in the Attachments. Last year was the third year of operation for this coffee trailer in the community and the second year the coffee trailer business was located at the Terrac e 167. There were no reported incidents or issues that Village Staff were made aware of with the previous owner and all things considered , this appears to be desired to be operated in the same manner. Richfield Plan Commission Meeting Request for permit to operate more than 30 days to less than 150 days My name is John Lorenz. My wife Becky and our business partners, Mike and Amy Shimon, are excited to enter into year 3 of our coffee trailer business! We would like to than k the planning commission, Village Board and Administrator Healy for your support. THE PLAN for 2025: Cinnamon and Honey Coffee Co trailer to be parked at Terrace 167, in the prepped area, off the south side of the parking lot. Days of operation are Tuesday- Friday. Operating hours fall between 7am-lpm. We are closed weekends at Terrace 167 (unless asked to be apart of a special event). Quite often we pull the trai ler to off premise events on the weekends. During the off season the trailer is pulled off property and stored. We are not a "drive thru" operation. Customers park, come to the t railer window to order and pick up. A seating area is provided to relax and enjoy their purchase if they like. A restroom facilit y is also available to our customers. Our menu offers a great number of coffee/non-coffee drink options, made w ith high quality ingredients, and a few baked goods. We are proud to provide the Village of Richfield a unique and friendl y atmosphere to feed their caffeinated and non-caffeinated needs. We have gained many loyal regulars, while each day still brings about many first-time rs. Some grab a little something on their way to work, while others make Cinnamon and Honey Coffee Company a destinatio n to meet up with friends and take in all Richfield and the surrounding area has to offer. Thank you so much for your time and support! John (262)894-3996 Cinnamon and Honey Coffee Company (CHCC) proposal/outline Hello Richfield Planning Commission. Below you will see an outlined look into the detai ls of our coffee trai ler operation. We are coming to you, asking for a temporary use permit for a maximum of 150 days. Thank you! • CHCC is a coffee trailer. During the seasonal months of operation, the trailer will be parked at Terrace 167 much of the time day and night . • CHCC will be open at Terrace 167 Tuesday - Friday • Exceptions • Needing to be parked in a heated location during colder portions of a day/stretch of days during seasonal operating months. • Acts of mother nature or serious unforeseen circumstances . • CHCC hours of operation at Terrace 167 wil l fall between 7am-lpm. • CHCC employees arrive prior to and stay after operating hours for set up/closing/cleaning. • CHCC does not have a drive through. Customers park and walk to the trailer to place/pick up order. • Seating area is provided to customers to relax and enjoy their purchase if they wou ld like. A restroom facility will be open to customers during hours of operation. • Potable water for our drinks is brought in from Terrace 167's wel l to fi ll our tanks. Then filtered through a water filtration system. This set up has been approved by the Washington County Health Department. • A ll solid waste created by CHCC is disposed of at an off-property location unless an agreement is made with Terrace 167 to use their waste receptacles. • The trailer is equipped to run on generators, but one of the many benefits of the Terrace 167 location is the access to needed electrical power. This rules out the need to use our generators whi le parked at Terrace 167. If generators were needed, they run at a decibel range in the 60's. Which is equivalent to normal conversation/background music. • Flowerpots and other landscaping wi ll be added to beautify the area. • Outdoor lighting on trailer will be on throughout the night for safety purposes. • Security cameras are used on the trailer. • Our team is very design focused and will continue to provide an experience that is classy and on brand to our vision. The Village can be assured that our location at Terrace 167 will be both inviting, very esthetically pleasing and well-kept throughout the season. • Professionally made 30" sign age is affixed to the trailer. Use of flags/banners (i.e. Coffee, Open) may be used. • To receive our needed operating permits from the state/county, CHCC has gone through a thorough health inspectio n and is subject to random inspections . • CHCC has a commerc ial general liabilit y insurance policy and has Terrace 167 as an additional insured on the policy. • Terrace 167, CHCC and The Village of Richfield will have open communication to continue to have CHCC something the Village can be proud of. The building addition complies with all other dimensional standards that may apply Staff Response: The building addition complies with all other dimensional standards that may apply and therefore complies with this standard. Pursuant to Section l 70. l 803(C)(3), in making its decision, the Plan Commission shall consider the following factors in addition to those factors listed in 170.443: 1. The size and location of the existing legal nonconforming building 2. The size and location of any other buildings on the subject property 3. The size and location of the proposed expansion 4. The necessity of constructing the addition within the setback 5. The proximity of buildings and other structures on adjoining properties 170.443 Basis of Decision A. The size of the property in comparison to other prope1ties in the area. Staff Response: The size of the parcel is 1.0-acre. The surrounding propertie s on North Shore Drive are also similarly sized on the northside of the road, with some parcels being a touch over 1.0-acres with as large as a 2.0-acre parcel immediately adjacent to it. On the southside of North Shore Drive, there are many homes that are on what would be considered 'typical lake lots ' for Bark Lake. B. The extent to which the issuance of the special exception would be in keeping with the overall intent of this chapte r; Staff Response: The Rs-3, Single Family Residential Distric t is one of the older residential zoning districts our Code has. It is intended for lots that are smaller than 65,000sqft (1.5-acres) and is limited to only those parcels which were this zoning designation when the Code was adopted. The intent was to create a Zoning District which allowed residential land uses " within older, established areas of the Village where such uses are located on lots or parcels of land which are within predominately residential areas, area smaller than 65,000sqft, and were lots of record on the date of the approval of this chapter. Additionally, this provision in the Code was made as a policy decision of the Plan Commission to allow it to consider these types of unique situations for redevelopment or expansion of existing commercial , industrial, or residential structures. C. Whether there are any unique circumstances and the nature of those circumstances that warrant the issuance of the special exception; Staff Response: This area of the Village of Richfield is one of the oldest inhabited parts of our community and was the epicenter of our community's earliest residentia l and commercial roots, so much so that Bark Lake was actually the home of our community's first ambulance service ran by Dick and Marilyn Becker, who also live on the same street as the VILLAGE OF RICHFIELD PLAN COMMISSION COMMUNICATION FORM MEETING DATE: May 7, 2026 SUBJECT: Special Exception for home expansion located at 3456 N.
