Secretary: Kyle Noonan Zoning Committee – Public Hearing Floodplain Zoning Ordinance recreated, Gollon Dam and Meyer #3 Dam December 14, 2023 County Board Room Call Hearing to Order: Chairman James Gebauer called the public hearing to order at 9:00 AM. Members Present: James Gebauer, Myron Brooks, Sue Swiantek, Mike Bub, Rollie Thums Members Absent: None Other Attendees: Ryan Jarvis, DNR; Sarah Rafajko, DNR; Gary Zielske; Jason Belter, Tony & Rachel Yaron; Dan Gellert; Brian Wilson from Star News, Kyle Noonan, Sue Noland The purpose of the public hearing is to repeal and recreate Chapter 29, Floodplain Zoning Ordinance; for approval of the recently received FIRM maps from FEMA ; to approve dam failure analysis for the Gollon Dam located in the Town of Taft; and to approve dam failure analysis for the Meyer #3 Dam located in the Town of Rib Lake. Public notice was published in the local Star News on November 23 and 30 . The information was made available for public viewing in the Taylor County Zoning Department and on the county website. The ordinance revision is required to update references and to incorporate the updated FEMA maps from the current 1978 floodplain HUD maps. The Gollon Dam was built in 1966 on the Wolf River and contains approximately 45 acres with a structure height of 11’. The dam failure analysis was completed in 1995 , but the plan was never submitted to Taylor County for adoption into the Floodplain ordinance. There is just one property owner downstream. There was no contact from him. The dam has a low hazard rating due to lack of development below the dam. Also, the hydraulic shadow downstream of the dam would be roughly the same as if there were no dam. The Meyer #3 Dam was built in 1976 and contains approximately 30 acres with a structure height of 16’. The dam failed in 2016. Currently the dam has a high hazard rating. There are two property owners downstream but no residences /structures within the hydraulic shadow. The Zoning Administrator had talked with Mr. Krueger, one of the property owners. A dam failure analysi s was completed in October 2023 and the plan is to rebuild the dam structure to the same specs. Gary Zielske presented information from the 1997 Mondeaux Dam flood study that determined his property below the M ondeaux Dam is not in floodplain. The USFS had shot elevations indicating the cabin wo uld be out of the floodplain but part of the driveway would be in. Gary was asking the Committee if they approved the revised ordinance and new maps, that they make an exception for his “panel” to be sent back to FEMA for correction. It was determined the comment period for the draft map changes was a couple of years ago. The process to get a map change is to submit a LOMA (Letter of Map Amendment) to request a change. Normally this requires an engineer or registered land surveyor to determine elevation and have it submitted to FEMA. Mr. Zielske felt he shouldn’t have to incur that expense since it was determined already by USFS. The final decision was to have Zielske submit the current information from 1997 to FEMA for requesting a LOMA. If not successful, then there is a possibility to have the County S urveyor assist with shooting the elevation for Mr. Zielske. Tony & Rachel Yaron were also present. They have property at N3194 River Rd in the T own of Hammel. The new FIRMs show floodplain covering his e ntire parcel where the cabin is located except for a small portion. Mr. Yaron noted that he was looking for support of any way to beat FEMA. Also discussed flood insurance and what would happen if the county did not approve FIRMS. The DNR individuals present reported if the county doesn’t adopt the maps, they would continue using the current HUD maps and property owners might not have flood insurance available for t heir property. They also noted the Lending Institutions will receive the new maps and will use them. With no other questions, Chairman Gebauer closed the public hearing at 9:55 AM. Secretary: Kyle Noonan Zoning Committee November 15, 2023 County Board Room Call Meeting to Order: Chairman Jim Gebauer called the meeting to order at 9:00 AM. Swiantek moved to approve the statistics; Seconded by Bub. Motion carried. Light Detection and Ranging (LiDAR) project: LiDAR is used to create aerial mapping using radar to points on the ground to give detailed topography. The current mapping completed in 2016 is two points per square meter and the proposed flight in 2024 would be 8 points per square meter. The cost is $281,000 with a majority covered by USGS and NRCS bringing the cost down to $109,000 for Taylor County. The remaining proposed cost split among departments would be Land Information-$30,000, Zoning-$20,000, Forestry-$9000, with the balance coming from ARPA funds of approximately $50,000 which has to be allocated by December 2024. The Zoning Dept would use carry -over funds from Non -Metallic Mining and Uniform County Address System of $10,000 each. This mapping is a lot more accurate than what we currentl y have and will benefit more departments than just the contributing ones. Brooks moved to approve the Zoning portion for funding LiDAR; Seconded by Thums. Motion carried. Maintenance Status: Administrator reported approximately 642 septic tank maintenance notices were sent out this spring which were due for completion in August. A second notice was sent to those individuals who had not complied with a new due date of October 31. Currently we are only 2% non -compliance with 12 tanks which have not been serviced. These individuals will receive a citation next month if not completed. FEMA Floodplain Ordinance and dam analysis: In 2017 FEMA started updating floodplain maps which have not been updated since 1978. We have received the new maps and are required to update our current Floodplain Zoning ordinance within 6 months which requires a public hearing to be conducted. The revised ordinance will include two additional dam failure analysis for the Gollon Dam located in the Town of Taft and the W. Meyer #3 Dam located in the Town of Rib Lake. A question was asked how many habitable s tructures are impacted in floodplain on the revised maps. Administrator reported there are approximately 31 houses/cabins within floodplain on the new maps. It was requested that these property owners be notified of the effect to their properties and of the upcoming hearing. Administrator also reported Taylor County is the only county in the State not enrolled in the National Flood Insurance program. A resolution will be discussed in December as to whether or not to enroll in the NFI program. Any Other Business: Administrator reported we will receive a $5000 grant for the electronic collection in 2024 as the DNR has funds available. Next Committee Meeting: The next meeting of the Zoning Committee will be December 14 at 9:00 a.m. to conduct a public hearing for new floodplain ordinance and two new analyses; with Committee meeting to immediately follow.
