Discuss and Possible Action on Request by Clayton & Samuel Phillips for Rezoning of Parcel 151-2806-073-9981 from Agriculture (A) to Rural Residential (R-4) Administrator Cherek explained parcel 151-2806-073-9981 was never rezoned to the correct zone when it split from a larger parent parcel years ago. This was recently discovered when the landowners, Clayton and Samuel Phillips, had a survey done to potentially split the lot. According to Village Ordinance 13.5.14(3), the minimum lot area for an agricultural zoned parcel is 6 acres and the parcel in question is 4.5 acres. This rezoning from Agriculture (A) to Rural Residential (R-4) would put the parcel in accordance with the Village Ordinances. The Plan Commission approved rezoning of 151-2806-073-9981 at their meeting on July 23, 2025. MOTION – Approve Request from Clayton & Samuel Phillips for Rezoning of Parcel 151- 2806-073-9981 from Agricultural (A) to Rural Residential (R-4) Motion made by Paul second by Parlier. The modifications include a color change of the exterior paneling from a 2-tone gray to a solid dark gray, a downsize of approximately 15,000 square feet and a change in the roofline of Phase 1. Cherek confirmed modifications will not affect taxes paid to the Village. MOTION – Approve Proposed Modifications to the Development Plan by PJM Investments, LLC / Menzner Hardwoods Co. Motion made by Paul second by Ahrens. Motion passed by voice vote. d. Discussion on Use of Golf Carts Within the Village Limits – Moved to after Item 5b Village resident, Clint Oelhafen, appeared before the Board to discuss the possible use of golf carts on Village roads. Discussion included possibly amending the ATV Ordinance to include golf carts or creating a separate ordinance, possibility of requiring registration similar to what the Village of Spencer currently enforces, and what possible fees the Village would charge. The Board gave confirmation to Administrator Cherek to move forward with discussion with the Village of Spencer and Attorney Vanderwaal to determine the best course of action for the Village to allow golf carts on Village roads. Cassie Lang Village Clerk / Deputy Treasurer 9. The bond sale happened earlier on August 6 th. Three bids were received from BOK Financial Securities, Baird Financial and Northland Securities. BOK came in with the lowest bid at 3.7884%. BOK bid a premium bond bid which created a reoffering premium of about $310,000. Ehlers opted to use the reoffering premium to lower the principal amount due in the refunding portion of the bond issue, resulting in a lowering of the overall amount to bond from $5,485,000 to $5,180,000.
