Our family would like to formally state our strong
opposition to the zoning item proposing to transform the
agricultural area into the 256‑unit residential
development known as Heyday Germantown.
We moved to Germantown only a few months ago,
specifically because this community still has land, space,
and a country‑like feel. It is not overdeveloped, and it
does not feel like living in a city — that is exactly why
families choose to live here. This proposal goes directly
against the character and values that make Germantown
what it is.
Express News posted about this proposal online on
August 27, and nearly every public comment expressed
opposition. Residents are clearly concerned, and we
urge the Village to listen. If decisions are made solely to
bring in revenue at the expense of Germantown’s
identity, families will leave. People live here for a reason,
and this development directly conflict with those
reasons.
We are deeply worried about losing agricultural land,
increased traffic, strain on schools, and many other
long‑term impacts. We ask the Village to reconsider this
proposal and protect the rural character that makes
Germantown special.
Thank you for your time and consideration.
Sincerely, Melissa & Dan Mulcahy

a planned development district zoning district near
Schoen Laufen Park which will be held before the
Village of Germantown Board on October 5, 2026.
We are against this for the following reasons:
-Extra traffic and congestion in that area and in
Germantown in general
-Increased safety concerns for my family and community
-Reduction in wildlife in the area
-Increase in citizens who do not have a vested interest in
Germantown because they are not purchasing a single
family home and may see this as a temporary residence
-The population density of that area of Germantown
would not be proportionate to the rest of Germantown
especially the immediate surrounding area

development. The west parcel is in an environmental
sensitive area and should not be impacted by
development. Know you are licking your chops, so to
speak, at the tax revenue. But I am asking you please to
look at the bigger picture and consider the community as
a whole when deciding "rental" developments. I feel you
are turning a blind eye and deaf ears to the many people
speaking out about this development. We matter more
than out of state developers, who farm out the ongoing
maintenance of the property. We matter more than the
people you hope to bring in on a revolving basis as
these are rentals are not owner occupied. Why is there
such a push to increase the population of Germantown.
You have Sutton Farms, You have Carillion. You were
proposing a huge 400 unit rental development for the
Village Center. Please tread carefully.. Once done you
can not undo these developments. Feel the focus should
be more on commercial, retail and manufacturing. I
know there is a need to fund the improvement to fire
station, a new police station as well as improving the lift
stations. All takes money. As a 48 year resident of
Germantown, I appreciate your trying to keep my
property taxes down. Honestly, I would rather pay a little
more in taxes to keep these rental units out of
Germantown. Make Germantown a place where people
want to buy a house, not rent. Encourage developers to
build smaller more affordable houses, condos, even
owner occupied row houses. I am counting on you to
keep Germantown a place where people want to own
home. Thank You.

That is a lot of water use and sewage from toilets,
showers, washing machines and dishwashers. Can the
system handle it? If not, what is the cost to the Village to
upgrade? What about traffic on Lilac Lane and Division?
Division is finally getting upgraded but will it be enough?
Will there be enough interest in those high priced units?
We are not Tosa. Looking at the situation through tax
dollar glasses and listening to the sales pitch from the
developer is not best for the future of the community and
the type of lifestyle that current residents want. Their
profit is their priority. We are here for an environment
that is a well thought out suburban look, not a crowded
one. Renters are not as committed to a community as
home-owners.

for review. That land should remain undeveloped
especially for a large apartment building site which is
proposed. This will most definitely negatively affect not
only the park & residents in the area but all Germantown
residents. We DO NOT NEED more apartment buildings
pushed onto us that takes away the natural beauty &
ecosystem of the area. There is also sewer/water to
consider as well. Please listen to us & DO NOT allow
this destruction to happen! We need as much “green”

Germantown and will cause taxes to increase. Anyone
saying residents will not see increases is lying. No one
wants Germantown to become like Menomonee Falls,
Cedarburg, Grafton, or Mequon. The fact this is getting
passed when many residents are complaining about it is
just wrong. People moved to Germantown for a reason,
we want to keep it smaller and do not want or need new,
overpriced developments taking over farmland. Listen to
the residents and stop Illinois developments from
making suburbs like Illinois. Why do you think everyone
is moving out of Illinois and to Wisconsin? I’d be livid if I
lived across the street from where this development was
taking place.

Comments I am against the proposed development of the Heyday
DRAFT
Project for a number of reasons.
1.) is the changing of “green space” to asphalt and
concrete.
2.) is the number of homes per acre of this development,
doesn’t correspond to the area’s homes per acre. 3.6
homes per acre for the development versus 1.25-2
homes per acre now.
3.) the lack of proper utilities for this project. Namely,
EMT’s, water and sewer facilities.
Especially the lack of sewer capacities for this area. As
proved by the issues of 2025 and 2026
flooding of my subdivision. And the Villages search for
more water, example was the test well drilled on this
property by Layne Northwest, and the test well drilled by
Badger Well Drilling on the northeast corner of Lannon
Rd. and Hwy Q. Both test wells failed.
4.) the Village boards desire for increase in tax revenue
over the quality of life. The example that I am referring to
is that the 256 homes with 4 people per home equates
to over 14 people per acre of land. This is not what this
area of the Village of Germantown has now. Which is
more like 4-5 persons per acre.

Utility Rate Adjustments
The Village of Germantown Village Administrator and Finance Director, in collaboration
with the Dept of Public Works, seeks approval for a 3% increase in water fees, using the
Public Service Commission simplified approach. In addition, we will implement a 3%
increase in sewer fees beginning January 1, 2027.
Water Utility
We are aware of the recent increase in water fees, and unfortunately, the Village is still
operating at a loss. The current rate of return is (4. 2%). The operating loss in 2024 was
$400,000 and the operating loss in 2025 was $870,000. Within a 25 mile radius, the Village
of Germantown is still well below the median cost of water bill.
In addition, the guidance for Days Cash on Hand should exceed the billing period, 90 days
for the Village of Germantown. Our Days Cash on Hand is currently 30.
Operating revenue should at least be enough to cover the cost of operations and
depreciation, a ratio of 1.0. Our current Operating Ratio is .90.
It is not in the best interest of the Village to wait until a Conventional Rate Case is again
necessary before increasing rates. The rate case takes about 6-10 months to complete and
is very expensive, with those costs calculated into the new rate for recovery. Using the 3%
Simplified Rate increase approach is our best course of action to begin moving toward a
position of financial stability and increasing our cash on hand.
The average increase will be $8.76 per household per year.
Sanitary Sewer Utility
The Village maintains 110 miles of sewer main, with 5,943 customers. The village contracts
with MMSD for treatment and their annual charge is the largest expense, accounting for
67.8% of the operating expenses. The 2025 operating loss was $770,000, compared to
$540,000 in 2024. Total net position decreased by $170,000, and the rate of return is
(1.24%). The last rate increase was in 2024 and was insufficient in covering the rising
costs.
A 3% increase to both fixed and usage fees will be an average of $12.06 per household per
year.
We appreciate your consideration of this request as we look to improve the financial health
of the Village, with minimal impact to its residents.

PLACEMENT: Action Item
ITEM TITLE: Three percent sewer rate increase and update the 10-year cash
flow and rate projections. (ACTION)
SUBMITTED BY: Lisa Davis, Finance Director
SUMMARY EXPLANATION:
The Sewer Utility’s last rate increase was in 2024. The Utility is still operating at a loss
due to the rising cost of treatment and capital attributed to the MMSD. The
recommendation is for a 3% rate increase on both volumetric and fixed to go into effect
Q1 of 2027. Impact on average would be $3.02 per quarter or $12.06 per year for an
average household. Rate increase would improve cash flow, and excesses would build
reserves in anticipation of significant future capital expenditures.

contingency up to the full amount remaining in budget not to
exceed $28,200.00 for 2026 Library HVAC Control Project.
(ACTION)
SUBMITTED BY: Scott Anderson, Superintendent
SUMMARY EXPLANATION:
In 2025 $16,000.00 was budgeted to complete an HVAC controls system update at the
library. This project was not completed in 2025 and these funds were carried into 2026.
In 2026 $20,000.00 was budgeted for the library gutter seam sealing project. You may
recall that the gutter project came in favorably. Between both projects, the library major
repair line item currently has $28,200.00 remaining.
This request is the first project in a phased approach to replace HVAC controls
systems, which are all generally original to the building. The aged system is no longer
able to communicate critical information to staff. This lack of communication could
result in significant system damage, especially during cold weather months.
Currently, the system in place is proprietary to Johnson Controls. If approved, this
project will utilize an open platform system, which can be maintained by any qualified
contractor. The proposed equipment is the same system used at public works, and
presumably would be utilized at any future campuses constructed or renovated. This
will allow maintenance staff and contractors the ability to access more facilities from a
single platform. While the original funding is adequate to complete the first phase of the
project, staff could utilize the remaining gutter funds to complete additional work, which
will eventually reduce future requests. If approved, this project will complete installation
of a new front end, new boiler plant controller and fully integrate the existing equipment
into the new platform.
Staff solicited pricing from several area contractors and the pricing is listed below for
review.

PLACEMENT: Action Item
ITEM TITLE: Consideration of a Change Order with Foth for Continuing Property
Records not to exceed $35,000.00. (ACTION)
SUBMITTED BY: Paul Haugen, Water Superintendent
SUMMARY EXPLANATION:
In 2001, the Village of Germantown Water Utility reclassified from a Class C utility to a
Class AB utility. Class AB utilities are required to institute a perpetual inventory of their
assets known as continuing property records pursuant to Wis. Admin. Code § PSC
185.43(2). The Public Service Commission of Wisconsin determined that the Utility had
not fully developed its CPR and required the Utility to meet all requirements within 24
months of the Final Decision, dated October 4, 2021. The Utility was also required to
report to the Commission in writing regarding its progress toward completion of the
CPR within three months of the Final Decision and every six months thereafter.
The Water Utility hired Foth in June of 2026 in the amount of $15,000.00. After the
initial investigation and data collection, the undertaking is greater than originally
anticipated. We are working towards our PSC extension date for completion of the work
by July 31st, 2027.
For reference, the CPR must include the following:
• Include records for locational assets and mass unit assets;
• Identify and describe each locational asset;
• Show the total construction cost of the asset, the date of construction, and a
breakdown of the locational asset into appropriate USOA categories.
• Provide a summary of the mass units broken down by unit type (i.e. water
mains, valves, hydrants, service, meters, etc.) and list the mass units by
size, date of installation, and construction cost;
• Distinguish Contributed Plant from Utility Financed Plant; and
• Integrate Utility’s mapping records into the CPR.
The Village will work with Foth to identify and update missing PSC-related data in the
GIS system after the data review is complete. This work includes the following:
• Missing data will be gathered from Utility mapping records and Germantown staff
knowledge.
• Missing data updates will be compiled by Foth on a time-and-materials basis, or
Foth will assist Germantown as requested.
• Foth will evaluate PSC data management options for the Village of Germantown.
• Management options and the associated level of effort may vary depending on
the results of the data review.
• Options and varying levels of effort will be reviewed in detail with Germantown
after the data review is complete.

BUSINESS OF THE VILLAGE BOARD
MEETING DATE: October 19, 2026
PLACEMENT: Action Item
ITEM TITLE: Consideration of Quote with MACORP to paint the Outdoor Picnic
Shelter at Firemens Park not to exceed $24,069.00.
(ACTION) Item previously approved at PW&HC 10/07/2026
SUBMITTED BY: Gil Standridge, Park & Rec Director
SUMMARY EXPLANATION:
I wish to protect the wood trusses and purlins underneath the Outdoor Picnic Shelter
roof at Firemen Park with Woodscapes solid color stain. The wood has not been
painted or stained since the shelter was constructed over 20 years ago. I wish to extend
the life of the shelter for several more years.
I am requesting to apply two coats of Shermin Williams Bond-Plex Water based Acrylic
Coating to the tin roof on the outside of the shelter. This will also extend the life of that
roof; it will improve the aesthetics of the building itself.
This project should extend the life of the shelter and save the village money from
having to do major repairs or replace the shelter.
I received three quotes from different paint companies. All three companies quoted
painting the purlins and trusses underneath the roof as well as the steel ceiling top of
the roof. Service Painting Corporation was the highest at $48,000. Two-Day Paint
quoted $23,1000, and MAPCORP quoted $24,069.
I request that this committee approve MACORP to do this project. Public Works has
used MACORP for several projects and commend their work as excellent. MACORP
has done several industrial projects whereas Two-Day Painting has more experience
painting residential homes.
Funds for this project are budgeted in account 40591000-592300- Capital Building
Improvement.

Hi Daisy,
There needs to be a state project ID set up since WisDOT will be reimbursing the costs
outlined in the SMFA. Hence, the language stating WisDOT will initiate the project
authorization. Germantown can proceed with a locally let project and will front the
construction costs. 90% will be reimbursed by completing the DT1713 form
(Reimbursement Request programs using local let contract process).
Related to the language about costs incurred to the state:
WisDOT is incurring costs (i.e. setting aside funds that must be used) for the project, so if
the project doesn’t end up being built, Germantown would be liable for any design costs
that had been previously reimbursed.
Germantown is not in jeopardy of forfeiting their cost share arrangement. If construction
costs exceed $614,000, Germantown will not be reimbursed for the additional costs.
Thanks,
Andy

Washington County Shared Services Grant Program
for Countywide Fire/Emergency Medical Services
(EMS)
What the Program Is
This is a county grant and shared-services funding program designed to supplement
municipal Fire/EMS operations and Fire/EMS-related administrative and oversight costs.
The program leverages multiple revenue sources: a County levy authorized under Wis.
Stat. § 59.51, the County levy authorized for EMS under Wis. Stat. §66.0602(3)(e)6., and
the already implemented County sales tax under Wis. Stat. §77.70. Washington County
will exercise its levy authority in accordance with these authorities and will combine that
revenue with so that the program is net neutral in levy impact to the County’s overall tax
levy. Funding remains subject to annual County Board appropriation. The program is
structured to support local EMS readiness, response, governance, and accountability
through defined performance expectations and reporting.
What the Program Is Not
This program does not create or operate a countywide EMS system under Wis. Stat.
ch. 256 or Wis. Stat. § 256.12. Municipal EMS agencies remain locally owned, operated,
and managed. The program is not a mechanism to shift municipal EMS operations to
County control, and it is not intended to increase the County’s overall levy burden;
County levy authority will be exercised and offset with sales tax resources to maintain net
neutrality in levy impact.
Legal Authority and Framework
Wisconsin law authorizes the County to establish and fund this shared-services grant
program and authorizes municipalities to request County assistance.
1) County authority to act by resolution. The County Board may establish the program
by resolution. See Wis. Stat. § 59.03(2)(b).
2) Municipal request and County administration upon request. A municipality may
request by resolution that the County assume or exercise an administrative function
related to Fire/EMS support. Upon municipal request, the County may provide
administrative and related support. See Wis. Stat. § 59.03(2)(a). The resolution must be
passed by a majority of the members-elect of the governing body and specify the terms
upon which the powers shall be exercised, state whether the authority is to be exercised
exclusively by the County or jointly and find that the exercise of such power by the
County would be in the public interest. The County will next pass a resolution by a
majority of members-elect to assume the exercise of the function.
3) Levy authority for Fire/EMS and budget framework. The County will exercise its
authority to levy under Wis. Stat. § 59.51, and Wis. Stat. §66.0602(3)(e)6., . Revenue
generated under this authority will be combined with revenue from the already
Page 88 of 92
2
implemented County sales tax to fund the program in a manner that is net neutral in
impact to the County’s overall tax rate, with all appropriations subject to annual County
Board approval. County sales tax will be used to lower the otherwise needed additional
tax levy.
4) General County authority and public safety powers. The County’s general
corporate powers and public safety authority support this grant and shared-services
approach. See Wis. Stat. §§ 59.51 and 59.54.
Procedural Next Steps
County Action
The County Board will adopt a resolution under Wis. Stat. § 59.03(2)(b) creating the
program, defining eligibility, performance expectations, reporting requirements, and
confirming that all funding is subject to annual appropriation. The resolution will also
confirm the County’s exercise of levy authority under Wis. Stat. 70.62, Wis. Stat. §
66.0602(3)(e)6, and the budgetary approach to combine that revenue with sales tax
proceeds to maintain net neutrality in tax rate impact.
Municipal Action to Participate
Each municipality wishing to participate must adopt a resolution by November 7, 2026,
requesting assistance under Wis. Stat. § 59.03(2)(a). A model resolution will be provided
by the County and will, at a high level:
1) Formally request participation and County assistance for Fire/EMS and Fire/EMS-
related administrative/oversight support.
2) Acknowledge the program’s performance metrics and reporting requirements.
3) Agree that funding is subject to annual appropriation and may be adjusted.
4) Designate a municipal contact responsible for coordination and reporting.
County Follow-Up
After receiving municipal resolutions, the County Board will pass a resolution accepting
the participation request and approve awards and terms. The County will then enter into a
grant agreement and/or an intergovernmental cooperation agreement, as appropriate,
under Wis. Stat. § 66.0301.
Administration After Approval
Following award approval, municipalities should expect:
1) Agreement execution outlining scope, eligible costs, performance metrics, reporting
cadence, and term.
2) Regular reporting on performance and expenditures, with documentation of eligible
costs.
3) Payment mechanics defined in the agreement, including timing, method, and any draw
or reimbursement procedures.
4) Annual review and renewal considerations tied to performance, compliance, and
County budget appropriation.
