POLICY QUESTIONS: DOES THE PLAN COMN/ISS!ON WISH TO APPROVE THE SPEC/Al EXCEPTION FOR THE PLACEMENT OF A
PROPOSED ACCESSORY STRUCTURE IN FRONT OF A SINGLE- FAMILY HOME?
ISSUE SUMMARY:
Pursuant to § 170.874 of the Village Code, entitled "Placement of Detached Accessory Buildings on a Lot", the Plan
Commission is allowed discretion in considering the placement of accessory buildings in places other than the side or rear
of properties. The logic and reasoning behind making such a policy decision was that it was recognized by Staff, the Plan
Commission, and the Village Board that there were instances where it would make sense to provide flexibility to property
owners that might not otherwise be available even through the variance process. In the situation before us tonight, Todd
and Lois Zangl are acting as petitioner for the placement of a 896 sqft detached accessory structure in the front yard as
defined in our Village Code.
In this case, per the Richfield Municipal Code's definitions most of the yard is considered the "front yard". The only
permi ssible area that a detached structure would be possible to be located in is outlined in green in the picture (shown
below). The topography of the "rear yard" makes it virtually impossible to construct any functional accessory buildings on
the lot, without receiving a Special Exception. As such, the applicants are requesting the Plan Commission consider a
Special Exce tion for their ro ert .
The Section of the Code previously referenced states the following:

0 There is "practical difficulty" in placing the garage elsewhere that would conform with the Village Code. This
"practical difficulty " in placing it behind the home is that there is no practical location to place the proposed garage
without significant site work to create a building pad and access due to the topography.
(§) In the opinion of Staff, these types of reasons are exactly why the Plan Commission and Village Board chose to adopt
this provision in the Code. This petition would not be successful in receiving a variance .

VILLAGE OF RICHFIELD
PLAN COMMISSION COMMUNICATION FORM
MEETING DATE: May 7, 2026
SUBJECT: Lighting and Landscaping Plan for Richfield Service located at 1810 Wolf Road (TKN:
Vl0_034400K and for property identified by TKN: V10_034400G - Richfield Service
Sales, LLC, Petitioner
DATE SUBMITTED: April 29, 2026
SUBMITTED BY: Brad Calder, Administrative Services Coordinator
POL!CY QUESTIONS: DOES THE PLA N COMMISSION WISH TO APPROVE THE PROPOSED LIGHTING AND L ANDSCAPING
PLAN FOR RICHFIELD SERVICE?
ISSUE SUMMARY:
In March of this year, the Plan Co1mni ssion
considered and approved the Plan of Operation ,
Site Plan, Grading and Erosion Control Plans for
the proposed expansion of Richfield Service
located at 1810 Wolf Road (TNK
V10_034400G). The only remaining elements of
the approvals process the Plan Commiss ion must
still consider are the Lighting and the
Landscaping Plan.
Lighting Plan
The lighting plan is a resubmittal because the
previous plan did not consider the entire property
and only show ed the light dispersion on the
proposed addition. That has now since been
corrected. Lighting for this property is controlled
by Section 234-2 entitled "Applicability ". It
states, in part, the following:
"All proposed ... building additions of 25% or more in terms of gross floor area, seating capacity, or other
units of measurement specified herein ... shall meet the requirements of this chapter for the entire property. For
all building additions less than 25%, the applicant shall only meet the requirements of this Chapter for any new
outdoor lighting provided. "
Building Coverage Maximum 60% (53,3 l 7sqft) Existing- 13,863sqft
Prop osed - 5,839sqft
Total - aprox.19 , 702sqft
The proposed addition is greater than 25% of the gross floor area of the existing building as shown above on
the table. As a result, we need to see a Lighting Plan applied over the entire property, as the petitioner has now
done . The proposed additional lighting to this building are six (6) full cut-off and fully shielded 'wall pack'
lights. Each 'wall pack' light has a lumen output (per lamp and there is only 1 x in this instance) of 6,030 on
thes e less than 40-watt bulbs (36. 7-watt). The total amount oflumens for the addition equates to 36,180 leaving
a balance of 163,820 "available lumens" for the 2-acre site.

PLAN COMMISSION COMMUNICATION FORM
MEETING DATE: May 7, 2026
SUBJECT: Lighting and Landscaping Plan for Richfield Service located at 1810 Wolf Road (TKN:
V10_034400K and for property identified by TKN: VI0_034400G-Richfield Service
Sales, LLC, Petitioner
DATE SUBMITTED: April 29, 2026
SUBMITTED BY: Brad Calder, Administrative Services Coordinator
Because this property is east of STH 175, this property is in Zone 1. Pursuant to Section 234-7(D), the Plan
Commission with a full property Lighting Plan does not equal greater than 200,000 lumens for the property.
The Subject Property does not have any parking lot lights on the northside of the building. The existing
building itself has five (5) "wall pack" lights. There are no area lights, lighting for the signage, etc. elsewhere
on the property. To exceed the lighting threshold with just these 'wall packs' on the property, there would need
to be 33 more of them (assuming 6,030 lumens) or each of the existing five (5) would need to be in excess of
32,764 lumens which would be more of an 'area light' not a downward facing "wall pack". The proposed
Lighting Plan complies with Section 234-7(0)(2), because there are no instances where the output from the
lumens equates to 0.2 footcandles or greater. The maximum allowance shown is 0.1, which is permissible.
Village Staffs recommendation is for approval.
Landscaping Plan
► 0 § 170.1603 Landscaping required.
A. Generally. Landscaping is required for on-lot landscaping, street bufferyards, peripheral bufferyards,
and in off-street parking areas and in areas where vegetative mitigation is required. The area and/or
length of each, as required herein must be measured in order to determine the amount of
landscaping required.
B. Additions to buildings which increase overall building area up to 50%. Additions to buildings which
increase their overall building area up to 50% shall conform to the landscaping standards set forth
in this divisfon reduced by 25%.
The existing building
contains 12,050 square feet,
and the proposed addition
consists of 6,630 square feet.
Pursuant to Section 170.1603,
because the proposed building
addition exceeds 50% of the
size of the existing structure (approximately 55%), the project does not qualify for the 25% reduction in
required landscaping standards. As a result, the applicable landscaping requirements must be calculated at
the-full-starrdard-rate; - - --- -- - -- - - ---- - --- - ----- --- -- ---
Additionally, the required landscaping improvements are driven by the proposed increase in parking. The
petitioner has been approved for twenty-seven (27) additional parking stalls, and the corresponding
landscaping requirements are based upon that expansion. The table below outlines the applicable standards
for the subject property.
The petitioner is proposing landscaping that exceeds several of the minimum ordinance requirements. For
shrubs, a total of twenty-seven (27) are required, while the submitted Landscape Plan identifies thirty-two
(32) Spirea shrubs. For decorative trees, only three (3) are required, yet the petitioner is proposing four ( 4).
Based on discussions with the petitioner's agent, the selected species include two (2) American Linden
(Tilia) and two (2) Comelian Cherry Dogwoods ( Cornus mas). The proposed 1.5-inch caliper size is also
consistent with Village standards.

Finally, the petitioner has proposed eleven (11) Sugar Maple trees with a caliper size of2.5 inches. Based

VILLAGE OF RICHFIELD
PLAN COMMISSION COMMUNICATION FORM
MEETING DATE: May 7, 2026
SUBJECT: Accessory Structure - Special Exception located at 3207 State Hwy 167 (Tax Key:
V 10 _ 035600F) - James & Suzette Chance, Petitioners/Owner
DATE SUBM ITTED: May 1, 2026
SUBMITTED BY: Brad Calder, Administrative Services Coordinator
POLICY QUESTIONS: DOES THE PLAN COMMISSION WISH TO APPROVE THE SPECIAL EXCEPTION FOR THE PLACEMENT OF A
PROPOSED ACCESSORY STRUCTURE IN FRONT OF A SINGLE-FAMILY HOME?
ISSUE SUMMARY:
Pursuant to § 170.874 of the Village Code, entitled "Placement of Detached Accessory Buildings on a Lot", the Plan
Commiss ion is allowed discretion in considering the placement of accessory buildings in places other than the side or rear
of properties . The logic and reasoning behind making such a policy decision was that it was recogniz ed by Staff, the Plan
Commission, and the Village Board that there were instances where it would make sense to provide flexibility to property
owners that might not otherwise be available even through the variance process. In the situation before us tonight, Mr. And
Mrs. Chance are acting as petitioner for the placement of a 1 ,026 detached accessory structur e in the front yard as defined
in our Village Code, to replace the current barn/shed.
In this case, per the Richfield Municipal Code's definitions most of the yard is considered the "front yard". The only
permissible area that a detached structure would be possible to be located in is outlined in green in the picture (shown
below). The topography of the "rear yard" makes it virtually impossible to construct any functiona l accessory buildings on
the lot, without receiving a Special Exception. As such, the applicants are requesting the Plan Commission consider a
Special Exception for their pro ert .

SUBJECT: Accessory Structure - Special Exception located at 3207 State Hwy 167 (Tax Key:

The Section of the Code previously referenced states the following:
170.874 Placement of detached accessorv buildings on a lot
Except as may be permitted in this section, a detached accessory building must be located behind the front face (i.e., face
of the building closest to the street) of the principal building (Exhibit 6-3). In the case of a corner lot, the detached
accessory building shall meet the minimum setback requirements from all streets. Only accessory buildings for
agricultural uses are permitted in front of the principal building. Pursuant to the procedures and requirements in Article
5, the Plan Commission may approve a special exception to allow an accessory building in front ofthe principal
building. In making such decision, the Plan Commission must consider (I) the size o(the subiect property, (2) the
character of the area, (3) the size o[the proposed accessorv building. (4) the extent to which the proposed accessorv
building is visible from public and private streets and other properties in the area, (5) the practical difficultv in placing
the proposed accessorv building in the location described in this subsection, and (6) other factors related to relevant
circumstances.
The subject property is zoned RS- I, Country Estate District.
( t) The size of this property is 6.1 acres and is located just east of Kettle Hills Golf Course on the south side of State Hwy
175 west of Ball Drive. Mr. and Mrs. Chancce also own a small 0.13 acre parcel along State Hwy 167. Their driveway
access actually crosses this parcel. Staff is recommending that Mr. and Mrs. Chance have a Certified Survey Map (CSM)
to combine the two lots, it will also address the potential gap in the legal description as noted on Washington County
GIS.
2) In terms of the character of the area, the subject property and the neighboring properties to the east are heavily
wooded (non-environmental corridor) in the rear yard, with a mix of maintained lawn or hay fields in the front yards. The
Neighboring parcel to the west is Kettle Hills Golf Course. The subject property has a row of evergreen trees that line the
frontage of State Hwy 167 providing privacy and obscures much of the property from State Hwy 167. The neighboring
property to the north is much more open but their view of the subject propetiy is obscured by trees.

SUBJECT: Accessory Structure - Special Exception located at 3207 State Hwy 167 ( Tax Key:
V10_035600F) - James & Suzette Chance, Petitioners/Owner
DATE SUBMITTED: May I, 2026
SUBMITTED BY: Brad Calder, Administrative Services Coordinator
3) Given the size of the property, the petitioner is allowed to build a 2,657 sqft. garage. The proposed garage is 32'x28'
for a total of 1,026 sqft. within the limit of what is legally pennissible and is under the standard by 1,631 sqft.
(4) In tenns of visibilit y from the roadways and residences, I've included photos of the property, from the road (Esker
Lane). The proposed location is setback about halfwa y into the parcel in front of the home on the eastern side of the
parcel. This location was chosen in work ing with the neighbor to the east as it will have no impact on the neighbors view
of Holy Hill. The proposed location exceeds all of the required setbacks. See the proposed site in the Application
materials. The proposed garage calls for a masonry and stucco exterior, the cun-ent single family home on the site
pictured below has masonry stone and traditional side exterior. Staff believes the proposed exterior materials for the
garage will satisfy the exterior materials requirement of"The exterior building materials must be the same as, or
substantially the same as, the principal building on the property." in the Village Code.
Exterior
(5) There is " practica l difficulty " in placing the garage elsewhere that would conform with the Village Code. This
" practical difficulty " in placing it behind the home is that there is no practical location to place the proposed garage
without significant site work to create a building pad and access due to the topography.
6 In the opinion of Staff, these types of reasons are exactly why the Plan Commission and Village Board chose to adopt
this provision in the Code. This petition would not be successful in receiving a variance.

PLAN COMMISSION COMMUNICATION FORM
MEETING DATE: May 7, 2026
Temporary Use for "Len's Coffee Co." - More than 30 Days but Less than 150 Days,
located at 3208 State Highway 167 (TKN: Vl 0 _ 027600E) - Leah Nagel, Petitioner
April 29, 2026
Brad Calder, Administrative Services Coordinator
POLICY QUESTIONS: DOES THE PLAN COMMISSION WISH TO APPROVE THE TEMPORARY USE PERMIT APPLICATION FOR "LEN'S
COFFEE CO. "?
ISSUE SUMMARY:
The petitioner is applying for a Temporary Use Permit to operate her coffee trailer in the parking lot of 3210 State Highway
167, the business address of Terrace 167. The use is classified under "Seasonal product sales" in our Municipal Code and,
while permitted in the B-2 Community Business District, it requires a Temporary Use permit. In early 2023, the Plan
Commission decided that temporary uses intended for operation past 30 days needed Plan Commission approval.
Previously, unless predicted to be particularly disruptive, temporary uses were all approved administratively.
In the picture no the following page, the petitioner has illustrated how the site will be set up with her coffee trailer and
accompanying picnic tables. The proposed hours of operation are Monday through Friday, 7:00-12:00PM. They will
not operate on the weekend from this location and will likely pull the trailer off-site for weekend sales as they indicated
in their submission materials. The applicant hopes to begin operation mid-May, weather permitting; the 150-daypermit
would then expire mid-October. There will be one to two (1-2) employees in the trailer per shift. There will only be
walk-up service and no drive thru option. The petitioner's trailer and operation plan has been previously approved by
the Washington County Health Department and continued compliance will need to be demonstrated. Further details of
their proposal are located in the Attachments.
Last year was the third year of operation for this coffee trailer in the community and the second year the coffee
trailer business was located at the Terrace 167. There were no reported incidents or issues that Village Staff were
made aware of with the previous owner and all things considered, this appears to be desired to be operated in the
same manner.

Request for Seasonal Operation Permit (30-150 Days)
Dear Members of the Plan Commission,
My name is Leah Nagel, owner of Len's Coffee Co. I recently purchased the existing coffee
trailer business from Cinnamon and Honey Coffee Co. and look forward to continuing service
within the Village of Richfield.
As part of this transition, I will maintain the same operational structure that has previously been
approved and successfully implemented, ensuring continuity for both the Village and the
community.
Operational Plan for 2026:
The trailer will remain stationed at Terrace 167 in the designated, pre-approved parking area.
Hours of operation will be Monday through Friday, 7:00 AM to 12:00 PM. The trailer will not
operate on weekends at this location unless participating in approved special events. Weekend
operations may occur off-site. During the off-season, the trailer will be removed and stored off
site.
This is not a drive-through operation. Customers park and walk up to the service window. A
seating area and restroom facilities are available on-site.
The menu will include a variety of high-quality coffee and non-coffee beverages, along with a
limited selection of baked goods, with a focus on providing a welcoming, community-oriented
experienee-. ------ ------ ---------
I am committed to maintaining the same standards of quality, cleanliness, and professionalism
established by the previous owners while ensuring a smooth transition. This request reflects a
continuation of an already approved operation, with no changes to layout, traffic flow, or
overall impact.
Thank you for your time and consideration.
Sincerely,
Leah Nagel

SUBMITTED BY: Jim Healy, Village Administrator
POLICY QUESTION: DOES THE PLAN COMMISSION WISH TO GRANT A SPECIAL EXCEPTION TO ALLOW FOR THE SINGLE-FAMILY
HOME EXPANSION FOR PROPERTY LOCATED AT 3456 N. SHORE DRIVE?
ISSUE SUMMARY:
Pnrsuant to Section 170.1803 entitled "Nonconforming Buildings" a legal nonconforming building may be used for any
conforming use. A nonconforming building that is used for a conforming use may be enlarged, provided that the building
addition complies with all requirements and the Plan Commission and Village Board authorize such an enlargement
pursuant to the requirements in Article 5.
Pursuant to the procedures and requirements of Article 5, the Plan Commission may approve a special exception to
authorize the construction of a building addition within a building setback area provided that:
1. The existing building was legally established
Staff Response: This is a single-family residential home which is on a residential block with other similarly situated single
family residential homes.
2. The use of the building is legal conforming
Staff Response: The use of the building for a 'Single-Family' dwelling is permitted in the Rs-3, Single Family Residential
District and therefore complies with this standard.

5. The building addition is in complianc e with the height limitations of the zoning district in which it is located,
and is not greater in height than the contiguous portion of the existing building
Staff Response: The building addition is in compl iance with the height limitations of the zoning district in which i t is
located, Rs-3, Single Family Residential Distri ct. The maximum height of buildings in this District which have a lot width
between 100' to 150' is 35' and therefore comp lies with this standard.
6. The building addition does not extend closer to the lot line that is the lot line that is creating the non

not made worse by the proposed expansion)
Staff Response: The building does not extend closer to the lot line that is the lot line that is creating the non-conforming
situation than the existing building and therefore complies with this standard. The additions to the property in question
impact the side yard setback. Since this lot is 110' w ide, the side yard setback is 25 ' . On the east side of the property, at its

7. The building addition does not extend into a setback the existing building does not currently encroach upon
rendering the proposed building non-conforming in a manner it was not previously, prior to the proposed
expansion
Staff Response: The building addition does not extend into a setback, the existing building does not currently encroach
upon rendering the proposed building non-conforming in a manner it was not previously and therefore complies with this
standard.
8. The building addition complies with all other dimensional standards that may apply
Staff Response: The building addition complies with all other dimensional standards that may apply and therefore complies
with this standard.
Pursuant to Section 170.1803(C)(3), in making its decision, the Plan Counnission shall consider the following factors in
addition to those factors listed in 170.443:
1. The size and location of the existing legal nonconforming building
2. The size and location of any other buildings on the subject property
3. The size and location of the proposed expansion
4. The necessity of constructing the addition within the setback
5. The proximity of buildings and other structures on ad,joining properties
170.443 Basis of Decision
A. The size of the property in comparison to other properties in the area.
Staff Response: The size of the parcel is 1.0-acre. The surrounding properties on North Shore Drive are also similarly
sized on the northside of the road, with some parcels being a touch over 1.0-acres with as large as a 2.0-acre parcel
immediately adjacent to it. On the southside of North Shore Drive, there are many homes that are on what would be
considered 'typical lake lots' for Bark Lake.
B. The extent to which the issuance of the special exception would be in keeping with the overall intent of this chapter;
Staff Response: The Rs-3, Single Family Residential District is one of the older residential zoning districts our Code has.
It is intended for lots that are smaller than 65,000sqft (1.5-acres) and is limited to only those parcels which were this zoning
designation when the Code was adopted. The intent was to create a Zoning District which allowed residential land uses
"within older, established areas of the Village where such uses are located on lots or parcels of land which are within
predominately residential areas, area smaller than 65,000sqft, and were lots of record on the date of the approval of this
chapter. Additionally, this provision in the Code was made as a policy decision of the Plan Commission to allow it to
consider these types of unique situations for redevelopment or expansion of existing commercial, industrial, or residential
structures.
C. Whether there are any unique circumstances and the nature of those circumstances that warrant the issuance of the
special exception;
Staff Response: This area of the Village of Richfield is one of the oldest inhabited parts of our community and was the
epicenter of our community's earliest residential and commercial roots, so much so that Bark Lake was actually the home
-of our community's first ambulance service ran by Dick and Marilyn Becker, who also live on the same street as the

VILLAGE OF RICHFIELD
PLAN COMMISSION COMMUNICATION FORM
MEETING DATE: May 7, 2026
SUBJECT: Rural Accessory Building Designation located at 1988 Scenic Road (TKN:
Vl0 023300A), - Tim Einwalter , Petitioner
DATE SUBMITTED: May 4, 2026
SUBMITTED BY: Brad Calder, Administrative Services Coordinator
POLICY QUESTIONS: DOES THE PLAN COMMISSION WISH TO RECOMMEND APPROVAL DESIGNATING STRUCTURES AT 1988
SCENIC ROAD AS " RURAL ACCESSORY STRUCTURES" TO THE VILLAGE BOARD?
ISSUE SUMl\llARY:
The applicant has been working with Staff to construct an addition
(totaling 816 sq. ft.) to the accessory structure (shed/garage) located
on the northeast comer of the property. When reviewing the
addition, the accessory structures on the parcel currently exceed the
maximum accessory building floor area allowed. The parcel is
located in the RS-2, Single-Family Residential District and is 2.99
acres in size. The maximum floor area for accessory structures is
one structure 192 sq. ft. or less and one structure 1,320 sq. ft or less
or one strncture that cannot exceed the total of both, which is 1,512,
sq. ft. Currently the parcel has 4,760 (4,360)sq. ft. of accessory
' structures To allow for the addition to the accessory structure, the
property owner has applied to designate the remaining accessory
structures as rural accessory structures.
Pursuant to Section 170.640 entitled "Purpose", states the
following,
"As more full y described in this division, the Plan
Commission is authorized to designate certain existing
accessory buildings as a "rural accessory building" in those
zoning districts listed in Appendix A. l1L If a building is so designated, it is not counted towards the allowable
number of accessory buildings permitted on a lot or towards the allowable building square footage permitted
on a lot. This division describes the procedures and requirements for a rural accessory building
determination."
The structures in question are located at 1988 Scenic Road, on the east side of Scenic Road just north of E. Cliffe Dr and
south of Pleasant Hill Road. The property consists of the single-family home and shed/garage , and the property owner is
petitioning for the following structures) to be considered rural accessory building, the barn and silo. Below is a breakdown
of the square footage of the structures on the property .
• Single Fami ly Home - 2,700 sq. ft. The original farmhouse built in 1843 that has been remodeled and added onto
over the years.
• Shed/Garage - 520 sq. ft. Was built in the 1970's and was originally located in the open space between the home
and the barn. It was moved to its current location in 2014.
• Barn - 3,650 sq. ft. the original north portion of the barn was built in 1886 and southern portion of the barn was
built in 1914.
• Silo - 150 sq. ft. located on the southeast comer of the barn.
• Carport - 400 sq. ft. On the east side of the parcel. Appears to be constructed after 2022 according to aerial photos.

(2) Effects of the building on surrounding properties;
Staff Response: The property is surrounding by similarly situated residential parcels, the parcel being bordered by Kettle
Side Court to the east and south. To the north, there are larger 'estate lots' that were created via CSM.
• Barn - The barn is visible from Scenic Road. Visibility from all other sides is minimal as vegetation blocks it from
the view of adjoining properties.
• Silo - The silo visibility is limited as it is the same height as the barn but with its location it is not visible from
Scenic Rd. Visibility from the adjoining properties is obstmcted by vegetation.
(3) The overall appearance of the building; and
Staff Response:
• Barn - The building is very traditional in appearance as the exterior is painted red, with the stone foundation
exposed and gray/silver metal roof. has The building appears to be in satisfactory condition, free of any blight or
nuisance conditions.
• Silo(s) (2) - The silo is concrete.
(4) Any other factor that relates to the process of this chapter as set forth in §170.305 or as allowed by state law.
Staff Response:
• Barn~N/A
• Silo-NIA
Section 170.643(C) requires that any building receiving rural accessory structure designation must be structurally sound.

barn and silo are not stmcturally sound.
